Consumer Complaint against XXXX XXXX ( NMLS # XXXX ) and XXXX XXXX XXXX ( NMLA # XXXX ) DHI Mortgage Company, LTD. NMLS # XXXX XXXX XXXX XXXX XXXX. XXXX XXXX XXXX, TX XXXX XXXX www.dhimortgage.com XXXX XXXX XXXX XXXXe ( NMLA # XXXX ) DHI Mortgage NMLS # XXXX XXXX XXXX XXXX, XXXX XXXX ( NMLA XXXX ) XXXX, GA XXXX XXXX This complaint alleges age bias in the processing of my mortgage loan application. I. Bias Against the Elderly : I am a gainfully employed senior citizen who applied for a mortgage loan to purchase a second home in another state. I applied to DHI Mortgage who was identified as the " preferred lender '' of the home builder in order to qualify for an array of incentives that were available to me as a home buyer. DHI Mortgage proceeded to harvest my personal financial information as part of the loan application process and I worked cooperatively with them to make sure that they had access to all and any related documents that were needed for the underwriting of my loan application. Around noon on XX/XX/XXXX, I received a call from XXXX XXXX, the Loan Originator to with whom I had been working from the initial start of the loan process. She told me that there was a problem with my loan application. She said that DHI Mortgage could not include any of my salary this year in calculating my qualifying income for the loan because I had said during the initial phone call that I was planning to retire in about a year. I responded, Well, I do not have to retire! I explained that I had not even applied for retirement nor shared any retirement intent with Human Resources on my job. I explained that I had already signed my contract for the XXXX XXXX, and that I was a XXXX XXXX able to work as long as I was capable of performing my job. No one was making me retire. Further, people talk about retiring and change their minds all the time if circumstances change or they just decide to change their minds. Her response was, You cant go back! I asked, Go back on what? She continued to go on about how my income would change when I retired and I would fall short of the income threshold needed for the loan. I reminded her that whenever I did retire, I would still have XXXX Retirement income, which I could document and whose documented amount she requested. XXXX kept trying to explain that DHI Mortgage could not count future income, but only current income, which seemed contradictory since she kept saying that my current contracted income would not count. She said DHI Mortgage required that I be on a job at least three years ( never heard of that before!!! ). Not only did that strike me as bizarre, I also recalled from my review of the loan paperwork that XXXX XXXX would be selling my loan to someone else before I even made the first payment!! So the idea that they needed a three-year stream of income to guarantee a loan that they would sell before my first payment seemed strange. Further, given the industrys insistence that consumers be forced to pay PMI to protect the lenders financial interests against future financial uncertainties associated with a mortgage loan they make, why would a three-year future income benchmark be privileged over a strong credit history, stable employment history, and current income? After all, no one can predict the future, for NOTHING in life is guaranteed three years in the future for anyonethe very premise upon which any kind of insurance operates. I began to feel that disqualifying criteria were being manufactured as we spoke to fit conclusions that had already been made. XXXX insisted that the solution was for me to start taking a distribution from my IRA now, an idea that I rejected because of the unnecessary tax liability it would present for me. Further, pressuring me to start disbursements from my IRA after I have strongly objected to the unnecessary tax liability that I would incur is reprehensible and highly unprofessional for a loan officer. That conversation ended with XXXX stating that she would talk again to the loan processors and get back to me. However, it should be noted that I was never offered an opportunity to speak to the underwriters on my own behalf and offer any firsthand information about my finances that would assist them in making a decision about my financial stability. There also seemed to be no interest in verifying with my employer ( 1 ) whether actual retirement plans had been established with my employer or ( 2 ) what my VA retirement income would be in the coming three years IF I actually did retire. As I stated, seniors talk about retirement many times before actually doing it. After allegedly checking with the mortgage team or someone else, XXXX called my agent and me later that afternoon and informed us via conference call that my loan application was being denied because of a discontinuation of income. I asked her what documentation DHI Mortgage had to substantiate such a conclusion. I could get no answer. Unlike other information that had required extensive documentation and verification of my financial information, this decision seemed to be based on no more than a loan originators perception of what retirement is for senior citizens or a desire to impose individual qualifying criteria on a loan applicant at retirement age. Thus, the denial of my loan application is an unfair and discriminatory action based on biased, negative perceptions of elderly consumers rather than on an objective assessment of my individual creditworthiness. 1. First, there appears to be a presumption of what retirement is and a preconceived notion of what elderly do when they retire. My colleagues who retire frequently join or start consulting or other businesses, continue their professional employment in other states, or work part time on jobs related to their profession ( ex. teaching online ) or they may build ventures around their avocations. At no time did XXXX ask me anything about what my retirement plans might be if I left the XXXXwhether I would take another job after relocating to Georgia, pursue a business venture, seek any other sources of income, etc. Nothing! The alleged and presumed discontinuation of income is no more than an age-related stereotype, a preconceived image of retirement assigned to me merely because I spoke of retiring in conjunction with buying a second homea decision that those with the financial means to do so routinely make every day without being subjected to the age bias that is evident in this case. I believe that I am being discriminated against as a consumer at retirement age. My loan denial appears based on a perception about a future prospect of retirement and not on any documented evidence of future retirement as a fait accompli and its associated reduction in income. By not providing me access to the underwriters to discuss this issue and by making a decision that privileged hearsay over documented factual evidence of creditworthiness and financial stability solicited from me, XXXX XXXX appears to endorse XXXX bias about loan applicants at retirement age. 2. DHI Mortgages preapproval letter made it clear that it would undertake an effort to verify the personal financial information that I initially gave them and seek resolution of any facts particular to the Borrowers financial information to determine that I meet the Lenders underwriting criteria ( Preapproval letter dated XX/XX/XXXX ). Rather than taking those steps as indicated in the letter, DHI Mortgage acted counter to that described action. While it was a fact that I verbally expressed an intent to retire in about a year, actual impending retirement was never a DOCUMENTED or VERIFIED FACT. Nor was there ever any DOCUMENTED or VERIFIED FACT of a related DISCONTIUATION OF INCOME that grew out of a casually verbalized intent during a telephone conversation whose context was never ascertained by hearing both sides of the conversation. Had XXXX XXXX been guided by an effort to verify an individuals information rather than simply speedily retreat to a PERCEPTION of an individual based on age, the loan processors could have easily asked for contact information for the XXXX Retirement System or the XXXX Benefits Counselor in order to confirm whether or not a pending retirement was a FACT as well as WHEN and HOW much any change in my income would occur as a result. Instead, XXXX neither pursued any facts much less their resolution regarding this solitary reason for declining my loan application, a reason that was given weight over all the solid documented evidence of my qualifying credit worthiness ( an excellent credit score, a 1 % credit card utilization, a 6-figure salary, low DTI ratios based on past and current salary, liquid assets that exceeded the value of the loan, and 17-year job history ). XXXX protestation that DHI Mortgage requires three years of FUTURE income is what needs to be substantiated as factperhaps through class action litigation ; I see that argument as no more than a specious attempt to keep an otherwise financially qualified senior citizen from getting a mortgage loan. I was left with the strong sentiment that there was a hidden agenda at work here that had little to do with criteria for approval for a mortgage loan. As communicated to my real estate agent and by a voice message that I received from one of XXXX supervising officers at the company, DHI Mortgages remedy is for me to accept their referral to someone else to underwrite my mortgage loan, specifically to participate in their DHI Mortgage Home Buyers Club, an outfit that works with home buyers with credit challenges ( and buyers who no doubt pay greater interest rates to lenders to get a mortgage! ). II. A loan Practice That Unfairly Disadvantages Senior Consumers : On XX/XX/XXXX I received a letter from DHI Mortgage officially denying my application for a loan. My credit status led them to conclude that I supposedly have excessive obligations, though all three bureaus reported excellent credit ratings and a credit utilization of only 1-2 percent. Further, my income was ruled insufficient, apparently as a result of the loan processors adamant refusal to include my entire current six-figure contracted salary ( XX/XX/XXXX to XX/XX/XXXX ) in the calculation of my DTI ratios. By NOT reporting and not including my current income, the loan processor knowingly misrepresented my qualifying income simply because I rejected her urging to start taking disbursements from an annuityfuture supplementary income for which I have NO current financial need in order to manage repayment of the requested mortgage loan. When I challenged this denial, DHI Mortgage stood by the decisions of their underwriters, telling me that At the time of application, you indicated to the Mortgage Loan Originator that the subject property would be your second home as you intended to retire next year and move to Georgia. Since you plan to retire, your current employment income is not likely to continue for the next three years and, therefore, could not be used as qualifying income ( Email from XXXX XX/XX/XXXX ). What is discriminatory here is that this appears to be an artfully constructed Catch-22 applied only to senior consumers. Seniors approaching retirement age routinely get annual statements that project their future retirement monthly income should they elect to retire at a certain age or date. For DHI Mortgage to refuse to permit this future income in their calculation of a senior consumers three-year projection of income because it is FUTURE rather than CURRENT income is patently unfair and discriminatory. DHI Mortgage is unfairly dismissing the senior consumers CURRENT annual income, zeroing it out for three years and refusing to put in its place the verifiable retirement income projection guaranteed ( earned and vested ) for those years. Meanwhile, younger consumers get the benefit of a creditable future income stream based on the existing current annual income and the mere PRESUMPTION ONLY of a future income based on nothing. This practice of imposing a disqualifying ABSENCE of current income on a senior loan applicant at retirement age who is gainfully employed full time while giving younger consumers similarly gainfully employed credit for the PRESENCE of income is clearly a violation of my consumer rights against age discrimination and is an underwriting tactic that is patently unfair to senior consumers and senior mortgage loan applicants. Conclusion As outlined above, the denial of my loan application is not based on equitably evaluated documented facts as promised but rather on hearsay and personal perceptions of senior citizens. The servicing of my loan application by DHI Mortgage has been handled unfairly, and I appeal to XXXX XXXX to cease and desist this discriminatory practice. I also appeal to all agencies and governing bodies that exist to protect the rights of all citizens to fair and transparent credit practices to demand from XXXX XXXX immediate compliance with the law. My understanding is that the mortgage underwriting process is to review evidence of an applicants credit and financial information and determine from documented evidence that we meet the lenders criteria for a loan. The dismissal and immediate discounting of a senior consumers current annual income merely because of conversations of retirement ( rather than a documented review of verifiable retirement income ) is no more than a contrived barrier erected to bar a retirement-age consumer from the financial access that other consumers freely have. I further encourage XXXX XXXX to take steps to sensitize its loan officers to the disparaging perceptions of elderly consumers. The practice of creating for us roadblocks that do not exist for other applicants only leaves us questioning the companys integrity as a lending institution. Thank you.

My Formal Complaint Against DHI Mortgage Company I am writing to file a formal complaint against DHI Mortgage Company, detailing concerns related to unfair and deceptive lending practices as well as discriminatory behavior. I believe these actions violate ethical business standards and demand a thorough investigation. I have spoken with the Customer Care Department who has been unresponsive to my calls and emails and refused to provide me any insight into the investigation that was supposed to be conducted. I applied with DHI mortgage on XXXX and shortly after received the Purchase Agreement from DR Horton to begin the process of applying for an FHA loan for the home I was interested in purchasing. The process began and I was assigned a Loan Officer - XXXX XXXX XXXX XXXX # XXXX. She reached out to me and told me that my application was in progress. A few days later I received the Initial Disclosures and various documents that needed to be signed. I didnt receive any follow up call from XXXX advising what I am signing and I made numerous attempts to reach her. After speaking with my real estate agent and DR Horton Rep, she finally texted me advising she was going to call and address questions that I have. She called and I got my initial questions answered after a couple days of waiting. On XXXX I received an email and call from XXXX XXXX - XXXX # XXXX ( Loan Processor ) stating that I was Conditionally Approved and she provided me a list of conditions/requirements that would need to be satisfied prior to the closing of the Home. Please note that prior to receiving the conditional approval, no call or email was provided to me advising that certain items will need to be addressed to obtain the loan. Apparently, this expectation was supposed to be set during the application/ preliminary phase. The conditional approval also set a tentative closing date of XXXX The first list of conditions ( Containing 20+ required items ) required me to pay off outstanding credit accounts/debts and provide bank statements that correspond with the payments. Additionally, on the first list of conditions, there were items that I was required to pay off that were not even debts or mandatory obligations. Once I made the DHI team aware, these were removed from the list. As of the evening on XX/XX/XXXX, I worked diligently to upload all of the requested documentation and these efforts carried on for several days as I had to involve other companies to obtain the requested documents. There was a lot of back and forth between the Underwriting Team, the Loan Processor and myself as they kept requesting more documentation over and over. One thing to note is that I submitted the application and was preapproved for the home using XXXXXXXX XXXX account. During this process, I was instructed that I had to produce bank statements for ALL of my bank accounts and heavy scrutiny has been placed on those additional accounts that were not even in Scope for purposes of me obtaining the loan. The back and forth cadence continued for several days between the Loan Processor and Underwriting. I also received a Gift from my parents and this process was very rigorous to say the least. My mom was able to transfer the money with no problem but they were unable to accept the gift from my father. They decided to review and vet both of my parents ' personal accounts and stated they would accept my moms gift but refuse my fathers AFTER stating they only needed the last 10 Transactions. My father and I had a conversation with the loan processor prior to him giftings me money and the information she provided on the phone was inaccurate because we received different information after them saying they were refusing my fathers gift. Nonetheless, my mom was able to provide me with another gift and associated bank documents. Concurrently, I had received more requests to sign documents without explanation and these documents contained information about the interest rate. The only reason I went with DHI Mortgage was due to the incentives they were offering on the purchase of a new DR Horton home. I was given misinformation about how the incentives work and it was never explained to me correctly from the beginning of this process. The documents I was being coerced to sign were basically forcing me to use a huge part of my incentive to buy interest points. During this time, I was making multiple attempts to reach out to XXXX - Loan Originator to discuss the new loan disclosures and she was unresponsive. I later found out that she was out of the office sick. I understood, but I figured someone would reach out to me to continue the process as there was no concrete ETA of when she would return. There was a holding pattern until XX/XX/XXXX and I received an email from XXXX XXXX - Loan processor stating that Underwriting needed an additional 21 items of documentation. I again worked diligently that evening to provide all of the requested documents and get them uploaded. During this time, I got paired with another Loan Originator - XXXX XXXX XXXX # XXXX who was working on behalf of XXXX in her absence. My father and I voiced our concerns to her regarding the documents I received and the misinformation I had received regarding the interest rate. She advised she would be escalating to upper management. During this call, I received an email with another 30 items of documentation that would be required for Underwriting to review. I followed up again via email to XXXX advising that I hadnt received a call and she stated I would receive a call on XXXX On the morning of XX/XX/XXXX, I received a call from XXXX, a Branch manager and again had to voice my concerns about the process and the lack of communication and customer care I had been receiving thus far. She advised me that I would receive a call back after she investigates. The next day, I didn't receive a call from her but I received a call from XXXX XXXX - Branch Manager XXXX XXXX XXXXXXXX who called me and said he was willing to answer any questions I have about the interest rate. My father had been a part of every phone conversation at this point and has had visibility on issues up to this point. His tone and demeanor during this conversation was very condescending and he was trying to justify every action in regards to the concerns I was having and additionally told me that I am not being discriminated against. My father and I also explained to him that there seems to be requests alluding to Over Documentation after reviewing various guidelines set forth by FHA. Once I advised him AGAIN that I was being discriminated against for being a minority and trying to purchase a home on my own, he stated that he could no longer talk to me and my father, and he would escalate it to the customer care team that handles discrimination claims. That evening I scrambled to gather all 30 + items of documentation. A couple days go by and I receive a call from XXXX XXXX - DHI Customer Care Specialist on Monday XX/XX/XXXX and again my father and I voiced our concerns and I gave multiple occurrences of Discriminatory actions, intrusive and irrelevant requests for documentation and other information. He advised an internal investigation would occur in relation to what has happened and for me to keep him informed on any shortcomings that occur after our call. On XX/XX/XXXX, I received an email from XXXX XXXX stating that all the documentation was pending review from the Underwriting department and he will reach out once he receives feedback. Two days go by and it's now XX/XX/XXXX and I receive another email from XXXX XXXX with another 19 items of documentation that needed to be reviewed. This time, I identified items that were out of scope or items that I already provided and he advised he would escalate to the Loan Processing Team Lead - XXXX XXXX. She called me that same afternoon and was extremely rude and disrespectful to my father and I. Also she advised that I can disregard the email sent and to delete the email as the list of items was then reduced down to 12. This was a clear indication of Over Documentation and had I not said anything, there would have been excessive scrutiny on the additional documents provided. As of XX/XX/XXXX, I provided the additional documentation and didnt hear anything back until XX/XX/XXXX from XXXX XXXX XXXX He stated that the fulfillment team will review within 24 hours and will reach out if anything else additional is needed. As of XX/XX/XXXX, I received an email from XXXX XXXX stating that the additional documentation is back with Underwriting and they will have feedback on Tuesday XX/XX/XXXX which was my expected closing date. This lender has displayed nothing but injustice towards me and my family. As a minority, we should not have to face this type of treatment and this has been a very discouraging and daunting experience for me as a First Time Homebuyer. I would be curious to know what other minorities have faced some of this same behavior because it is not right and I was taught to speak up when things are not right. This has caused TRAUMA for me and my family and I am demanding JUSTICE for the type of experience I have been provided to date. I have not been able to reach XXXX XXXX since our first conversation and I am done trying to conform and allow DHI Mortgage to continue these egregious actions. WARNING * DO NOT DO BUSINESS WITH DR HORTON!! WORST EXPERIENCE EVER!!! & This is not my first time buying a house. THEY ARE THE ABSOLUTE WORST. EXTREMELY UNPROFESSIONAL AND UNETHICAL!!! * On XX/XX/2021 I went into contract with DR Horton/DHI Mortgage . I put a deposit of {$4000.00} in escrow while the home is being built. Weeks later I received a call from a sales representative, one who I was unfamiliar with stating that I need to cancel my contract immediately and I will be refunded. I asked her what reason would I have to cancel and she said she will call me back. I didnt hear back from her for weeks. I was so confused so I contacted my realtor and sent an email over to my representative at DR Horton. No one responded. My realtor reached back out to me and also was unable to get a hold of someone. The same woman reached back out to me a few days later telling me to cancel my contract and assuring that I will receive a refund for my deposit. I asked once again, why would I do that? I havent spoken to anyone about cancelling my contract. I asked for a supervisor and she said her manager will give me a call. I asked her to send me the managers number as well that also did not happen. Then a few weeks went by and I didnt hear anything back from her until a few days ago. When she reached out she advised me that I will be getting a spot lot and not the house that I signed the contract for. I expressed my confusion to her and asked her why was this happening. Her response was that this was my request. I expressed to her once again, My confusion and reminded her that she told me she will call me back with manager info and manger will also call, I got no call. She then blatantly hung up the phone. I was so confused, upset and frustrated that this woman, who I dont know from DR Horton is constantly calling me to cancel my contract. I then went to a DR Horton location and spoke with someone. I was advised that the person who was working with me initially, has gone on a leave of absence and this person is filling in for her. After doing more research I discovered that she wanted me to cancel so she can get the sale credit instead of the other woman who she filled in for. This is extremely unethical and made me very uncomfortable with this deal. I reached out to her manager, who was fully aware of what was going on and also offered to provide full Refund to me as long as I cancel the contract. The manager advised me that DR Hortons lender has placed a denial on my file because I chose to go with an outside lender. This was extremely unfair. I was more confused because I never received any notice of denial. I decided that going forward I will email them instead of telephone conversations because they were telling me all different information, and nothing added up. I asked that the manager send me an recap email of our phone conversation. She did send an email but it didnt recap the conversation like we agreed on the phone that it would. I then sent a response email to the manager with all my supporting documentation, that shows my approval from DR Horton lender, screenshots that supported all the information I provided to them, and my contract that shows my outside lender. The manager didnt have much more to say after seeing all my documentation. She then said, well do you want to still close on your home? At that point I was so disgusted by them and I agreed to cancel my contract. After cancelling my contract I was told that DR Hortons lender had charged me {$470.00} for an appraisal. When I paid for my appraisal I thought it was paid to my new lender. I later found out that DR Hortons lender requested the appraisal without informing me of that. Also, after putting denial on my file which confused me even more. How are you going to put a denial on me then request an appraisal? I was advised to reach back out to the lender to get the refund because I wasnt even supposed to be charged for an appraisal!! When I reached out to him. He refused to give me a refund regardless of his wrongdoings. If you are looking to buy a house go with any other builder, DO NOT DO BUSINESS WITH DR HORTON!! WORST EXPERIENCE EVER!!! & This is not my first time buying a house. THEY ARE THE ABSOLUTE WORST. EXTREMELY UNPROFESSIONAL AND UNETHICAL!!!

On XX/XX/XXXX we closed on the purchase of a home from XXXX XXXX. We utilized their lender for the purchase, DHI Mortgage. Instead of paying a monthly PMI premium we elected to pay for an upfront refundable mortgage insurance premium because we felt the home values in our area were going up and that we would put in landscaping and upgrades to the home to achieve 20 % fairly quickly. We paid at the time of closing {$12000.00} for the upfront refundable mortgage insurance policy. XX/XX/XXXX- I emailed XXXX XXXX and XXXX XXXX our contacts from DHI to obtain contact information on our upfront refundable mortgage insurance premium. XX/XX/XXXX- contacted XXXX XXXX he said he wasnt able to get the information anymore it would be with his loan servicing department or I could contact our title company XX/XX/XXXX- I contacted our title company. XXXX XXXX, was not able to provide a certificate or proof of payment for the upfront refundable policy. They stated the lender was paid or rather they withheld those funds from their wire. XX/XX/XXXX- contacted XXXX to understand what the process is to have the PMI need reviewed. I was told that there is no active PMI policy for my loan. I asked if I could have the contact information for the PMI department. XX/XX/XXXX- I emailed XXXX Loan administration XX/XX/XXXX- received an email back from XXXX that there is no active PMI on my account. With an hour of getting their email, I responded letting them know that I purchased an upfront mortgage insurance policy. I never heard back from them via email. XX/XX/XXXX-When I called in on the standard line for DHI Mortgage they told me that they transferred everything over to XXXX. XXXX has no record of mortgage insurance since XX/XX/XXXX ( may have been XX/XX/XXXX ) XX/XX/XXXX- I spoke with XXXX from DHI servicing department who was working with her accounting manager, XXXX ( refused to give a last name ) and XXXX XXXX to get in touch with XXXX and they will give me a call back. XX/XX/XXXX- I followed up the current status to XXXX XXXX who said they had asked the XXXX XXXX to research and get back to us as soon as possible. XX/XX/XXXX- I received a call from XXXX XXXX , National resolutions customer service at DHI who said she would be my primary contact going forward and she would email me her contact information. She had said a mistake was made and they did not have a certificate showing a refundable policy. She acknowledged that she knew we were suppose to have a refundable policy. XX/XX/XXXX- After not receiving her contact information via email as discussed I called and left a message for it. I then received contact information and an email letting me know she would contact me once she had a resolution. XX/XX/XXXX- I emailed checking back in for a resolution. I received a response saying that they heard back from the XXXX XXXX and they are allowing them to pay an additional premium to convert my coverage to refundable. That they just need to regroup with a manager at XXXX and determine who could assist me with my cancellation request once the revised coverage is in place. XX/XX/XXXX- I requested copies of the insurance polices XX/XX/XXXX- I emailed XXXX and let them know DHI Mortgage says I do have a policy and that they transferred it to them. I requested them to get back to me. No response back via email. XX/XX/XXXX- After speaking with XXXX on the phone she agreed to send the certificates to me but said they had just sent payment to XXXX XXXX so the revised policy wouldnt be in effect until the premium was posted. I was suppose to get a follow up email with contact information to XXXX but have yet to received that as of this evening XX/XX/XXXX XX/XX/XXXX- called DHI three times today and received voicemail each time. They show that it was waived and there is no information in the loan origination notes about a mortgage insurance policy. They suggested I may want to reach out to an attorney or the company who issued the PMI policy XX/XX/XXXX- Called XXXX XXXX, they said they show the policy but that it is still insuring DHI Mortgage which is unusual if my loan was sold.

I 'm wholly dissatisfied with the DHI mortgage experience. I was promised a 30 day close and given CD paperwork to reflect that deadline. I was also assured that we would close at the end of XX/XX/XXXX, then the excuses started rolling in ; first they blamed that my other house had not sold, that was taken care of, then I needed 3 letters of explanation from my employers, I had to change bank account information, I needed no less than 15 different letters of explanation and some were provided multiple times to multiple parties, and at least 70 pieces of supporting documentation. I would return all documentation promptly and often wait 2 to 3 days to even hear back from DHI employees. When they would call, it was often at XXXX on Fridays with the statement that additional documentation was needed immediately and this would further hamper my loan process if not immediately received. After returning the documentation, I would not hear back until the middle of the next week. Also, when contacted, more than once I was contacted by one individual and then when re-engaged that person was off for the next week and would be shuffled to another. No consistency on who was actually handling my loan at any given time. In addition, I paid for a mortgage lock, but since DHI continued kicking the loan down the road, that was extended multiple times and I was charged for it. DHI should have at least eaten that cost. Every step of the process it was stated it would only be a few more days, whereas by XX/XX/XXXX ( 20 days later than originally promised ) and several mysterious layers of approval, my loan was finally turned back on ( apparently it was shut off ) and the process started again to finally close on theXX/XX/XXXX. Many times I had asked and had another lender waiting ready to approve my loan, but was told it would be only a few more days. In truth I was being strung along to keep me at DHI. I should have followed my intuition and pulled out of the situation at the first sign of trouble and moved onto the original lender Integrity. I stayed because I believed DHI and their employees would be looking out for my families best interest. Clearly I was mistaken. Although we received a large credit, it did n't make up for the additional {$4000.00} in expenses incurred due to DHI 's mortgage process. We incurred expenses for a month of lodging ( week at a time, due to being strung along ), additional storage truck rental, storage space rental, additional POD rental, purchasing day to day living supplies, added fuel charge, flight rescheduling, additional airline travel, and missed work for my spouse due to transportation challenges. This does n't even address the rescheduling needed for buses, a fence install, internet install, furniture delivery, to name a few. Pushing it back 3 different times also caused additional fees ( {$750.00} ) for a mortgage lock that I needed to pay although DHI was the reason for the delays.This almost drove us entirely from the home to start looking elsewhere. The irony of the situation is I was counseled by members of DHI on fiscal responsibility, but yet they were the very institution causing fiscal stress on my family. Is this standard practice!?! Overall I ca n't remember a time I was treated worse by a service provider, let alone as a veteran. We were misled, strung along, lied to, belittled, and treated overall like our business did n't matter. This being said I would never put my name behind DHI and would tell anyone that asked that they should be avoided at all costs. XX/XX/2023 To Whom It May Concern, I have recently become very concerned about my financial privacy. The company XXXX and DHI Mortgage have been either unable or unwilling to answer my questions. Representatives at both companies have directly informed me that they are not aware of how to solve the situation, and continuously direct me to each other. I believe one or both of these companies are in violation of the The Gramm-Leach-Bliley Act ( the GLBA ), and I would like their individual compliance departments to determine if this is indeed the case. I would also like to know if there are any other privacy violations that may have occurred which are in conflict with different laws that they are required to follow. In the beginning of XXXX, 2023, my husband and I applied and were approved for a mortgage through DHI Mortgage. During this process, DHI Mortgage utilized the company XXXX. XXXX prompted me and my husband to provide private identifying information, as well as access to our online banking information to assist the approval process. We both provided our banking usernames and passwords to XXXX. Due to a setting on my online banking portal, I am alerted every time there is access to my private financial information using my banking username and password. Once I provided this information to XXXX, I received upwards of two alerts per day, notifying me that my account was being accessed. As I had voluntarily provided this information to XXXX and DHI Mortgage, I disregarded these alerts at the time. We were approved for our mortgage and closed on XX/XX/2023. We have moved into our house, and we have already begun making mortgage payments. As of todays writing, I am still receiving alerts that my online bank account is being accessed multiple times a day. I can confirm the access is not my personal use. It is a third party. The pattern of access has remained consistent from when I first provided my online bank account information to XXXX and DHI Mortgage. On average, my private financial information is accessed upwards of twice a day and in off hours, such as XXXX XXXX. This has led me to assume that XXXX software is still accessing my bank account on a daily basis. Both companies have assured me that they should no longer be collecting financial information on me ; however, I have not received any written or verbal instruction on my responsibility to limit their access. If it is my responsibility to change a password or remove my authorization, I have not received a notification or an indication to do so. This is a major privacy violation, as both companies may be continuing to collect and store private financial information on consumers without their knowledge or continued consent. While I consented to XXXX accessing my bank account during the application and approval process, I did not know I was consenting to a lifelong monitoring of my private financial information. I do not know where this information is going or how it is being stored. However, I am stating my revocation of my authorization of my online bank account portal details for XXXX and/or DHI Mortgage in this complaint. Their continued access to my financial information is no longer permitted. I expect a prompt reply to these concerns from XXXX and DHI Mortgage. I also feel obligated to inform the CFPB of these practices, and that both the companies are either ignorant to privacy laws, or simply unwilling to follow up or inform me of the proper routes to take. XX/XX/XXXX I closed on a mortgage with DHI Mortgage. It was later transferred to XXXXXXXX XXXX and now the loan is transferred to XXXXXXXX XXXX. My property taxes and insurance are all from escrow. My loan for XXXX has ballooned to an excess of {$870.00} additional payment per month. I contacted XXXX to inquire why? I was told it is because they did an analysis and determined my escrow amount was not based on my actual homeowners insurance bill for the year sent to them by my insurance carrier and they estimate my property taxes to be {$10000.00} year on a {$420000.00} home in XXXX XXXX. My property has been homestead since XXXX. The XXXX XXXX property appraiser mailed the bill to XXXX XXXX The XXXX Representative I spoke with on XX/XX/XXXX stated when the loan was transfer to them all the documents were not sent or loss in transit. They have no knowledge my home is homestead and therefore basing my payments on their own analysis. She stated, " DHI Mortgage did not transfer all the mortgage documents to XXXX and XXXX did not transfer all of the information to then in transferring to XXXX XXXX. I asked the representative doesn't it behoove each company when transferring mortgage loans to secure the proper instruments. She stated it is not XXXX XXXX fault if the company they purchased the loan from did not transfer the documents to them. She further stated, " they do not go by the tax bill from the Property Appraiser. It is my responsibility to alert them to my Homestead exemption status. I asked the representative where can I send the documentation and she advised me I can not. I can only call a phone number within her organization and speak with someone about it. They will not adjust my payments and it will just stay in escrow for future escrow. My payment will continue to be {$870.00} higher per month. When I purchased my home I had to meet FHA guidelines to qualify and meet income to debt requirements. This new payment would have disqualified me for the home purchase in XX/XX/XXXX. I would have never made it to the closing table with this payment. This company XXXX, XXXX and DHI Mortgage are transferring loans, intentionally omitting information and conveniently loosing documents to disregard the actual yearly taxes and insurance to inflate customers monthly mortgages which result in homeowners inability to pay. This would result in the homeowners loosing their homes due to intentionally inflating monthly payments. I have further learned, DHI mortgage sold my loan to XXXX and omitted one of the borrowers on the loan and did not transfer all of the loan documents. XXXX who had my homestead documented omitted this on the transfer to XXXX which has resulted in the same omissions. I do not believe these three companies are this careless. I believe it is another example of targeting minority home loans to intentionally orchestrate a default. These are danger and reckless practices not to mention discriminatory. My tax bill for XX/XX/XXXX was {$860.00} paid by DHI Mortgage. My tax bill for XX/XX/XXXX was {$4800.00} paid by XXXXXXXX XXXX to XXXX XXXX. My monthly mortgage payment with DHI Mortgage at closing was {$2600.00}. My monthly mortgage payment when transferred XXXX and during the time they serviced my loan the amount was {$2600.00}. My monthly mortgage payment when transferred to XXXXXXXX XXXX for the entire XXXX year was {$2600.00}. My new monthly mortgage payment with XXXX for XX/XX/XXXX is {$3500.00} and the representative that will be my new payment going forward.

My family has been held up from from being approved for an FHA loan. My XXXX credit report showed a credit boost service offered by XXXX to help boost consumer credit legally. My utilities bills such as ; XXXX XXXX XXXX and XXXX were being paid on time. I was told by DHI Mortgage representative, XXXX XXXX that the FHA does not allow this type of feature on my credit report. I did ask questions because I was under the assumption that this was to help consumers build and boost their score. There has been so many miscommunication and misleading information we have received from their representative, until we decided to switch lenders. XXXX also advised our realtor and myself that switching lenders be the best idea. We did switch lenders and went to a company named XXXX XXXX XXXX. Our loan officer XXXX XXXX, ran our information in the FHA system and received an automatic approval. But by the time it went into underwriting, they learned that there was a credit reject on our file. I never received any information on this reject. And we still have no valid information on FHA not accepting your utilities being reported to the credit bureaus. I emailed DHI Mortgage rep XXXX, who failed to give me answers on what happened. Why our credit file was rejected in the FHA systems. Our credit scores were within guidelines. We had completed DHI 's Home Buyers Club Program. We have a healthy downpayment, have been on our jobs for nearly 10 years and have the monthly income with debt ratio being within the guidelines. After sending a follow up email to XXXX on XX/XX/2019, I then received a call from another DHI representative, XXXX XXXX on the same morning. She informed me that we were rejected because I failed to removed the credit boost feature. This was false information. I emailed XXXX during the process and asked a few questions but I did comply and remove the feature. Our current loan officer asked me to see if they would remove the credit reject from the FHA system and they have failed to do so. XXXX mentioned that she left me a voicemail at the end of XXXX. I have 102 deleted voicemails dating back to XXXX. I listened to them all and not one was from a DHI rep named XXXX. I'm considering having my cell phone company pull my call log activity. Upon our conversation, XXXX told me that she would be in touch by the end of the day. I forwarded emails to her in reference to this matter. She told me she would contact me by the end of the day. It's currently XXXX ( EST ) and I have yet to hear anything from her. She has also failed to confirm that she received my emails. This is clearly a mistake on their end, which have caused my family headache and heartbreak. We are ready to move forward and although there are other ways to get a loan, we were advised that FHA is the best loan for us at this time. We have worked extremely hard and have did ever thing these companies have asked us to do. DHI refuses to remove this and it's not fair. Prior to all of this, my wife was approached by a neighbor that told her ( my wife ) that she heard we was having issues with our loan. I don't know if the neighbor was just being nosey, but all of this happening doesn't seem right. I don't want to think they are intentionally holding us back but from the responses and actions we have received from them, it appears that way. In XX/XX/XXXX I applied for a home with DHI and was approved with a closing date of XX/XX/XXXX. I then got laid-off from my job on XX/XX/XXXX, but already had another job lined up and therefore immediately I notified my loan officer including the offer letter which included my income. I sent it to her on XX/XX/XXXX. I wasn't notified until XX/XX/XXXX from the loan officer ( 10 days before closing ) to advise she wasn't going to be able to approve the loan because my DTI. I was distraught. I then called her back several times and she did not answer work or cell. Therefore, I sent her an email asking what was I to do because I had no where to go at that point and why wasnt that caught when I sent the information to her which would have alotted me enough time to rescind the 60day notice, considering I had to put in a 60 day notice to vacate and it was too late to reverse it at that point. I never received a response from the loan officer which then prompted me to send her another email which asked her why my child support income could not be considered. She then replied to that email stating " she could use the child support if it was 6 months ''. I already mentioned I only had 3 months so I knew she was basically telling me there was nothing she could do for me. I then reached out to my realtor and she directed me to another lender that she knew would be able to help me. I contacted the lender and he got on it right away and got me an approval with my 3 months child support. On XX/XX/XXXX the loan officer from DHI reached out via email stating she could now use 3 months. I knew immediately she was trying to steal the loan back but I already made the decision to work with the new lender who was able to help willingly. I advised her I decided to move forward with the lender and asked for her to transfer the loan to the new lender. I never heard anything from her and a week passed and she had not yet transferred the loan which delayed me in closing. Me, my realtor and new lender had to jump through hurdles to get in contact with staff at DHI to have the loan transferred. Once they transferred the loan on XX/XX/XXXX they submitted a denial which blocked other lenders from working with me. I am now homeless with no place to live with my XXXX children. I have made several attempts to get the loan transferred without the denial ( which is not valid ) and appears to be an deceptive act as they was trying to take the loan back. I also asked for manager, VP and director contact information and have not received any response. They have drug my through the dirt hindering my ability to get a FHA loan when I am qualified for the loan. Their unfair and unethical behaviors has damaged me and my family tremendously. They made me pay them {$450.00} for an appraisal then turned around and blocked the lender from being able to close me on the house. I have lost many nights of sleep, cried a river and have not been able to eat a meal since this has taken place. This by far is the worst lending company to work with. I would not recommend DHI for any lending purposes.

On XX/XX/XXXX we entered into a contract with XXXX XXXX ( homebuilder ) and DHI ( lender ). Several discussions with their MLO XXXX XXXX ( XXXX XXXX ) led to a submitted application and preapproval. It was during this preapproval that we discovered the existing of a Federal Tax Lien on my husband 's ( XXXX XXXX, XXXX ) bureau. We believed at the time the lien was associated with his father. My husband does out past income taxes and is currently on a repayment plan, paid as agreed. This was disclosed to the MLO. On XX/XX/XXXX XXXX emailed us to inform us that the application was going to be receiving credit approval ( conditional ). We fully expected to be required to provide proof of payments, balance, etc. but to our surprise XXXX asked for nothing pertaining to the XXXX. On XXXX XXXX was provided a copy of the installment agreements and payment history for the lien after a discussion with my husband. XXXX acknowledged receipt of the documents. We received a conditional approval on XX/XX/XXXX from XXXX XXXX ( XXXX XXXX ) and satisfied the conditions of the approval ( which still requested nothing regarding the lien ). On XX/XX/XXXX I received a call from XXXX stating that the underwriter made a mistake and realized that a conventional/conforming loan was not an option as it could not be sold to Fannie/Freddie and they would need to have us enter into an FHA loan instead ; which required even more money down due to XXXX XXXX FHA limits. The error is this. XXXX was provided the information and in escalating the satisfied conditional approval of the conventional loan it was revealed to me by XXXX XXXX ( Asst. Nat'l Resolutions Manager ) that in an internal email/document between the underwriter and XXXX AFTER having received our lien documents and payments that he informed underwriting the tax debt/lien was not associated with XXXX which led to their credit approval. It is my strong belief that this is a violation of UDAAP in that XXXX had direct knowledge and confirmed receipt of the information but withheld the information in an attempt to gain the approval. However, at my request, I asked XXXX to investigate the loan amount on the approval as it was $ XXXX short at which time underwriting somehow became aware of the voluntary and/or deliberate withholding of our credit information and XXXX contacted me to pursue the FHA loan instead. The situation was escalated and XXXX ( ph # XXXX ) admitted there were " communication errors '' on behalf of XXXX but that we 'd be required to pursue the FHA loan and provide approximately $ XXXX in closing costs. She acknowledged with XXXX 's manager ( XXXX ) on the phone that errors were made but XXXX would not portfolio our loan and our only option was the FHA. I cited my concern with UDAAP, ECOA, HMDA, and TILA and asked to speak with a compliance officer or legal team representative and she refused to provide me any contact of a subject matter expert. I have every conversation in email as well as our conditional approval and conditional credit approval that were both satisfied.

DR Horton Mortgage in XXXX Texas denied my access to loan product that I was highly qualified to receive. The loan offers withheld my application know the following facts, 1. I was moving from XXXX to XXXX to purchase a home and I was on a extreme time limit. 2. I was a first time home buyer with limited experience in the home buying process. In addition, to being a first time home buyer, I was a women buying a home alone, with no experience. The lender told me several times I am highly qualify for a conventional loan and allow me to fill out a conventionak loan application on XX/XX/2022. I expressed in writing and verbally multiple time the loan products, I wanted to apply too. I told officer, I was not interested in a FHA loan, and wanted a conventional loan using the XXXX XXXX XXXX XXXX XXXX or the XXXX XXXX XXXX XXXX. I signed my conventional loan prepare escrow documents on XX/XX/2022. The house was scheduled to close on XX/XX/2022. The lender accepted my application and proceeded to ask for additional supporting documents, like work from home document on XX/XX/2022 and processed my earnest deposit on XX/XX/2022. However, my lender withheld my mortgage application for weeks and often called in to check my progress. Without warning around the week of XX/XX/2022, I was told the lender could not offer my a conventional loan and would only give me FHA Loan. I asked why several times and was told the conventional loan application could not be processed and the system rejected my application. Knowing that I had a deadline to move from XXXX to XXXX with a small child by XX/XX/2022 due to my job, the mortgage company played that card to their advantage. After request a review of my application by a supervisor, I was denied a conventional loan. I was also told to sign the paperwork for an FHA loan by Friday, or I would lose the house. They were not willing to give me time to find another lender. I immediately drove to XXXX to try to resolve that issue and to my dismay, after several discussions, was forced into a FHA loan application. I was never given evidence of why my application was denied or what was root issue. After signing the FHA loan application, my mortgage was approved with 5 business day. I felt like they took advantage of my clean reputation, great score, low debt to income, now credit issues. I was forced into a product I did not want. Therefore, I am requesting evidence as to why my conventional loan for XXXX XXXX and XXXX XXXX applications was denied. I am also requesting copies of all my papers work processed during my application period with loaner by certified mail. After forcing me into a FHA loan, knowing I had no other housing options at the time, the lender try to offer me additional incentives like 3 years of 1 % interest rate. Lastly, I spoke with several of my neighbors, how also had similar issues with this lender and their application process. They described the whole situation as a nightmare and that the lender to advance of they fact that they were all 1st home buyers.

In XX/XX/2017 I XXXX XXXX along with XXXX XXXX applied for a loan with DHI mortgage. The loan officer is XXXX XXXX XXXX. XXXX XXXX called me and advised he would be able to give me a preapproval and that I may begin my search for a home. XXXX XXXX sent me over my preapproval letter via email in the amount of {$250000.00}. He advised XXXX had some nice homes. I advised him that I much rather XXXX XXXX. At that point he was a little dry and asked why. I advised because of the reputation and the reviews. He than began and seemed to be a little dry as if he did not want o deal with me.He kept saying his preferred builder was XXXX. Never the less he advised to me that I may begin to look for a home and go under contract if I see one I like. So I did go under contract with XXXX. I called XXXX and meet with him about 1 week to a week and half before XXXX. He advised give me some time to look at your file and I will then begin to send it to processing in the mean time he sent me over docs showing what my payments would be. So I waited until after XXXX I called him and he advised I see your husband has a judgment I advised he did not that his ex wife forged his signature on a rental home and she is being investigated he advised give me some time to come up with a solution and advised he would call me in two or three days. Well two weeks went by I emailed him, I called him I left messages and he completely ignored me.So around XX/XX/XXXX he called and advised that he needs to see how he can work on this file and not been incomplaint in removing my husband name. It appears like he did not want anything to do with the loan I believe and he made me feel it was because I di not choose XXXX as the builder. This is very unfair and very wrong. So on XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX,XX/XX/XXXX I tried contacting him again and still no answer.So I contacted the Corporate office via email and heard back in 24 hours from XXXX at the Corporate office she called me from XXXX contact number. She apologized and said XXXX XXXX has no excuse for ignoring my calls and not responding. She advised he does not know how to handle my file with the bankruptcy and it just being a difficult file. So my question to her could he not have asked for help on this case. He had not even sent it to processing and or to the underwriting for review. HE has completed ignore me and left this file ant the bottom of his desk. So I ask this question to XXXX and she agreed it was not handled correctly at all. I believe this was unfair treatment due to the fact I did not go with his builder of choice. I am now working with another lender and looking at another home. This has been very stressful and I will be looking for an attorney to handle this as well for all the mental anguish this has done to me. As of today he has not even attempted to follow up with me. DHI Mortgage : Failure to represent 2-1 Buy Down promotion in all loan estimates -- A 2-1 buydown promotion was not reflected in any of the loan estimates provided to the buyer, despite knowledge by seller and lender from day 1 that the buydown would be an incentive for this sale. -- As a result, all provided loan estimates ( 2 ) were misleading, and prevented the buyer from making accurate judgements on affordability and accurate comparisons to other lenders based on DHI Mortgages provided information. -- The monetary consequence of this exclusion is that the initial Closing Disclosure stated that the cost to close was {$1900.00} higher than what was provided in the most recent loan estimate a +13.75 % increase. -- The lender provided a loan estimate on XX/XX/XXXX, and a 2-1 buydown subsidy payment schedule on XX/XX/XXXX. When the second loan estimate was provided on XX/XX/XXXX, the lender clearly had full knowledge of the 2-1 buydown promotional yet did not include this promotional as a variable in the loan estimate. -- The lender claims it could not include the 2-1 buydown in the estimation without the buydown addendum. A competent lender would have requested such an addendum from the seller in a timely manner, along with all other documents required, to accurately portray the true cost of sale to the buyer. Therefore, the buyer believes its exclusion was a conscious decision intended to mislead the buyer and make the loan offer more appealing than it truly was. -- It must be noted that the lender ( DHI Mortgage ) and seller agent ( DHI XXXX XXXX XXXX XXXX XXXX ) are subsidiaries of one company, XXXX. XXXX. DHI XXXX provides buyers with seller incentives for financing their loan with DHI Mortgage. The buyer contends it would be well within the lender 's power to request these documents from the seller given they operate under a single parent company. -- The acquisition of the 2-1 buy down addendum was a quick process, once initiated. The sellers agent requested the buyer sign the addendum, had the buyer sign the addendum, and had the lender provide the CD on the same day, XX/XX/XXXX, exactly 15 days after the Uniform Residential Loan Application was submitted on XXXXXXXX ( which marks the buyers credit with a hard inquiry ). -- Its an incredible coincidence that, while the buyer has exactly 14 days to compare rates with other lenders without impacting their credit score, the Closing Disclosure with the 13.75 % higher cost to close was generated on day 15. -- In other words, DHI Mortgage intentionally chose to forgo requesting critical addendums from the seller that they knew would be part of the final sale in order to intentionally misrepresent the terms of the sale to the buyer, until such time, that if the buyer were to seek competitive offers, it would adversely affect the buyers credit rating and risk the pending sale.

Dear XXXX XXXX, I am reaching out to you in hopes that you will hear my concerns, provide me with some assistance or direct me in the right direction. Recently, I completed a pre-qualifying mortgage application XXXX. I used the company 's in-house mortgage broker DHI XXXX, which is a subsidiary XXXX. The amount I requested to finance was in the sum of {$210.00} dollars. After a review of my credit, I was told I did not qualify for any of the FHA Home Advantage Programs, which would provide downpayment assistance, closing costs and credits towards mortgage insurance. I was told by DHI Mortgage that my income debt to ratio was to high, specifically with regards to my student loan debt. I have a credit score between XXXX and XXXX depending on the credit reporting agency that is reporting. In 26 years, I have never missed a payment or have had a delinquency reported XXXX. My credit history clearly demonstrates that I am credit worthy individual. The following is some background information. When my credit file was reviewed by DHI Mortgage XXXX my student loan payment was reporting {$1200.00} dollars a month, which was totally inaccurate. My payment will NEVER be calculated anywhere close to that amount being a teacher in a public school system. I contacted my loan servicer and the payment was recalculated at {$330.00}, which is 15 percent of maximum amount of discretionary income. The payment will be adjusted again in XXXX 2015 under new provisions to the Health Care and Education Reconciliation Act ( HCERA ). The new adjusted monthly payment will be approximately {$230.00} dollars, which falls under the maximum limit set fourth by HCERA of 10 percent of discretionary income. Furthermore, I am a public servant who is enrolled in the XXXX Loan Forgiveness program. After XXXX qualifying payments my federal student loans will be discharged. Is any of this information factored in? None of this makes any sense to me. My current apartment lease cost me {$1600.00} + a month. Now, had I meet the " guidelines '' according to DHI Mortgage my monthly mortgage payment would have been {$1200.00} dollars. This would have included taxes, mortgage insurance and homeowner association fees. Something is very wrong here. My goal is to get a better understanding. On XX/XX/2019, I was emailed a letter of suspension for a mortgage I had applied for with DHI mortgage.The suspension letter contained a listed of documents I would need to provide in order for a credit decision to be made on my file. Some of the documents had previously been provided but one in particular required I visit the county clerks office in a different area of the state. My suspension letter includes a required timeframe to produce the documents of 5 days. It was also suggested to me verbally to shop some other lenders who may have different approval requirements. I then arranged to take a vacation day from work to drive to the clerks office but also began to shop other lenders. On Tuesday XX/XX/XXXX, I was notified by another lender that they could approve my loan with different requirements. I immediately requested my FHA case number to be transferred, DHI replied that they would transfer the loan, no other information was provided. On Wednesday XX/XX/XXXX, I was notified by DHI that I had to pay {$700.00} before my file could be transferred to my new lender for an appraisal. I had not been notified of a completed appraisal nor had my agent or anyone outside of DHI for that matter, no signed reciept for the appraisal had been made by my agent. At this point there was actually serious concerns about the loan being funded at all, yet the appraisal was not postponed. Regardless I delivered the check to the builder in the early afternoon. Approximently 20 minutes after delivering the check for the transfer I was sent an email that I had not met the required conditions from my suspension notice for approval and had been officially denied. I was notified by DHI that they had actually sent my file back into underwriting without the required documents needed in the suspension letter. In a later email I was also told that the document that underwriting had requested were different than what was included in my suspension letter. My letter asked for a payment transcript but the underwriter had requested a verification of mortgage. DHIs suspension letter states that if I do not provide the required documentation within 5 days that no loan decision could be made. Yet in an email the loan officer stated that the file had been re-submitted ( without giving me the opportunity to provide the documents ) and a decision had been made. I believe that DHI prematurely made a credit decision without the required documentation as retaliation for changing lenders. DHI reported a FHA case denial to HUD without giving me the opportunity to even produce the documents needed to make a credit decision, when I decided to use a different lender, all but sealing my fate for a complete denial of an FHA loan.

On XX/XX/XXXX I entered under contract with XXXX. XXXX XXXX XXXX to purchase a new home. They offered a promotion at the time in which new buyers were to receive {$5000.00} towards their home, and additional money towards closing cost if they were to utilize XXXX. XXXX mortgage ( DHI Mortgage ). I agreed to the latter and discussed acquiring an FHA back loan, which necessitated for me to provide 3.5 % of the closing cost for the home ( roughly $ 13K ). I was pre-approved for financing, and provided the necessary documentation to complete the mortgage, and received a locked in mortgage rate of 2.75 % and signed the documentation to lock this rate in up into and through close, so I thought. Roughly one week prior to my closing date of XX/XX/XXXX, I received a call from the lender that I was unable to be underwritten, due to a gap in employment. I had provided information pertaining to the gap, as well as numerous other documents pertaining to my current employment, child, business bank account etc. Subsequently, the lender stated that he/they would be able to get me into a conventional loan, which would require that I put an additional {$7000.00}, for a grand total of $ 21K and I had less than seven ( 7 ) days to come up with this money, or my house would be sold to someone else. On top of this, I learned that my rate would change and when I inquired as to why, I was told because " I went from an FHA back mortgage to a conventional. '' In between this time, I was sent a very vague document in regards to a " interest rate promotion '' that the builder was offering, and the letter was back dated to the date of the original signing of my home. I inquired as to what it was, and was told that it was to lock in " a rate. '' I closed on the home on XX/XX/XXXX and throughout signing the document I was curious as to why my rate was now XXXX XXXX. Roughly one week after moving into my new home, my lender through the DHI Title Agency, sent me a copy of my Special Warranty Deed as well as a copy of a XXXX. On the latter document, it displays the term on my loan in line 13, which reads as follows : Term : Fixed/ Interest Rate : 2.750 %, No Balloon Payment and seller concessions and has my wet signature. My loan was subsequently sold to Fannie Mae, and the loan servicer is XXXX XXXX XXXX on behalf of XXXX XXXX, but disappointingly, I'm paying a 2.99 % rate, instead of the 2.75 %. That .24 % difference adds up over a course of 30 years, and would have undoubtedly lowered my payment. When I complained about this, it went unheard as they were more concerned about their review/rating that I had provided.

During the purchase of a home I was initially quoted in writing from the loan officer ( XXXX XXXX ) at DHI a loan estimate which has changed several times now. Each time the numbers changed and did not make sense to me. I consulted with the Mortgage processor XXXX, who is the person in charge of my file and is responsible for gathering all the final documents for the underwriters review. I asked her if she could perhaps explain the substantially large increase on my file in XXXX 's absence as XXXX told me I can go to XXXX while she is out of the office for any questions. XXXX also was confused about the increase on the loan estimate dated XX/XX/2023. The only extra charge she understood and was able to explain was an extra {$500.00} dollars that I am being charged extra because the property I am trying to purchase appraised lower than expected and I have to pay the difference. XXXX said she would let XXXX 's boss XXXX XXXX XXXX know about the situation and she would get back to me regarding all other extra charges. When I spoke with XXXX and I questioned an additional {$8800.00} XXXX payment charge appearing on my loan estimate she could not give me an answer and said she would have to get back with me. I then asked for help from my realtor XXXX, he and I asked to speak with the Loan officer manageXXXX ( XXXX ) once again and while on a conference call on XX/XX/2023 she admitted that her loan officer ( XXXX XXXX ) had made several mistakes on my loan estimate. These mistakes include Property taxes errors for improved land versus unimproved land. This large sum difference was added to my down payment line item. When I asked XXXX about the additional XXXX she said this was a glitch in their system. I asked her why if she knew about the glitch, why it was not fixed and she could not answer. She seemed puzzled with my question. At this point I felt that I am deliberately being confused by this Representative. It feels like a bait and switch scheme when she talks about the numbers. I am now extremely concerned because I was expecting to close on the home on XX/XX/2023 and with that in mind I paid down payments on movers and made many arrangements to move. All of this insecurity has me very nervous and can cause me to lose a lot of money as I am purchasing this new home to accommodate my XXXX mom that lives with me and as I explained to the loan officer originally I need this home as it is handicap accessible and it will help me assist my moms deeds. In XXXX of 2015, upon retiring from the XXXX XXXX, I initiated contact with XXXX XXXX with the expectations of initiating my first home purchase utilizing my VA home loan benefit. After conferring with a real estate agent that worked for XXXX XXXX ( the wife of a former friend of mine ) she convinced me that I should have a XXXX bedroom home built in the XXXX XXXX XXXX XXXX neighborhood of XXXX XXXX, Florida. During these initial consultations, the agent convinced me that I would have to tender a down payment " in order to guarantee my desired lot location ''. Considering that this purchase would be a VA loan, I was hesitant at first, but she insisted that my money would be returned upon closing of the home. Furthermore, she also stated that the only way that I would lose my down payment was if I backed out of the purchase agreement. Believing this, I tendered the required payment via my wife while I was XXXX as a XXXX XXXX in XXXX. After six months in XXXX, I received news that I had been accepted for hire by the XXXX back in my home town of XXXX, Florida. Upon receiving this news, I returned home expecting to start work immediately. Upon returning, I was informed by the XXXX that it would take a few months to complete all of my new hire paperwork. During this time, my new home was being completed, with an expected completion date of XXXX. I returned home at the XXXX. Once I learned that my hiring would be delayed by a few weeks to a few months after completion of the home, I shared this information with the XXXX XXXX mortgage broker. Without any further consultation with me, she promptly informed me that my home purchase would have to be cancelled until such time as I could prove that I was receiving a pay check from my new employer ( during this time, I was receiving retirement and XXXX compensation, as was my wife, totaling approximately {$XXXX} a month, which would balloon to $ XXXX a month once I was able to start at XXXX XXXX XXXX XXXX ). Although I was disappointed by this decision ( I really wanted that new home! ), I capitulated to their decision and requested that my down payment money be returned until we could start the process anew once I received my firm hire date. Upon asking for the return of my funds , XXXX XXXX personnel informed me that my money would be forfeited as " damages '', but that I could receive the funds back if I purchased a different home within six months from the date of their forfeiture decision.

We started our VA loan mortgage with DHI Mortgage due to buying a home through DR Horton and in order to get " incentives '' offered by the builder ( i.e. money towards closing costs, home upgrades, etc. ). We have had nothing but problems with both DR Horton and their mortgage company DHI Mortgage ( who originated our loan under the guise of " you have to use DHI Mortgage to get all these wonderful incentives '' ) since buying our home in XXXX last year. We received a notice from the mortgage company that bought out our loan from DHI, stating that our escrow account was UNDER FUNDED the entire first year of us living here and because of that, our house payment would be increasing by {$320.00} a month!!! That is outrageous!! After calling around and doing the research, it came to light that the " escrowed property costs over year 1 '' on our original loan paperwork and the amount on the property tax assessment record they provided at closing were 2 different amounts. When I called the XXXX County property tax office they told me that our mortgage originator and our closing attorneys were legally responsible for making sure our escrow account had enough to cover those property taxes since an escrow account is the account your mortgage company uses to pay your property taxes and homeowner 's insurance. I tried to call every number I had, or could find online, for DHI Mortgage, all of which are a " number that is not in service ''. I called the closing attorney, and they told me the same thing the property tax office did. The closing attorney wrote us a check for the prorated tax amount we never received from the builder. They also told us that we should not have been able to close because the amounts did not match. After still not being able to reach DHI Mortgage, we decided to drive up there on our lunch break today, XX/XX/20, and speak to someone face to face. We spoke with XXXX XXXX, and he openly admitted that DHI Mortgage was instructed by DR Horton, quite a few years ago, to base all loan paperwork 's " escrowed property costs '' on a class 3 homestead property exemption which is literally HALF of what it is supposed to be when buying from a home builder. If a property is still under the ownership of a home builder, it is LEGALLY required to be taxed based on a class 2 non-exempt property. Meaning that EVERYONE that has bought from DR Horton was supposed to have a significant house payment DECREASE after year 1.

On XXXX XXXX, XXXX, I was looking to purchase a home. I found a home in my price range with the company XXXX. XXXX. The sales agent XXXX XXXX informed me that I had to put down {$2500.00} and since I was going XXXX that I would get my money back at closing. I gave XXXX XXXX the payment on XXXX at that time not one time did it say that my money " non refundable '' or I would not have given that amount of earnest money. In the coming weeks nothing was mentioned about the matter only about missing paperwork they needed to complete the loan application / process. XXXX XXXX I viewed the home and told XXXX XXXX that I would buy if the price was right and that I was not paying {$1800.00} that I could not afford that. He called XXXX XXXX from the house and she informed him she had room to work the numbers and it would not be XXXX. On XXXX XXXX I met with XXXX XXXX and again indicated that XXXX I could n't pay when she presented me with a payment of XXXX for a house {$23000.00} cheaper than the first house but my monthly payment would be XXXX in difference from the first house. I received emails for the next couple of weeks to send paperwork to complete the process but I did n't, due to my son becoming ill. I informed XXXX, XXXX, and XXXX that I was not going thru with the purchase due to the fact` that could n't afford the home. I was told that I had to submit a cancellation letter. After I presented the letter about a week later I was contacted by DHI Mortgage asking if I changed my mind on the house. I responded with no then was told " well your earnest money is non-refundable '' and told I have to sign a letter stating that. A Mortgage company, DHI, and my Mortgage Broker, XXXX XXXX, who is an AGENT for DHI MORTGAGE COMPANY, interfered with a contractual relationship I had with my builder, who sold me the new home, and my real estate agent and her broker, who agreed that I was to get a " CASH REBATE '' of {$2000.00}. The Mortgage Broker Company, DHI, and their agent, XXXX XXXX did the following : He informed me, 5 days, prior to my new home closing escrow, that DHI MORTGAGE CO. would n't fund my loan, as per XXXX Requirements, if I ( XXXX-buyer of new home ), were to receive my legally agreed upon CASH REBATE. The CASH REBATE FORM WAS LEGALLY SIGNED by the XXXX parties agreeing that I 'd get the {$2000.00} cash rebate. XXXX XXXX, mortgage and agent to DHI Mortgage CO. forced me under DURESS AND BY COERCION and by FRAUDULENT MISREPRESENTATION, to sign a VOID FORM, voiding my {$2000.00} CASH REBATE THAT I WAS LEGALLY ENTITLED TO RECEIVE. He also, " legally '' interfered with a CONTRACTUAL RELATIONSHIP I HAD with the Builder and Agent, who XXXX signed that CASH REBATE FORM, legally guaranteeing me that I WAS TO RECEIVE the {$2000.00} UPON CLOSING ESCROW. LASTLY, it is ILLEGAL to INTENTIONALLY LEAVE OUT SIGNED FORMS that are PART OF THE PAPERWORK, ESCROW, etc. The CASH REBATE FORM, guaranteeing my {$2000.00}, and the VOID form, which I was forced to sign, WERE INTENTIONALLY NOT INCLUDED IN THE FINAL ESCROW PAPERS. Even though DHI Mortgage and Their Agent, XXXX XXXX did n't sign the REBATE FORM, he did legally and INTENTIONALLY INTERFERE with me getting that CASH REBATE, by refusing to FUND MY MORTGAGE LOAN, 5 days, prior to closing. It takes a couple of months to submit papers, run credit checks, have them check my employer, etc. Nobody in their right mind would walk away from a new home after being approved and the loan ready to fund within a few days, and this is the only way the funding would occur, is if I would forfeit my {$2000.00}. It is n't as though I was working separately with a bank or separate Mortgage Co. Remember, the BUILDER OWES and operates DHI MORTGAGE COMPANY, so XXXX XXXX knew EVERYTHING THERE WAS regarding all paperwork, contracts legally signed, etc.

THE TERMS WERE DISCUSSEDWE WOULD ONLY NEED {$11000.00} ( AMOUNT ENDED UP BEING CLOSER TO XXXX ) ON CLOSING DATE. WE DID NOT HAVE THE MONEY AT THE TIME OF SUBMISSION AND IT WAS DISCUSSED THAT WE WOULD HAVE ASSISTANCE FROM MY GRANDMOTHER AND OVERTIME AT WORK. NO WORD FROM THE OFFICE UNTIL XX/XX/XXXX AND IT WAS PRESENTED AS I HAD NEVER INFORMED HIM OF THE SITUATION AND HE STATED THAT I HAVE TO MAKE THE DECISION TO NOT MOVE FORWARD WITH THE LOAN AS THE INFORMATION HE HAS SAYS I QUALIFY EVEN THOUGH DOCUMENTATION HAS BEEN SUBMITED OF THE CHANGES THAT NOW DISQUALIFY ME FROM THE LOAN. HE CONTINUALLY REFUSES TO ADVISE IF HE HAS SUBMITTED THE CHANGES. I am writing this email to submit a formal complaint about my experience DHI Mortgage employee, XXXX XXXX XXXX, XXXX ID # XXXX. I have been working with him since XXXX of XXXX once I submitted my offer for my new construction home. I uploaded all of my final required documents in XX/XX/XXXX. XXXX contacted me on XX/XX/XXXX to inquire if I wanted to now lock in my rate at 4.875 %. When asked why has he contacted me now on XX/XX/XXXX to lock in my rates while they are now extremely high and not back in XXXX when I submitted all of my documents, his response was " well I can't control the rate increases and I can not control the completion date of the home ''. I informed him that I am well aware that he can not control those items, my concern is why is he now contacting me to lock in my rate after they have increased significantly but not back in XXXX after he received every document that was requested from me. He then responded " It was too early to lock in the rate back in XXXX and I told you in XXXX that the rates were not locked ''. I responded once again, that I understand XXXX was too early and I am aware that the rate was not locked back in XXXX but I wanted to know why this option was not presented to be back in XXXX after all of my documents were submitted. He could not provide me with a logical answer instead he kept repeating that it was too early back in XXXX to lock in the rates. So I asked why was it too early then but not too early now knowing that my home is still not completed? He could not provide me with a response. I am extremely frustrated knowing that because this agent dropped the ball and failed to disclose to me back in XXXX that I had the option of locking in my rate for 60 to 90 days as he mentioned on the call on XX/XX/XXXX, that I went from 3.25 % back in XXXX to 4.875 % now. I am referencing the XXXX rate because I did not hear from him in XXXX or XXXX to know what the rates were at that time. I emailed a written complaint about this agent 's action to the branch manager as well as well a written complaint to the builder.

I closed on a new construction property in Florida that is part of a Community Development District with a 30-year bond payment and O & M fees that are billed annually on my tax bill. While these fees were disclosed to me at contract and included on the first Loan Disclosure, there was a mistake made on later disclosures which reduced the total CDD amount from {$2500.00} to {$230.00} per year in the escrow estimate. The final loan disclosure at closing also had this error. I used this information from the loan disclosures to budget my annual mortgage payment and then made a decision to change from a 30-year term to a 15-year term. Once my first tax bill was sent at the end of XXXX, I realized that the CDD fee is a separate amount, above and beyond the property tax which was not properly explained or disclosed in any of my closing documents. In fact, the mistake is captured on an Unimproved Tax Disclosure which was signed at closing. The end result is my escrow account was short {$9800.00}. The mortgage company did notify me to send an extra {$410.00} per month to account for the difference in taxes assessed at closing on raw land vs what would be billed in XXXX on the improved land. This equals {$4900.00}. Because my escrow was in further shortage, I sent {$6700.00} to escrow in XX/XX/XXXX. But my escrow is still short plus required reserves resulting in my mortgage payment increasing by nearly {$800.00} per month in XXXX. I believe my mortgage in XXXX and beyond will be well above what was disclosed on the final loan closure due to this CDD error which DHI Mortgage has admitted making. The mortgage company has agreed to compensate me for just over {$2000.00} which represents 14 months of what they calculate the CDD error to include. I believe their mistake impacts me for the 30 years of the bond payment. Even after closing this mistake continued with an email in XX/XX/XXXX which is attached. Lastly, my loan was sold from DHI Mortgage to XXXX XXXX lending effective XX/XX/XXXX. To my escrow shortage is being paid to this lender.

XX/XX/2020-started our mortgage process with DR Horton XXXX XXXX - applying for a va loan ( husband is XXXX XXXX military ) -our anticipated closing date is XX/XX/2020 XX/XX/2020- refinanced one of our vehicles to help with our debt to income ratios. $ XXXX/month to $ XXXX/month. In addition pay off a small credit card balance. Done. -At this point things seem to run smoothly Communication between all parties have been flowing. XX/XX/2020- Confirming documents, asked clarification for student loan debt ( {$4600.00} ) if it will affect our mortgage approval. Our loan team said no. XX/XX/2020-Our closing disclosures have been signed and sent back to the loan officers we are waiting further instructions regarding closing day details. XX/XX/2020- Our loan officer called us saying we need to pay off the student loan listed above. 2 days prior to our closing date. At this point I think they were forcing a scar tactic on us to just walk away. However they said the VA underwriter flipped our loan from approval to conditional due to this one debt not being payed off. In the email they sent us was to create a money order for {$5.00} to pay off the student debt. Obviously this amount doesnt match the loan amount above. Due to this new requirement for us to close they insisted we bring our form of payment to the close on XX/XX/XXXX. Between XX/XX/XXXX-XX/XX/XXXX We were not given new closing disclosures to sign and send back. XX/XX/2020- I wrote the loan team back asking for new disclosures to review the closing amount. XX/XX/2020-Loan teams response was they couldnt send them out to us by the end of the business day. XX/XX/2020- Our loan was approved again. Still no new disclosures and were told to bring a check to closing to cover the debt. We soon found a home that we liked and went under contract with DR. I purchased my home from DR Horton and obtained my mortgage from DHI Mortgage and used DHI Title to close on XXXX XXXX. At settlement, they collected {$1200.00} from me for three months of property taxes. Soon after closing, they sold my mortgage to XXXX XXXX XXXX ( XXXX ). After selling my mortgage, DHI Mortgage paid my property taxes in full ( XXXX ) and requested that full amount be sent back to them from XXXX in XX/XX/XXXX. I had noticed my escrow account balance was extremely low and asked for an Escrow Analysis be performed by XXXX. While I was waiting for this to be performed, I noticed on my transaction and payment history with XXXX that {$3200.00} was sent to DHI Mortgage on XXXX XXXX. I then went back and looked at my Closing Disclosure and confirmed that I had paid {$1200.00} towards property taxes at settlement. I contacted DHI Title on XX/XX/XXXX about this and have not had a resolution to this issue. I had been told that XXXX XXXX, the Area Manager with DHI Title Agency, had escalated the issue to their Customer Care team. I received an email from XXXX XXXX Customer Care Specialist with DHI Mortgage on XX/XX/XXXX stating that they reached out to XXXX and they decided that another escrow analysis was not needed. That a new analysis will be completed in XXXX of this year. They have never addressed the fact that they still have {$1200.00} of monies I paid to them at settlement for three months of property taxes. I have not been given any explanation as to why the requested the full amount be sent back to them from XXXX. I understand that they paid the full amount of taxes outside of settlement, and they are due monies from my current escrow account, but not the full amount. It should be {$3200.00} less the {$1200.00} they had already collected from me. The entire transaction with Horton has been a nightmare. On XX/XX/2022, I received an email from what looked like to be my mortgage XXXX about the closing of my house. The email had my XXXX email address, name, email format of the mortage company, my closing costs ( {$29000.00} ), and address of my house. I followed the instructions of this and made the payment cost for the closing of my house. On XX/XX/2022, my Mortage XXXX had called me and told me how I planned to send the money for my closing ( Keep in mind that the builder and mortage company did not tell me the exact closing date of my house yet, only the general time ). I was surprised because I thought I sent it, but apparently there has been a hacking and sending of fradulent emails within the company the past. The hackers had intercepted the emails of the closing ( included closing cost, address, etc ), and impersonated the people I was in contact with. They misled me into sending a fraudulent wire transfer through this, as almost everything seemed OK and only a few people had this information. This fradulent bank account was a XXXX XXXX account. This has been going on since XX/XX/XXXX at DHI Mortage, and they failed to inform me of this until XX/XX/XXXX, when I was too late to stop the wire obviously. I still filed this to XXXX ( my bank ), to recall the funds from XXXX XXXX account ( fradulent bank account ). I also went to multiple XXXX XXXX location, and managed to create a compliant to them to investigate this account, but they failed to freeze it and far as I know this account is still active. I believe that dozens ( maybe XXXX ) of fake XXXX XXXX accounts were opened up during this time period, and the closing/housing information of XXXX of people who worked with DHI mortage were stolen by these hackers. DHI Mortgage failed to provide the appraisal as required. Section 1002.14 ( a ) ( 1 ) requires that the creditor provide copies of appraisals and other written valuations to the applicant promptly upon completion, or no later than three business days before consummation ( for closed-end credit ) or account opening ( for open-end credit ), whichever is earlier. The appraisal is dated XX/XX/2021 but wasn't provided to me until XX/XX/2021. This is not prompt. I followed up with her several times to obtain a status and she was never forthcoming with any updates. DHI Mortgage Originator, XXXX XXXX, apologized for lack of transparency and assured me that this was a coaching opportunity for her. However, she called me on Wednesday, XX/XX/2021 to tell me that I should be receiving our revised closing disclosures the same day, or the following day. I heard nothing from her until Tuesday, XX/XX/XXXX ( today ), with no further updates about the revised disclosures. She only called to delay the closing because she had concerns that the closing package wouldn't be ready by our agreed upon closing date. She has previously re-iterated that the closing date in our contract was a projected closing date. I asked that the closing remain at the time we already agreed upon due to having a utility appointment for later in the afternoon. She said she would notify the closing department and get back with me. She did not contact me to advise whether closing was moving forward as scheduled or was firmly being rescheduled to accommodate their lack of planning and effort in getting the documents completed timely. I write this complaint of DHI Mortgage 's shady appraisal practices and complete lack of transparency about their processes. I write this complaint not knowing how much cash is needed to close nor when the closing is scheduled.

Approximately a year ago I applied for a VA mortgage loan through DHI Mortgage in XXXX XXXX, FL. after submitting {$5000.00} deposit on the house. For several weeks two or more individuals withing this organization requested financial information which was provided as many as XXXX times either by email and/or fax. During this ordeal I was assured numerous times that any of the items provided was the absolute final item needed ... only to followed by yet numerous additional items ad nauseam. The process became so overwhelmingly redundant with unprofessionally absurd with duplicative requests. When it was an obvious given that DHI had no intention of approving the loan, I requested my down payment returned which they denied under the blatantly false pretense that I refused to provide them with information. A stalemate was established in that DHI vehemently refused to approve or deny the loan so that the {$5000.00} did not have to be returned. Under advice from my realtor, I sought another home through another builder which happened to be of greater value with another lending institution. Providing the very same financial information provided DHI days/weeks prior, my loan was approved smoothly for the new home purchase. During this more professional association, we were complimented on how pleasant it was to have effected the loan in an expeditious manner including the submissions of financial information in a concise and accurate, timely manner. Additionally during the time frame just prior to the DHI ordeal, my primary residence was refinanced which was a second mortgage loan approved by yet another lender ... again with the same financial information provided. I am a highly qualified individual with an impeccable financial records. They are discriminating against me as a woman, and as a honest individual. They have asked for so many documents and as i produce they want more. There is a sense of mistrust because they are scammers and feel everyone is like them. This company has gotten big and rich by scammers hard working class individuals like myself and feel if I am a woman then I am stupid. Please look into these peoples scam and shut them down. My credit score is amazing, i have 20 % Debt ratio, however DHI proceeded to search for reasons to deny my loan. They harrased my HR department and constantly asked them to verify that my letters of explanations were true. They were never satified with my letters and kept searching for a reason to increase my debt to income by taking into account minor details such as gas and meal expenses. DHI also stated my income was incredibly less than what i reported on the application. After they verified my income to be true, they proceeded to asked my HR provide a written letter explantion of my pay because they werent satisfied with the employment/income verification. They also stated the only way to make the loan more favorable to underwriting was to increase my down payment. I wanted to add a cosigner but i was discouraged to because " they can make it work '' without one. The loan was sent to underwriting 5 times, and 5 times it came back with more excuses. I was eventually told all this info is needed for the investors to buy the loan. Its one thing to ask for information, but its another to continually harass my company and ask if i was telling the truth. Why do they need more down payment if they didnt believe i make enough to pay the loan? Why is my loan already being set up to be sold to investors before being approved. The worst part was that i put my vacate Notice to my apartment 2 months prior, with all the time wasted By DHI, i had 2 weeks left in my apt and was going to be homeless soon. I had no choice but to cancel the loan and renew a lease. Didnt need the house if i have a lease. I spoke with a lawyer and they advised me i was prematurely denied, for no reason other than discrimination.

Good evening, I recently closed on my very first home on XX/XX/XXXX. With all the excitement and incentives received on my behalf was a Blessing in so I thought. As of today XX/XX/XXXX I have yet to receive the Realtor Rebate to pay off my early termination fee for my apartment. This noted on my closing disclosure and documents Ive signed throughout this process prior to completing the closing. As of XX/XX/XXXX, I turned in my keys to my apartment complex and found out that they have yet to received the realtor rebate. I contacted my realtor at XXXX XXXX and continue to ask whats going on. I was referred back to the XXXX XXXX XXXX XXXX. Someone is passing the Buck. I paid a visit to the title company DHI to be informed that the information was wrong and they dont know what to do or what happened and that the credit was there but was not billed. This is a very big issue for me, because this could go against my credit on none payment of early termination. At this time I feel that the company is giving me the run around and not fessing up to the truth to what happen and what they will do. The realtors broker tried to contact title on several occasions to be informed that no one is in. What I want to happen from this complaint is a check in the amount of {$2700.00} to be paid to the perspective company on file. We are in the process of purchasing a home from Dr Horton in XXXX TX. We were offered a 4.99 % interests rate and up to {$10000.00} paid towards our closing costs, if we went through there lender DHI Mortgage. After weeks of working with them they said we were qualified. A little over a week ago they wanted a letter of explanation for differences in XXXX 's from XXXX and XXXX taxes. That was sent, now it is because my company is not liquid enough. I have sent everything they have requested and we are still getting the run around. I spoke to our loan officer and requested to speak to her manager. She gave me his number and assured he would call me when he got out of meeting. I called him later and it goes straight to voicemail and he has not contacted me at all. We bought a vacation home this summer and was qualified and purchased the home and that Mortgage Company had all the same XXXX and XXXX information the DHI Mortgage has received. I Actually sold my primary residents to down size with this home in XXXX and all costs are going to be less, but yet we do not qualify with credit scores hovering around XXXX. We have not even received an executed contract signed by the seller. My home has sold and we close tomorrow and only have till the XXXX of XXXX to get out on lease back. I was told today that our applications was denied and agin no-one in management will talk to me directly to explain why. The loan XXXX has not given me a understandable explanation with facts. We think it may be to get out of 4.99 % interest and paying closing cost when they know we are tied in at this point.

XXXX of XXXX wasn't any help she requested that I refinance my car and I that I put 5 % down payment. My agent asked to change the close date to XX/XX/XXXX, we was told we would get the updated close date document, we never received it. I was suggested to go to a third loan office late XX/XX/XXXX/XX/XX/XXXX to I provided them with all the required paperwork and was waiting on a pre qualification letter. Then I started to get emails about the contract which my sales agent told me to disregard and sge would to let her sales manager know we were waiting for XXXX to provide a prequal. To later learn while I was still actively under contract for the for that home another buyer was allowed to place a backup contract on my house. Needless to say XXXX XXXX cancelled my loan and put the new loan in effect. Despite doing everything I was asked I still lost the house. I am very displeased with the home buying process.

I applied for an FHA mortgage in XXXX XXXX At the time of the application, I was not informed that there was a previously completed FHA appraisal on the home that was less than my contract offer. Over the following weeks, there was delay after delay after delay and no one would explain the reason for the delays and requests for irrelevant items. More than a month after the contract, the previous FHA appraisal was disclosed. It was only disclosed because the DHI mortgage team had exhausted all efforts to get a new FHA appraisal and hide the previous one from me. They were forced to negotiate in light of the lower appraisal price. During the process of waiting for a clear to close, our mortgage agent stated that I would not be charged the appraisal fee as the appraisal had been done for a previous buyer. Once DHI was not able to get a new appraisal the rest of the settlement process moved fairly quickly. The day of settlement when I received the XXXX, I noticed the appraisal fee was still listed as being paid by the buyer as well as a general category of " seller credits '' in the amount of {$15000.00}. My realtor and I both requested an explanation of 1 ) Why the appraisal fee was still on the XXXX and 2 ) What items were included in the " seller credits. '' My mortgage agent said she would get back to us by the end of the day with the explanation. She did not. In the 6 weeks since settlement, the accounting of what was included in the " seller credits '' has been requested multiple times and has still not been received.

Hello, We had applied for a loan with DHI Mortage on XX/XX/2021, the Loan officer XXXX XXXX XXXX NMLS ID # XXXX, gave a go-ahead to submit the offer to our realtor on the same day. On XX/XX/XXXX XXXX called us to confirm the loan and said we have to get a letter from the employer to prove that we will have the same salary after we move to XXXX. Firstly we are in the same or similar job for 12 years and have XXXX down in cash, XXXX salary and XXXX credit score applying for XXXX loan. She didn't do any due diligence to confirm us what info she needed on the letter would need to take a loan. ( we called her multiple times, reached VM, emails, texts were not replied to ). We wanted to know what exactly should be in the letter head of the letter from the employer. ( Legally she should not ask us on securing future employment details ). The next day we were asked to sign the purchase agreement and we did. Our realtor was told we won the bid and an email would be sent in 1 hr confirming it. the next day she send us a denial letter saying the length of the employment History was the reason on denying the loan. She never tried to speak, ask and help us to acquire the House.the calls and VM, emails texts were not replied to and missed doing any due diligence on it. she dint care for us/neglected us. we were clearly discriminated by Builder, the loan officer based on nationality and race. They evaluated us on how to eliminate this application rather than giving it a fair chance. Please look into this.

We are escalating this matter due to the lack of communication and customer service we have experienced with DHI Mortgage. On XX/XX/XXXX we were pre-approved for a mortgage loan to start the building of our first home. During that time we received no communication regarding the loan process until I received a phone call from our loan officer on XX/XX/XXXX advising they will not be moving forward because my income had changed. I provided a letter from my employer providing a breakdown of my bonus structure. However, it was communicated that we can go to another lender. We proceeded to do so, and received a verified approval on XX/XX/XXXX from XXXX mortgage. Our realtor submitted the verified approval, however DHI did not take the time to review it and declined it with no explanation why on the same day. The only feedback received was " Corporate '' denied the loan and still no explanation why. As a consumer I have the right to know the reason why the mortgage loan was declined, and what steps were taken to make this decision. We did everything that we were told to do by the loan officer ; however, she failed to communicate regularly or update us on the status of the application until the very last minute. I had an issue with the points that were on the disclosure because it was explained to my husband and I that my credit would be ran again before closing after my credit was fixed so that would would not have to pay for points. I brought up that up to the the supervisor XXXX XXXX and she said that the builder may not extend the close date and we would have to start the application process over. They did not confirm final approval until the day we closed. They kept telling us the last 30 days prior to closing that we may not get approval because of a mistake the loan officer, XXXX XXXX made with our loan processing. This was very deceiving because we made to believe that if we did not close on XX/XX/XXXX we may lose the home due to an issue with a document they needed from the IRS for the current tax season that was not due until XX/XX/XXXX. Somehow everything worked out and we were able to close but we were rushed and pressured to close on the same day the closing disclosure was emailed to us. We did not have efficient time to get anything corrected or seek legal help. When I asked XXXX what she could do about it, she told me nothing because we close in a few hours. We paid XXXX in points when we should not have had to. It took me time and money to correct my credit only to be taken advantage of by the lender for their financial gain.

My wife and I entered into an agreement to buy a home from DR Horton. They recommended we use DHI Mortgage company for the loan. My wife and I were both on the application and got pre approved for the mortgage. Since it is new construction it has taken some time for the home to be built. It is not ready. When the covid-19 pandemic hit my wife lost her job with XXXX and is currently not making any money. My credit score has taken a significant hit as well. I have reached out to XXXX from DHI on numerous occasions through voice mail but she will not return my calls. The last email correspondence was on XX/XX/-20. Therefore I went to another mortgage company to inquire about the possibilities of going through them instead. I was told that my credit score is to low to qualify and was denied. I gave the realtor the denial letter to submit to DR Horton so that we could get the {$5000.00} binder returned since we don't qualify for the loan anymore. They in turn terminated the contract for the new home but refuse to release the binder to us claiming we breached the contract which is untrue. The truth is we no longer qualify. I called DHI yesterday and spok with XXXX who is the manager and XXXX 's boss. I requested either an approval letter from him or a denial letter. I have received neither. He was supposed to email me last night about starting the process but I heard nothing from him.

During the process of speaking to the sells person at XXXX. XXXX XXXX XXXX XXXX in XXXX XXXX Louisiana, I was referred to DHI Mortgage XXXX XXXX XXXX XXXX XXXX, and XXXX XXXX XXXX XXXX I was approved for my home to be built in XX/XX/2018, we have had several appointments throughout the build and now my home is almost completed. in meeting with DHI Mortgage my lender, I wasn't given the initial loan estimate after the contract was executed in XX/XX/XXXX, Their was a property address issued at the time. I spoke with another lender who reviewed my credit in XX/XX/2018 and based off of my self and my wife 's income we were never able to qualify for a loan in the amount of {$230000.00} which is the amount of my purchase agreement for this loan. I feel like fraud was committed against us, because accurate information was not given, DHI Mortgage ran my credit multiple times, hurting my score and I was never given any domination other than the contract to purchase and some type of XXXX XXXX XXXX XXXX XXXX. I never received any information on what my estimated monthly payments would be and the amount of cash needed to close. I found out from another lender that my payments would be well over {$1200.00} per month which is what I am comfortable with. I think that was considered unfair practices, I never signed my initial loan application with loan estimate disclosure with DHI Mortgage.

I went under contract on a home with a XXXX XXXX home on XX/XX/19. I applied for a loan and was prequalified through DHI Mortgage ( Company NMLS # XXXX, Branch NMLS # XXXX ), their lending company. I received a loan application about a month later, but my finances had changed. I informed the current loan officer, XXXX, NMLS # XXXX, that my current financial position is not the same. I have also informed XXXX XXXX, the sales representative. I have asked them both to update the loan application because I will not sign for a loan that I don't qualify for. I did the right thing and disclosed my current financial position. XXXX XXXXXXXX and DHI Mortgage are trying to force me to apply for a loan with incorrect information because based on the inaccurate information, I qualify for the loan. They will not update the information in question, and are telling me I have to withdraw from the contract and forfeit my $ XXXX earnest money. I have requested several times to have the loan application updated, and they keep telling me they will not update it because based on the old information I still qualify. I have explicitly stated that I am aware that misrepresenting finances on a mortgage application is mortgage fraud. I tried to get mortgage to purchase a house in Florida. DHI Mortgage ( lender ) in collusion with D.R. Horton ( seller/builder ) engaged in a bait and switch scheme on interest rates, as well as to manipulate the mortgage application process to support D.R. Horton 's position to give DR Horton an unfair advantage on issues re.the contract/ Agreement executed XXXXXXXX. Closing on my first home in XXXX days and I am confused about the credits listed on the purchase contract as well as my cash to close. The lender used in the process is an affiliate of the builder/seller who has not been transparent with the numbers listed on the closing disclosure. I began asking questions on XX/XX/XXXX via email or text when I received the closing disclosure with a closing date of XXXX which was an error since my closing date was moved to XX/XX/XXXX. I asked multiple times for them to explain the breakdown of the credits as it is not clear on the XXXX. I am a veteran who is allowed to receive my earnest money paid as well as my tax credit back at closing, which DHI has repeatedly denied me of. At this point, I can not cancel the contract as I don't have another place to live and am expecting my first child in XXXX days. Signed contract and applied for a End Loan with XXXX XXXX/DHI Mortgage in XXXX XXXX. I provided all my documentation right away within 30 days of the original contract date ( information was sent by way of email directly to the Mortgage Loan Officer ( MLO ) and can be provided ). Per the contract I was suppose to have a pre-approval within 30 days of the contract. Dear XXXX -- I have had continuous issues with DHI Mortgage in applying for my new home loan. There has been misclassification of a XXXX gift from my mother that they tried demanding was a " downpayment '' gift more than XXXX weeks before my decision to purchase the home. They tried to force my mother to sign an illegal gift letter and wanted her personal account statements to review although she has no relationship to my home. They have also begun calling employers I have not had any contact with for over 3 years even though they have W2s and tax returns. They have refused to believe I am employed with my current employer and have asked repeatedly for their " employment verification service '' they use. They have an offer letter, W2s, and pay stubs for verification here. They have further harrassed me by continuously spelling my name wrong and asking for bank statements back to 7 months before the expected closing of my home. Lastly, they are adding {$1100.00} in closing fees for unknown reasons and have refused to explain the charges. These type of deceptive and harrassing mortgage practices should not be allowed to continue.

In the light on COVID-19 my partners job has been considered nonessential and he is temporarily out of work. I am considered essential as I work in a XXXX and am still going to work. We chose to back out of the contract and DR Horton agreed to let us do so since we are only now working off of one income. We applied for a mortgage with DHI and received an initial Closing Disclosure XX/XX/XXXX. Our closing was moved to XX/XX/XXXX and we never received an updated Closing Disclosure. I reached out to the Loan Officer, XXXX XXXX, on XX/XX/XXXX asking for an update and a revised Closing Disclosure. She informed me I would receive XXXX on Monday XX/XX/XXXX. We never received any documents. On XX/XX/XXXX I asked XXXX again when we could expect an updated Closing Disclosure with no definitive answer. On XX/XX/XXXX, XXXX day prior to our closing, I reached out to XXXX asking for a Closing Disclosure for the third time. I informed her we did not feel comfortable moving forward with closing with only verbal closing amounts over the phone and that we would need to see a Closing Disclosure by the end of the day to move forward with closing the next day. I was relocating from one state to another and I was continuously giving the run around from DHI Mortgage in North Carolina about job verification and pay. I was given two different closing dates. I scheduled my moving company around the first date along with transferring utilities into my name. When the closing didn't happen I had to stay in a hotel from XX/XX/XXXX till XX/XX/XXXX for weeks and I also had to get a storage unit {$190.00} for a month and hire an additional moving company to move my items once I closed. I have been at my job now for 19 years. I was not starting with a new company I was currently transferring with the the same Government Agency. I thought steering was Illegal? Now we stand to loose the {$5000.00} discount offered by the builder. Builders should not be allowed to penalize the consumer by simply choosing another lender that is not affiliate d with XXXX XXXX . Why is builders sales rep allowed to stiff arm, steer, and guilt us into using their own lender. This must be stopped!! Any feedback would be greatly appreciated.

I am in the process of purchasing a new house with XXXX XXXX and elected to use their mortgage company, DHI Mortgage as the lender. In starting the application I was given a number of forms to sign electronically, however, when it came to collecting the documentation to substantiate my qualification for the loan, the loan officer told me I could email my information or fax it. When I was inquired about a secure upload since I was being asked for bank statements, tax returns, pay stubs, etc I was told to just encrypt the PDF. I would feel more comfortable with a dedicated secure upload. For the average consumer it would not occur to them that email is not the most secure way to send the documentation and most are unlikely to think about encrypting or otherwise protecting their information. At this point it has taken significantly extra time to submit the documentation since I know have to locate the documentation, print and then arrange for use of a fax machine which is very costly if I elect to go to a print shop or other commercial provider.

We worked with DHI in XXXX. 2 days before the closing they asked us for documents that we sent weeks ago. 1 day before closing they were still asking for documents that we already sent in. The day of closing they had us sit in the conference room for 3 hours just to tell us we had to push our closing. During the whole process of the building portion of our home THERE WAS NO COMMUNICATION between us and our loan person. Every time we would email XXXX, XXXX, and XXXX WE GOT NO REPLIES. No one would ever pick up the phones. The day of closing they tried to say the paperwork wasnt ready and then another person came in and said it was. The team dont communicate with each other. XXXX would says one thing and then XXXX would say something TOTALLY DIFFERENT. After we closed we went to get our stuff and come back. I had several problems with DHI lender and underwriting. I was told we would close on the house XX/XX/2020. Today is XX/XX/2020 and I was told on XX/XX/2020 that my Income was too high for down payment assistance. I was lied to in XXXX and was given false disclosures. I was asked to extend my lease and also to drain my 401k to pay down credit cards. I applied for a mortgage through DHI mortgage in XXXX. I was sent a loan estimate with no cost for points in XXXX. The night before to get the CD deadline XXXX they changed the amount charged for points which was not on the estimate in XXXX. Otherwise they would change my interest rate and delay my closing for a 2nd time. The 1st delay was due to the fact the lender representative forgot to submit the loan. Therefore, I had to stay in a rental property at a higher rate of {$1900.00}. Now I am going to be forced again to pay DHI an extra {$2000.00} or {$1900.00} for the rental property for another month. The stupid XXXX 3 day for CD disclosures to the consumer is the most ridiculous rule that has ever been created for the real estate community. Even if the CD changes the title and lender has to eat it. As a borrower my new home is ready and these changes has delayed us being able to get into the home 5 days and possibly more than that because of the XXXX XXXX holiday. I would think that after 3 months of searching for a home, and 30-45 days of underwriting and getting everything to the underwriter except a sample of blood, that the last thing I would want is an unnecessary delay. By that point in time I am pretty confident that I just want the keys to my new house!! I still do n't get an initial disclosure and then the closing disclosure that I need 3 days to review. I closed on a townhome XX/XX/2023 ; it was a new build with developer XXXX XXXX. The lender was the developer 's, XXXX. An appraisal was completed for financing in which the home appraised for XXXX, XXXX which was the price of the home. After completion and closing I emailed for a XXXX appraisal, as it stated I was entitled to. It is over 5 months, and they are still requesting documents, many of which have already been given to them. I am very disappointed with DHI for selling my loan to XXXX XXXX XXXX. They offered me a low interest rate and then sold my loan to XXXX XXXX XXXX that has a bad reputation. Since XXXX transferred my loan, XXXX has only processed one of my payments. I have three payments that XXXX has not processed. I called to inform DHI on today, XX/XX/XXXX about my disappointment and asked if my loan could be transferred back to DHI but the rep I spoke with was very unprofessional and rude. I did not catch his name, but I made the phone call on XX/XX/XXXX, around XXXX.

On Friday XXXX, I asked my loan officer XXXX XXXX XXXX from DHI Mortgage to give me an updated quote for interest as the rates had gone down from that morning at which she refused to do so. Interest rates have now risen and I was blocked from being able to lock in at the lower rate. This was the second time that she refused to allow me to lock in a rate. The first time was when I asked for the rate to be locked on XXXX which she declined to do. Because of this, she is going to cost me XXXX more in closing costs as well as monthly payments.

I'm in the process of obtaining a loan with DHI Mortgage, the in house lender for DR Horton. The appraisal did not meet value and the lender is insisting in waiting for another appraisal to be completed in order for me to close on the house. I'm literally homeless after the XX/XX/XXXX and the lender is insisting in having another appraisal completed. I have been under contract for over 6 month with this situation. The home is ready and I have been promised to close several times and no closing yet.

XXXX/DHI has violated my rights under 15 USC 1692. 15 USC 1692a ( 6 ) states what a " debt collector '' is and XXXX and DHI both fall under this statue. Amongst more violations, Pursuant to 15 USC 1692e. ( 11 ), XXXX and DHI failed to disclosed in the initial written communication with the consumer that they ( debt collectors ) were attempting to collect a debt and any information obtained will be used for that purpose.

A VA funding fee was financed into my loan amount, without an option to pay the closing funding fee paid at closing. The seller were to pay all closing costs. Case in point : Escrow funds were not paid by seller, until I inquired and requested the funds for the escrow shortages, of which I still have a deficit. Other issues are now under investigation, concerning the payments paid at closing.

During the mortgage process I asked the lender to match the rate of the competitor. They obliged my request but failed to disclose that they obtained that rate not by matching it but by having me pay points to buy the lower rate. It was not broken out separately in the closing documents and was only brought to my attention when the tax statement for points paid arrived.

I do not have a credit score because I do not have debt. I have paid for everything in cash. DH Mortgage told me I either need to get a credit card or pay in cash. The FHA loans do not require a credit score and it could be done with manual underwriting.
