Complaint Description : Illegally charging late fees each month when payments are made on time ; billing error not resolved since XX/XX/XXXX. Approximately in XX/XX/XXXX my clinic XXXX XXXX opened a loan for me to finance a XXXX XXXX in the amount of {$1900.00}. The loan contract was submitted and an account was opened ( XXXX ) but the treatment did not start until a month after the loan paperwork was signed so XXXX XXXX contacted HCS to cancel the loan XXXX and opened a 2nd loan XXXX to replace the 1st due to treatment start date. This company DUPLICATED my loan and I ended up having 2 loans for the same amount ( XXXX and XXXX ). The correct contract was XXXX and had a 1st due date of XX/XX/XXXX for {$77.00}. In XX/XX/XXXX I had an add-on to the loan since I had additional treatment. This 2nd loan was for {$870.00} and acct # XXXX was created for this loan. I received 2 bills in the mail so I made one payment on one bill and when was getting ready to pay the 2nd one ( thinking was the 2nd loan I had ) when I received a 3rd bill. I then realized they had DUPLICATED my XXXX XXXX loan ( {$1900.00} ) so now I had 2 loans for {$1900.00} and one for {$870.00}. I then stopped paying until they closed the duplicated loan to avoid confusion. XXXX XXXX tried to close the duplicated account for 2 months until HCS finally closed it, they said they kept telling them to close it and they failed to do it. By then, both my accounts were past due as I had stopped paying until this matter was resolved. Once it was resolved, I paid both accounts current and asked them to refund late fees on both accounts due to the duplicated account they failed to close in a timely manner. They refunded late fees since I had paid the number of payments due minus late fees. To my surprise, they did credit the late fees BUT for some reason they accounts were still showing past due, each month the past due amount varies. I kept making my payments on time and every month I paid ON TIME they still charge me a {$35.00} late fee on each account. I've spoken to them 3 times as I started to get collections calls and letters and I explained all late fees were removed on BOTH accounts and on XX/XX/XXXX I made my number of monthly payments due to bring the account up to date, so WHY is it showing " past due '' each month? coincidentally sometimes it shows the past due amount is {$70.00} which are 2 late fees together which were already refunded ... I asked but they could never give me a response. They kept telling me they would send my account to another department for review and to fix any issues as they agreed with me, the account should be showing up as current as it was current, and someone would call me back ... NO ONE ever called me back. It's been a nightmare since XXXX when I paid current, they keep charging me $ XXXX/MONTHLY on " late fees '' on BOTH accounts. I am tired of asking them to review my account, review my number of payments for them to realize I have made ALL the number of payments required to bring the account current AND I have been credited all late fees so the accounts SHOULD be current in their system, however, their system is not working correctly and they are still charging a late fee each month when I continue to make my payments on time. At this point I feel completely ROBBED by HCS and I have notified them I refuse to continue to be abused and robbed as they have failed to fix their computer system/billing problem and failed to review my accounts and correct it. For example : ACCT # XXXX : XXXXst due on my 2nd loan was XX/XX/XXXX. I paid current in XXXX ( made 2 monthly payments together ). They refunded 2 late fees. Acct should be current. But on both XXXX and XXXX statements, it shows {$70.00} past due plus {$35.00} late fee ... I again just paid my monthly payment {$81.00} in XXXX and in XXXX. XXXX statement now shows {$100.00} past due plus {$35.00} late fee. This is unbelievable!!! ACCT # XXXX : 1st due XX/XX/XXXX for {$77.00}. This one of the duplicate accounts. Paid {$20.00} in XXXX and paid 3x {$230.00} on XX/XX/XXXX, totaling 3 monthly payments. XXXX and XXXX statements say {$70.00} past due and {$35.00} late fee, this never stops!!! In addition to all this, their statements are confusing as they do not mention the date I made a payment, it only shows a payment was made and the amount but they fail to write the date on it. This is also very confusing to the consumer as it is hard to determine or " see '' if they were right to charge a late fee if it was past the due date but not seeing the payment date and only seeing the " late fee '' charged is deceptive and shady on their end, offering only limited information to the consumer leads to abuse, as they can say whatever they want as to when the payment posted but they fail to show the payment date in writing on the statement.

I was originally set up on auto payments through the HCS Loans website, however their system routinely failed to pull the money out on the due date so in XXXX I manually made my payment and withdrew from their auto payments. Despite their system failing to pull funds as scheduled I made all of my payments timely or within the 3 day grace window, my due date is the XXXX of every month. I was originally contacted by a collector on XX/XX/XXXX that once I explained that I have made monthly payments they are just being made early he ended the call. Since deciding to manually make my payments I have been paying at the beginning of the month. They are telling me now, XX/XX/XXXX, that their system can not recognize the early payments correctly and that I need to make two payments in XXXX to get caught up because their system reads my XXXX payment, XX/XX/XXXX, as an XXXX payment even though it was clearly made in XXXX and the XXXX payment had already been made. The representative transferred me to a manager who said that they could not credit the XX/XX/XXXX payment as a XXXX payment because the XXXX billing cycle was still in affect when i made that payment and that I need to make two payments to get caught up. The representative and manager both agreed that they could see monthly payments but that my XXXX payment came in to early so it can not be reflected as a XXXX payment. I told the manager that I would happily go ahead and pay my XX/XX/XXXX payment if they would go ahead and have their system recognize the XXXX payment as a XXXX payment or as not due. She said that they could not do that. She said that I am now being charged late fees ( even though the payments actually came in early ) and my account now reflects interest charges which per my contract it should not. I am waiting on a reply from a higher up manager but was told that it can take a while and that they will not make their system reflect the XX/XX/XXXX payment as a XXXX payment. They are crediting it as an extra XXXX payment. I also offered to from now on wait until at least the XXXX of the month to make payments to be sure that the billing cycle for the previous month was over. However the first representative told me I needed to wait until the XXXX and the manager said the XXXX but that the XXXX billing cycle ended the XXXX so they dont seem to know when their billing cycle ends. My payment history per their website is below. They are now, XX/XX/XXXX, telling me that even though the payments are clearly made monthly that I am behind because my XXXX payment was too early to be credited as a XXXX payment. They are trying to collect an extra payment from me even though I have made a payment every month and are now trying to charge me additional fees on top of that. My first payment was due in XX/XX/XXXX. Payment history per their website : XX/XX/XXXX {$170.00} XX/XX/XXXX {$170.00} XX/XX/XXXX {$170.00} XX/XX/XXXX {$170.00} XX/XX/XXXX {$170.00} XX/XX/XXXX {$170.00}

I have a an installment loan with HCS Loans, XXXX XXXX. XXXX XXXX, XXXX, NC XXXX for services from XXXX XXXX XXXX XXXX. I have a promotional loan of {$110.00} per month, for a total loan of {$3100.00}. The promotion expires on XX/XX/XXXX. I began making payment in XXXX, XXXX. My payments are made through my bank, XXXX XXXX, Georgia. As HCS will not provide electronic banking information for electronic ( ACH ) payments, I have my bank process a timely check for payment. I have requested this information from HCS, but they have advised me that they want MY bank account information for autopay, and I won't release that confidential information to them. For the XXXX, XXXX payment, I had confirmed that XXXX mailed a timely check. On XX/XX/XXXX and XXXX, a representative from HCS called me to inquire about my payment. I had advised them that my bank made a timely payment by check. The representatives, both on recorded lines, advised me that it could take 7 to 10 days to credit my account if payment is made by check. They noted my response to them in my account log. On Monday, XX/XX/XXXX, I had received 2 calls from HCS about my XXXX payment. I confirmed with my bank that the payment was sent on XX/XX/XXXX. HCS recorded my statement that day. On XX/XX/XXXX, HCS called me 4 times inquiring about the same payment. Upon my investigation, HCS received it on XX/XX/XXXX ( the due date ) and deposited the check into their account with XXXX XXXX XXXX. The check clearly has my account number, name, and address on it. In my final call that day to XXXX, I was advised to provide them with a copy of the cancelled check, both front and back, and fax it to them at XXXX. I faxed it immediately to them. On Saturday, XX/XX/XXXX, I received my XXXX statement from HCS, and it indicates non-payment for XXXX and a late fee of {$35.00} added to my account. I had advised HCS in an attached letter when I provided the copy of the check that I will no longer endure any further harassment from them and if they want an electronic payment, they must provide me with the XXXX XXXX XXXX account number and ABA/Transit number promptly. All of my account payments and debts are paid timely through my bank, and without incident, so this insane process must stop immediately.

Total amount balance at time XX/XX/XXXX XXXX was {$15000.00} of which cash of {$7500.00} was paid. On XX/XX/XXXX I took the above loan to pay the difference. I received a loan with HCS, Health Credit Services through XXXX XXXX. On XX/XX/XXXX I paid the loan off before the promotional period by {$690.00}. I realized my mistake and called to get this resolved. I was told that the payment had to be validated and this could take up to 60days. I called back again and was told that the loan batched on XX/XX/19 and was sent to account to get a check cut to me. I called several times before and was told t hat I was given incorrect information. The funds had to be validated and then I would get a check which could take an additional 60 days. I have asked to speak with a manager, accountant and no one has returned a call or tried to resolve this issue. I called last week and was told the amount of my overpayment had been validated and a check would be mailed. I called again on yesterday XX/XX/19 and was told yes the funds have been validated but this transaction has to batch before a check can be mailed. This process is ridiculous and unfair to me as the borrower. There is no reason a company should hold anyone refund for over 90 days with no date as to when it will be returned.

In XX/XX/XXXX I made a payment for my loan. The company is trying to claim it got declined, but I had the money removed my account and not returned. I have made a payment every month to them ; on two accounts they took two payments when I authorized only one. I had one of each of those returned, but the other payment remained active. I was told BY THEM that I had to file with XXXX for a return, which they have the call recorded of me being told this. I did that, and now theyre claiming I didnt pay, when my banking accountant statements say otherwise. I went through my receipts every single month, and yes, there is a payment to them for every month. I have also sent them the evidence and required paperwork, but they refuse to acknowledge it. I do not owe them ; if anything, they owe me, and the EXTREME negligence in the handling of my debt needs to be handled by someone else, as obviously theyre too incompetent to do it themselves. I am harassed every month since by them when I do not owe them for an errant month.

I cancelled a loan in XX/XX/XXXX. I am to receive a full refund of {$5100.00} of money that I paid in to them. I have been going back and forth with this company and they say theyve mailed a check but now their corporate office is not sure if the check is mailed or not. They keep telling me to wait 7-10 business days and call back if I havent received. I was recently told it was mailed on XXXX and as I called today XXXX and spoken to a representative theyve asked me to wait another 7-10 business days and to call them again. This is money owed to me and its getting increasingly frustrating as I get disconnected multiple times only to reach someone who is not entirely sure as to whats going on. The companys name is Health Credit Services. I am reaching out here in hopes that there might be a resolution.

I received a denial for credit notice from XXXX XXXX in XXXX. I registered a CFPB Complaint on it as I never applied for credit with any one this year much less XXXX XXXX. In their response they noted they do the financing for a company called Health Credit Services ( HCS ). XXXX said HCS sent them a request for credit approval on my behalf. I have no idea who this company is and I have had no medical procedures in a year and half and that one is paid for. I have none scheduled this year and owe no hospitals, urgent cares, specialist or doctors of any kind. I have had 2 visits to my Primary Care Provided doctor and those were covered with my copay. HCS had no authority to request XXXX XXXX to pull my credit.

I was charged twice by Health Credit Services for a monthly installment on loan XXXX, but they never credited me for the double charge. They simply pocketed the money. I sent documentation of the deduction directly from my checking and attempted to follow up over several weeks, but they never responded. One customer service manager did mention that this appeared to have happened to a number of accounts, but she refused to say what, if anything, the company was going to do to fix it. The company is managing a loan for services rendered at XXXX XXXX XXXXXXXX. XXXX appears to be based in XXXX, North Carolina.

Paid off balance with the company. Was owed money by the surgeons office, they remitted this money not to me but to HCS. So, I contact HCS about them sending me a refund and was told it can take up to 60 days. Well, 60+ days later and they are researching. There is nothing to research, they owe me what came in from my doctor incorrectly.
