On XX/XX/2019, I initiated a search on Clay Cooley of XXXX XXXX website. I immediately got an email and phone calls started right away. I talked to one person and explained my financial situation and also described my trade in. I was assured that they would be able to get me taken care of. She explained they have fresh start programs and that they are giving maximum trade in values. She specifically told me they give more than what the car is worth through the month of XX/XX/XXXX. I told her my payoff balance was around {$11000.00}. I had it written down on a piece of paper when I got there. There was really bad weather that day and there were hardly any customers there besides me. I met with the sales person I was told to ask for. She got some information and I told her that my tradein was in my son 's name as he got the car in his name since I was going through a divorce and my credit was not good. I told them I wanted to try to get a vehicle on my own to build my credit. Later she came back with another salesman. They advised me that it would be best if I buy a brand new vehicle versus the used vehicle I looked at online. After some talking, they came back with payments of around {$1000.00} a month. I had already explained that I was divorced and only had 1 income and a little bit of spousal support that would end in XX/XX/XXXX. I had already told them my budget was in the {$400.00} - 500 range. My current payment was only {$360.00} and although I knew I would be challenged by my credit, I was willing to try to get a good deal. Unfortunately, they both told me it would be better if I had my son on the loan as a cosigner because of his credit and income. I called and asked my son and he said ok as long as I could refinance within a year like the salesman told me and then I could be on the loan by myself after I've had months to build my credit. After more time, they came back with a payment of {$580.00} a month and explained that if I pay half of the payment before the due date and the other half on the due date that I would save in interest, etc ... ..I was still uncomfortable with a payment that high because again, I only have one income and I felt like that would be really stretching my budget. That would be a {$220.00} difference. After they spent more time convincing me that I could do that, I thought maybe I can do this if I cut out any extra expenses but as it was, I was just getting by with what I was bringing home. My rent was going up to {$880.00} for a 1 bedroom and I was a bit worried about being able to pay all my bills. While this is going on, there was bad weather outside as well. At this point, I feel like I should have asked for my car keys back and left. But I also wanted to have the payments I had been making to benefit me too since I was paying on time every month on a vehicle that was in my son 's name. I wanted a fresh start to build my credit up and to be my own person now that I was divorced after 29 years. Finally after being there from XXXX XXXX, it was already XXXX XXXX when another gentleman called me in his office to sign the paperwork. Again, very few people in the dealership and at this point I was so ready to go home ... .the person pointed to where I needed to sign. He said " I have good news for you '' ... .we got your payment down from {$580.00} to {$540.00} because we added gap insurance and a full 5 year warranty. He never pointed out how much I was getting for my trade in. The XXXX only had a little over XXXX miles on it ... .I can't remember the exact mileage but it was not over XXXX so it was considered a low mileage trade in. He never pointed out the price I was paying for the new vehicle. He did tell me the the APR would be 10.60 %. Because it was so late, I felt rushed and then they wanted my son to drive 30 minutes from XXXX to XXXX ( in bad weather ) to sign his part. Then they said they could have someone drive out to his home to get the documents signed so they did that. They arrived at his residence around XXXX XXXX and I had to tell the guy to let me know when he arrived and not to ring the doorbell because they're baby was asleep already. After that, I never received any copies of the paperwork. I had no chance to look over what we signed for. I called several times ... .I emailed the girl who had been emailing me daily to get paystubs for my son ... .all of the sudden, she was not responding when I needed something. I kept asking when can I pick up my copy of the paperwork. Another week passed and I decided I needed to stop by the dealership to get paperwork. By this time, it was already XX/XX/XXXX and we signed on XX/XX/XXXX. It took about 30 minutes for them to locate the information and basically they printed off of a computer. The paperwork I have in my possession has not signatures on it. I thought this was weird because we always got copies of the signed documents for all the other vehicles we've purchased in the past. Today is XX/XX/XXXX and I still don't have the full copies. Now, in looking at their website ... .the same vehicle I purchased is showing on their website as " the price you pay '' anywhere from {$16000.00} to {$17000.00}. The sale price that shows on my paperwork appears to be the MSRP price of {$21000.00} and that is supposedly after {$3700.00} rebate was deducted. The contract shows the amount financed is {$28000.00}. I have been researching and I'm definitely paying way too much for this vehicle. All I wanted was a fair deal. The math is all over the place. Sales price : {$24000.00} Amount Financed : {$28000.00} After {$3700.00} rebate = cash price {$24000.00} Trade in value : {$9000.00} - tradein payoff : {$11000.00} - difference of {$2400.00} Taxable amount : {$12000.00} and sales tax : {$750.00} Am I correct that this doesn't make sense? For that much money, I should be driving an XXXX XXXX or XXXX ... I purchased a 2019 XXXX XXXX ... the base model. Not an XXXX or anything fancy. To add to the bad deal I got, it took them almost 4 weeks to pay off my trade in. I had to call several times about that as well. They promised me a good trade-in value and said to go in and ask about their specials. Their website is showing the 2019 XXXX XXXX XXXX for under {$20000.00}. I am wondering why I'm paying way more even by having my son on the loan with his good credit. Please help me figure this out. This is the first time I've had a very bad experience. I was there over 4 hours and I wished I would have questioned them more or had them explain the contract better because I might have just kept my own car and kept shopping for a better deal. They sugar-coated and over promised stuff and did not deliver. I did not get even close to what they were telling me I could get for my trade in and put full price on the contract. I hope this dealership changes some of it's ways.

The dealership has modified the contract without my knowledge and/or consent. XXXX XXXX XXXX XXXX has the original contract that shows incorrect lien holder, they received it on XX/XX/XXXX, XXXX XXXX WAS NOT listed as the lien holder on the original contract anywhere. On the original contract shows XXXX XXXX as my lien holder on every page that was signed and that is NOT the correct financial institution that funded this contact. XX/XX/XXXX, a pre-approval was issued by XXXX XXXX XXXX XXXX so I went to XXXX XXXX XXXX in XXXX on XX/XX/XXXX, presented my XXXX XXXX XXXX XXXX XXXXXX/XX/XXXX, I purchased XXXX XXXX XXXX XXXX ( VIN : XXXX ) from XXXX XXXX XXXX located at XXXX XXXX. XXXX XXXX, XXXX, Texas, XXXX. The vehicle was FALSELY ADVERTISED online as a pre-certified. The dealership DID NOT DISCLOSE prior history of the vehicle at the time of purchase, such as the vehicle had a performance chip which and was tuned by the previous owner. XXXX Deceptive Trade Practices Consumer Protection Act ( DTPA ) states the failure to disclose information concerning goods or services which was known at the time of the transaction if such failure to disclose such information was intended to induce the consumer into a transaction into which the consumer would not have entered had the information been disclosed. The names of the sales employees were XXXX XXXX, the sales manager was XXXX XXXX, and the finance manager was XXXX. On XX/XX/XXXX, XXXX XXXX XXXX XXXX, charged the manufacturer warranty, however, NO WORK WAS DONE ( see attached documents ). I waited in the lobby for over 4 hours, even when I informed them that I had a XXXX appointment in XXXX that I was unable to make due to the service advisor and service manager purposely kept me waiting when they knew exactly what was wrong according to a PRIOR work order dated XX/XX/XXXX ( see attached documents ). XX/XX/XXXX, I was in contact with the title clerk at XXXX XXXX XXXX, she informed me that the contract I signed, on XX/XX/XXXX, had the INCORRECT lien holder, XXXX XXXX, and that all of the paperwork would need to be resigned in order for her to get my plates issued. The title registration application has the incorrect address and was filed showing incorrect owner city and county. XX/XX/XXXX, I RETURNED THE VEHICLE TO THE DEALERSHIP! I spoke with XXXX, a finance manager, he reviewed the contract and said that it was INCORRECT but that it wasnt a big deal and all we needed to do was update the contract and sign it again. I informed him that I wouldnt be signing another contract and handed him the keys, his said that he will just update the contract and that he doesnt need me to sign another contract, my reply was that if he were to do such a thing, it would be ILLEGAL and I will contact the TXDMV and the XXXX. He followed me outside yelling at me to take my keys because I cant leave the car on his lot, that this is going to show as a repossession on my credit, and he was going to call the bank to come tow my car. My only response was for him to do whatever it is he felt he needed to do but that I didnt want anything to do with the vehicle. On XX/XX/XXXX, I spoke with an XXXXnvestigator from XXXX XXXX, she also acknowledged that the contract they had the wrong lien holder, so therefore, would get in contact with XXXX XXXX to cancel everything so a refund could be issued. XXXX XXXX funded this loan without reviewing the contract for errors and/or misprints. On XX/XX/XXXX, XXXX, XXXX XXXX finance manager, contacted me by phone threatening me that if I didnt pick up my car that he would make sure it was reported on my credit so that I would not be able to finance another vehicle. He was yelling at me accusing me of lying about the contract but when I put XXXX XXXX on a 3-way phone he immediately hung up. Afterwards, I spoke with the investigator from XXXX XXXX, she claims the dealership have a contract and a contract assignment which displays XXXX XXXX as the lien holder. However, the only contract/contract assignment form that I signed has XXXX XXXX ( see attached documents, date/time stamp at bottom ). XX/XX/XXXX, XXXX XXXX drove the car back to my house and left it parked on the street with the keys in the cup holder. I made it home 6 hours later, luckily my neighbor called and let me know people were in front of my house. The temporary tag expired on XX/XX/XXXX, I still have not received plates from dealership due to the information that the dealership has on the registration is WRONG! I have already received a warning from the city about the car not being legal. XXXX XXXX tried covering up their contractual errors by falsifying parts pertaining to the original contract, as well as, misleading acts and/or claims such as justifying their actions by telling XXXX XXXXXXXX, after I returned the vehicle and refused to resign the new contact, that I requested to use XXXX XXXX as my lender, FALSE! As a matter of fact, XXXX XXXX DENIED my application on XX/XX/XXXX ( see attached document ). Why would any dealership make false allegations unless they obviously acknowledge that all of this occurred, due to their own mistakes, under no circumstances, should any dealership justify such UNPROFESSIONAL AND/OR DECEPTIVE CONDUCT TO EXTORT CONSUMERS BY PRACTICING SALES ACTS THAT PROVIDE FALSE STATEMENTS AS MATERIAL FACT, WHEN KNOWINGLY AND WILLINGLY COMMITTING SUCH ACTS WITH THE INTENTION TO DECEIVE THE CONSUMER IS AGAINST THE LAW AND IS IN VIOLATION OF THE CONSUMERS RIGHTS. HOW MANY OTHER CONSUMERS HAS XXXX XXXX INTENTIONALLY DECEIVED FOR THEIR OWN FINANCIAL GAIN? THE END RESULT IS ANOTHER VICTIM, XXXX XXXX HAS SCAMMED, WILL BE NEGATIVELY AFFECTED BY BAD CREDIT RATING WHICH BRINGS ECONOMIC HARDSHIPS FOR CONSUMERS. I also have voicemail messages from XXXX XXXX XXXX acknowledging the contract was incorrect and needed to be resigned in order for the title to be filed. I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. This is in regards to a car loan that I have with XXXX XXXX for a XXXX XXXX XXXX. I have acquired my vehicle thru XXXX XXXX in house financing back in XXXX XXXX. I have made all payments in the amount of {$510.00} were all made on time since the original loan. However the XX/XX/XXXX payment I made the remaining payment amount of {$140.00} dollars was made on XX/XX/XXXX and hard posted to my bank account on XX/XX/XXXX. I received as call regarding delinquency on XX/XX/XXXX @ XXXX and spoke with the supervisor XXXX XXXX who advised me that XXXX XXXX has a 3rd party payment processing company XXXX and they advised her that the funds in the amount of {$140.00} ( which was the remaining amount due for my XX/XX/XXXX payment ) was sent back to the bank due to NSF on XX/XX/XXXX. She advised me at that time to reach out to my bank and discuss the matter. I did speak with my bank who advised that the payment had been made on XX/XX/XXXX and hard posted to the account on XX/XX/XXXX and that I had more than enough money in my account to make the payment. The bank requested for me to get a trace number on this transaction so they could do the necessary research on their end to trace this payment. I had a XXXX way conference call on the XXXX @ XXXX with with XXXX XXXX and the XXXX XXXX representative. The rep advised her that there was nothing that did not show NSF nor where there anything showing that funds were being sent back to the bank. At that point, XXXX XXXX advised the rep to have someone in the back office look into my account to see if by chance there is a clerical error or if the funds have been placed back in the wrong account. The call ended on the note of a follow up call to be made after the research had been done on the banks end. On XXXX I spoke with XXXX XXXX @ XXXX and advised her that per the bank the payment had processed and the funds have not been sent back over she then advised me that my account is in delinquency and subject to be picked up if the issue is not resolved. On XX/XX/XXXX a 4 way conference call was made with me, XXXX XXXX, XXXX XXXX XXXX XXXX, and XXXX at XXXX ( which is the 3rd party processing collection company for XXXX XXXX ). XXXX advised that the payment was made on XX/XX/XXXX but came back as NSF on XX/XX/XXXX. He provided a trace number via email to XXXX XXXX which at the time XXXX advised that the bank would complete an investigation on and a follow up will be made on this issue. XXXX XXXX advised XXXX and me that she would put my account on hold until we could get this issue resolved. XXXX advised before the call on his end was disconnected that he would send the email over to the XXXX XXXX XXXX with the information approximately around XXXX XXXX that morning. I received follow up collection calls since this issue occurred as of XX/XX/XXXX and after XXXX XXXX advised that she would put the account on hold to prevent calls from being made to me. Since our conversation on XX/XX/XXXX I have received the following calls : XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX XX/XX/XXXX XXXX The bank has completed a complete trace per the number that was provided and I have notified XXXX XXXX several times that the payment has not come back as NSF . However she has advised me several times that if the issue is not cleared up then they will come and pick up my car. However my request of XXXX to do the research on their end to trace the payment and show proof of this payment being posted on XX/XX/XXXX then being NSF on XX/XX/XXXX has gone null and void. XXXX XXXX is threatening to pick up my car for a payment that they can not find. I clearly have all the documents including the email and bank statements to show proof that the bank does not have the funds neither have they been placed back into my account. They are not trying to look at the possibility that maybe their 3rd party processing company has either lost or misapplied my funds. I continue to get the threats that my car will be picked up for this missing payment yet I have everything that shows that the payment was made. XXXX and XXXX XXXX need to find my money ASAP. We need immediate contact with XXXX XXXX on this issue to resolve this due to the repeated threat of a repo on a payment that I clearly have made. I also have the documentation that shows on my credit report that the XX/XX/XXXX payment has been made. That I am not late nor delinquent at all on any of my payments. I think that they are running a scam and trying to get over on people who DO actually pay their payments. You really want to repo my car over a {$140.00} that your company lost when clearly making the payments have never been a problem. There was no other option but repo until this issue was corrected. That is over the top and sad THIS ISSUE IS URGENT!!!!!!!!!!!

3 years ago I went to Clay Cooley off of XXXX and XXXX I met a young lady there I hadn't seen in 3 years I co-sign for a car for her I didn't know they had game going on with me the next day I went back up there I told him I did not want the car during the car back in I wasn't in my right mind when I did that the car was turned back in I came back home the young lady at the dealership turn around and gave her the young lady the car back without me knowing about it she had been having the car driving for a whole month to months I didn't know anything about aunt in XXXX call and ask for the payment as to what car payment what are you talkin about the car was strength back in they said no you have a car in your name I said know that car was turned back in I never got any paperwork on the car I have been fighting this for 3 years young lady at the car dealership gave the young lady the car back told her she didn't have to worry about anything she fixed it to where I would have to take her to court so she can keep the car for free so this young lady been driving around and I asked you V haven't paid my one dime on it for free this went on my credit report I have been fighting this for 3 years they have told so many lies I've got to stop from the car lot I have been up to Clay Cooley car lot on Mini and mini occasions I talked with a young man because I never got any paperwork he gave me a piece of paper 2 years ago where my name where somebody forged my name on the paper I went back up there to talk to the same young man and they have fired him from there they giving me that paper and talkin to me I am XXXX when I went in there that day I had no intentions of purchasing no car for her and nobody else I had a loved one that passed away I was out of my mind I went back the next day had the car turned back in tell them I did not want the car the salesman young lady kept telling me I need to let the woman keep the car no I found out this woman didn't have no insurance she didn't have license nothing who does then I said no the car is turned back in why would you turn around and give her the car back without me knowing about it still in my name till this day this woman still driving around in a free truck and new used truck in my name it is so heartbroken because I am a XXXX woman can't get no house can't get nothing in my name I can't get anything because this is on my credit report they would not take it off my credit report this woman is getting tickets in my name toll fees in my name and I'm still having to spend that money I have cried for three years because they did me bad that car lot is very crooked they are crooked they're doing a lot of people wrong up there selling people cars saying it's a XXXXwhen it's a XX/XX/XXXXI've been cussed out we're coming up there calling calling calling about that car when the car was turned end and you want in return gave it back to the woman without me knowing about it stealing my name yes I have been fighting this I have been talking and fighting this for 3 years and it's so sad that this woman been driving a free truck for 3 years in my name and I'm held reliable for it something that was turned in the car was turned back in you are at got the car and you turn around and gave it back to her without telling me in my name who does things like that this is a wicked world we live in I want this off of my credit report I have talked with the credit report on for three years I've been fighting with them to take it off my credit report and they would not do it they won't even report it that I've been calling and talking to them fighting with them the car lot even cosign my name fragili it wasn't my signature somebody put my signature on a piece of paper and it wasn't my signature I want this SUV taken off of my credit report because it was sad the way they treated me and Dad 's me and I have been fighting this for 3 years please take this off of my credit please Clay Cooley car lot has been doing a lot of crooked and dirty work to people getting people in cars utilizing other people whatever they can do to make a cell to put money in their pockets they don't care they do that and it's hurting a lot of people I don't want anybody to suffer and go through what I have went through what I'm still going through thank you for listening to me but please help me get this off of my credit report

On XXXX/XXXX/XXXX I began the car buying process with Clay Cooley Motor Co. On XXXX/XXXX/XXXX, the process was stagnated after the finance manager told me that I MUST purchase an extended warranty in order to complete the vehicle purchase. The document that I was told that was mandatory that I sign, had a clause in it that indicated that the " purchase of the extended warranty was not necessary in order to obtain vehicle financing ''. I declined to sign the document and left the dealership and immediately filed a complaint with CFPB that was later resolved at the corporate level on XXXX/XXXX/XXXX. I took ownership of the vehicle on XXXX/XXXX/XXXX. On the same day my original complaint was resolved, XXXX/XXXX/XXXX, I received an additional " welcome call '' confirming my auto purchase and the terms of my contract. During this conversation, it was discovered that the paperwork submitted to underwriting by Clay Cooley XXXX XXXX XXXX was not the same paperwork that I had signed with the dealer representative. I was asked by the underwriting manager XXXX to send her a copy of the contract that I signed at the dealership on XXXX/XXXX/XXXX. Once she saw the contract that I had in my possession, she indicated that all of my numbers were wrong and that I needed to sign a new contract at an interest rate 4 % higher than what I originally contracted for. Keep in mind, I was approved for financing one full calendar week before taking possession of any vehicle in their inventory. I was later advised by XXXX that the terms of the contract that I signed would be honored. I conferred with an attorney and based on the law in the state of Texas, I was in possession of a valid contract under the law, and it appeared as though the dealer did not want to honor the terms of the contract due to the fact that I had already filed a complaint against them because of the extended warranty. The warranty cost was taken off of my account, and it appears as though a higher interest rated was entered to make up the loss by the dealership. After my conversation with XXXX, I was assured that the information they have in the system would be corrected. I made my first car payment on XXXX/XXXX/XXXX ( one week early ) and to my surprise, learned that my interest rate was 20.93 %, although my contract states 17.10 %. I called customer service on XXXX/XXXX/XXXX and was deferred back to the dealership to resolve my concerns. I contacted the dealership and was told I needed to resign another contract. I asserted that I was in possession of a legal and binding contract and any mistakes made by the dealership are not the consumers responsibility to resolve. On XXXX/XXXX/XXXX, I inquired about the registration plates for my vehicle and was told " they had not come in yet ''. By XXXX/XXXX/XXXX, I still did not have tags for the vehicle as my paper tag was set to expire XXXX/XXXX/XXXX ( a Saturday ). I was directed to leave a voicemail for XXXX XXXX. I did not receive a call back. After not hearing back from the Clay Cooley representative, on XXXX/XXXX/XXXX I went to the local Tag Office in XXXX XXXX, TX with my sales contract and was advised nothing was showing filed with the state to register the vehicle I purchased on XXXX/XXXX/XXXX. I phoned XXXX XXXX again and she stated that she had not received any paperwork to forward to the state to register my car. At this point, Clay Cooley has reported the purchase of a vehicle to all three credit bureaus with a contract that I did not sign, they have willfully held title paperwork back and refuse to register the vehicle that I have been financially responsible for since XXXX/XXXX/XXXX. I lost two days of wages being unable to drive an unregistered car, and I have been charged and additional 4 % in interest since XXXX/XXXX/XXXX, unbeknownst to me without my signature. After repeated requests their representatives have refused to produce the sales contract showing my signature for the rate of 20.93 %.

In XX/XX/2016 I purchased a vehicle from XXXXXXXX XXXX XXXX XXXX. The vehicle was financed through XXXXXXXX XXXX 's private finance corporation XXXX XXXX. After attempting to trade-in the vehicle at a competitor 's dealership, a XXXX report was run and I was advised that my vehicle had prior structural/frame collision damage to the driver 's side and the rear of the vehicle. This information had not previously been disclosed at the time of purchase. XXXX XXXX violated Chapter 17, subsection E of the Deceptive Trade Practices Act by knowingly selling a vehicle that had prior collision damage and whose value was misrepresented at the time of purchase. The value of my vehicle at present when attempting to trade it in is roughly {$4000.00}, however, the payoff on the vehicle is {$12000.00}, which is nearly triple the actual value of the car, that had pre-existing damage to its frame. The conduct of the sales staff at XXXXXXXX XXXX was a producing cause of my damages. XXXX XXXX and XXXX XXXX were in direct benefit from the misleading transaction. Section 17.50 of the Texas Business and Commerce Code describes five ( 5 ) types of wrongful acts that can provide a basis for a consumers suit under the DTPA. These include deceptive acts or practices, breach of warranty, unconscionable course of action, violations of the Texas Insurance Code and violations of tie-in statutes. Section 17.46 ( b ) of the Texas Business and Commerce Code sets forth the specific acts or practices that are considered false, misleading or deceptive. Because the DTPA does not create any warranties, the plaintiff must rely on other statutory provisions such as the Uniform Commercial Code or the common law to establish the warranty. An unconscionable act or practice means any act that, to the consumers detriment, takes advantage of the consumers lack of knowledge, ability, experience or capacity to a grossly unfair degree.

I attempted to purchase a XX/XX/XXXX XXXX from XXXX of XXXX in XXXX, TX. I completed the underwriting process on XX/XX/XXXX at a different XXXX dealership ( XXXX ) but was unable to complete the transaction as there was not a vehicle at the dealership that I was interested in purchasing. I was able to locate a vehicle at the XXXX location on XX/XX/2016. I was told that it was mandatory that I purchase a XXXX warranty contract with the vehicle by the dealership, however, I was told by the underwriting department for XXXX at XXXX that all warranties are optional. I recited the information to the dealership XXXX and was told that it was not an option and that the service contract would have to be signed adding an additional {$1900.00} to the amount financed over the 4 year term of the loan. On XX/XX/2016, I returned to the dealership and further reiterated that I had been told that the service contract was optional and was told " That 's just the way XXXX does it. It 's not optional for your " type '' of loan ''. When presented with the paperwork for the vehicle, I was presented the service contract. To the left of the signature line, there is a " Notice to Customer '' with at bullet point under it that states : " The purchase of this service contract is not required to obtain financing or to purchase or lease this vehicle. '' By XXXX on XX/XX/2016 the dealership and I were at an impasse because I was being told in essence that if I wanted to purchase a car from them, I would have to purchase the warranty and they would not take it out of the contract regardless of that the document states in writing.

I noticed that a couple of weeks had passed, and that my original loan from my trade-in, had not been paid off. I made several attempts to contact the dealer, to inquire about the loan pay off. Every time I called, I was either placed on hold, with nobody returning to the phone, or was told that someone would contact me. Each time, no response. I eventually reached out to my sales rep, who said he spoke to someone in Accounting, and that the check had already been mailed. He even assured me that it would reach my lender by XX/XX/XXXX. I even gave it a couple of days, and on XX/XX/XXXX had checked with the lender to see if the check had arrived. They explained to me that they had not received the check for this loan pay off. I was finally able to reach someone in Accounting on XX/XX/XXXX, who told me that they had, in fact, had not mailed the check. I have purchased several vehicles and have never experienced a loan pay off as slow as this one. I have even had to make an additional payment on the prior loan, so I could avoid late fees and a negative hit to my credit. It's not so much the fact that it has taken so long, but the simple fact that I have been lied to repeated times about the situation. I'm genuinely concerned that this dealer will not pay off my pre-existing loan, even though they have contractually agreed to do so. I disputed an incorrect date on XXXX XXXX with XXXX for the XXXX XXXX account listed on my credit report, and a month later XXXX XXXX sent me an notification that the XXXX XXXX account has been deleted off my credit. This dropped my score 117 points. I contacted XXXX and they said they sent a letter to XXXX XXXX on XX/XX/XXXX and due to no reply back after 30 days the account was deleted. I 've contacted XXXX XXXX numerous of times and even reported this problem to bbb.org. I have been getting the run around since XX/XX/XXXX and no one seems to not know what to do. FInally in early XX/XX/XXXX, someone responds to the bbb complaint and says they re loaded my account information in XXXX and the credit companies should see it. I contacted XXXX only for them to tell me that they ca n't see the account in XXXX, and I need to tell XXXX XXXX to complete an re insertion by contacting XXXX marketing services. I was told this by a male rep. I contacted XXXX XXXX to relay the information and they tell me they contacted marketing services of XXXX and XXXX is telling her that XXXX XXXX was never an account on my credit. The sale person proposition me a favor since he sold me the car, the finance person said I had a maintenance agreement when it was time to get my Oil changed I found out I didn't have it. I cancelled the extended warranty for {$3000.00} it was not taken from the loan until XXXX. The {$3000.00} was applied as payments towards the loan, but the amount was never taken from the loan, so I'm still paying on it monthly. I purchased the Car {$27000.00} ( Trade in was added to the purchase price {$7000.00} ) I still owe {$26000.00} with monthly payments of {$540.00}. I tried to return the car within the 3 days and was told by the sales man I was not able too. He said to me and I quote " you come in here with a XXXX credit score no money down and expected lower payments ''. Just Rude! I have been turned down 30 times trying to refinance this car. Covid hit the next month and I was not able to move forward with the complaint, everything closed. I sent messages and no answers, I feel like I was taken advantage of. On XX/XX/XXXX, my credit was ran without my permission. I had been lied to and deceived by Clay Cooley XXXX XXXX XXXX, who had already previously ran my credit on XX/XX/XXXX. There was no need or permission given to XXXX to run my credit check a second time. As a result of XXXX 's violated action against me, my account received multiple hard credit inquiries from various auto lenders, which stay on your credit for 2 years, not to mention a reduction in credit score. I have attempted to contact XXXX, lenders, and credit bureaus, but I have only gotten the runarounds between these entities, with no resolution in sight. I was even told to file a police report from one credit bureau against these lenders if they were not willing to cooperate with me and help me remove unauthorized inquiries from my credit. I have not filed a report and hope that my complaint here will be resolved successfully, without any need to file a police report against these lenders- especially since XXXX XXXX the one in charge and at fault in allowing this to happen. What's so disheartening is that after I was lied to by a XXXX rep and he ran my credit against my knowledge and permission, I was told by his boss that he would help me resolve the duplicate and erroneous hard inquiries made into my credit report ; but he flat out lied as well, and that left me with little to no option unfortunately.

A few days ago I bought a new truck from XXXX XXXX XXXX XXXX in XXXX Texas. Once the final price of the vehicle was established I was asked to go to the bank and get the down payment for the vehicle that we agreed to. Once I arrived back from my bank with the down payment I went to the finance office. In the finance office I was told that I have to buy extended warranty in order for me to buy the truck at the price we have already agreed to previously without any stipulations I was also told that I qualify for a lower interest rate at 2.5 % but because the dealership is not making enough money on the sale of the truck I have to pay 4.5 % interest first four months in order to secure the deal. They said just finance it for 4 months and then you can pay it off or refinance but not before then. I told him that's incorrect information he went to the manager and came back to the office and said they are no longer willing to sell me the truck then gave me my down payment check back. I had already invested four hours of my time being there and waiting with my family they used this against me and force me to buy the truck without warranty but with a higher interest rate he even showed me that I qualified at 2.5 % APR with almost to XXXX credit score and a very low debt to income ratio and 50 % down payment on truck.

I 've opened a credit rebuild auto loan with XXXX XXXX on XXXX/XXXX/XXXX which states the loan is a rebuild program because they report payments to all 3 credit bureau 's which will help the credit score. To date this has been false, my credit score has not gone up the entirety of my auto loan and XXXX XXXX stated they report payment history. My credit scores are not equate due to this and it 's so frustrating dealing with these type of auto loans that promise to rebuild your credit by reporting to all 3 and they never do they just put the vehicle loan amount on your credit if the vehicle is a lemon and only last you hopefully a year and it 's just not fair that they get away with these tactics. My vehicle is still running fine thank god but it 's an XXXX sold with high miles no warranty I 'm paying high interest which makes the vehicle costs triple when blue book value is only {$4000.00} and change the loan term is 4 years yet they ca n't be polite and keep their word of reporting so it helps the consumer really rebuild credit? I purchased a used XXXX XXXX XXXX from XXXX XXXX XXXX in XXXX Texas. I purchased a vehicle XX/XX/XXXX of this year. I do not have my registration or my plates yet. The state is also showing that there is a lien on the vehicle in the name of the previous owner still. They also do not have a Texas title for the vehicle. I then get two letters in the mail from XXXX saying that the dealership canceled my extended service contract and my gap coverage. I called XXXX to confirm that there is no coverage on the vehicle and they confirmed that there is in fact no coverage, the dealership did cancel both contacts, and the dealership was issued a refund for approximately {$5000.00}. I have spoken with the dealership with the finance XXXX, and he is giving excuses for delays in the titling and registering of the vehicle. My sales person has been telling me since mid XXXX that the registration has already been done and that I will get it any day. The state, my XXXX XXXX tax assessor, is saying that no, its not registered to anybody and thats when I was told about the lien from the previous owner. Ive tried asking to speak to the general XXXX of the dealership and no one will ever transfer me to them. I never get past the finance guy.

I have requested no phones call from this company since the beginning of my loan. The refuse to remove my number and continue to call. If I am 1 day late I get threatening text email and calls that they are going to turn my car off. On XX/XX/2018 My account was 20 or 21 days past due and I spoke with XXXX and explained I was getting a loan through my credit union to make the payment because I missed 3 days of work for my grandmothers funeral. That she wasn't accepting my arrangement and was moving forward with my account and then she hung up on me. My account has never been more than 30 days past due and I get threatened with every call from them. I get calls, emails and text with them threatening to turn my car off. 2 weeks ago they shut my car off on a Saturday when I had arrangements set with them and wouldn't answer the phone. I was with out a car until that next Monday. They use the GPS shut off even on 1 day past due. Tells me that because this is tote the note loan I have no rights and they can do what they want because they took a chance on me. Their collection efforts are harsh and abusive. Just because my credit isn't perfect doesn't mean they can be ruthless.

I purchased my vehicle XX/XX/XXXX at XXXX XXXX I was told by the sales guy that after a year I would be able to trade my vehicle in if I paid my payments on time in which I have never missed a payment. In XXXX of XXXX I purchased a car the motor blew up within a about 3 days of the purchase i returned it to CLAY COOLEY MOTOR CO XXXX XXXX XXXX XXXX XXXX, TX XXXX and chose not to purchase at all because I felt that they had wronged me in the sale of the car. They submitted this item to my credit report as a charge off, when it should have never been applied to my account. This charge off has cause hardship in not being able to purchase a new car and continues to create issues for me financially damaging the moral of my credit worthiness when I was initially wrong. In this case I would like to request that they remove this item from my credit report as this was not my purchase. And I am not to be held responsible for the car. So that I can move along. But I have not been able to do so because they have this item on my record as a repression while, I waited for a very long time for answers on getting the car repaired. this event ultimately caused stress and put me into an early XXXX, and I was not in any position to be able to dispute this item.

I purchased my vehicle from Clay Cooley XXXX back in XXXX. I had issues from the beginning with every maintenance light being on in the vehicle so I ended up having to take vehicle back to get looked at. I get my car serviced regularly and have receipts to show for. I purchased a XXXX to have secure transportation for not just myself but for XXXX small children as well. I purchase a car from Clay Cooley on XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX my car broke down. The company made me pay XXXX dollar for a loaner car in addition to my car note. They kept my car until for over a month without fixing it. Once it was finally fixed I ended up taking the car back 2 additional times for the same problem. Had a total loss. The Gap insurance coverage required from me to obtain a copy of the ELO Connected and Protected agreement. Which I had to obtain directly from the office were I financed the vehicle. I agreed with the dealership to return the vehicle since it was a lemon. I had transmission issues with the car from the time I baught it.
