My boyfriend and I applied with this lender in XXXX of XXXX. He told us at the time of approval that he could get us approved for up to {$400000.00} with the possibility of some debts being paid down. He then recommended a realtor that he was worked with that has experience with XXXX loans which is what we got approved for. XXXX, the lender, already assured us that we had been approved to purchase a home and that we were okay to put in offers. We put in offers on a few homes and each time the realtor would ask the lender to draft up an approval letter based off of the amount that we were putting the offer in on the home. Our process started off okay but then it went completely downhill. My boyfriend and I finally found a home that we both liked and were wanting to move forward with and that was XX/XX/XXXX of XXXX. Prior to this, we already had an issue with the lender not disclosing issues with our credit. Before putting down our offer we had asked the lender to give us our cash to close amount that way we made sure we were on track. The lender gave us the information but the amount he gave us was about {$10000.00} more than we were expecting. When I inquired and asked why, he said that due to my boyfriend having such a low XXXX XXXX, his company was saying it is MANDATORY for us to buy down the rate. I told him I've never heard of anything being required but optional for us if we want to pay a higher mortgage then that should be our choice. At this time we were also looking into the option of another lender, so I gave her a call and told her what XXXX was saying in regards to the rate. She assured me that she's never heard of that being a requirement and she ran numbers on their end and the numbers she had given us were completely different including the interest rate and down payment required. My boyfriend and I were highly upset and expressed this issue with our realtor and told him we do not want to move forward with this lender being that he was already dishonest and tried to slip in extra monies without disclosing it with us prior. My realtor told us that we had nothing to worry about and that he would talk with the lender and get this resolved. The lender then reached out to us asking for a copy of the numbers we had received from the other lender. Moments later, we received a text from XXXX saying that " all of a sudden '' he had no problem matching the other lenders offer. My boyfriend and I still weren't too excited, but our realtor assured us that we would be fine and to move forward. We finally got our offer accepted on the home we wanted on XX/XX/XXXX which included a {$10000.00} non-refundable deposit that was suggested by our realtor to make the offer look strong and also approved by the lender. After the offer had been accepted and we were moving forward, the lender decided to let us know that there may be an issue with my boyfriends overtime and he is not sure he will be able to get the loan approved and the only way to get this resolved is by having his HR send a letter to him stating that overtime is mandatory. Our realtor told us to not give the deposit until this issue was resolved to make sure this deal would move forward. After about 2 days of going back and forth with my boyfriends HR we were told that our lender received the necessary letter and that he would double check with his underwriting team to make sure this will not push the loan out of approval for the home. We asked for a copy for a copy of letter at least twice which we never received although we were told we were. The next communications that we received were from our realtor letting us know that we were good to send in the money for the deposit, so we assumed that everything had been resolved. For the next XXXX weeks we were finalizing paperwork and any documentation that the lender needed from us. We were set to close on XX/XX/XXXX. XX/XX/XXXX is when the lender told us that his underwriter is not able to approve our loan based off of the letter that was received from my boyfriends HR, because it stated that although overtime is mandatory it can not be guaranteed in the future. XXXX told us that the only way we can move forward is by having a co-signer. My boyfriend and I were not too fond of this idea at first but ended up deciding to see if we could ask my parents for help. This ended up not being possible being the fact that they haven't had to file taxes for a few years. The lender asked us if we could ask any other family members and then we can refinance in 6 months and have them removed, and I said none of my family members have the credit or ability to have this added to them financially. He then asked my boyfriend and I if we could use his sister. We both said no, because she herself had just bough her first home XX/XX/XXXX and we don't want to add a {$350000.00} loan onto her on top of that. XXXX, the lender, told us that it would be fine and it won't affect her at all. We told him no, because her credit and financials were not in the place for this. At this point our realtor told us we were at risk of losing our {$10000.00} if we didn't figure out a way to get this done. Again, the lender reached out to me personally and asked me to talk to my sister in law which I reminded him that we already expressed to him why we can't do that. He then reached out to my boyfriend personally and asked him to talk to his sister in which my boyfriend replied and reminded him that we already said that we would not do that. All of this had pushed us into XXXX at this point. The lender finally said that he thinks he can get us approved but he needs an updated letter. I raised the concern that isn't that altering a legal document since HR already submitted paperwork, so If you get a new letter based off of a statement that you need it to say, I am worried underwriting would flag our whole account. He said no it's okay and wouldn't hurt us. The lender asked if my boyfriend could get a letter from his direct supervisor stating overtime was mandatory. My boyfriend said he would try. He reached out to his direct supervisor but in turn the supervisor said that if XXXX already submitted paperwork, that he can't send anything discounting that because it would be against company policy since XXXX has the final say. XXXX and the realtor then again asked my boyfriend to reach out to his HR. At this point we are completely frustrated and upset and wondering why all of this was not taken care of before we put in an offer and had it accepted. We are trying to work with our realtor to see how we can get our deposit back in which we are told our only option is to move forward and purchase or give up the money. After all of this time the realtor still hasn't handed over the check, it was in his possession. The realtor and the lender took it upon themselves to reach out to my boyfriends HR even after he had asked them not to and they ended up getting a completely different letter on XX/XX/XXXX. XXXX said he would submit that to underwriting which was XX/XX/XXXX and was hoping to have an answer. On XX/XX/XXXX ( our original closing date ) he said we were being given a second chance and asked for some more information which I sent to them that day. XX/XX/XXXX is when underwriting finally approved our file. My boyfriend and I sent a proposal for different terms on XXXX XXXX let the lender and realtor know that since the contract stated our close date was supposed to be XX/XX/XXXX and we didn't meet that date our contract was voided per the language of the contract and that we can only move forward with the loan with new terms. The realtor didn't respond to us until XX/XX/XXXX. I had been traveling and dealing with legal issues at the time so I wasn't able to send a response until XX/XX/XXXX and the realtor was asking the lender to close the file. XX/XX/XXXX we talked to the realtor an explored our options, we told the realtor we can not close until XX/XX/XXXX to move forward due to emergency expenses and that the money would be ready by then. The realtor told us that the seller is not able to close in XXXX and that the seller will have to be the one to terminate the contract and that we will still not be able to get our money back. We said okay we have no other choice then. The realtor told the lender it was our choice to terminate but we said that we are not able to agree to terms with seller and so the deal can't move froward. XX/XX/XXXX we received and email requesting documentation to move forward and close the loan. The realtor responded and said the file will be not be moving forward. XX/XX/XXXX I checked our online portal and saw that we had been transferred to a new lender, XXXX. XX/XX/XXXX the lender reaches out to me asking to sign the realtors termination letter on behalf of the realtor. I called the Lender 's company and spoke to XXXX XXXX, Compliance Senior Vice President, on XX/XX/XXXX letting her know what happened and she apologized and said that is not how the company is run, she said that the only way to move forward with an investigation is to have the loan and file closed out because right now we have an open loan just sitting there not doing anything and I agreed. She asked me to send her documentation which I did. A few weeks later we received a letter from the XXXX company stating that the fault was ours for not sending documentation when it was being requested of us and that we prolonged things moving forward. This was the last communications that we had.

On XXXX XX/XX/XXXX, My husband, XXXX XXXX, was referred to XXXX XXXX of USA Mortgage in XXXX, Missouri in regards to a home loan by our realtor, XXXX XXXX with XXXX XXXX. My husband, XXXX, contacted XXXX XXXX via phone call to inquire about home loans and pre-approvals. XXXX XXXX then started a correspondence with XXXX XXXX and myself through both email and text message ( see XXXX XXXX ). XXXX XXXX asked XXXX and I for various documents, including proof of income, taxes, and a copy of our IDs ( see XXXX XXXX ). XXXX provided his pay stubs from his current job at the time and XXXX previous ones. I, XXXX XXXX, provided my 1099 statements as I am a XXXX employee ( see XXXX XXXX ). XXXX XXXX asked for proof of me being a college student for the last couple of years, in which I provided as well ( see XXXX XXXX ) as he said that because of my self-employment they would need my college history ( see XXXX XXXX ). XXXX XXXX asked to run a credit check, in which XXXX credit was high enough but mine was not. XXXX XXXX instructed us via email and text on ways to help raise my credit ( see XXXX XXXX, XXXX ). XXXX and I made payments so that our credit score would rise. Once I received notice of my credit improving, I contacted XXXX XXXX so that we may continue the process ( see XXXX XXXX ). We were given a pre-qualification letter for {>= $1,000,000} on XXXX XXXX ( see XXXX XXXX ). After receiving the pre-qualification letter, we looked at houses and put an offer in on a house, XXXX XXXX XXXX XXXX, MO XXXX. The seller accepted our offer. After the offer was accepted, we contacted our realtor and put our house, XXXX XXXX XXXX XXXX XXXX, MO XXXX, on the market for {$170000.00}. Our realtor, XXXX XXXX, contacted one of his clients, who then viewed our house and made an offer within XXXX hours of it being on the market on XX/XX/XXXX. The clients offered the asking price, so XXXX and I agreed and signed a contract immediately. Within the next few days, the buyers of our house had inspectors over on XX/XX/XXXX. The private home inspector found little wrong with our house on XXXX, and we agreed to make all modifications that were asked of us ( we were asked to fix a banister and a drain ). While this was taking place, we paid for a private home inspection on the house we were wanting to buy in XXXX. The inspector found some major problems on XX/XX/XXXX, but the seller agreed to make all necessary repairs that were asked. While this was happening, XXXX XXXX and his assistant contacted XXXX and I asking for various forms and verification of incomes ( see XXXX XXXX, XXXX ). I also stated in a text to XXXX XXXX that his assistant was asking for two years ' worth of W2s but that I was a XXXX employee and did not have these ( see XXXX XXXX, XXXX ). My employer and office manager filled out the Verification of Income letter and returned it to me. I then took a picture and sent it to XXXX XXXX XXXX, XXXX ( see XXXX XXXX, XXXX ). After the income letter and documents were turned in, we were notified that we had made it into processing ( see XXXX XXXX ). During processing, on XX/XX/XXXX, I decided to go shopping for a loan. I contacted an agent with XXXX Mortgage out of XXXX, Missouri. She had me forward all of our information so that she could give us a quote. This agent called me the next day, very upset. She informed us that XXXX and I needed to find a way to get out of the sale of our home. She informed us that the loan would not go through. She stated that on our application it showed I was not self-employed ( which I had stated I was multiple times throughout the course of contact with XXXX XXXX and assumed they had filled it out as such ) ( see Addendum XXXX ) and did not have XXXX years ' worth of XXXX on my taxes, that XXXX had XXXX many late payments on our mortgage, and some late payments on installment loans. She informed us that USA Mortgage was not going to be able to close on our loan. Not only that, but also that we should have never been pre-qualified in the first place. She also informed us that my Verification of Income and Employment letters should have come directly from my office and not accepted via text from me. After receiving this call, I called our realtor, XXXX XXXX, immediately. He then informed me that there was no way out of the selling of our house due to the inspection already being done, agreed upon, and signed. Our realtor contacted XXXX XXXX immediately and asked him for clarification and for help. XXXX XXXX had led our realtor and ourselves to believe that this loan could go through, and we would be okay ( see XXXX XXXX ). XXXX XXXX reached out to us, after stating that things would be fine, to inform us that there were other things needed so that the loan would go through ( see XXXX XXXX ). XXXX XXXX stated on a phone call with me that he had the approval but needed to get our debt-to-income ratio reduced so that the loan would not have to go into manual underwriting. XXXX XXXX stated that because we were part of the COVID-19 forbearance, if the loan went into manual underwriting that it would not be approved. XXXX XXXX offered to find us a house with my income only or to try a different route ( see XXXX XXXX ). I immediately contacted the agent with XXXX, who assured me that there was no way any loan would go through with my income, or XXXX late payments without fraud. She informed us that we would not qualify for a loan until at least XXXX of XXXX. XXXX and I were shocked and very upset. We ceased all forms of communications XXXX XXXX XXXX see XXXX XXXX ). XXXX XXXX emailed us a denial letter ( see XXXX XXXX ). The denial letter further proves what the XXXX Mortgage agent had told us, that we should have never been given a pre-qualification based upon delinquent payments ( see XXXX XXXX ). We immediately began scrambling, packing and trying to find a place for our family to stay. We had to move into my sisters home and renovate her garage into a bedroom until further notice. We were looking to buy a house so that we could expand our family and relax. We loved our house on XXXX XXXX and the beautiful memories that we made with our family. Our family was comfortable and had a great quality of life. Unfortunately, I am a first-time home buyer and had no clue about late payments, installments, the process of VOE letters and such. Had we not been fraudulently pre-qualified, we would have never begun the process of selling our home. We would still be living at XXXX XXXX, our daughter would not have had to switch schools, and we would not have to spend so much unnecessary money. The mental and emotional burdens that we have all had to bear have been extremely hard on my family. XXXX and I made the mistake of trusting XXXX XXXX and USA Mortgage with XXXX of the most important decisions and milestones in our life. We trusted that XXXX XXXX and his team were knowledgeable about the FHA and home loan process, procedures, and documentations. It appears that this assumption was wrong and that our trust was misplaced. Unfortunately, it has led to XXXX, our XXXX kids, and me being un-homed and displaced.

Before closing on my new mortgage with USA Mortgage, they informed me that my interest rate was going to be XXXX because of my credit score. Therefore, I ask if we could buy points to bring my interest rate down and was told it would cost us what I think was over {$5000.00} and it would give us 2.87 % interest rate. I asked why the price was so expensive and was told, that's because it was expensive to buy points. I was later told I could not get points because my credit score was too low. However, at the closing on XX/XX/21, I noticed that under " Loan Cost '' it said ( 1.5 % of loan amount points {$4600.00} Processing fees {$650.00}, Underwriting Fees {$550.00} ) amounting to {$5800.00}. It was late in the evening during the closing, but I pointed out to the person that was conducting the closing and she suggested that I call the mortgage company. We called the mortgage company while in the closing process room. I believe it was XXXX XXXX from USA Mortgage answered the phone and said the people she needed to speak with were not there, they were out of the office, however, she stated we bought 1.5 % interest rate which brought our interest rate down to 3.25 %. I told her then that would mean to me, that she was saying my initial interest rate had to be 4.75 %, and that did not sound practical. XXXX said that they would take care of it on Tuesday XXXX so we signed the documents because we were under the impression that they would take care of this matter according to what the lady said. On XX/XX/21 we received a call from XXXX XXXX around XXXX p.m. saying that she sent us an email with documents to sign on XX/XX/21 that should have been part of the closing, and she needed me to sign them. I told her I would take a look at them as soon as I could. She called me back within a few minutes and said, she should have made it clear to me that I had to sign them before XXXX p.m., in XXXX minutes, or they would have to terminate my purchase of the house and they won't be able to lock in my interest rate. I couldn't get the email sent by XXXX to open. This happened 16 days after the closing. Therefore, I called the lawyers office, XXXX XXXX and XXXX immediately after talking to XXXX about this matter, and XXXX, a representative from the attorneys office, said that we were officially closed, and she had not received any document from USA Mortgage, and that they would reach out to XXXX XXXX to see what the documents were all about. XXXX sent the documents to XXXX at this time but XXXX could not open them and neither could I. I don't trust USA Mortgage and I would like to have them investigated to see what happen to my interest rate that they charged me for, or I want my {$5800.00} back. I don't know why XXXX is sending me documents to add to the the closing that took place 16 days ago, and I can't open the email documents to see what they are saying. I asked XXXX was the documents pertaining to the {$5800.00} that I charged for the points that I didn't receive, and she said yes, and it was pertaining to the rest of the closing also. Also, when I talked to XXXX XXXX on XX/XX/21, she said XXXX XXXX was no longer with USA Mortgage because of what they did to us concerning the points being incorrect, However, they may be able to offer me refinancing with a lower rate, and that she had talked to XXXX XXXX XXXX and XXXX XXXX XXXX said, she may me this refinancing with a lower interest rate because of what they did because it was too late to change the wrong that was done, to get my money back.

1. On XX/XX/XXXX XXXX I bought his single-family home located at XXXX XXXX XXXX XXXX XXXX, GA XXXX for {$370000.00}. The legal description of the property is Land Lot XXXX, XXXX District, XXXX Section, XXXX XXXX, Georgia, being lot XXXX, XXXX XXXX. 2. The day of the credit transaction completion and closing, I signed and endorsed a Check/Promissory Note and was made out pay to the order of : DAS Acquisition Company , LLC. XXXX. My Promissory Note check was tendered pursuant the law 31 CFR 103.11 ( u ) ( iii ) 4. However I have not received my closing documents in the quitclaim deed from the Seller/Grantor of the property as proof of transfer of all interest with clear and marketable title to the property, and I have not received the Title to the property according to the law at 31 CFR 103.11 ( u ) ( iii ) 5. Pursuant the Law of Money and Finance : Treasury at 31 CFR 103.11 ( u ) ( iii ) ( u ) Monetary instruments ( iii ) All negotiable instruments ( including personal checks, business checks, official bank checks, cashier 's checks, third-party checks, promissory notes ( as that term is defined in the Uniform Commercial Code ), and money orders ) that are either in bearer form, endorsed without restriction, made out to a fictitious payee ( for the purposes of XXXX ), or otherwise in such form that title thereto passes upon delivery ; 6. I have not received any closing agreements, or contracts thereof bearing both bona fide signatures and evidence of lawful consideration by XXXX XXXX, XXXX XXXX or anyone at DAS ACQUISITION COMPANY LLC 7. It appears DAS ACQUISITION XXXX XXXX, XXXX XXXX have devised or intending to devise a scheme or artifice to defraud, or for obtaining money or property by means of false or fraudulent pretenses or representations and making false claims and reports of making a loan of cash, check or money order. DAS ACQUISITION COMPANY LLC never made a loan. I have contacted DAS ACQUISITION COMPANY LLC and I have submitted a Loan Affidavit to be signed and notarized to verify and authenticate proof of any alleged loan. However over the course of 4 months, DAS ACQUISITION COMPANY LLC, XXXX XXXX XXXX, XXXX XXXX have failed/refused to sign and notarize the loan affidavit document supporting and providing evidence of a loan.

This company collected my DL, SS #, Mortgage Statement, and Credit Report. I'm severely violated here since now this XXXX man team will not hand over my XXXX XXXX credit report. The CFPB will not do anything but send a letter. YOU have to enforce harder punishment for these XXXX XXXX mortgage companies taking advantage of us and HAVING our whole life and we have nothing ( my SS #, DL #, picture, etc ). Now, they will not communicate with me after I informed them I was writing the Attorney General 's office. XXXX told me that they were pulling a " HARD REPORT '' BUT XXXX promised it was a SOFT pull. On the online application I told her that I wasn't going to agree to a credit pull since I had a copy to sue her. I HAVEN'T BEEN GIVEN ANY DETAILS OF THE LOAN? YOU have to REGULATE this Mortgage industry. NOW, I'M FEARING THEY WILL SELL MY DATA. They are refusing to release my credit report to me stating they can only send me a consumer version. I was forced to RELEASE MY CREDIT OR ELSE XXXX WAS NOT GOING TO PROCEED WITH THE LOAN. I had sent her a copy of my Credit Report from XXXX Bureaus ' but this was NOT GOOD ENOUGH FOR HER. SHE FORCED ME BY STATING THAT SHE HAD TO PULL HER OWN COPY??? IT STATES THE SAME INFORMATION??? Now, they won't proceed with the loan since I'm requesting a copy of what they have on me. They have a MORTGAGE CREDIT and XXXX stated that I CAN'T HAVE A COPY OF MY OWN CREDIT THAT SHE ILLEGALLY PULLED? XXXX alerted me that I had a hard pull on my credit this morning. I had sent her my credit report yesterday ( XX/XX/2022 ) SHE PROMISED ME IT WOULD BE A SOFT PULL SO SHE LIED. I DON'T EVEN KNOW THE NAME OF THE MORTGAGE COMPANY WHO WILL HAVE MY DATA? WHO IS DAS/ACQUISITION OUT OF MISSOURI? They don't even answer the phone like a normal business?

Included with this complaint you will find the closing disclosure provided to me on XX/XX/2016 by DAS Acquisition Company LLC ( DAS ). As you will see the closing costs disclosed totaled {$2200.00} ( page XXXX ) - this number includes {$2300.00} in loan costs + {$7100.00} on other costs - {$7300.00} in lender credits. Therefore, my cash to close totaled {$0.00}, as disclosed on page XXXX. HOWEVER, it is the practice of DAS to require borrowers to agree to the additional attachment provided which requires me to bring in {$4800.00} to close. I believe this practice by DAS Acquisitions Company LLC DBA as USA Mortgage is intentionally set up to circumvent the requirements of Regulation Z, specifically the disclosure requirements of TRID. If nothing else this closing disclosure and accompanying document should be considered an unfair deceptive act or practice as one document leads a borrower to believe their cash to close is XXXX when what is truly happening is the lender is disguising a lender credit as a borrower 's true cash to close. DAS should be required to comply with Regulation Z and truly honor the lender credit as disclosed in the closing disclosure and therefore my cash to close would truly be as disclosed on the closing disclosure {$0.00}. I would also recommend that this complaint be expanded to identify any other impacted consumers. A lender should not be allowed to issue conflicting closing documents. I am not sure if this is a sales tactic or a way to avoid having to verify assets of a consumer and doubt this document is provided to the final investor as it would make the closing disclosure in violation of Regulation Z.

We were pre-approved for an fha loan by a lender at USA mortgage in the beginning of XX/XX/2021. We were sent a pre-approval letter as well as our realtor thay was assigned to us by the lender at the company. We were told to go and make offers and find our home. We look for weeks, looked at many homes found one, made an offer didn't get it. We kept looking then we found the one. Made the offer told the loan officer about it he gave us number like what to expect for mortgage payments and such and then our offer was accepted. Now we are at the end of the closing process and the lender calls abd says there is an issue on the XXXX report. Not denying there is, however, we asked why this report wasn't ran wheb we were pre-approved and were told via text message, " a XXXX report can not be ran until a fha case number is assigned and in order to do that you need to be in contract '' so my grievance is : we were lied to about the XXXX report not being able to be ran, we were told to get into this binding contract and started packing and investing money into loving into this home and USA mortgage is the reason we entered the contract in the first place. I fear litigation charges from the seller as they called weeks ago told us there was an issue. Called right back within 5 minutes and said they were mistaken everything was fine, then last week they finally ran the XXXX days before closing.

Violation of the Fair Credit Reporting Act ( including but not limited to Section 623-b ) A Notary Public is a state public officer appointed and commissioned by the Governor whose function is to : administer oaths, take acknowledgments of deeds and other instruments, attest to or certify photocopies of certain documents, and perform other duties specified by law. Responsibility of a notary provides for authentication in lieu of notarization in 28 U.S.C. ... That section provides that to meet any notarization requirement under federal law or practice, an unsworn declaration under penalties of perjury is sufficient.

Im currently selling my home and in the process of buying a new one through contingency. The buyers of our current home we are selling are going through DAS acquisition company/USA Mortgage as their lender. Our first closing date was XX/XX/2020 and now here we are 4 different closing dates later and the lender is still having problems. It started off as 5 days before closing, then 3 days before closing, and now 14 hours before closing. I have personally tried calling them and was told someone else would call me back and still havent heard anything, the title company hasnt heard from them and neither has my agent. I want some answers and compensation! This is ridiculous and very very unprofessional. I would not deal with this company if I were a realtor!!! Im currently renting the new house to make sure the owner doesnt sell it which is $ XXXX a month PLUS my regular bills at our current house which is also $ XXXX. My husband is the only person that works in our house because I stay home with our child and this is getting to be way to much on our family. This company is horrible, it needs to be shut down!

Before I hired my mortgage company or even of knew of DAS Acquisition Company, LLC., DAS ran my credit without my permission. Credit ran XX/XX/XXXX ( this inquiry is reported by all 3 credit reporting agencies and XXXX ) ( XXXX XXXX XXXX XXXX notice attached ) XXXX XXXX XXXX XXXX XXXX XXXX, MD XXXX my actual lender was DAS ACQUISITION Co LLC XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Mo XXXX I never gave either one of them permission to run my credit. I was informed by the company XXXX XXXX forms ( attached ) were illegally created and other loan modification papers were sign with a signature that uses my name but not signed by myself. XXXX has informed me these are forged documents created by DAS. This is the mortgage company I eventually ended up using and get and gave them permission permission to run my credit at a later time on XX/XX/2021. The latest credit score was not used on my loan which was a much higher rate. A lock in rate was obtained prior to DAS legally having permission to a much higher credit score.

Went thought USA Morgtage and DAS Acquisition underwriter at the last minute on last wednesday stated I need addition document of employment. My loan officer I have no issuse with its the underwriter of my VA mortgage put me and my family is a really diffucuilt sitution and loss hope and uncertaintly of using this house that the underwriter went though all the stages and getting our hopes ups, and making my family possibility becoming homeless over this sitution. My mortgage broker submitted my application for a loan I would not qualify for, even after being provided full disclosure of my situation. Broker was not aware of mortgage rules and as a result submitted my application for a loan type I would not qualify for, and then did not advise me in a timely manner prior to the financing contingency deadline that underwriting had found issues with the application. As a result, I lost {$1500.00} earnest money. Mortgage broker refused to take responsibility for lack of timely communication, and not understanding the mortgage rules.
