Loan was modified on XX/XX/2023 due to hardship. New payment arrangements were {$210.00} every other XXXX instead of initial agreement of {$520.00} every XXXX of the month.

The vehicle had been disabled and was parked at XXXX XXXX with security permision and fiance ' is employed at same hospital. XXXX XXXX Police contacted the lender and not the title holder, which breakes the chain of custody. On the very next day i contacted XXXX XXXX XXXX at XXXX XXXX XXXX XXXX XXXX, Ohio XXXX XXXX. I claimed the car as the title holder and made arrangements to pick up the vehicle but it was XXXX XXXX weekend. XXXX XXXX Called the XXXX again, the lien holder DBS Finanial at XXXX XXXX # XXXX XXXX, Ohio XXXX XXXX. I was current on my payments so i was charged for the tow = {$600.00}. I modified the loan to take the next 2 payments on the end of the loan which would have the next payment due XX/XX/2023.
The account reflects a different address. There is to be a notice of auction sent with 10 days for the debtor to respond, the car was auctioned before.
Now the lender has a court order claiming i surrendered the vehicle.

DBS financial had broken TILA laws by not fully disclosing to me at the time I signed the application that I also unbeknownst to me that I also gave them my POA to act in my behalf. I also wasn't told that by giving them my SS number that it then becomes a trust action because I am the XXXX of my SS XXXX XXXX XXXX XXXX. They go and file a 1099A on my behalf with the Treasury to receive the funds to pay back the credit that they extended to me to buy my car. And instead of marking it paid in full like they should they monetize my app with the promissory note by taking app and the funds they receive from the trust fund and use those funds and invest in the stock market. Once they do they then the note then becomes the collateral so they unlawfully took my car when they repossessed XXXX XX/XX/2023! I want restitution.

DBS are making harassing calls. They called to say they are under new management and 1 day past due the car is up for repossession. They refuse to give me a copy of the contract because I had never heard such a thing. The way I work my deposit can be stagnant between XXXX or XXXX. I was forwarded to a manager by the name of XXXX. Whom said it doesnt matter whats in the contract an hour late he can order a repossession. He made countless threats and repeatedly told me he will talk to me however he wants hes in charge and that he will have it repossessed and SUE me if my payment isnt in by not XXXX XXXX. I thought these actions were against CFPB rules or something.

Ive had my car since XXXX my payments are set up on auto payments. Last Friday they didnt pull my payment out. Monday she called me and said they needed the payment. My bank information was giving at the beginning of my loan signing so I dont know why it wasnt pulled out around XXXX my car was repossessed. I called Tuesday morning they said I had to now pay {$1100.00} to get my car back. I am a XXXX XXXX XXXX just had XXXX at the end of XXXX and had a financial change. This is my first time missing a payment well not missed because its still in my account.

I financed a car from ABC MOTORCREDIT and was financed buy DBS FINANCIAL. I was charged a down payment of {$500.00} which is illegal according to the truth and lending act. The finance charge is the sum of all charges. There are multiple violation on my contract. The car was repossessed and Im currently being taking to court.
