Below please find a day by day, item by item detail of my complaint against XXXXXXXX XXXX : Wed XXXX XXXX- I was informed by my eye specialist that I required emergency retina XXXX the following day. I was also informed that my recovery would require me laying face down XXXX for 5 days, allowing for a short XXXX minute break each hour. To accommodate this requirement, I was referred to XXXX XXXX for medical equipment rental. I phoned the company that afternoon at XXXX to order the rental. I was told the price would be {$120.00} for a week rental, but that it would not be delivered until Friday XX/XX/XXXX. I hesitated to place the order since I would only have use of the equipment for XXXX of the XXXX nights I would need it, but decided to go ahead and place the order. I was informed that I would receive a confirmation email, which never occurred. Thu XX/XX/XXXX - XXXX was performed and I was sent home with a specialized foam pillow that accommodated the face down positioning, although with much discomfort. Fri XX/XX/XXXX- I checked my front porch nearly every hour or two until going to bed around XXXX p.m., but the equipment was never delivered. Sat XX/XX/XXXX - XXXX equipment was delivered this morning, but now that I only had XXXX days of usage left, I called the company to let them know it was delivered a day late to see what they might be able to do for me. I spoke to XXXX who stated that they did not guarantee deliveries and their policy was absolutely no refunds. I asked to speak to a manager, but was told I would need to call back the upcoming week, as no managers were available. My family member who was assisting in my care, opened the box to see what the equipment was like, as I had just spent two miserable nights not being able to sleep comfortably, and thought I would see how much difference it made in comfort not only for the nighttime, but accommodating a somewhat upright position during the day to facilitate reading. I also needed to retrieve the return address label that was inside the box. Upon removing the equipment from the box, it was immediately noticed that one of the knobs used to adjust the equipment to my body frame was broken and unusable. Please note there was no bubble wrap or other protective materials in the box. In addition, the " instructions '' that came with the unit were illegible photocopies, with nearly blacked out diagrams. There was no identifying information for all the different adjustment points ( such as numbering the adjustment unit along with a corresponding number in the diagrams, which again were almost blacked out and illegible ). Between the broken knob which prohibited adjusting the equipment properly to fit me, and not having adequate instructions, we determined I would not be able to use the equipment at all. Since the customer rep at XXXX XXXX had not been helpful on the earlier call, I submitted a dispute with my credit card company and received a temporary credit. Tue XX/XX/XXXX - XXXX phoned the company back and asked to speak to a manager. XXXX answered again and said she could help me, even though she had told me on Saturday she was not a manager. I again asked to speak to a manager and was transferred to XXXX. I told her about the late delivery, broken nut, illegible instructions and the fact that I had never received an email confirmation when I submitted the order. She insisted that they had proof of delivery for Friday, but when I asked for her to email me a copy of that, it never came. I asked for her to send me the confirmation email which she also insisted had been sent, as I wanted to see the day and time it was sent. Again, this was never provided to me. She did send me a rental agreement, which of course I had not received prior to this, and had never signed. I requested a refund since I was unable to adequately use the equipment, but was told the owner was the only person who could approve that, and that he was unavailable. I asked for his name and contact information but she refused to supply that. I asked for her to provide my contact information to the owner for when he was available, but never heard from him. After the end of our conversation I sent an email with photos of the broken nut, illegible instructions, and again asked that the owner contact me at the phone # I provided. Again, I never heard from him. Thu XX/XX/XXXX- as instructed in the box 's paperwork, I called once again and informed XXXX that the equipment would be shipped back on Friday XX/XX/XXXX as required. Fri XX/XX/XXXX - Unit was shipped back via XXXX label provided by company. Thu XX/XX/XXXX- I received an email from the company with an invoice dated XX/XX/21 for the {$120.00}, along with an additional {$30.00} Administration fee, line item dated XX/XX/21. No mention of any kind of Administration fee is included in the rental agreement. Mon XX/XX/XXXX- I updated my dispute with my credit card company to add the issues with not receiving proof of XXXX delivery date, receiving unsigned rental agreement, {$30.00} Admin fee and the owner not being accessible. Fri XX/XX/XXXX - Received collection letter dated XX/XX/21 for {$170.00} from Credit Counsel , IncXXXX No documentation was included to explain how the original amount went from {$120.00}, to {$150.00} to {$170.00}. I advised my credit card company of this and was told they had not yet received a response from the company regarding the dispute, but that they have until XX/XX/21 to do so. The collection letter states I have 30 days to respond, however I would like guidance if possible on what I should or should not do with them. Thank you for your assistance,

XX/XX/2023 XXXX XXXX calls me and tells me he is the Attorney for XXXX XXXX. I informed him i am not paying another XXXX to XXXX XXXX because they lost all my mother in laws things and almost XXXX on her. He asks if i filed a complaint, i tell him yes and he tells me he has her files and there is no complaint in her files. We exchange some more words and i hang up on him. XX/XX/2023 XXXX XXXX calls me and leaves me a message stating that because i hung upon him that i must be feeling a sense of responsibility and that's why i am so defensive, and that the matter should of been resolved a year ago and that i am failing miserably.Tells me to get a lawyer to help me and that me being rude and obnoxious isnt gon na make it go away. XX/XX/2023 calls and leaves me a message saying that this is his final call and that he is going to have to move forward legally tomorrow the XXXX XX/XX/2023 XXXX XXXX calls me saying he doesnt understand why i hung up on him. I did what i did and I don't need him to tell me what i did and that i need to spend more time and energy on something more productive like making money so we could get something arranged. He tells me every time he talks to me my story changes, they stole her jewlery to they almost XXXX her to now you wan na make payments, now you wan na make complaints, its a whirlwind with you. youve been in my office for 2 months and havent made a payment. Telling me the situation ive created isnt pleasant. Waiting for me to put my energy into something more productive like getting these poor people compensated. XX/XX/2023 XXXX XXXX leaves me another message pretty much telling me he is gon na take me to court and that he got the notice from me filing a complaint. XX/XX/2023 XXXX XXXX calls me again XX/XX/2023 XXXX XXXX calls me again, stating its been over a year and that i have failed miserably at resolving the issue, communicating and good at filing bogus compaints. Tells me that i am intentionally trying to defraud his client and that they dont take to kindly to that. Tells me i dont seem too interested in paying the bill and I'm more interested in filing complaints and hope that they forget about me. XX/XX/2023 XXXX XXXX leaves me a message Tells me they are moving forward with legal action on the XXXX. XX/XX/2023 XXXX XXXX calls me, Stating he is XXXX XXXX Calling in regards to the bill. XX/XX/2023 XXXX XXXX calls me again stating he is XXXX XXXX tells me i am hiding instead of honoring agreement. I filed frivilas complaints with hopes of getting away with not paying the balance. Tells me he has talked to his client and they are COMING FOR ME. XX/XX/2023 I email XXXX XXXX and tell him i have filed a complaint against him with the XXXX and that i want no more contact from him, ive asked for someone else to handle my case XX/XX/2023 at XXXXXXXX XXXX XXXX XXXX emails me back, tells me that the XXXX doesnt pay delinqent bills, he has already demonstrated that i am aware of the bill. Tells me idle threats do not deture CCI, so why not offer a settlement now. I email him back stating that i want someone else to handle me case and i no longer wish to talk to about this issue. He emails me back saying the XXXX doesnt have the authority to remove him. Tells me it has become glaringly apparent that my intention is to defraud his client.He is going to re omend lidigation. at XXXX i message him back telling him he is wrong and that i can not afford to pay hundered dollars a month that i am on XXXX. and that i dont want to talk to him about this account any more. Emails me back telling me i have till Friday. XX/XX/2023 i email him telling him i can pay {$50.00} a month.emails me back declining saying {$150.00} a month. I tell him i cant do that, id be homeless

On XXXX 2013, a guy approached my husband at the hospital waiting room meanwhile I was at the XXXX room, convinced him of this equipment rental for my XXXX XXXX, got my credit card and personal information from my husband and disappeared. Stressed as my husband was waiting for the outcome of my XXXX, he thought that this guy belonged to the hospital personnel and he was n't we found out later. The rented Item was never delivered to my house, being an equipment rental, if it would had been delivered to my house, they would have had to pick it up as well. The pickup never happened because the item was never delivered. Since the item was charged into my credit card by XXXX XXXX, I called XXXX XXXX XXXX XXXX and told them that I never received the item. After a thorough investigation XXXX XXXX removed the charge from my credit card account. A year later or more, I received a call from a Collection Agency, Credit Counsel , Inc., trying to get money from me that I never owed. According to this Collection Agency, the debt to a XXXX XXXX XXXX. I told Credit Counsel Inc., what happened again, that the item was never delivered to me. I also expressed to the Collection Agency, that if they had bought a debt that never existed from XXXX XXXX, they were supposed to take it against XXXX XXXX and not harass and yell at me, like they were doing every time I answered the telephone. I just learned from XXXX and XXXX Credit Report Agencies, the complete name of this Collection Agency that was calling me since I had a hard time trying to get their name because whenever I answered the telephone to them, they were always shouting at me and trying to intimidate me to make me pay for something that I did not owe, and do not owe. According to the Credit Report Agency XXXX, this Collection Agency has LEGALLY CERTIFIED that the debt belongs to me and that I did not pay it. My question is, how can a company LEGALLY CERTIFIES something that is not true. Moreover, try to hurt my Credit Record where I have always kept an average score of 800 or more, since I do not like to owe, and I pay all my accounts in time. Based on what criteria Credit Report Agencies, believe Collections Agency statements over customers statements that have never had a collection, and have never paid late. Why not asking for trustworthy proof before placing a collection in my account. By not requesting proof or support for their allegations, before publishing something that hurt my name and my records, the Credit Report Agencies become accomplice of these type of unscrupulous Collection Agencies. The same way that we might have not received approval for a credit card or a loan, based on this false information published, there should be a penalty for the Credit Report Agencies and for these Collection Agencies for giving false information to vendors or providers. Thank you very much for your prompt attention to this matter, and looking forward to hear from you soon since I consider these false accusations in my credit reports to be damaging my image and my reputation.

Called XXXX on or around XX/XX/XXXX in regards to Debt call from XXXX XXXX. XXXX XXXX told me he was an attorney for XXXX XXXX and he was trying to get money owed. I informed him I wasnt paying it because they lost everything XXXX owned down to her XXXX XXXXXXXX. He asked me if I filed a law suit against XXXX XXXX and I said no that I didnt know I could and he stated that if it was true I could. I told him they were inept a taking care of old people, they were short staffed had one nurse for 2 buildings and almost XXXX XXXXXXXX. He asked if I made a complaint with the state and I said yes and he said its not in his file. I told him a nurse from XXXX called me and asked me if XXXX was abused by other residents while she was there I told her no but continue to tell her about the staff shortages only one nurse for 2 buildings how they lost all her belongings and how they almost overdosed her. He tells me there is no report from the state in her file and I tell him I worked XXXX XXXX and know complaints disappear. XX/XX/XXXX XXXX XXXX calls and leaves me a message on my voicemail telling me that ignoring their calls will not make the debt go away and that he feels that I am trying to get out of painted the date and that guy never intended to pay the debt that I fraud and the company, so I call XXXX XXXX back. I told XXXX XXXX that I am on disability and that I can not for the pet a lot a month I told him I could pay {$10.00} a month and he laughed and he said that he is not going to except that amount and I told him that I can not pay hundreds of dollars and hes like how about {$500.00} a month and I might know thats my whole check but what I live on and he pretty much said that that was not his problem, and again he said to me I think you purposely tried to defraud the company and that I never intended on paying the bill. Then he hears my dogs barking and says to me when you got dogs and I was like yes I have two years with dogs are pretty expensive are they and I asked him if he had dogs and he said no and Im like well then how would you know that theyre expensive. XXXX XXXX goes on to pretty much make fun of me because I am on disability Im gon na tell him you know I wouldnt be able to pay my bills if I paid {$500.00} a month to pay this bill back and he told me all that were gon na have to go to court, he tells me that XXXX have to send it to litigation and pretty much me having to give up everything I have to pay this bill back which would include my property. XXXX XXXX has been very crass and very rude with me. I have emails from XXXX XXXX being rude to me and I also have a couple voicemails if I have to continue to deal with XXXX XXXX this issue was never going to be satisfied. I would prefer not even talking to him. He is a very humiliating person. He puts me down and talk to me like Im an XXXX and threatens me. XXXX XXXX works for credit counseling Inc. out of Florida.

My husband received care at a rehabilitation facility called XXXX XXXX XX/XX/XXXX. All services were paid for upfront through our insurance and we also paid around {$60000.00} for his stay at the facility. On XX/XX/XXXX we received a notice from our insurance company advising they received a bill from what appears to be a company related to XXXX XXXX. They refused payment due to incorrect diagnosis codes, modifiers, unit or place or service. We later received what appears to be a medical bill from the rehab facility reflecting a remaining balance due of {$4500.00}. At the bottom of this bill there is a hand written note showing a balance of {$290.00} for " Canteen Items. '' I've never received a medical bill like this in my entire life. When my husband attempted to contact XXXX XXXX directly to dispute these erroneous charges they couldn't explain the bill and refused to send his dispute to the their billing department. They instead advised he should contact a XXXX XXXX who is supposedly with their billing department. However, we've received phone calls from XXXX XXXX ( XXXX ) and when we've attempted to call him directly he is never available. I've attempted to contact him directly and have left voicemails advising that we're disputing this bill and requested him not to call us again. He later made attempts to contact my husband and I through my parent 's in law and advised them of this medical debt WITHOUT OUR PERMISSION. He left me a voicemail again on XX/XX/XXXX. To date we haven't received a bill or notice from XXXX XXXX about this fraudulent debt. When I called today XX/XX/XXXX I spoke with another man. He advised XXXX XXXX wasn't available, so I advised him we're disputing this fraudulent debt and requested to be put on their Do Not Call list. He refused to stop the calls and advised I would have to tell XXXX XXXX myself. I advised his company is breaking multiple FDCPA guidelines and he replied " they don't have to bend to my will and I could probably end up getting sued, this isn't a sales call so these guidelines don't apply, and he finally advised if I don't want these calls to continue then I should get an attorney. '' I would like to advise I've now contacted an attorney per their request. I confirmed that the actual company contacting us is NOT Serenity Oaks, but a debt collection agency called Credit Counsel Inc., CCI. AGAIN, we have never received anything in the mail from this company! During my call with the gentleman today, XX/XX/XXXX, at no time did he EVER give the mini-Miranda disclosure required per FDCPA guidelines.

On or about XXXX XXXX, 2016, I received a phone call from XXXX XXXX of Credit Counsel , Inc. XXXX XXXX indicated that he was representing his client XXXX XXXX in an attempt to collect {$2700.00} for an unpaid workman compensation debt. I had not received any correspondence via mail before this phone call. I knew of XXXX, the workman comp bill and the amount of {$2400.00}. XXXX XXXX indicated that by XXXX XXXX, 2016 I needed to get back with him and submit the {$2700.00} On XXXX XXXX, 2016, I contacted XXXX XXXX and informed him that the amount he quoted was incorrect. He stated that this was the amount he was authorized to collect and received from XXXX. He stated that it was late fees and other charges. I called XXXX XXXX and was told that {$2400.00} was the amount owed on the claim. XXXX XXXX stated that he was " going to sue me and get more than I owed ''. He went on to demand immediate payment, stated that he was looking at my credit report and I needed to get the money from my XXXX. I informed XXXX XXXX that I did not have a 401 k and he immediately called me a liar. He continued the bullying tactics by threatening to file a lawsuit and sue me in court. I was taken aback by the unprofessional behavior, threats, and name calling. I inquired later on in hopes to contact a supervisor to resolve this matter as well as report XXXX XXXX 's behavior. I was given the name of a supervisor, XXXX XXXX. I attempted to contact him and my call was intercepted by XXXX XXXX. XXXX XXXX stated that no one named XXXX worked there, he was the supervisor and I was wasting his time. He transferred my call to another gentleman that stated he was the supervisor. He demanded payment of {$2700.00} and if I was n't wanting to talk about submitting full payment, I was wasting his time. I had never been involved with a collection agency and this did not seem appropriate. I submitted a debt validation letter to Credit Counsel , Inc. and requested validation. I received paperwork indicating {$2400.00} was owed, several health insurance claim forms and to arrange full payment from XXXX XXXX. I did not received any other documents or information I requested. After I submitted the validation request, cease and desist letter, I still received a voice mail from XXXX XXXX of Credit Counsel , Inc. stating that was representing XXXX and attempting to collect a debt. This was clearly a violation and disregard to requesting to be contacted by mail only. The employees of Credit Counsel , Inc. did not cease and desist contacting me by phone.

This company violated my consumer rights and heavily impacted my credit score. This is considered identity theft where I gave no written consent to anyone to use my information. I am exercising my rights. My position is legal based upon sections of the Fair Credit Reporting Act as well as the Fair Debt Collection Practices Act. These laws are to make sure that a level and fair playing field exist to protect American consumers from abusive reporting procedures on credit reports, as well as illegal and deceptive collection practices. I demand that policy be adhered to by all creditors and respective credit reporting agencies. Amended consumer rights Fair Credit Reporting Act Public Law 15 U.S.C. 1681 Fair Debt Collection Practices Act : https : //www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/fair-debt-collection-practices-act-text On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. If all of these requirements are not in order, then I have the legal right to request the deletion of this tradeline accordingly. I have no knowledge of this and want this removed due to fraudulence. According to the Fair Credit Reporting Act, Section 609 ( a ) ( 1 ) ( A ), " It states an entity, company, person and etc. are required by federal law to verify - through the physical verification of the original signed consumer contract - any and all accounts an entity, company, person and etc. post on a credit report. '' And due to Credit Counsel not being able to verify the account numerous of times nor provide any type of proof I would like this removed. I am due for the monetary relief of XXXX since my information has been validated. There has been phones and letters stating a debt that I do not owe. I had a repair performed on my vehicle at XXXX XXXX XXXX on XX/XX/18 and had a balance due of {$830.00} for this work. I was not aware of the balance, since I never received an invoice from XXXX. I became aware after receiving a debt collection notice from XXXX XXXX at Credit Counsel Inc. on XX/XX/18 for {$920.00}. I spoke to the management at XXXX to let them know that I never received an invoice, which would have alerted me to pay and I was disappointed that they sent the bill to collection without even letting me know. They agreed that an error was made and they were supposed to invoice me but never did so due to an oversight. I promptly paid the outstanding balance due to them, which was {$830.00} in person on XX/XX/18. I was assured by XXXX that I no longer owed them any money and that the debt collector will no longer be contacting me for payment. I received a receipt from XXXX, showing the payment made and that the balance on my account is {$0.00}. However, I have received additional correspondence after payment was made from Credit Counsel on XX/XX/18 requesting payment for {$86.00} even though I do not owe this money, as I already paid my debt and resolved the issue with the creditor. Further, the balance that Credit Counsel Inc. is stating I owe increases with each notice I receive. The initial notice received on XX/XX/18 is {$910.00} which includes {$83.00} in excess of the balance owed to XXXX. An email received on XX/XX/18 indicates I owe {$920.00} ( {$85.00} in excess of the balance owed ). I paid off the debt on XX/XX/18, and received another notice on XX/XX/18 for a total of {$86.00}. When I inquired why this excess amount is owed from Credit Counsel Inc, an explanation or details supporting the claim could not be provided and they only sent the invoice of {$830.00} from XXXX. I also inquired of XXXX on why the amount being charged by the debt collector is higher than the amount owed and the manager, XXXX XXXX, at the XXXX stated that it is not in accordance with their contract for Credit Counsel to charge more than the {$830.00}, since Credit Counsel receives a fee as revenue from the amount collected from the debt.

When I inquired why this excess amount is owed from Credit Counsel Inc, an explanation or details supporting the claim could not be provided and they only sent the invoice of {$830.00} from XXXX. I also inquired of XXXX on why the amount being charged by the debt collector is higher than the amount owed and the manager, XXXX XXXX, at the XXXX stated that it is not in accordance with their contract for Credit Counsel to charge more than the {$830.00}, since Credit Counsel receives a fee as revenue from the amount collected from the debt.

I had a XXXX in XX/XX/XXXX ; on the same day, someone had a XXXX at the same facility. I paid in full, in cash, on the day of XXXX. Over a year later, the facility merged the liposuction patient 's account into mine and began billing me nearly $ XXXX for a XXXX I didn't have. I contacted them and sent a copy of my receipt, my admission form, and even an affidavit from my surgeon that the XXXX I had was a XXXX. They simply took the receipt for my payment and deducted it from the amount owed for the other patient 's liposuction and billed me again. I responded every time, sending the documents over and over. Same routine -- I sent the same documents in response to every contact, including the statements from the facility showing that they were billing me for a XXXXy when I had a XXXX. This week I tried to buy a house, and my credit report had dropped from XXXX to XXXX because the debt collection agency had filed a negative report despite having received proof that the debt was for a different XXXX than the one I had. I called the collection agency this morning, and they said I owed {$200.00} for overtime for a XXXX, but I had sent them the statement from the facility showing they were billing me the balance for a lipectomy. I had dental services from XX/XX/2012 to XX/XX/2012. At the time I was covered under XXXX. I paid for the remaining balances with my credit card. I submitted paper work for the dentist to be paid directly from the insurance carrier ( XXXX ). You will note that is what happen on the claim form. The dentist indicated that " XXXX paid patient '' at the bottom of the claim form bill. I was contact recently and ask to pay a bill that was supposed to be paid by the insurance company back in XX/XX/2012. I have subsequently changed employers and insurance carriers. The insurance company does not keep records back that far. I have asked for a canceled check from the insurance company to show that I cashed any check. They do not show one being cashed my me and the collection agency can produce any documentation showing that I received payment ( other than the handwritten note at the bottom of the bill page ). For several months I have periodically received a phone call from an unknown number. Today I received multiple and finally decided to call the company back. It turns out they have my number on file for a debt owed by another gentlemen. Multiple representatives informed me that my number could not be removed from their system and that they would keep calling until it is paid. I have been harassed daily by a Credit Council , Inc. bill collector, by the name of XXXX XXXX, after making an agreement ( on XX/XX/XXXX ) of how I was to pay a debt for my company. On XX/XX/2022 at XXXX, I called Credit Counsel Inc XXXX XXXX ) XXXX, a debt collector representing XXXX XXXX XXXX in reference to a collections account in the amount of {$280.00}. I offered to pay the amount owed. The response from the guy was that the amount owed is almost {$700.00}. I asked how is that possible, and he said that administration fees are being charged. I told him that I understand that they are a business and need to make money, but {$700.00} on a {$280.00} debt seems to be a bit overkill. As a business owner myself, I offered to pay them {$350.00}, as I thought that {$65.00} would be a reasonable " administrative '' fee for them. He refused, I then asked if he could break up the amount that he was asking into smaller payments and he refused as well. I then impolitely told him that I guess we will just play the waiting game and wait until it falls off my credit and then no one gets paid. I have attempted to have this XXXX XXXX understand that there is a mistake but all he does is threaten me with reporting to my credit and insult me calling me a liar and a fraud and that i'm going to pay for this. I have emailed him papers showing I don't owe them but he doesn't care. I have no idea who this guy is and i'm tired of him calling and harassing me its been going on since XXXX of this year and he claims I owe {$5000.00}.

I underwent XXXX and paid out of pocket. Before the procedure I inquired about the price and was given a price ( in writing ). The morning of the procedure I was asked to pay {$420.00} more than I was told. Under duress, I paid, but told them I disputed the difference and they told me to contact my doctor 's office, who had given me the pricing. I contacted them after the XXXX and they said I needed to speak with the XXXX center, who sent me back to my doctor. I disputed the amount of {$420.00} with my credit card company because I was told the procedure pricing well in advance and it's not my fault they were wrong. I've spoken with the person who gave me the original quote in writing and they said they've contacted the XXXX center to remove this debt but that was months ago, and the debt is now on my credit report.

XXXX of XXXX and XXXX billed me for a repair that is covered under first year warranty and refused to repair damage to my ceiling caused by this malfunction. I have done my best to work with XXXX to no avail. The owner of the company, who was more than happy to spend time with me during the purchase, now refuses to speak to me in person, on the phone, or by email. Without any notice, they turned it over to a debit collector called Credit Counsel, Inc I have sent Credit Counsel , Inc. certified mail within 30 days of there notice to me stating that I am disputing this invoice and to not contact me again. The collection on the credit report has not been erased. This debt was paid since XX/XX/2019, and should have never appeared on the credit report as a collection to start with since it was paid. I told them I want the mistake removed from the credit report ASAP and provided proof of payment. The company verified that payment was received. I told them I need a letter that states that they received payment and it will be removed from my account. they never replied to me. I am in the process of getting a loan and this is slowing it down. they said they would delete it and they have not and are violating the fair credit reporting act.

I had received a Refund check for my Gap Insurance on my car for XXXX on XX/XX/2018 months later this company sent me a request to refund the money back they said they sent the check by error, how was this by error when I canceled my gap insurance with this company I had sign all the paperwork for the cancellations, I called my lawyer and he sent paperwork requesting proof of the error. I spoke to their customer support and I was informed that the date of service and date of last activity on this account was XX/XX/2013. That is well past seven years and they are in violation of the Fair Credit Reporting Act. I do not wish to pursue an attorney for this violation of the FDCPA but will have to if they do not oblige my request. I was a victim of identity theft and noticed a collection from Credit Counsel Inc I 've attempted to dispute multiple times however no response on their end. Not sure what else to do. Police department told me to contact the federal trade commision which I wrote a formal complaint against Credit Counsel Inc in regards to this matter.
