Currently I ( and members of my family are being attacked regarding a debt tied to my SSN ) via harassment by D & A Services , LLC ( Dynia & Associates , LLC ) regarding a debt they currently hold under my SSN. Each of my creditors, on every account that is going unpaid due to my inability to pay approximately {$480000.00} dollars in debts to various creditors and the IRS. Each creditor was notified in writing that I will be filing for bankruptcy as soon as I have enough money to secure an affordable attorney and cover my filing fees. For each company I submitted and verified that they received my request for a cease and desist for no contact - with additional directions to require them to mark the account in a manner that if the debt was outsourced for collection that they would see the account notated for no contact as well. D & A Services , LLC ( Dynia & Associates , LLC ) has willfully engaged in a complete disregard for my request despite them receiving a SECONDARY cease and desist request with notice of intent to file bankruptcy delivered to : XXXX XXXX XXXX XXXX, XXXX XXXX, IL XXXX & XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, IL XXXX Their company consistently operates outside of federal protections regarding debt collection and following their unsuccessful attempts to bully and harass me into paying a debt that I can not pay they have begun their persistent aggravated contact attempts to my family members and roommates including an onslaught of daily phone calls to my father ( same name ), who lives in a different time zone and they call him daily between the hours of XXXX and XXXX XXXX his local time. I have secured his phone records validating the time of contact and all the numbers can be traced back to D & A Services , LLC ( Dynia & Associates , LLC ). The voicemails left identifying their company and the debt confirm the call tracing. D & A Services , LLC ( Dynia & Associates , LLC ) is further advised for immediate notice in this escalation complaint addressed to the CFPB and FTC to cease and desist any and all communications with me, my employers ( past, present, future ) and to discontinue their harassment, intimidation, and contact with my relatives/roommates/associates. As well as to black list my social security number and bar any accounts past, present, or future from any kind of contact. I feel I am under extreme duress from their relentless refusal to cease their harassment and communications to 3rd parties disclosing my debt. D & A Services , LLC ( Dynia & Associates , LLC ) had received the separate notice advising that I am having to file a bankruptcy and Im getting together my filing fees. I dont have the funds at this time and although there are several legal firms who have offered to take up my harassment case against D & A Services , LLC ( Dynia & Associates , LLC ) in a class action claim at no cost upfront ; my bankruptcy filing is a different issue it takes time to get together the funding for that with my family providing assistance when they can. There is no confusion regarding my clear communication to D & A Services , LLC ( Dynia & Associates , LLC ). In order to fraudulently obtain a default court judgement in their favor, they are consciously falsifying their contact records and will deny any receipt of my correspondence and continue to aggressively collect on a debt held by their offices. I am certain they have falsified their records. In the process of their aggressive collection efforts even after receiving my cease and desist requests with notification of bankruptcy intent ; they have exposed my private financial issues to multiple 3rd parties. Their actions have put an agonizing amount of stress on me and ruined my mental health state. I have also escalated a formal complaint including documentation to the Virginia State Attorney Generals office for investigation into the business dealings of D & A Services , LLC ( Dynia & Associates , LLC ) in my state. Regarding my concerns, I am requesting a further investigation into D & A Services , LLC ( Dynia & Associates , LLC ) including a full review of their business practices and detailed audit of other consumer complaints like mine against their company. They can not be allowed to continue operating beyond the scope of required business practices for a debt collection agency. After consulting with a legal advocate attorney who is handling other complaints against D & A Services , LLC ( Dynia & Associates , LLC ), I intend to seek all options through class action or individual suit including any compensation available to me based on the array of evidence ; and their intimidation and blatant disregard for the protective laws in place by flat out refusing to abide by my cease and desist requests for no contact along with an additional refusal even after receiving notice of my intent to file bankruptcy. This notice of complaint to be filed with the CFPB and FTC as well as the Virginia State Attorney Generals office serves as notice of my grievances with this collection company.

XX/XX/2021 To whom it may concern : I would like to file a complaint against XXXX D & A Services , LLC. I just received the attached collection letter from this collection agency for a debt that I have already disputed against, XXXX XXXX Bank, because I do not owe XXXX Bank the {$710.00} that they continue to send to different collection agencies claiming that I owe these funds to them. Each time that I have disputed this fraudulent charge that XXXX XXXX Bank has run up themselves with their usury fees, and charges. XXXX XXXX continues to pass on this debt that they know full well that I do not owe, to collection agency, after collection agency. And the collection agencies have been placing these fraudulent charges onto my credit files without first even verifying the debt, just as XXXX XXXX XXXX has done. Just as the attached collection letter that I have sent to you shows, XXXX D & A Services , LLC, is claiming that XXXX XXXX XXXX, a collection agency, is the current owner of this bogus collection debt, the same debt that XXXX XXXX XXXX, did not verify first, prior to slandering my credit, the same debt that I have already disputed, they are now passing on to another collection agency. I have already disputed this {$710.00} debt, along with two others against XXXX XXXX XXXX that they had claimed to have acquired from XXXX Bank. I do not owe the debts that XXXX Bank is trying to charge me for, as well as XXXX XXXX XXXX, and now this new collection agency, XXXX XXXX D & A Services LLC. And although I have disputed the collections that XXXX XXXX XXXX has unlawfully placed onto my credit files, collection accounts that they know that they never prior verified. Both XXXX XXXX XXXX, and XXXX Bank are now trying to pass on these collection accounts onto this XXXX D & A Services LLC, knowing full well that I did not charge up the false balances that they are destroying my credit with. XXXX XXXX XXXX knows full well, that they placed collection accounts onto my credit files maliciously, and wrongfully without verifying the debts, and this is unlawful. Since last year after I learned about them, I have disputed these false collection accounts that XXXX XXXX XXXX has wrongfully placed onto my credit files, collection accounts that they never did prior verification of debts on. I requested copies of my credit reports from the credit bureaus, and this is how I had found out about the collections, and that both XXXX Bank, as well as this XXXX XXXX XXXX, were both listed on my credit files, destroying my credit twice. My credit files are being dinged twice, for each of the accounts that XXXX has wrongfully ran up, and is falsely claiming that I owe. Both XXXX Bank, and this XXXX XXXX XXXX, have doctored up status dates onto my credit files, making it to look as though I have had dealings with both XXXX Bank, and this XXXX XXXX XXXX, as recent as present XXXX, and that is a lie. I have had no dealings with XXXX Bank going on two years, and as previously stated, I do not owe those balances. But yet, both companies are making sure that the credit bureaus wrongfully destroy my credit rating, by placing those balances that XXXX Bank knows that I do not owe. As previously stated, I have just received the attached collection letter from this collection agency XXXX D & A Services , LLC, a collection in the amount of {$710.00}, and I am disputing this debt, because I do not owe it. I neither owe this {$710.00} debt to XXXX XXXX Bank, nor do I owe this {$710.00} debt to XXXX XXXX XXXX This same debt that XXXX XXXX XXXX never prior verified, prior to slandering my credit, they are now illegally passing this collection account on to this XXXX D & A Services , LLC to unlawfully collect this debt, even though I disputed this debt against XXXX XXXX XXXX after I found out it was on my credit files last year. The attached letter from XXXX D & A Services , LLC Is dated XX/XX/2021, and as stated I just recently received it, and although this collection agency has not even verified this debt, they too have begun to harass me. I have received calls on my cell phone from this collection agency, and there is a XXXX XXXX from D & A Services that has been making calls to me. She has left voicemails stating to call her at this number XXXX XXXX XXXX XXXX ext. XXXX. And in my call records it shows that she is also calling from a XXXX XXXX XXXX XXXX leaving voicemails. I received a voicemail on XX/XX/2021 at XXXX XXXX from what sounds like a recorded mechanical voice threatening me with legal action.

D & A services left a VOICEMAIL message that said, " We have an important message from D & A Services. This is a debt collector. Please call this number. Thank you. '' Now, this was the first initial communication between myself and D & A Services LLC., by FDCPA rules, they had to disclose the mini Miranda. Specifically,15 U.S.C. 1692. *Case Law : XXXX v. XXXX XXXX XXXX XXXX " We need not look any further than the statutory language of the FDCPA to decide that the voicemail is a communication. XXXX XXXX 's first voicemail to XXXX falls squarely within the FDCPA 's broad definition of communication. The voicemail, although short, conveyed information directly to XXXXby letting her know that a debt collector sought to speak with her and by providing her with instructions and contact information to return the call. The voicemail also indicated that a debt collector was seeking to speak to her as a part of its efforts to collect a debt. '' It further went on to say that, " The voicemail left by XXXX XXXX falls squarely within the FDCPA 's definition of a communication. And because it was XXXX XXXX 's initial communication with XXXX, XXXX XXXX 's failure to make the required disclosures was a violation of 1692e ( 11 ). '' Now, with that being said, the voicemail about the alleged debt was left on my phone on XX/XX/XXXX, at XXXXXX/XX/XXXX SINCE I HAVE NEVER SPOKEN TO D & A SERVICES LLC, I WILL CONSIDER THAT AS THE FIRST INITIAL COMMUNICATION. By FDCPA rules, 807. False or misleading representations : ( 11 ) The failure to disclose in the initial written communication with the consumer and, in addition, if the initial communication with the consumer is oral, in that initial oral communication, that the debt collector is attempting to collect a debt and that any information obtained will be used for that purpose, and the failure to disclose in subsequent communications that the communication is from a debt collector, except that this paragraph shall not apply to a formal pleading made in connection with a legal action. FUTHERMORE, UNDER 809. Validation of debts : ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing : ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumer 's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. D & A SERVICES , LLC. NEVER PROVIDED ME WITH ANY OF THE FOREGOING INFORMATION THAT'S LISTED ABOVE HEREIN. THEIR FAILURE TO DO SO, CONSTITUTES THEIR BLANTANT DISREGUARD TO ABIDE BY THE FDCPA RULES AND REGULATIONS. FURTHERMORE, I MOVE TO BAN D & A SERVICES LLC FROM COLLECTING DEBTS EVER AGAIN. My Claim : Credit Card Account that has been settled. Previously I opened a Consumer Complaint XXXX disputing XXXX XXXX XXXX Credit Card billing. As it turned out, XXXX stated I agreed to on-line bill statement presentment. I dispute that claim. I did not ask for on-line statement presentment and I did not confirm a change to my account for on-line statements. See this summary below which is posted in Complaint XXXX : The XXXX response of XXXX XXXX, XXXX makes the claim that I enrolled in electronic statements on XXXX XXXX, XXXX and this was why I did not receive any paper statements for the XXXX item, a printer costing {$100.00}, that was purchased on XXXX XXXX, XXXX. Following the purchase in XXXX XXXX, there were 7 months of electronic statements ( XXXX thru XXXX ) in which XXXX charged my account for late payment fees and interest running up the account to a total {$370.00}, roughly {$270.00} of fees and interest. There were no other purchases during this time. This XXXX XXXX account was opened in XXXX and the email address that XXXX references sending electronic statements has not been active. The XXXX information was not up to date because I had no intention of using electronic statements and was never asked to update the information. All of my credit card accounts are set for paper statements. I dispute enrolling in electronic statements for the XXXX XXXX card. Typically if there is a change to an account, there would be a " confirmation '' email saying that there was an account change and asking for my confirmation that I wanted electronic statements. I deny that I received any notice of the change to electronic statements to my account and I deny confirming that I wanted such a change to my account. I am willing to pay for the printer, but I deny the late payment fees and interest charged for 7 months with absolutely no written notification of past due payment. On XXXX XXXX, XXXX, I sent the attached letter to XXXX XXXX, XXXX, XXXX XXXX XXXX and D & A Services. I included a check for {$100.00} for the printer in the letter to D & A Services. I have had no response from D & A Services. I am out of town until late XXXX XXXX. XXXX Since I have had no response from D & A Services to my letter of XXXX XXXX, XXXX, I believe that they accepted my check for the amount of the printer. They have not returned my check stating otherwise. It has been more than 90 days without a response from D & A Services. XXXX Now I have received a letter from XXXX XXXX XXXX claiming that they have bought my account from XXXX XXXX XXXX. However on XXXX XXXX D & A Services sent a letter claiming that they had bought my account from XXXX XXXX XXXX. So XXXX XXXX XXXX has sold my account twice once to D & S Services and once to XXXX XXXX XXXX. I dispute the selling of my account to XXXX different debt collectors. I believe D & A Services has accepted my check for the resolution of the disputed amount because they have not responded within 90 days. The debt collection agency D & A Services, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, IL XXXX sent a 'dunning ' letter to consumer dated XXXX XXXX, 2015. The envelope was postmarked XXXX XXXX, 2015 and consumer received it XXXX XXXX 2015 which violates the thirty ( 30 ) day timeline consumer is allowed to respond to dunning letter. This is a practice synonymous with 'false, deceptive, misleading misrepresentation ' as it violates the Fair Debt Collection Practices Act ( " FDCPA '' ), 15 U.S.C. Section 1692e. Many debt collectors are adopting this practice as a way to cause consumer a lack-in-time to respond within 30 days and utilizing the timely manner set out by the FDCPA. Not all consumer 's have access to a fax machine. This Consumer takes issue with other factors of the 'dunning ' letter in regards to the fact consumer does not owe D & A Service ( or any entity acting on behalf of D & A Services ) a debt. Consumer disputes owing D & A Services a debt based on the FACT : Consumer has no fiduciary, contractual obligation to pay D & A Services anything. There is no payment history, nor products, or services that have been rendered to D & A Services, because these elements do not exist ; there is a failure of consideration and no valid agreement, contract or fiduciary obligation under federal law that requires payment to third-party debt collectors. Furthermore, Consumer 's sole ( permanent ) income is Social Security XXXX income which is federally protected income under Section 207 [ 42 U.S.C. 407 ] ( a ) of the Social Security Act ; ( SSA ). Consumer is head-of-household and possesses NO property of value. Consumer 's federally protected income presents a 'genuine issue of material fact '', which will result in a frivolous lawsuit if pursued. Consumer filed this complaint as a means of formal documentation that consumer will " tender '' as evidence in a court proceeding if D & A Services chooses to adopt their own agenda and pursue this matter further. Consumer wishes all communication ( mail/telephone/attempted collection ) cease upon notification of this debt dispute reported in this venue. Consumer has added a complaint lodged by another consumer who experienced 'unjust enrichment and extortion ' levied against them when interacting with D & A Services. Consumer of this complaint will not engage in contact with D & A Services based on violations of the FDCPA, false misleading contact by D & A Services. If D & A Services makes any attempt to contact consumer on ANY level consumer will file a federal and state lawsuit against D & A Services and present documentation to support consumer 's position in this matter. On XX/XX/XXXX, D & A Services sent me a letter stating a XXXX XXXX XXXX account had been placed with their company for collections. The debt listed in the letter was for the amount of {$3000.00}. I have never before applied for my own XXXX XXXX XXXX credit card and therefore believe this debt to be invalid. On XX/XX/XXXX, I sent D & A Services a certified letter asking for additional information about the account and to provide verification and documentation that there is a valid basis for claiming that I am required to pay the debt. I specifically asked them to provide a copy of the written agreement that created my original requirement to pay as well as a copy of the billing statement sent to me by the original creditor. I also asked them to provide details about their authority to collect this debt such as their debt collection license information. On XX/XX/XXXX I received a response from D & A services. They included a photocopy of what they claim to be billing statements sent to me from XXXX XXXX XXXX between XX/XX/XXXX to XX/XX/XXXX. These statements have my name and address on them, but I never once received them. In addition, the statements show payments were made on XX/XX/XXXX ( {$160.00} ), XX/XX/XXXX ( {$350.00} ), and XX/XX/XXXX ( {$150.00} ). I would like to know who made these payments and what account they came from because it was not from my bank account. Also, these statements do not have one single charge on them toward the original debt in question. It only shows the debt amount and the monthly fees & interest charged throughout the year which have now increased the debt from {$2600.00} in XX/XX/XXXX to the {$3000.00} that is said to be owed today. I don't understand how they can claim I owe this debt without showing me a single one of the charges they claim are past due. They also failed to include a copy of the original written agreement showing it was indeed me who opened the card and that I agreed to the terms and conditions and my requirement to pay. Finally, D & A Services did not provide any information regarding their license and their authority to collect this debt. It is of my opinion the credit card statements they provided are falsified to look as if they were originally sent to me. Each statement provided is a copy and double sided, however, on some of the statements, the dates do not match what is on the front versus the back. For example, one statement is dated on the front as XX/XX/XXXX - XX/XX/XXXX, but on the back of the page the date is listed as XX/XX/XXXX - XX/XX/XXXX. On another one of the statements, the front is dated XX/XX/XXXX - XX/XX/XXXX while the back is dated XX/XX/XXXX - XX/XX/XXXX.

I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. I was contacted by D & A Services , LLC via letter dated XX/XX/XXXX. They informed me they were representing XXXX XXXX XXXX XXXX XXXX XXXX XXXX to collect a debt amount of {$800.00} which they purchased from XXXX XXXX. I responded within the 30 days asking them to validate the debt which they did. I sent a D & A Services a debt settlement letter. Agreed to pay the original amount of {$620.00}. I also informed them because Covid-19, I would pay this in 4 installment payments of {$150.00} on the XXXX of each month. I sent this letter on XX/XX/XXXX. I waited for a response. I received a letter dated XX/XX/XXXX saying I didn't respond to their letter. They reduced to debt from from {$800.00} to {$680.00}. I replied to D & A Services LLC on a letter dated XX/XX/XXXX their letter was incorrect. I did respond. They received and signed for my certified debt settlement on XX/XX/XXXX @ XXXX XXXX according to the USPS website. I provided the tracking number printed out a receipt from USPS. I re-iterated my previous settlement offer of {$620.00}. This letter was mailed out on XX/XX/XXXX. I received a phone call from D & A Services LLC on XX/XX/XXXX @ XXXX XXXX. A woman left a voicemail. I called back and informed female rep who I was. This call lasted 5 mins and 36 seconds. I was on hold for 5 of those minutes. I informed her to please contact me via letters as we have doing. Don't call me. She advised she would relay my message. They received my certified letter at morning. I'm in California so I'm 2 hours. They received and signed for my certified letter and then called me promptly. I'm still waiting to hear from them. My issues with them are : 1. They lied about that fact I didn't respond to their correspondences. 2. They lied about not receiving me letters because I sent all correspondences by certified letter via USPS. I have receipts. 3. They've inflated my original debt amount.

In XX/XX/XXXX I received a call about a debt they said that I owed to XXXX in the amount of {$6100.00}. I told them that I did not owe any money to XXXX and that the last time I had dealt with XXXX was inXX/XX/XXXXwhen I closed my credit card account with a balance of XXXX. When they tried to push this again, I tolad them that they either had the wrong person or a fraudulent account. It told them to stop harassing me as the debt was not mine. I never heard from them again. Last month a different company contacted me about the same debt. The caught my attention because my credit score dropped by XXXX points. Again I told them that the account was not mine and filed a complaint with the CREDIT Bureau. After researching it as little as they did, the credit bureau said that the complaint was real. I asked the collection company to show me proof that I opened this account.. They said that they would. In the meantime, I contacted XXXX and they had no record of my having a delinquent account. This time the collection company sent copies of two statements looking like a XXXX statement. The first one had several problems. Number one was that my first name was misspelled. Number two it showed that supposedly I made a payment to them in the amount of {$110.00} on XX/XX/XXXX. I took that information to my bank and asked for a copy of my bank statement from XX/XX/XXXX through XX/XX/XXXX There was no payment made to anyone for that amount, and no payments of any kind to XXXX. On XX/XX/2019, D & A Services sent a letter stating that XXXX XXXX was their client for a debt balance {$3300.00}. D & A Services stated they were authorized to accept {$1000.00} on behalf of their client, due XX/XX/2019 as settlement in full. On XX/XX/2019, D & A Services contacted me by phone and said I owed a balance of {$2300.00}. I explained that I received a letter from their office XX/XX/2019 outlining the settlement in full. The agent said I was short {$44.00} and therefore owed the remaining balance. I asked, " why would they send a letter stating {$1000.00} was settlement in full, if I supposedly owed more than that amount? Also, I paid {$1000.00} toward this final payment. '' The agent said the letter I received from their office was not valid. I asked, " how is that possible? It is on your company letterhead and sent from your company? There is a phone number that keeps calling me repeatedly and asking me to call back. It always starts with a man whistling a short tune and then, in a threatening tone, the man always follows the whistle with a message that says " this is a debt collector, call back immediately. '' In one message, the man asked for my social security number to be ready and available when I call back. He never addresses me by name, and never leaves any additional details. I know for a fact that I do not have any debts that have went unpaid. I am in college and still live at home with my parents and I have no bills. I did live in an apartment for a short while, but I was never behind in my payments and immediately received my deposit back when I moved back home. I also cancelled my internet services and confirmed the cancellation with the workers in the local office several times to be sure. All of my school loans have been deferred until I complete school and I receive statements for those every month -- they are from the government and state that I currently owe nothing. I have another full year of school to go. There is nothing else out that that I have ever had a bill for. This company calls me EVERY DAY and leaves vague, creepy messages. I would like for it to stop. Based on research that I have done online, they appear to do this to several individuals, many of whom suspect that it is a scam. I have looked up the supposed agency that it is linked to according to the internet, but I can not find information on the agency anywhere.

On Thursday, XX/XX/XXXX my son received a call, on HIS cell phone, from D & A Collection Services. They asked for my son and then stated they needed to speak to me. My son asked who they were and they refused to give any of their information. Only saying it was regarding a debt I owed. I had NOT received ANY written or oral communication from this company at this time. I still have NO clue what debt they claim I owe. In XXXX this company called my cell phone was very rude and demanded to speak to me FYI Could not even say my last name and only has a part of my info. They stated they needed information from me regarding a debt. I asked what debt and this is where things turned even more nasty. We ended in a screaming match and me informing them to NOT contact me OR anyone on my behalf again. If they would like to address a debt they should follow the rules and send a letter. On XX/XX/XXXX @ XXXX XXXX I received a terrible call from some very rude person from this company. The phone call immediately deteriorated into a screaming match with this guy taunting me. I recently submitted a cease desist to D & A Services. Stating in my demands that I am refusing to pay the alleged debt and to stop communicating with me through all mediums. D & A services are still contacting me without the prior consent per federal law states 15 USC 1692c ( a ). D & A services are damaging my reputation. D & A sent me false and deceptive forms. In that deceptive form they used obscane and profane language. They are coercing me to pay this alleged debt that I stated in my documentation that I am refusing to pay. In that file I also stated to cease communication with me and to answer questions and return it back to me. This company is operating under a different name pursuant to 15 USC 1692e ( 14 ). They sent me a false and deceptive form stating that Bureaus investment group XXXX XXXX XXXX is the current creditor so who is D & A Services? This is identity theft the original creditor never stated in the contract that they were doing business with D & A Services. Now this debt collector have my private information and my location abode without my permission. I recently was in the hospital XXXX XXXXXXXX XXXX due to these creditors selling my private information without my consent. I am out of work due to my XXXX XXXX. Contact was made by D and A Services on XX/XX/2018 @ XXXX eastern time stating personal information such as address, date of birth and SSN the women proceeded to state this information was needed to be verified by me before they could sue on the behalf of another collection agency, neither agency has validated with a contractual agreement of my owing any money to them, so my response was to go ahead and sue, documentation is required in court. On XX/XX/2018 I received a collection letter not a subpoena. Unless this debt that has been validated ( with a contract ) not just verifying by general information or copies of documents without a signature, I owe nothing. According to the FTC, FDCA 1692 ( c ), ( d ), ( e ), and ( g ) threats to collect is an illegal practice, another illegal practice was contacting me by use of my cellular phone under the Telephone Consumer Protection Act 47 USC sec 227 ) without my written consent. A letter of validation of a contractual agreement has been mailed to D & A services, I am waiting on the returned receipt, upon receipt I will be able to provide the information. I had a biz CC ( XXXX XXXX debt that I believe was written off by XXXX after we went to court in 2018. Lately the collection company D & A LLC has been calling me on my cell phone at various times of the day, usually before XXXX. I advised them that as this was a business debt they should call me at my store after XXXX PST. The call calls continued. I don't mind them calling as long as the hour is not too early according to my schedule XXXX not theirs ) and to my business phone number, not my cell number. I finally called them back, told them I thought the debt had been written off by XXXX and figured D & A was fishing. XXXX has never tried to contact me by mail or phoe during the 2 years.I was turned over to XXXX XXXX. She (? ) was pleasant and cooperative and promised to resolve the phone number issue, etc. However, I still believe the debt was written off by XXXX, I paid taxes on the paid off amount, and believed the matter was settled, especially after 2 years. A debt collection company has called repeatedly leaving messages with family/friends saying that they are calling from D and A Services ( or DNA? ) to collect a debt and information to return the call. I, as well as family/friends, contacted the company and requested that they stop calling. They have not. Also, they do not always state who they are attempting to contact regarding this alleged debt, I believe intentionally, in order to have my family member ( s ) return the call. They have also given out private information such as my name, the amount of the alleged debt, and also ask for my contact information. This has been very annoying, frustrating, embarrassing, not to mention illegal. They are just flat out completely ignoring all requests to stop the calls. I do not know what else to do other than file a complaint and talk to an attorney. It is apparently a useless waste of time to continue requesting that they stop calling so I am hoping that this complaint will help. We were jacked ( ripped off ) when we moved. We had to put moving costs onto a XXXX XXXX / XXXX XXXX XXXX card. We had just purchased a home ( no mortgage ) and with 800 plus credit scores, we assumed we could grab a HELOC and pay off credit cards within a couple months. We were subjected to a third party consumer information service that had bad outdated information ( XXXX ) This prevented us from obtaining a HELOC from XXXX XXXX XXXX and XXXX XXXX XXXX. This took 17 months to work through, and did secure a HELOC with XXXX XXXX XXXX XXXX. As we were declined for credit ( with credit scores of XXXX, interest and penalties accumulated. Escrow completed, and the credit union sent checks out. XXXX XXXX / XXXX XXXX XXXX received payment before XXXX XXXX, next day XXXX XXXX XXXX charged off the account and sent to collections. D and A Services XXXX XXXX IL. Two days later, the cashed the check and now I have to deal with collections for the full amount plus even more fees. XXXX XXXX XXXX got paid and retain these funds ~ $ XXXX.

I came home tonight and had a message on my prepaid cell phone, which is using up my minutes, from some debt collector called D & A calling from XXXX and telling me to contact them at XXXX ext XXXX and I have NO IDEA who they are, have never been sent any letters to verify any debt whatsoever, so they have broken the FDCPA just like another collection agency I just reported to your office a week ago doing the same!! After several intimidating calls from D & A Services to collect a debt for XXXX XXXX XXXX, I made a payment in ignorance to them on XX/XX/XXXX in the amount of {$100.00}. After I called XXXX XXXX XXXX to inquire about the account, I was told it was discharged and closed. Therefore D & A Services falsely impersonate themselves to collect this debt for XXXX XXXX XXXXXXXX. I requested D & A Services to provide me a legal binding signed agreement between them and XXXX XXXX XXXX to collect this debt for them. They sent me copies of old statements. I sent a certified letter on XX/XX/XXXX asking them not to withdraw from my bank account until they are able to verify their legal binding to collect the said debt. They were not able to provide me with this information. On XX/XX/XXXX they withdrew the amount of {$270.00} from my bank account without my consent and still have not furnished the information requested. DNA has called my cell phone saying I have a debt, and to please contact them. I called to be told by a recording, this is attempt to collect a debt. I later heard from a representative asking if it is okay to continue on. I agreed to hear what they were talking about, and the process begin. I was asked all my personal information to find out they were harassing the wrong person, I did not want to disclose my personal information over the phone. After they told me they had the wrong person and the name given was my mother. I asked them to disclose the debt since they had asked me, my personal information, I was told I was n't on the account could not disclose her personal information without her consent. I did not give my mother my consent to be a credit reference. I 'm highly upset, there should be a law against putting a person on a loan for credit reference without their consent when applying for a loan.Also stop debt collectors from perusing non applicant ( credit references ).

My original debt was with XXXX, who sold the collection to XXXX XXXX XXXX. In XX/XX/XXXX XXXX contacted me with a settlement offer, which I accepted and paid in the amount of {$3400.00}. D & A Services, XXXX XXXX, Illinois sent us a collection notice for {$3500.00}. I tried telling her we paid this in a credit consolidation in 2017. She continued to insist we owed it so I made the mistake of giving in to her because we do not want to be sued. She insisted that I provide her with my bank account routing number, account number and said she was post dating the check for an amount of {$1500.00}. Caller called at XXXX XXXX XXXX 2017 and refused to identify self despite repeated requests. Caller was informed that she was calling a business phone and told to make no further telephone calls. Caller called agai n at XXXX on XXXX XXXX , 2017 and would not properly identify self and was reminded that this call was in violation of the Fair Debt Collections Practices Act. I finally requested to speak with a superviso r and informed supervisor of facts previously stated. I paid the debt for XXXX XXXX XX/XX/2020 received a call this morning from XXXX a phone number registered in XXXX XXXX, VA to call XXXX regarding a complaint # XXXX. Repeated phone calls looking for someone by another name. I have had this phone number for over three years. Most recent harassment is from D & A Services, LLC., but they will sell the information to then next set of thugs to continue the harassment. When confronted with the wrong number, they claim " we do n't have this number in the system. '' This is a fraudulent claim, since they had called less than XXXX seconds before and hung up before I could get requisite information to formalize a complaint with their organization. If this were an incidental wrong number, this would not be an issue, but this is a concerted effort to harass by so-called debt collectors who keep selling this bad number and refusing to remove it from the database.

I received a VM from D & A Services stating that the call was regarding a debt and to call back. The collectors ' name was XXXX XXXX and phone # was XXXX. I then called him back. I got in touch with XXXX XXXX. He asked for my name, which I gave him, then preceded to tell me about the debt. Only after that did he give the mini Miranda and then asked me to verify my identity. I asked for a manager, who he transferred me to. Someone from XXXX keeps contacting my employer and asking for me by full name, making threats, being rude and scary, insulting me to my coworkers and telling them I owe money, in general being disrespectful to people in the office- and they're calling on a toll free number so my employer is paying for the harassment.
