My complaints are regarding 2 companies : 1st : XXXX ( XXXX XXXX XXXX XXXX ) and 2nd : Continental Credit Control. I had a medical examination provided by XXXX on XX/XX/XXXX that was billed to my insurance company for {$910.00}. I believed the bill was in error because XXXX was ( & still is ) in network with my insurance company and there was no 'provider responsibility ' or write off on the statement or EOB as I had ALWAYS seen in the past with all in-network providers that provided a lowered patient responsibility portion. ( For example, quite often I have had to ask XXXX XXXX to re-submit a claim to my insurance for a variety of reasons and every single time, it turned out that the original amount I was billed for was highly reduced or actually found that I was not liable for it ). So I assumed this was also the case for XXXX, as I could not believe that the full amount that was being charged was 'allowed ' and all of my financial responsibility. Thus, I called XXXX on XX/XX/XXXX and requested they re-submit the claim, which apparently they did according to XXXX 's records. I was told I would expect to receive information as to what was found and resolved. I never received another bill from XXXX nor any EOB from my insurance company, thus I believed the matter was handled. Until I received for the first time ... suddenly ... a letter/statement from Continental Credit Control dated XX/XX/XXXX, literally 20 months after I had the last conversation with XXXX! Upon receiving this collection notice, I called XXXX on XX/XX/XXXX and was told my case would be sent to " XXXX XXXX XXXX '' but not to expect any response until mid-XX/XX/XXXX as they were experiencing a high volume of cases due to faulty invoicing ( this information was also on their recorded message during the long hold ). I then called that same day, the representative for Continental Credit Control listed on that statement " XXXX '' ( her initials ) and informed her of the situation and what XXXX told me. I asked her to please put my account on hold until I heard back from XXXX. The representative " XXXX '' from Continental was very cold, abrasive and unwilling to do anything for me. Thus, by early XX/XX/XXXX when I had not heard anything from XXXX, I called numerous times and asked to be connected to a supervisor, and each time I was either disconnected or put through to leave a voice message and NEVER received a call back! I even asked for the head billing supervisor of the whole company and was given a number of 2 men in Texas, whom I also left at least 3-4 messages for and did not receive a call back until XX/XX/XXXX. By then, on XX/XX/XXXX, I had finally reached a 'live ' supervisor at XXXX I will refer to her as " XXXX '' ( her initials, as we are supposed to exclude personal information ). " XXXX '' confirmed with me that my record had shown my conversation on XX/XX/XXXX and that the bill was re-submitted to the insurance. She also provided me with the dates that XXXX mailed me a bill for the {$910.00} service and they were ALL prior to my call on XX/XX/XXXX ( the last one they sent was on XX/XX/XXXX, which prompted my call to them ). She said they last heard from my insurance company denying the claim onXX/XX/XXXX but that no other bill was then sent to me to collect the payment! The insurance company also did not send out another EOB. Thus my chief complaint is that XXXX really should 've sent me another statement following the response they received from the insurance company in XX/XX/XXXX. Since I never received any subsequent bill from XXXX nor an EOB from the insurance, I assumed this was taken care of. If I had received a bill following the resubmitted claim, then I would 've paid it then or at least started a payment plan. 'XX/XX/XXXX ' told me it is in XXXX 's billing practices not to ever send out more than 3 statements, however, those were sent to me prior to the claim being re-submitted in XX/XX/XXXX. 'XXXX ' said it was not their responsibility to follow up for payment, which seems absurd to me. ( If you owe the gas company or phone company money, you keep getting a monthly bill, you are n't suddenly 'off the grid ' for 20 months and then sent to collections! ). As stated earlier, I left at least 4-5 messages with supposed 'supervisors ' inXX/XX/XXXX and XX/XX/XXXX of XXXX too and never heard back except from one, finally after 2 weeks of my leaving messages. 'XX/XX/XXXX ' did, to her credit, offer to reach out to Continental to see if there was anything that could be done about the interest, and when I spoke with her again on XX/XX/XXXX, she told me there was nothing they could do about the interest charged by Continental . She informed me that they, XXXX, were going to file an appeal on my behalf with the insurance again, although I 'm still not exactly sure why or what that would accomplish. My conversations with both companies in the past 2.5 months have been regarding the issue of not receiving any bill or notification after XX/XX/XXXX and then suddenly being sent to collections with interest 20 months later! The issue is not with being liable for the amount of {$910.00}, now that I 've been made aware that the full amount was/is my responsibility. Had I been billed again in XXXX, I would n't have had this additional interest amount to pay AND my credit would not be tarnished because of their poor billing and communication practices. As I stated in the beginning, my 2nd complaint is with Continental Credit Control, CCC. The representative assigned to my case " XXXX '' has been very cold and unwilling to assist on any level each time I have called her. I feel I should 've been granted a 'hold ' on my case as I called them right after receiving their first letter and explaining to her my dealings with XXXX in XX/XX/XXXX. Today, XX/XX/XXXX I spoke with the chief collections supervisor of CCC as I did not want to speak with " XXXX '' anymore. He, " XXXX '' ( supervisor initials ) was just as cold, very dismissive and unwilling to hear my case. I asked him for the notes and details of my case as I wanted to write down what he said but he kept interrupting me, even from the beginning, by saying " this conversation is getting funky. '' I asked him how was the 10 % interest rate determined, from when did it commence, who drafted the terms of the collection ( was it XXXX or CCC ), if there was anything that could be done about the interest, but he was very condescending in his responses and I can guarantee I was maintaining a professional voice. Two things of particular really alarmed me from the conversation with " XXXX, '' he said he could tell from my credit on XXXX that I had $ XXXX of credit available to simply put the whole {$1100.00} amount due ( {$910.00} principle + interest ) on a credit card. I immediately asked him if he just looked up my credit without my consent and he defensively replied that he was looking at what was pulled on XX/XX/XXXX when they acquired my account from XXXX as a 'soft ' inquiry. Is that even allowed? Why does he still have that information in front of him in XXXX from something pulled in XXXX? How can he dare assume we would put more debt on high rate credit cards? I informed him that we ( my husband & I ) do not have $ XXXX available in credit, that for a fact we have nearly $ 20K in credit card debt and to put another {$1200.00} on a credit card was not a casual choice nor option! He disputed what I said as if I was making up my own indebtedness!! Secondly, he stated a couple times " as a courtesy '' if I paid the full amount ( principle and interest ) he would " remove as a credit rating '' the debt as so it would not show up to the 3 credit bureaus. I asked him to clarify this as I assume once you pay off a debt, that it should be automatically removed to show as paid - this is one of the instances where he was very condescending and short in his answer as I was trying to understand what he meant by this statement. He asked me to make a payment online, to direct all future correspondence with the company just in writing, he was hesitant in providing his last name to me and HUNG up on me while I was asking a question. Again, I kept a calm voice throughout the conversation. I believe that the CFPB and the California State Attorney General office should create a rule that require medical providers to mail patients statements, following correspondence with insurance companies and letters to inform patients that if the account is not paid, then the matter will be sent to collections. This was not the case with XXXX, as I never received a subsequent bill nor a letter that this was being sent to collections as stated above. As 'XXXX ' of XXXX informed me, they have a billing practice of not sending out more than 3 statements, even though a case is pending or in transition with an insurance company, seems unprofessional and unfair to the patient. I will certainly NEVER again utilize them for any service. I also believe there should be a grace period for patients before collection agencies can charge interest. I read the Civil Code 3289.B, however to charge interest from a statement 3 years ago that I honestly believed was taken care of between my insurance and XXXX is unfair and excessive. I would 've paid this off if I had been informed that it was my obligation. To be required to pay interest on a debt I did n't even know I had is in my opinion, criminal. In XXXX, XXXX, Continental Credit Control, a third-party data mining and collection agency located at XXXX XXXX XXXX XXXX XXXX . XXXX, XXXX XXXX, CA XXXX, reported a collection account to all three of my major credit bureaus on behalf of a healthcare service provider ( XXXX XXXX/XXXX-XXXX XXXX ) for the amount of {$2400.00} with an accruing interest rate of 10 % in demand to collect on a settled medical lien that was paid in full and as agreed nearly 4 years ago as part of a litigation settlement in a personal injury lawsuit. The original principle lien balance with XXXX XXXX ( {$1500.00} ) was negotiated down to a final settlement amount of {$410.00} by my attorney ( XXXX XXXX ). Prompt payment for this balance was remitted by check ( no. XXXX ) from my attorney 's office to XXXX XXXX/XXXX-XXXX XXXX on XX/XX/XXXX. Bank records of the canceled instrument indicate that the check was presented and collected-on by XXXX-XXXX XXXX on XX/XX/XXXX. At no point within the intervening 4 years since the account was paid and settled did XXXX XXXX/XXXX-XXXX XXXX or the furnisher ( Continental Credit Control ) attempt to contact me directly or notify me of the claim for a balanced owed before suddenly reporting a collection to my credit bureaus in XXXX. Upon notice of this collection account ( XXXX XXXX, XXXX ), I took immediate action to contact the furnisher to submit documentation showing that this account was paid as agreed and has been settled since XXXX ( including copies of the canceled instrument from my attorneys escrow account referencing the lien settlement at XXXX XXXX as well as a settlement agreement signed by both the management at XXXX XXXX/XXXX-XXXX XXXX and my counsel, which I have also attached to this complaint ) ; however, repeated attempts to provide this documentation and to remedy the issue have gone on rebuffed, disregarded, and dismissed by the furnisher. The refusal by Continental Credit Control to receive the documentation demonstrating that this account has been paid as agreed and settled since XXXX and correct the invalid reporting on my credit bureaus accordingly represents willful violation of their obligations under the Fair Credit Reporting Act and a blatant and fraudulent attempt to extort me for a balance not owed. Concomitantly, during the time since XXXX when the invalid collection account was first reported to my credit bureaus, I have repeatedly disputed the collection record with all three major credit reporting agencies ( XXXX, XXXX, and XXXX ) to no avail. Despite the settlement documentation ( referenced above ) which Ive submitted with each dispute, the credit reporting agencies allege to have verified that the information provided to them by the furnisher is valid and accurate ( cf. XXXX Report No. XXXX XX/XX/XXXX ; XXXX Confirmation No. XXXX XX/XX/XXXX ; XXXX # XXXX XX/XX/XXXX ). Thus, even with documentation demonstrating that I have no liability or obligation for this collection account and that this collection account in invalid, the credit reporting agencies have remained unresponsive and unwilling to remedy or correct the error and expunge this invalid collection account along with all derogatory remarks pertaining thereto from my credit bureaus. This also represents willful violation of their obligations under the Fair Credit Reporting Act. As a direct result of the respective failure at the credit reporting agencies to fairly revue my disputes and remedy this issue as well as the ongoing invalid derogatory remarks that continue to be posted to my credit bureaus by the furnisher, my credit score has suffered tremendous and unwarranted damage and continues to decrease. This issue has caused creditors to withdraw offers of credit and/or close good-standing credit accounts as well as other personal and financial damages. Moreover, the negative effects of this invalid collection on my credit bureaus hold serious long-term personal and professional ramifications for me if the issue remains uncorrected.

Continental Credit Control ; XXXX XXXX. XXXX XXXX, XXXX XXXX, CA XXXX Phone XXXX ( XXXX XXXX XXXXContinental Credit Control was contacted in good faith to resolve only XXXX outstanding medical bill that consumer was aware of. Several phone calls and a voicemail were made to reach them. Upon contacting XXXX XXXX and XXXX XXXX it was it is policy not to send notices or call in regards to updating consumer of more than XXXX acount outstanding. To quote, '' We do n't have to send you anything, you could have called. '' When asked how a consumer is supposed to be aware that several accounts exist when XXXX notice attempt several months ago the response was stated that Continental Credit Control does not send out statements, call or notify you that the collection has not been paid on. Accounts from XXXX physician may exist from different visit and consumer only is aware of XXXX, paying on XXXX - what way could a consumer be aware. Continental credit Control Rep stated that their accounts are all seperated and treated seperately even for XXXX physician so they do n't have to tell you about other accounts you owe on, as a policy of thiers if they contact once or twice at all your just supposed to know. Consumer was unaware several accounts were outstanding and was not notified that the billing process payment would only go to XXXX acoount. Also when creditor was asked about securing a paymet plan under six months with electronic check in good faith in regards to new discovery of other amounts under different account numbers, Continental Credit Control Rep. XXXX XXXX stated that the only way to remove the credit reporting was to pay in full by credit card. When asked if why other creditors were willing to work out a guaranteed debit payment plan the response was the staff Rep : XXXX XXXX stated it was not an option. Whe asked further if this was a company policy or a California XXXX XXXX XXXX Representative XXXX stated he became rude and talked ove me each time interrupting the consumer. When calmly approached for a reasonalbe explanation or effort to work with reaching a amicable agreement with debt collection XXXX XXXX XXXX was even less professional and stated he could only assist the concumer if the bill was paid in full at the time of the all and he could no longer talk to and hung up leaving consumer slammed on the othe end of call and having to call back to resolve amounts/account reference numbers and other details with XXXXaccount representative. Hanging up on a consumer when the consumer is asking if it 's a company policy/practice or California XXXX regarding statements, payment plans or such is just plain unfair practice and leaves the consumer at the loss, having to call back through phone trees, voicemail and waiting on the phone. Of all the agencies this consumer has dealt with Continental Credit Control has shown themselves to be the least worthy or fair practice and assisting consumers staying informed of outstanding or transferring medical bills by stating they do not have to send out notices, nor inform the consumer that other account are not grouped together for the same medical physical, so you only pay XXXX account while the others stand out and accumualte interest. That is not fair, and then report it to your Credit. Also that when a consumer attemtpt to make a payment plan and provide account and payment in a good faith effort for best business practice is told that the only way is pay it off in full or not at all. In this day when financial and XXXX crisis has it all of us it is disconcerting that Continental Credit Control Representatives XXXX XXXX and XXXX XXXX should follow such a phone script in business with patients. The phoe calls were tape recorded and hopefully will be followed up to review Continental Credit Control for improvements.

In addition to the past due they are also attempting to charge interest rate on a medical bill that is related to a medi-cal insurance policy. Against federal regulation policy holders of medical are to never be billed for services or medical procedures. This is not only incorrect but according to the FDCA, this is illegal as collection accounts can not be reported as having a past due balance. Being that their offices are reporting invalidated and unlawful recording information that goes against the law and my rights you must delete this account and report the deletion of this account. Their actions have constituted fraud under both Federal and State Laws. The representative XXXX XXXX ( ext XXXX ) verbally disregarded the law and refused to correct the issue even after I provided verbal authorization for XXXX XXXX XXXX XXXX representatives to discuss on my behalf in effort to fix the billing issue from their internal organization to the original creditor. On XX/XX/XXXX I contacted Continental Credit CTRL to resolve a medical bill that was placed on my Credit Report. I had called them before I believe in XX/XX/XXXX asking why I was getting collection notices from them in regards to Radiology bills that were due to a violent crime. I gave them the Victim 's Assistant contact information as well as the Assistant D.A. as well as opposing counsel. They disregarded the information and placed the bills on my credit report. The person I spoke with XXXX XXXX at ( XXXX ) XXXX said on XX/XX/XXXX mentioned that she went over the notes and saw the previous info. I asked her then why was it on my credit report if they knew that I was a victim of a violent crime and that it was going to be paid via either restitution or by the Victim 's Assistant Program ( VAP ). I told her that I would check the correct fax number and mailing address for the account and call her back which I did and gave it to here within 10 minutes. She said after I have given her all the numbers and addresses for the VAP, that there was nothing that she could do. I asked her what that meant. She didn't have an answer. I told her that made no sense and why would they be so difficult to a person that was doing everything to get them paid and their credit clear. I asked to speak to her manager and he was unavailable. This company is very ill-informed about the VAP and their ability to pay medical bills if a person is approved. I attempted to explain that to her but she wouldn't listen. I guess their phone calls are limited by time therefore they talk extremely fast and don't have time to listen. Regardless, I spoke with them at least 4 times today to rectify this situation. As well as at least twice before on XX/XX/XXXX I called them twice XXXX XXXX & XXXX after being hung up on by a male.. I don't understand why a company representative from Continental Credit CTRL would be so difficult to a person who is doing everything in their power to get them paid. They are unprofessional and uninformed. They need more training on how to resolve medical billings on the proper XXXX forms to insure payment. I also asked them if this could be resolved if I contacted the XXXX XXXX practice directly and for that she had no answer. Why are victims of violent crimes made to be punished by not only the assailant but by the credit agencies whom the survivor is trying to pay? This has caused a mountain of stress that is very destructive.

I filed a complaint # XXXX previously and the complaint was closed because Continental Collection Agency lied and said my insurance company was billed and they denied the service stating I was responsible for the amount owed, and the complaint was a dispute of debt and not appropriate for CFPB. I maintained from the start I did not owe the debt, my insurance was never billed, and this was a mistake on someone's part. I received a copy of the denial from the insurance company and plain as day it states Claim not covered by this payer. The wrong insurance company was billed by XXXX XXXX back in XX/XX/2015. I was finally after many attempts and several notices later from Continental Credit Control able to reach someone at XXXX XXXX to explain they billed the wrong insurance. Continental Credit Control refused to talk to XXXX XXXX about this to verify the debt. Once I was able to get XXXX XXXX to respond I was pulled out of collections, my insurance was billed, and today I received a check from XXXX XXXX for {$24.00} because I was over charged for my co payment for this date of service. As I explained in one of my complaints to CFPB, I have industry experience and had been in contact with my insurance and was clear I knew what I was talking about. I was getting no cooperation or willingness to try and understand from Continental Credit Control. XXXX XXXX would not return my call. I know Continental Credit Control probably paid a flat fee for a bucket of uncollected claims from XXXX XXXX. Some valid collection cases and some not. It doesn't give them the right to lie when you ( CFPB ) send a complaint to them, or to categorize complaints incorrectly to justify them, or to try and bully people into paying money they might not owe so they can recover their investment for the debt they bought. Attached is a copy of my correct insurance card that XXXX XXXX had from the start, along with copies of all the statements I continued to receive from Continental Credit Control, the insurance denial showing the claim was denied as not covered by this payer so you can see the Continental Credit Control Rep lied in a previous complaint response stating the insurance denied the service as the patients responsibility, and a copy of my refund check once by insurance was billed correctly by XXXX XXXX. Maybe in the future complaints CFPB can require credit agencies to show proof of what they're stating in their response.

I ( XXXX XXXX ) was involved in a XXXX case along with my boyfriend XXXX XXXX XXXX XXXX and we were both sent to XXXX XXXX by XXXX, she was a representative for the XXXX XXXX XXXX XXXX XXXX XXXX and who we were ex clients of. We were sent to XXXX XXXX for treatment for our injuries. XXXX had stated that we won't have to pay for any bills whether it was a win or loss case. After the case was over, we both were getting bills from XXXX XXXX sent to our mailing addresses. XXXX notified XXXX about the bills and she said not to worry about them, she wanted XXXX to take pictures of the bills and send them to her so that she can handle it. She stated that we should not be paying any bills to any doctors that she referred us to. As time passes by, we checked our credit scores and we been wrongfully sent to collections when we were not at fault nor responsible. My boyfriend had contacted XXXX about the collections but, she has been little to no help whatsoever, she does not respond to his messages. We both filed and submitted a dispute late XXXX with XXXX and XXXX with mixed results. My boyfriend XXXX XXXX XXXX XXXX had his collections removed from his credit score account by XXXX but XXXX has not so he submitted his own complaint. As for me, XXXX has removed the collections from my credit account on XX/XX/XXXX. For unknown reasons, XXXX added the collections back to my account on XX/XX/XXXX. I tried calling them to find out why, no pick up. For XXXX, I filed the exact same dispute and I was not satisfied with my results. I do not understand why XXXX removed the collections and put it back into my account 5 days later. This is not a game, it is a serious problem and I do not appreciate how this is being handled by the credit bureaus. I also do not understand why my boyfriends collections has been removed by XXXX and mine has not when we both filed the same exact dispute, no changes or differences between our disputes. I have supporting evidence to back up my complaint, screenshots my boyfriend XXXX XXXX XXXX XXXX took of his conversations with XXXX. Side note ; XXXX contacted XXXX XXXX XXXX himself, he said that he will be of assistance and send a letter soon stating that we were not at fault and that we shouldn't have gotten sent to collections by XXXX XXXX.

Violation HIPPA, PHI and California 's Medical Privacy StatuesIn reference to account # XXXXPlease be advised that under Federal Statutes the Fair Credit Reporting Act, ( 15 U.S.C. 1681 et seq ) and California 's Consumer Credit Statutes, you may be held liable for the following actions ( a ) Duty of furnishers of information to provide accurate information. ( 1 ) Prohibition. ( A ) Reporting information with actual knowledge of errors. A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or consciously avoids knowing that the information is inaccurate. In addition, the HIPAA and California 's Medical Privacy Statutes are in effect in this situation even though the health care services provided may have been prior to enactment. The Privacy Rules prohibits a covered entity from using or disclosing an individual 's protected health information ( " PHI '' ) unless specifically authorized by the individual or otherwise allowed under the Privacy Rules. In general, PHI encompasses substantially all " individually identifiable health information '' that is transmitted or maintained in any medium. " Individually identifiable health information '' includes health information that is created or received by a health care provider, health plan, employer, or health care clearinghouse, and that relates to an individual 's physical or mental health or condition, including information related to an individual 's care or the PAYMENT for such care. The furnishing of my account information is not in compliance with HIPAA, or California 's Privacy Act, and any subsequent reporting of this account on my credit reports to XXXX, XXXX and XXXX is a clear violation of Public Law 104-191 ( " HIPAA '' ) since there can be no permissible business purpose in divulging protected health information to anyone on an account once there is no longer any payment due.

Monday XX/XX/XXXX I received a phone call from a person at Continental Credit Control informing me she was a collection agency attempting to collect a debt on behalf of XXXX XXXX from XX/XX/XXXX. I informed her we had not ignored any bills and pay everything immediately after we receive them so there can't be a past due bill. I requested she send me an itemized statement so I can see what she's talking about. She claimed notices had gone out to My address with no response. I told her no way, nothing has changed for me, and I have not received anything from them. When I arrived home in the mail was a notice from Continental Collection Agency in the amount of {$160.00}. There was a ten percent interest charge included in the total of {$35.00}. I immediately called my insurance company to see if they paid the claim back in XXXX thinking maybe I misplaced the EOB and never received a bill. My insurance, XXXX has never been billed for the service either. They even checked to see if the claim was sent and rejected it for some reason and they never sent it again. There is no record of this service with my insurance at all. More perplexing is how XXXX XXXX/XXXX came up with a charge for the service since they are an in network provider with XXXX and they would bill me the difference of the contracted price based on my plan after XXXX paid. Even the XXXX claims specialist said it's impossible to speculate exactly what this amount would be without an actual claim. When I called Continental Credit Control to explain they need to bill my insurance and then bill me the difference of the contracted price, I was informed they don't deal with insurance companies. I explained I understand this but clearly XXXX XXXX has made a mistake. I was told to write an appeal and send it to them and they'll consider it. Otherwise it will go on my credit. This is wrong. On XXXX XXXX, XXXX, I had a XXXX at a facility calling themselves XXXX XXXX ( located in XXXX, California ). Prior to undertaking this medical procedure, I was informed that my total out-of-pocket cost would be {$120.00}. I agreed to pay this amount and was charged the same following the completion of the procedure, which I promptly paid in full using an XXXX XXXX card issued in my name. On XXXX XXXX, XXXX, I was contacted by an organization calling themselves XXXX XXXX ( also based in XXXX, California ) that claimed I owed {$350.00} for the aforementioned medical procedure and that no payment had been received either on the day of the procedure or in the subsequent four months. After several attempts ( by mail and phone ) to contact this organization went unanswered, I was finally able to speak with a representative of this organization at length in XXXX XXXX and it was agreed by both parties that my payment of {$120.00} on XXXX XXXX, XXXX had fulfilled any financial obligation that I had with XXXX XXXX and that there would be no further attempts to collect the non-existent debt of {$350.00}. And, after not receiving any further notices from XXXX XXXX for over 15 months, I assumed that the dispute had been resolved and the case closed. However, on XXXX XXXX, XXXX, I received a notice from an organization calling themselves Continental Credit Control ( based in XXXX XXXX, California ) in attempt to collect {$400.00} ( or the original {$350.00} debt plus interest of {$59.00} ). At the time of writing this correspondence, over 20 months have passed since the medical procedure in question was performed and I am somewhat perplexed as to why I am still being contacted concerning a debt which I do not owe and would like to be assured that a final and binding resolution to this dispute can be achieved within the next few months.

I ( XXXX XXXX XXXX was involved in a XXXX case along with my girlfriend ( XXXX XXXX ) and we were both sent to XXXX XXXX by XXXX, she was a representative for the XXXX XXXX XXXX XXXX XXXX XXXX and who we were ex clients of. We were sent to XXXX XXXX for treatment for our injuries. XXXX had stated that we won't have to pay for any bills whether it was a win or loss case. After the case was over, we both were getting bills from XXXX XXXX sent to our mailing addresses. I notified XXXX about the bills and she said not to worry about them, she wanted me to take pictures of the bills and send them to her because she stated that she will handle it. As time passes by, we checked our credit scores and we been wrongfully sent to collections when we were not at fault nor responsible. I contacted XXXX about the collections, she has been little to no help what so ever. We both filed and submitted a dispute late XXXX with XXXX and XXXX with mixed results. XXXXsunion removed the collections from my XXXX XXXX account on XX/XX/XXXX however, XXXX has not when it is the same dispute. I filed a dispute 3 times with XXXX and yet, results come back the same that it is accurate and that I am liable for the collections. I do not understand why XXXX removed the collections from my credit account within a week but not XXXX. I have screenshots of text messages with XXXX for supporting evidence to back up my complaint. Side note ; on XX/XX/XXXX, I spoke with XXXX XXXX XXXX himself and he said that he will be of assistance and write a letter stating that we are not at fault and shouldn't have been sent to collections. My girlfriend XXXX is also having similar problems but she will submit her own complaint.

On XX/XX/XXXX I was notified by mail that Continental Credit Control ( CCC ) was attempting to collect a debt owed to XXXX XXXX XXXX XXXX ( XXXX ) for a service from XX/XX/XXXX. I contacted XXXX forthwith, leaving several messages and my phone number. They could not provide me with documentation for the service that I have been alleged to have received. XXXX patient services informed me on XX/XX/XXXX that their billing records do not extend to XXXX. I was told a supervisor would contact me no later than Wednesday XX/XX/XXXX. However, I never received further correspondence about this matter from XXXX or their patient services. Consequently, I contacted consumer finance about the issue and was told to send a certified letter to CCC disputing the debt. I have requested they send documentation for this debt and additional information about it as well. I mailed the letter on XX/XX/XXXX to CCC at XXXX. XXXX XXXX XXXX XXXX, CA XXXX, XXXX tracking # XXXX. They received this letter on XX/XX/XXXX. Unfortunately, CCC has not responded to my requests for assistance in regards to this matter nor have they provided me with legitimate documentation about the debt they are attempting to collect. Additionally, they have put this collection on my credit which has negatively impacted my life. As a result, I have filed a complaint with the Federal Trade Commission ( Ref. # XXXX ). I had an x-ray done on my foot on XXXX XXXX, XXXX at XXXX XXXX XXXX in XXXX XXXX, CA. My bill was submitted to insurance which paid a portion and the remaining balance was submitted to me. I paid the remaining balance with my XXXX card and was told that my account was cleared. On XXXX XXXX, XXXX, I get another bill from XXXX XXXX for the same balance. I call them and they look up my account number and confirm that yes indeed, my balance had been paid off and it seemed their billing department had not updated. They gave me a receipt number for my previous payment and assure me that bill will be notified immediately. On XXXX XXXX, XXXX, I get a 'final notice ' from XXXX XXXX XXXX to send my owed payment to a collection agency. It 's the same balance from last XXXX that they think is still owed. I immediately call back to contest. Again I am assured that billing had not updated. This time, I 'm even given an approval number from the billing department to prove that it has indeed cleared my account. Additionally, I am reassured that whatever system they have to send my balance to collections will also be canceled. On XXXX XXXX, XXXX, I get a letter from Continental Credit Control collections agent threatening my credit and demanding for my balance due from XXXX XXXX as well as an accrued interest. I am infuriated. It seems that nothing ever happened with my XXXX calls to XXXX XXXX. I would have been happy to pay the balance had there been a payment issue, but ever time, I am reassured my payment cleared.

On XX/XX/20, I wrote to Continental Credit Control, a collection agency that was attempting to collect {$2100.00} on behalf of XXXX XXXX XXXX XXXX. I wrote the company asking them to verify the debt and provide me with any documentation showing details of the debt I presumably owed them. I sent the letter via certified mail which they received on XX/XX/20. Continental Credit Control did not respond to my letter and subsequent validation letters that were sent to the credit bureaus. As you can see per the attached invoice from Continental, there were two line items in the account summary for {$1000.00} and {$1100.00}, respectively. From what I can surmise, these two amounts equal the amount above that they were trying to collect, which means that they would only report one amount to the credit bureau. However, their malicious intent to inflict as much damage as possible, they reported each line item separately in order to show two collection accounts instead of one in order to make my credit report appear worse than it is. However, in spite of my repeated personal request and through CRA 's dispute process, they have failed to provide detailed documentation of the alleged debt. By reporting the collection account on my credit reports that they can not validate, they are providing false information that is damaging my reputation and preventing me from obtaining credit under the best possible terms.

Due to an issue with my insurance company I had to wait on my " in network '' out of pocket vs my " out of network '' out of pocket to get sorted before I could be sure that the billed amount was accurate. Unfortunately it took a long time to sort out and required me escalating the issue with my insurance company. Long story short, I did not get a full answer until XX/XX/XXXX ( ish ) of XXXX, I then paid XXXX XXXX right away, and in full for the {$360.00} that was due. At the same time I was contacted by Continental Credit Control regarding this payment. I explained it was paid in full and to not contact me again. They called me repeatedly and send my a letter this past spring. I just received another letter ( dated XX/XX/XXXX ) stating I still owe the money AND interest ( 10 % ), now saying I owe {$380.00}! I called Continental Credit Control and left a message with my account #, my phone #, etc for the case manager explaining ( yet again ) this was paid months ago and to stop contacting me! This is the letter XXXX wrote that says I do not own the bill because is was not turned into the insurance company in time by the doctors staff / XXXX XXXX / XXXX / XXXXXXXXXXXX. The additional information we were requesting was in reference to pre- existing condition. This information was sent to the customer since XXXX XXXX XXXX was not the ordering provider and would not be able to provide this information. Since we are showing that this information was never received from the customer, the provider then has the right to bill the customer. On the other hand if we reached out to the provider for this information and got no response as a contracted provider they would not be able to bill the customer. Continental Credit Control is reporting a debt for an account that was paid. The initial medical provider changed names four times ; XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX XXXX XXXX creating confusion & turned the account over to a collection agency. In spite of the account being paid my call to the collection agency, upon receipt of their bill, met with demand for payment + interest in order to delete their credit reporting from my credit bureaus. And I was told if I did not pay the frivolous debt within a couple of hours it would remain on my credit as it would be construed as " Credit Bartering '' if removed at a later date. I did reluctantly pay, to restore my credibility in the credit community, after being assured by XXXX XXXX & her Supervisor " XXXX, '' whom refused his last name, that their reporting would be deleted. I was also told by " XXXX '' that he was deleting the reporting as a courtesy, because of the confusion in billing ( s ) & any refund of over-payment could be obtained from XXXX. This collection account is still on my credit bureaus. This isn't " Credit Bartering '' as claimed would be considered if not paid within hours by Ms. XXXX, nor were their actions courteous as claimed by " XXXX. On XX/XX/XXXX I contacted Continental credit control account number XXXX ( on credit report ) to request for them to remove the collection that shows on all my credit reports the amount being reported is {$480.00} for medical. I spoke with a XXXX XXXX and I asked for them to remove/delete item from all my credit reports advising them that its pasted the California law for statute of limitations as it has been over 4 years ( has been since XXXX ). Miss XXXX at that point informed me that she would do no such thing because they are not obligated to do this and that this limitation does not apply to them! She told me that they could still collect no matter what the statue of limitations is, but they can collect from me as long as they want. XXXX XXXX was very rude and unprofessional and demanded for me to pay if I wanted to get it taken off of my credit report. The California law needs to be in-forced for Continental Credit Control and to be accountable for their lack of negligence. I have also disputed with XXXX report number XXXX and XXXX dispute # XXXX they rejected both request to remove and stated was accurate which is incorrect due to the time period as the balance maybe correct but the negative medical credit report time frame is inaccurate.

I had an XXXX at XXXX XXXX ( XXXX XXXX XXXX ) in XX/XX/XXXX. I thought my insurance had covered everything. I never received a bill from the XXXX location. In checking my credit report online in XX/XX/XXXX, I saw an unknown debt to a " Continental Credit Control ''. I called XXXX to dispute when they informed me that it was related to an XXXX. I called the XXXX location and they told me the debt had been sent to the collection agency Continental Credit Control. I never received any phone call or notice in the mail from the collection agency either that that there was an outstanding amount owed. My frustration is that the original bill was only {$190.00}. I have worked hard my entire adult life to have a stellar credit score. Now at age XXXX, when I am finally close to buying a property for the first time, I learn that my credit score has been negatively affected by a bill I knew nothing about and would have paid promptly had I been aware. I find it outrageous that the XXXX location and the debt collector can take all these actions that negatively affect me in such a profound manner without ever confirming that I even knew I owed the money. In the fall of XXXX , my wife received pre-authorization for a medical procedure from her medical group, XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX ). The procedure was performed by a subsidiary of XXXX XXXX on XXXX XXXX , XXXX . THIS WAS A FULLY COVERED PROCEDURE, but we received a bill for the full amount, {$1300.00}. XXXX claims the payment was made ; XXXX XXXX claims it was not. Our insurance provider, XXXX XXXX of California has been unable or unwilling to resolve the dispute, despite my wife 's repeated calls over the course of a year and a half -- including three-way conference calls. On XXXX XXXX , XXXX , with the bill still unpaid, my wife filed a letter of grievance with XXXX XXXX . Again, this produced no conclusive action. The bill has now been sent to a collection agency, who has added interest to the original balance. It bears repeating that this was a FULLY COVERED, PRE-AUTHORIZED PROCEDURE. XXXX XX/XX/2020 I had an emergency XXXX XXXX performed at XXXX XXXX, I paid the bill of {$600.00} in total at time of services. A month later XXXX XXXX of XXXX XXXX created a fictitious bill in the amount of {$350.00}. After receiving the bill I spoke to there billing department and was told it was a mistake. A couple weeks after that I received a letter all funds where credited and account is paid in full. Four times I received a bill and after calling received the same letter stating my bill was paid. I then received a collection notice from Continental Credit collections. When speaking to them I was told they could do nothing. I have sent my proof of payment and all copies of letters to both companies. I have never received proof of any charge of {$350.00} and have been told it was an error many times. Even so the bill continues and has been placed on my credit report. This is a felonious bill and acknowledged by XXXX XXXX Continental Credit is aware of this discrepancy. These companies have not fixed this billing error instead harassed me at work, home and placed this on my perfect credit rating.

I received a bill in the amount of {$330.00} from Continental Credit Control and I called XXXX XXXX the representative on my bill. I asked if I could make payment arrangements in the amount of {$50.00} a month and if I did they would agree not to report the bill to the three credit bureaus. She said, yes that this would not hit my credit report if I was making payments to take care of the bill. I made my first payment in XXXX for {$50.00} then XXXX for {$100.00}. I was on time with all payments. I checked my credit report on XX/XX/2020 and the company did report the debt and they reported that I never made any payments. I called the company the next day and tried to speak with XXXX XXXX, she was unavailable. I then spoke to the manager and told him the situation as to why they reported it and why they were reporting no payments were made. He said, that XXXX never told me that she wouldn't report it and that I was lying. I would not have made something like this up. He didn't want to ask his representative why she said and agreed to this with me.

I've made numerous phone calls to internal collection department of XXXX XXXX XXXX XXXX to confirm no debt with them and to complain about their third party collection robot-calls. Somehow my debt, even though already paid off, was passed over to their external debt collector ( Continental Credit Control ). At each of my complaining calls to XXXX XXXX collection department, I was assured that there is no outstanding balances for me to pay, therefore they'd contact Continental to stop them from calling me once and for all. Yet, as of XX/XX/XXXX I've been getting Continental 's robot-calls for 5 months or so. Also, I attempted to get connected directly with Continental 's representative who's supposed to be in charge of my account many times but failed. And, at another time I was told by a different Continental representative that she'd let the one in charge know about my account status. I'm really frustrated being tossed around between these two business practices and can't wait to get my peace of mind back from their pesky robot-calls.

My wife had a medical procedure XXXX years ago. They submitted the bill to XXXX XXXX using my wife 's old account. Months ago I spoke with Continental Credit Control and to XXXX XXXX who said they found the medical bill and would put it through for payment. I thought end of story. But yesterday we received a statement dated XXXX/XXXX/16 from Continental Credit Control showing {$410.00} due, including 10 % interest. We spoke with Continental Credit Control this morning and the first thing they insisted that we make payment over the phone and then they would take it off of the credit report. Only after back and forth conversation did he recheck and tell us that they RECEIVED payment back in XXXX! A statement sent in XXXX for a payment made in XXXX? Well, a month ago we were DENIED a credit card because of bad credit! To add insult to injury, Continental had the gall to tell us we still owed the interest due!

I am getting calls from this number ( XXXX ) XXXX for a XXXX XXXX that is paid. They say they are going to charge my debit card tomorrow and have the last 4 digits which I never gave to my Dr. office. They do have my correct patient number from my Dr office. I cancelled that card ( they don't know that yet ). I called the Dr. office directly and they said that I am paid in full and never sent me to collections. Continental Credit is reporting a medical collection from XX/XX/2008. There have been two concerning issues with Continental. First, Continental Credit did not validate this debt prior to reporting this on the credit report. We had insurance at the time and there was no bill that wasn't covered. Second, this is past the FCRA limitation of 7 years. This bill is from XX/XX/2008 if it is even valid. I have tried to deal with them but they refuse to respond to my requests. They just keep trying to collect this debt at all costs despite our objections. At this point it is past the statute of limitations, past FCRA limit on reporting, and violated the FDCPA by not validating the debt when requested, not respecting a disputed account etc etc. They state there is 62 months of payment history. I had no recollection of this debt with continental credit until I saw it on my credit report a few years ago. They never reached out to me, yet, they kept accruing interest on my account with them. I called them and asked to pay the original amount owed. They refused. I told them they never contacted me. After that, still never received contact and two years later I call again trying to rectify wanting to pay original balance since it was unbeknownst to me I even had this medical debt.
