I was served a Complaint on XX/XX/XXXX stating I was to appear in Court on XX/XX/XXXX. This is a Civil Complaint from CROWN ASSET MANAGEMENT , LLC, who is a Debt Collector hiding under a LLC. These are attorneys located in XXXX. I live on XXXX. The attorneys name is XXXX XXXX XXXX. They buy written off loans and then file complaints with the court without ever notifying in writing that they bought the debt. The statute of Limitations in California where the contract was signed to XXXX XXXX XXXX is 4 years. I defaulted payment due to the mortgage crisis of XXXX in XX/XX/XXXX. The statute of Limitations in Hawaii is 6 years, therefore, this debt that they are illegally trying to collect on is Over the Statute of Limitations. CROWN ASSET MANAGEMENT , LLC, never once sent me a notification that they had purchased this written off loan. They just went and filed a civil complaint to the court on XX/XX/XXXX. There is also another attorney in XXXX, XXXX XXXX XXXX XXXX that I filed a complaint before, continues to buy written off loans for pennies on the dollar and both Attorney Firms use misrepresentation and deceit on unsuspecting consumers who do not understand their rights un the Fair Debt Collections Practices Act. I contacted XXXX XXXX acting attorney for collection of this written off debt. She stated that the debt was not over the statute of limitations as they purchased this loan on XX/XX/XXXX. I corrected her stating that the Statue of Limitations starts on the day the in which the debt defaulted on payment which was in XX/XX/XXXX. I went to court on XX/XX/XXXX. The judge continued the case until XX/XX/XXXX. The judge asked if I had contacted the XXXX XXXX, debt collector ( WHO WAS NOT PRESENT IN COURT ). I told the judge that I had and wished to dismiss this case because the attorney for CROWN ASSET MANAGEMENT , LLC, XXXX XXXX was not present in court and that the debt is over the statute of limitations. The judge just continued the case until XX/XX/XXXX advised me to contact the debtor again and to hire an attorney. I am XXXX and am only receiving social security benefits. I can not afford an attorney and I know my rights under the FDCPA. I called the law offices of XXXX-XXXX on XX/XX/XXXX as ordered by the judge. The receptionist told me that XXXX XXXX was not in the office and that she would be in the office on Friday, XX/XX/XXXX from XXXX XXXX to XXXX XXXX the receptionist then transferred me to XXXX XXXX 's voicemail. I left a voicemail stating I was ordered by the judge to contact her and again stated to XXXX XXXX that this debt is over the statute of limitations and that I was never notified in writing by their offices that they bought this written off debt and that the judge ordered me to contact her and that the case is continued to XX/XX/XXXX. XXXX XXXX was to return my call on Friday, XX/XX/XXXX. As of this date, I have had no response from her. As I was in court, I heard many cases from this firm and XXXX XXXX XXXX 's firm. Most defendants do not show up in court so the judge orders a judgement in favor of the plaintiff 's. The judge SHOULD HAVE DISMISSED MY CASE FOR THE PLAINTIFF IN MY CASE DID NOT SHOW UP. WHY DID THE JUDGE CONTINUE MY CASE AS A DEFENDANT FOR A COMPLAINT, BUT THEN GRANTS JUDGEMENT IN FAVOR OF PLAINTIFF ATTORNEY 'S WITH THESE ILLEGAL FILINGS ON OLD DEBTS WHEN THE DEFENDANT DOES NOT SHOW UP. I FIND OUR JUSTICE SYSTEM A ABOMINATION!!!!! THESE ATTORNEYS WHO HIDE UNDER A LIMITED LIABILITY CORPORATION SO THEY CAN NOT BE DISBARRED FOR THEIR ILLEGAL ACTIONS. AND A CORRUPT JUDGE ALWAYS FINDING IN FAVOR OF THE PLAINTIFF. These attorneys act as debt collectors buying up defaulted loans that are too old and are over the statute of limitations to sue and also have been written off by the original creditor for pennies on the dollar using misrepresentation as to NEVER NOTIFY ME IN WRITING AND JUST FILE A COMPLAINT WITH THE COURT IS MISREPRESENTATION, DECEITFUL AND ILLEGAL UNDER THE FAIR DEBT COLLECTIONS PRACTICES ACT. I would like to see once and for all that these attorney 's be brought up on charges for illegally obtaining monetary funds from many unsuspecting consumers in the State of Hawaii, using misrepresentation, threats of arrest and jail time and illegally getting judgements against consumers that I personally know who are having their paychecks garnished for they did not know their rights on old debts to be sued upon. And also start an investigation of the judge who is repeatedly ruling unjustly in favor of Plaintiff knowing that these attorneys are using misrepresentation, threats of arrest and jail time and illegally getting judgements against consumers that I personally know. XX/XX/XXXX an shady Loan company XXXX XXXX aka XXXX XXXX XXXX coordinated with a shady car dealership in XXXX, XXXX and allowed the sale of a car to a person, even after I contacted them to not allowed any transactions in my name.I made it very clear that I do not live in XXXX, XXXX, which The shady loan company knew, because of the phone calls and letters they sent to my XXXX, XXXX home trying to solicit the loan.I have been the victim of multiple company security breaches since XXXX, and again in XXXX, with letters from the companies to prove it.I have sent XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX several forms and documents to prove my claim of fraud.They were to send me forms for fraud and did not send them at all.After which I received a letter from them stating that since the documents I sent didn't prove anything, the claim is valid, even though I never had the chance to send them any forms or documents, until I later contacted XXXX XXXX XXXX directly to try and get to the root of this issue.I was told not to contact local court judge, and ignore any court documents, because they were just formalities in the process, since my claim is to be investigated.To my surprise The judge has ordered a decision in the companies favor, for me to pay {$XXXX} and court costs of {$XXXX}, for something that has nothing to do with me at all.It is my fault for not contacting the judge, even though I was told not to worry about anything by representaives.XXXX XXXX has been recently sued by several State attorney general offices for this same type of shady loan practices, involving shady dealerships and getting loans approved for persons that don't qualify for them, or are most likely to default on them.According to online article they are to pay people back for all of the costs, that people are having to endure, as a result of their shady tactics.There are several complaints against this company on the XXXX website with complaints very similar to my own.I should not be going through any of this garbage.I have been a XXXX man since XXXX, with severe XXXX issues, along with XXXX issues, and all of this has caused my conditions to become complicated at times.There is no way that I would ever be qualify for a {$XXXX} auto loan.I was even asked by XXXX representative if I ever lived at a certain XXXX, XXXX address, and have a son that is a junior, to which I stated to him no, I have been in XXXX, XXXX since XXXX, and no son of mine has such a name.The representative has my XXXX phone number on file, and has been sending me letters here in XXXX, XXXX, yet can't assess the facts of where I have been living.Just plain ridiculous and insulting to my intelligence.They should have never allowed any of this happen, and now they are trying to make people such as myself into something we're not, in order to help pay for their crimes.I have reported this to XXXX Attorney General 's office recently, and the Consumer XXXX XXXX back in XXXX, in which a letter was sent to the dealership about the whole issue threatening to fine, among other things, them if they didn't stop with their shady tactics.I have to find out XXXX years later that someone was allowed to purchase the car anyway without my consent.This is unacceptable, and these type of businesses should be closed permanently.

My Claim : Selling a Credit Card Account that has been settled. Previously I opened a Consumer Complaint XXXX disputing XXXX XXXX XXXX Credit Card billing. As it turned out, XXXX stated I agreed to on-line bill statement presentment. I dispute that claim. I did not ask for on-line statement presentment and I did not confirm a change to my account for on-line statements. See this summary below which is posted in Complaint XXXX : The XXXX response of XXXX XXXX, XXXX makes the claim that I enrolled in electronic statements on XXXX XXXX, XXXX and this was why I did not receive any paper statements for the XXXX item, a printer costing {$100.00}, that was purchased on XXXX XXXX, XXXX. Following the purchase in XXXX XXXX, there were 7 months of electronic statements ( XXXX thru XXXX ) in which XXXX charged my account for late payment fees and interest running up the account to a total {$370.00}, roughly {$270.00} of fees and interest. There were no other purchases during this time. This XXXX XXXX account was opened in XXXX and the email address that XXXX references sending electronic statements has not been active. The XXXX information was not up to date because I had no intention of using electronic statements and was never asked to update the information. All of my credit card accounts are set for paper statements. I dispute enrolling in electronic statements for the XXXX XXXX card. Typically if there is a change to an account, there would be a " confirmation '' email saying that there was an account change and asking for my confirmation that I wanted electronic statements. I deny that I received any notice of the change to electronic statements to my account and I deny confirming that I wanted such a change to my account. I am willing to pay for the printer, but I deny the late payment fees and interest charged for 7 months with absolutely no written notification of past due payment. On XXXX XXXX, XXXX, I sent the attached letter to XXXX XXXX, XXXX, Crown Asset Management and XXXX XXXX XXXX XXXX. I included a check for {$100.00} for the printer in the letter to XXXX XXXX XXXX XXXX. I have had no response from XXXX XXXX XXXX XXXX. I am out of town until late XXXX XXXX. XXXX Since I have had no response from XXXX XXXX XXXX XXXX to my letter of XXXX XXXX, XXXX, I believe that they accepted my check for the amount of the printer. They have not returned my check stating otherwise. It has been more than 90 days without a response from XXXX XXXX XXXX XXXX. XXXX Now I have received a letter from XXXX XXXX XXXX claiming that they have bought my account from XXXX Asset Management. However on XXXX XXXX XXXX XXXX XXXX XXXX sent a letter claiming that they had bought my account from Crown Asset Management. So Crown Asset Management has sold my account twice once to XXXX XXXX XXXX XXXX and once to XXXX XXXX XXXX. I dispute the selling of my account to XXXX different debt collectors. I believe XXXX XXXX has accepted my check for the resolution of the disputed amount because they have not responded within 90 days. On XX/XX/2023, XXXX XXXX XXXX, XXXX attempted to contact me regarding an alleged debt that was incorrectly claimed to be owed. As per 15 U.S. Code 1692g, this constitutes my response within the stipulated 30-day timeframe, along with my formal complaint as outlined below. I wish to emphasize that the legal precedent set by Heintz v. Jenkins mandates that law firms must adhere to the same FDCPA Laws as debt collection agencies. XXXX XXXX XXXX, XXXX stated that Crown Asset Management LLC is the alleged owner of this alleged debt. Notably, Crown Asset Management LLC has never sent me a 15 U.S. Code 1692g letter. This absence of proper communication violates 15 U.S. Code 1692g and such non-compliance will not be tolerated. Crown Asset Management LLC you have violated the FDCPA law ( 15 U.S. Code 1692g ). Secondly, 15 U.S. Code 1692c ( a ) specifies that a debt collector can not communicate with a consumer regarding debt collection without the consumer 's prior consent or express permission from a court with appropriate jurisdiction. At no point have I granted permission to Crown Asset Management LLC & XXXX XXXX XXXX, XXXX to contact me in relation to an alleged debt that is inaccurately attributed to me. It is important to note that discussing an allegedly incorrect debt is never opportune. Moreover, the implication by Crown Asset Management LLC & XXXX XXXX XXXX, XXXX that I engaged in business with their company is wholly untrue. To substantiate this, I request a visually signed contract bearing my signature that demonstrates my consent for them to conduct business concerning this alleged debt. Thirdly, I am concerned that Crown Asset Management LLC & XXXX XXXX XXXX, XXXX possess my personal information without obtaining my explicit consent. I seek clarification on how they acquired this information for the alleged debt that is in dispute. This action is a violation of 15 U.S. Code 1692b. Fourth, I demand that Crown Asset Management LLC & XXXX XXXX XXXX, XXXX prove the existence of the alleged account through a process of verification. " Verification, '' as defined in Black 's Law Dictionary ( 4th Ed. ), pertains to confirming correctness, truth, or authenticity through means such as affidavits, oaths, or depositions. In accordance with this, I require the following : 1.A signed and valid contract incorporating the alleged terms. 2.A Chain of Assignment detailing the history of alleged account possession. 3 A comprehensive Sum Certain, illustrating the calculation of the alleged amount. 4. Alleged Monthly statements. 5. Alleged signed cardholder agreement. 6. The fully executed Alleged original purchase agreement relating to the alleged account. I hereby demand that Crown Asset Management LLC & XXXX XXXX XXXX, XXXX close this file within their offices. Furthermore, I insist that they refrain from reporting any information to credit bureaus. Failure to comply with the aforementioned requests will prompt me to seek legal counsel. In such a scenario, Crown Asset Management LLC & XXXX XXXX XXXX, XXXX will be held accountable under 15 U.S. Code 1692k for their FDCPA violations.

Starting back in XX/XX/XXXX I started disputing XXXX with them themselves and the credit bureaus. XXXX XXXX and XXXX removed the XXXX account ending in XXXX. I sent a Validation of Debt letter to XXXX and it was never answered. as well as 4 other factual dispute letters to XXXX. Plus 2 other CFPB Complaints about XXXX. XXXX and XXXX. XXXX All documents are attached to the prior complaints. On XX/XX/XXXX I was served with a law suit from Crown Asset Management , LLC. I have never heard from them before nor have they tried to make contact with me about this alleged debt. Court Summons and supporting documents attached. On the Complaint from the Summons from Crown Asset Management , LLC Paragraph 1 states the account was opened XX/XX/XXXX, This is false. Paragraph 8 says I owe {$1200.00}. This is not what XXXX is reporting. Paragraph 6 says I do not object to any errors. This is false. I have the last 6 months of paper trail through XXXX and XXXX showing I am disputing errors. They would know this if they contacted me. They delivered the summons to my house, but the summons had the wrong address on it. It's an address I have never had, never seen or knew it ever existed. And not listed on my credit report. On the affidavit of the records they say they have purchased the account from XXXX it says date opened is XX/XX/XXXX. Last payment XX/XX/XXXX. The amount owed is {$1200.00}. The charge off date says XX/XX/XXXX. All 4 of these items on the affidavit do not match my credit report with XXXX who has Certified Verified this account with XXXX through a rigorous investigation of 6 months. The Legal Document Specialist for Crown Asset Management , LLC certified these documents as accurate XX/XX/XXXX. This was during a CFPB Investigation with XXXX and XXXX. XXXX can not be giving out information about an account that is in dispute. I also called XXXX on XX/XX/XXXX twice and said I am disputing this account. From all the errors on the documents that Crown Asset Management , LLC is using to sue me with I do not believe they really own the debt or if they do own the debt it was sold " as is '' and the validity of the debt is not guaranteed. I believe this is gross attempt to collect a debt that either does not belong to them and or is extremely inaccurate. No real proof the debt is collectable by them. Several pieces of the documents are severely redacted, missing and illegible and contact information to verify the sale is missing. Please help me against this wrongful debt collection. I am not posting my XXXX 'XXXX Credit report on here because I don't want Crown Asset Management , LLC to fraudulently parrot my information to use against me in Court. I also looked up their XXXX, a rating of 1. I know that this may not be important, but I'm XXXX % XXXX and live on XXXX. I could really use the help from them going after my Social Security XXXX.

The debt collection agency XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX, IL XXXX sent a 'dunning ' letter to consumer dated XXXX XXXX, 2015. The envelope was postmarked XXXX XXXX, 2015 and consumer received it XXXX XXXX 2015 which violates the XXXX XXXX XXXX XXXX day timeline consumer is allowed to respond to dunning letter. This is a practice synonymous with 'false, deceptive, misleading misrepresentation ' as it violates the Fair Debt Collection Practices Act ( " FDCPA '' ), 15 U.S.C. Section 1692e. Many debt collectors are adopting this practice as a way to cause consumer a lack-in-time to respond within 30 days and utilizing the timely manner set out by the FDCPA. Not all consumer 's have access to a fax machine. This Consumer takes issue with other factors of the 'dunning ' letter in regards to the fact consumer does not owe XXXX XXXX XXXX XXXX ( or any entity acting on behalf of XXXX XXXX XXXX XXXX ) a debt. Consumer disputes owing XXXX XXXX XXXX XXXX a debt based on the FACT : Consumer has no fiduciary, contractual obligation to pay XXXX XXXX XXXX XXXX anything. There is no payment history, nor products, or services that have been rendered to XXXX XXXX XXXX XXXX, because these elements do not exist ; there is a failure of consideration and no valid agreement, contract or fiduciary obligation under federal law that requires payment to third-party debt collectors. Furthermore, Consumer 's sole ( permanent ) income is Social Security XXXX income which is federally protected income under Section 207 [ 42 U.S.C. 407 ] ( a ) of the Social Security Act ; ( SSA ). Consumer is head-of-household and possesses NO property of value. Consumer 's federally protected income presents a 'genuine issue of material fact '', which will result in a frivolous lawsuit if pursued. Consumer filed this complaint as a means of formal documentation that consumer will " tender '' as evidence in a court proceeding if XXXX XXXX XXXX XXXX chooses to adopt their own agenda and pursue this matter further. Consumer wishes all communication ( mail/telephone/attempted collection ) cease upon notification of this debt dispute reported in this venue. Consumer has added a complaint lodged by another consumer who experienced 'unjust enrichment and extortion ' levied against them when interacting with XXXX XXXX XXXX XXXX. I have been disputing a debt with a company XXXX for over a year now. I had an account with them back in XX/XX/2014. I paid this debt in full back in the year of XX/XX/2014 in the amount of {$380.00}. Unbeknown to my knowlege about a year later I noticed on my credit report that it is reporting as a charge off to a bad debt. I would like to note that I directly contacted the company immediately and was told at first yes the debt is clear zero balance. I requested that it be corrected with the credit reporting companies as it is affecting my credit with false information. It was never removed. I again contacted them and was told the account was sold to Crown Assets. I contacted crown assets and was told that they have no record on file and that XXXX is no longer in business. I disputed this account with all 3 credit reporting companies and finally XXXX confirmed after there investigation that it is to be deleted off my credit report. ( which it was deleted ) however it is still reporting on XXXX and XXXX. I am fustrated that experian and XXXX is still reporting this. It is affecting my credit score. I paid this debt in full 4 years ago. Plus my biggest question is how XXXX was able to verify to delete it off my XXXX credit report because they have received confirmation but XXXX and XXXX did not receive the same response. It leads me to believe that XXXX and XXXX did not due a full investigation. I then contacted XXXX to see how they received there verification to delete the account and I was told that there was no response within the 30-45 day period they have to respond so by law it is automatically deleted. The rep also stated to me that it was confirmed that this company is no longer in business. I have been disputing this like I mentioned earlier for over a year now and they are still reporting it. I feel they are just updating the false information. I paid this bill in full 4 years ago and I planned on never ordering from them again anyway because there was nothing but problems with the item I had bought. ( It was a XXXX XXXX XXXX tablet ). The screen was cracked slightly and the tablet hardly works. ( I complained about it immediately and was told they would send me another tablet and I was to send back the damaged one ) They never sent me another tablet so I personally paid out of my pocket to replace the screen. Either way I received the merchandise and I paid for it. That company was beyond horrible and do not stand behind there products that's why I was never ordering from them again and probably why they went out of business. Having poor customer service like that will have you loose your customers. I want this account removed off my credit report. I am being penazlied for something that I paid for in full 4 years ago.

In XXXX through XXXX, we had significant medical and credit card debt incurred, as well as income lost for 33 months between XX/XX/XXXX and XX/XX/XXXX. In XXXX, two separate judgments were entered against me for credit card debts. In the last quarter of XXXX, I proactively reached out to settle the debts using financial help from a family member. We were attempting to settle both debts at the same time in order to clear our credit completely. We had significant difficulty with one of the companies, but we received an offer from another. The company we received an offer from was Crown Asset Management, represented by XXXX XXXX in XXXX WI However, the other debt collector rejected their original offer and refused to renegotiate due to a misunderstanding on their end, just 24 hours before funding was to be sent out. This unfortunately resulted in me not being able to settle any of the debts as we were unable to clear our credit. Initial Dates for Crown Asset Mgmt : In XXXX of XXXX, we received a reasonable offer of {$10000.00} In XXXX of XXXX, my son and I were in an accident, which resulted in 4 additional medial bills and judgments as we waited for our lawyers to resolve the issue. After were were able to settle in after the economic shut down of XXXX, I once again reached out to XXXX XXXX to make another attempt to resettle our debt. Crown is now managed by XXXX XXXX XXXX, not XXXX. Today, XX/XX/XXXX, I received an unreasonable and excessive counter offer of approximately {$16000.00} to settle the debt. This is an INCREASE of {$5800.00} in just over 1 year. My total debt has not increased HALF that amount since XXXX. This equates to a percentage increase FAR EXCEEDING all 5 other judgments that I have been able to resolve. I fully understand interest has accrued over the past year, however, a 3.99 % increase ( which is where EVERY OTHER debt collection agency is at ), would result in a significantly less increase than what has been countered with. This is excessive, unreasonable, and far outside the amount I have available from a family member who is assisting in this settlement. I am prepared to settle for {$12000.00} ( {$1300.00} OVER the initial offer in XXXX ) and the funds will be sent within 48 to 72 hours of acceptance. I am NOT in a position of paying nearly {$6000.00} MORE than the previous offer a year ago. There is absolutely no standard of interest or reason for such a counter and absolutely no precedent for what can be expected. I am already borrowing this money. I have no retirement, no savings, and no money set aside for education for our kids. And this is not helping me and my family be able to move on from unexpected and unavoidable medical debt over 10 years ago.

XX/XX/XXXX To whom it may concern : I would like to file a complaint against collection agencies, XXXX XXXX XXXX XXXX XXXX as well as, Crown Asset Management , LLC. Neither of these two collection agencies had contacted me first, to verify the debt that they have placed onto my credit files, slandering my credit. XXXX XXXX XXXX XXXX XXXX claims that they received a debt to collect on from Crown Asset Management , LLC, Crown Asset Management was supposed to have acquired this debt from XXXX XXXX XXXX XXXX XXXX. These collectors are placing false fraudulent status information onto my credit files, making it seem as though I had some debt that they are collecting on from the year XXXX, and that information is not true. As stated, neither of these collection agencies had previously contacted me to verify the debt that they are trying to charge me for. I dont owe what Im being charged, and I want this false derogatory information removed from my credit files, as well as from the collection agencies files. And I would like hard copy proof on their letterheads that, that has been done. I asked that they remove the false information from my credit files, and I wanted hard copy proof when that had been done. In the mail today, Tuesday, XX/XX/XXXX, I received the attached cover page, along with a pile of doctored up statements from XXXX XXXX XXXX XXXX XXXX, with them lying, and claiming that I had requested that they send me verification of the false debt, that they originally didnt notify me about, prior to slandering my credit files. I never asked that they send me any such verification, I disputed the debt, and again, I am requesting that both, Crown Asset Management, and XXXX XXXX XXXX XXXX XXXX remove the false information from my credit files, and I want them to stop writing, and calling me as well. As previously requested, I want them to cease and desist from ever contacting me again. XXXX is ultimately liable for the conduct of its agents. I should not be subject to paying for a debt I do not owe or be subject to default for a debt I do not owe. XXXX and Crown Asset also failed to validate/verify the debt or forward my financial records to me regarding this debt. This is the most I can piece together since the lenders and Crown Asset refuse to give me a complete copy of my financial records and the entire file related to the account. XXXX conduct is in direct violation of Consent Order XXXX, which the CFPB ordered after it found violations very similar to my case. As such, XXXX should be held in contempt and sanctioned. In XXXX, after 20 years of employment with the same company, my wife was laid-off due downsizing. She had several credit cards at the time and I was listed as an authorized user on some of them. I was not the OWNER of any of the credit cards - I was only an AUTHORIZED USER. My wife was successful in finding another job but the pay was 1/3 of what she was making before she was laid-off. For over 3 years, she tried to keep up the payments on her credit cards by drawing money each month out of her retirement account. Unfortunately, in XXXX of XXXX she had no choice but to declare bankruptcy because she had used up her savings and retirement dollars. After she was discharged from her bankruptcy, I began receiving certified/registered letters from XXXX demanding that I pay the balance on her credit card. I explained to them that I was not the owner of the card, but simply an authorized user. I asked them to send me proof that I had signed the cardholder agreement as a responsible party. I received a letter from them stating that they did not have the proof that I was a responsible party on the account. I explained to them that until they could furnish proof that I was a responsible party on the charge card that I was disputing the validity of the debt and respectfully requested that they do not contact me again. To date, they continue to harass me requesting payment and have now sold the account to a collection agency that is demanding payment. My wife talked to the attorney that handled her bankruptcy and was informed by her that I am not responsible for this debt. I am requesting that the harassment for payment on this account be stopped and that the negative information they have reported on this account to the credit bureau be retracted.

Upon this letter, I sent them a dispute letter to notify I am a victim of the identity theft on XX/XX/2019. I have reported the idendity theft to CFPB, local Police department, and FTC. I asked a confirmation letter which states that there is not any account my name and social, but they said, " No, because the account number is not existed. '' Today, I sent express priority mail asking the account applications made on paper, online, or by telephone, and any record including payment history, phone number to access the account, signatures on applications, and the copy of ID when the account was made using the address, and investigators report. The XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and thier client Crown Asset Management have never sent the account application. The account in XXXX XXXX does not exist. It means those company made a fraudulent account without my permission. They got judgement ( {$6100.00} ) using the address I have never lived, and then they sent the first letter regarding the judgment debt to me. What should I do next? Crown Asset Management, a debt collector, is suing me for a debt that I previously requested validation for via a letter sent to them on XX/XX/XXXX. I also filed a copy of the letter with the courthouse since I was being sued at the time and still lived in XXXX. I first learned about this alleged debt from a letter served to my ex on my behalf on XX/XX/XXXX. Prior to this, I was never contacted by mail or phone about the debt and was not given a chance to validate it in accordance with the Fair Debt Collection Practices Act. After receiving the letter, I sent a validation of debt letter on XX/XX/XXXX requesting more information about the debt. Crown Asset Management never responded to this letter, and it has been over six months since I moved to a new address in XXXX and also had my mail forwarded without receiving any reply. On XX/XX/XXXX, Crown Asset Management filed a motion for summary judgment without providing me with the information I requested in my XX/XX/XXXX letter, which I had filed at the courthouse when I lived in XXXX XXXX. I discovered the motion on their website and was upset that they had not properly furnished me with the requested information. I also noticed that the motion was addressed to an unknown address, so I would not have received any correspondence from them even though I had given them my address in my debt validation letter. Crown Asset Management 's actions appear to be in violation of the Fair Credit Reporting Act and the Fair Debt Collection Practices Act, and I believe that my rights have been severely violated. I was not contacted by anyone prior to being served the summons. I responded via mail to the attorney, disputing the debt was mine. In response I received via mail copies of 6 statements that had no identification ( no name, acct number, address, etc ). There were also 108 essentially blank pages. I responded in writing again, stating this was not my debt and pointed out there was no identifying information on the documents that were sent. The attorney responded in writing saying that the records had been photocopied incorrectly. He sent more copies of the records with a name and address. His letter then continued asking me to call him so negotiations could proceed to settle the debt. My XXXX letter that I sent to the attorney asked for a copy of a signed credit application to prove this was my debt. I also asked for the date of the Statue of Limitation. I received another set of the same paperwork, but nothing that I asked for. I am being taken to court On XX/XX/2022 over this. I can not find an attorney to represent me because the debt is so small. I am scared and find this whole process intimidating and humiliating. But more than that, how can any debt dealership company like Crown Asset Management be allowed by law to persecute people without evidence of any legally signed contracts?

I previously paid my XXXX account in XX/XX/XXXX and was informed that my Credit Reports would be updated to reflect that my XXXX Account was Settled, however, it is still showing the account Not Settled and Balance of over XXXX. This account was settled through XXXX XXXX XXXX in XXXX, GA and verified payment was made through my account with XXXX XXXX XXXX XXXX for {$2300.00} on XX/XX/XXXX and my account is still showing Not Settled with XXXX XXXX XXXX. I have been illegally Discriminated against with these ruthless tactics by XXXX XXXX who sold the account to XXXX XXXX XXXX who has also collected on behalf of XXXX. Therefore, my account is not properly reflecting as settled and this is nothing more than a Bait and Switch illegal tactic utilzied and corroborated by XXXX XXXX and Crown Asset Management. My XXXX Account should be showing Settled because I was promised this would be reported to the Credit Beaurau once the account was settled. Also, XXXX XXXX Bank lied when I called them stating that the account is reflecting correctly and it is not. My balance has been paid in a Settlement Agreement and I was assured that the Account would reflect appropriately on my Credit Bureau. Other Retail Organizations also update the credit once an account has been settled, although it was sold to another entity. I have never heard of such lies being portrayed by XXXX and Bank and Crown Asset Mgmt through their Bait and Switch Tactics. I would not have agreed to pay the account off if the Agency would not have agreed to ensure the account shows as Settled on my Credit Reports.

I had lost my job and was late paying one day for this company and tried calling them to tel l them of my demise. Only to be told that they could not do anything for me. I was attempting to pay the debt but with late penalties and other, I could not do so as i continued to have money problems. i called to ask them if they could work with me and they said no. i was paying when i received a bill from them but they stopped sending bills after the credit company took over. i did try to locate old bills and pay them monthly. they served me with a summons after the date that they said i had to respond. i had tried calling a month prior when i received their first threatening letter but no one answered so i just sent a money order. i was not sure who the debtor was. the complaint stated i did not attempt to pay the debit which is a lie. also it was forcing me to sign the complaint and said i had no objection. when talking with the person on the phone, i did state that i was not even sure who the creditor was and they finally told me after a few minutes. i made payment arrangements and they sent a further stipulation agreement to which i felt compelled to sign but under duress. point though is if this company had worked with me in the first place, this all would not have happened. and on my credit report, they say i am like three years behind in payment ... another lie. i have been sending money orders all along. i am not even sure if this is the right balance. sorry for not capitalizing my letters, my computer messes up when i do. thank you for your time and consideration.

I was in the process of fixing my credit so that I am able to purchase a home. I contacted the original Company, XXXX, and was advised that my account was sent to Crown Asset Management LLC. I don not recall being informed that my account would or could be sold to a third party. In spite of this, I proceeded to contact this company at XXXX. Upon calling I was informed that my account has not yet been assigned to a representative and that it was pending placement. I asked how long would that process take the Operator advised that she was unaware and that it depends. She advised me that she could take my information, add it to the account, and when my account is " placed '' they will see the notes that I called in. This was roughly six or so months ago. Between then and now, I have continuously called, on numerous occasions. One call I was connected to an XXXX voicemail. I left a detailed message ( XX/XX/XXXX and XX/XX/XXXX XXXX ). I have yet to receive a call from her. I called back repeatedly. When doing that I would be transferred to a busy signal. When I called back and tried a different option, I was again sent to a voicemail ( this time not XXXX, but a general voicemail box ). I left more messages. Still no one has contacted me. I even made the attempt of contacting the Company via XXXX. I seen an XXXX XXXX, and made an attempt for someone to call me back. XXXX, XXXX, Crown Asset Management and their debt collector XXXX XXXX are using threats of a lawsuit to attempt to collect a debt that is not owed. They are doing this in violation of the FDCPA. They know that they can not prove that I owe the debt in court, because it was the product of identity theft so they are using a threat of legal action in order to try to fraudulently collect on a debt that I do not owe. They should be fined under the FDCPA and now that President Biden has been sworn in, I would expect that the CFPB will start actually doing its job again which means bringing lawsuits against these rogue debt collectors that were allowed to flourish over the last four years. The XXXX credit card that they are trying to collect on was paid in full about four or five years ago. I actually took out a HELOC and consolidated credit card debt. The account ( along with a few others ) was reactivated and used by an identity thief. XXXX, XXXX, Crown Asset Management and XXXX XXXX have all been supplied with the police reports and the FTC reports. YET they continue to try to fraudulently collect on this debt in violation of the FDCPA. I understand that the former chair of XXXX was a close friend of the former President, XXXX XXXX, and that may be why CFPB never did anything about this before -- but now, we have a new President who is upholding the laws, so I would like the FDCPA enforced in this matter and in ALL accounts that XXXX if fraudulently trying to collect on.

I have never signed a contract with Crown Assett management, I dont owe them anything. Yet the garnishment is still on my pay check as of today to continue. I called Crown Assett mgt on XX/XX/XXXX and XX/XX/2018. The answer I got is " it is a process ''. No one can tell me how long. In the meantime I have XXXX children to feed, while Crown Assett was already notified of the XXXX dollars they were GUARANTEED on XX/XX/XXXX. In XXXX of 2021 I received a court document from a collection agency stating that they had served me they had gone to court behind my back and they won by default. I was never served in any way shape or form I was never notified by this collection agency I don't know what the debt is for where the debt came from or even if the debt is mine. The three pages of the Court docs didn't include the name of the original debtor the name of the person that I owe the debt and when the last payment on this supposed to get was made which means I don't know if it's mine where it came from and it is more than likely a time-barred debt. Since they won by default because they falsified documents and they serve me when they didn't I'm now on the hook for almost {$5000.00} which I don't know and I don't know how to fight it. I need help ASAP before deleting my home or if they try to garnish my husband 's wages we would not be able to make our mortgage payment and we would lose our home. I never received all the full court documents and if you'll notice on the image I attached the page that is supposed to provide the original debtor how much does XXXX on the last payment was made with never filled out it was incomplete. I have a debt collection from XXXX and I called XXXX and spoke with XXXX about making payment arrangements on my account and she said my debt was sold to Crown Asset at XXXX I called and spoke with XXXX and he said that he could not take my payments and payment arrangements would have to be done through XXXX XXXX at XXXX. I called XXXX XXXX and spoke with XXXX and he stated that he could not take any payments because I was currently XXXX XXXX Military and the account had been transferred back to Crown Asset management. So I called Crown Asset back and spoke with XXXX XXXX and told her that I was currently in training and this was my only day that I had to make payment arrangements on my outstanding debts and I needed to pay on this account. XXXX said that the account was not with Crown Asset and that she couldn't take a payment anyway because all their payments would have to be made through XXXX XXXX. This collection company XXXX XXXXCrown Asset sent writ to old address that I lived at over 3 years ago and filed a court case against me. I only know about the writ and the lawsuit after receiving court papers with an appearance date. I did my own investigation to find company suing me. I reached out immediately asking for a copy of the writ to be sent to my correct address which I gave to them. I was told according to the law they already did what they had been required to do. I asked as a courtesy please resend to correct address. I was told representative asked manager who repeated same thing, not required to resend. I emailed a request in writing asking for writ to my correct address. No response was received. I attended first court date, told court that I never received writ or any notice from Bill collector. The court order them to send it to me. I contacted the lawyer on the case the same day and confirmed address. Nothing ever came. Court date # 2, told court again nothing was received. This time court ordered to send writ. Again, nothing received. Court date # 3, Judge ordered writ by registered mail with signature. Again nothing came. Court date # 4 Judge again ordered writ by trackable mail, continued for 30 days. During all this time multiple calls from collection agency about this debt. I told them they failed to send notice and should not be contacting me. They continue calling me.

Crown Asset Management ( CAM ) sued me in XXXX County, Indiana, and I just happened to find the summons on my front porch step flapping and blowing in the wind. It was only by pure luck I found the notice. If this unattached document had blown away I would have never know I was being sued, but fortunately I did find the summons and I responded promptly. The huge error on Crown Asset Management 's filing was that I do not live in the county where they sued me. Simple research based on my address would have easily indicated that my county of residence is XXXX county Indiana. CAM filed a motion to dismiss the case and then they refiled in the correct county. I was only able to find this out by checking the website XXXX daily to see if CAM refiled in the correct county. The case was initiated XXXX, but as of today I still have not been officially notified. I am a XXXX XXXX XXXX and my time and energy is dedicated to making sure my XXXX needs are met during this very difficult time. In addition to that, I am a mother with XXXX XXXX and the last thing I need is this company distracting me from my XXXX and my own family. They have repeatedly contacted me before the court filing and have violated the Fair Debt Collection Practices Act by ignoring my plea for them to stop. They have wasted enough of my time and by having to respond to them over and over again without any results is very frustrating.

I paid an debt, and in the attached email I have downloaded for your review stated it would be updated in XXXX days, that was XXXX months ago. I called in today XXXX to XXXX times asking to speak to a manager after several attempts to have this removed from my credit report. The woman I spoke to refused to give me her name, and also transferred my phone call to a company that was not crown asset manager. I later found that she transferred me to the company that was hired by them to settle my debt. I had already spoken to debsty, who stated that reports are generated at the end of the month, and crown asset management received the settlement letter within the XXXX days, and it was up to them to contact the credit bureaus to give notice that my debt was settled. They have yet to act on their part in contacting the credit bureau. If this is not taken care of I will file lawsuit against them in this matter for reasons that I will research on why I am able to file a lawsuit. I made her aware that I had already spoken to debtsy, who has since changed their name to XXXX, and asked to speak to a supervisor on every phone call. she refused, and transferred me to debtsy. I would like every phone conversation listened to from me to her line, and I would like disciplinary action taken against her. Crown Asset Management purchased as debt from one of my creditors. I was in a program with XXXX XXXX XXXX, and the debt collector would not work with XXXX XXXX XXXX to negotiate the debt. I was then sued by Crown Asset Management and after consulting with an attorney, I agreed to a Judgment Entry with the creditor. The agreement terms were that I would pay one payment of {$130.00} on month 1, and {$130.00} dollars per month thereafter. The creditor did not initially provide me with their correct account/case number, which was required to make my payment on the website that they provided. Furthermore, nothing on the website affiliated it with the debt collector. The website address provided was XXXX. There is nothing on the site that establishes it as being connected to Crown Asset Management, which I thought was suspect. Still, after getting the correct case number, I did make the first several payments to the creditor. I noticed that after making the payments however, that they did not send me any payment confirmations via email, nor did they provide any confirmation number or notification that a payment was made. They provided absolutely no information concerning my debt or the payments that I was making. I may as well have been sending money into a black hole. I did not trust this site, and I ceased making payments. The debt collector has now moved to garnish my wages.

In XXXX, I had a 6 month free trial of XXXX XXXX which I assume automatically renewed on XXXX XXXX, XXXX without my knowledge for an amount sum of {$49.00}. Let me also say that I did not receive any bank statements from XXXX XXXX at my billing address at the time, so I was not aware that I had accumulated any debt or else I would have paid it back immediately. I was contacted on XXXX XXXX, XXXX by a debt collector who made me aware of the fact that I now owe {$300.00} and some change. After calls to XXXX XXXX, they informed me that the excess money owed to the debt collecting agency came from late payments on the account. I called XXXX XXXX, XXXX party debt collecting agency, and they have no knowledge of the initial charge on the account. They also stated that they would be willing to settle for {$210.00} but I declined since the original amount was {$49.00} and they did not send a statement to my billing address to inform me of the amount owed originally. I contacted XXXX today, XXXX XXXX, and they granted a refund to my XXXX account for the XXXX $ since I did not use the prime service at all. Meaning, I should n't be in debt at all since the original amount I owed was a non-intentional and XXXX has recognized this and refunded the original purchase to the XXXX XXXX XXXX. I have attached an email verifying that XXXX has refunded the initial amount due to their error.

At XXXX XXXX XX/XX/2020 I received a call from XXXX XXXX who began threatening me that his client would pursue actions against me if i did not work with him on resolving an account his company had purchased. I advised I had done no business with his company XXXX XXXX nor Crown Asset Mgt and did not feel comfortable going forward due to the fact a business whom ive not conducted business with had all my personal info and was willing to devolve it to someone who answers a phone and no verification. This company has called numerous times a day and when answered they would hang up and not say anything. The disputed amounts do not pertain to any credit extended, but relate entirely to introductory ( deferred ) interest program. XXXX XXXX ( XXXX XXXX ) failed to credit my account prior to the expiration of the deferred introductory interest. We received documented credits for multiple deliveries of damaged merchandise. XXXX XXXX ( XXXX XXXX ) did not apply the agreed upon credits to the account when the merchandise was disputed and agreed upon to issue credits ( on recorded lines ) in a timely manner. XXXX XXXX ( XXXX XXXX ) were negligent and fraudulent in this manner by attempting to seek payment on deferred interest for merchandise that was damaged and previously agreed credits were not timely applied to the account. Had such credits been applied to the account as stated and agreed by XXXX XXXX ( XXXX XXXX ) the account balance would have been {$0.00} prior to the expiration of the deferred interest program. I received a letter with 2 collection agency names on it. " XXXX XXXX XXXX XXXX " and " CROWN ASSET MANAGEMENT , LLC '' showing a debt that I do not owe from " XXXX BANK ''. Please remove this from your records as this is not a valid debt. Both the business 's that the debt was aquired from made errors and were fraudalently handled by a phone team of social justice warriors who kept me on hold and never did have the correct amounts. This is the only way I can communicate with XXXX XXXX XXXX XXXX because they dont know how to respond to me in any other way. They claim to be a company who helps their clients even if the loan that was taken out was fraudulent. Also, there was never a loan for {$3800.00} deposited into my account in the first place. They claim there was. The bank account that is now closed ending in XXXX never had a loan in that amount deposited. I never used the money for a loan in that amount. My spouse is My witness. Crown Asset Management LLC sent me a debt collection letter approximately in XX/XX/XXXX with no account number or amount number or any information about to whom this debt is owed to. Sent Crown Management a debt validation letter approximately on or about XXXX asking for debt validation. I called the company to find out more information and the person hung up on me. I followed up with a second request for debt validation letter. In retaliation, this company files a lawsuit against me on XX/XX/XXXX in XXXX XXXX, Chicago, Il without ever validating the debt. This company also lied to the courts stating I was served with court papers and I never was. In the month of XX/XX/XXXX I reviewed my credit report from XXXX, and found a hard inquiry from Crown Asset Management , LLC ( C.A.M. ) dated XX/XX/XXXX for a purpose unknown. I disputed the entry made by ( C.A.M. ) with XXXX and received a letter from XXXX in response to my dispute indicating that I need to contact the company that is responsible for the inquiry. I had a store credit card debt through XXXX XXXX but i run into trouble paying the charges so the company made payment arrangement and froze interest charges. As part of the arrangement I monthly payments was to be by auto direct payments form my check-in account. I lost my job there after and direct auto payments form check-in account were returned and arrangements on the payments could not be honored. I also I incurred returned fee charges on my bank account. I started receiving bills with charges greater than agreed so I sent email to inquire about the charges but never got a response. I was earnestly intent on resolving the issue but never got a response. The debt was transferred to Crown Asset Management and I disputed the amount claimed. They sent me details of accumulated interest charges so that the claim now it far more that the balance agreed and over a thousand dollars more that the initial principal amount of charge. On XX/XX/XXXX I received a letter from a company saying they would help me in my lawsuit. I immediately thought, what lawsuit? I then went onto XXXX, searched my name, and found that I am being sued by a company I've never heard of nor heard from. I googled, tried to call the company and left a voicemail and submitted an e-mail to them online saying I'd never heard of them how could they be suing me. I also sent this same information to the lawyer representing them. I told both parties that I am more than happy to pay my debt, which I had been trying to find to no success, but these people had NEVER tried to contact me. I am an identity theft victim. I made my FTC report before Crown Asset Management took legal action against me. I never received the letter that I could dispute the debt. They keep claiming it was sent to my address, yes but I never got a hold of them. The XXXX that is in charge of my account was being condescending and was putting words in my mouth, basically to say what he wanted to be recorded on the phone line. I too recorded him just like they had me on a recorded line. The lady I spoke to before was really rude, told me that just because I am an identity theft victim does not mean that I am not responsible for the money ; accusing me of having given someone authorization to use my card. I requested a file disclosure from the debt collection agency and then they want to send me all these affidavits and court papers to prove that I am victim of identity theft. I have proof that accounts were opened under my identity and did not belong to me. I do not feel like returning those documents to them. They have caused me so much stress, and anxiety. I want someone of the higher ranks to tell this company to not belittle individuals, nor force or incriminate us as delinquents.

About 3 years ago, I had a debt relief company " XXXX XXXX '', help me with some debt relief. Paid them a total of approx $ 10K. Everything went well. No issues. Everything seem to be taken care of. About a month ago, a company called Crown Asset Management filed a lawsuit on me for some old debt that was " taken care of ''. ( suing me for some added up debt of approx $ 18k ) I wasn't notified by Crown Asset Management, only to be caught by surprise, a lawsuit. " XXXX XXXX '' appears to be out of business as of sometime in XX/XX/XXXX so that is to no surprise. My only action was to get an attorney on my behalf to help with this matter. On top of everything, my attorney found some charges that I am being sued for that I believe were from identity theft. From the little information that we found record of, there was at least three transactions on XX/XX/XXXX in the amount of {$1500.00} that I believe someone stole my identity and used. Maybe even more before that. There are two companies I wish to file complaints on, Crown Asset Management and XXXX XXXX. They may even be connected together in this scam ... ... ..I don't know, but intend to get to the bottom of this.

On XXXX XX/XX/XXXX at XXXX, my financial counselor and myself called XXXX XXXX to get a deficiency balance statement on a repossesion that happend in summer of XX/XX/XXXX. XXXX XXXX stated the debt was sold to a collection company. They gave us the contact number at XXXX, Crown Asset Mgt. We called Crown Asset Mgt and spoke with XXXX. She informed us that it was in the process of being sold to another collection agency and that she could not give us the deficiency balance. I am being taken for a garnishment by this company and I have no idea who they are. This debt is not listed anywhere on any XXXX credit reports. I have tried to call them several times to get information and no one answers the phone or returns messages. I last attempted to call this company again after I was served this week and was told they are garnishing me and why would they do a settlement offer when they can just take my paycheck and then hung up on me. I tried to call back at least XXXX more times and they would not answer. Also the name that is given for the company is totally different than the name of the company listed on the garnishment paperwork and when I asked them if they were a debt collector they told me I just wan na agrue and that they are not a debt collector. Crown Asset Management ( C.A.M. ) violated my rights as a consumer. C.A.M. did not give me the opportunity to exercise my right to dispute this alleged debt. I received a summons in the mail, and in the documents it showed that they tried to serve me face to face for a few weeks. The documentation was written by an attorney representing the company violating 15 USC 1692e ( 3 ) as stated an attorney or affiliation can not act as a debt collector. Looking at the information sent from C.A.M. under the Uniform Commercial Code Section 3-204, the name and the signature of both the beneficiary and the original creditor must be disclosed in the same document 3-204 ( d ), but Crown Asset Management and my signature are not found together on any document. However. C.A.M. continues to unlawfully seek litigation against me having no first hand knowledge of the consumer credit transaction that took place which is a violation of 15 USC 1692e.2 ( a ) ( b ) according to the FDCPA. I received a bank subpoena on XX/XX/2021 regarding an account that was opened under my name with XXXX. I had no knowledge of this which is why I filed a police report right then and there. Crown asset management went into my savings account and pulled out the full amount without warning. I then filled out a claim of exemption form and filed it with the court timely. The judgment debtor denied it. On XX/XX/18, I received a summons from the county sheriff regarding a debt that is over 10 years old which has not appeared on my credit report to have a judgement filed against me. The company is Crown Asset Management and I have never received any notification from them regarding any debts owed until today. When I attempted to contact them several times I was unable to find someone who could give me any information and was threatened with a garnishment which the summons also states. I received in the mail a letter where I've been told to show up for a court hearing about a debt that I knew I had, and have already set up payments with another company called : XXXX. This court docket does not tell me anything except the company they are representing and how much money I supposedly owe, which I can't even verify this amount as correct. After being intimidated with a court summons ( 2020 during the pandemic ) left at my door, and my XXXX nephew retrieve it as I wasnt home. I received a letter from XXXX XXXX and XXXX in XX/XX/2019 that they had sold a debt to Crown Asset Management. On XX/XX/2019, I sent a certified letter to Crown Asset Management informing them that this was not my debt and to validate the debt. Crown Asset Management signed for the certified letter and the return receipt card was mailed back to me verifying that they had received the letter. The letter included my current address so that Crown Asset Management could send me debt validation through the mail. Although they have my correct address, I have not received debt validation from them yet. I am writing for your assistance because I have read that this debt collection company tries to sue individuals for debt that does not belong to them and they also sue individuals without ever sending them any correspondence about the debt, no assignment of the debt, and no debt validation after it has been requested.

In XX/XX/2016, I purchased two blouses and two pairs of pants from XXXX for my wedding and associated events for {$120.00}. When I received the packaging, it was heavily soiled and damaged ( see pictures ). Given the quick turnaround to the wedding, I needed to keep one set of blouse and pants and sent the second set back. I was issued wage garnishment on XX/XX/XXXX by Crown Asset Mgmt LLC for 25 % of my wages on a debt that isn't mine. When I tried to contact the company, they didn't even have any of my current info, I had to give it to them to get the info on my debt.
