This complaint is against ALL Consumer Reporting Bureaus/Agencies/Companies/Public Reporting companies/Consumer Data Mining Companies/Consumer Credit Bureaus , et al and the CEOs/Presidents and or Acting CEOs/Presidents and or Successors, Assigns, Agents, and Representatives. We are FEDERALLY PROTECTED CONSULMERS. Our credits report ( s ) AND file ( s ) have erroneous reporting from ALL Consumer Reporting Bureaus/Agencies/Companies/Public Reporting companies/Consumer Data Mining Companies/Consumer Credit Bureaus , et al . We have been advised that CREDIT REPORTING is a form of collection strategy and we DEMAND that ALL credit reporting CEASE IMMEDIATELY, ALL Consumer Reporting Bureaus/Agencies/Companies/Public Reporting companies/Consumer Data Mining Companies/Consumer Credit Bureaus , et al and acting CEOs/Presidents , et al are in direct violation of 15 USC 1692 e ( 8 ). We never received an initial communication from ALL Consumer Reporting Bureaus/Agencies/Companies/Public Reporting companies/Consumer Data Mining Companies/Consumer Credit Bureaus , et al , which means they are in direct violation of 15 USC 1692 G ) ( b ). On XX/XX/2019, I submitted a personal check to my XXXX dealer to pay for vehicle repairs as I normally do. The cashier submitted my information to CrossCheck, Inc. to verify my check was valid. The response from CrossCheck, IncXXXX indicated the check number had already been used and the check I presented was not valid. ** I immediately contacted my bank to determine if there were any problems with my checking account or checks. The bank responded by telling me the check number had not been used, there were sufficient funds to cover the personal check, and there were no restrictions or limitations on my accounts. ** The cashier submitted my information to CrossCheck, Inc. again after I verified with my bank the check was valid. The cashier and I verified the information submitted to CrossCheck, Inc. contained no errors. Again, the CrossCheck, Inc. response indicated the check was not valid and declined the check. ** I called the CrossCheck, Inc. phone number for consumers/checkwriters, ( XXXX ) XXXX, to see why my personal check was declined. The number is simply a recorded message. The checkwriter can leave a phone message with their information but CrossCheck, Inc. takes up to15 days to respond. I then contacted Customer Service, ( XXXX ) XXXX ; however they will not talk to checkwriters. There is no representative a checkwriter can speak to determine why a check was declined or correct false information in a timely manner. There is no other timely method to contact them and determine the problem or corrective action. CrossCheck, Inc. is not accountable to consumer/checkwriters. See attachment 1 for CrossCheck, Inc. contact information. ** As a result of the declined check, I was unable to pay for the vehicle repairs with my personal check and retrieve my vehicle. The consequences of frivolously declining a check can be significant. I am fortunate I was in my home town and not traveling where I may not have had any resources. ** I followed up this event by requesting an annual credit report from CrossCheck , Inc . The CrossCheck, Inc. report stated that no negative data regarding me or my check writing history was found and that there was no negative data associated with me in Cross-checks data base. I can confidently conclude the information provided by CrossCheck, Inc. to my XXXX dealer regarding the validity of my personal check was false and misleading. See attachment 2 for a copy of the credit report. ** A review of the Consumer Financial Protection Bureau, Consumer Complaint Database ( www.consumerfinance.gov/complaint ) shows many complaints against CrossCheck , Inc . I have attached the consumer narrative of two complaints that are similar to mine. See attachment 3. Many of the complaints do not have a consumer complaint narrative that the public may view so I can not determine if there are more complaints similar to mine. I would guess there are many more complaints similar to mine that could be viewed by your office. XXXX The XXXX XXXX XXXX database shows a number of consumer/checkwriter complaints against CrossCheck, Inc., also. ** Conclusion : CrossCheck, Inc. provided false and misleading information to my XXXX dealer that indicated my personal check was not valid. My personal check was not accepted by my XXXX dealer as a result. My personal check was valid based on my contact with my bank, my personal knowledge, and the CrossCheck, Inc. credit report. I have an excellent record of paying debts on time with valid checks. CrossCheck, Inc. does not have a timely process for correcting false information on checkwriters. They provide little accountability to consumers/checkwriters. CrossCheck, Inc. has re-occurring problems with issuance of false and misleading information against consumer/checkwriters based on a review of the Consumer Financial Protection Database and the XXXX XXXX XXXX

My name is XXXX XXXX, I am the XXXX and XXXX of XXXX XXXX & XXXX XXXX XXXX in XXXX Georgia. I was referred to CFPB by the XXXX in California. My complaint is against Cross Check Inc. Although this is a very detailed complaint, I am asking that Cross Check return XXXX with interest immediately to XXXX XXXX & XXXX XXXX XXXX. I will to cover the most important information involved in this complaint. In XXXX of XXXX, I requested an investigation of my business account named XXXX XXXX & XXXX XXXX XXXX with XXXX XXXX XXXX, my banking institution of over 20 years. It was discovered that Cross Check was illegally and fraudulently over debiting my account for a gross19 years. The discovery was confirmed in XXXX of XXXX that Cross Check replicated, used the exact same company identification number as well as the exact same source identification code of my chosen merchant processing company to fraudulently debit money from my account. This Scam went on for years undetected because Cross Check, in addition to using the important banking information of my chosen merchant processing company, they also used unidentifiable information, so that neither my bank nor I would discover them. This scam made it appear that my chosen merchant processing company was over debiting my account. I have only used two merchant companies in 18 years, this also made it difficult to detect that Cross Check was fraudulently debiting my account. XXXX XXXX XXXX is ready and willing to offer the findings from an investigation of my account at my request. I have reached out to Cross Check on numerous occasions to get them to return these funds to XXXX XXXX & XXXX XXXX XXXX immediately, they have refused, but tried to offer me a small percentage of the XXXX they illegally and fraudulently debited from my account. It was explained to Cross Check that my company did not have a check acceptance policy, however, on the rare occasions that I received a check, it was processed through my own merchant processing company and my bank. Cross Check claims that they have processed 17 checks for XXXX XXXX. This is false, and misleading, if Cross Check processed any checks after XXXX, they did so without my knowledge or my consent, or a contractual agreement giving them permission to do so past XXXX. Cross Check contacted my company in XXXX of XXXX, one check was processed with Cross Check with permission. This was determined at this time that XXXX XXXX & XXXX XXXX XXXX did not want to have a relationship with Cross Check. I have not had a relationship with Cross Check past XXXX. I have never had a phone call, or conversation with Cross Check in 19 years. I have never gotten a message or any form of communication from Cross Check in 19 years to evidence a continued relationship. I have never received any US Postal mail, Certified, mail, deliveries of any sort ever. I have never ever received a kit of any kind, as they claimed. If that were true, I would have contacted Cross Check myself in XXXX. My address, email address, and phone & fax numbers have been the same for 20 years. XXXX XXXX/ XXXX XXXX & XXXX XXXX XXXX has not signed any kind of contract or agreement giving Cross Check consent or permission to debit my account past XXXX, nor I have I had any type of communication with Cross Check past XXXX to evidence a business relationship past XXXX. Cross Check maliciously and deceitfully continued debiting my account year in year out because they knew they were not being detected. This is illegal, fraudulent, bank fraud, unscrupulous business practices and a Complete Scam. In XXXX, we became involved with a company called Cross-Check. We became known as Store # XXXX. Cross-Check provided check verification services. In XXXX, Cross-Check said we needed to update the way checks are verified and said they would transfer our existing account to a system that verifies the checks in office with a in house check machine. We agreed and the machine was shipped, we filled out the paperwork, and set up the machine. We used the machine one time. In XX/XX/XXXX, we decided we no longer wanted to continue any services with Cross-Check, because we obviously weren't using it and checks were rarely received. I called Cross-Check and spoke to XXXX, who told me to write a letter 30 days out and fax it to them to cancel services with them and they would send us a XXXX label to return the machine, which I did. I called back later that month and confirmed cancellation of our association with XXXX. I shelved the machine and forgot about it. As far as we were concerned, we were done with Cross-Check. In the mean time, we changed banks. On XX/XX/XXXX, an audit was done on our account and they found a a repeating payment of {$40.00} and it was listed as XXXX XXXX. I called several possibilities and finally called Cross-Check. I began a conversation with XXXX. I gave XXXX our store # and she looked it up and confirmed that our account was closed. I spoke to the XXXX again and they said it was definitely being charged through Cross-Check. I called back again and spoke to XXXX. I gave her the charge info and after doing a search she discovered that it was a charge through them for a different store # XXXX. XXXX said that in XXXX they gave us a different store number, while continuing to charge us for the old store #. The services we had in XXXX were supposed to be replaced by the services we upgraded to in XXXX, but that is not what happened. Cross-Check continued to charge us for the initial 2012 setup of {$25.00} a month and began charging us {$40.00} a month for the upgrade. Additionally, Cross-Check did not notify us that the store # was different. When I spoke to XXXX the second time, she could not understand why these store # 's were not connected or why the primary store # had not been cancelled when the new store # was set up. XXXX told me to send an emaildispute to XXXX, outlining what had happened and asking them to look into the dispute and to contact me immediately to resolve this issue. I waited three days and called again. I spoke to XXXX, who said XXXX would be in the office in about 30 minutes and she would call me then. I received a call from XXXX at XXXX on Friday XX/XX/XXXX. We were closed by then. I returned her call Monday XX/XX/XXXX at XXXX and XXXX called back at XXXX. XXXX told me that there was nothing they could do, that it was our mistake and it was just too bad. I told XXXX that I wanted a written response to my dispute and told her that by law, I am entitled to XXXX. They did not comply. I called corporate and told the same story, they came to the same conclusion, I made the same request for a written response and I have yet to get one. They did, however, send a XXXX label to collect their equipment. Bottom line, Cross-Check continued to charge us for two Store # 's for 4 years and then continued to charge us after we sent a letter in XXXX cancelling all services with them. We feel this is fraudulent.

I previously submitted a complaint that is now closed where I requested CrossCheck to do the following : It has come to my knowledge that the companies listed in this complaint. have been supplying my personally identifiable information to 3rd parties without my knowledge or my consent. In accordance with the fair credit reporting act, these companies have violated my federally protected consumer rights to privacy confidentiality under 15 USC 1681. 15 USC 1681 section 602 a states I have a right to privacy. 15 USC 1681 section 604 A, section 2 : it also states, a consumer reporting agency can not furnish an account without my written instructions. 15 USC 1681C ( a ) ( 5 ) sections states : no, consumer reporting agency may make any consumer report containing any of the following items of information : any other adverse item of information, other than records of convictions of crimes, which, antedates the report by more than seven years. 15 USC 1681S-2 ( A ) ( 1 ) : a person shall not furnish any information relating to a customer to any consumer reporting agency, if the person knows, or has reasonable cause to believe that the information is inaccurate. crosscheck responded that it needed me to supply them with more of my personally identifiable information in order to process this request. There is enough information present in the complaint for them to respect my right to privacy guaranteed to me by the aforementioned statues and laws. Instead of respecting my right to privacy, CrossCheck is making me jump through hoops. I do not want them having my information, sharing my information, nor will I be voluntarily supplying them with any of my information. To expedite this process, you can find my ID attached to the complaint. Please note, I am doing this under duress, and if my request is not swiftly met with the requested action, I will pursue every penalty under the law. I wrote a check at my optometrist for glasses and they ran the check through Cross-Check for verification. The check came back declined, not for lack of funds, or bad check history, but the optometrist thought it was because the check number was too low. There is more than sufficient funds in the account. I contacted Cross-Check and you can not get a live person. I filled out a request for a credit report and reason and the report came and said : " Cross Check has detected no negative data regarding you or your check writing history. In addition, CrossCheck did not access any other source in evaluating whether to approve your check. Rather, in this instance, CrossCheck decided not to bear the risk of your check 's dishonor based solely on industry parameters that CrossCheck established. " This basically said that the industry parameters are their own and the declined the check because they felt like it. If it is indeed because the check number was too low ( although they did n't say so ) what should I do, throw out all my checks and start at XXXX? They have not given me a reason why I was forced to use a credit card. Will this random and arbitrary event happen again? This is outrageous. It 's also embarrassing to be told in public with lots of people around that your check was declined. They should not be able to make this determination without a real reason.

In XXXX of 2017 my son purchased a car from XXXX XXXX XXXX in XXXX . Before my son went to the dealership to purchase they sent him to XXXX XXXX in XXXX to take out a bank account that the down payments were to be sent to. At the time of purchase the salesman collected from my son a blank check for {$2000.00}. We asked what this was for and he said do n't worry about it it is just a formality. The salesman said the down payments could be broken up in payments to XXXX XXXX to make things very easy. This sounded very good to us. All of the paperwork was signed and he left with the car. No word from anybody until a collection company started calling both my son and me to get the {$2000.00} for a company called cross check. he did not know what to do but gave them a debit card to get {$500.00}. I intervened when they wanted to get another {$750.00} a week later and they started calling me repeatedly. I told them that there was no problem in paying the remaining {$1500.00} but we did not even know who we were sending it to. I told them we were more than happy to make payment arrangements but instead XXXX the vice-president kept calling me a liar and yelling and demanded the full amount that day. The most disrespectful person I have ever talked to in my XXXX years.

A company called " XXXX '' attempted to take {$200.00} out of my checking account. In addition they attempted to take {$25.00}. These attempts were made simultaneously. Two weeks later I started receiving calls from XXXX XXXX XXXX XXXX at my job and the caller claimed that they were attempting to collect a debt. I immediately asked for the details in writing and they stated that they had sent a letter. They had not. Each time they called I requested the details in writing. They claimed they sent it. I told them if they could not send it in writing, that I did not believe they were a collection agency but a scam. I asked them to stop calling me. They continued to call me every day for weeks. On XXXX/XXXX/15, nearly two months later, I received a letter from XXXX XXXX XXXX, a unregistered collection agency claiming I owed a company called CrossCheck, Inc. the {$200.00}. I have never done business with CrossCheck, Inc. XXXX Louisiana Revised XXXX XXXX requires collection agencies to be registered. ) I have sent them a dispute letter since receiving their letter. I have a company called XXXX XXXX XXXX from Floridaphone number XXXX threatening me with filing a felony check fraud charge against me. I had a XXXX and missed a lot of work and I requested to set up payment arrangements. The caller, named XXXX was very rude to me and told me that I had no business in a car lot buying a car that I could not pay the down payment. My XXXX obviously was not planned and they have been very rude to me. I asked to speak to another person than her because she was being so rude to me that she had me in tears, I spoke to another woman who I agreed to pay half of the amount owed this paycheck and the other half in one month, because they scared me with threatening me with fraud charges. I felt like my rights were being violated because I know you can not threaten charges against someone and then she began to recite the law in Texas for checks, this is a check guarantee company and I 've asked for an address for the company which they will not give me so I can send them a letter stating I do not want to be harassed anymore.

On XX/XX/2019 I wrote a check to XXXX and it was cleared through their system that the funds were available, as I was getting a {$3000.00} loan to cover the check that I was writing for {$2500.00}. I attempted to logon to their site to set up a payment plan to settle this, however it didn't work. I then e-mail saying my account was showing invalid. Well my elderly mother does not drive and has a Texas Valid ID card with no expiration date. Why is their system not set up to process these types of transactions. That is age descrimination. We were at an eye doctor when this transaction took place. I had the bank on the other line clearing the transaction and Cross check customer service called by the merchant and cross check could not comment on the transaction until it was submitted in writing. Well I did just that and got a response that it was due to no Drivers license. This is wrong incorrect fair Credit reporting against the elderly. My check was denied at a merchant in XXXX, VA due to a financial monitoring company, " Cross Check, Inc ''. When the merchant checked with the service, they said my check number had already been used. The merchant knew me and let me pay with the check. I called the Cross Check number and the only option an automated system gave me was to file a complaint online, by mail or by automated phone line. My bank account showed the last check issued and it was not the check number being used and the bank balance was fully funded. I had a check that bounced and but when it was re-deposited it cleared. A company by the Name of Cross Check assessed a fee. They have put a tag on not only the account that the check was written on, but also my other checking account.
