I XXXX XXXX XXXX a Federally Protected Consumer/Creditor who have been Violated, Pursuant to Federal Debt Collection Practices Act ( FDCPA ) U.S.C Title 15 section 1692, 1681, 1679. on XX/XX/XXXX I made an appointment for credit repair with Credit Diva of Dallas Inc. XXXX XXXX XXXX,. XXXX XXXX XXXX, Texas XXXX ( XXXX ) XXXX email : XXXX, and during the initial visit spoke with XXXX XXXX I was asked for advanced payment for {$1200.00} for the XXXX XXXX XXXX, {$1200.00} for 2 tradelines to be added to my credit report and {$100.00} for the initial visit, in the sum of {$2500.00} Pursuit to U.S.C Title 15 section 1679 ( b ) ( a ) ( 4 ) ( b ) it is a violation to charge advance payment for any credit consultation/repair, the services must be completed fully before accepting payment. a couple of months passed and another active client at the time confided in me about the tradelines she paid for did not help her in obtaining a house, and that moment I reached out to XXXX XXXX owner of Credit diva of Dallas Inc. and asked for a refund and that time XXXX XXXX expressed to me harshly which is a violation Pursuant to Title 15 section that she don't refund any money back but after me being persistent a portion was given to me in the sum of {$600.00} half of the total sum of {$1200.00}. I XXXX XXXX XXXX consumer had other issues with Credit diva of Dallas Inc . I was not given a copy of the contract which is another violation Pursuit to Title 15 section 1679 ( f ) Contract compliance I did not have in my possession a copy of my rights as a consumer any type of contract that's a compliance according to FDCPA along with numerous of compiling violations such as misleading representation, U.S.C Title 15 section 1692 ( 2 ) ( a ) Prohibited Practices U.S.C Title 15 section 1679 ( b ), section 1635 right to recission, Section 1681 ( q ) obtaining information under false pretenses, Section 1679 ( g ) civil liability, Section 1679b engaging directly or indirectly an attemp to commit fraud or deception, 1679c ( a ) written statement before contract disclosures, consumer has a right to sue credit repair organization, right to cancel. Section 1679c ( b ) retention of compliance records signed by the consumer acknowledging and stays on file for 2 years and to be a seperate statement form the original contract. I XXXX XXXX XXXX have a private right of action Pursuant to 1692k ( A-1 ) ( 2-A ) Civil Liability I requested a copy of the original agreement XX/XX/XXXX I got no response so I reached out to Credit Diva of Dallas Inc. on their social media page and I got a responds and a copy of my contract which is a requirement of Title 15 Section 1679 ( f ) but upon receiving a copy of the contract 1 year later and felt totally voilated XXXX XXXX XXXX XXXX XXXX. knowingly and willingly trespassed against me by not providing me with a copy of any agreement/contract informing me of my rights and not disclosing this required infomration. There are services in the contract that I never received such as consulting, coaching, webinars, video conferencing, and if I had been provided a copy of the said agreement/contract I would of never given XXXX XXXX XXXX XXXX XXXX. or any other person authorization to receive, sign, endorse any contracts/agreements or any instrumitalities or collect any violation fees on my behalf. I XXXX XXXX XXXX a Federally Protected consumer have the right to redress as an injured party this has caused me emotional distress, deframation to my character I am instructing the Consumer Financial Protection Bureau to Protect me as a Federally Protected consumer.
