I am XXXX XXXX and Im submitting this complaint myself and there is no third party involved. Integra Credit presented me with a fraudulent contract, they did not fully disclose all accurate and truthful information in the loan contract. The United States Supreme Court clearly states that : waivers of Constitutional Rights not only must be voluntary, but must be knowingly intelligent acts done with sufficient awareness of the relevant circumstances and likely consequences. XXXX XXXX United States XXXX XXXX U.S. XXXX, XXXX ( 1970 ). Also XXXX XXXX XXXX, XXXX XXXX defines fraud as an intentional perversion of truth for the purpose of inducing another ( individual ), in reliance upon it, to part with some valuable things belonging to him to surrender a legal right. A false representation of a matter of fact, whether by words or by conduct, by false or misleading allegations, or by concealment of that which should have been disclosed, which deceives and is intended to deceive another so that he shall act upon it to his legal injury. Congress defines the term debt collector means any person who uses any instrumentality of interstate commerce or the mails in any business the principal purpose of which collection of any debts. An instrument is a written document ; a formal or legal document in writing such as a contract, deed, will, bond, or lease. Anyone who sends written documents through the mails ( this includes email ) and the principal purpose of that document/instrument is to attempt to collect a debt they are in fact a debt collector. Congress is only referencing 3rd party debt collectors when they say due or asserted to owed or due another. Congress makes it abundantly clear that a debt collector is ANY person who uses instruments in interstate commerce whose principal purpose is the collection of debts. This information proves that Integra Credit is in fact a debt collector. Integra Credit failed to inform me of the true nature of of the loan. There was illegal conduct in regards to the loan, including but not limited to fees, interest rates, monthly payments being paid which is against federal law pursuant to 15 USC 1605. Integra Credit is unable to loan money and/or credit as determined by case XXXX v. XXXX XXXX XXXX Bank, XXXX F XXXX XXXX XXXX XXXX, XXXX denied in XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX. The contract with Integra Credit is deemed void and fraudulent based on the information outlined above and the following cases outline this : XXXX XXXX XXXX. XXXX XXXX XXXX XXXX XXXX XXXX F XXXX XXXX, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. XXXX ; XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX. XXXX Bank, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX XXXX. If the documents fail to provide all the necessary elements of a contract, then the contract was never legally executed and is void ab initial and no debt is owed. Integra Credit has committed numerous violations of my consumer rights including but not limited to 15 USC 1605, 15 USC 1635, 15 USC 1692j, 15 USC 1692e ( 2 ) ( A ), 15 USC 1692e ( 7 ), 15 USC 1692e ( 8 ), 15 USC 1692f and many more which has been outlined in an Affidavit of Truth that was sent to them and delivered 11/01/21, with a signed return receipt as proof of delivery. Integra Credit committed numerous crimes against me including but not limited to 18 USC 1341, 18 USC 3718, 18 USC 1028A and many more which has been outlined in an Affidavit of Truth that was sent to them and delivered XX/XX/XXXX, with a signed return receipt as proof of delivery. Integra Credit committed identity theft when they contacted the Federal Reserve to get the alleged loan that they claim I got from them, when in fact it is Integra Credit that are the borrower and got a loan from me through the Federal Reserve. Integra Credit has committed identity theft on multiple occasions as they have knowingly used without lawful authority, a means of my identification in order to compromise my financial reputation. Integra Credit was sent a Bill of Paticulars, Affidavit of Truth and Cease and Desist exercising my consumer rights pursuant to 15 USC 1692c ( c ) ( 2 ). I demanded that Integra Credit send me the following information to prove that the alleged debt was mine : ( 1 ) Name and address of the original creditor who created the debt, ( 2 ) Name on file of alleged debtor, ( 3 ) Alleged account #, ( 4 ) Address on file for the alleged creditor, ( 5 ) Amount of alleged debt, ( 6 ) Date this alleged debt became payable, ( 7 ) Date of original charge or delinquency, ( 8 ) was the debt assigned to a debt collector, ( 9 ) Amount paid of debt was purchased, ( 10 ) Commission for debt of collection efforts are successful, ( 11 ) Documentary evidence that this agency is in fact holder in due course, & ( 12 ) Certified copy of the original negative information notice required by FCRA Section 623 ( 7 ) ( A ). Integra Credit violated my cease and desist by continuing to collect on the alleged debt when they cease all forms of communication with me through any and all mediums unless it pertains to my remedy in writing via mail. Integra Credit was sent request of debt validated which they have not honored. Integra Credit has continued to violate 15 USC 1692g ( a ) ( they have not sent written notice containing information pursuant to federal law ) and they continue to violate 15 USC 1692g ( b ) by continuing to collect on an alleged debt that I have disputed without sending proof that I owe this debt. Integra Credit has compromised my financial reputation with false, frivolous, and fraudulent allegations. Integra Credit are alleging that I owe a debt when it is a fact that I dont. The alleged debt is reported in a positive balance, if there was an actual debt it would be reported in a negative balance. Attempting to collect on a debt in a positive balance which is not an actual debt is a false representation of the amount of a debt. Integra Credit has continued to violation 15 USC 1681 ( a ) ( 1 ), 15 USC 1681b ( 2 ), 15 USC 1692e ( 8 ), 15 USC 1692e ( 2 ) ( A ), 15 USC 1692e ( 10 ), 15 USC 1692f by claiming that I owe an alleged debt and by falsely and fraudulently reporting information they know is not true to consumer reporting agencies in an attempt to use unfair and deceptive means to make me pay an alleged debt I do not owe and they can not prove I owe and by doing so without my written permission to do so. I demanded in writing the Integra Credit stop reporting false, fraudulent information and alleged debt to consumer credit reporting agencies and furnishing my report with this information. Integra Credit are not reporting accurate information in accordance with the Fair Credit Reporting Act ( FCRA ) and they no longer have my written instructions to furnish my consumer credit report. Pursuant to 31 USC 3718, Integra Credit has to have a contract with the treasury in order to even collect an alleged debt which Integra Credit does not have. The United States government created a bond ( which is my birth certificate ) with which negotiable instruments may be issued. My bond and social security number provided the security interest for this consumer credit transaction. Security which covers all obligations or alleged obligations which is that of the United States government pursuant to 18 USC 8. To extend my credit is a right I possess. It is the right to securitize instruments for my use. I extend that credit but never lose my rights because each contract involving my credit must also contain my right to rescind the transaction that created the security interest. I also informed Integra Credit that a sufficient response to my Affidavit of Truth was an affidavit with rebuttal, point for point anything else would constitute as a non-reasonable response and that not only does my unrebutted affidavit stand as truth in commerce but that I can and will file fault judgement in favor of me, the consumer. As of today Integra Credit is in default and the necessary actions are being taken against Integra Credit and XXXX XXXX.

Was not provided the contract which i can prove. However my name appears on this contract with IP address which i did not put there and can also prove. The IP address was scoured from where i applied for the loan online on their site. I was misled on the frequency of the loan payments. I have been contacted about late payments and spoke to collectors in which each communication did not include the mini miranda required by law and the FDCPA. Some did some did not. I tried to work this out i was told they werent considered a pay day loan service exactly. From what Indiana law states then they have way overcharged for interest for this loan which is well over 150 %. If they are not a pay day loan service then they are capped on what interest is allowed. That cap also comes with a felony charge of anything of over a certain percentage which they have grossly went over. I gave in writing and 4 days in advance of the payment being due a notice to terminate any ACH payments auto withdrawn from the bank. They returned a confirmation they had received this and took care of it. The very next day the account was debited with a pre payment which stayed on the account the entire week which usually turns into the amount the have actually charged. A day after the due date that pre note fell off the account. I did not know if this would be for the payment or the loan amount in full so i waited to see causing me to miss the payment. This seemed unethical to me and may have broken laws as they had not ever auto debited the account that early before but the day after i send a request to cancel all ach and get a confirmation that they had they then initiated an ach payment the next morning. 3 days in advance of the due date. Not something they had done previously. I received an email to reach out and work out the differences. I called them and while on the call I explained my issues. My biggest issue was i was misled on the frequency of payment. That i had not been given this contract. They had in one email not long after the loan had to describe to me how to go on their site and find the contract. That is how I found my signature Typed at the bottom with a IP address i assume is mine from when i applied for the loan. I had not done this. I was told that it auto populates that when you click boxes. Boxes that would say you agreed to this or that. I have proof i did not click anything or ever see this document. I know that many people may say that and as crazy as this sounds I really did not sign this or click any boxes and i can prove that. The lady on the phone stated well someone did it may have not been you but someone did. That someone was not me nor anyone i know whatsoever because this was never done unless they done it. This i can actually prove. After speaking with the company for 45 minutes on the phone in an attempt for them to work this out and collect payment i had still not been read the mini miranda telling me i was talking to someone acting as a debt collector per the law. I brought this up. I had once had another few calls with them where they had failed to do this also. I have several emails which also forgo this. I made them aware of this. I tried to call the company and pay in lump payments and at one point in fill to avoid the interest and be done with it. Several times i was told the representatives that initially answered couldnt take my payment i had to be transferred to a collector or escalations. I tested that theiry and waited a bit and called back and the same customer service representative when they didnt know my name were able to receive payments. They just refused to take mine and wanted me to be forwarded to a different dept which was extremely uncomfortable for me as i just wanted to pay this thing off fast and get out of it and then seek legal action for what they have done. Eventually i got to talk to a collector who didnt read a mini miranda. She had actually agreed the debt wasnt valid due to the not signing of the contract. I recorded my calls and have this on recording. At that point i let it be. Then they wanted to negotiate. I tried for 45 minutes i was extremely nice. I made sure to be very cordial to them. I never raised my voice. I even offered to oay them and accepted the same interest and everything but not the frequency of payments which was every other week. I was led to believe it was monthly and wasnt corrected on that. This wasnt acceptable to them. The lady hung up on me as i was talking with her. I hadnt ever had someone hang up on me when i had been this nice ever before. I have this recording as well. This is the call she told me they werent a pay day loan service. She also didnt read me the mini miranda. I later looked back at the contract i had printed off after they told me how to do so via email. I found proof that i did not check boxes. I did not type my name or see this contract at any point. I do have that proof. Everything i have said here is true and can be proven without any doubt. I didnt think id actually be able to prove it for sure but i have found proof. Absolute Proof. I ket them know this and the laws which where broken and screen shots of those Indiana laws per email. This was the last attempt to still rectify this situation. They asked me to call them. I dont really want to at this point. They can email me in writing. They hung up on me when i was being extremely nice. Never even called back or said why. I couldnt believe it as to how nice i was being and she actually hung up. Again i can prove this. These are the issues i have experienced but from reviewing their XXXX file and other reviews this seems to be a common practice.

According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states : " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumer 's right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers ' nonpublic personal information. '' INTEGRA CREDIT is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' INTEGRA CREDIT the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, INTEGRA CREDIT whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party - the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code $ 1681s-2 ( A ) ( 1 ) A states " A person shall not furnish an information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. '' XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services "

Im following up on a complaint against Integra Credit and XXXX XXXX XXXX for practices that I believe violate the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ). According to my agreement with Integra Credit, all disputes related to my account were to be resolved through arbitration. However, without my consent or any arbitration proceedings, Integra Credit sold my loan to a collection agency, XXXX XXXX XXXX. In their response they admitted they don't own the debt that it was owned by a collection agency. I believe this act constitutes a breach of contract and violates my rights as a consumer. When I became aware of this issue, I contacted Integra Credit and expressed my willingness to repay the debt directly to them. Despite my willingness to settle the debt, Integra Credit refused to recall the debt that I believe was sold illegally. Furthermore, in the course of this transaction, Integra Credit disclosed my personal information to XXXX XXXX XXXX without my consent. I believe this is a violation of FCRA Section 604 ( a ) ( 3 ) ( F ), which restricts the dissemination of consumer information without a legitimate business need. Following the acquisition of my loan, XXXX XXXX XXXX has engaged in harassment in an attempt to collect the alleged debt. They have called me multiple times during work hours and even contacted my workplace directly. They have also threatened to report the debt to credit reporting agencies if I didn't pay them. In order to avoid further harassment and potential harm to my credit report, I felt forced to pay XXXX XXXX XXXX. I believe these actions constitute violations of FDCPA Section 806 ( 5 ), which prohibits causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number ; FDCPA Section 805 ( a ) ( 1 ), which prohibits communication with a consumer in connection with the collection of any debt at the consumer 's place of employment ; and FDCPA Section 807 ( 5 ), which prohibits the threat to take any action that can not legally be taken or that is not intended to be taken. In light of these concerns, I request that the CFPB investigate these issues and take appropriate action to protect my rights as a consumer. I also ask that Integra Credit remove this account from my credit report immediately, as I believe it was wrongly sold and reported to the collection agency.

I was approved for a loan of {$2200.00} on XX/XX/23. I connected the application to my bank account ( by using MY bank log in info ). I received an email from Integra later that night stating that the funds had been sent to my bank. Saturday XX/XX/23 I still had not received the funds and contacted integra customer support. The support agent asked me to verify my information starting with my account number. She told me the numbers I was reading off were completely incorrect and that she would need to send to have the funds returned by the bank and I would have to provide a bank statement. I attempted to tell her that I was sure the account connected to my accounts because amounts in the accounts and everything were the same. It was also determined during that call that I had unknowingly applied using my maiden name. Im guessing this occurred due to me applying through XXXX XXXX which I had no clue had not updated my married name in the ten years I was married. On XXXX XXXX you have to update this manually I learned! Monday XX/XX/23 I spoke with integra again and since they had not received the funds I contacted my bank via their app messaging feature. It was determined by a bank representative that the money was being sent back due to my last name not matching my account. The account number was correct. I received a couple of emails from integra the next morning and thought I would just need to provide my bank statement and drivers license. The only info that was different on the new application was my last name. They even had my social security number. Easily could have been verified that I was in fact who I was saying I was. Called customer service to reapply XX/XX/23. SECOND application was denied! But they ran my credit again! I want either the inquiries removed or my loan since this loan was for emergency car repairs and to pay off an old loan that I thought my ex spouse had taken care of. I didnt read the complaints on XXXX just looked at the rating, lesson learned.

I took out a installment loan with Integra, in XX/XX/XXXX I reached out to company asking for help over the month of XX/XX/XXXX as i was not able to make my payment. I was assured that my next payment would not be due until XX/XX/XXXX. On XX/XX/XXXX the debited my bank account which caused me a XXXX overdraft fee. I instantly contacted them. Was assured they would refund my payment as well as my overdraft fee in 2-3 business days. On XX/XX/XXXX I reached back out to be advised they would issue my payment back but not my overdraft that would be credited toward my balance. On monday XX/XX/XXXX I followed up to be told it takes 2 full business days for the payment to clear and then time to process refund but that it was on it's way. I was told this again Tuesday and on Wednesday I was told it had been processed and on it's way to my bank, on Thursday I reached out again to be told that they're working to resolve the issue ... no longer stating I would receive a refund but that the supervisor couldn't process the refund and it had to be sent to upper management. Today XX/XX/XXXX I reached out again and told that upper management has not reviewed my account yet but that I would hear from someone when they do. No longer recieving even an ETA for when this will be returned. This is a horrible way to run a business based on trust. I was honest with them and they withdrew money from my account without authorization after stating they would not and now are refusing to refund the money they were not authorized to take. I would like the refund of the payment that was not authorized as well as the overdraft fee I was charged due to the companies unwillingness to honor the email they had sent stating I would not have a payment pulled until XX/XX/XXXX

I took out an installment loan of {$3000.00} on XX/XX/2023 and was to be making bi-weekly payments of {$180.00} to XXXX Bank ( Integra Credit ) After making 6 payments to this lender I noticed that my balance had actually increased to over {$3200.00} and after contacting them they never provided me what the reason was for of this and I have been in contact with them ever since trying to settle this debt and they have amassed late fees and charges to the amount of {$4300.00}. They have reported the loan as delinquent to my credit agencies and I have attempted to get them to work with me so that I can close this account, the only option they offer me currently is a {$1300.00} settlement offer to destroy my credit. I have asked this situation to be escalated internally via XXXX XXXX support and they have come back to a resolution of, offering to waive a one time late fee of {$15.00}. This place is a predatory lender and should be notated as such within this data base to assist consumers going forward. I have paid {$1700.00} ( screenshots enclosed ) for this and I am proposing a settlement in full for complete removal from my credit report in the amount of {$1200.00} which would be the full amount of the {$3000.00} borrowed. This company has been unwilling to work with me on this, I am seeking the next steps from the Nebraska Attorney Generals Office currently. I appreciate this agencies willing to help consumers.

I am writing to file a formal complaint against Integra Credit for their negligence in updating my charged off account to XXXX to show that the account has been paid in full. Despite providing Integra Credit with proof of payment, they have not taken any action to update my account and this has caused significant harm to my financial standing. I have made a full payment to Integra Credit to satisfy the debt, and have provided them with documentation proving that the account has been paid in full. However, Integra Credit has not taken any action to update the status of the account with XXXX. As a result, my credit score has suffered, and I have been denied credit and loan applications. I have made several attempts to resolve this issue with Integra Credit, but they have not been responsive. I have contacted their customer service department multiple times, but they have not taken any action to resolve the issue. I demand that Integra Credit immediately update the status of my account with XXXX to show that the account has been paid in full. I also request that Integra Credit compensate me for any damages that I have suffered as a result of their negligence. I appreciate your attention to this matter and look forward to a prompt resolution.

I borrowed {$500.00} last XXXX from this company called Integra Credit. They of course quickly went through all their many terms, but never sent me a copy. I have made payments in the amount of {$1200.00} and just submitted another payment today for the " missed payment '' in the amount of {$79.00} to be processed within the next few days. I shouldn't have had any missed payments since they are being automatically withdrawn on my paydays. What seemed to have happend when I looked at my bank was they tried to withdraw the payment right before my direct deposit went in on my pay day. My bank of course also charged me a return ach fee when it happened. Integra Credit then proceeded to call me every single day, twice a day, about this past due payment. It was harrassing and especially disruptive since I work during the day. I just logged into their website and it says I still over {$340.00}. I feel like it is fraudulent for a loan company to make over a thousand dollars in interest on a {$500.00} loan. I tried calling and asked the customer service rep if she would close my account. She put me on hold for about 10 minutes to get a manager, then told me they would call me back, however they have not. Can you please help me?

According to XXXX XXXX a short term loand was opened with my information - all correct except spelling of first name, bank and email. The original account was oppend with Integra Credit who never contacted me. My first contact regarding this fraudulent account was from XXXX in XXXX of 2020. During my first conversation with XXXX I was told that it was an Integra account and any dispute had to be addressed with them. On XX/XX/2020 I contacted Integra who informed me that the account was no longer their 's but instead was sold to XXXX. Any dispute needed to be filed with XXXX. All further attempts to contact XXXX went to dead phone lines. On XX/XX/2020 I recieved written communication from XXXX stating that they investigated and determined the account was valid and that I now owed XXXX plus an additional late fee for XXXX. On XX/XX/2020 I spoke with a XXXX employee who informed me I needed to file a police report and return with the letter ( which will be done today, XX/XX/2020 ). The XXXX employee also informed me they are simply collecting the debt for Integra and that the account is not a XXXX account. This contradicted the information provided by Integra on XX/XX/2020.

Integra Credit is misleading their consumers and abusing the credit system. I first reported their misconduct in XX/XX/XXXX for credit inquires and a lack of properly reporting my accounts to credit bureaus. Their website FAQ section states they only do a soft pull during the application process, however, with each application I completed, a hard inquiry was placed on my credit report. During XX/XX/XXXX, each inquiry was removed from my report. Integra has yet to report my 1st loan payment history although they advised on several occasions they do monthly credit reporting. I opened a 2nd loan with Integra in XX/XX/XXXX and during XX/XX/XXXX I called for assistance due to financial hardship caused by XXXX. I was placed in a Financial Hardship Program that postpones the payment due and stops collection activity for a period of 14 daysXXXX I entered into this program on XX/XX/XXXX and the status of my account changed immediately as per the email I received and my conversation with the representative. Despite this program, I noticed today that my loan account was reported delinquent on XX/XX/XXXX with no other payment history reported.

I received a letter from a company identified as IntegraCredit located at XXXX XXXX XXXX XXXX, Suite XXXX, XXXX, IL XXXX. They stated in the letter I owed them {$1700.00} for a loan I supposedly had taken out. I have never heard of or had dealings with this company and I have no outstanding loans. I contacted the company by email and phone. They have not responded to my email. On the phone, they wanted me to give them the last four numbers of my social security number. I explained to them they are contacting me and I have never done business with them, so there is no reason for them to have my SSN. They refused to talk to my without providing that information. I suspect this is an episode of fraud or identity theft, but without the company 's willingness to talk to me, I can not resolve the problem.

I wasn't sure what to select for my specific issue, so I hope this complaint will still be received. I took out a loan through IntegraCredit and when I noticed that my payments weren't bringing down my balance, and in fact, my balance went up a couple of times, I emailed them and asked them how this happens? I never got a clear answer, just something along the lines of, they frequently adjust the payoff balance according to financing or something. I also found out that I do not live in one of the states listed on their website as able to provide loans to. I live in Ohio and Ohio isn't one of the states they provide services to. When I asked them how it is that they approved and gave me a loan, I got no response, they completely ignored that part of my email.

I took a loan from Integra Credit in XXXX. They charged me a 275 % interest. I was charged an interest charge on cash advances fee, a customary fee, and a fee charge on cash advances. I was not aware of all of these charges when I took out the loan. With all of these high percentage fees, it makes it impossible to pay the loan off. I am not going to loss my house over this loan. I have now stopped paying them. I cant afford to give my money away to greedy companies like Integra credit. They continue to harass me daily with phone calls and emails. They call my family members for no reason at all but to let them know that I owe Integra money. This company needs to be shut down.
