I took out a personal loan from XXXX XXXX XXXX XXXX XXXX based in XXXX, GA. I fell behind on the loan. I was unaware that XXXX XXXX XXXX had assigned out my loan to a company named CU Recovery until I contacted XXXX XXXX XXXX to ask about sending payments. After the call with XXXX XXXX, almost immediately, my brother and my elderly mother, both who live in other states from me, started to get very threatening messages on their cellular phones from a company purporting itself to be " XXXX XXXX XXXX '' and stating that I had a " Civil Complaint Filing '' in XXXX County Tennessee. On both messages the man left his name as XXXX XXXX along with the number XXXX. When I called the number the receptionist answered the phone CU Recovery. They violated the FDCPA by misrepresenting who they were and also by misrepresenting the nature of the debt by claiming it was a 'Civil Complaint Filing '' which sounds like a lawsuit. This was intentional. Also, this company had my phone number but they chose to not call me and to instead call and harass my family members whose names were on my credit union account as emergency contacts. This was done to intimidate and humiliate me. When I spoke to this company they verified that they were calling on my credit union account. But then they shut down and refused to identify themselves when I asked again. Because I was still perplexed as to why they would leave another companies name on the voicemails. I had to contact the credit union that stated it was CU Recovery that had my account and on hearing what this company was doing.. the credit union pulled my account from them and it's back with the credit union . I filed other complaints with the XXXX about their tactics and CU Recovery LIED to the XXXX and said they did not leave XXXX XXXX XXXX or use that name. But they did. The number left for me to call went back to CU Recovery and the credit union confirmed they were the ones with the account and indeed they tried to collect on the account. The account was only with their agency and no other before being pulled back. The company, XXXX XXXX XXXX, is a FAKE COMPANY, created by CU Recovery - that allows them to contact and harass the family members of debt holders with anonymity.

I am filing this complaint against CU Recovery Inc. because of their lack of reply to my debt validation letter. Dating from XX/XX/XXXX to recently I have been trying to negotiate a settlement to payoff my debt with CU Recovery, originally from XXXX XXXX XXXX. After several attempts to do so, I began to worry that they were scamming me or that they were stalling progress in order to add fees to increase the original debt. On or about the week of XX/XX/XXXX, I contacted XXXX XXXX XXXX ( the original creditor ) to ask them to validate my debt, they refused to talk to me in XXXX attempts, instructing me to make all contacts with CU Recovery Inc. I was then in contact with the collection agency ( CU Recovery Inc. ) and sent the attached debt validation letter on XX/XX/XXXX via US Postal Service Certified Mail ( ATTACHED ). The collection agency received the letter on XX/XX/XXXX but has not responded to my request for original documents and have since stopped contacting me. I am concerned that CU Recovery Inc. is not a legal entity or that it is trying to stall the process to settled in order to hike fees and other interests, specially since they have not responded to my debt validation request claims and the amount they say I owe does not reflect the amount reported in my credit report by XXXX XXXX XXXX this month. According to the Fair Debt collection Practices Act ( FDCPA ( section 1692g ) and XXXX Administrative Code ( section XXXX ) the agency should verify my debt and send me the following, in writing, within XXXX days of receiving my letter ( it has been over XXXX days now ) : proof of my agreement to pay the original creditor, a copy of the final account statement issued by the original creditor, a breakdown of the total amount due, showing principal, interest and other charges and for all other charges, the date of and basis for each charge. Please help me obtain this information that is due to me by law from the collection agency.

XXXX Around XXXX I called CU Recovery after receiving a letter in the mail and spoke with XXXX XXXX XXXX He told me I was legally responsible for {$1300.00} that went past due in my father 's account because I had opened an account with him. I tried explaining to the man at the company that I never opened an account with my father and was not responsible for this debt. The exchange was less than pleasant on both ends and I disconnected the call. I then called XXXX XXXX XXXX XXXX XXXX XXXX at XXXX and spoke to XXXX. I asked to speak to a supervisor or manager. She asked me if she could help. I explained to her that I had received a collections notice in the mail and what I had learned from speaking with XXXX at CU Recovery. I told her I have never been to XXXX XXXX and don't recall ever signing anything to be placed on an account with my father. XXXX placed me on hold and then XXXX picked up the phone. I told him my concern, that I had never been to XXXX XXXX and don't recall signing anything to be put on my father 's account. He told me he couldn't find any authorization and that after talking to his credit department he would call me back. XXXXI did not receive a call back from XXXX, so I called back up to XXXX XXXX. XXXX answered the phone and I explained who I was, telling him I needed an update since I hadn't received a call back. He seemed surprised that no one called me back and said a gentlemen by the name of XXXX XXXX was supposed to have called me back, but he's in a different time zone so maybe that's why he didn't call. XXXXI still have not received a phone call and that's why I have decided to start a formal complaint. I don't know if they reported this against my credit, or how my name got added to an account without my signature or permission. I have no answers.

Approximately XXXX or 5 months ago, I received a call from CU Recovery Inc and they tried tricking me to reset statute of limitations. I advised them that I did not recall this debt because it was from on or about XXXX. I advised them verbally to cease and desist all future contact with me by phone calls to myself, friends, family and employer and as well postal mail. I made it clear that I consider it harassment and it will not be tolerated. They acknowledged my request and we mutually hung up the phone. About a few weeks to a month later, they called me again! I advised them that it is harassment and I do not want to speak to them again, that time I hung up the phone in anger. Well today I received a letter of collection dated XXXX XXXX, XXXX. The letter states I have XXXX payment options. I have attached a picture of the debt letter they sent me. It 's in reference to account # XXXX in the amount of {$7200.00}. I do not know where this amount came from and the letter does not illustrate DOFD ( date of first default ) and there are no other identifying information illustrated on the letter. I feel as if I 'm being taken advantage of, or that I might be becoming a victim of some sort to CU Recovery Inc. From the initial phone call from over the summer of XXXX, I advised them per the FDCPA that in other cases of case law, courts have allowed a verbal cease order to stand and that is what I advised CU Recovery Inc . They have ignored said request and they need to be stopped. If they are taking the law into their own hands for me, then what are they doing to other consumers? Please help me, I do not appreciate being harassed. Thank you CFPB.

received 2 title loans from XXXX XXXX XXXX XXXX XXXX XXXX. payments were made and then fell in to a financial problem. hours of work were cut and income went down and then both vehicles went down with problems. couldnt make payments for a while and then went to collections. received calls from a XXXX XXXX from CU Recovery. he called my work in XX/XX/2018 and spoke with him. he said to call him back in which we did. he wanted my wife to take loan out of her 401k to pay him which we explained we couldnt do it because we had taken a loan out already for medical costs. next he wanted us to take out a loan from family or friends and explained we couldnt ... nobody had the amount he was wanting. he even trheatened to sue us, which scared my wife. anyway on that call we made arrangements to use our tax refund when we received it to pay him but told him we would not get it for a couple of months. we made the agreement that we would pay XXXX a month until tax return came and then pay the balance of which was {$3000.00} and he said once we paid the settlement offer off, we would get our vehicle titles back. we paid this off and got a notification letter from XXXX XXXX that it was paid. last we have heard from him about anything. have tried calling the number that he would use to call constantly and have texted but no replies have been received from XXXX XXXX at CU Recovery. We did our part and paid off the settlement offer in full, now we are expecting CU Recovery and XXXX XXXX to fulfill their part! all we want is our vehicles titles ... they acted on XXXX XXXX XXXX XXXX XXXX XXXX part..so they are soley responsible for this matter.

1. According to the FDCPA, my federally protected rights have been violated. In XX/XX/2019, I, XXXX XXXX XXXX was contacted via phone by CU RECOVERY, in reference to a debt. This was their ( CU RECOVERY ) first time contacting me. While I was on the phone, the agent never told me that I had the right to ask them ( CU RECOVERY ) to " validate '' the debt, which is my right under 15 U.S.C. 1692I. 2. Also, as a consumer under the FDCP, my right to privacy was infringed upon, due to the fact that I never gave the debt collector ( CU RECOVERY ) permission to contact me directly via phone. The debt collector ( CU RECOVERY ) also had a my previous address on file which is another source of contact infornation they never receieved from me directly. 3. Also, under 15 U.S.C 1692b, the debt collector ( CU RECOVERY ) were not supposed to use a logo on any documents, nor were they supposed to acknowledge that the notice was an attempt to collect a debt. As I stated above, the address they ( CU RECOVERY ) had on file was a previous address, which means that they possibly mailed a notice to my PREVIOUS address, which means they possiblly communicated with someone else other than me in reference to the debt, which is also another infringment on my right to privacy. THE AMOUMT OF THE DEBT TOTAL IS {$28000.00}

Approximately 2 months ago our family members and in-laws began receiving telephone calls from a man identifying himself as XXXX XXXX on their personal and private, never publicly published numbers. This included business telephone numbers of cell phones for inter-company use. The man would ask for a family member by first name as if he were an old friend, he refused to provide his true name and company he worked for. He was extremely rude and hung up on family members who continued to ask for this information. He also threatened to have his telephone number blocked if we continued to call him and ask for this general information because he " did n't have business with us. '' After our own investigation, we discovered this man works for CU Recovery, a debt collector in Minnesota. Our family member also recently received a forwarded letter from CU Recovery stating they were attempting to collect over {$8000.00} worth of debt from an auto loan that is over 15 years old, no longer collectible or owed by all applicable state and federal laws, and the vehicle was repossessed and resold at auction from this family member over 15 years ago.

My wife co-signed on a car loan for her son. Her son stopped paying on the loan and the car was re-possessed. We received a letter about a week ago from a collection agency named CU recovery, from Wyoming, with an amount to be paid. My wife contacted the agency and was told to try to get a loan to pay off the balance, and if we could not get a loan, they would work with us to resolve the account. Today, my wife contacted the agency, and was told that we had one hour to figure out how to pay for the debt, otherwise they would sue her and garnish her wages. My wife contacted me at my work and told me what was happening. I then contacted several lawyers for advise, as well as researching online what our rights were. I told my wife to contact the agency, and inform them that we were in contact with a lawyer, the agency then said we have one day to pay or they will start to garnish wages. They also said that we have a credit card with enough credit to cover the balance and need to pay now with that.

I am currently enrolled in a debt consolidation program with XXXX XXXX XXXX, who has been wonderful to me. One of my accounts enrolled in the program is a personal loan from XXXX XXXX XXXX ( XXXX ). Today, XX/XX/XXXX, I was contacted by their debt collection agency, known as CU Recovery in Minnesota. The individual, XXXX XXXX, took it upon himself to contact my girlfriend and my girlfriend 's sister ( whom which I don't even have her number ). This, to the best of my knowledge, is not only extremely unprofessional and unnecessary, but illegal and not allowed by an agency. I have made payments to my debt consolidation perfectly for nearly a year now, and negotiations were already underway with this creditor. For this man to do this is unbelievably rude. Clearly, he had to do some serious digging to even get her number, which again I myself do not even have. In light of this, I would like to submit a formal complaint on CU Recovery and XXXX XXXX for this absurd action. Thank you.

In XX/XX/2018 I started to get repeated phone calls in such a short period of time from the same number registered out of XXXX, Minnesota. Many times, the calls would total 4 in a 15 minute period. I figured it was a telemarketer. Throughout the month and into XX/XX/XXXX, the same pattern every other day. Soon after, the messages where asking to call back the number and ask for XXXX XXXX ( aliases ). Last week, I return to my office from lunch and there are repeated messages from the operator via the messaging center alerting me that a XXXX XXXX is attempting to call you and has called several times, " please advise ''. I call the number left and asked who are you and why do you keep calling. He stated " I will ask the questions and let 's start by your last four of social security. I had attempted to negotiate a reasonable settlement of past due car payments with the original note holder. XXXX XXXX XXXX XXXX. We could not resolve. I voluntarily returned the vehicle. The vehicle was sold for an amount equal to or higher than amount owed. I attempted to resolve the quoted 'balance due after sale ' with XXXX XXXX. No response at all. Then I was contacted repeated by phone ( to the point I blocked the caller ). I responded in writing requesting no further phone calls and an accurate breakdown of charges. To this date I have not had any compliance from the debt collector - C U Recovery and they have actually sent me information with other individuals names on it stating they owe the debt as well. I overdrew my bank account in XX/XX/XXXX and received a letter from CU Recovery collections. I called them to inform them the payment would be made to the bank not the collections agency. Afterwards ( the same day ) I verified this at my local bank with the bank manager and was ensured I could pay at the bank and no penalties would be levied against me. Again today XX/XX/XXXX I got another letter stating I owed the full amount when in fact I have paid down the original debt of {$420.00} to {$170.00}. Collector has taken on a debt that is doubtful. The original lender, XXXX XXXX XXXX XXXX, only alleged the debt to me this week. I began to research the matter today ( a totaled vehicle that had GAP insurance - alleging additional debt ), and have already received a collection attempt from CU Recovery. It is very unethical for XXXX XXXX ( and CU Recovery as their agent ) to attempt these tactics without first allowing legally allowed time for verification of the debt. On XXXX XXXX, 2017 a person name XXXX from C U Recovery , Inc. called my place of employment. When I asked where she was calling from she refused to tell me and asked me why I was screening my calls. She said she was going to call me back at my job and hung up before I could say anything. She had called a few minutes before this call and I sent it to my voicemail. She did not leave a message. I posted a message on their website stating that they are violating the Fair Debt Collection Practices Act by continually calling my place of employment.

In CU RECOVERY 's response to CFPB Complaint # XXXX, CU RECOVERY mentioned XXXX Employees XXXX placed two alleged accounts of mine in their office for collection. They were not supposed to collect my location information. 15 USC 1692a ( 7 ) defines The term location information means a consumers place of abode and his telephone number at such place, or his place of employment. The fact that they collected my name, telephone number and address is an infringement to my privacy, pursuant to 15 USC 1692 ( a ) that is a violation.

XX/XX/2012 {$4000.00}, The company is trying to collect an OLD debt in which a VOLUNTARY repossession occurred.
