To whom it may concern, I XXXX XXXX started services with XXXX XXXX XXXX XXXX. As of today, I was in 100 % debt. They, as of XX/XX/XXXX reduced my debt to 83 %. The only problem I am having now is with Diaz & Associates. When I started with XXXX, Diaz & Associates were no where in the picture. The account in question-XXXX XXXX. For some reason, they sold the account to Diaz & Associates. The account was at {$9700.00} which was sold to Diaz & Associates and they, in turn has the account be owed as {$10.00}, XXXX. I was told by XXXX account representatives to have all of my creditors to call them about any payments I owe. I was called by someone by the name of XXXX from Diaz & Associates LLC about it being imperative that I get in-contact with them ASAP! I called the number and spoke with him. I told him about the services I had inquired with the XXXX to handle and my finances when it comes to paying creditors I owe, that I could no longer afford to pay due to financial hardship from my on-call job. During the months of XXXX and XXXX, I had telephone calls left on my voicemail from Mr. XXXX from Diaz & Associates. It was he that told me that if we do not here from you as soon as possible, that we are going to have to reach out to your employer to collect this debt. I got scared and called XXXX to let them know what had transpired and they told me to make note of the number of telephone calls received/left. He only left two a day. Last month, I talked to someone from XXXX XXXX XXXX and she told me to reach out to you-CRFA. She told me that she looked at my credit report and it is listed as a chargeoff/collection. She explained it to me and I understood somewhat, but why is they looking for me to pay the full amount when the account was charged off. What one of the lenders shared with me was to contact you and to also contact Diaz & Associates to see what I can do to work on making payments because the negativity that they report is hurting my credit score. I called on e of Diaz & Associates legal representatives and he expressed to me that I make three {$100.00} a month payments fro three-months, then we can disgust making payments plan. He also stated to me that if I make steady and ongoing payments that he can reduce the balance owed. he even stated that he would be able to remove the derogatory reports of the delinquent payments. For some reason, I feel like he is not being truthful because I thought negative information stays on your credit report for 7-years. My son lost his job XXXX and working another job out of XXXX Washington. In the month of XXXX, his truck went out and in XXXX, his engine went out. My son had to borrow money from a family member to get his trailer fix. His truck is in storage in XXXX, CA. I had to pay his life insurance from XXXX, to XXXX, XXXX. Again, I need to know what can I do to help correct my chargeoff/collection account with Diaz & Associates LLC. As of today, I am trying to correct and clean up my credit report, but when I have a creditor like Diaz & Associates LLC reporting my payment as late every month because I have not made a payment, what more is there to do? Again, please let me know what can I do to make matters right with Diaz & Associates LLC? I know they are lawyers and know the system of fair credit reporting more than I. But, I know CRFA-governs the fairness of how and what creditors can/ can not do or use tactics to get consumers to comply when it comes to making monthly payments to his/her or their account. When Diaz & Associates LLC told me that the next step that they were going to do was going to be to get the money from me by taking me to court. At first, Mr. XXXX said they were going to reach out to my employer. I can not afford to lose my job or having a substantial amount of money withdrawn or taken from my account based on a lien. Please help me with this matter and what ever decision that the CRFA decides, I will be in agreement. If I need to make payments to Diaz & Associates LLC, I can do at a bear minimum. If so, I can work out a payment agreement with them. I am in a hardship situation as of XX/XX/XXXX. My ex-husband is in a legal court litigation and funds in my household are limited. I filed a complaint with XXXX through the XXXX website and received confirmation that the complaint had been accepted. Upon contacting XXXX directly, they advised that I would not be allowed access to my credit report for 30-45 days pending the investigation of the dispute. Additionally, because I had not verified information through their website, I would not be able to obtain status of this dispute until after it was resolved, again back to 30-45 days. Of course, none of these warnings were given to me prior to filing the dispute. Despite accepting the dispute from XXXX, they would not take additional disputes from me until the original dispute single item was resolved which could take 30-45 days thought there are multiple inaccuracies on my credit report, which they still provide to 3rd parties. The entire complaint starts information being reported to the credit bureau as the result of a XXXX XXXX XXXXDiaz and Associate Loan which was included in a XX/XX/17 settlement with the State of Oklahoma in which the debt was to be forgiven and negative information removed from the credit bureaus. Despite this and numerous settlements in multiple states and federal courts regarding these loans, all three credit bureaus continue to perpetuate the fraud by allowing collection agencies to report this information. As a consumer who has already been the victim of predatory lending as deemed by several Attorneys General and Federal Court Action, I now fight a system in which collections agency information is accepted as fact, with no due diligence on the accuracy or legality of the information by the bureaus who report it or the collection agencies who own it. The collection agency in question Diaz and Associate, obtained the debt 6 months after the settlement and despite easily accessible public information regarding the settlements, still tries to collect it, even today when I was calling to find out why it had not been removed. Meanwhile, the credit reporting agencies take no responsibility for the legality or accuracy of the information being given to them. The collections agencies take no responsibility for knowing anything about the debt the buy en masse and there are no consequence and its up to individual consumers to do all the leg work. It feels that the entire systems is set up as a FRAUD against consumers. Guilty until you prove yourself innocent. All the while, new processes are put in place to protect these agencies and allow them to perpetuate information the factual inaccurate information on lengthy times that are not acceptable in the digital age. All parties seem to have and excuse not to do anything, while consumers are denied credit or fight lengthy battles on artificial timelines through convoluted process just to correct information that should be there to begin with. Frankly, I could commit a crime and the constitution protects me from double jeopardy yet we routinely allow credit reporting agencies to impose double jeopardy in Charge Off accounts with subsequent collections accounts ( sometimes in multiples ) as the debt is sold and resold. While I am not a Constitutional Lawyer, our founding fathers probably didn't foresee our digitally enabled world, they were onto something with the Fifth Amendment. We allow this credit reporting oligopoly to collude solely for their own benefit with no consequences. Yet we wonder why Americans question if the system is rigged against them - it is! Believe it or not, there is even more to the story. I give up!!!

In XXXX I owned a one person, one XXXX company and a XXXX business. Business was good and so was my credit. In late XXXX XXXX work started slowing down and so did my XXXX that are workforce occupied. In XXXX things got worse and then worse yet on XXXX and XXXX. Because of my good credit I had several credit cards with high limits, thinking the slowdown was temporary, my credit card balances got higher and higher until they were shut off and not being able to pay were defaulted. In XXXX work started to pick back up and I began settling accounts until I had paid off or settled every account that had contacted me. In XXXX I had partnered with some people to buy some vacant land and was elected XXXX XXXX XXXX, " XXXX XXXX XXXX. '' The bank that the company had an account with sent a " sign and use '' credit card that was also defaulted in early XXXX because the window of opportunity for the development of XXXX had closed on the owners. I lost {$32000.00} in the vacant land deal. In XXXX of XXXX I received a call from a person who said he represented a collection agency that had purchased a bundle of old accounts and realized that the one for XXXX was about to pass the statutory limit for prosecution. He stated that because it was so close a law suit would be filed the next morning, but that he had convinced the company to allow him to reach out to me to try to settle the account. He stated that with a signed agreement he would be able to work out an agreement that included deep discounts to the total balance. I asked for time to consider this but he stated that he was leaving the office in ten minutes and the suit could only be stopped if I signed and faxed an agreement that he had e-mailed me. Because I did not want a suit filed against me I signed the agreement and faxed it back. Almost immediately I began to suspect I had been conned. With just a little research I determined that this account had been in default for almost 6 years. The law in FL requires a legal attempt to collect on this kind of contract within 5 years. I did not make any payments required by the agreement that I signed because I was lied to. In XXXX XXXX I was filed on and responded to the court with the the above information. In XXXX XXXX there was a hearing and because I had not answered the suit in affidavit form, it was if I had provided no answer at all. The judge stated that she felt she should continue this case to allow the correct format but the plaintiff 's attorney argued vociferously that his client deserved a judgement. The judge informed that I should have been more careful, that I should appeal this ruling and then gave the plaintiff a summary judgement. I contacted an attorney to appeal this judgement and his bill is already up to {$6000.00}. In the suit the plaintiff states he bought a group of accounts, that this was XXXX of, with " with no knowledge of their validity. '' I was lied and conned and then sued based on the lie and because of not responding in affidavit form now have a judgement against me and have had checking accounts garnished.

I 'm contacting you, asking for an investigation of Diaz & Associates , Inc. located at XXXX XXXX XXXX XXXX XXXX XXXX in XXXX California XXXX.Because of my on-going Identity theft, I enrolled in an Identity theft monitoring service XXXX XXXX. On XXXX XXXX, XXXX my service notified me that a Major Derogatory mark, new account was opened and an address change took place on all XXXX of my credit reports, reporting by Diaz & Associates , Inc . I pulled all XXXX reports finding the new account was XXXX XXXX, XXXX to this notification, I never knew Diaz & Associates existed . Diaz & Associates, Inc. did not contact me by mail or any calls from their office, not providing me notice of debt. I found numerous errors on my credit reports caused by the data Diaz & Associates , Inc. is reporting to the credit bureaus. After consulting with a debt collection attorney, I demanded Diaz & Associates provide validation of the debt they was incorrectly reporting on my credit report. I wrote Diaz & Associates , Inc. by certified mail asking for full validation of the account and putting Diaz & Associates , Inc. on notice regarding all the reporting errors on my credit report. Diaz & Associates, Inc. replied by advising me how well versed Diaz & Associates , Inc. is with state and local laws and the FDCPA. In the same letter they tried to explain why they made so many errors on my credit reports. Diaz & Associates , Inc. also included an illegible copy of a customer agreement and disclosure statement dated XXXX XXXX, XXXX from XXXX XXXX stating that the customer agreement and disclosure statement authorize them to collect the non-validated debt on my credit reports. XXXX XXXX, XXXX I replied to Diaz & Associates by certified mail that I dispute any and all of their claim of the debt they were reporting. In the same letter I advised Diaz & Associates, Inc., that they violated my FDCPA rights under sections 809,812 and 807. XXXX XXXX, XXXX I was advised by the United States Post Office that the business was closed. USPS tried to deliver the certified letter for a second time again reporting the office was still closed ; leaving notification that the letter was waiting for pickup or reschedule. After a fifteen day holding period the certified letter has been returned to me unclaimed. How can Diaz & Associates, Inc. still be reporting this debt on my credit report if the office is closed? I 'm asking for resolution that Diaz & Associates , Inc. removes any and all reporting to my credit reports. I find their business practices be deceptive and should not be allowed to continue reporting the debt they have failed to notify me of or validate.

Diaz & Associates writes in a letter that I have a debt of {$7400.00} from " XXXX XXXX XXXX XXXX ( ) '' and they're offering me " an opportunity to resolve this account in full for the balance of {$2600.00}. '' I checked my credit report, and no such bank name appears on my credit report. I looked up the bank to see if it was legit, and XXXX XXXX was acquired by XXXX XXXX XXXX in XXXX and renamed the next year. It's late XXXX, so that means XXXX stopped issuing credit cards over 15 years ago. In the whole ten years of my credit history, this credit card didn't even exist. In California, a debt collector has to inform a consumer if a debt is time-barred. The collector must include the notice in the first written communication sent to the consumer after the statute of limitations passes. Clearly, if it's not even in my credit report, it's been way over the 4-year statute of limitations for written contracts in California. It's all very fishy, like they've purposely picked a bank that doesn't exist so the consumer can't call in and ask questions to verify the alleged debt. I think this company is trying to extort money out of me. Is Diaz & Associates a scam? According to the XXXX XXXX XXXX website, Diaz & Associates has had 63 complaints closed in last 3 years. The many many other claims appear to still be open. One guy who got the same letter as me wrote that " my credit report clearly shows I have never had any business with any firm by that name or in any similar amount. This " attempt to collect a debt '' is CLEARLY a phishing scam, CLEARLY illegal and I want them to cease immediately, release me from all claims and liabilities pertaining to this unsubstantiated debt collection account, and to send notice to any credit agency affected that this account ( File # ****** ) is fraudulent and without support documentation. There are many other websites that tell horror stories about this company I can not believe they are still in business. But they are, and Im guessing their tactics work to scare the vulnerable into falling for their scam, and that they're making tons of money by targeting seniors like me! For over 9 years now Diaz and Associates in XXXX Ca. has continued to insist that I owe monies from unsecured credit card debt that is clearly time-barred and in violation of FDCPA, FCRA, California civil code 337 and other various federal laws pertaining to debt collection and protection of the consumer. As a result, I have had court issues and financial hardships from this company that engages in predatory collection practices and deceit to gain financially I have reached out to them over the years to show me the proof of the original debt, to which they have not. I have demanded that they do not contact me, to which they do. They attempt to use trickery in order to renew the debt to which I dont, but yet they continue as they know full well that the stated debt in attached to my name is uncollectable. Diaz and Associates, then recruited a law firm under false pretenses in order to collect this debt. They are a fraudulent company that ignores fair and legal collection practices, the law and, case law to in rich themselves. They use harassing tactics to pressure the consumer and uses unethical practices in order to pray on uneducated, ill-informed consumers. As a result, I have filed a complaint with the state Attorney Generals Office, as well as Consumer Financial Protection Bureau. As I read the multitude of complaints on file, they will respond that they know the stated laws above but yet they continue. This needs to stop immediately and the XXXX needs to respond to their ongoing hostile practices.

In XX/XX/2023 I reviewed a copy of my credit report and noticed an account from this company that i do not recognize. They are alleging i owe them money but yet have not provided me with any type of proof that this debt actually belongs to me, there is absolutely no contract between me and this company. In addition they are reporting to my consumer report without my authorization, and this erroneous account is affecting my credit worthiness and ability to obtain a home loan. I am devastated because I need to be able to purchase a home so that my ill elderly mother can move in with me, I am the only person she has left. This company has not proven this debt belongs to me which is a direct violation of the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b }. They are defaming my character and violating 15 U.S. Code 1692d - Harassment or abuse : A debt collector may not engage in any conduct the natural consequence of which is to harass, oppress, or abuse any person in connection with the collection of a debt. You are harming my reputation with the alleged debt. Also 15 U.S. Code 1692j - Furnishing certain deceptive forms. Because of these violation i reserve the right to pursue legal action as outlined in 15 U.S. Code 1692k - Civil liability. I do not recognize this account and believe this to be an error, this company needs to remove from my credit report or provide me with proper validation as outlined in the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b }.

On XX/XX/XXXX I was informed that the mentioned business called my place of work and a message was taken. I then called the company and a XXXX answered and verified my information. I asked what this was in reference too. He then advised that it was in regards to a account in collections that his office received today. I inquired to what account and for what amount was in collections. He advised me that it was for a XXXX Account from XX/XX/XXXX for an amount of {$990.00}. He also advised me that they were trying to get in contact with my local police department to serve me with a summons to appear in court. He gave me the information and gave me two payment options. I then paused while I was looking up the business on XXXX. He kept asking me if I wanted to take care of this and I told him to hold on for a second. I did this 3-4 times. He got angry and advised me since I would not take care of this today he was going to put it onto my credit history. He then got even more mad and told me he did not want to talk to me anymore and not to call him. He then hung up on me. I was never given a debt collection statement. I also asked him to verify the debt and he refused. He stated that they sent something out in XX/XX/XXXX for a account that was given to there office today. I then called the company back and spoke with XXXX again. I told him I think we got disconnected and he said he hung up on me and that he doesn't want to talk to me anymore.

My father received a call from Diaz and Associates for me and gave me the message. I called the number back and spoke to a woman who was very nice. She then put her supervisor XXXX on the phone. He was the total opposite. When I told him that I would not pay the bill because I did n't believe it was mine he became very rude. He started harassing me. I told him he was being harrassing. Having worked at a collection agency I know the laws. He then said that I must not have been very good since I was not working there anymore when in reality I moved out of state and im still in collections. He continued to be very rude and insulting. The mini Miranda was not provided by either him nor the first woman. I was not told my call was being recorded. When I told him to stop calling my dad 's he said the number was removed. When I asked what number, he refused to give it to me. I did tell him not to call my phone either as it is a cell and once I tell him not to he ca n't. He then told me that I 'm harassing him by not hanging up the phone. I told him I wanted to know what numbers were being removed and he again refused to tell me. He then continued to make comments to try and degrade me. I let him know that by doing what he 's doing he is still breaking the law. He finally gave me the numbers that were being removed and the call ended. This whole call was a violation.

XX/XX/XXXX, I received an alert on my credit report of a collection company, when I view my credit this company DIAZ & Associates have placed a payday collections in the amount of {$800.00} from some company named XXXX. Monday, XX/XX/XXXX I received a letter in my mail from DIAZ & Associates, acct # XXXX-XXXX, file # XXXX stating that I owe a payday loan to which I know I never did. So attempted to call this company at XXXX-XXXX-XXXX to ask information about this letter, the person transferred me to the manager XXXX. I asked him what was this and when was this acct generated. XXXX gave me the date of XX/XX/XXXX and I asked him did he have paper work with my signature, copy of my id, of how was this acct generated. XXXX told me he didn't have that information and could not give me the facts of how this acct was opened. But I told him that DIAZ & Associates was the ones that put it on my credit and XXXX said yes they did. XXXX stated that he would give me the number to this XXXX but then said he didn't have it but got really bothered when he felted as if I was being rude. But I told him I have a police report from being an Idenity theft person, he said it was to old. I stated how would you put things on peoples credit and not have all the correct information they are needing. I used a curse word and hung up on him.

The supposed company Diaz and Associates sent me a letter dated XX/XX/XXXX stating that I owe a debt of {$1000.00} but are willing to settle for {$190.00} If I paid by XX/XX/XXXX. They offered for me to pay by XXXX XXXX to get it there quick enough. The letter states the original creditor as XXXX XXXX. bank. I contacted that bank and they have no records of me having an account there. I called the debt collection company phone number on the letter and got a very unprofessional person on the other line asking for my social security number. I told the representative that I had no knowledge of XXXX bank or an account I have ever had with them. The guy confirmed my name and email address and told me that XXXX is going to take action against me in court. He stated the debt from XXXX but Kansas law states the statue of limitations would not allow the debt to be sued on. I told the guy I had no knowledge of the debt again and would be sending a dispute letter. and he said I will be sued an hung up on me. The letter I received gave me no offer or knowledge to dispute the debt within 30 days of I believe it to be a mistake which is required by law. Nor was that mentioned on the phone. This seems to be a fraudulent situation. This debt has never been reflected on my credit report. This seems to be scammers.

Diaz and associates contacted my place of employment without ever notifying me by mail or my private number on XX/XX/31 and XXXX. Theyve called there several times. When I called on XXXX to verify why they was calling for an unknown debt and asked why I was being harassed at my employer I was transferred to a manager ( XXXX XXXX ). He became angry on the phone and threatening that I need to pay debt of {$3200.00}. I then called the payday loan and it was accurate I owed a debt but my debt was given to XXXX XXXX. I called them there and my account is still open with them, not Diaz and associates and my amount asked is actually {$2300.00} per XXXX XXXX. Another person called me from Diaz and associates and again tried to say I owed this debt, wanted me to give him my current address and other information and demanding i pay them. When I said I was filing a complaint and calling my attorney general he became angry and was saying I owed this debt and needed to pay. I explained several times Ive spoke with XXXX XXXX XXXX and I will be going through XXXX XXXX the debt collection XXXX XXXX XXXX sent my debt to. I tried to tell him to stop calling my employer and he hung up. I called back because he would not let me get the words out and kept hanging up on me so I could not state not to call anymore.

This company was contact months ago and so were all 3 credit bureaus. The account in collections was opened fraudulently back in XX/XX/XXXX and this company is purposely reporting this debt as if it was opened in XXXX. This company bought a debt that is 11 years old, repackaged and falsified dates on it to appear as if the debt is brand new, and listed it on my credit report as brand new debt. No original documents were provided to the dispute through XXXX as to the age of this debt. I have never been contacted by Diaz and Associates regarding this 11 year old debt. The name listed on the debt is a name I havent legally had in 9 years, which was my legal name in XXXX when this loan was originated. My last name changed in XXXX, XXXX. That piece of evidence alone would give any reasonable person information to show that, as of XXXX, this debt is too old, and falls outside the statute of limitations for collecting and reporting. Looking at research, there are several instances from other consumers stating the same, that Diaz and Associates buy old, uncollectible debt, fraudulently change dates listed in the account, and attempt to collect on debt which is outside of the statues listed by the Fair Credit Reporting Act of 1970. This is a clear violation of the Fair Debt Collection Practices Act of 1977, and should be addressed appropriately. My next step is to take appropriate legal action against Diaz and Associates and their owner through my lawyer.

I am the recent victim of potential identity theft so I recieve alerts to my phone whenever there is a change to my credit report. I recieved a notification from Diaz and Associates that I owed {$780.00} from XXXX XXXX from XX/XX/XXXX. I promptly called Diaz and Associates because I had no recollection of the debt. The representative I spoke too immediately tried to get me to " settle '' the debt even-though when verifying my address they had me listed in XXXX not XXXX where I have resided for the last four years. When I disputed the debt and asked for it to be verified I was transferred to another gentlemen who wanted to argue with me and refused to verify the debt. He then claims a notice was sent out to me and that he could email me a verification of the debt on the spot, which I know is not appropriate because I would think he would be able to verify all of that with the original debtor. When I advised him that I will not be paying today and I would be filing a complaint, he responded, " I don't care file your complaint ''. In XXXX, I reported a fraudulent account on my credit profile from XXXX XXXX that was opened in XX/XX/XXXX. I do not have and have not ever had an account with this company. I contacted all three major credit bureaus, provided them with the correct information including the fact that I did not live in the state where this account was created, nor was that my last time. The account was removed from my credit report in XXXX. However, now another collection company by the name of Diaz & Associates has re-inserted this information on my credit report. I have disputed this with the credit bureaus and this company and the credit bureaus continue to state this information is valid. It can not be valid when it was previously removed my report as fraud. Diaz & Associates sent me a computer generated lease agreement with an ELECTRONIC signature that is not mine, this can not be used as a means to determine the validity of the debt. It is extremely egregious that a credit bureau would allow a collection agency to add information that has been removed previously.

Again another debt collector Diaz & Associates has sent me a letter trying to collect a debt I already paid. In 2005 I paid an outstanding debt to XXXX XXXX and received a letter from the court saying my debt was fully paid. I have attached a copy of that letter from the court. Even though the debt has been paid I still receive harassing phone calls and letters from collection agencies. I have attached a letter sent to me from Diaz & Associates. I have tried through phone calls and letters that the debt has been paid, and made them aware of the letter I have received from the court stating the debt has been paid. They have even called my friends and family asking where I am and told them I owe money. Also they have threatened further legal action even jail. Ok so back in XXXX my identity was stolen when I lived in va. I made a police report. Let credit bureaus know what happened. I thought that fixed anything that would arise. I received a letter from Diaz & Associates dated XXXX requesting payment on a debt supposedly from original creditor XXXX in the amount of {$690.00}. I called the company and explained to them I had no knowledge of the account. Diaz and Associates, XXXX, XXXX XXXX of debt in question : XXXX XXXX XXXX Received a letter XX/XX/XXXX in the mail for a debt that took me by surprise. First off, the bank mentioned in the letter has not existed since XXXX. All of my previous debt have been discharged, so I found this very suspicious to get a debt letter in my name. Next, this is the only letter received asking to settle a debt in full at a fraction of what is actually owed. And lastly, they are directing to a website to pay off the debt. I found this all alarming and looks like a scam.

I got a call from the company around XXXX and asked for them not to contact me that the debt is over XXXX XXXX XXXX and it was paid off. Starting XX/XX/2022 I started getting text messages from a XXXX which is a local number to me from the same company. I called the company and spoke with someone about this and told them I told them to stop contacting me and explained the dept was paid and to stop contacting me. I received a letter from Diaz & Associates about a credit card collection that is a time barred debt on XXXX. I called the credit company whom they are referring that I owe money to. The credit company XXXX says they have no record of the account or anything under my SSN. I do not recall ever opening an XXXX credit card. The name on the letter is before my name change in XX/XX/2005. I have not opened a credit in that name in over XXXX years. XXXX continue to put that I owe them on my credit report. I have told them over and over it is not me.
