I received 2 consecutive inaccurate mortgage statements from CUSO Home Lending XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX when my regular amount due is {$1800.00}. Despite these statements, I had my normal monthly amount automatically withdrawn from my checking account ( {$1900.00} which is slightly extra each month ). Upon receiving the second inaccurate statement, I contacted CUSO on XXXX to report the issue. It was during this phone call that I was told there was a " glitch in the system '' and the error likely had to do with an ARM change. I did not recall that I had this type of mortgage and had a loan approval letter kept with my statements stating the approval was for a 30 year fixed loan at 4.5 %. I sent a copy of the letter via email and CUSO subsequently replied that I indeed had a 10 year/1 arm variable rate. They sent my their copy of the signed documents from closing indicating the 10 year/1 arm terms and asked if I had a copy. What I found in my closing paperwork was an unsigned copy of the 10 year/1 arm. I am not disputing that my signature is on the their documents, I am just explaining why I thought I had a fixed rate. In looking through my unsigned document of the terms it clearly states that I would be notified in writing at least 45 days prior to the ARM change. Not only wasn't I notified, I was the one having to initiate communication regarding inaccurate statements. The communication since has revolved around me paying the new increased mortgage amount with my previous payment being held in suspense. The explanation I was given was that they do not apply partial payments.They sent me an updated statement dated XXXX with the amount due as {$4100.00} ( {$2000.00} for XXXX and {$2000.00} due for XXXX with {$1800.00} being held in suspense ). I have sent a check to cover the difference but both XXXX and XXXX were already sent on the XXXX of each month with my typical payment ). I expressed my frustration to the company and my concern regarding the potential for status of the account to adversely affect my credit ( email sent XXXX XXXX Rather than answering my direct question regarding the status of my account and whether or not this would affect my credit, I got an email response on XXXX simply stating the vice president " is going to reach out to me ''. I have not received any calls or communication since this time.

Mortgage account is to be paid by person residing in home, since I was evicted. I last made payment in XX/XX/XXXX, due to being on fixed income ( VA, SSA ). Mortgage company has not contacted me in regards to late payments, albeit I am listed as first placeholder on the note. I contacted the mortgage company in XX/XX/XXXX, in regards to the lack of communication from the mortgage company in regards to the account being late. I was informed that I was " refusing to pay '', when I never stated those remarks. I was informed back in XX/XX/XXXX, I would be contacted in regards to late payments, and/or any other changes to the mortgage. I received a call in XX/XX/XXXX, in regards to a " forbearance agreement '', placed on the mortgage. I was informed the agreement was ending at the end of XX/XX/XXXX, to which I never applied for a " forbearance agreement ''. Also, I was informed by the caller only when the terms are modified, should all parties be contacted. I attempted logging into the account on XX/XX/XXXX, and was unsuccessful ( see runtime error attachment ). I was able to reset my browser settings, logged in, and noticed the mortgage terms changed from XX/XX/XXXX, to XX/XX/XXXX. I WAS NOT notified by phone, email, letter, etc., in regards to the terms being modified. I may not be residing at the property address on file with the mortgage company, yet since it is being reported to my credit reports, it is of high importance to me any late payments, change of terms ( deferment, forbearance ) be brought to my attention from the mortgage company. The actions by the mortgage company is very unacceptable.
