It is imperative that consumer ( XXXX XXXX ) file a formal complaint with the CFPB in responding to dunning letters sent by Credit Management of XXXX XXXX, Nebraska. Credit Management is known for filing judgments against consumers without waiting the 30-day timeline allotted under the Fair Debt Collection Practices Act ( FDCPA ). Credit Management of XXXX XXXX, Nebraska does not accept CERTIFIED MAIL with Return Receipts when sent to them as a verification of " dunning '' letters. Credit Management has a business practice of sending numerous dunning letters to the same consumer, with the same date ( XX/XX/XXXX ) alleging consumer owes several accounts ( Acct No. : XXXX XXXX XXXX ) with several reference numbers and several different amounts on one single account. This is unnecessary, redundant, and deceptive. This business practice equates unjust enrichment and fraud. In this consumers case the entity Credit Management claims to be collecting on behalf of the XXXX XXXX XXXX who received a Medicare and XXXX coinsurance payment as well as a co-payment from consumer. Accepting these payments renders consumers account with the XXXX XXXX XXXX paid-in-full. Consumer has a co-payment receipt to prove it! ( XXXX XXXX Receipt # : XXXX XX/XX/XXXX for {$35.00} dollars ). Anything over this payment is considered balance billing and illegal. ( See Sections of the Social Security Act [ the Act ]. 1902 ( n ) ( 3 ) ( B ) 4714. Attached to this complaint is a copy of a letter sent to the XXXX XXXX XXXX dated XX/XX/XXXX making it known that consumer does not owe anything. It is self explanatory and will satisfy any monetary claims regarding Credit Management 's involvement. Credit Management is known to pursue frivolous lawsuits and obtain unwarranted judgments without the knowledge of the debtor and with no basis at law. Credit Managements frivolous lawsuits are intended to get information, force payment through fear of legal entanglement or gain unfair or illegal advantage. Credit Management uses the legal process for illegal, malicious or perverted means. It is important that consumer use this venue to convey a strong message that consumer has rights and protection under state and federal law and that there will be serious ramifications if those rights and protections are violated. Consumers sole income is Social Security income which is federally protected income under the Social Security Administration Act ( SSA ) ; Sec. 207. [ 42 U.S.C. 407 ] ( a ). Consumer has a copy of consumers Social Security Award letter as proof positive documentation. Consumer has no attachable property of value. Please be advised : Under compilation of the Social Security Laws Section 207 [ 42 U.S.C. 407 ] ( a ) which states : the right of any person to any future payment under this title shall NOT be transferable or assignable, at law or in equity, and none of the moneys paid or payable or rights existing under this title shall be subject to execution, levy, attachment, garnishment, or other legal process, or the operation of any bankruptcy or insolvency law., whether consumer gives permission or not they do not have the authority to authorize garnishment of a federally protected account. Under Nebraska Revised Statute Section 25-1563.01. ; the same Supreme Court ruling applies in this matter as well. Consumers protected income presents a genuine issue of material fact that if a summary judgment is granted ( after receipt of this formal notification ) it shall be obtained through a deceptive, frivolous, abusive and harassing process that can garner monetary retribution for consumer. Consumer refuses to be a victim of unjust enrichment and extortive tactics. Consumer has no fiduciary or contractual obligation to a third party debt collector because there is no exchange of any benefit or detriment with ANY future collection agencies, junk debt buyers ( JDB ) or collection law firms. There will be no enforceable agreement. No payment history, nor products, or services has been rendered to such entities because these elements do not exist ; there is a 'failure of consideration ' and no valid agreement, contract or fiduciary obligation under federal law that requires payment to such parties. If Credit Management continues to harass, abuse or pursue consumer ( XXXX XXXX ) the Nebraska Attorney Generals Consumer Protection Division ( CPD ) ; and the Federal Trades Commission ( FTC ) will be notified as a prelude to a formal lawsuit against Credit Management, as genuine issues of material fact exist.

I received a letter from Credit Management in XXXX XXXX Ne, it was dated on XX/XX/XXXX and received the letter on XX/XX/XXXX, I called on XX/XX/XXXX to Credit Management requesting the documents of the statements of the charges happening sometime in XX/XX/XXXX and advised that I would like to have those sent to me so I could look and compare my bank statements and that the address and name is incorrect provided the correct information and then the rep gave me about 5 different dates and asked when did the credit management sent me out any information the listed off dates that they contacted me on phone but I never received any communication from them other that 1 year prior and called them and requested the same statements so I could verify the charges and if I paid them, I never received those the prior year, and the informed them how is that my fault when I never received the correspondents to review. I in the mean time contacted XXXX XXXX and they advised that they did n't have a outstanding balance and the XXXX hospital contact person never returned my phone call. I finally received the statements that I requested on XX/XX/XXXX with correct mailing address but incorrect last name, I was able to verify that the first charge that they were requesting was paid in full in XX/XX/XXXX by garnishment. the second charge was vague information and placed a call into the XXXX hospital and they returned a call today XX/XX/XXXX and that was verified that was not paid. made the payment to the Hospital and received a certified letter from Credit management today XX/XX/XXXX they placed a summons to my county court for that amount of both and explained that the first one is paid back in XX/XX/XXXX and the hospital was paid today and they stated to me that they will place a request in to XXXX XXXX to clarify and show payment and that the hospital one would need to be determined but I still owe them their attorney fees but I advised that the one was already satisfied and other paid and hospital did n't advised me to pay the credit management. and represented stated that its being submitted for review but filing fees was my responsibility. at no time or on the first statement they sent out did it give amount of time or on the documents that they sent out to me did it have you have xxx amount of days to pay the amount due or it will be pursued to court. Am I obligated to pay the court filings even tho 1 was already paid and never updated on their end and the second one was taken care of as soon as I received the information that I requested. oh this was all over XXXX which was safitifed back in XX/XX/XXXX and the other was XXXX and filing fees are XXXX.

Case No. XXXXXXXX XXXX XXXXXXXX. This limited action pursuit by the judgement creditor, Credit Management Services, has resulted in two garnishment occurrences, totaling over {$1200.00} and an automatic closing of my account # XXXX, by the garnishee, XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, Kansas XXXX. A letter in response to this non-earnings garnishment judgement communication was sent to Credit Management Services Inc. and received on XX/XX/2021 ( USPS CREDIT MGMT TRACKING # XXXX XXXX XXXX XXXX XXXX received by Credit Management Services on XX/XX/2021 ). This letter to the judgement creditor was an earnest attempt to discover the validity of this debt and if valid, the possibility of settling the debt. Specifically, the letter requested : 1. The name and address of the original creditor, the account number and the original amount owed. 2. Verification that there is a valid basis for claiming that I am required to pay the current amount owed, and if applicable, how the original amount owed is different than the current amount owed, at the time of the non-earnings garnishment. 3. Details about the age and amount of the debt including a copy of the last billing statement from the original creditor ; a detailed explanation of any interest added or payments made since the last billing statement and the legal authorization of this interest ; the date the original creditor claims this debt became delinquent. 4. Please also note whether this debt is within the statute of limitations and how that was determined. 5. Around XX/XX/2020 I contacted Credit Manage Services , Inc. of XXXX XXXX, XXXX to pay the balance due on an account they had received from XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX. I had been in regular contact with XXXX XXXX office manager, XXXX, about this account. She had decided it was a health insurance billing issue and told be she instructed Credit Management Services to hold all collection efforts until the situation was further investigated. Credit Management Services XXXX Inc by way of XXXX XXXX attorney filed a lawsuit agaist me for the aprox {$700.00} balance. I contacted the original XXXX XXXX and XXXX confirmed she instructed Credit Management to hold any proceedings. I contacted Credit Management via phone and as told, " yes we had got that information from the client, but we wanted the judgement anyway ''. I informed the debtor of this and she removed the file from the collection agency, although the collection company wanted fees. I called in XXXX to pay the fees of aprox {$130.00} to satisfy the judgement and clear the record. On that call I was informed that there was another account the had been placed with them for over {$37000.00}. I stated I had no knowledge of this account and requested they provide details via USPS so I could validate. I have no other communication written or telephone after that until I received a summon s from county court. The summon indicated Credit Management Services , Inc. was suing me for {$37000.00}. I have no opportunity to be informed of the alleged debt or request validation. I also have not been given the option to ensure the debt was validly passed on to the collection agency specifically not violating HIPPA laws. This is how the first case was handled too. It seem as XXXX XXXX is trying to operate as a debt collector but functioning as a attorney not adhering to FDCA. I can provide the summons and court documents if requested. Again they provided no notice of the debt, no opportunity to dispute or request validation and other actions required by federal law. I have filed complaints with the XXXX Attorney General, XXXX and will possible file a counter suit for violations. Consumer deserve protection from these unscrumptious attorneys acting as debt collects and not disclosing they are acting as debt collectors.

I had XXXX XXXX bills that with XXXX and at the time I was un-employed and actively seeking work. They could not work with me on payments and thus turned over to CMS ( credit management services ). CMS never contacted me properly and I contacted them after finding it on a credit report. I was willing to make payments but they would only take payment in full and nothing else. If I had the pymt in full it would have never went to collections, as I acknowledge I owe the debt. I tried a number of times to rectify the situation ; however, they continued to tell me pymt in full only. I was then subpoena 'd by mail ( with no date or time information ) at the end of XXXX 2014. I called them immediately and stated this was un-necessary as I am willing to make payments. Yet again, payment in full only. I then asked when was I to appear in court and they stated they could not give me legal advice. I stated this is not legal advice as I only want to appear to defend myself. The were of no help and quite deceptive. So I obviously missed my court date and then received a judgement against me at the beginning of XXXX. I called them the same day XXXX received the judgement and I found out that XXXX again the only thing they will take is payment in full and they already know where I bank and have a court order to garnish accounts. I really feel that this is highly un-professional as I am willing to pay, but I have not options to do this in full. They did give me a suggestion to borrow from family ; however, you see I can not do that as my family is small and on limited income. They also asked me to get a loan to rectify the situation, but you see I have no collateral do do a loan and do not have the credit to do an unsecured loan, either. This really puts me in a bad spot and I was willing all along to make pymts. I feel this company is extremely unfair, unreasonable, and quite un-professional in how they conduct their daily operations.

Today XXXX/XXXX/XXXX I received in the mail a notice that I owed on a debt ( pass due account ) that I have never been involved in or been the primary beneficiary of loan. I have never received any correspondence and /or notification in reference to this debt ever! Approximately 4 to 5 years ago my oldest son XXXX XXXX got a loan for a PU from a dealership and I was requested by dealership to be a reference to his loan. I specifically told them that I would not co-sign a loan as I was going through a divorce and was working on my own financial needs ... The paperwork was filled out at the dealership by the car salesmen ( not at the bank and not before a bank loan officer ) and I was told to sign just for a reference. Several months later my son lost his job and was unable to make his loan payment ... He made some type of arrangement with the dealership/bank to turn the PU back in to settle the loan ... ( That 's what he told me what happened and until today I have not heard/ received any correspondence/notification of any type from the bank/dealership or anyone else involved with this transaction. Now I 'm told by Credit Management of XXXX XXXX when I called them today. That I 'm the primary person on the loan and that I initially owed them {$4200.00} and with additional interest of {$4300.00} and need to pay immediately a total of {$8600.00} Or they will have judgment against me. Credit Management said they did n't know anything about any notifications from bank ( original creditor ) as the just bought this past due account in XXXX. I did n't even know there was a problem with XXXX XXXX XXXX and XXXX until I received the notification today. I feel XXXX XXXXl and Credit Management are after me due to I have a stable financial situation and I have more assets then my son. Where my son is still in the process of working on his credit score and financial health.

I disputed all/parts of the alleged debt owed and requested actual proof/documentation of the debt. Signed agreement with payments made. They responded to my letter and said after reviewing the debt they believed it was still owed. They did n't send me anything beyond that which makes it impossible for me to know if the alleged debt is accurate. They then filed a complaint in county court. I am responding to the complaint. This company recently settled due to collection practices on a class action suit. I feel they are still using questionable tactics. They now want not only the alleged debt but attorney and filing fees and that could have all been adverted if they would have provided me with the documents I requested but I believe they did that thinking they could make a little more money with this account by filing thinking I would agree to pay or a default judgment. I have dealt with them before and made an arrangement on a debt that they filed on that they provided me proof of so I think they thought they would get me to agree to this debt and the fees as well. Whether I owe the debt or not is not the issue ... the issue is I feel they filed to collect extra fees as I did n't make any arrangement with them because they failed to provide proof of the debt.

When my husband left me in XX/XX/XXXX, I struggled to survive. I had a dentist bill of about {$00.00} and a electric bill of about {$600.00}. A credit agency got a judgment against me I could not pay. now, just today in XX/XX/XXXX that agency garnished my wages for {$430.00} per month. I am a single mother and me and my XXXX kids will not be able to make it if they succeed in doing this to me. I have since that time rebuilt my credit and I work full time. I am making it by the very thinnest of margins. I checked the law and the Statute of limitations has long, long since past by years on this debt. The have it worked up to {$4000.00}. now. The garnishment is illegal. But the credit agency just does what it likes, knowing that I can not afford an attorney to protest this. They figure we can get away with it XXXX times out of XXXX and the worst that can happen is XXXX in a while someone will make us stop. Most cant. Me being XXXX. Why do these credit people just do as they please with no accountability? This collection effort is some 6 years beyond the legal statute of limitations. And I will begin to suffer the garnishment next week. I beg you to help. This is illegal and will devastate me and my XXXX kids lives.

Medical bill balance of {$370.00} from XXXX XXXX XXXX XXXX ( XXXX ) for service on XXXX was directly paid to XXXX by XXXX ( XXXX = XXXX Savings Plan ) on XX/XX/XXXX. Medical bill balance of {$22.00} from XXXX for service on XXXX was directly paid to XXXX by XXXX on XX/XX/XXXX. Medical bill balance of {$14.00} from XXXX was directly paid to XXXX by XXXX on XX/XX/XXXX. I have been furnishing documentation showing this to XXXX since XX/XX/XXXX. In spite of this, XXXX has sent these paid amounts to Credit Management Services ( CMS for collection. I have asked the Nebraska Secretary of State 's office ( NESOS ) for assistance by documenting these amounts were paid and should be immediately removed from collection and corrections made retroactively with all credit reporting bureaus. NESOS has done nothing other than pass correspondence from XXXX to me. Further, I provided proof of these payment on XX/XX/XXXX emailed directly from XXXX and gave CMS until Monday, XX/XX/XXXX to make the corrections showing these amounts paid, correct the information with all credit reporting bureaus and issue a letter of apology from both CMS and XXXX. I have yet to receive any response from CMS.

I was wrongfully charged by XXXX XXXX back in XX/XX/, and submitted Disputed Request. They ignored me, and then, forwarded a {$28.00} bill to the Credit Management Services for collection. The case with XXXX XXXX is still in dispute and I have contacted them numerous times to no avail, starting a lawsuit against them. I contacted this Collection Agency : Credit Management Services on XXXX XXXX, XXXX. The lady first fooled me into getting personal information. First, she asked for my birth date, which I provided un-suspiciously! Then when she asked what phone number to contact you, I figured it's their tactic to get enough information to be able to ruin my credit with the credit bureaus! When she figured that I am asking not to continue and I won't pay until the dispute is resolved with XXXX XXXX, she simply hung up! I am very worried that Credit Management Services having my birth date on their file, then will cause a lot of damages to my personal well-being, finances, and other damages I can think of. As a very minimum, I am requesting them to stop, and remove my birth date from their records.

I called today after never having gotten a bill since well ever I had been given a summons back on the XXXX tried calling to see whats up finally found out who and where this debt collector is credit management inc in XXXX XXXX nebraska anyways called today lady on the phone said I need to pay attorney fees which even in the summons states they can't collect ( I have it recorded if that helps ) after I asked she became real rude and back pedaled she also would not give me a straight answer just for the sake of asking I requested whatever the total amount would be she kept saying XXXX plus some amount she does not know which makes me really question how I should know if this is even a legit thing. Last of all I don't even recall going to this place they say I got treatment but yeah can they just hang over my head an undisclosed amount? I looked it up and seems like they really exist but there is multiple issues even a class action lawsuit against them for violating stuff.

I recieved notification from a bankruptcy/fair debt collection agency ( consumer protection ) that I was being sued in civil court. I have not recieved ANY notification of any debt that I had. I also haven't recieved a phone call of said debt ( I still have no idea the dollar amount or the nature of the collection ). I recieved a certified letter on a Saturday ( that I was not present for and my husband with the same last name was not allowed to sign for ). The only thing on the certified notification was the name of the debt collector ( credit management services out of XXXX XXXX, NE ) which was the same name was on the letter as the stated above letter from the fair debt collection consumer protection law firm. This debt has not showed up on my XXXX report or XXXX report. Whatever the debt is I would ( a ) like a certified letter explaining the debt ( b ) if it is a debt I owe like to settle it out of court.

In XXXX, I signed for a certified letter from Credit Management , Inc. In XXXX, I ended up paying off my debt through the doctor 's office. I recently received a letter letting me know that this collector is now garnishing my wages. I tried to work with the company, but they were unwilling to work with me. Garnishing my wages is going to cause me to lose my house. They have not reached out to me in over four years. They said they didn't have a good number or address for me. They were able to get my address from the court, and my phone number is online. They didn't try too hard to get in touch with me at all.

I was sued by Credit Management in XXXX XXXX. I am currently making payments as they threatened to take me to court for garnishment. I never received any notification in the mail about the debt, or court date. Was just serves with judgement to pay after the fact. Now they are sending my husband and I duplicate bills for the same amount, but different debt id numbers so they are trying to collect twice. My husband was making payments to them as well, but our local court dropped all claims and payments as they were found guilty of misconduct so it voided my husband of his debt and court costs
