I filed a XXXX XXXX Dispute on XX/XX/XXXX against creditor Credit Fresh. The reason for the complaint was that my account was reported as 30 days past due via XXXX for the month of XX/XX/XXXX, when the account was not 30 days past due. I set up a payment arrangement for the payment due on XX/XX/XXXX, to be processed on XX/XX/XXXX. The payment due on XX/XX/XXXX, was paid on XX/XX/XXXX. The payment due on XX/XX/XXXX, was paid on XX/XX/XXXX. I made an additional payment on XX/XX/XXXX for the payment due on XX/XX/XXXX with {$0.00} due or owing. All payments were made during this period were within 30 days and the account was not 30 days past due as all payments were made. An email response was received via the XXXX in response to this complaint on XX/XX/XXXX advising that the company ignored XXXX XXXX attempt to obtain clarification regarding the account. On XX/XX/XXXX, I received a notification via spam email of a service called XXXX XXXX for XXXX, having provided a report regarding a recent loan application that was made. I had never heard of this service, so I logged in and found that this service was a secondary credit report identifying credit line accounts and additional personal information on behalf of XXXX. Credit Fresh was the first account that was reflected in the report, and I immediately noticed that the information reflected in this report was 100 % incorrect. ACCOUNT NUMBER Account number reported on the XXXX XXXX Report is XXXX Account number reported on Credit Fresh Statement/Website is XXXX Account number reported on XXXX is XXXX. CREDIT LIMIT Credit Limit reported on the XXXX XXXX Report is {$0.00} Credit limit reported on Credit Fresh Statement/Website is {$3500.00} STATUS Status reported on the XXXX XXXX Report is " Collections '' There are no reported collections on any official credit bureau agencies . FIRST PAYMENT DATE First payment date reported on the XXXX XXXX Report is XX/XX/XXXX. First payment date reported on Credit Fresh Website is XX/XX/XXXX. FIRST ON-TIME PAYMENT DATE First on-time payment date reported on the XXXX XXXX Report is XX/XX/XXXX. First on-time payment date recorded/payment processed in Credit Fresh Website is XX/XX/XXXX. DAYS IN COLLECTION Account status on the XXXX XXXX Report is Collections of 682 days past due. Account status on XXXX XXXX XXXX is " XXXX XXXX ''. My draw capability was deactivated on XX/XX/XXXX, based on what they said was " payment history ''. I paid the account regularly and on-time within just the last few payments at that time, of which I never knew would cause the account to be stricken from further draw despite the fact that the account has a balance available for withdraw. In XXXX, I experienced emergency XXXX due to a developed pre-cancerous XXXX XXXX mass that required immediately XXXX within days of discovery. I communicated this and they identified that they did not care, and it did not matter the circumstances, they would not offer any payment accommodations of deferring a payment all together on the back end, so that multiple double payments would not be needed. During this time, I was also several days short on hours due to inclement weather conditions including active tornados where I live, where I was unable to go to work. The past due days were minimal and typically within XXXX week, and I had no idea they were building up to deactivate the ability to draw on the account while collecting the payment, as they provided no indication they would deactivate the draw capability. I have made numerous calls pleading for assistance and they would never reinstate the account to allow me to draw, as obviously due to being out of work, my hours were short, which would have allowed me to be current on other payments to resume regular payments as normal if I would have access to the balance for draw. Concerning my medical circumstances, not offering any assistance is pretty disgusting. I last contacted them in advance to move the payment due from XX/XX/XXXX to XX/XX/XXXX and to double the payment for XX/XX/XXXX to XX/XX/XXXX. They did not apply the arrangement and kept asking me the same information over and over again. The reason why I believe the account was reported as 30 days past due, is because they scheduled the debit on XX/XX/XXXX, by forcing me to provide my credit card information via email. The representative processing the payment on that day, incorrectly ran my expiration date, and the payment automatically declined. I believe this is what generated a reporting to the credit report. I was emailed immediately, and I immediately called them and read the information ( same card ) over the phone and it was processed correctly. This account was not past due 30 days at either that payment or the end of the month, as of XX/XX/XXXX, the only payment past due was for XX/XX/XXXX. The account is not reported at 30 days as they don't report any account information until XXXX days, as they would always advise what date the account would be reported, which was greater than 30 days. Pending the results of this complaint, I will bring the account current as I am unaware what XXXX happen. XXXX XXXX XXXX, the account is not scheduled to report/default until XX/XX/XXXX, although the last payment was XX/XX/XXXX, so any additional reporting before then, would be purely retaliation to this complaint.

On XX/XX/2023, I was given three calls from number XXXX. I did not answer any of them, as I was busy working and paying attention to my work phone ( as opposed to my personal phone ). They came in at XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX I returned the missed calls at XXXXXXXX XXXX on the same day. A woman answered, who was nice, but she had very slurred pronunciation as if she was intoxicated. I acknowledged that I was in fact, XXXX XXXX ( the person that they were looking for ) ; she told me that she " didn't mean '' to call so many times. I was transferred to another woman, who began by politely asking me how exactly my debt came-to-be. I explained that I was laid off and that CreditFresh was one of the very few loaners of mine that didn't offer any kind of debt relief program for individuals suffering a layoff, and that I wasn't aware that the loan had gone into default ( it turns out that I had made payments after the official default date but was never made aware of the default on the websites homepage for my username ). I further explained that it obviously snowballed because of this, followed by me explaining that I was happy to set up a payment plan to resolve it. She continued by asking, " When do you get paid next? '' I responded and politely said that it wasn't information that I was willing to disclose. She asked me to repeat, so I told her again that it wasn't information that I was willing to disclose. She tried to intimidate and gaslight me by saying, " You don't want to tell me when you get paid next ( or something very similar to this )? '' I said, " No, and I find it extremely sketchy that you're asking. '' She replied, " You think it's sketchy that I'm asking when you get paid next? '' I said, " Yes, that is not your business and you should only be concerned about me making monthly payments on time. '' She began to argue, and I ignored it and interrupted her by saying something very similar to, " Listen, lets " do this. Moving forward, if you want to talk with me, email me. '' She responded by saying that that's not the way her company works. I then explained that they needed to because it's a legality issue and she needs to abide by it. She argued a bit more, and I continued to tell her the same thing. Eventually, I told her not to call my number again, and if she did, I would report her every, single time. Since, I've been getting calls from many random numbers ( XXXX, XXXX [ multiple calls ], XXXX, XXXX, XXXX, XXXX [ which I received twice in one day ], XXXX, XXXX, XXXX, XXXX XXXX, XXXX, and XXXX ). I'm not sure if it's them or not. Even if it isn't, her demeanor took an illegal tone and she acted as if she didn't even know who the FTC is, even when I told her on the phone ( after explaining that I believed her to be sketchy ) that I would be reporting everything that she was saying to me. This was a cruel, unfair, and illegal tactic on her behalf, and I am happy to have a conference call with the CFPB and this individual/company should the opportunity be presented.

To Whom It May Concern, I am writing to file a formal complaint against CreditFresh, a financial institution that provides line of credit services. I am deeply concerned about their unfair and deceptive billing practices that have had a significant impact on my financial well-being. Description of the Issue : On XX/XX/2020, I opened an account with CreditFresh, for a line of credit. Since then, I have consistently made timely payments as required by the terms of the agreement. However, I have repeatedly encountered unjustified and exorbitant " Billing Cycle Charges '' that are added to my account on a regular basis. These " Billing Cycle Charges '' are not adequately explained and are based on a complex formula related to the outstanding principal balance. Despite numerous attempts to seek clarification from CreditFresh, I have not received satisfactory explanations for the imposition of these charges. The lack of transparency and justification for these fees is deeply concerning. My attempts to communicate my concerns with CreditFresh have been met with evasive responses and attempts to deflect the issue. Furthermore, their customer service representatives have provided inconsistent and unsatisfactory explanations for these charges, leaving me feeling frustrated and exploited. Actions Taken : I have sent multiple emails to CreditFresh, expressing my concerns about the unfair " Billing Cycle Charges '' and requesting detailed explanations for their imposition. I have received responses from CreditFresh that attempt to rationalize these charges but fail to provide a clear and transparent explanation for their calculation. I have requested that these charges be removed or substantially reduced, as they constitute an undue financial burden and are not adequately justified. I have expressed my intention to close my account with CreditFresh if these unfair billing practices are not rectified. I have taken the necessary steps to protect my rights as a consumer by seeking clarification, advocating for fair treatment, and attempting to engage CreditFresh in resolving this issue. However, the lack of appropriate responses and actions from CreditFresh has left me with no choice but to escalate this matter. I am sharing this complaint with the Consumer Financial Protection Bureau in the hope that appropriate action will be taken to investigate CreditFresh 's unfair billing practices. I believe that these practices not only harm individual consumers like myself but also undermine the principles of transparency, fairness, and ethical conduct within the financial industry. I kindly request that the Consumer Financial Protection Bureau initiate an investigation into CreditFresh 's billing practices to ensure that consumers are treated fairly and that deceptive practices are addressed promptly. XXXX XXXX XXXX XXXX Credit Fresh is reporting a collection/charge-off account to all XXXX of my credit bureaus that is not mines. I have no signed contract or business dealings with XXXX XXXX XXXX XXXX Credit Fresh. Recently I received several harassing phone calls from XXXX XXXX XXXX threatening over this debt that is not mines. In addition XXXX XXXX XXXX proceeded to call and harass family members. I have never received any legally binding singed contract from XXXX XXXX XXXX XXXX Credit Fresh stating that they owned this debt nor their intent to pursue collection & report erroneously to my credit bureaus. I see they have had action & lawsuits taken against them for using deceptive tactics to collect bad debts. I have requested documentation to include a signed agreement & proof that XXXX XXXX XXXX XXXX Credit Fresh owns the debt ( along with copies of anyone else who has owned this erroneous debt ). Upon contacting the said original creditor, they acknowledge they do not have any knowledge of this account. XXXX XXXX XXXX XXXX Credit Fresh is in willful non-compliance with the FCRA. With identity theft, data and security breaches on the rise I am sure XXXX XXXX XXXX XXXX Credit Fresh understands the importance of properly investigating my concern. I will continue to document my efforts to get this issue resolved. If this is not resolved I intend to pursue litigation & seek monetary damages. I am confident I will prevail and will not be interested in settling after legal expenses are paid. I believe it will be in XXXX XXXX XXXX XXXX Credit Fresh 's and my best interest to resolve this issue prior to litigation to avoid unnecessary out of pocket expenses. According to the Truth in Lending act there needs to be a break down on the statement of the amount of interest you are charging. I see in the farms and conditions I am signing say billing cycle charge can not be waived. Credit Fresh is in violation of the Truth in Lending act by not having a proper break down of the total number of payments. The withdraws dont even show a date on the statement, annuals percentage rate, and security interest disclosures. Credit fresh is using aggressive tactics and unfair loan termssuch as high interest rates and feesto take advantage of unsuspecting borrowers. Credit Fresh is going after the most vulnerable and least knowledgeable borrowers Regulation Z is a Federal Reserve Board rule that requires lenders to give you the true cost of credit in writing before you borrow. That includes spelling out the amount of money loaned, the interest rate, APR, finance charges, fees and length of loan terms. An unlawful loan may also be some form of credit or loan that disguises its true cost or fails to disclose relevant terms regarding the debt or information about the lender. This sort of loan is in violation of the Truth in Lending Act ( TILA ). My complaint is that it is taking advantage of me if my new credit balance is {$1500.00}. My booking charges in two months amount of two {$420.00} and the credit amount to my actual balance is {$98.00}. That is a total of {$520.00} paid year to date with {$98.00} not yet posted to the account as of today XXXX XXXX Credit Fresh not providing proper breakdown of payment schedule, interest rates and fees enticed and misled into me taking out a loan that carries higher fees than my risk profile warrants or that I are unlikely to be able to pay back.

I have disputed this XXXX account that's on all XXXX credit Bureau 's that says I owe XXXX, it came back that it is my account by the consumer. So I called the collection agency and I have the call recorded which I told them I was a recording so I wasn't doing anything wrong. First I was hung up on 2 times because the people couldn't find my account through my name or social security number. I was so upset that my XXXX called back and spoke with them. To which again they said we can't find her account there is nothing listed for her. He and I both said then you need to take this off her credit reports, you can even find the account. to which their response was to hang up a third time. I called XXXX and was on the phone for XXXX hours trying to get this removed off my credit report and they said dispute it again, which I did and the company cam back saying the account was valid. I asked XXXX where was this opened at? They said in XXXX I have never lived and XXXX and followed up with how is it that I opened an account with XXXX which since has been removed off my report in XXXX Nevada then 2 months later open another account with XXXX XXXX XXXX. It shows all over my credit bureaus that I'm a victim of identity theft. I just found out yesterday that this person filed tax returns in my name which I will be filing a police report. excessive : billing cycle fee service fee principal interest rate current ytd fees and charges XXXX since XX/XX/2023 total current loan amt XXXX ( so i have paid over XXXX in fees in 3 months and almost nothing toward my balance ) I have contact customer service multiple times with no success. I have asked why total amount due increases despite having automatic payroll deductions. Multiple customer service rep have assured your total loaned does not increase, but minimal ( 1 % ) of your payment is applied toward principal due to fees. When I have reviewed statement balances the best a representative could tell me was " Oh, you are off billing cycles. '' Which makes no sense. I am paying over XXXX a month in payroll deductions and have paid nothing toward my balance and actually my balance has increased you can only call customer service to adjust payment in order to apply more toward your principle. However, it is difficult to get through, agents often ask you to call back or agree to return call when network is back up with no return call. You are unable to adjust your payment or make an additional payment online. When I tried to make an additional payment online I was charged an additional service fee. This was addressed with customer service and fee was reversed.

I have had to take a loan through credit fresh because I fell on hard times and needed the money. Well Ive been paying on the account for well over a year at this rate. It seems like the balance has never gone under the XXXX its at, if anything it just constantly goes up on its own. My payments were roughly XXXX every XXXX weeks for awhile. Then just recently they were so nice to introduce this new program called the credit evolution program my payment was supposed to go down to XXXX dollars every XXXX weeks. It did for all of about XXXX or XXXX payments. Since then it has done nothing but go up even higher than my original XXXX. My next payment is set to be XXXX dollars. My balance is clearly under the XXXX dollar limit for a lower payment. Ive tried contacting them about this issue before and they were no help. Claiming things such as thats just how the cycle charges work. When I go to their website to try and get my account statements they will not display. Almost as if the link is broken and there is no other area or option on the website to get them from. This lender is very predatory and unclear with how they do things. The fact that they are able to get away with just changing peoples payments on a whim is beyond me.

My max credit with this account from when i opened has been XXXX. I have paid back over XXXX XXXX dollars with no draws, almost all being on time. My balance has not gone down a single cent, in fact it has increased, no matter how much i pay back. They refuse to detail these imaginary fees on any statement. My money should be going straight to the principal and interest, which should be the same since i opened the account. Instead, it seems fictitious fees are being added or my money just is not being taken and applied to my principal. I find this to be illegal ( fraud, robbery ) As they are just taking my money every single month and not reducing my balance based on unknown reasons, and then keep charging me every month. My balance should be below {$1000.00} by my calculations, however it still shows as GREATER THAN XXXX, more than i ever could have even taken out. I need to know exactly what is happening with this money, where the itemized charges are ( as this is required by law ) and the exact lines in any documentation i signed that depicted these figures and fees. I expect my account to be fully forgiven and closed by the end of the weekend, otherwise this will go to court. Thanks!

I made an {$550.00} payment and they added on {$500.00} to my balance. I called and they promised Me that the balance would go down after making more payments. They said that they were charging me a billing cycle charge each payment. These biling cycle charged are 98 % of any payments I have made so after several attempts for them to stop these shady practices I'm on my 10th month of making payments on a {$5000.00} loan and my balance is {$5100.00}. I have made {$5200.00} worth of payments to this company and still owe more then what I borrowed. This is the worst predatory lending I have ever seen. I am a XXXX veteran on social security and I can't keep giving this company free money after I have already paid them more then what I borrowed. These fees, and charges were hidden. On or about XX/XX/XXXX, I obtained a line of credit in the amount of {$2900.00} from Credit Fresh through their website. My husband had passed away 10 days prior, and I did not understand the this company would make a draw on each and every payday ( I get paid every other Thursday ). To date, I have paid {$1400.00}, and my balance is still {$2800.00}. In other words, my balance has only decreased by {$170.00}, despite the amount I have paid ( {$1400.00} ). On XX/XX/2023 I called, just excuses and runaround why the amount ( s ) keep fluctuating. I emailed XX/XX/2023, they refused to respond. I emailed XX/XX/XXXX, twice and XX/XX/2023, they refuse to respond. I used the text feature ( XXXX ), on XX/XX/2023, they refused to respond. I have attempted to rescind my ACH debit, they refuse to respond or acknowledge this. I have paid XXXX in 10 months, the original amount was XXXX Credit Fresh says I owe XXXX, where did the money paid go? How can I possibly owe more than the original loan by XXXX when I have paid nearly XXXX in just 10 months. This is beyond predatory. This is beyond allowable interest in Oklahoma. I am also contacting the FTC and Oklahoma State Attorney General. I am also sending via signature required my revocation of ACH debit. This company is ruthless, follows NO rules, NO acceptable accounting practices. They should be shut down IMMEDIATELY. The refusal to respond, the refusal to remove the ACH authorization tells anyone all you need to know about Credit Fresh. Please, I am begging you, STOP these crooks.

On XX/XX/XXXX I inadvertently over-paid them with a debit from my debit card that is attached to my checking account. The balance that I owed them was XXXX, but I paid them {$3500.00} anyway. I spoke to them about this on XX/XX/XXXX and was told to expect the refund back into my account in 3 to 5 business days. On the 5th business day, XX/XX/XXXX I didnt have my overpayment refund yet, so I called them again. They stated that their Compliance Department has my account under review and they were waiting to hear back from their Compliance Department. I followed up by phone on XX/XX/XXXXXXXX and got no new update. Just that they & I should both expect to hear from their Compliance Department. I called them again XX/XX/XXXX, which is 2 full weeks after the overpayment, and got no new update. Again, just that they and I are both still waiting to hear back from their Compliance Department, and that sometimes it takes a couple weeks. I pointed out that it HAS been two weeks, and they still can not tell me when to expect my money back.

I received a statement that showed for my first billing cycle, I had incurred a {$55.00} billing cycle charge ( which is fine- I agree to that ). I just paid the loan off today but it changes the billing cycle amount to {$160.00} when paying in full. I agreed to the loan with the {$55.00} charge but I did not agree to them changing it to {$160.00} when paying it in full. On their website 'https : //www.creditfresh.comXXXX XXXX ' it states there is no pre-payment penalties yet I am being charged more when I was pre-paying the loan. I followed up with them today & customer service states the billing cycle charge changes based off how much you pay which directly conflicts with what was stated on the website about pre-payment penalties when I signed up. This intentional ambiguity is designed to charge me a pre-payment penalty despite stating they would not.

I called about my account showing past due. I have made a full payment every 2 weeks and skipped one payment and was advised my account is 39 days past due, from XXXX. I have paid 3 more payment since that time and was told that it did not matter, if I did not pay 2 payments by the XXXX XXXX XXXX my account is delinquent and would be reported as such to my credit report. I was in need of a small {$1000.00} loan to pay off some bills. I inquired with several different banks to explore my options. Somehow during this process, CreditFresh opened this account without my knowledge or permission. I was only trying to get info on rates. After I was informed of it being opened, I requested that it be closed immediately and my request was denied. They told me they would take monthly payments directly from my checking account and that it would be paid off quickly. After paying for several months, I noted that the fees being deducted from my bank account were only enough to cover monthly finance charges and fees and the principle was never touched. Not only did they open the account without my permission, they mislead me in regards to how it would be repaid.

When I signed up I was told that the balance would be paid off within 12 months. However I was recently told that I would have to pay the full balance in one lump sum. I initially had a payday line of credit for {$2400.00} from XXXX, which I mistakenly maxed out within 1 year. But as it stands now my payment is {$280.00}, with {$240.00} of that going towards interest, which is blatantly outrageous.
