I received a several phone calls and text messages in XXXX of XXXX from someone saying they were attempting to collect on a debt from a default judgement in Massachusetts small claim court from XXXX. The person texted from XXXX. The caller/texter never fully explained who they were but made it seem like they were a representative of Norfolk Financial Corp , who apparently purchased the debt and obtained the default judgement almost 20 years ago. I informed the person that I only went to college in MA, and hadn't lived there for more then a year when the court docket shows the papers were served to me at an address that wasn't mine, and furthermore the debt wasn't mine. I specifically told them that they were probably looking for my father who shared the same name as me, and lived in the address they had in MA, but they insisted it was mine. They threatened that they were next going to levy my bank account. I asked them for additional details on the original debt understanding that Norfolk Financial is only a debt collection company, and they never responded further. I was able to look the judgement up online in the MA circuit court archives, and it very much looks like there was a default judgement made against most likely my father at that time. I received another set of calls today, XX/XX/XXXX, allegedly from the same group. The phone call came from XXXX, but they asked me to call back on XXXX. Further texts also came from this number. In the message the female caller identified herself as calling from attorney XXXX XXXX 's office, and provided the docket number from the original default judgement as well as the last 4 digits of my SSN. She said the call from XXXX was from her 'paralegal '. She again threatened me that she would next levy my bank account. Over the phone I reiterated that the debt wasn't mine, I didn't live in MA when the court summons went out, and that it was likely my fathers. After telling this woman that I wasn't interested in talking about this further she abruptly hung up on me. Within a couple of minutes she texted me an image of a document that I assume shows the original debt, which was from XXXX XXXX. The problem is the SSN on it isn't mine, the debt was for an account that was opened in XXXX when I was XXXX XXXX XXXX, I never had any accounts with XXXX XXXX, and again I didn't live in MA when the debt was purchased and the small claims case was prosecuted. I informed her of all of the issues with their attempt to collect this debt, informed her that my father passed away close to 5 years ago with nothing in his estate, and that I would consider any additional attempts at contact would be considered harassment and that I would sue for violations of the FDCPA. The second screenshot she sent to me was from a firm called XXXX XXXX XXXX, XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXXXXXX MA XXXX, with a phone number of XXXX and an email of XXXX. I can find no record of an Attorney XXXX or XXXX XXXX or XXXX that works in debt recovery in Massachusetts, but there is a long history of people associated with these numbers and companies doing borderline scam debt recovery, and they are associated with Norfolk Financial which was barred from being licensed as a debt collector in MA so they farm out the actual collection to smaller firms.

After receiving a few phone calls at work ( he left a message ) and on my cell phone from XXXX XXXX of the law office of D. Carruthers in XXXX Ca I decided to call him back. He told me I had a debt and owed XXXX from a XXXX loan I had taken out a few years ago. He then gave me XXXX options 1. pay XXXX today and make small payments on the rest. 2. make larger monthly payments to pay it off. 3. pay smaller payments but would need to pay XXXX today for a down payment to start the repayment process. I explained to him I would need more time to come up with XXXX. He told me that was not an option because I have already taken a long time to repay them back. He also told me it would be embarrassing if he had to serve me legal papers at my place of work since I am refusing to settle this today. I told him I was not refusing to settle, I just needed more time. He began to get rude and began to ask why cant someone like my husband or anyone help me pay this. I explained, I did not have a husband or anyone that would help me. I told him it is too hard for me right now because I have a baby and another son. He then replied, " so you have a new baby with no husband ''. He said that sarcastically. He also said he knows how much money I made and said he knows I can make the payments. I again explained to him I was not able to pay just yet. I asked if I could call him back. He confirmed my place of employment as if he was going to send someone to come by. Before hanging up I asked to speak to the attorney he had mentioned earlier he said I could speak to him at court. I was trying to see if we would be able to settle something in the near future, but he did not seem to want that. after a few minutes went by I called him back because I felt very threatened and nervous about him/someone coming to my place of employment. When I called him back I told him to not call or go to my work ever again. He replied by saying they will do whatever they want to resolve this. I then asked for their address. He replied by saying that I do not need their address anymore because they have already made a decision about what to do with my case. I said I want your address any way. He gave me XXXX XXXX in XXXX Ca XXXX. I then asked for their fax. XXXX XXXX then hung up on me. Also in the middle of the conversation I asked him how much was the loan I took out, he replied XXXX or something like that, but I now owe over XXXX from interest. I feel threatened and nervous about job loss. I also think he refused to settle anything with me because he did not want to give me more time.

A collection company named, XXXX XXXX XXXX , XXXX, ( XXXX ) owned and operated by D, Scott Carruthers has violated my rights under the Fair Debt Collection Practice Act ( FDCPA ) by attempting to collect a debt outside the statute of limitation for collection. XXXX also filed a collection lawsuit for the debt, which was outside of the statute of limitations of four years in this state. The debt was with a company called XXXX, which went delinquent and into collections in XX/XX/XXXX, and was Charged off by as a bad debt at the time. XXXX XXXX XXXX bought the debt for pennies on the dollar in XXXX and are attempting to illegally collect a debt outside the statute of limitation, and trying to collect XXXX times the original amount ( {$3800.00} ), which according to the FDCPA is also illegal. XXXX XXXX XXXX started their tirade back in XXXX XXXX by calling my job and threatening me on numerous occasions, until I demanded their office stop calling my workplace. XXXX XXXX XXXX and D. Scott Carruthers has threatened me, harassed me and are now filing an illegal lawsuit for collection of a debt that according to federal law is an illegal attempt to collect. Furthermore, XXXX XXXX XXXX has knowingly acted outside the law and have no respect for it, because Carruthers and XXXX XXXX XXXX never formerly served on the lawsuit in accordance with the law. XXXX 's sole purpose is to bottom feed by taking advantage of folks that were subject to financial misfortune during the housing market crash in XXXX, which I was a part of. I am asking that Mountain Lion Acquisitions, and D. Scott Carruthers be held accountable for their illegal acts, and everything they filed with the courts be rescinded, and they remove the Judgment notice XXXX 's and D. Scott Carruthers reported to my credit reports, which was filed erroneously, and was outside the statute of limitations for collection. Additional, XXXX XXXX XXXX , XXXX and D. Scott Carruthers lawsuit and reporting to my credit report has caused me not to be able to secure a personal loan of {$50000.00} as of XXXX XXXX, because of their erroneous reporting to my credit report. A Financial Representative from the company I applied to specifically asked me about the judgment, which was reported as of XXXX XXXX, which I was not aware of until then. furthermore, XXXX and D, Scott Carruthers filed a lawsuit without properly notifying me of the lawsuit, which again is against the law. Yesterday I received XXXX calls from a debt collector XXXX XXXX XXXX XXXX XXXX stating that they were a law firm attempting to collect a debt. This is after a conversation I had the previous day ( different customer service agent/paralegal ) requesting an email with their original correspondence as I had recently moved. I did not receive this email. They called at XXXX, XXXX and XXXX ( yes I have the EXACT time, and the calls came to my employer ). During the first call the man refused to give me his name and literally YELLED at me screaming, " YOU KNOW WHAT YOU NEED TO DO, YOU JUST NEED TO PAY IT. STOP TRYING TO BUY TIME!!!! '' All I asked for was a copy of the original correspondence in regards to the debt that was sent to me. I asked for them to email this letter so that I could review it ( I mean who makes legal decisions without seeing something in writing? ) and he yelled, " SO WHAT ARE YOU GON NA DO?? IF I SEND YOU THIS EMAIL I WILL GIVE YOU XXXX MINUTES TO READ IT AND I WILL CALL YOU BACK. STOP TRING TO BUY TIME! YOU '' RE GINNA PAY THIS!!!! " Needless to say, I then hung up the phone. I was at my place of employment getting yelled at by a stranger that refused to provide the correct documentation in regards to the debt, and was yelling commands over the phone. They also threatened legal action and wage garnishment, and would not let me speak AT ALL. During the second call he called and said, " SO WHAT IS YOUR EMAIL?!? '' No hello, no can I speak so so-and-so or anything. I gave him the email and he began to yell again. " SO WHAT ARE YOU GON NA DO? YOU NEED TO PAY THIS NOW! YOU HAVE XXXX MINS TO READ THE EMAIL AND I AM CALLING YOU BACK TO ASK YOU HOW YOU 'RE GON NA PAY!!! '' I kept saying ( in a very low and calm voice because I am at work ) to " Please stop calling my job. '' He kept speaking over me and would not allow me to ask questions, so yes, I hung up. The third call went ignored. Did I mention hat they left a message on my SUPERVISOR 'S voicemail???? This is where it must end. I do n't care if someone owes {$5.00} or $ XXXX, there is no reason to yell and harass them at their place of employment. This company has crossed the line. I sent a cease and desist letter via email, AND CERTIFIED MAIL and received yet XXXX other phone calls this morning. So technically there are 4 issues:1 ) Frequent or repeated calls2 ) Used abusive language3 ) Threatened to take legal action4 ) Called after written case of communication notice.

My complaint is from the Very Beginning Mountain Lion was very Cantankerous & trying to bully me around over the phone. Then later I received a Notice of Wage Garnishment of {$18000.00} from Mountain Lion Acquisitions. This company did not lend me {$18000.00} they purchased the loan from the Original owner Cash Call who lent me {$5000.00} to pay my Federal taxes. Therefore I do n't believe its Honest, Integrity or Fair for them to try & collect {$18000.00} from me when that 's not the Correct Accurate amount of the Original Loan. Mountain Lion nor cash call ever tried to work with me Mountain Lion just called me all the time with threats & this Ridiculous offers that no one can comply with unless your Rich, not a Normal hard working person that Pays the Correct amount of Taxes legally & Do n't Cheat on their tax returns & say I do n't know I just gave everything to my CPA yeah you know. Mountain Lion are in Violation of the Fair Debt Collections Practice Acts 15USC.1692., Common law malicious prosecution, & they are violating the declaratory relief under the California Finance Lender law XXXX, Mountain Lion is also in violation of the Roenthal Fair Debt Collection Practices Act California Civil Cod 1788, etseq. These kind of Company are Big Time LOAN SHARKS that should be prohibited to do Business because they PREY on Innocent hard working people like me! Also they Claim Millions of dollars on there tax return & write it down to mere pennies or some where around {$2500.00} and Rip off innocent people .They really were never willing to work with me they always asked for ALL the Money up front the Whole amount or more. They asked me for {$8500.00} the whole amount up front & then they just kept raising to {$9100.00}, {$11000.00}, {$16000.00} & Now {$18000.00}. If I had that kind of Money just laying around, then I would have never needed a loan in the First Place. Also With cash call they never tried to work with me if they did it would have not gotten this far I believe Cash call & Mountain Lion work as a team to Rip off people & That 's why they have a TV Commercial now. Original creditor loan me. Shark loan. These people should be shut down. Took out loan emergency situation. Did not need the whole {$3000.00} representative explained I had to and that I could pay it back in 24 hours. Intrest would be reduced substantially. Paid back {$1500.00} of loan immediately. Company continued to charge over 100 % of interest on the loan. Misleading tactics. Attempted to settle what was owed. Same name clearly two different ethnicities. XX/XX/XXXX ( XXXX ) XXXX, XXXX, XXXX, XXXX XXXX, stating failed response, will be at my place of employment and or residence to serve me. Final notice. Stating balance of nearly {$3000.00} {$1200.00} original amount the other so called interest they claim to be charging me. Attempted to dispute with credit bureau. No validation received from this company only a bill with unlawful interest and law suit threats. There are many more phone calls from this company I receive, including my relative 's and friends. They are in violation of the fair debt collections act. They are falsely representing that a legal proceeding will be taken against me unless the alleged debt is paid.

On XXXX XXXX, XXXX, I received a letter from the XXXX XXXX D. Scott Carruthers, stating I owe a balance of {$16000.00} for an original debt of {$2100.00}. In the letter they also state that once they verify my place of employment, then they will begin the lawsuit. I have written the collection agency that this law office is representing on several occasions requesting proof of the debt. I have never gotten any response from them. The last letter I sent to them was dated XXXX/XXXX/XXXX where after doing some research of my own and contacting my states attorney general, I found out that the Statute of Limitations had expired.I sent them that letter explaining my findings and still have yet to get a response from them. And now 1 year and 3 months later I get a letter stating that I will be sued. Update XXXX : I have since tried to resolve this matter by going to court but ultimately settled and am now paying {$50.00} a month on a debt that I do not owe. I am a victim of identity theft and this loan was taken out in my name without my knowledge by my former boyfriend who I was abused by. I feel that since we lived together at the time and he had access to all of my personal information, that he took out the loan without my knowledge or consent. I provided this information to the lawyer that contacted me including police reports, and an identity theft letter ( notarized ) and copies of previous restraining orders to prove the abuse that I was subjected to. A deposition was done as well, and I told them the same thing. But they continued to state that I owe the debt. Although I am currently paying ( out of frustration, and fear of them finding my abusive ex and them giving him any information to where he can find me-he has threatened to kill me on several different occasions ) is there anything else that I can do? I have attempted to contact XXXX XXXX, not XXXX, and not D Scott Carruthers, a law firm, to contest the amount they say I owe for a personal loan through the original creditor XXXX. I have tried to get a response from XXXX XXXX directly to resolve my account. I am forced and rerouted to speak with XXXX XXXX who works at the law firm D Scott Carruthers to accept their amount of {$20000.00} as the amount I owe. I have contested this amount and asked to pay a settlement close to the amount that still appears on my credit report of {$3100.00}. In good faith, I have paid more than {$1100.00} at their demand to enter into any paid agreement, and they required $ XXXX monthly as the only option to pay off the loan. I am unable to pay $ XXXX monthly so they have declined all together to make arrangements with me as they continue to add interest 300 % more than the original loan. I am asking to set up a monthly amount of {$200.00} and a settlement equal to or near the original debt. They are not budging. They called me two weeks ago and I requested the same amount, and they said they would get back, but I have not yet been able to reach an agreement while the interest they claim is rightfully there's is accruing. I need help in getting a reasonable settlement with a monthly payment that I can pay. Why I am forced into an agreement with lawyers instead of the debt collector XXXX XXXX is also concerning. XXXX XXXX has not reported the the credit bureau any payments made in the amount of {$1100.00} to my account. Nor have they stated the amount of the debt owed. There aren't any trade lines with the amount I owe, as they accrue interest by withholding an a reasonable payment agreement. They aren't being transparent in my view. They would rather not make an agreement in your presence, but I need a reasonable agreement before they sue me for {$20000.00}. I need an agreement right away to stop this interest rampage. First call was at XXXX in XX/XX/XXXX.A XXXX XXXX is calling me regarding putting a court ordered lien on all my bank accounts. I was told I owed a debt from XXXX and a judge had ordered a lien on my bank. He provided a docket number from a county I lived in at the time. I asked for correspondence regarding the legitimacy of the debt. He got loud and ordered me to talk to the court where the judgement was ordered. I again asked him to provide the proof as I am unaware of any judgements on me and nothing has been sent to me, nor do I recognize the debt. He gave an address to a place where a family member once lived at the time. On the night of XX/XX/XXXX I advised him I talked to the MA State Attorney Generals office and they advised me to again request documentation be sent out. He then told me hed email me the court decision to me. On the first night he stated the lien would be for {$3500.00} all said and done. On the second night he stated the lien was going to be {$7500.00}. I told him I need to know the legitimacy of the actual debt being mine and that way I could have a lawyer look at it and tell me if it was in fact not a scam and then Id settle anything that is in fact mine. He started yelling and talking over me. I asked what company he represented and he stated he works for Norfolk Financial thru the law office of XXXX XXXX in the XXXX Ma area. I called the low office of XXXX XXXX and they claim to have never heard of XXXX XXXX who claims to be a lawyer sometimes and then a paralegal the next. He then tells me he can have the Norfolk Finacial call me since they are right across the hall. I asked for a number and he provided XXXX and his number is XXXX. I asked for the toll free number and he stated they no longer have a public number. I decided to hang up at this point telling him hes not providing me the proper documentation to prove I owe the debt and two he cant prove he has the right to settle the debt.

I took out a loan at XXXX for XXXX was paying back XXXX a month after XXXX payment which was a total of {$3800.00} I was under the understanding I was finished paying the loan back. As time went by XXXX XXXX was never on my credit report. Then this year in XX/XX/XXXX a lawyer from D SCott Carruthers contacted me to settle a debt that they say i owed of XXXX when my husband asked who the debt was from they said XXXX XXXX. we asked to send proof at the debt nothing was ever sent.Two months passed and in XX/XX/2018 the lawyers from D Scott Carruthers was calling 4-5 times a day demanding payments, then they started calling my place of business 4-5 times a day which i told them to do not call me at my workplace and my husband trying may attempts to try to resolve the issue at this time my husband was trying to Negotiate with them a payment plan since my husband is out of work and we are a single family income. They started threatening him with if you dont pay today we will take you to court and garnish your wedges if you dont pay XXXX XXXX up front we will take you to court and make you pay and make you pay paper fees and court fees my husband state we could pay XXXX down make monthly of no more that {$200.00} payments which is financial burden at this time and settle at no more than {$5000.00} and she stated they would think about it that was on a Friday XX/XX/XXXX they called back that Monday demanding XXXX down at {$380.00} a month settle at {$9000.00}. My husband re explained we didnt have that kind of money and she state if I dont hear a response by the end of the day I will file a judgment take to me to court and garnish my wedges. This was the last time we talked to her as of XXXX XXXX. D Scott Carruthers has never sent us anything and we really have no way of knowing how much the debt really is.

This company has called friends of mine, referrals that I placed on prior application loans and told him he 's an attorney ( although he 's not ... when I spoke with the rep he said he 's with Scott Carruther 's law office ). They 've discussed my debt with other people, they call other people ( friends and family of mine ) on their cell phones and scare them telling them they 're an attorney and that I must call them. They call me several times a day, they 're making false statements, bothering my friends and family. I have never gotten anything from them in writing. I asked them to stop calling me that I 've disputed this debt on my credit report and they said I have to send them something in writing. I 'm about to send them a certified letter in the mail.These people are thugs and no attorney in California who is still practicing should put his name along with these types of blatant tactics that are obviously against the law. They do this to helpless people and think they can get away with it by quoting this man 's name The Law Office of XXXX. and he knows their tacts. I 've read hundreds of reviews from other people regarding him and his obvious and I ca n't believe they 're still in existence and that they can continue to treat people like this. I hope that this organization can do something about this. They threaten legal action saying they 're going to summon me and take me to court on a loan amount that I have no idea {$18000.00} when the original loan was {$5000.00} and half of it which I paid off to them.

On XX/XX/XXXX my father received a call from XXXX he was questioning about my where abouts and where I lived at. He told my father that was offering a job and was trying to get general information about me. I dad finally realized that this was not an employer and told him to stop calling he. He then began to hostile and my father hung up. The same number has contacted my mother more then 10 times through out the day between the hours of XXXX-XXXX. He has threated her and told her that if she does not provide information about me he will pursue legal action. on numerous occasions my mother has told him to stop calling and harassing her. He called again on XX/XX/XXXX at XXXX and has threated her and harassed her. on XX/XX/XXXX at XXXX he contacted my work spoke to a student assistant and demanded to know if I worked there and the work site address. The student assistant provided the worksite address thinking it was regards to work. The phone call was transferred to my desk, and I explain XXXX XXXX XXXX to stop harassing my parents, sibling and friends. That my parents will be will be calling the police department in regards to harassment. I told him to stop calling me and hung up. I'm not sure who this person is, he is falsifying and pretending to be someone an employer, just to get information on me. It has been over a year and he continues to harass me. It has gotten to the point that he has contacted my employer. This is unacceptable. XXXX XXXX XXXX XXXX, XXXX XXXX is the information I have on this person.

D. Scott Carruthers XXXX XXXX XXXX, XXXX, CA XXXX This office, specifically a man named XXXX XXXX has been calling my work, my Manager, my boyfriend, my sister, my other relatives and my cell phone non-stop leaving messages and trying to locate me by asking ways to get contact with me and leaving messages with them, for me to contact the " Attorney Office '' as to make it sound like I am facing a legal issue. This is very embarrassing, especially because I work at a University and hold a professional position. I have sent a certified US Mail to his office asking him to Cease and Desist all phone communications to all the numbers he has, and all communications must be done through US mail. That was dated, XXXX XXXX, 2016. Since then up until today, he continues to call. I made one last call to his office on XXXX/XXXX/16 and spoke with XXXX, I said, " XXXX I am asking you to stop calling my work and all other phone numbers you have on file, this is harrassment. I want all communications via XXXX Mail. '' He said, " I did. '' Then I said, " I also sent a Certified Letter on XXXX/XXXX/16, requesting you to Cease and Desist. Goodbye ''. I have received repeated calls at work and on my personal phone number from XXXX XXXX and XXXX XXXX claiming they are attorneys who are attempting to sue me because I will not pay a debt they say I owe. I am currently going through a security clearance with the XXXX. I had a debt with XXXX XXXX ( original lender ) that has been transferred to Mountain Lion Acquisitions. I called them on XX/XX/XXXX at 1108hrs. I spoke with XXXX and my financial counselor attended this telephonic appointment. When we asked to be placed on payment arrangements, XXXX disclosed that my balance was {$17000.00}. This loan was taken out in XXXX of XXXX. I made 3 payments of {$360.00} for a total of {$1000.00}. I have been contacted on numerous occasions by an alleged debt collector from phone number XXXX XXXX XXXX XXXX. They claim that I owe a debt on an old loan to which I have no knowledge. Hi I received a call from " Law office of Scott Carruthers '' today. First a girl spoke with us and said we owed a few thousands on a bank account that had negative balance almost a decade ago. And that we need to pay this amount. When we asked her if her office was a debt collection agency, she said NO. She said they were a law office. Which seems like it was a false statement. When we disputed this amount since we do n't see it on our credit report, she started getting irritated and handed it over to her " supervisor ''. The supervisor seemed irritated right away. So we asked him to mail us a letter with all the details of this account, amount, etc. on their letter-head. He refused saying he did not want to spend 42 cents mailing a letter. I requested a credit report on XXXX/XXXX/15 and found that this company, XXXX XXXX XXXX had placed a negative account on my credit report. I contacted them and requested a copy of any contract, policy or anything that shows I have ever given them permission to establish an account on my behalf. My brother received a phone call from a man named XXXX XXXX who stated that he worked for the Law Offices of Scott Carruthers of XXXX, Ca and during the phone call he had disclosed information to my brother about a pending court date which I was informed by my legal resource that he is not allowed to do so by law. Last year ( 2015 ) phone calls were constantly terminated to my work phone from XXXX XXXX calling from the XXXX XXXX. In XX/XX/2017 I reached a settlement with a law firm D Scott Carruthers representing XXXX to settle my account for {$7500.00} and remove the negative items on my credit report. I attached the settlement emails and the verification of my completion of the terms. I specifically ran my credit report prior and included in the exhibits so there was no confusion. My husband and I get calls from D. Scott Carruthers office.
