Dear Sir/Maam : I am submitting a complaint with your department as a last resort. I have tried to work with XXXX, Credito Real Finance USA FKA AFS Acceptance LLC and XXXX for over a year to try to fix errors on my reports with minimal success. During the last year I have been forced to pay higher interest rates, higher insurance rates, been denied for credit cards and could not apply for a mortgage that I would have otherwise qualified to secure. They have ignored my request to provide me with the documents that their company has on file that was used to verify information on my account with Credito Real Finance USA FKA AFS Acceptance LLC Account #. They failed to provide me with payment status, dates and a contact person at Credito Real Finance USA FKA AFS Acceptance LLC. Both bureaus are reporting this account differently and we all know that's not possible. It has been over 30 days since I have requested a letter of verification from XXXX and still have not received the information, I requested on XX/XX/XXXX. By not verifying the information as accurate and providing a method of verification that I requested, under Section 611 ( 5 ) ( A ) ( i ) of the FCRA they are required to promptly delete that item of information from the file of the consumer. I have disputed the inaccurate and unverified information listed on this account multiple times with XXXX and XXXX with no success. Please help resolve this problem as soon as possible. Upon investigating my three credit reports, I was saddened to see that there were numerous errors on all three of my reports. I decided to file disputes with all three credit bureaus using what I thought was the right way of disputing errors on a credit file. I submitted numerous disputes online with all coming back as Verified as Reported and some with more incriminating updates added to my files. I have learned through trial and error that when you dispute inaccurate information on a credit file online you give up certain rights. You do not have important dates documented and most importantly you lose the right of the credit reporting agency having to show the method of verification. Shame on me, for not completely understanding the process and thinking the credit reporting agencies really care if the information is accurate, they just want to push the disputes/verifications through as quickly as possible. Disputes # 1 - XX/XX/XXXX, Dispute # 2 - XX/XX/XXXX and Dispute # 3 - XX/XX/XXXX were conducted online so if further verification is needed, I am sure XXXX can fill in the details. XX/XX/XXXX I Called Credito Real USA Finance FKA AFS Acceptance LLC at XXXX XXXX ) XXXX as instructed to do on my results dated XX/XX/XXXX ( Exhibit I ) and disputed the same account on XXXX credit report online. I called Credito in XX/XX/XXXX and talked to a person named XXXX to inquire about the charge off, the late payments and the delinquency date listed on my XXXX and XXXX credit reports. I also asked about title to my XXXX XXXX XXXX that was now paid off through my repayment plan. I tried to explain that the information they were providing to XXXX and XXXX was incorrect and they should remove the inaccurate information. I was transferred to the collection department and the operator told me the payments were late and they were not taking them off my credit reports. The operator told me to dispute these inaccuracies with the credit bureaus. I asked about the title to my car and I was told that it was sent to XXXX XXXX XXXX and that they did not have the title to my car anymore. Dispute # 4 sent certified letter XX/XX/XXXX and I received the results dated XX/XX/XXXX. " Verified as reported correctly ''. Dispute # 5 sent certified letter Requesting Methods of Verification based off the result from Dispute # 4. Sent letter XX/XX/XXXX signed for on XX/XX/XXXX. I sent another letter to XXXX, Certified Mail Return receipt on XX/XX/XXXX ( Exhibit N ), I included a copy of the letter I sent dated 1/23/21 and all supporting documentation I previously sent to them. I requested a Method of Verification Letter for my dispute of the inaccurate information Credito Real Finance USA FKA AFS Acceptance LLC has been listing on my credit files. I am absolutely, certain that Credito Real Finance USA FKA AFS Acceptance LLC Account #, I disputed, is incorrect and should be immediately removed from my XXXX and XXXX credit files. I exercised my rights under FCRA 611 ( a ) ( 7 ) to request a complete description of all methods used to investigate my dispute. I asked for a complete list of all documents and correspondences with Credito Real Finance USA FKA AFS Acceptance LLC used to verify Account #. I asked for a list of all names and contact information of employees spoken with at Credito Real Finance USA FKA AFS Acceptance LLC as part of this investigation. I explained to XXXX that I am asking for this verification because my credit score is important to me and I believe it is being unjustly degraded as a result of this account being reported incorrectly on my credit files. I requested that they not send me a template letter in response to my request for the methods used to verify this account. I explained that I expected to receive a response within 15 days of receipt of the letter, as stated in Section 611 ( a ) ( 7 ) or I expected Credito Real Finance USA FKA AFS Acceptance LLC Account # to be permanently expunged from my record. XXXX signed for the Certified Mail Return receipt letter I sent requesting Method of verification on XXXX. 15 days -- -- -- -- -- -- XXXX -- -- -- -- -- -- -- -No response Results dated -- - XX/XX/XXXX -- -- -- -- -- -- No method of Verification attached 30 days -- -- -- -- -- -- XXXX -- -- -- -- -- -- -- -No response XXXX Results Dated XX/XX/XXXX Received XX/XX/XXXX XXXX Confirmation # XXXX ( Exhibit O and P ). The result came back as We have verified that the item has been reported correctly. Nothing changed compared to the results fromXXXX except the address of AFS Acceptance LLC changed to XXXX XXXX XXXX XXXX FL XXXX XXXX XXXX FL XXXX. The reason that I have included this is because I sent out another letter to Credito Real Finance USA FKA AFS Acceptance LLC at XXXX XXXX XXXX XXXX, XXXX XXXX FL XXXX, the Address that was listed on my results dated XX/XX/XXXX ( Exhibit L ). The letter was returned back to me with wrong Address written on the envelop and a sticker from the US Postal Service stating, Return to Sender, No such Number, Unable to Forward ( Exhibit Q ). The FCRA Section 623 prohibits information furnishers from providing information to a CRA that they know or have reasonable cause to believe is inaccurate. Credito Real Finance USA FKA AFS Acceptance LLC was knowingly furnishing inaccurate information since at least XX/XX/XXXX ( Exhibit H ). I am submitting a complaint with your department as a last resort. I have tried to work with XXXX, Credito Real Finance USA FKA AFS Acceptance LLC and XXXX for over a year to try to fix errors on my reports with nearly no success. Please help me resolve this issue. I have been disputing Credito Real Finance USA FKA AFS Acceptance LLC Account # online, on the phone and by certified mail for over a year now. Both XXXX and Credito Real Finance USA FKA AFS Acceptance LLC have been violating the Fair Credit Reporting Act ( FCRA ) Sections 611 and 623 on numerous occasions throughout the past year. I have had to endure re-aging of my account by both XXXX and Credito Real Finance USA FKA AFS Acceptance LLC. The actual date of delinquency should be listed as XX/XX/XXXX which would make this account over 7 years old and should have been removed from my credit reports in XXXX, when I began disputing this account. I have had to endure a charge off appearing on my reports years after the account was being paid as outlined in my Wage Earners Payment plan. I have had to endure blatant disregard for the laws outlined in the FCRA and enforced by the CFPB. I have had to endure the embarrassment associated with being denied credit, ( credit cards, auto loans, personal loans, and even a mortgage ). I have had to endure higher interest rates, higher insurance rates and higher health insurance premiums. I have had to endure spending money on Certified letters only to have them returned to me because incorrect addresses are being reported on my credit reports. I have had to endure losing over {$55000.00} dollar in equity by not being able to secure financing for a house selling well below market value at XXXX. I must endure renewing my lease, that expires in XX/XX/XXXX, for another year, at a {$300.00} per month increase each month ( 25 % increase during our current Pandemic ). I must endure the sleepless nights, that have become a problem for me, since I have received the photo copied results without the Methods of Verification. I must endure the look in my daughters eye when I tell her that I can not help her with her homework because I must do the job of the CRAs and Furnishers of information to CRAs because they consciously violate the laws governing the Fair Credit Reporting Act. PLEASE help me get this derogatory, costly and very damaging account permanently removed from my XXXX and XXXX credit files. Thank You P.S. I financed a car from XXXX XXXX XXXX on XXXX XXXX XXXX on XX/XX/XXXX. They coached me to say the right answers to Credithos applicant questions and I never got a test drive of the vehicle. Also, I traded in a fully functioning XXXX XXXX XXXX with {$3000.00} cash for the down payment purchase of the XXXX XXXX XXXX. From the first day that I purchased the vehicle I had three problems with the vehicle that I notified XXXX XXXX XXXX about, and those problems were # 1, there were 2 bad struts on the car causing the wheels to wobble and drag diagonally as I drive forward, # 2, the wheel alignment was way off. The steering wheel was turned almost fully sideways while riding in a forward motion. # 3, I was missing the right rear turning signal and right rear reverse light. XXXX XXXX XXXX did not fix the lights until my first monthly payment was approaching and the other problems that were apparent the next day after I purchased the vehicle were not fixed. On XX/XX/XXXX, I made my first monthly payment on the vehicle to Creditho on XX/XX/XXXX. I took the car to get an oil change on XX/XX/XXXX, at XXXXXXXX XXXX on XXXX XXXX XXXX XXXX at XXXX XXXX XXXX XXXX. When I left the oil shop, I was headed to work and the engine went out on me on the e-way, but it was still able to ride only at a top speed of XXXX XXXX I immediately notified XXXX XXXX XXXX about the current circumstances of the vehicle, and I was told to take the vehicle to their partnering auto repair shop on XXXX XXXX XXXX XXXX called XXXX XXXX XXXX XXXX XXXX The mechanic that I spoke with told me that it would take up to 3 weeks before the car would be repaired. I returned 6 days later on XX/XX/XXXX, to check the progress and they hadnt even touched my vehicle at all neither had they ordered any parts for the vehicle at all. I then asked the manager that was sitting at the front desk for an invoice receipt for my car being in their shop and he refused to give me one as requested and told me that I have to get the receipt from the manager of XXXX XXXX XXXX named XXXX, so I took my vehicle back from them and rode it to XXXX XXXX on XXXX XXXX XXXX XXXX with the hazard lights on. I left the car with the XXXX XXXX XXXX on XX/XX/XXXX. I returned to XXXX XXXX on XX/XX/XXXX, to pick up my vehicle and they notified me that they were not going to cover my vehicles repairs under factory warranty because of pre-existing conditions. I was also advised by the manager of the XXXX XXXX XXXX Department named XXXX to take the vehicle back to the dealership that I purchased it from and have them fix the vehicle under their dealership warranty and that XXXX XXXX XXXX sold me a lemon. I then rode the car back to my place of residence with the hazard lights on. When I got home, I turned the car off and went inside my home to proceed in calling XXXX XXXX XXXX and let them know the status of the vehicle and the current situation at hand concerning the vehicle. I was told to bring the vehicle back to XXXX XXXX XXXX to work things out. The next morning, I got in the vehicle to take it to XXXX XXXX XXXX and the car would not start at all. I have an auto loan with AFS Acceptance and I am seriously concerned about the collections practices of the company and the treatment of their consumers. I will admit that I have experienced financial hardship for the last year and a half due to XXXX XXXX XXXX that has resulted in a loss and change of employment. I have recovered the vehicle after repossession twice ( XX/XX/XXXX and ( XX/XX/XXXX ), and have advised the company that I am working as diligently as possible to get back on track, although recovering a repossessed vehicle is very expensive and has placed me in more of a financial bind. As of today, I am now 31 dpd for XXXX and 1 dpd for XXXX, with a bal of XXXX. Due to my employers guidelines, I am not able to use my cell phone at work. I have verbally requested on multiple occasions that I would like for my cell number to be removed and that I can correspond via email, regular mail, or on my home phone. It should be documented that I have returned several emails, phone calls, and have advised when I could pay, following the company 's instruction to keep an open line of communication. After verbally requesting that my cell phone number be removed, this company continues contacting me multiple times per day, even after contact has been made with one of their representatives with my intent to pay. Multiple representatives advised me that they would remove my number, and I was even told on one phone call that they had to speak with upper management before my cell number could be removed. I was then advised that I would need to submit a written request for my cell number to be removed from my account. I sent a written request via email on XX/XX/XXXX and was told that my cell number was removed. From that day I have corresponded with the company via email and have returned calls when necessary. Today, XX/XX/XXXX at XXXX XXXX CST, I received a call on my cell from a representative named XXXX XXXX. I answered and simply asked why he was calling a cell number that I have not only verbally requested be removed but I have sent in a written request as advised. Instead of accepting ownership for the mistake, apologizing and disconnecting the call, XXXX began to antagonize me and stated that the account is my account and " whatever happens, happens ''. I calmly advised him that I understand that I am delinquent on my loan payments, but that there are guidelines that must be followed and I must still be treated with respect. I advised that I would be able to call him back to discuss the arrangements that were available. Upon calling back, I was transferred to a representative named XXXX XXXX that I have worked with in the past to recover my vehicle. May I add that when my vehicle was repossessed in the past I was well over 90 dpd with no payments made, and this is not the case. Today, XXXX said that there were no options available although I have advised that I would make another payment this month on XX/XX/XXXX. She states that there are no options available and that they will refer my account for repossession. I am now at a loss, I understand that there are collections practices that must be followed but I am truly trying to work with this company and am not receiving the assistance I need. I will admit that I have expressed my agitation with the harassing phone calls multiple times per day and that I have advised them that I know that there are guidelines that they must follow, I feel that this is why I am not able to get assistance and am now being forwarded for repossession once again.

These laws are to make sure that a level and fair playing field exist to protect American consumers from abusive reporting procedures on credit reports, as well as illegal and deceptive collection practices. On XX/XX/XXXX, I sent a letter to XXXX regarding a collection account listed as " AFS Acceptance. '' I had previously called the number listed, and this company 's name is Credito Real USA. In any case, I told XXXX in my letter, first, that they were reporting inaccurate information on my account concerning the name of the Creditor. I also asked for some validation/verification of this debt as I did not recall ever having an account with Credito Real USA. I emailed and spoke to Credito Real USA as I had also sent them the same letter I sent to XXXX. They responded. XXXX did not. On XX/XX/XXXX, Credito Real USA sent me verification materials, including my account detail. Both Credito Real USA and I sent copies of these materials to XXXX. According to the Creditor, I made my final payment on this account on XX/XX/XXXX. As XXXX XXXX website helpfully explains, the " 7 Year Rule '', which is the time an account can remain on a credit report, begins with the first late payment recorded on the account. According to the documents I have attached, Credito Real USA marked my first late payment on XX/XX/XXXX. They did not report any further payments after the date of XX/XX/XXXX. On XX/XX/XXXX, I sent another letter to XXXX, laying out the exact problems I just defined. On XX/XX/XXXX, I received a letter from XXXX dated XX/XX/XXXX, which states that after conducting their reinvestigation, they changed some details but are keeping the account on my report. Their updated information moves the date of the reporting to XX/XX/XXXX! Does that mean that this account has stayed on my credit report for ten years? I believe that both XXXX and Credito Real are committing fraud by keeping this account on my credit report. I did not major in math, but I can count seven years from XX/XX/XXXX ; the account should have been off of my report by XX/XX/XXXX, nearly a year ago. This is my last attempt to clear up this " misinformation '' without the use of the judicial system. Not only will I find it necessary to sue for actual damages and declaratory relief, but I will also have to pursue a fraud claim against both the Creditor and XXXX. No other Credit Reporting Agency has this account listed. Both XXXX and Credito Real should know better regarding the amount of time a Creditor can report an account on a credit report. This last hope to avoid litigation should be viewed as my " Intent to Sue '' letter, as per the rules of the FCRA. Both companies will also be responsible for my attorney fees. I have been consulting about this matter with a local attorney. I have yet to pay him a retainer as I hope to settle this matter out of court. I will also not hesitate to reach out to local journalists for whom I'm sure this will be a fascinating story, especially now during this pandemic, when many people have lost their jobs and may be delinquent on their accounts. At the very least, it will be an excellent lesson to the public about checking your credit reports often. And, just to make it clear to XXXX who tried to close one of my disputes by claiming that it was a duplicate, I have attached the two CFPB complaints cited in their Response to Dispute to prove this is not a " duplicate '' of any prior reporting, as the name Credito Real USA appears no where in either letter.

this complaint is in response to credit real USA previous response on complaint XXXX. 1.They stated that I did not enter into a credit transaction under the truth in lending which is false. They provided proof in the previous response with a contract that clearly says " Truth in Lending Disclosure ''. Which I was never given full Disclosure on how to exercise my right to rescind this transaction which a violation of 15 U.S.C 1635 2.They also stated in previous responses that they are not subjected to the FDCPA which is also false. 15 U.S.C. 1692A ( 6 ) states that a debt collector is ANY person who regularly collects or attempts to collect, directly or indirectly, debts owed or due or asserted to be owed or due another. this makes Credito Real a Debt Collector under the Fair Debt Collection Practices Act. So they are obligated to validate this Debt pursuant to 15 U.S.C 1692g. they are REQUIRED to provide these 5 contents upon initial communication. ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumers written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. 3.Credito Real USA also stated that this was not an credit transaction which is also false when 15 USC 1605 states the determine of a finance charge and it quotes " Except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended '' A Finance charge is only commuted when there is consumer credit transaction and under no other circumstanses. 4.Credito Real is an Financial Institution pursuant to 12 USC 1843K and is in Violation of 15 USA 6801 and displaying non public information that I wish to opt out of their system to provide information to the credit reporting agencies to resell my private information Credito Real USA has been using false information the entire time has now proven that they are in violation of Truth in Lending ACT, Credito Real has never provided any statue codes or laws to back up any of their responses and is committing fraud and now these responses will be use as exhibits to proceed in litigation

I received a car loan from AFS corporation on XX/XX/XXXX. I have been paying on loan regularly and on time. The monthly payments were around XXXX dollars a month. I paid almost XXXX dollars into the vehicle until, I lost my job XX/XX/XXXX in which I was with for over five years. I have been reaching out to the finance company in which I thought would be their for me. I was wrong, I tried borrowing the money I could not get any help due to my family members having it hard themselves. XX/XX/XXXX the vehicle was gone it was repossessed. I knew they would come and get it soon, but they took it like a thief in the night. I would have given them the keys, if they would have rung the door bell, because of the non payment. I had items in the vehicle in which the company never returned. I started receiving phone calls from my representation whom was XXXX XXXX then it was given to another individual by the name of XXXX XXXX. I was looking for a job everyday nothing, I even filed for unemployment in which, i received but found out I owed a over payment and that money, I was goingXXXX to receive was being paid towards that amount of XXXX dollars. I loved and worked hard for this vehicle to loss it. So after speaking with XXXX for a while it was then transferred over to XXXX XXXX whom I spoke with on a continuous basis. I even filed a complaint with the XXXX and we can to an agreement of {$3000.00} XXXX XXXX even agreed to it on the phone my boyfriend even heard him say it and after he agreed he hung up after hearing my boyfriend voice on the phone, he thought we were the only ones on the phone, I needed proof form another party. I later received an agreement settlement for {$6000.00} in which I never agreed upon so the XXXX closed the case. The vehicle was later sold at an auction, in which I was never informed of the auction date, time, or location. They never gave me the option of getting the vehicle back. I received a letter stating I owe XXXX dollars? How is that possible when I paid that much into the vehicle, time passed and nothing was said it only showed charge off on my credit report. I started cleaning up my credit report in which I hired a company to do, then I received a letter from XXXX XXXX XXXX a firm in XXXX, XXXX whom is representing AFS in XXXX, XXXX they file a summons against me. I was hurt and disappointed that this company received all this money and now this they are so dishonest. I responded to the summons but it was to the XXXX and XXXX I did not read full document. I was to respond to the court, after speaking with a lawyer, I responded to the court now am waiting on response. I have documentation from XXXX and the company. I may owe something but not XXXX dollars the loan amountt was only XXXX this make me feel humiliated knowing this company is lying against me. I sent Credito Real USA Finance written request for debt validation pursuant to 15 U.S.C. 1692g along with a cease and desist through ANY medium Pursuant to 15 U.S.C. 1692c ( c ). They failed to provide the 5 things required upon my written request. So I bought a car from a used car dealership in XXXX called XXXX XXXX XXXX. I purchased a used ( XXXX ) miles when I purchased 2018 XXXX XXXX. It was sold to me at XXXX and had the pretense that it was new and not heavily damaged upon purchase. The entire loan process was extremely shady, the company, unable to get me a loan, ran my credit a total of 12 times ( without telling me that they were doing so ) until they finally found a finance company, Credito Real USA who decided to loan to me. At a whopping 24.95 interested rate that turned my originally XXXX financed into an astounding XXXX, they hassled me for documents for proof of residence even after I'd signed all the paper work and they'd agreed to lease to me and when I couldn't provide it ( I am currently in a between situations as far as living, I am a XXXX year old, XXXX American female who is a college student and not extremely financially literate, they decided to put a GPS in my car, turns out I ended up having to pay an extra XXXX to put it in my car which was not stated in the contract or they would take the car away, knowing I was in a desperate situation, I had to pay the money. A few months go by and the car turns out to have been in an accident, and has several major issues wrong with it that prevent it from being driven safely. I go to the dealership and the car requires over XXXX in repairs to run properly and that wouldn't even come with a gaurentee that it would continue to run well in the future. So having no other option because I don't have XXXX laying around, especially after I just purchased what was supposed to be a new vehicle, but to have the finance company come reposess the vehicle. This of course is going to completely tarnish my credit for 7 years, and now I am in a horrible situation because of unethical business practices along with predatory lending.

We started a deferment process on a car loan on XX/XX/XXXX. We have never been late on this loan or asked for this. The form was sent to us on XX/XX/XXXX by XXXXXXXXXXXX who is a manager. The form was completed immediately through their XXXX signature process and sent back on XX/XX/XXXX. We called on XX/XX/XXXX to ensure that all was received. The cs rep said yes. We continued to receive calls about our payment even though we were told by the above manager and CS representatives that our payment was deferred for XX/XX/XXXX and not to worry. The calls continue to come. We called on XX/XX/XXXX again being told deferrment was in process but to call at end of month reassured once again not to worry. We were told that we did not have a payment due until XX/XX/XXXX. We called on XX/XX/XXXX asking for payment alarm to be turned off. It was turned off. Today XX/XX/XXXX we received a nasty call that we needed to contact AFS Acceptance about our account ASAP. We called and were told we owe the XX/XX/XXXX payment and that now it was going on our credit as late. We have had this car since XX/XX/XXXX and have paid its enormous interest payment every month on time. It is a 60 month loan at high interest due to be paid off next year in XX/XX/XXXX. These guys are very unprofessional and horrible with how they treat customers. The car dealer who sold us the car went out of business two months after putting us in this awful loan. We have followed everything they asked and they have continually lied to us. Our credit should not have anything negative at all since they messed a simple task up. I sent Credito Real an Affidavit of Truth signed with notary present XXXX or around XX/XX/XXXX via certified mail and green return receipt They replied with a letter and not another affidavit of truth. Pursuant to 15 USC 1602 ( l ), the definition of a credit card is any card, plate or coupon book or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. My Social Security Card was the credit card I used to administer this credit transaction in which a finance Charge was imposed on XX/XX/18. XXXX XXXX XXXX failed to follow federal Law 15 U.S.C. 1605 regarding a Finance Charge. 15 U.S.C. 1605 states that the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended, and imposed directly or indirectly by the creditor as an incident to the extension of credit. The finance charge does not include charges of a type payable in a comparable cash transaction. Credito Real Required me to put a {$4000.00} Cash down which is a violation of this section Also Credit Real USA has been collecting on this account that was Cleary already paid using my credit card ( SSN ) and still tries to collect on this account monthly As the original creditor pursuant to 15 U.S.C. 1602 only I can validate this debt and DO NOT validate this debt.

Back some time ago XX/XX/XXXX or XX/XX/XXXX I went passed a car dealership called XXXX XXXX with my at the time boyfriend who was trying to purchase a car. I was going to help him out with getting the vehicle but was unable to due to my credit not being the greatest. They gave another alternative of putting a big lump sum of money down and to my knowledge he nor I had all the funds to even meet their requirements for the down payment or loan. I never recall setting up an account and if an account was set up it was definitely had to be his responsibility because I was told I did not qualify. For some years now this company has been harassing me with phone calls threatening to come to my home and job for payments. I even on several occasions have told them do not call my phone anymore because not only will they call and hang up continuously without even saying anything. Their tactics are way too aggressive and have also called my family ... my older brother who I have NEVER lived with or used as a reference, they have called his wife 's place of employment and left messages for me on her phone, they have contacted my step dad who lives in XXXX and I reside in XXXX, they have called my mother, and at times that they have done so I would n't even hear from them. They have left messages that if I do not call them immediately they will issue a summons for arrest following a court proceeding. I surrendered a vehicle in XXXX of 2015. My balance was around {$12000.00}, and they sold the vehicle for just under {$5000.00}. With fees and interest, my account charged off and reported to my credit as me oweing a little over {$7900.00}. I decided to call them and see if I could pay a settlement amount to have the account satisfied. The customer service rep I spoke to, after over 15 minutes and several reps that could not find or assist me on my account, was very rude and kept telling me very incorrect information. She tried to tell me that my balance was actually over {$10000.00} due to the fact that the amount charged off, did not include any of my per dium interest accumulated during the life of my loan. I 've worked in the subprime lending industry and I know how simple interest loans work. But she tried to tell me that THEIR company charges the interest at the end of the loan, even though my contract did not state this AND my payment history did not reflect this. She tried to tell me that she would be willing to take off the {$2500.00} from the {$10000.00} she said I owed. This is an incorrect amount by my payment history, as well as the agreed upon terms in my contract. She was attempting to collect on a higher amount then what I owe amd lied to me on how their simple interest loans work. She refused to get me to a superior, stating she was the boss and there was no one above her.

This is an on-going issue with this company. I feel as though I am a victim of predatory lending. I have a DSI loan, where interest accumulates daily. I send extra funds in with my payment to reduce my balance so that I pay less interest over the term of the loan. This company never applies the extra money towards interest although my payments are current and often paid early. I called on XX/XX/XXXX and asked that the extra {$81.00} that was being held be applied to my principal balance. They stated that they would put in a ticket to accounting to have it applied. I got my next statement on XX/XX/XXXX. The {$81.00} was still unapplied and the extra that I paid on XX/XX/XXXX was also not applied leaving me an unapplied balance of {$110.00}. I called again on XX/XX/XXXX to ask why funds were not applied to principal, again, he stated that he would put in a ticket and give them XXXX hours. I called back today to check my balance and this is still unchanged. This company is ripping people off and collecting more interest than they should. I feel helpless, I can only call and take their word for what they promise and they never follow through. This is my second time reporting this company to the CFPB for the same issue. They need to be audited and investigated. This is definitely predatory lending. I have attached the statement that shows the monies not applied to the principal.

I purchased a vehicle 1 year ago the vehicle in the past 4 months now has been having start issues thinking it was something wrong with the car I spent money trying to fix it i then took the car to a mechanic shop who determined it was the past time sensor. I took the car to get a second opinion who also determined this. Following this consumer credit transaction, I understand I was to be informed that I have the right to dispute the validity of this alleged debt within 30 days AFTER the initial communication ( which is the contract they attached to my previous complaint ). They failed to include this information in this contract AND failed to send it separately in the mail stating I have the right to dispute this alleged debt. How where they able to assume the debt was valid? Well, according to FDCPA 15 usc 1692g # 3 ; it states that if a consumer does not dispute the validity of the debt within the first 30 days, the debt collector will assume the debt is valid. So, I am paying for things that are already paid for because they never made me aware I had the right to dispute the validity within the first 30 days. This is a breach of the contract due to the fact these MUST be included in initial communication ( the contract ) or sent separately to the consumer by law. Even if these debt collectors assume this debt is valid it does not mean anything because it is my right to refuse to pay an alleged debt and no court or judge can say I Owe it under any circumstance. On XX/XX/XXXX, I financed a car with AFC Acceptance LLC, aka Credito Real located in XXXX XXXX Florida. The amount financed, after me paying a {$3000.00} down payment, was around {$18000.00}. From the start of my loan, I have made XXXX payments. XXXX of the payments were double payments. There was also XXXX hardship deferments. The amount that I paid on my loan was {$18000.00} On XX/XX/XXXX, I contacted Credito Real to make a settlement and close out my loan. In my request, I offered a lump sum amount to pay and asked for a copy of my file to show my payments and what the balance due was on the account. Credito Real did not meet that request. Instead they emailed me to tell me to make a payment to bring the payment into right standing. I conta XXXX them XXXX more times regarding this via email. Each time, I received the same response. On the evening of XX/XX/XXXX, I called the Escalations and Recovery department. The representative told me that my balance due on the account is {$18000.00}. My monthly payments of {$410.00} are due on the XXXX of each month. I made a payment of {$500.00} on XX/XX/XXXX. I logged in to the website today that the extra funds I paid are in an unapplied account. They have done this on several occasions, this time I decided to call today ( XX/XX/XXXX ). I asked the representative to apply those fund to principal. He stated that he can not and I have to wait until I make the XX/XX/XXXX payment then they can apply to principle. Which is a lie because it has never happened with my prior payments. In addition, thats an extra 30 days of interest that I am being forced to pay on a larger balance and they are holding my extra money. I explained to him that this is unacceptable. I have a DSI loan, by not applying my extra to principle, more interest accrues daily, I pay more interest over the term of the loan and it takes me longer to pay off the loan. My Vehicle was repossessed in XXXX of 2021. I never receive the notice of sale as required by Florida law. Credito Real USA or AFS Acceptance whoever they are very deceiving and they're XXXX XXXX. They call non stop all day long from va5rious different phone numbers. They use Robo calls, they even call and stay silent and hang up the phone. They even have private delivery people to bring letters to my home. Not via USPS, it's hand delivered like I've been served. I've explained when I lost my job that I will be struggling to make payments. If they check my record after I stopped working that is when I fell behind. I do mu best at making payments, sometime doubling up in one month. However that is not enough for them. I even asked if I can break my payments in half to help me manage, but I was told no because their system doesn't recognize partial payments. I would still accrue interest fees until the payment is made in full. On top of all of that my interest rate is over 24 %. That alone should be illegal. I tried to refinance to have lower payments and get them off my back, but due to the way they report to the credit bureau 's has my credit all messed up. I just want them to stop.

I was returning a call from my auto company AFS acceptance, I informed my rep XXXX that I needed to make the payment on the last Thursday on the month I just started a new job and my pay dates are off now. I hope with my taxes I can get my payments back on track and not pay late any more. I financed a vehicle through AFS on XXXX/XXXX/2014, with a loan agreement of {$13000.00} owed at a 19.95 % finance rate. I made 16 payments on this vehicle, totaling close to {$7000.00}, and was in a car accident and the vehicle was totaled. My insurance company paid AFS {$10000.00}, making the total amount paid on this loan over {$21000.00}, with it being reported that over {$6500.00} was paid towards interest. I paid off this vehicle in 16 months when it was a 50 month loan and it specifically states in the documentation that there is no penalty for paying off the vehicle sooner. Given the fact that I made payments of {$400.00} each month, for 16 months always on time and the total paid by my insurance company being over {$10000.00}, AFS charged me a finance percentage rate of nearly 50 %, when it should have stayed the 19.95 per our contract. I am owed at least {$3500.00} according to their own record keeping and contracts I had signed when purchasing the car.

Credito Real USA is reporting a debt on my consumer report. I disputed the debt, in which they responded to me advising that the debt is owed. In XX/XX/2019 I co signed for my daughter to obtain a car loan. The dealership put my name first and I requested it to be fixed-it wasn't. Fast forward a few months, I declared bankruptcy and included my daughter 's vehicle loan after consulting with my attorney. Credito Real would call me if my daughter was late on her payments. I purchased a car from AFS Acceptance approximately 2 years ago. After numerous conversations with them and some unethical statements said to me by their retention " specialists '' I chose to do a voluntary repossession. The account has been closed and they have done a " charge off '' on the account. the previously complaint that was submitted on XX/XX/28 addressed a new issue after the arbtration was over. This is a new matter and I demand the accounting on this account to prove that I was late.
