If applicable, please cancel prior cease & desist conditions ( except TCPA ) on the account. Your organization is to communicate with me ONLY for the purposes of providing information for my records and to show sources of your reinvestigation. Collection is not permitted while I consider the account to be a billing error. I have attempted to notify you of the billing error but was unable to find the accurate address for billing inquiries as required to be listed on your periodic billing statements per disclosure as required under 15 U.S.C. 1637 ( b ) ( 10 ). I tried sending a billing error notice, but never received anything in response and no agents conducted an investigation to my knowledge. I have reason to believe the department receiving my billing error notice merely sent me period billing statements instead of the documentary evidence I requested as defined in 15 USC 44 ( a right conferred to consumers by the FTC Holder Rule per 16 CFR 433.2 ). I am entitled to documentary evidence to clarify the charge-off allegation and for other tax purposes since the error is computational in nature, resulting in misapplied credits. No adverse reporting, closure of the account, or collection activity is permitted per rules pending resolution. I wish to initiate the billing error using the account number as listed on my consumer reports. Please provide copies of the following information : All billing statements from the date of account opening A list of people you have sent my personal information to The Gramm-Leach Bliley disclosures A copy of the 1099-C cancellation of debt, if applicable Date of First Delinquency Date of Last Activity Mailing address of your registered agent Fax number for correspondence ACDV and AUD forms from all reinvestigations In order for XXXX XXXX XXXXXXXX, XXXX XXXX to report an account as a charge-off it is required by 26 CFR 1.166-2 that XXXX XXXX XXXXXXXX, XXXX XXXX received documentation in writing from the authorities confirming that the charge-off is subject to specific order. There is a comment on my XXXX report indicating a reported as a loss by the credit grantor yet I have not received a XXXX. I demand strict proof thereof via a certified copy under penalty of perjury that BANK XXXX XXXX, XXXX. received written permission from the regulating authorities to charge the account off. I demand evidence in the way of the FAS-140 ( previously FAS-125 ) or the state equivalent of the same writing as described by Title 26 IRS code ( both CFR and USC ), complying with required accounting practices and under penalty of perjury. I hereby issue an authenticated request for an accounting and request regarding a statement of account on par with Colo. Rev. Stat. 4-9-210, and require authenticated accounting and authenticated approval or correction to the statement of account within fourteen days. The correction is to account for any tax credits, insurance payoffs, or set-offs by way of application of unearned finance charge, unearned discount, or unearned interest. If the reinvestigation determines the information is not reporting to the maximal standards of accuracy required to meet the privilege of reportability, immediately remove the tradeline from my consumer reports ( including but not limited to XXXX, XXXX, XXXX, and XXXX ) while you conduct a reinvestigation compliant with reasonable procedures for data furnishers. Cease all collection activity including but not limited to communication through consumer reporting agencies as reporting is considered a form of communication and collection activity. I believe 14 days is a reasonable amount of time to gather this information. I look forward to your complete compliance. I have attempted to resolve this fraud dispute due to identity theft on several occasions, I filed a complaint with the FTC and a police report which I will be attaching. The police report has the suspect information along with arrest information that I will be attaching to this complaint as well. I was contacted by an attorneys office via email on XX/XX/XXXX by the name of XXXX XXXX XXXX XXXX XXXX XXXX offering me settlement options for and account that has already been flagged as fraud. I proceeded to call the phone number provided in the email which is ( XXXX ) XXXX and I spoke with XXXX on XX/XX/XXXX I informed her that this account was opened fraudulently and that there has been several disputes and a police report was already filed, she informed me that I needed to fill out a fraud affidavit and send the police report along with the case number for the ID theft, which I agreed to do. she informed me that she would put a request in for the fraud affidavit to be mailed out. I called back aprox 1 week latter to follow up with the fraud affidavit because I have yet to receive it and time is of the essence. I spoke with XXXX on XX/XX/XXXX and he informed me that he sees in the notes that the fraud affidavit was sent out on XX/XX/XXXX which is 7 days from the date it was requested, He also informed me during that call that the law office of XXXX XXXX XXXX couldn't remove and negative information from reporting as a result of ID theft even after they receive the fraud affidavit and police report and that I would have to contact his client directly which is XXXX XXXX XXXX XXXX and provided me with a phone number. I called XXXX XXXX XXXX XXXX on XX/XX/XXXX and after identifying myself they informed me that I needed to speak to another dept named Track America which is handling the account and proceeded to transfer the call. I then requested to speak with a supervisor and ended up speaking with XXXX on XX/XX/XXXX and she informed me that her office acquired the account mid XX/XX/XXXX. ( Be mindful that I filed a dispute with XXXX early XX/XX/XXXX and sent a copy of the police report along with the FTC complaint ). XXXX also informed me that she did receive my police report and that her office is investigating the fraud, during that time she also informed me that Track America has no control of the XXXX XXXX XXXX account reporting on my credit and that I need to contact XXXX XXXX XXXX XXXX to remove the account. I hung up and called back, and spoke with XXXX XXXX at XXXX XXXX XXXX, she informed me that they received the dispute XX/XX/XXXX and the investigation results was denied on XX/XX/XXXX because there was a payment made on the account, and after her looking into the account further she mentioned that : " it didn't make any sense because there was a payment made on XX/XX/XXXX for {$100.00} but the payment that was made was an auto payment from customer rewards '' She also informed me that my police report was received. today is XXXX/XXXX/XXXX and I still haven't received the supposedly required affidavit to complete the investigation and relieve me from this fraudulent debt. The file No. for the law office of XXXX XXXX XXXX is XXXX XXXX XXXX XXXX XXXX is reporting invalidated fraudulent information to the credit bureaus and said action might constitute fraud under both Federal and State laws. Due to this fact this is my final attempt to have this matter resolved prior to contacting the National Association of Attorney General and seeking legal action.

I have contacted the office multiple times regarding my account, I am frequently told by the representative that # 1 there is a restriction on my account and # 2 I must speak to a supervisor. I provide the oral permission to remove any communication restrictions regarding the account, once this " occurs '' I am either transferred to a supervisor or their voicemail. No one ever calls me back. The last time I contacted the office, I was told to send an email providing a written statement to remove any account restrictions regarding communication. I have not received a reply to my email and when I called again, I was told that there was a restriction on my account still. I am confused as to why representatives are providing misinformation regarding removing the restriction while we are on the phone and thus have now moved to having me email to remove the restriction IF the task isn't going to be completed. I have contacted the owner of the account XXXX and the servicer TrakAmerica and both companies state that contacting XXXX XXXX XXXX to remove the restriction is the only option. The representatives from both organizations do not understand why after numerous calls XXXX XXXX XXXX has refused to do their part. I have sent over multiple emails and a hosts of faxes to communicate with XXXX XXXX XXXX. I have contacted the office by phone a minimum of three times a month regarding the debt. After mailing a certified letter requesting to verify did I receive communication from XXXX XXXX XXXX regarding verification. All conversations, emails and faxes regarding resolving the account lead to dead in roads. I am instructed by supervisors to email over settlement offers, payment arrangements etc but I do not ever receive a response.

On or about XX/XX/2019, I received a citation about a lawsuit being filed against me on behalf of XXXX.The suit was brought by XXXX XXXX XXXX on behalf of XXXX XXXX as plaintiff. SXXXX XXXX XXXX is a law firm acting as a debt collector. I called XXXX XXXX and they said they had referred the account to a third party debt collector, TrakAmerica and that I had to call them about the account. I had many discussions with TrakAmerica ( I had never received anything in the mail from them ). They claim they are not a debt collector, but that they refer accounts for their clients to debt collectors. They said that XXXX XXXX still owns the account. They said I would have to contact XXXX XXXX XXXX about the account. On or about XX/XX/2019, I mailed a certified letter ( tracking XXXX XXXX XXXX XXXX XXXX ) to TrakAmerica, requesting validation that they had the authority to collect this debt ). I received no response from TrakAmerica. On XX/XX/2019, at @ XXXX XXXX, I spoke to XXXX XXXX who stated she was a manager at TrakAmerica. I thought when she answered the phone that she said her name was XXXX XXXX. I was transferred to her by XXXX who answered the phone after a 45 minute wait time. I found out from XXXX that TrakAmerica does not send out collection letters or collect debts. That they just refer accounts to debt collectors, in this case XXXX XXXX XXXX. I was not aware that it was legal for a third party, who does not own the account, to refer an account for legal action.

I reached out to XXXX about a status change on my credit report which shows the loans have been written off. I spoke with the XXXX representative XXXX XXXX XXXX around XXXX and requested info about the write off status and he confirmed that the loans were written off and went into collection with a law firm that serves as a collection agency named Trak America . I requested the bill of sale, 1099 form for the written off amount, any documentation on the write off, and a copy of the signed contract for the alleged debt. I am currently awaiting this information. I have never received any information from XXXX XXXX Trak America as this call was the first I have heard of Trak America. I am making a request from Trak America for the following : This is not a request for validation of debt or any alleged debt but rather proving where you got my information and what you believe entitles you to collect any debt or alleged debt from me. In 2018 i refinanced my house with XXXX XXXX. I owed XXXX to XXXXXXXX XXXX XXXX for a credit card. XXXX wrote a check to XXXXXXXX XXXX for the total amount due of XXXX payable to XXXXXXXX XXXX. I sent XXXX ; XXXX the check and the debt was declared paid in full by XXXXXXXX XXXX. Apparently XXXX XXXX had hired a collection agency named TrakAmerica for my debt. I have no recollection of dealing with TrakAmerica, but either XXXXXXXX XXXX failed to notify TrakAmerica that they received payment or TrakAmerica failed to remove it from the credit bureaus because I have just refinced my house again with XXXX to get a lower interest rate and once again they have made another check to XXXXXXXX XXXX for the same XXXX. I have now had to pay XXXXXXXX XXXX twice for the same debt. XXXXXXXX XXXX tells me I will have to contact TrakAmerica. However, my Check is made out to XXXXXXXX XXXX and since I don't owe the XXXX XXXX 's will have deposit the check and reimburse me. XXXXXXXX XXXX or Trak America should have removed this debt from the credit bureaus so I didn't have to pay it twice, If you could help me clear this up I would appreciate it.

TRAM America ( XXXX XXXX ) is a law firm that represents XXXX XXXX XXXX to try and collect the debt on their behalf. They sued me without any warning that they were going to do so. They also did not serve me with the papers because I no longer lived in that state. I called them for a week ( XX/XX/2019-XX/XX/2019 ) and they did not pick up or return my messages. Finally, I had to call XXXX XXXX XXXX for them to connect me to a TRAM America representative. I can not qualify for anything and this debt ( {$2800.00} XXXX is seriously affecting my quality of life. I explained to them that I wanted to settle the debt. But the most important thing was they reported to the Credit Bureau. The lady was rude and unprofessional. She made me feel small and disrespected. They do not report to the Credit Bureau- how does that help me? If I am making may payments, that information should be communicated to the Credit Bureau and my score should improve. TRAM America should be ashamed of themselves. They're a group of lawyers who are out to get the consumers, they care nothing about us and only want to push for their quotas.

So you are aware, we are paying on this debt. One month was owed that we accidentally skipped, and my husband made payments, today after I told him what happened. Our XXXX XXXX XXXX 's credit card apparently went to collections - this is my husband 's card, mind you, not mine - and a XXXX XXXX ( spelling? ) from the company TrakAmerica, called ME AT WORK asking for me to call them back at ( XXXX ) a number that took me to XXXX 's credit card company. When I spoke to a representative, I told him that I was complaining about the company calling me at work. He said he found us in the system, using my husband 's cell phone number XXXX the one that is in collections XXXX, and said he can't discuss it at all to anyone and that I needed to call XXXX, which is TrakAmerica 's number. XXXX 's couldn't even find my work number when I asked him to search that way. I am furious that they called ME and it's not even my card AT WORK, which they were never given permission to do. This is harassment and I wanted to file a complaint report against TrakAmerica.

XXXX county court issued judgment to me for hearing at court to collect debt, I told this company I would settle this debt for {$200.00} or {$300.00} what the card is worth because they where abusing late fees, I have tried calling them repeatedly and the law office and creditor and collection agency wo n't return calls to settle this account. they are trying to ignore it so they can get the judgement on my credit, I told them if they do n't return my call I will file complaint with CFPB. XXXX XXXX XXXX XXXX turn a defaulted debt owed by me to XXXX XXXX Acct : XXXX to Track America , INC . This resulted in legal action taken by XXXX, XXXX, XXXX XXXX XXXX, XXXX XXXX. ( XXXX ) on XX/XX/2018 to fill a lawsuit against me for {$2300.00}. When I stopped paying I only owed {$780.00}. I initially offered a settlement XX/XX/2018 for {$500.00}. I opened a XXXX XXXX account a while ago that charged off. Since then the account was placed with Trak America a collection agency. The account was sent by them to XXXX XXXX XXXX. I have been trying for a week or so to reach them regarding the debt but they dont answer and they dont call back. I have brought this to the attention of Trak America 3 times and they have failed to tell me how to resolve if the debt is placed with a non communicative attorney. Dear Staff : Trak America and their legal counsel have recently submitted a notice that they will garnish wages on a XXXX debt that was satisfied 15 years ago. There was a judgment issued and my wages were garnished. In XXXX, my wages stopped being garnished. I never changed employer or left work. I assumed my debt was satisfied. Now, 15 years later, a new law firm is attempting to collect the same debt. I have sent proof of payments obtained from my employer. After numerous phone calls by my attorney, they have refused to respond to me.

Also, since the debt was discharged by the FCRA the debt can not be reporting twice as Collection and Bankruptcy. On my other credit bureau agencies ( XXXX and XXXX ) it was removed as a Collection since it was part of the Bankruptcy. This debt was included in the bankruptcy and it was discharge ; however, this debt is still reflecting in my credit bureau reporting as Open from XXXX XXXX XXXX XXXX. Also, since the debt was discharged by the FCRA the debt can not be reporting twice as Collection and Bankruptcy. Data Search, which as far as I know from what theyve told me, is a debt collection agency. they have continuously contacted me about medical debt after several attempts to have them stop. the last call I received a male was using harsh language and threatened to call my mother.
