As a company, how can you be committed to building, selling, financing and insuring affordable homes when customers complain you take XXXX responsibility and treat the mortgage, the manufacturer, the retailer and the insurance company as separate entities? Our mortgage, our home, the utilities connected to our home, and the processes involved in purchasing our home are all the same thing to us. Its just simply OUR HOME. You refuse to hold yourself accountable for your builders, sellers, financing, and insuring subsidiaries and the actions that occur within your company with a company motto of XXXX XXXX. Your company culture does not match your companies actions. My family has endured enough. We have worked extremely hard to obtain our first home that we purchased from you. Now were facing our second foreclosure from you. I have lost my job because of this, suffered finically, and faced enough consequences due to the failures of your company. I live in a home with conditions that pose a threat to the health and safety of my family and this home jeopardizes the soundness and structural integrity of the property. My electrical utilities, water utilities, and my driveway are encroaching on my neighboring properties. I have an insufficient, unsafe, non portable water source with inadequate pressure and no protection from this non potable water from contaminating and polluting due to back flow preventers not being installed. My company has suffered and has been impacted by your actions taken against our credit because you expect us to pay you 30 years of fraudulent mortgage payments that you induced us to sign. Our Companys abilities in acquiring a business line of credit have been limited by your actions taken against us not allowing us to expand on bigger jobs. We recently have suffered a non-fault accident that resulted in out vehicle to be totaled and denied financing repeatedly because of your actions taken against us. Due to your negligence my children have suffered harm. Every day is scary for us including minor things such as taking a bath and brushing our teeth. We receive door letters from you with phone numbers that dont work and we have XXXX answers from you. You have provided XXXX effort to take corrective action and you get away with providing false information and incorrect facts. Despite your harm and wrong doings to us we will be ok and we will survive no matter what you do to us. It is truly amazing what we are capable of accomplishing with all the obstacles you put in our way. I will stop at nothing to ensure that my family has a home that is safe and secure and that it can adequately provide suitable living. Wouldnt you? I would really like to resolve this with you. I would like to stop continuing to suffer unnecessarily. I am more than happy to uphold to my responsibilities as a home buyer and pay a mortgage for a home that can justifiable state what I should pay. Please do whatever is necessary with if your power to do to correct the things you can and mitigate the negative consequences that we are both suffering because of this. The Property was not properly graded and there are site drainage problems which have resulted in damage to the foundation. The grading and slopes were done in a way that causes surface water to drain toward the home, instead of away from the homes foundation. There are ventilation problems in the underfloor space because the ventilation is not up to code standards. This has led to mold in the attic, roof, kitchen, and bathroom areas of a home. This problem is exacerbated by improper exhaust fan venting, improperly sized ducts, and blocked ducts. The foundation problems have resulted in settling which have caused numerous cracks in the interior sheetrock walls. The house needs to be removed from the foundation entirely and the site prepared to meet existing code regulations ; then the house needs to be reinstalled in a manner compliant with code regulations, with adequate under floor ventilation and proper grading. XXXXXXXX XXXX XXXX ( XXXX ), or its agents, represented that water for the Property would be provided by XXXX XXXX XXXX XXXX ( XXXX ). However, neither XXXX nor its developer ( XXXX XXXX, XXXX ) have paid the required fees and done the construction required by XXXX feasibility study. Consequently, XXXX has refused to provide water service to the Property. There is a shared water well agreement for the Property, under which no more than four properties are to share the well. PHVs developer has connected more than four properties to the well. This shared water well agreement was never disclosed to us prior to their agreement to purchase the Property, nor was it disclosed at the closing. In fact, the loan and earnest money contract signed stated that there was not a shared well for the Property. The water flow rate from the well is inadequate and fails to meet the required three gallons per minute flow rate, nor does it yield the allowed pressurized storage of no less than 720 gallons to each dwelling. What little water does flow is contaminated. There are high levels of Nitrates and Nitrites and there are insufficient amounts of sodium hypochlorite to properly disinfect the water of harmful bacteria. The power supply for the well pump is located on a power pole controlled by the developer and is fenced in. Because the developer has failed on a number of occasions to pay his electric bill, there have been several times when is and our children had no water all. As a result of the above, Us, and our children lack access to potable water for the Property and are only able to use what little water they can get for showering. The final version of the notice of violation from the District 's attorney was done on Friday afternoon and it should be in the mail to the developer.The notice gives the developer 14 days to meet with the XXXX XXXX XXXX XXXX and resolve the issue of regarding the violation of District rules governing an exempt well. The on-site sewage facilities permit for the septic system was only approved on the condition that the public drinking water would be provided by XXXX. XXXX, the existing septic system on the property is in violation of the permit. There have been a number of surveys done on the Property. The survey that was the basis of the purchase by us, that you represented was the boundaries and acreage of the Property, is at odds with the other surveys which have been done of the Property. As a result, it appears that the Property that was actually conveyed to us by you, is smaller in area than what you represented to them. On XX/XX/XXXX, I sent an email to Country Place Mortgage Requesting to see if I was eligible for Loss Mitigation. I got no response. On XX/XX/XXXX, my foreclosure was cancelled voluntarily within 40 minutes after I desperately pleaded with Country Place Mortgage regarding my situation and desire for peaceful resolution. On XX/XX/XXXX, the Department of Savings and Mortgage Lending determined that the Actions of Country Place Mortgage and XXXX XXXX XXXX constitute apparent Violations of the Texas Finance Code that potentially justifies instituting disciplinary/enforcement action against Country Place Mortgage and XXXX XXXX XXXX XXXX The Texas Department of Housing and Community Affairs Required Form T that was conducted on XX/XX/XXXX, was never completed. The Regional Vice President XXXX XXXX never offered to assist us in selling our home nor purchase the home from us. Country Place Mortgage failed to comply with its obligations to obtain the water test results prior to the loan closing. There are numerous amounts of loan documents, appraisal documents, underwriting documents within my required paperwork with missing information. The XXXX XXXX did not have the Shared Well Agreement, nor other vital information that Country Place Mortgage states it provided. My home was place on site incorrectly, not connected to utilities properly, and unsafe. Country Place Mortgage did not ensure that a licensed installer warrants the proper installation of the home, site preparations, and utility installations. Country Place Mortgage increased the price of the home being sold based on our decision to make the purchase. Country Place Mortgage Requested and accepted documents that were executed in blank and allowed alterations to be completed to documents without our consent or knowledge of the alterations. Country Place Mortgage charged me for the surveys conducted by XXXX XXXX XXXX that was never provided to me or the XXXX XXXX. Country Place Mortgage charged me for the XXXX XXXX XXXX XXXX XXXX. Country Place Mortgage failed to meet the requirements of the Title XXXX Loan and HUDs Handbook XXXX Property Acceptability Criteria. XXXX XXXX Mortgages on-site representative that conducted the XXXX did not verify correctly that the property meets the XXXX XXXX XXXX. My home is not safe, sound, or secure. The property conditions pose a threat to the health and safety of the occupants and/or jeopardizes the soundness and structural integrity of the property. The property encroaches onto neighboring properties that affects the marketability of the subject property. Country Place Mortgage did not obtain a certification from the appropriate utility company or local regulatory agency stating that the relationship between the improvements and local distribution lines conform to local standards and is safe. Country Place Mortgage apparently knew about the XXXX XXXX and authorized the property site to be treated for Termites, even though that is hazardous to human health. Country Place Mortgage allowed my family to be subjected to harmful consumption and health affects by allowing this to happen. Country Place Mortgage did not confirm that the dwelling unit contained a continuing and sufficient supply of safe and potable water under adequate pressure and of appropriate quality for all household uses ; and that the sanitary facilities were in place and that there was a safe method of sewage disposal. Again, the above is only a partial accounting of some of the problems and issues relating to the Property. You should not be enforcing a second foreclosure against me in retaliation for my complaints to the Department of Saving and Mortgage Lending or any other agency for doing their duties. I should not have to be harassed by more people coming to my house knocking on my door trying to buy my house again. I should not have to face retaliation because I want to give my child a safe bath and protect my child from suffering a bleach chlorine allergic reaction from the water. I especially should not have had to endure this anymore for we have already done so for 11 months.

Your point has been made and you have won. I accept defeat. I never wanted to stay in this situation however I had no choice but to remain here in a uninhabitable home. I tried everything I could to the best of my ability to acquire the necessary items needed to make it habitable but I was unable to do so. I still have a pending XXXX case for the water. I will move in fear of harm that might come to my family by not doing so. It is difficult to do given that I have a wrongful foreclosure on my credit according to law. I will continue to make payments on my shed however I dont think I will be able to take it with me because I have no where to go. I can not find a place to rent with my dog and two cats they arent allowed and I cant give them up. I will be homeless until my cpa completes my XXXX taxes because I need them in order to obtain new living arrangements because I started my business XXXX of XXXX so I need my 1040. Why couldnt I have been approved for loss mitigation due to the fact that I didnt have safe reliable water? I was told that I would have to pay over $ XXXX to make the whole subdivision complaint if I wanted aqua water. Why couldnt we have pursued loss mitigation to prevent foreclosures and correct and address any mistakes that were made or concerns that I had that were completely validated? Or forbearance? Or a repayment plan? Or reinstatement? If you were so kind enough to hold off on the foreclosure so that I may figure it out with the sellers how come you couldnt have waited until I could figure out how to get water or any other circumstances that were out my control could not have been considered? The only thing I did was stop paying my mortgage but thats the only thing that I could do to ensure the safety and security to do anything for my family. We would have needed money to pay to move the power poles according to bluebonnet electric cooperative. We would have needed money to get aqua water. We would have needed money to correct the foundation, drainage, and boundary issues that needed to be corrected. We tried utilizing all warranties, insurances, and resources before not paying our mortgage but we either ended up not having anything that we were told we had. We didnt have mortgage insurance, title insurance or an owners policy or anything to avoid this. Im extremely confused how any mortgage company can come to the conclusion that when I bought a house that I would ever have the want to be a homeless, non paying citizen in pursuit of a free home. I never wanted to be in this situation. If there is no such thing as respa, XXXX, and others laws I thought were made to protect me from this thats fine I understand now. What can I do to then? Who can I pay and where do I pay and how much do I pay? Or its too late then ok now I understand I was wrong for thinking that the laws do not apply to consumers as much as I thought they did and its a bunch of bull XXXX I just thought I had as a citizen. Why did you send my husband a 1098 tax form this year in a different format that the previous two 1098 forms and why are they only in his name when our mortgage was in both of our names? I will not make my husband suffer this alone and I will reach out to the IRS if you are unable to address this. Do you not have any consistent with 1098 tax forms that you send to your consumers because it looks like each year Ive gotten a 1098 tax form from CountryPlace mortgage the order of items disclosed are changed and confusing. Do you normally provide invoices XXXX as the one for the appraisal and it counts as proof of payment? Because an invoice is not proof of payment and I dont think you can prove that in regards to the well the appraisals or the XXXX XXXX. Honestly I couldnt get away with it on my taxes Do you usually send 1098 tax forms in our own document or in the document that looks like and official 1098 tax form from the irs? Im confused on why this years 1098 tax form looks so different from the previous two years. When buyers purchase points for interest rates points or discount points how do they know? And where are they supposed to be given the chance to deny or accept them? Because I had no idea that I had been given two different interest rate lock forms, that I had a choice or what they are even for or how that happened. I just got a new pre qualification that said I was getting a 3.5 % interest rate on XXXX I didnt know I incurred extra costs for this. Why would XXXX XXXX assume that we would have any gift funds in the specific amount of {$2700.00} if we did not give him that impression? My husband and I were both state employees on a monthly salary at the time we bought the property how can and why would our income change? It should not have. Lot 3 has been foreclosed on in XXXX of XXXX. You stoped receiving mortgage payments XXXX of XXXX. You have not attempted to evict her as you have done so to me. You know that lot XXXX does not suffer from property abandonment yet you continue to take wrongful actions fully aware of them prior to making those decisions. Not having paid my mortgage in over a year is not a valid reason for foreclosing on me and evicting me. Its is only in pursuit in retaliation for every complaint and answer I have sought. I completely understand that I have provoked you to harm me but I do not regret trying to bath my child in water that did not have bleach in it when she is allergic to bleach. I wont apologize for that and I do not understand how my circumstances is only seen as a refusal to pay my mortgage. If there is any way that you could please release my husband and two children from the consequences of all of this I would greatly appreciate it. They are innocent and had nothing to do with the frustrations and anger that I have caused you. I tried to pursue a title claim but you won again you waited until the day after you foreclosed on me to deny the claim. How could I have sold my property and have been okay? I would have had to sell my property at an unrealistic price tag just to cover what I owed. The structural issues and inability to make repairs made it an unrealistic choice to sell. The fact that the shared well was in violation of the groundwater district rules and the inability to acquire public water utilities made it hard to sell. The fact that I had mold issues, foundation issues, and drainage issues, water damage on a brand new house made it hard to sell. The fact that I installed an extension to my driveway on my neighbors property and did not have the surveys from XXXX XXXX XXXX created an additional issue. I had no fire hydrants, my power pole was installed on another property and none of my electrical or water lines could be located from 311. I watched that house get built before electricity was even installed on the property. It was not already set up. The first time palm harbor pulled my credit Report was on XXXX XXXX. My house is located in the Wood-run subdivision that is owned by palm harbor homes XXXX Your address is listed on the documents and deeds. Making it inexcusable to have listed my house in XXXX in the first place. I dont know who XXXX XXXX XXXX however he has been a part of this the entire time. Independence title paid {$130.00} for taxes on our behalf on XX/XX/XXXX and Country place mortgage was refunded {$130.00} on XX/XX/XXXX. The XXXX XXXX surveys were not conducted in XXXX. They were from XXXX and the date was changed to XXXX. XXXX sorry but I will continue to ask questions and try to understand all of this because I dont ever want to be in this situation again. The only way for me to avoid this is to gain the knowledge and insight that I clearly needed before this happened.

Good afternoon, Complaint # XXXX Loan # XXXX Resolution Letter Response You have concluded that you complied with all applicable FHA Title II Loan Requirements. I will make certain that you correct yourself and you false conclusions. You will fully understand that you did not comply with all applicable FHA Title II Loan Requirements by the time we are done with each other. 1. ) When did you receive an email copy of the sample summary and analytical results prior to closing for the water tests done on XX/XX/XXXX and XX/XX/XXXX? Please advise before telling another lie to me that you remember I have documentation from the loan officer and from XXXX XXXX of conversations regarding this matter. So, make sure you call them and tell them whatever it is you need to fabricate some more documents with you. 2. ) The appraiser language is justifiable for the errors on the appraisal? You also stated that the invoices plus plans & specs are only provided when its a construction project and the home has not been delivered and there is nothing for the appraiser to inspect. If as you stated the home was onsite and partially completed then isnt that a construction project in action? Why does the picture in the appraisal not reflect a home in partial completion? Per HUDs notice of installation the home was installed XX/XX/XXXX and a HUD inspector inspected the home XX/XX/XXXX. As of XX/XX/XXXX from the Appraisal by XXXX XXXX, on XX/XX/XXXX it says private well, the appraiser did analyze the contract for sale for the subject purchase transaction. The appraiser states it as a new existing manufactured home. The purpose of this appraisal was to support the underwriting requirements for the FHA-insured mortgage. So, what I have concluded is that this appraiser is in your pockets because I compared the appraisal reports for Lot 2, and Lot 3 and mine. Sure, enough the same appraiser, you would think since the appraiser conducted my appraisal XX/XX/XXXX and Lot 3 on XX/XX/XXXX surely, they would know how much sq ft my house was and the price per sq foot and the comparable sales would match right? Thats not the case unfortunately and now you got 3 Lots looking for answers. 3. ) Thank you for feeling the need to explain the sequence of events to me and taking the time to do so. I now understand that you do know how it works. You state that once the final inspection is obtained the loan closing can be scheduled. After the loan is closed the lenders files for the statement of ownership. You provided the final inspection report to the CPFB in a pervious complaint and it states the final inspection date as XX/XX/XXXX thats not after the loan is closed. 4. ) You certainly let me know that I got a Title II Loan. Why did the loan officer know that? Why did I get a pre-qualification approval as an FHA-XXXX XXXX on XX/XX/XXXX? You know weve been working with your loan officer since XX/XX/XXXX right? XXXX XXXX signed the HUD/VA Addendum to Uniform Residental Loan Application on XX/XX/XXXX as Construct Home ( proceeds to be paid out during construction ) That is what is in the Lenders Package sent to the title company. 5. ) The analytical results were provided to XXXX then you wouldnt have received them until XXXX sent them but its ok I filed an opens record request with the XXXX so Ill get you that too when it comes back. Just because palm harbor bought the land from XXXX in XXXX that doesnt mean that he wasnt an interest party that should have conducted the water sampling. He was an interested party but you say he is not. That doesnt explain the fact that he was Lots 1-3 septic installer, the site contractor worker, and the land developer. Also he filed all of your permit request for the interest parties He also is developing 37 more lots. He also went into litigation with XXXX XXXX XXXXXXXX and filed suit against the interest parties. He signed a NDA. I got his estimate sheets too. 6. ) Regardless of whatever you say regarding the shared well it wasnt what you submitted in your lenders package to the title company. How are you going to prove that the public or community water supply system wasnt feasible? I filed complaint with the XXXX and that was absolutely not the case. Where is the Appraisers report then of the availability of the connection to the water supply system? 7. ) If you acted as the interest party then you should absolutely demand the well log since you are proving financial interest in the well. 8. ) Its ok that you didnt give me the detailed work and estimates I got that from lot 3 and I have their closing recording. Whats crazy is that you did disclose to them the situation, but you lied to lot 1 and lot 2 why is that exactly? Becoming a property owner after 40 years is supposed to be one of your greatest achievements. I took opportunities, chances, and acted diligently. Mistakes were made that jeopardize everything I have worked so hard to earn that I am not responsible for. This situation should have never happened to me and your response is unacceptable. I will not comply with being taken advantage of again. My forever home has been jeopardized, invalidated, and the trust we agreed to per the contract was breached. I deserve and demand a stable, affordable place to live and will not negotiate with you anything less than what you are responsible including all remedies entitled to me to obtain what I was promised in the contract. It was not my responsibility to prevent this incident from occurring it was yours. Remember that this might be just your job, but this is my family 's haven. This for me is supposed to be one of the safest places for my children. So, XXXX you. As the responsible party, it is your duty to fulfill all that is owed to me. I am unwilling to act or contribute to the recovery of your negligence, and you will suffer the legal consequence. Today I went and watched my house get wrongfully foreclosed on by the Mortgage XXXX. The Deed of Trust {$230000.00}, That I signed was supposed to have improvements completed, easements included, and I was to be given notice of a New Loan Servicer. I WAS NOT. On XXXX XXXX stated that the loan file ensured that all inspections occurred and were following HUD handbook XXXX with the included HUD Handbook XXXX pages attached. The well could have been connected to the community water supply. The well does not meet the required continuous supply of water to each dwelling and the water is not safe or potable. Was there an inspection done to ensure that the was inspected? What test results do you have that show the well meets the XXXX XXXX XXXX Drinking Water Regulations? For the OSSF we were required to have One acre now we have XXXX so we dont meet the local health standards If the appraisal report or inspection could not be done with the home construction completed as XXXX XXXX on XXXX then where the prepaid completion escrow requirement money is? XXXX XXXX XXXX CFPB Complaint # XXXX : The water samples were not emailed to you prior to closing. If the Appraisal took place on XX/XX/XXXX and the XXXX got a copy of the XXXX to XXXX family contract because the home was partially completed why are the HUD XXXX labels on it stating it I completed? How did the appraiser even find the home if they thought the address was XXXX, TX? And why would the XXXX XXXX contract from XX/XX/XXXX state the {$230000.00} appraised value And if the Appraiser signed it on XX/XX/XXXX then the The Appraiser could not have gotten the shared well agreement if it had been completed and filed with the county on XX/XX/XXXX. Neither could the appraiser get the water test results if they were done after the appraisal was completed. You can not say that the home was already installed on the property in number 8 and in number 2 state the home wasnt completed when the appraisal occurred. Attachment 1 : representing that the home and improvements would be 100 % complete and that the water for the Property would be supplied by XXXX XXXX XXXX XXXX. Attachment XXXX : The well and power supply for the shared well are located and controlled by XXXX XXXX who has failed to pay his power bill numerous times, leaving our families without water for extended periods of time. There is the extremely low water pressure and the flow rate from the well does not meet the required XXXX gallons per minute flow rate or the pressurized storage of no less than XXXX gallons to each dwelling. Attachment XXXX : On XX/XX/XXXX, a survey company called XXXX XXXX XXXX ( A & A ) conducted a survey for a XXXX XXXX XXXX XXXX XXXX XXXX situated in the XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX for the three platted lots located in the XXXX XXXX XXXX XXXX XXXX. XXXX XXXX 's property, Lot XXXX, the XXXX property Lot XXXX, and XXXX XXXX 's property, Lot XXXX. The XXXX buyers were required to incur all costs associated with the construction, installation, material for the well, and surveys conducted for a XXXX XXXX that was not permitted to supply water to our properties. The costs incurred for utility XXXX by the buyers were not disclosed on any loan paperwork because the property was sold to XXXX XXXX as an REO/SPEC home. The costs paid for the installation and materials of the well are also unknown. The costs associated with the survey where the easement was split amongst the XXXX buyers XXXX XXXX, the XXXX, and XXXX XXXX for a total of {$2500.00}, Attachment XXXX : The Well is in violation of the Lost Pines Groundwater Conservation districts rules and regulations 3.1A ( 3 ), 5.1, and 5.2 and the Texas Water Code, section 36.117 ( j ) unpermitted to service our properties with water required by Chapter 232, Local Government Code. and was not permitted to supply water to other properties. Attachment 8 : Over the time of two years multiple water samples were taken to evaluate the water quality and water standards of the propertys drinking water. None of the results complied with the requirements for the standards of safe drinking water or safe levels of contaminate levels. XXXX XXXX has added excessive unsafe levels of bleach to the well over a two-year period and installed the fences that block off all access to the easement. Attachment XXXX : On XX/XX/XXXX, XXXX informed XXXX XXXX that for her to obtain its water services she could step in as the developer and pay the applicable fees necessary to make the entire development compliant. The preliminary costs summary XXXX provided to the developer was a total of {$110000.00}. XXXX XXXX had already paid for the feasibility studies from XXXX to provide water to the XXXX XXXX XXXX XXXX XXXX XXXXr completed the study in XX/XX/XXXX. In addition, XXXX XXXX paid all legal fees and XXXX passed resolution XXXX in XX/XX/XXXX approving the feasibility of providing this water service. All the XXXX Services Applications and permits submitted to XXXX XXXX indicated that the property 's water source was public water system listed as XXXX. This is actually a very complicated complaint with a long list since I only just recently learned about this. I have had nothing but issues from the company and have since been kicked out of my home wrongfully and need help to try to get back in it. I would really prefer to talk with someone as the list is very long. I will briefly describe here. It really truly started when getting the loan in XX/XX/XXXX. I was told we would be in by XXXX, then it became XXXX, then XXXX. I barely got into it right before XXXX. I had over 10 % down and was told I wouldn't have PMI insurance. The company said oh we still charge it for the first five years. During parts of the loan financial issues were experienced and I asked to look at a refinance and was told we wont help and no one will. I also told them one time when a payment was a few days late that I could pay 1/3 of the payment that day but wouldn't be able to pay the remaining amount until the end of the week. They wouldn't take my payment saying that wont do anything. I started not receiving monthly bills instead received them maybe every couple months. Fast forwarding to XX/XX/XXXX, I sent a payment and realized after it was mailed that my bank account had been hacked. I called them explaining what happened and asked if they could hold the check. They started that they had not received the check and they couldn't hold it. Before I could get it cancelled with my bank, they cashed it and received payment but had my account severely over drafted. I during this year received foreclosure paperwork stating that i was six months behind which i knew wasn't true because i had recently switched jobs and cashed in retirement to fill in any down period of money flow. I paid them the amount that they were claiming and never saw anything on my bill about foreclosure fees which were totaling XXXX. I continue to make payments and inXX/XX/XXXX receive further foreclosure papers stating that I was once again six months behind. This again was not true. I had receipts to back it up. I explained this and they said well we never received it. So I pay them what they are claiming is owed. I emailed them asking if I could work out lawyer fees since all of a sudden the old ones appear on a bill that I received in my sporadic Bill 's being mailed. I was told absolutely. When trying to work out something they refused to do it saying that they wouldn't. I would email them so that I would have proof of conversations and all of a sudden during this they no longer communicate through emails. They refused to accept my payments once I tried tonwork out lawyer fees with them and claim that that's not what they said. Their documentation of conversations has proven to be very sketchy at best. During the loan, I would get calls from them but it was for a completely different person. I'm not n.j sure if they were applying my payments to this person or what. They also let my house insurance lapse and I had to find new insurance. So in the not accepting payments, they bought the home in foreclosure and evicted me when they refused to accept my payment. I tried to find a lawyer during all of this. Every lawyer said this is a case and a complicated one but no one would take it. After they bought the house, I knew nothing of it and qould still receive spontaneous bills up until XX/XX/XXXX when they informed me that they had bought it and were evicting me. I asked them what it would cost to stop this since they haven't wanted to work with me at all. They tell me two days before I was supposed to be out a price and expect it to be there the next day. Which of course was insane so they kicked me out. There is more that I just am not thinking of right now. They have also gone through and change reports that are as far back as two years old on my credit trying to make it look bad in me. They, at one pontx correctly reported the payments that they claimed I hadn't made and changed them later to look like I didn't make them. They are also still filing against my credit after they evicted me saying that I'm over 150 days behind on payments, XX/XX/XXXX currently shows me as being 150 days late. They are doing some extremely crooked and fishy things that need to be stopped. This has apparently happened to others as well looking at this site.

On XXXX CountryPlace Mortgage ( CPM ) Provided me with a Pre-qualification Loan Approval with a total appraised value of {$230000.00} the appraisal wasn't even completed until XXXX. On XXXX XXXX also had me sign a conditional commitment endorsement of the appraised value for the appraisal that took place later. All of the comparable sales listed in the appraisal are homes owned, created by, and financed by XXXX or XXXX XXXX. the developer is the property owner the home seller 's listed agent, the septic installer, the site, the XXXX worker, the neighbor, the electrician, the installer, and the builder. I have a XXXX. that clearly states I'm in the home seller 's old development called the wood run subdivision. Also, how can yall mess up the town I'm in when you developed the wood run subdivision right next door? My property does not meet development requirements for XXXX XXXX or The XXXX of XXXX and my property should not have been occupied until it meets at least XXXX of the local government 's requirements. The development applications that were submitted and the permits that were issued were required to be completed for what they were approved for but they were not. The XXXX was issued under a XXXX XXXX permit on XXXX yet the construction took place months before the permit was issued. My electrical distribution system was not approved and is still not on my property. I am unable to acquire public water utilities and the groundwater district deemed the shared well in violation of the rules and regulations standards and no inspections were conducted. The manufactured home that was installed in the property was done so incorrectly and inadequately to withstand its intended purpose. My XXXX XXXX is a fraud and it's just a numbers game I'm almost done figuring out. My mortgage needs to be voided. My children need to bathe in water that won't give them XXXX infections. I can't continue to pursue a water tank for potable water so that I can ensure my kids are safe until I know that the mortgage company will stop the foreclosure on XX/XX/XXXX. I cant just leave out of fear considering you hit my credit and I own my own business and it's my first year so I cant just go find somewhere else to live. We still can't get public water at this time so at what point are you going to admit that you are intentionally and at full force inflicting pain and suffering upon my family? You sought to foreclose on me on XX/XX/XXXX, XXXX, and XXXX, and XXXX in XXXX of XXXX. I came from nothing and I'm fine with having nothing and losing everything. If you want XXXX to drag me out of my house and my family to lose everything then that's what we will do. We arent going to move twice. Its better to suffer a complete loss than to accept defeat. XXXX, the title company, and the home seller need to be on the same page. since you are all XXXX XXXX. You have sent different documents from each entity which makes everything come into question. please establish which document out of the multiple documents you sent is correct. My statement of Origins, application for statement of ownership, and hud forms don't even match up to anything you claim. At what point do you stop before this becomes a class action lawsuit? i already enough properties from the XXXX XXXXXXXX XXXX and the XXXX XXXX and the other individuals that have reached out to me from social media for help.

Where do I start? My wife and I decided to build our forever dream home however this was ripped away from us. We have been in contract since XX/XX/XXXX for the land we've always wanted. I submitted all my paperwork to XXXX XXXX of country place mortgage shortly after. My credit score wasn't where he wanted it to be but " we had time and will pull at a later time '' is what he stated because we had a closing date of XX/XX/2021, ( well over 90 days ). At the beginning of XXXX, my credit was where it needed to be so we started the process for approval. I was approved by XXXX with XXXX having all the documents he needed. About 45 days out is where we started to run into issues with XXXX. Specific timelines for items he needed to get done were not being met to which XXXX made several excuses. His lack of communication on what he needed and the response times of email averaged 3-4 days and he hardly ever answered his phone. This became a trend throughout the whole process. We had several issues with the appraisal but were able to get that worked out. Underwriting then sent all items to the VA for approval. Everything was approved by the VA and sent back to underwriting one week before XX/XX/XXXX. A few days prior to XX/XX/XXXX ( closing date ) XXXX states we will not make the XX/XX/XXXX it is " still at final underwriting ''. We have to extend our buyer 's agreement with the seller since we have now gone past XX/XX/XXXX. After several back and forth emails, on XX/XX/XXXX XXXX says we will be clear to close by Thursday, XX/XX/XXXX. Everything is good to go finally. Thursday goes by and we do not hear from XXXX. We email and call several times with no response. Friday he finally answers late in the afternoon that there is now a denial from the VA. XXXX states on Thursday the VA denied it but failed to tell us until Friday. The original submission went past its date and " underwriting had to send it back to the VA ''. XXXX says " there's a problem with the system and it's giving us a denial. '' Monday comes and still no word from XXXX on what's going on. Several questions were asked by several people in an email chain to which XXXX does not answer. Eight days later, XXXX continues to not answer any emails on what the denial is. Throughout the whole process, XXXX took several days to reply to emails and hardly ever answered his phone. I can forward all emails for all the conversations we've had with him and his response times and excuses he would continually make. XXXX mislead, lied, had a lack of communication, lack of transparency, and was unprofessional during this whole process. XXXX is clearly incompetent in his job. Throughout most of the process, we included the regional manager XXXX XXXX in the email traffic to which he NEVER responded. I started looking up reviews on country place mortgage and found several complaints about XXXX specifically and his lack of communication, lying, and several other issues. I am not the first person he has done this to. My wife and kids now sit here with no answers and no dream home. For XXXX to do this to a XXXX veteran is disgraceful.

My husband and I bought a home from XXXX XXXX XXXX in XXXX of 2023. We had worked hard with the help of their salesperson to make sure we could put the house on my parents land, including both myself and the salesperson calling the county to make sure there were no issues or restrictions to put the house on the land. The salesperson constantly assured us that everything was perfectly fine moving forward and as part of the sale paperwork, we signed a document saying the salesperson had not helped us with land issues or deed issues, even though we have plenty of text messages showing otherwise, we didnt think it was a problem. The day after the house was delivered we were told by my parents neighbors that there was a single restriction from the oldest land deed stating no mobile homes shall be permitted on the land and that even though it is not stated on my parents property deed that it carries down and is still a valid restriction. After informing XXXX XXXX of the situation they continued to urge us to finish drilling and setting up utilities and that everything was fine because the neighbors cant actually do anything because its not a mobile home, its a manufactured home. Despite XXXX XXXX urges to continue from both the manager and the salesperson, we put a hold on eveything and decided to talk to a lawyer to see what we could do as we had heard that they neighbors were possibly willing to go to court to have the house removed since it was in violation of the property deed. After talking to a lawyer, it was discovered that yes the restriction is still valid even though the argument would be on the definition of mobile home and whether or not our house would be counted as XXXX by definition or not and if therefore could stay, but since the deed and wording is undefined and unclear that it was a grey area with no clear win. Instead, it was suggested we talk to the bank who financed our loan, CountryPlace Mortgage, and XXXX XXXX about cancelling the loan or having them resell the house to get it out of our hands. XXXX XXXX had all but washed their hands of us and refused to help us and give us any information, continuing to tell us that we should continue working towards moving in and that the neighbors were just trying to scare us, despite sharing the deed information with them as well as what the lawyer had said. We attempted to talk to the vice president of XXXX XXXX XXXX XXXX but he would only say he cant do anything and to continue talking with General Manager XXXX from the XXXX XXXX location we had bought from. Country Place Mortgage has also been unhelpful when providing resources and information during this process, refusing forebearance and not offering information on short sale or even resources for how we can get help for the hole my family is now in. My husband and I are not only paying mortgage on a house that has no utilities and can not be lived in but apartment rent as well and it seems that no one is willing to help us.

I was trying to get some assistance with some issues we've been having but I think I've reached my breaking point with you guys. This whole first-time home buyer experience and the lack of respect by trying to offer me a 1-800 number is the final straw for me. I'm just giving you a heads up on my next steps moving forward. I almost am at my one-year mark and was doing my due diligence and homeowner obligations and I hate to admit this but you guys have been the worst lending builders ever. I hope moving forward with your community that you will ensure better expectations for yourselves and provide your customers better service. Issue 1 : Water Source. Did we pay for XXXX to come out and put city water? We have a community well shared with 3 lots however one of the residents and the developer have been going back and forth on the sulfur smells. This has resulted in some serious water quality issues and a lack of proper water maintenance. The amount of bleach going into the well is unhealthy for our health and is so strong that you can turn on a sink and smell it through the whole house, it burns your eyes, it ruining our clothes. No one has the knowledge and authority to regulate the well so people are just adding bleach in excessive amounts. However, I will/am going to file a report with the XXXX. I also discovered that my sewer sprinklers are not in code according to the XXXX. I have a creek in my backyard and my sprinklers aren't far enough away from my creek so thank you for that XXXX also. I'll figure it out with the XXXX. Issue 2 : The Powerpole isn't up to code per the XXXX I guess bluebonnet is responsible for that? XXXX XXXX XXXX who conducted the surveying for the easement. What are we supposed to do about that? Issue 3 : My house appraisal value is not accurate based on the provided inspection given to my lender that was performed by XXXX XXXX. Issue 3 : The AC and the thermostat, also not in regulation the thermostat is installed too far away from the return air. Other issues : Our neighbors home was built and you guys forgot to install water spickets and still haven't addressed this. Their roof was also leaking the first week of living there and it was a new build. the land developer assumed that you guys were increasing the prices on our contracts that he charged you and asked us to see our receipts. For example, the price for the easement was {$900.00} for the fieldwork and {$650.00} for the exhibit. This definitely brings up concerns for us as a homeowner as I'm sure you can understand. There are many more issues and concerns but I guess I need to just contact the Federal Housing Administration, the XXXX, XXXX, XXXX, and whoever else I can bring this to attention and ensure that the other 37 lots don't result in the same disappointment as my family has had to suffer. I owed XX/XX/XXXX - {$660.00} paid & posted XX/XX/XXXX ( countyplace collections dept XXXX in Collections took payment over phone ) and I agreed with her to pay XXXX payment on or before XX/XX/XXXX well I paid it as agreed XX/XX/XXXX electronic Ach payment with receipt confirmation payment posted XX/XX/XXXX my bank transaction # XXXX - unbeknown to me why but Countryplace refunded {$660.00} mortgage payment back to my checking account on XX/XX/XXXX no return description of why no phone call and no mail correspondence explaining this action. this put my mortgage account two months in rears I also paid late fees separate for the XXXX and the XXXX late charge. in amount {$35.00} this too was returned. I had sent paperwork as I was attempting for the second time to file for loan modification, however in doing all I could to reduce my debt I was able to reduce my homeowners insurance from {$1400.00} almost {$400.00} a year to {$1100.00} yr and my property tax from {$340.00} a year down to {$100.00} therefore my mortgage Priniciple and interest being {$410.00} monthy and by adding Tax and Insurance my new payment monthly would be {$510.00} monthly affordable enough that I could put it back on automatic payment from my checking account. and remain on tract. However I am told by Countryplace that they will not intervent for me, an individual to make any such adjustments until my Loan anniversary which is XX/XX/XXXX. I asked that if there were to do a loan modification would that not be doing changes on an account on an individual basis? Well approximately 60 days from now thereby I told them it is no need to do a loan modification. I will continue paying as I can and be relieved when they adjust my mortgage XX/XX/XXXX. So now they are returning my mortgage payments and I want to know why. So why would they return my payment at a time when I am struggling to keep catching up payments. Are they trying to force me into foreclosure? I was supposed to be shut off from the well on XX/XX/XXXX because the well is in violation of the laws and regulations. I can't get public water yet either they can't even accept our applications. You guys made me pay for water whether it is the well or the public water I can't have either one. In addition to this, why did I have to pay for the survey and XXXX XXXX for it not to be included in the documents filed with the county? Why did you decide to go through another foreclosure on me after I submitted a complaint to the savings and mortgage lending department? Was it because the loan originator was cited in the wrong for the 1 to 4 contracts he should have had a part in? BTW my loan should have been around {$210000.00} but then you should also take off the cost of whatever they were since I don't have any improvements. You instead used the first prequalification letter & earnest money contracts to just add costs to my loan. You gave me 3 closing discloses, and 1 loan estimate, made me sign two Form 4506-T forms for a credit pull, and how am I going to sign a settlement statement for a house that says it's in XXXX, and then you guys switched to XXXX? Why do the Additional dates per state requirement say : XXXX on the XXXX statement for XX/XX/XXXX but not on the XXXX statement that is on XX/XX/XXXX? Also, there's no way I could sign page XXXX of XXXX on XXXX and on the XXXX page XXXX of XXXX printed on XXXX, that's ridiculous especially when in my closing recording they clearly mention that there was no escrow XXXX even present so what the XXXX? But you guys are smart and since the title company is in XXXX, TX I can't get any information from the XXXX location. I have never even been to the XXXX location. And why did I sign a new construction statement on XXXX for a house that was an REO/SPEC home that wasn't a XXXX home? Isn't an XXXX like a foreclosure HUD or bank-owned home? Country Place Mortgage has failed for the second year in a row to make timely payments from escrow for my hazard insurance, resulting in cancellation of the policy. We have been trying to rectify the situation for four days now, but leave messages with no return call, or when they do answer, feel as if we are getting the run-around. I was finally able to talk to a supervisor. She blamed it on the fact that the company switched insurance trackers in XXXX. When I asked if they swapped companies last year because it happened then, too, the system was down so she could n't check. I refused to hang up and said I would hold. She finally got back to me, though the system was still down, with the reason being the insurance company only billed for the minimum amount due. ( ..last year they never received the bill. ) They are n't able to make partial payments and must pay the full amount. They cancelled the minimum payment, and, since the bill was only for the minimum amount and they did n't know the total amount due, no payment was made. She could n't explain why we were n't contacted, just that it is n't the customer 's problem to have to deal with. I asked what would happen if disaster struck. She answered they had a blanket policy, but could n't assure me that my interests were protected with that policy or just her company 's. When I asked about last year 's issue, the excuse was that they did n't receive a bill. Before I got off the phone, she assured me a credit card payment was made on my behalf, but could n't give me a confirmation number, rather they would email me with the information. I have n't received that yet. I have done a little research and it seems that there are rules in place to make sure that timely payments are made. I interpret that to mean " on-time. '' I inquired about what I could do to be responsible for the payment myself, but she informed me that, per my loan, that is n't allowed. What can I do to make sure this does n't continue to happen? To make sure that my property is protected in these types of instances?

CountryPlace, Please explain the following items : In your response to my complaint on XX/XX/XXXX, you attached a One to Four Contract that does not include every signature and/or the Certification of Completion. Why is that? You are missing the Title COmpanys signature and the Sellers Wet Signature. See attached. How is Country Place NOT a part of the One to Four Contract if you created the document requesting me to sign it? One signature is from the title company, one is from you, and one is I had, and one is the only one I can say can be somewhat valid because it has a certificate of completion. Also, I got quite a few Closing Disclosures and this is my first time buying a house. Can you please confirm if we're using the Closing Disclosure from XX/XX/XXXX? that the Closing Disclosure you provided to the Title Company. Also, you sent a Closing Disclosure to the CFPB dated XX/XX/XXXX. WHAT ABOUT THE CLOSING DISCLOSURE FROM XX/XX/XXXX? The one from XXXX has a certificate of completion. ( see attached ) Why did we have to sign so many different closing disclosures is that normal? How come we or you had to pay for the XXXX XXXX XXXX Surveys? What about the XXXX XXXX ones? Why did the same appraiser who did my appraisal do a lot 2 and lot 3 also? If you had the XXXX XXXX Information how come you did not provide this to the title company or to me or the CFPB? We would have liked to know there was a whole XXXX XXXX Agreement. How come my house was sprayed for termites whenever you should not do that considering the well thing? How bad is that for my family 's health? How come XXXX the Site Contractor worker, the developer, and the septic installer were not disclosed to me? How come XXXX XXXX was not disclosed to me? And why did she list my house for sale after I bought it? How can I get the construction costs? I would like to know how much we paid for the well and everything? Haha, Corrections from my response Looking at the XXXX XXXX you gave me from XXXX & XXXX that you said I had a " gift deposit '' on the XXXX XXXX in the amount of {$2700.00}. So if you add {$590.00} ( what you said I had to pay to close ) the total amount is {$3300.00}. If you take the {$3300.00} that you said " paid outside of closing deposits on the XXXX XXXX XXXX the {$3300.00} that's only a {$34.00} difference which is pretty close! You can't change my bank statements. Now with that and the fact that there are little differences such as the Owners Title insurance on the Disbursement sheet from the title company stating it was only {$100.00} but on the XXXX it's listed as {$1500.00} XXXX bet I can come up with exactly how much " seller credits '' I actually got. In XX/XX/XXXX my wife at the time and I purchased a manufactured home. Country Place Mortgage held the loan. XX/XX/XXXX I separated from her and moved out of the home. At that time she had agreed to pay the mortgage payments. Sometime after that the home was repossessed. I learned of this in XXXX XXXX I believe. Each year since I have tried contacting them to determine what the home sold for and if they were going to issue a XXXX to the IRS. Phone calls have not resulted in anything other than them telling me they have time to decide what they are going to do. They will not even tell me what the home sold for. I have since learned the home was re-titled XX/XX/XXXX to a business or leasing company. Currently they are reporting I owe {$75000.00} to all XXXX credit bureaus. This amount does not reflect properly even if the home was sold for {$1.00} I have recently obtained court documents that show they " served '' me via a 3rd party. The server states they asked if I was an XXXX XXXX Service Member of The U.S or New York and received a negative reply. I am in fact currently on XXXX XXXX in New York and was at the that time as well. Country Place WAS aware of this as I had sent my orders and a copy of the NYS Patriot Plan. I fully understand I will likely owe something regarding this as will my wife as it is a joint account. I am hoping to be divorced as soon as possible. I just need to know how much is pending and if or when they will issue a XXXX to which I would need to pay income tax on. This situation is now causing issues with my security clearance. I had thought I was handling this properly by reaching out to them yearly to ensure whether or not a XXXX was issued or to determine exactly what was owed. I got behind on my mortgage and was told my family and I needed to vacate the home immediately two years ago. The home went to sheriff 's sale in XX/XX/2019 and the bank ( Country Place Mortgage ) purchased the home back. In XX/XX/2019, I was sent an application to apply for mortgage assistance by XXXX XXXX with CPM. I returned the application and required backup documentation the beginning of XXXX ( it was emailed to XXXX XXXX, via a HUD housing counselor with XXXX XXXX XXXX XXXX ). Multiple attempts to verify that the application was received have been ignored. Our housing counselor has attempted multiple times to receive a return phone call from XXXX XXXX or someone by the first name of XXXX and has never received a phone call back. We have not received acknowledgment that our application was received and we can not get anyone to return our phone calls. Yesterday, when my wife called to check on the status of the application, she was told by a customer service rep that assistance was denied. We have not been informed of this by mail or by phone call. The rep told my wife that CPM is not obligated to inform us if assistance was denied or not. Yet, the letter we have dated on XX/XX/2019 stated that we should received a confirmation letter that our application was received. We can't even get a phone call to tell us that the application was received. The customer service rep also asked my wife if we had a packet to apply for assistance. This is the very packet that we have submitted already and can not get any information on. The runaround is not professional and we need answers.

I would like to know why I " signed '' an appraisal acknowledgment waiver on XXXX stating that I didn't have to be provided a copy of the appraisal 3 days in advance of closing and then an appraisal acknowledgment on XXXX stating that I received my appraisal 3 days prior to closing for a house in XXXX, XXXX. The only one I got was on XX/XX/2020, from XXXX XXXX stating that the house was in XXXX, XXXX. Our preferred XXXX agent stated to XXXX XXXX that the appraisal had nothing to do with insurance replacement costs and provided the mortgage company with a XXXX valuation report. The insurance agent could not get the mortgage company to disclose the price of the home and we could not get alternative home insurance. On my Closing Disclosures from XXXX, and XXXX the location stated XXXX, XXXX. XXXX the Closing Disclosure stated XXXX, XXXX again. The total Closing Costs paid at Closing ( J ) on XXXX were {$19000.00} On XXXX they were {$1400.00}. On XXXX they were {>= $1,000,000}. I could go on and on and on about the issues. Im just trying to figure out what happened and why I'm being punished for all of this. In XXXX 2015, I called Countryplace Morgage to inquire about a home loan. I explained all my financials and property information. I then formally applied for the loan after, XXXX ( loan officer ) told me that I DID qualify. I was formally rejected on XX/XX/2015. XXXX suggested to me to apply again with a coborrower this time, so I applied again with my Father in XXXX 2015. My wife and I closed on the sale of our property located at XXXX XXXX XXXX XXXX XXXX XXXX, TX XXXX on XX/XX/2021. Our mortgage company for that property was CountryPlace Mortgage. I was informed that I would receive my escrow refund after approximately 20 days. I had not heard anything further from them [ CountryPlaceMortgage ] until I contacted them on XX/XX/2021. I was told that the escrow check had been approved on XX/XX/2021 and was supposed to have been mailed out to me soon after. It took me a whole year to figure this one out. On XXXX we put in a XXXX XXXX loan application with XXXX in XXXX XXXX. We were denied on XXXX and then approved on XXXX because the home was not already set up on the property. So they had us fill out another application and approved us through country place mortgage. On XXXX the revised loan proposal for a " XXXX XXXX '' and earnest money contract. The loan officer made us sign another earnest money contract and pay the down payment on XXXX. We gave the loan officer our insurance agent 's information and he based the quotes on our appraisal and prevented us from getting other insurance. On XXXX the loan officer mentioned the new construction items we had but still considered our new build home a construction home. Upon reviewing the Apprisal Documents the comparable houses that were used were all own, sold, and created by XXXX or XXXX and wrongly listed that they were sold in the time frame that they were. Some of those homes are still owed by XXXX. I am located in XXXX 's old XXXX the XXXX XXXX. Refinanced with another mortgage company. The payoff statement said the escrow balance was XXXX. The payoff amount included the principal balance, interest for the month, and the PMI payment for the month with a payoff date of XX/XX/XXXX. Attorney sent proof the check arrived in their office on XX/XX/XXXX. The company said the payment was not processed until XXXX. The payoff said I would receive a paid in full letter in 5 days and my escrow check within 20 days. In speaking with the company I learned that they have been taking money out of my escrow to cover interest and PMI even though they shouldn't have charged me anything after XX/XX/XXXX. Today is XX/XX/XXXX. I still have not received the letter and have not received a check. I spoke to them on XX/XX/XXXX and they still have the wrong escrow balance and they told me they would get to the bottom of the issue and call me today, that I did not need to call them back. They did not call me. I should not have to report them to get money that is rightfully mine. No one should have to go through this.

MIP was increased a second time without any notice. I realized online while trying to pay XX/XX/XXXXt due mortgage premium. I would like to protest the MIP increase until I have a detailed notice with increase calculation and the option to verify my tax and insurance payments. In the past, I have been able to lower my insurance premium and still meet the mortgagor 's guidelines for coverage. Also, the last time my MIP was increased it was in the thousands of dollars due to Country Place Mortgages ' error, and I had to contact HUD to advocate might rights. Country Place Mortgage has not taken any action to remedy the errors and hardship they cause consumers. Country Place mortgage improperly reported me negative on my credit and I had to involve HUD yet again to get them to remove the negative rating. This company continues to cause me undue stress and I would ultimately like to have my mortgage moved to a lender that actually provides customer service and has a vested interest in their customers. I was told that I was supposed to be put on a community well until the city water become available. It has been 11 months. During this time other people got moved in on this " community well '', My animals got sick, My kids got sick, my clothes got bleached, my health was affected. this is an on-going problem with this company. I live in a XXXX XXXX XXXX and if the lot rent is not paid by the XXXX - their late fee is like {$100.00}. My mortgage late fee is {$5.00}. I only get paid twice a month so I paid the lot rent on my first pay and the mortgage on the 2nd pay of the month. I never go over 30 days. Countryplace Mortgage is reporting to XXXX that there were late payments on a mortgage I held prior to my bankruptcy in XXXX, and foreclosure was not completed until XXXX.
