The CFPB Portal has listed a complaint as " open '' and " sent to the company '' for several months, and I have not received a response. A copy of the complaint and print screen of the complaint status are being included with this submission. Although I have filed complaints against Delta Management Associates , Inc. in the past, this is a NEW COMPLAINT. After filing in the past, Delta Management Associates , Inc. suspended the illegal garnishment on XXXX XXXX, 2016. However, two months later, they re-started. They sent a new Administrative Wage Garnishment order to my place of employment, and I was never notified of this action. Delta Management Associates , Inc. has been illegally garnishing my wages since XXXX XXXX, XXXX. They have spoken with my employer multiple times, misrepresented who they are collecting on behalf of ( XXXX XXXX ), and misrepresented what they are collecting ( a student loan ). Delta Management Associates , Inc. never provided debt verification or debt validation. I requested proof of the existence of a debt multiple times, and I did not receive any proof via the CFPB, BBB, or California Attorney General complaint processes. I have never received, or been sent, any mailings by Delta Management Associates , Inc . Since we have been in contact via mediated complaint processes, Delta Management Associates , Inc. could have easily attached the documents to the portals ( i.e. via the CFPB and BBB ). Delta Management Associates , Inc. also could have mailed documentation to the California Attorney General. Nothing has been provided. When presented with the FTC Identity Theft Affidavit, Delta Management Associates , Inc. did not cease its illegal collection practices. I am filing lawsuits in the State of California. I have consistently explained that I did not obtain student loans and do not have any debt. I have provided the ledger from XXXX that reveals that there are balances of {$0.00} for the debts that Delta Management Associates , Inc. claims it was contracted to recover. This was provided after engaging in the CFPB complaint process against XXXX for misrepresenting itself as XXXX XXXX. During the complaint process, XXXX provided a currently fillable Master Promissory Note form with fake information. XXXX XXXX is the XXXX employee who is responsible for providing this form. XXXX XXXX, from Delta Management Associates , Inc., is the party responsible for not providing written notification about the debt, threatening the illegal action of garnishing on behalf of the government, continuing to collect after being informed of Identity Theft and a legitimate dispute as to the existence of the debt, and engaging in knowingly false statements and misrepresentations about his attendance at the University XXXX XXXX with me. He has lectured me about " the difference between an imbecile, moron and retard, '' and indicated that I am not appropriately representing my college by failing to pay my debts. His tactics are deplorable, particularly since he has received definitive proof that I do not have any student loans. My employer never should have been contacted multiple times by Delta Management Associates , Inc. During the time of contact, Delta Management Associates , Inc. was violating a CEASE AND DESIST. I have included a copy of the ledger obtained from XXXX, which shows that there is no balance owed. Delta Management Associates , Inc. is not legally permitted to issue an Administrative Wage Garnishment. This needs to cease immediately, and I need the return of my illegally seized wages. Further XXXX and Delta Management Associates , Inc. need to cease in their illegal collusion and fraud. I have demonstrated that this Identity Theft did not happen years ago ; there is no proof of pre-existing loans. This Identity Theft is happening right now, and it is being perpetrated by XXXX XXXX of XXXX and XXXX XXXX of Delta Management Associates , Inc . Please hold them accountable.

I received a letter in the mail from XXXX dated XX/XX/XXXX in which it was stated that my student loan had gone into default status with a contact number to discuss payment options. I called and spoke with a woman named XXXX XXXX at XXXX ext. XXXX. I had a legal name change XX/XX/XXXX, so the conversation centered around 1. payment options and 2. how to get the account to reflect my new legal name since repeated attempts to have the my name updated in XXXX system were never done in the past, even after sending in docs reflecting it. Due to being unemployed since XX/XX/XXXX, I was told I could request to be placed on a payment plan to send at minimum $ XXXX/month to get my account current and that I could submit the official court docs proving that I indeed had a legal name change. I requested the information we discussed to be sent to me via mail. About one month later, I received the payment plan application where I confirmed my legal name, current address, employment information ( unemployed ), and salary/income information. Also, on this letter was an alternate contact email address ( XXXXXXXXXXXX ) in which I scanned the copy of this completed form and attached a copy of the official court documents reflecting my name change. I emailed this information to them on XX/XX/XXXX and requested in this email to be notified/receive confirmation of receipt of these items either in response to that same email or via mail. I never received anything in response. Fast forward to XX/XX/XXXX, where I received a call from a local ( XXXX ) number and upon listening to the voicemail that was left ( from a " XXXX XXXX '' ) was instructed to call XXXX ext. XXXX. No company or affiliation was stated in this message so I had no idea who he was, what organization he was with, or what he was calling about. They spoofed a local number and left a voicemail requesting a call back to a toll free number and appear to be located in Massachusetts. Due to being unemployed for so long, I no longer answer calls from unknown or toll free numbers unless explicitly agreed upon prior and only communicate with confirmed collection agencies that I have received written correspondence from in writing. Not to mention, they were STILL referring to me by a name I no longer use and are the ONLY collection agency doing so ( thus they are using outdated information ). Upon speaking to " XXXX '', he stated that it was an attempt to collect a debt. I asked who he was and who he was calling with because I was then instructed to confirm my name, date of birth, and social security number without any disclosure as to who I was being asked to provide this information to. Once he stated he was with " Delta Management Assoc. Inc '' I recalled that I had spoken to and emailed requested documents to them XX/XX/XXXX and never heard back in the requested format. He stated that they COULD NOT change my name in their system, thus I requested a supervisor. I was then transferred to " XXXX XXXX '' in which more circular convo occurred about updating my name. He later confirmed that I was approved for the payment plan, but they could not get ahold of me by phone and admitted " someone '' dropped the ball. He also stated that since they are a collection agency, they could not respond to me in writing, only phone. On XX/XX/XXXX, " XXXX '' called requesting even more docs ( ID, social security card, and a letter requesting the name change ) to update their end. I refuse to do this unless I receive something in writing for my records so I was transferred to " XXXX XXXX '' who said he needed permission from a manager to do this. They REFUSE to communicate in writing and only want to play phone tag so I will be contacting an attorney as I will no longer repeatedly send confidential info with their refusal to communicate anywhere other than over the phone.

I XXXX XXXX file this complaint with the Consumer Financial Protection Bureau, as I have already proven that XXXX XXXX is using another scam on a debt collection process that has already been beaten in federal court against XXXX . The student loans were all procured well before XXXX , and my student loans were privatized, not owned by the United States Department of Education, or guaranteed in any sort. Originally XXXX XXXX were trying to establish an administrative garnishment, but that was shut down by the Department of Education. The collection attempt was by a Massachusetts debt collector named XXXX XXXX . A second debt collector XXXX XXXX XXXX just closed another illegal collection process on behalf of XXXX XXXX for attempting the same type of illegal collection procedures. A copy of that decision by XXXX XXXX XXXX is attached with an apology from said entity. I am 100 % accurate in my claim that the debts stated owed to XXXX XXXX are not in any fashion connected to any federal agency, that being the U. S. Department of Education. The funds were procured by private entities, sold on the secondary market as part of a securitization, and thus must be collected as private claims through state court actions. The timeline to sue for these funds has long expired. Now XXXX XXXX play a musical chair approach by seeing if another debt collector named Delta Management Associates , Inc., and they are trying to obtain an administrative garnishment. This is not only illegal, but this company did a hearing request where I would have to schedules a hearing to make my defense on this frivolous claim. This is a violation of the stringent collection guidelines within the state of New Jersey. Delta Management Associates, Inc. is not bonded or licensed to do business with any resident of the state of New Jersey. They are a deplorable operation that will attempt anything to collect on any debt, even debts that are no longer enforceable, such as my 20+ year old private student loans. There were several complaints against this company online, and in state courts nationally. An administrative garnishment can only be enforced to the benefit of the United States Department of Education. period. I demand a complete rescission of the attached threat for administrative garnishment. The timeline for a legal collection process on private debts have long passed XXXX XXXX . This false administrative collection process is what got XXXX fired by the United States Department of Education as a sanctioned debt collector, and XXXX XXXX XXXX had no authority from any federal agency to collect on behalf of the taxpayers of the United States, nor does Delta Management Associates , Inc . I have attached a copy of a class-action lawsuit settled with Delta Management Associates , Inc. in a federal court in XXXX . Delta Management Associates , Inc. is not even legally bonded or licensed to do business in the state of New Jersey. My name is XXXX XXXX of XXXX XXXX XXXX XXXX, Virginia. My phone is XXXX or XXXX. This all started when I received a letter in the mail from Delta Management XX/XX/XXXX stating that they were attempting to collect on my XXXX defaulted student loans. My loans had defaulted due to the fact that I had been in an accident with my XXXX causing me to be out of work because I was recovering from my injuries for several months. At the time, I was an XXXX. I was no longer able to work for myself, so I lost my XXXX. During this time, my wife divorced me because I was n't making enough money for her. I had to sell our home and move because she wanted the money and then I had child support payments for XXXX children as well. I had completely lost everything that I loved and I had very little money. I also lost my car. I had to file bankruptcy and try to get back on my feet. I do apologize that I allowed my loans to go into default, but I tried to reach out for help with no avail. When the letter came from Delta Management, I called and asked how I could get my XXXX loans out of default XX/XX/XXXX. The Delta Management rep told me that I had to agree to have my payments automatically deducted from my paycheck and that after 6 months of consistent payments they will take my XXXX loans out of default. So, I agreed and also I agreed to pay 4 payments each month instead of 1 payment in the hopes that I would decrease my balance owed quicker and show my willingness to pay. However, although I have been paying voluntarily, consistently 4 payments each month since XX/XX/XXXX, I have not had my loans taken out of default. I am a military veteran and I am currently in the process of purchasing a home for myself and my new wife, but the loan officer pulled my credit report and showed me that my XXXX student loans are still on my credit report in default status. I was made aware that I can not get a VA Loan unless my loans are out of default. I have paid what I agreed to with Delta Management and am still paying, yet nothing on their end has changed. I feel that I was defrauded by Delta Management and lied to by them just to get my money. I also notice that they have been taking a large amount of each payment as interest and collection agency fees. This amounts to a lot of money as I pay them each week. Is this accurate? Is it legal for Delta Management to not take my loans out of default? I have called repeatedly since XX/XX/XXXX,XX/XX/XXXX and have been told the same thing. I have asked for a supervisor, sent written disputes through their website, sent emails through their website and also the Department of Education with no response from either. although, the website says they will respond within a few days. Also, every time I called the Department of Education Debt Resolution Dept, they told me that I had to talk too Delta Management. Please help me because I have been trying so hard to get this fixed that I am going to call and write my Senator, Governor, Congressman and President of the United States. I ca n't afford for my VA loan to be rejected. I promised my new wife that I would provide a home for us, but I ca n't do it without my Va Loan. This treatment that I received is wrong! I began receiving phone calls from a place that was calling itself " DM. '' They would not state what this acronym represented, and instead said, " Oh, you do n't know? I think you do. '' They would ask for my birthdate and social security number. Obviously, no sane individual gives their Birthdate and Social Security Number to someone who wo n't identify themselves and attempts to obtain personal information. I sent this organization a " Cease and Desist. '' They then contacted my workplace and spoke with the Administrative Assistant for my department. They attempted to obtain personal information about me from her. She provided me with their contact information. I called them again to state that they needed to stop. They said they would not talk to me unless I provided them with my Social Security Number and Date of Birth. Without receiving a single document from them, a " Notice Prior to Wage Withholding '' was sent to the Payroll division of my place of employment. The Payroll Officer provided me with this document. In response, on XXXX XXXX, 2016, I sent them a letter indicating that their actions are illegal. My place of employment said that they then received a notice to stop the wage garnishment. I thought that that was the end of this matter with Delta Management Associates , Inc . They have provided no debt validation, claiming that they can not do so unless I give them my Social Security Number and Date of Birth over the telephone. I have requested that they verify the existence of this debt, which is not listed on my credit, and which I did not enter into with any organization. I have absolutely {$0.00} in student loan debt, and I attended an online program, for which I was given a full scholarship. I maintained a XXXX GPA to keep that scholarship. I also have written documentation from the school indicating that I did not have any debts. Delta Management Associate 's claim that I owe more than {$50000.00} is absolutely ridiculous. The school was an in-state school with tuition of less than {$1600.00} for XXXX semesters. This student loan crisis is appalling and disgusting, and I do n't know why something is n't being done to stop this monumental fraud. Today, XXXX XXXX, 2016, I received another letter from the Payroll division of my place of employment. It is another " Notice of Wage Withholding '' from Delta Management. When I immediately called to determine what was happening, I received the same treatment. They state that they can not talk to me unless I provide them with my Date of Birth and Social Security Number. I called to ask them for their fax number, and in order to receive that information, they state that I must give them personally identifying information. The telephone call was recorded on both ends. I want this matter permanently resolved. Delta Management needs to correct all of its records and cease contacting my current and future places of employment. They also need to stop engaging in illegal Administrative Wage Garnishments, which is not an authority granted to them : a third-party debt collection agency. They are in violation of the FDCPA and my state 's ( California ) Rosenthal Act. I expect this matter to be resolved immediately.

After a long career in the XXXX government my daughter was seriously ill and had a XXXX illness I resigned from my job and went back to school. I graduated from the XXXX XXXX XXXX in XXXX with a XXXX degree in XXXX XXXX during that time I was also working for the XXXX XXXX program a math science and engineering program for underprivileged children in the XXXX public school system as a XXXX XXXX and XXXX XXXX. I also worked for XXXX XXXX Program which was an after school program for children in the XXXX XXXX Projects for underprivileged children as a XXXX XXXX. After I graduated I started receiving notices that I had student loans I contacted the Department of Education because I had heard that if you work for the Government or if you were working in a Job that you received your degree in that you could have your loans forgiven. I contacted the Department of Education got all the paperwork submitted it to the Department of Education I received notification from them that I was not eligible because I didnt meet the guidelines ( which I do not have the information at this time anymore because it's been so many years ) it was not explained clearly to me the guidelines and they never sent back my paperwork nor did they respond to any more of my letters requesting the reason why. I contacted the school and was told that it was for doctors, students oversees, and foreign students but the dept of education was saying it was for all students. But I decided to submit the paperwork again and I told them it was wrong and that the school told me about this and I wanted to know why I could not get the forgiveness. Then several years later I heard about this program again and also heard that the Department of Education was dismissing student loans I reapplied again to the Department of Education for the dismissal then I received a letter ( XX/XX/XXXX ) from the Department of Education saying that I had no student loans which this letter I do have. US Dept of Education Fiscal Service, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX, Delta Management Associates, XXXX XXXX XXXX XXXX XXXX, US Dept of Education Recovery , XXXX XXXX XXXX XXXX, XXXX XXXX XXXX. XX/XX/XXXX my bankruptcy was discharged and no one came forward to say anything about these loans but I did get the letter XX/XX/XXXX saying I had no loans I'm confused on what is going on it has been over 17 years and they are doing this I am on a fixed income and retired and now someone is taking money out of my retirement ( the amount keeps changing ) I called each company they say its not them I called the department of education they say call the company but in the mean time they are taking the money from my retirement check and no one wants to help me or answer questions I have. This situation has caused me a very bad financial hardship. I have tried to get this resolved and no one wants to help me no one is giving me answers but they keep taking the money which has now caused me a Financial Hardship. On XX/XX/XXXX my employer received notice of a wage garnishment order. This was my first notice of this action and I believe improperly executed and has violated my rights. I have been paying XXXX XXXX XXXX, XXXX XXXX XXXX., XXXX OH XXXX since XX/XX/XXXX. ( I provided a copy of my bank statement yesterday. I have a revised copy with the XX/XX/XXXX dates. The copy I sent yesterday only shows the XX/XX/XXXX payments. ) XXXX contacted me at that time and I provided financial information and the hardship I was in at that time. My son is an addict and as a direct result of his addiction, I was in extreme financial difficulty. At this time XXXX card had 2 judgments against me, one Im still paying, $ XXXX monthly and the other I was able to settle. Ultimately my son was Sectioned and with the help of family I started paying back the debt that resulted from this period. Although I moved during the period of making these payments to XXXX, they were made aware of the address change. I have attached a copy of the notice they sent dated XX/XX/XXXX stating they closed my account. This letter has my address and it notes my student loan. My home address was on record as well as my good faith effort to pay back an amount I could afford at the time. In XX/XX/XXXX, I changed employment. You were able to track me to my employer ; however, although my address was on file and noted with my student loan, no attempt was made to reach me at my home address. I had no opportunity to review my loan or negotiate any revised payments. Since I received notice of the garnishment, I was able to review my loan which has an outstanding principal balance of {$48000.00} and {$6500.00} interest balance. My current balance according to the information provider to my employer is {$65000.00}. My employer is complying with the order as required however I am requesting the order withdrawn and the opportunity to renegotiate the loan and payment. Above is the latter I sent to XXXX XXXX XXXX on XX/XX/XXXX. On XX/XX/XXXX I sent all the requested paperwork for consideration with the loan rehabilitation program and requested a copy of my loan history and payment. I have not called them since my initial 2 phone conversations on XX/XX/XXXX and XX/XX/XXXX. I am not trying to get out of my loan but however would like the opportunity to review the information and negotiate a payment schedule. Garnishing my wages without this opportunity, I believe, is a violation of my rights. I provided them with the requested documentation as well as bank statements showing my good faith effort to pay and XXXX 's knowledge of my address. The garnishment, which will be effective in my pay received Friday XX/XX/XXXX is going to place me in a financial hardship. I am supporting my XXXX year old son who has XXXX XXXX. He earns {$20000.00} a year and I provide over half of his financial support. In addition I have only been at my place of employment since XX/XX/XXXX and this has placed me in a very embarrassing situation. Any assistance in getting a hold on the garnishment so that I may review and negotiate my loan payments would be greatly appreciated.

Hello, I 've had a XXXX XXXX XXXX loan in default for a few years. I was never contacted about this specific loan ( all of my other loans are in good standing since they stayed in close contact with me ). I had successfully defered my other loans since I 've been abroad and unemployed, but somehow I never once heard about this XXXX loan until I applied for financial aid again to finish my last year of school and was rejected. So I contacted the collection agency that my loan was sent to : Delta Management Associates. I tried to set up a rehabilitation program but they only withdrew money from my account once. After around two months, I was asked for the same documents again without any explanation ( and I sent them without ever hearing from them again XXXX and then no more payments were ever taken from my account and they never contacted me again. I 've emailed the manager and XXXX employees there several time to ask what happened ( I have proof of these emails and it 's how they corresponded with me before because I am abroad ) and I have n't been able to get in touch with anyone there. I asked several times to send it back to the original lender so I could pay it off IN FULL without he collection agency 's very high interest rates ( I can afford to pay the loan but not the interest they tacked on ) or I asked for the loan rehabilitation to continue and asked why it stopped. In total, I 've sent about XXXX emails without zero response and I tried contacting default resolution at XXXX but was given different phone numbers and sent in circles. It seems no one is willing to help me. I have been trying to go back to school to finish my last year since XXXX 2014, but it 's impossible to get financial aid without this issue resolved. I 'm very desperate to complete school and I would like to go to grad school abroad. I ca n't get a hold of the collection agency Delta Management and they have not bothered to respond to me once. I 've asked XXXX for their advice and they said to lodge complaint and see if I can get the loan sent to the original lender or different agency to pay off immediately ( as long as I do n't have to pay high rates for agency 's fee since they are about an additional {$1000.00} ). They said it was also possible that the loan already went to another agency. So I tried to track it and was told to contact XXXX XXXX XXXX XXXX in XXXX as the XXXX XXXX. So I tried to look up their information to find out that they are permanently closed. Besides this, I was never once contacted about this loan for years until it was too late. I found other students that attended XXXX XXXX XXXX who had this same exact problem with this same exact loan ( zero contact and then defaulted ). So I am obviously very concerned about this and do n't know what my next step should be. I was thinking of getting a lawyer but I thought that could prove to be difficult as I am abroad and if it would really be worth it in the end. I 'm just looking for better solutions.

XXXX, an administrative wage garnishment hearing company, was hired by Delta Management Associates ( XXXX, MA ), a student loan wage garnishment company, to rule on my wage garnishment appeal due to financial strain. My appeal application and financial documents were sent to Delta Management Associates, but they did not respond as to the status of my appeal. On XX/XX/2020, I spoke with a representative at Delta Management Associates who told me my written statement hearing would occur on XX/XX/2020. When I asked the representative why I had not received notification of the hearing, she was unable to provide an answer. On XX/XX/2020, I received a Notification of Written Administrative Hearing, dated XX/XX/2020, and postmarked XX/XX/2020, the day after I spoke with Delta Management Associates. The XXXX notice stated I had 10 business days to submit any documentation for the hearing and the documentation had to be received by XX/XX/2020, the very next day. On XX/XX/2020, I left a voicemail for XXXX XXXX regarding me appeal. XXXX did not return my phone call, but instead XXXX XXXX returned my call. I spoke with XXXX XXXX of XXXX and asked why the notice dated XX/XX/2020, was not sent until XX/XX/2020. XXXX was unable to provide an answer and said she would have the hearing officer contact me. I asked XXXX why I was only given 1 business day to send my documents, but she was unable to answer and said she would have the hearing officer contact me. I asked her what documents had Delta Management Associates forwarded to XXXX for the hearing, XXXX was unable to provide an answer and said she would have the hearing officer contact me. I asked XXXX if the Notification of Written Administrative Hearing had been back-dated, since it was postmarked the day after I spoke with Delta Management Associates. She was not able to provide an answer and would have the hearing officer contact me. Furthermore, when I asked why my mailing address was incorrect, XXXX accused Delta Management Associates of providing the incorrect mailing address. Today is XX/XX/2020, and the hearing officer has yet to contact me. In addition, I have not received a ruling on my appeal from either XXXX or Delta Management Associates. This matter arises out of a dispute sent to XXXX XXXX on XXXX XXXX, XXXX at XXXX XXXX XXXX in XXXX, NH XXXX. ( See : Attachments ) XXXX XXXX failed to reply to my XXXX request and upon dispute transferred the debt to Delta Management Associates. ( See : CFPB Complaints # XXXX and # XXXX ) Upon the CFPB complaints Delta Management Associates then transferred the debt to XXXX XXXX who is attempting to collect the same debt that has yet to be validated by XXXX XXXX and/or Delta Management Associates. In response Delta Management Associates in complaint XXXX I specifically stated my opposition to Delta Management Associates that I did not authorization and/or consent to the release, transferring, selling, intrusion, data sharing, etc., of my private and/or personal identifiable information. I am Low Income and on XXXX. I telephoned Delta Management collection agency to inform them that I would like to rehabilitate my loan. First they tried to talk to me into a discharge. I explicitly informed them That was n't my best option and I knew my rights. this went on seemed like XXXX minutes and they finally agreed to send me paperwork for rehabilitation. So I gave that seven days for that to reach them by post mail. I called them and they chose to give me the run around again. I then had to call XXXX because somehow my account was suspended for XXXX days. they said I had to call XXXX. At which point I did and XXXX was even fruststrated. XXXX then told me I have the right to do whatever I would like to do in regards to my loan. XXXX then directed me to call the department of education inorder for the XXXX to contact delta management to get my rights addressed and my loan rehabilitated. Now the D.O.E just tells me that XXXX XXXX can take care of everything I need to rehabilitate the loan and that XXXX XXXX are the ones who have the right to choose not to honor the suspension and go ahead rehabilitate my loan. So I called XXXX XXXX and was hung up on mid conversation. I then got in touch with a supervisor haworth who told me I had to call XXXX or the department of education. called everyone twice and they all had me calling the other .wether it be XXXX, XXXX. or Delta Management. This went on for over an hour and still nothing is resolved. So I then get back on the phone with XXXX and they give me an address to D.O.E to write them a letter to get off a XXXX discharge program. in which I never wanted to be on. they say it 'll take XXXX days for that to go through. I just wanted to rehabilitate my loan. I spoke with XXXX XXXX at DELTA MANAGEMENT Associates XXXX XXXX is also with Delta Management Associates on my File. I spoke with XXXX XXXX at XXXX. debt colections division and she tells me just send me the agreed amount of rehab payment. with no rehabilitation aggreement .And it is my understanding XXXX. can not accept any monies unless it 's full amount of loan once it is in possesion of collection agency. Delta Management Associations called and I agreed to pay {$5.00} a month back to be in a program called " Financial Disclosure For reasonable Affordable Rehabilitation Payments ''. I filled the paperwork out and included my pension pay stub, then they begin calling daily sometimes more than once a day. Next I had to refill out the paperwork a second time & re mail it back. Now they are saying they do n't have my pension pay stub and I ca n't be in the program. I 've made XXXX payments already before they started telling me I could n't be in the program unless I faxed them another copy of my pension pay stub. I explained I live on {$650.00} a month and ask them to dismiss it due to financial hardship. I also explained to them a couple of schools ( XXXX Online charged for classes I withdrew from and kept the loan instead of returning it ) ( another school has closed but also kept the loan money after I withdrew ). Delta Management is harassing me non stop and saying I ca n't be in the program unless I re mail my pension pay stub at once which I explained I ca n't until the first because I live on a fixed income and do n't have the money to go to town and fax them another copy. They are also demanding access to my bank account which I refuse to give them access. My income is limited only {$650.00} a month, I pay $ XXXX month insurance out of that. I was suppose to receive the paperwork showing the agreement. I do not like being lied to, them demanding to re send a pension pay stub, re mail in forms again, demanding access to my bank account. I feel since they are harassing me contributing to health issues and the fact I 'm in a hardship financially they should dismiss the money owed. They keep adding interest to the loan. XXXX has committed fraud and falsified legal documents relating to student loan wage garnishment. A garnishment appeal was submitted to the deb collector Delta Management Associates who contracted with XXXX to make a judgement regarding my appeal. XXXX is unable to do simple math and/or they failed to look at my pay stub for the correct information. Either way, XXXX has has committed gross incompetence, placing a financial burden on the debtor. The pay stub clearly shows a wage garnishment of {$320.00} per pay period. However, XXXX states in their appeal ruling that the wage garnishment is {$160.00} ; therefore, the incorrect number was used to calculate disposable income, which was used to deny my appeal. In addition, XXXX lies about sending the Notification of Written Administrative Hearing to my correct address in a timely manner. A copy of the Notification of Written Administrative Hearing show an incorrect address, which XXXX representative XXXX XXXX accused Delta Management Associates of providing XXXX the incorrect address. Furthermore, XXXX is motivated to rule in favor of Delta Management Associates in order to maintain selection by the debt collector and continue their revenue flow. The wage garnishment of XXXX is {$2.00} per pay period based on my income and expenses yet XXXX fails to implement the same standard in calculating the garnishment amount based on my financial situation. Furthermore, XXXX did not take into consideration my extenuating circumstances regarding my father 's death ( a certified Death Certificate was included with the appeal ) and my brother 's SSI XXXX. I request XXXX to reduce the wage garnishment in accordance with the law to match the same wage garnishment as XXXX retroactive to XX/XX/2019, and order repayment of {$3500.00} to me from Delta Management Associates. In addition, I request the California AG investigate XXXX for predatory business practices and kickbacks from Delta Management Associates for ruling in favor of the debt collectors while using incorrect dollar amounts in their calculations.

The responses by Delta Management Associates to complaints filed on the CFPB website do not match the responses given by XXXX XXXX ( XXXX XXXX ) during a recorded phone conversation made by both parties on XX/XX/2020. Ms XXXX said the XX/XX/2020, garnishment would be refunded per the CARES Act. This information differs from the statement made by Delta Management to my CFPB complaints XXXX, XXXX, and XXXX. Delta Management has previously stated in response to my complaints that the wage garnishment on XX/XX/2020, would not be refunded. However, Ms XXXX stated during our phone call that the information provided by Delta in the complaint was incorrect. Ms XXXX stated the wage garnishment on XX/XX/2020, would be refunded. Which answer is correct? The answer provided by Ms XXXX or the XXXX who responds to the complaints? Delta Management claims to have sent a letter to my employer on XX/XX/2020, but my employer has not yet received the letter as of XX/XX/2020. Delta Management is unable to provide proof of delivery. Delta faxed and emailed the letter only after a complaint was filed. Furthermore, in regards to my garnishment appeal via XXXX, Ms XXXX stated that my garnishment should have been reduced to {$5.00} per pay period, since XXXX had found my financial situation qualified for the lower monthly garnishment. Ms XXXX comment confirms my previous complaint that XXXX and Delta do not take financial status into consideration and only use the maximum 15 % allowed under the law. In addition, Delta Management did not inform me that I had to contact them to request the wage garnishment freeze nor did they make mention of this in previous complain responses. This differs from information provided by Ms XXXX. Information provided by Delta Management in their complaint responses is not congruent with the information provided by Ms XXXX.

- Debt collection agency called my work office, which I have not shared with any of my loan institutions. Coworker took the message, and they would not disclose who they were or for what reason they were calling. - Call began by asking for my date of birth and full Social Security number without specifying : a ) who the caller was ; b ) what they wanted ; or c ) why they needed this information. - Refused to speak with me without the aforementioned identification information. - Representative informed me that I was being contacted by a debt collector, Delta Management Associates , Inc., and that they worked for the US Department of Education. - Representative stated that my federal student loans had defaulted, cited an amount I believe to be greater than the amount I had taken out. - Asked if I could pay the loans back in the full amount today ( nearly {$42000.00} ). Asked if paying {$35000.00} was more amiable. - Offered to sign me up for a " rehabilitation '' payment plan, in which I would pay somewhere between {$5.00} and {$240.00} per month for 9 months, after which I would be reassessed for a different amount by a different debt collection company. - Asked for address information, salary, monthly expenses, family members, and information about assets, two weeks of signed pay stubs or a signed XXXX for the current calendar year. - I had consolidated my loans in the past and am currently paid up. Over the past month I, along my family members, neighbors, coworkers, distant acquaintances, and people I have no relation with have received phone calls that begin at roughly XXXX XXXX and last well into the XXXX XXXX hour from XXXX XXXX XXXX, regarding either a " very important educational matter '' or " a very important business matter that we working one for her ''. When these other people are called and let them know they have no contact information for me, the representative on the phone ( sometimes a woman named XXXX, sometimes a woman named XXXX, or a man ( not sure of the name ) will become very verbally abusive. For example a colleague that I only know in passing received a call on her cellphone. When she indicated she knew my name but had not personal contact information on me XXXX told her that she was clearly lying and could face legal action. When I have returned their phone calls I am immediately asked to verify my entire social security number, which I will not give over the phone. I have asked that this company sent me whatever their business is with me in writing and I, along with my attorney, would address whatever they need then, but I have received nothing. I have asked repeatedly to stop calling me because I will not give anything in writing but it continues. As I typing this a social media friend who I have not been in contact ( outside of social media ) in more than 10 years sent me a message stating that this company just contacted her and when she told them that she had not been in contact with me for many years, she was asked to try to locate me and call them back with a contact number. Im not sure who to take this to anymore, but Ive disputed this account several times with both the original creditor and the credit reporting agencies accordingly and Ive attached everything to support my dispute. However, I continue to received a pre-template letter sent to me that its been verified and it REMAINS. How is it possible that this was verified if you continue to report incomplete, inconsistent, inaccurate, and unverifiable information on this account and a thorough and in-dept investigation. Ive disputed and I havent received anything as such, but it continues to be reported in violation of the consumer laws. Continues to report wrong balance, incorrect date of first delinquency, wrong date of last active, inconsistent payment status, high balance and actual balance is questionable, etc. I believe that section 609 of FCRA also allows me to ask for detail information about the account and how you indeed investigated and your detail process. Im extremely upset and shocked about the way this charge-off account is reporting on my credit report which continues to report with incomplete, inconsistent and unverifiable Info. How can you honestly say that you verified as it being accurate? This was NOT verified! I am requesting this investigation under the authorization of the Fair Credit Reporting Act Section 623. Several weeks ago a debt collector name Delta Management Associates Inc. phone XXXX located XXXX XXXX XXXX XXXX XXXX XXXX, MA. or XXXX. XXXX XXXX XXXX, Ma XXXX called me regarding a debt for a XXXX XXXX. I informed them that is not me and to not call again. week of XX/XX/XXXX the company called me again on the same number. On XX/XX/XXXX I received another call on the same XXXX number. This time I spoke with the manager who said his name was XXXX XXXX and he said they would remove me from their call list. However 10 minutes later they called again on a cell phone of mine. I then specifically asked them to remove all phone numbers that have my name listed on it from the area code in which I live. This they refused to do. Although they are referencing my name with the number they wanted me to give them my phone numbers. I told them you are only calling me because my name of XXXX XXXX is associated with this number and because you have associated my name with XXXX XXXX you are calling me. So easily you can find the numbers associated with my name and remove them from your list. They still insisted they won't do this. I believe this is abusive especially since the debt they are calling about is not even the person they are calling. They said they would remove the called numbers from the list yet would not send me a confirmation in email or writing and said only two numbers would be removed. Again I believe it is their job to know who they are calling and is not right to keep calling the same person again who doesn't belong to the debt.

In XXXX I received a collection letter stating I owed XXXX from Delta Management Associates , Inc . I sent them a letter disputing the loan, specifically asking for copies of all original written agreements and a breakdown of all collection amounts. They never responded at any time in XXXX, XXXX, or XXXX. I believe they are to respond with in 45 days? At the end of XX/XX/XXXX, I received another collection letter from them. Only this time it is obviously the same loan, broken now into ... two different loans. With two different account numbers. At first, I ripped them in half, but then it occurred to me what they were doing. I did not dispute them this time because I believe it is the same loan. I believe because I disputed the first letter, and they never responded to it as requested, they just deceitfully broke it down now into two different loans, with different account numbers so they can continue to try to collect it. Figuring I wouldn't bother to dispute it again a second time. Which I didn't. Since I didn't dispute the new " set '' of loans, now they can assume it as a " valid debt '' and continue to try to collect it. I believe this is certainly a deceptive practice. Number one, because it just is. I mean how many times will they not provide proof, and keep splitting the loan, or changing the account number? Number two, because they don't have proof of the original loans this is what they do? I believe it is a fraudulent method to bypass having to provide me with proof.

I originally borrowed approx {$8500.00} through a loan process ( they report it was closer to {$10000.00} ) for my son about 10 years ago for his first year as a XXXX at XXXX.. Did n't have to pay back until he graduated. He dropped out instead. I paid for several years but after a series of misfortunes, moving out of state for a better job, going through a separation, losing my job ( company closed ) then losing my XXXX yo daughter, I let the loan lapse. It has been bought or sold or changed hands to other loan companies ( XXXX for one ) and now they say the loan is approx {$25000.00}. They made a deal with me last year if I would pay $ XXXX/mo for 9 mos we could get it out of default status. I agreed. But did n't agree with the total owed and indicated that on the form before I signed. They are now saying it did n't count because I wrote on the form. They want to try that again but I MUST agree to the amount they say is due. I know once I sign the agreement I WILL owe that amount ; I 'm afraid then it can be proven then that I do owe that amount and agree to it. I do n't want to do that. Now I 'm told their next step is to garnishee my wages. Delta Management sent a letter to my employer asking the institute to deduct {$240.00} bi-weekly to service my defaulted student loan. I tried to negotiate the amount but the company refused to listen to me or work with me. I continued to pay until the federal government suspended all payments and collections in 2020 when COVID-19 break. Delta Management continued to convince my employer to deduct three payments and sent to them even when the Federal Government suspended all student loan payments and collection activities. I contacted Delta Management in XXXX and spoke to them almost every day to refund the money taken to me but they refunded one payment out of the three and promised to refund the rest in two weeks and that has not happened, I continue to call at least once a month all that I hear from the staff is " I am requesting a refund for you and it will take 2 weeks to get to you. '' I have not received the two refunds since XX/XX/2020. Please help me to get my refund since my request is informed by a legislative instrument. Yesterday, XX/XX/2021, I filed a complaint against this company, Delta Management Associates , Inc. Today, XX/XX/2021, they called the XXXX of my school, his Administrative Assistant, and Human Resources to " verify employment for someone in the XXXX XXXX Office ''. The Human Resources staff member forwarded me the message left on the Superintendents phone and it was left by a XXXX XXXX, Reference # XXXX, and to return his call immediately at XXXX XXXX. '' While the message was being left, the Admin Assistant to the XXXX received another phone call from woman who wouldn't give her name and wanted to verify my active employment and asked for her to give out my SSN and date of birth. Instead, the HR staff refused and tried to get her name and phone number and then hung up. Immediately, my work day was interrupted with this harassment, embarrassment, and stressful situation. I have repeatedly informed Delta Management Associates, Inc that they have the wrong person and our SSN were mixed up, the person they want has a birthdate in XXXX and lives in Minnesota. On XX/XX/XXXX, I received a call at my work, from XXXX XXXX saying she had to speak with me right away. I tried calling her back on XX/XX/XXXX and spoke with a XXXX XXXX who wanted my date of birth and social security number yet refused to disclose who he was and why he was contacting me. On their recorded line, I told him I am not to be called at work, I dont know why they are calling and It sounded like a scam so I ended the call. In XX/XX/XXXX I received a letter from Delta Management threatening to proceed with wage garnishment. I was asked to submit documents regarding my dispute. I sent this document immediately back to them, although they purposely sent it to me days before the deadline. I never received anything in writing regarding the outcome of my dispute. In XX/XX/XXXX I received another let from Delta Management regarding the debt. The information that they sent to me by them regarding this debt is dated in the years XXXX, XXXX, XXXX, and XXXX. I believe that this loan was brought several times by different debt collection agencies over the years and after reviewing these documents, I know they are fraudulent. There is no school signature on the documents. They also claimed I made a payment on the debt in XXXX ; I lived out of the country and never paid anything towards the debt. The company involved is Delta Management Associates Inc., located in XXXX MA. I have received several harassing calls and letters from them over the past several months. Last Friday, XX/XX/19 they called the receptionist at my place of employment. The call was forwarded to me, where I informed them not to call my work number, and that I am not allowed to take personal calls at work. I explicitly told them not to contact my employer, or to contact me while at work. This afternoon, XX/XX/19, one of my HR representatives informed me that, directly defying my request, they had sent a fax to my HR department, requesting private information about me, including my social security number, dates of employment, my employer 's federal tax ID, payroll address and information, and my hours/status at this job. My HR representative was extremely uncomfortable, and asked me to tell Delta again to not contact us. Week of XX/XX/XXXX, a call was made to a debt collection company. I received notification in the mail about the debt and the notice said that they are willing to offer a settlement. We received the settlement offer with a due date of XX/XX/2018. We agreed and asked for the settlement offer in writing or in an email. They refuse to put the settlement offer in writing. They call every other day asking for payment - even though our settlement agreement had a due date of XX/XX/2018. We have asked repeatedly for a settlement letter for our records and they repeated say they can not do that. Without proof of the settlement offer they agreed to, it is their word against ours for the settlement amount. And now they are calling every other day, as recently as XX/XX/2018, asking for immediate payment. When we mention the settlement offer and the due date, they say they don't know what we are talking about. Then after we push the settlement issue a little more, they suddenly find the settlement agreement. But this is exactly why we wish to have the offer in writing. The collector garnished my wages without notice. After multiple requests for an appeal by phone and email, I received my money back. I emailed the ombudsman and the management company requesting the rehabilitation verbally offered to me but never sent in writing. I requested only mail contact and stated my intention to repay. The company will not respond and I have almost been back to work for a year after unemployment ( the reason the garnishment was not legal and to which the company acknowledged fault by mailing me a check ). I have provided my address and since day 1 they refuse to put any option in writing or let me have a written copy of the rehabilitation to review. I want to pay this off but I fear after aggressively pursuing and winning over the illegal garnishment that they intentionally are refusing to respond so my year expires and they can pursue garnishment again. 1. Delta Management began calling me at my work number, demanding I provide PII ( personal identifying information ). I repeatedly refused, as they would not provide their purpose or authorization to possess such information. Later I went to their website, and seeing they are a debt collector, I feared I must have been a victim of identity theft or mistaken identity. 2. Delta Management Associates attempted to collect a debt in XX/XX/XXXX for XXXX University, which I do not owe. They did not inform me I had the right to dispute, did not include ANY of the necessary and lawful warnings. Luckily, I knew my rights under the FDCPA and disputed, pointing out that they had not only failed to disclose my rights to dispute but also included a collection notice on the front, which is disallowed. I disputed and informed them of this, saying they needed to cease collection or I would go after them for the two FDCPA violations. They THEN sent me another collection letter, over 30 days after initial communication, and included the necessary information, attempting to backtrack and make it look like they had done this all along. They need to cease collection, as they failed to inform me within 5 days of initial contact that I had the right to dispute. THey have also never validated it, and they included it was a collection attempt on the envelope, thus violating my rights under the FDCPA numerous times.

Delta Management Associates is out of compliance with the CARES Act. In reference to XXXX, Delta Management Associates states, " Delta Managements Associates , Inc. ( Delta ) is in compliance with this Act as the garnishment payment in question had already been processed prior to this being put in place. This went into effect on XX/XX/2020 and the pay period for this check ends on XX/XX/2020. '' The CARES Act is clear about garnishment date. The pay period does not matter because garnishment did not occur on XX/XX/XXXX it occurred on XX/XX/XXXX, which is the effective date of the CARES Act. Furthermore, this answer from Delta Management Associate is different than their previous response. They are now changing their argument as they concede that XX/XX/XXXX is included in the CARES Act. I made a phone call to Delta Management Associates to inquire about the status of a loan rehabilitation application. The call was placed on XXXX XXXX at XXXX. While I was trying to obtain information, the Delta representative I was speaking to, a male with a southern accent, muffled the phone and started making jokes and laughing with a colleague. Based on the flow of the conversation, it can be safely assumed that he was making fun of the issues brought up during my call which constitutes abusive behavior and language. Abusive language does not need to limit itself to obscene language - it can also apply to tactics made to mock, diminish or otherwise ridicule a consumer. I felt ridiculed and his behavior was highly inappropriate. I requested to speak to another customer service representative and was transferred over to XXXX XXXX, who handled herself in a more professional fashion. I received a call from a woman who claimed to be with Delta Management Associates. She was very rude and was unable to verify the debt. The agent was unable to provide me with any information, refused to mail me any information and refused to provide me with a mailing address for Delta Management Associates. I have been in default for the better part of 10 years. I started a program to try to bring my loans current in the spring of XXXX, I paid into the program for 10 months as this was what I agreed to do. I had to sign a 'contract ' to do this. I was told at the end of the 10 months my loans would then be in good standing once again and out of default. This was supposed to happen in XXXX of XXXX. I just found out in XXXX of XXXX that this program no longer existed and I was out of luck and apparently the money I paid into this no longer counted towards this goal. I paid all that money to bring my loan out of default, then they tell me the program is shut down? I was not even notified that this happened, I had to find this out on my own. Delta Management Associates just contacted my employer to ask for an employment verification. I do not have any accounts with this company and have never received any written notice or phone calls to my personal phone number ( which I use to set up accounts ) regarding any debt owed. About a year and a half ago, Delta Management Associates called my office and connected to my desk number and asked me to give them my SSN so that they could access my account information. At that time I told them that I did not have an account with them and absolutely would not give them my SSN. I had not heard from them again until today my receptions said that they called asking to verify my employment and that she directed them to our online verification system. Delta Management went through the State of California and garnished my retirement with out any prior communication. They claimed I had signed a loan consolidation through them and I had not. I had worked with XXXX and XXXX XXXX from Delta Management Associates who were handling collections on behalf of American Student Assistance regarding defaulted Federal Stafford Loans. I had provided a payment of {$7800.00} to be applied to loan XXXX which would be paid off in full. The XXXX remaining loans of XXXX, XXXX, XXXX would be entered into rehabilitation with a monthly payment of {$230.00}. The loan ending XXXX had an interest rate of 6.8 % while the other XXXX had interest rates of 2.32 %. Delta Management Associates misappropriated my payment across all XXXX loans instead of applying payment as agreed upon and paying XXXX completely off. Delta Management Associates , Inc. sent fraudulent wage garnishment papers to my place of employment. They did not contact me first, did not provide me with a chance for a hearing, did not validate, nor verify the debt, and they are not a guaranty agency. As a third-party debt collector, they should not have sent garnishment papers, due to their lack of guaranty status. I tried to resolve the matter via CFPB complaints, a XXXX complaint, a complaint to the California Attorney General and through direct communication with Delta Management Associates , Inc . I was unsuccessful. I then went to Small Claims Court and obtained a judgment. I still have not been paid, and the garnishment has not been stopped. In other words, I was garnished again after the judgment. I have included the judgment and would appreciate the return of my funds and the cessation of a fraudulent garnishment. Thank you.

Delta Management Associates began contacting 3rd parties in XXXX 2016, including friends and co-workers whose contact numbers even I do n't have in attempts to reach me. The people contacted were in absolutely no way used as references in any of my debts. Delta Management said they wanted to know my whereabouts out of concern for my physical well-being. I contacted them at that time to let them know they should only contact me, by calling me either on my personal or work phone numbers. In reference to XXXX : The CARES Act states that XX/XX/2020, is included as one of the wage garnishment refund dates. My paycheck was not valid until XX/XX/2020, and the payroll company can not put the transfer on the accounting ledger until XX/XX/2020. The perpetrator 's comment : " As for the complainant 's XX/XX/2020 paycheck addressed in his complaint, that garnishment will not be refunded as the payroll company had already processed that prior to this Act being effective. Any payments processed after XX/XX/2020 by his payroll department will be refunded to him. The refund and suspension process are steps that take time and do not happen immediately. I keep getting phones from Delta Management , foreign man : who calls just about everyday, home number, cell number and work number. I ask him who he is representing, cause I do n't owe anything to Delta Management , but he refuse to say until I verify my personal information with him. I refuse to verify my information, cause once again ; I do n't know who he is representing. Also, I have had some of my social media ( facebook friends ) call me or text me to tell them that this man has been calling them to ask about me and my personal information. Today, while attempting to work on payment terms w ith Delta Management Associates regarding my apparently delinquent XXXX XXXX Student Loan acc ount, I simply requested to know the dates which my account would be automatically debited for the agreed upon amount. My fed student loans were transfered to Delta Management Associates , Inc . back in 2016. I was informed that the only way that I could come out of default was to rehabilitate my loan by making 9 payments. At no time was I informed of the consolidation option. If I was given the consolidation option I would have consolidated my loans and had become eligible for Public Service Loan Forgiveness in 2016. As it stands now, due to not being informed of my consolidation option, I made 9 payments that will not count towards PSLF. Delta Management was deceptive and never gave me all the information I needed to make an informed decision. Of course, I have no doubt in my mind that they will not be held accountable for any of their deception as no one cares that most of us are trying to make ends meet.

I spoke with XXXX at Delta Management Associates in regard to the refund checks owed to me due to the CARES Act. She was not able to provide any information about the refund checks in terms of when they would be printed, when they would be mailed or an estimated time of arrival. They were told to not call back any of the businesses, but they can send a letter requesting the information on official letterhead.
