On XX/XX/XXXX I received a letter ( attached hereto for reference ) from Creditors Specialty Svc XXXX Inc. ( " CSS XXXX '' ) alleging I owe {$1700.00} for a debt to a third party. The debt is well out the statute of limitations in XXXX and the creditor may not use language in its correspondence to imply litigation remains a possibility. XXXX v. XXXX, XXXX ( XXXX ) ( " If the debt collector uses language in its dunning letter that would mislead an unsophisticated consumer into believing that the debt is legally enforceable, regardless of whether the letter actually threatens litigation, the collector has violated the FDCPA. '' ) Here, the debt collector CSS XXXX has " extended to you the opportunity to take care of this delinquent account voluntarily. '' This falsely implies that payment can be compelled through involuntary means, i.e. litigation. The letter states it may rely upon " avenues of legal collection procedures '' to enforce the alleged debt. An unsophisticated debtor would naturally assume CSS XXXX is not making reference to " legal '' procedures as opposed to " illegal '' ones but, rather, that " avenues of legal collection '' refers to a lawsuit. Finally, CSS XXXX letter refers to " attorney fees '' and " court costs '' though there could be no such charges allowable in connection with the alleged debt. CSS XXXX letter is further in violation of 15 U.S.C. 1692e ( 10 ) because it states " YOU ARE IN DEFAULT ON YOUR PAYMENT ARRANGEMENT '' which is false and misleading. CSS XXXX either knows or should know that there are no payment arrangements with regard to this particular debt and indeed ANY debt with regard to the entire portfolio of the business on whose behalf CSS XXXX ostensibly is collecting. Finally, the bogus interest charges of {$880.00} are illegal under California for a variety of reasons. This debt does not involve a loan, which would permit a lawful interest rate of up to 10 % per year, which the applied interest rate would exceed in any event. Nor does this debt involve a purchase of goods or services on a contract which would permit the collection of interest subject to the debt collector 's having proven that such fees were both reasonable and necessarily incurred. Nor is this alleged debt even reduced to judgment, only after which would a creditor in XXXX be permitted to charge 10 % per annum ( which, again, the interest charges in this matter exceeds. ) Finally it is noteworthy that this creditor has been sued on numerous occasions in both State and federal court, with one federal court noting that this collector is not properly licensed. This debt collector not only lost these cases, but very recently filed for bankruptcy protection within two weeks of its owner XXXX being compelled to appear in Court to answer questions about his own assets in order to collect the judgments in lawsuits against the company. Interestingly, this debt collector does not even appear to be forwarding the money to the companies on whose behalf it purports to collect as they they appear as creditors in the bankruptcy proceeding. Because XXXX and CSS XXXX continue to engage in perfidy in connection with the bankruptcy proceedings, a receiver and an injunction was recently sought against XXXX and his various alter-ego debt collection businesses. The " debt collection '' practices set forth above cross the line into criminal fraud and RICO. XXXX and his companies enjoy the automatic stay in bankruptcy, which conceivably prevents debtors who are victimized by these continuing acts from suing to stop them. It is therefore imperative that the CFPB take some sort of remedial action in this case.

I was sent to XXXX for an XXXX on XXXX/XXXX/XXXX, by representing counsel, after being involved in an auto accident on XXXX/XXXX/XXXX, and was informed by the attorney that if I did not win the case, I would not have pay anything. I received one statement for an overdue account from XXXX in the amount of {$3000.00} in XXXX XXXX. I contacted them to inquire why I was receiving this bill, and provided them with the termination letter from the Law Office, indicating that no money was received from the law suit, per their request. In XXXX XXXX, I received a letter from Creditors Specialty Service , Inc., requesting the amount of {$5200.00}. XXXX XXXX ( CSS ) also contacted me at my job, demanding payment and a call back immediately, threatening to garnish wages and to put a lien on our property. I contacted XXXX XXXX ( CSS ) on XXXX/XXXX/XXXX and requested that she stop calling me at my place of employment. On XXXX/XXXX/XXXX, I spoke with XXXX ( XXXX ) and informed her that I was never given the opportunity to pay this debt, to make payment arrangements, or to utilize my personal medical coverage to resolve this issue, and informed her of the amount that CSS was attempting to collect. XXXX called me back within the hour on XXXX/XXXX/XXXX, and stated that after talking to her supervisor, they felt that CSS was attempting to collect too much for the debt, and she and her supervisor XXXX would be contacting CSS to inform them that the total amount that they could collect ( medical expenses/fees ) would be {$1000.00}. On XXXX/XXXX/XXXX, XXXX XXXX ( XXXX ) called me at home, and attempted to collect the debt. I informed her of the modifications made by XXXX ( which she initially stated she unaware of ), and demanded the payment in full for {$1000.00}. I informed her that I would be willing to make a payment arrangement with CSS ( per XXXX, this would be an option ), and was told that I could not make any payment arrangements, and that I could pay for the debt in full using my XXXX credit card, when she indicated she was looking at my credit report and could see the available credit to use. In addition, she made threats on both occasions to take me to court, and report to credit bureaus. I did not authorize CSS to access my credit report, and feel that this is a violation of my privacy.

Received notice of attempt to collect a debt ; performed due diligence and called the agency to dispute the debt ; the Debt Collector then communicated that there was a mistake it was a different Company who was seeking a collection. I explained that the company had been partially paid because due to incompetence on their part a larger debt was incurred and via email had been notified that unless the credit card payment was returned the matter would be considered closed and paid in full ; the collector then verbalized that, that could only be done via a check as payment, then threatened to have me served tomorrow at my address ; I then communicated that, that was illegal as I had not even received proper notice and the opportunity to dispute the debt based on my documentation, the debt collector then began to belligerently insist that there was going to be a suit filed tomorrow, that I was going to be served at my residence, he was going to file the suit before I had the 30 days to dispute the debt ; even thought this particular company had the wrong debt attached to my name. When I informed the debt collector that such actions could not be taken until proper notice was completed and the my right to dispute the debt process completed a law suit could not be filed. The collector kept taunting saying Oh are you upset now when I repeatedly communicated I was not upset that I had just been to XXXX again belligerently trying to have me become emotional he told me to go back to XXXX and practice that XXXX stuff ; XXXX XXXX communicated that his boss wanted to speak with me, I again verbalized I knew my rights and recompense under the law to the second debt collector who did not give me his name much of the same belligerent threats of filing a lawsuit ensued at which time I repeated that I had not even received proper notice he kept repeating he was going to serve me tomorrow if he wanted to and the debt would be over {$500.00} by then, I repeated I knew he was not within his rights to do so until proper notice, and my response process was complete he hung up the phone.

there was so many that applied on the above I just picked an action, This company has reported to my credit, made threats and continues to pull my credit with a hard inquiry almost monthly, and they keep re reporting the debt which the credit bureau has to keep removing, they are a thiurd party collection collecting on a debt that is past statue of limitations, and the very rude lady asked me if I was illiterate when I advised that I knew my rights through the CFPB, and FDCPA she told me that she can report for 7 years from the date she receives the file, and advised me I was uneducated, then reported to my credit and then reported to my wife 's credit when she was advised that the account was included in a bankruptcy and she was violating those laws also this company 's unscrupulous attincs have not stopped and they again pulled by consumer credit bureau in XXXX days apart, they also tried to re report again but it was blocked by my credit monitoring which I had to add cause of there actions which is costing me additional money to fight them at this point I would like you to get involved and put a permanent stop to this, and levy the fines and penalties that are warranted under this broken practice laws the company is Creditors Specialty Serv XXXX Ca XXXX XXXX address XXXX XXXX XXXX XXXX XXXX Ca XXXX Ph : XXXX and they call multiple times a day from XXXX both mine and my wifes phones and are VERY demining Oh and she re reported me as a " skip Can not locate " 24 hours after calling me Uneducated " and I have screen shots from my credit monitoring service the current report dates are XXXX, XXXX, XXXX, She called on XXXX at XXXX and I hung up on her when she called me uneducated and she called immediately back at XXXX She called at XXXX at XXXX and this was the call that she reported me Skip can not locate after, this is all documented and has caused my wife and I stress and hardship and financial damages, PLEASE intervene

I received a telephone call today around XXXX on my cell phone asking for someone other than me. I explained they had the wrong number and then they stated that they just received my number and then said my name. This automatically put me into a panic because they originally had asked for someone else. They never once stated their business name only stating that they were attempting to arrange financial arrangements for a debt from XXXX in California in the amount of XXXX $ and wanted to see how i would go about paying for this today XXXX/XXXX/16 Or they were going to report this debt on my credit and ruin my credit if this was not paid. I told them I would call them back because I 'm not aware of this debt. I called XXXX at XXXX and a man answered the phone CCS. I wa put on hold and then transferred to a rude man by the name of XXXX who kept saying your name is on the paper so you are responsible. my credit is not great but I 'm working on that and I find this unfair and also illegal because no one has the right to threaten you to get you to pay a debt from over 3 years ago. Re : Creditors Specialty Service, Inc. XXXX XXXX XXXX, XXXX , CA XXXX XXXX I was in a XXXX on XXXX/XXXX/XXXX for which I was not at fault. The other person 's car, ( the driver was not insured ), was towed to XXXX XXXX XXXX. That company said I was responsible for the storage in the amount of $ {$1100.00}. An attorney for my insurance company said I was not responsible. Creditors Specialty Service was asked to collect from me for XXXX XXXX XXXX. Creditors Specialty Service contacted me by phone and letter at least four times. They filed a claim in small claims court around XXXX XXXX. They did not show up in court and the case was dismissed. I received a letter from Creditors Specialty Service dated XXXX/XXXX/XXXX entitled " request for update. '' The letter implied that my credit would be denied if I did n't pay the {$1100.00}. I called Creditors Specialty Service and told them this was harassment. They said they would remove the case from their files. It concerns me that other people would pay the amount due because of the threatening nature of the letter.

Collector has called me and my family multiple times between XX/XX/XXXX and XX/XX/XXXX to attempt to collect {$840.00} for their client or their client was going to sue me for over {$2000.00}. This is stemming from a supposed auto withdraw I had set up with their client for {$60.00} every other week. They claim that last time they received a payment was XXXX. There has been no communication with me previous to this recent call barrage about owing this debt. They would not give me any details about the debt except the parent company 's name. The only arrangement I had like this was not with this company and satisfied some years ago. I also called the company, that I had this sort of arrangement with, on XXXX to validate that I owed nothing. When speaking with them today, I told them they either had the wrong person or this was just bogus. The representative I spoke with gave me the last 4 digits of my SS # but I would not validate that so she disconnected the call.

Original Creditor ( XXXX XXXX ) charging me for storage fees. I instructed tow driver to bring my car to the junk yard. He told me that a bill will be sent to my address. Six days later, i called in to ask if i can still get some of my things. To my surprise they informed me that i need to turn-in my title and i am charged for storage while title is not turned-in. I tried to explain no one have informed me, but they did not allow me and told they will place it to collection. I'am not aware about turning-in my title to them. If i knew it i should just turn it in on the very same night. They did not even called me or inform me, i just discovered it by accident since i need to get some of my things. It seems like if i have not called in, they will just keep on charging me storage. I 'm disputing the storage charges. I should not be charged. Proper information and explanation should have been initiated before any services have rendered.

XX/XX/XXXX, XXXX in XXXX, CA turned over my debt of {$1000.00} to Creditors Speciality Services ( XXXX, XXXX, OR XXXX, XXXX ). In XX/XX/XXXX, Creditors Specialty Services contacted me to collect the debt. In the meantime, I had already paid {$600.00} to XXXX because I did not know my account had been turned over to collections. Creditors Specialty Services instructed I could pay the remaining {$420.00} to them. On XX/XX/XXXX I paid {$420.00} over the phone with my debit to Creditors Speciality Services. I have a bank statement to prove this. As of XX/XX/XXXX, more than a year later, Creditors Specialty Services has not paid XXXX the money that I paid. XXXX is holding my car title hostage until Creditors Speciality Services pays them. After contacting Creditors Specialty Services, I have learned that their owner was fired for fraud and theft. Creditors Specialty Services is a fraudulent debt collector.

I need to complain about multiple behaviors. First and foremost, the debt was not owed! That said, they engaged in the the following behaviors : ( a ) Made harassing phone calls including threats and profanity ( b ) been unwilling to provide actual details about the amounts owed or from where the original debt arose from ( c ) offered no way to dispute the debt ( d ) said they were lawyers ( e ) never sent written information This firm is a set of crooks. There is not even an attempt to seem like a reasonable, honest or forthright firm. This is the kind of firm the CFPB was established to investigate and penalize. The firm is called Creditors Specialty Services , Inc. in XXXX California. They claim to be associated with the following attorneys -- XXXX XXXX There is no way to call them directly or discuss a dispute because they have no business other than harassment.

Since XX/XX/XXXX, I have received notifications from Creditors SpecialtyService Inc. Due to illness, I did not have the ability to address the debt or communicate with the collector. In XX/XX/XXXX, with my health declining further, I attempt with the help of my sister to resolve the debt. Due to other concerns with finances, my intention was to declare bankruptcy. The only communication ( see call log attached ) with a representative was made in late XX/XX/XXXX, who gave me what I need to do to resolve. All attempts since that phone communication have gone unanswered ( see call log ) and it appears that the company is either no longer in business or my have gone bankrupt. I need to resolve this debt and clear any cloud on title of jointly owned property with my siblings. I am ready to resolve the debt, but have no means to connect with the company to do so.

Creditors Specialty Svc of NV inc informed me that a car I owned was towed after I sold it, I told them I had sold it and they asked for proof so I called DMV and the representative told me that the towing company contacted the DMV to see who the past owners were and they also told me this type of thing happens all the time that they try to collect from any one who use to own the vehicle, they sent me documents that show that I indeed completed the release of liability. I called the collection company and told them the name of the person we sold the vehicle to but we still are receiving threats from the collection company and its been over 3 years since I received the first collection notice.

years ago they took all the money out of our account they after us with very harsh phone calls and we paired {$200.00} a month we agreed on an amount, after a few payments and I ask for their information proof of payments on their part they stop charging us. trough a judge order they took all the money we had in our account.
