Dear CFPB, I am writing to file a formal complaint against Consumer Information Company ( CIC ) regarding an inaccurate eviction record associated with my name. The details of the case are as follows : Case Filing Date : XXXX Case Number : XXXX Plaintiff Details : Plaintiff 's Name : XXXX XXXX Plaintiff Attorney : XXXX XXXX XXXX : I am the sole owner of my property, which I have owned since XXXX. I have never been involved in any eviction proceedings or faced eviction at any point.
Unfortunately, due to the distressing circumstances of being XXXX and subjected to a XXXX XXXX incident, my personal information was compromised and unlawfully sold.
As a result, I was enrolled in the XXXX XXXX XXXX program, a federal program designed to safeguard individuals in situations such as mine. Through the program, I was provided with documentation to obtain a new driver 's license, ID number, and other essential documents to protect me from further fraudulent activities. Additionally, the XXXX XXXX XXXX program, acting through power of attorney, successfully removed all fraudulent information from the credit bureaus.
Complaint Details : Despite my efforts to rectify the situation and the removal of fraudulent information from the credit bureaus, an inaccurate eviction record remains associated with my name within CIC 's records.
I firmly assert that this false eviction record is a direct consequence of the identity theft I endured and is in no way a reflection of my rental history or creditworthiness. The inclusion of this inaccurate information has caused significant harm to my personal and professional reputation, resulting in distress and potential financial repercussions.
Legal Defenses and Applicable Laws : Fair Credit Reporting Act ( FCRA ) : Under the FCRA, consumer reporting agencies have a legal obligation to ensure the maximum possible accuracy of information included in consumer reports. CIC 's inclusion of a false eviction record violates the FCRA, as it misrepresents my creditworthiness and rental history.
Georgia Fair Business Practices Act : This state law prohibits unfair and deceptive acts or practices in trade or commerce. The presence of a false eviction record on my background report constitutes deceptive practices that harm my reputation and personal standing.
Demand for Resolution : I demand that CIC takes immediate action to permanently remove and block the false eviction record associated with my name from their records. Failure to comply within seven ( 7 ) days of receiving this complaint will leave me no choice but to pursue legal recourse. I am prepared to escalate this matter to a federal case and present all relevant documentation and evidence before a jury, showcasing my rightful ownership of the property and the absence of any eviction proceedings against me.

This is in regards to a full file disclosure from a speciality CRA, Contemporary Information Corp ( CIC ).
This CRA has run numerous reports on me in the past- including- a dispute with this company back in XXXX XXXX were reporting an expunged record- in which they eventually corrected ( confirmed in a paid report run XX/XX/XXXX ). In XXXX XXXX, they ran another tenant screening report which reported a 'code XXXX Must call customer service for a manual search. ' My full file disclosure request included the below language : " I am writing to request a free annual full file disclosure ( FCRA 612 ( a ) ), including all information recorded and retained, regardless of how the information is stored, including sources for the information in the file, information about persons who have procured a consumer report, and a record of all inquiries, as mandated by the FCRA and enforced by the CFPB. Please include definitions for any coded information as also required by the FCRA. '' " While this letter of full file disclosure request and enclosed identification fully satisfies all requirements of the FCRA Regulation V, please inform me in writing if there are any issues with this request. Any noncompliance of the FCRA or FACTA will be documented and appropriate actions will be executed. '' The response of the full file disclosure was simply a clean consumer report ( attached ).
There is : -no record of the report ran on XX/XX/XXXX ( attached ) -no record of the report ran on XX/XX/XXXX ( attached ) -no mention of the coded information on report from XX/XX/XXXX -no definitions of coded information -no record of the prior dispute -no source of information from previous dispute -no information about the persons who have procured a consumer report on me All supporting documents are attached and labeled.
I am looking to receive a proper full file disclosure - EVERYTHING that this company has in my file - not just a clean consumer report ( CIC sent me a clean report in XXXX XXXX and somehow sent out the 'code XXXX ' report in XX/XX/XXXX ).
In summary- CIC originally issued an inaccurate report, claimed it was fixed after a formal dispute, later issued a report with some sort of coded flag on it, and then issued me a clean report when I asked for a full file disclosure.
These guys keep messing up my report and now are n't following proper protocol for a full file disclosure. Can I please get some assistance? Thanks!

This company is fraudulently reporting incorrect information for my daughter and I. They are fraudulently reporting that we are the same person. They are illegally reporting that we are aliases of one another. We do have the same first name only and different last names. They have never verified if we are the same person or not even though our information is completely different. Both of our information is listed on each other 's credit reports, public records, background checks, employment history, 3 major credit reporting agencies, insurance reports, etc ... We are requesting that this company removes all information that it has listed for both us and wipe the report clean. We are requesting that the company sends each of us SEPARATE copies of our consumer reports and files for us to each review. We are requesting that a security freeze is added to both of our files so that no further misleading, misinformation, incorrect, fraudulent information is reported again until all matters have been resolved. We are requesting that they refund us for the extra money that we had to pay out of pocket to dispute, repair and correct our profiles only for them to submit the incorrect information illegally again. I signed up for my report to be pulled on XXXX and the report is inaccurate. The company that pulled the report is XXXX I was a victim of identity theft and XXXX is reporting inaccurate evictions that have already been proven not to belong to me and have already been removed from my credit reports as well as my XXXX XXXX report. These have already been reported to the cfpb. I want these removed immediately. I have never lived at these addresses that are being reported. It has already been investigated and proved that they dont belong to me. Also, if you look at these evictions there are 2 from the same Address. It doesnt take a genius to know that one could not get evicted from the same place twice, 5 months apart according to the XXXX Report, clearly something isnt adding up. How could one supposedly be evicted and then go back to the same place and be evicted again, as XXXX is reporting? That makes no sense.
I have also included screenshots of the other 2 things that appear on the XXXX report. Two traffic tickets that are in-fact mine. Notice how on the top of the report it says my full name XXXX XXXX XXXX it also says my correct full name on the traffic tickets. On the 3 evictions that do not belong to me it does not say my complete full name. It only says XXXX XXXX. When filling out any applications, documents, or legal documents I always put my full name XXXX XXXX XXXX or XXXX XXXX XXXX. XXXX knows that they provide inaccurate information because they clearly state it in the first attachment that I have submitted. This is unacceptable and I want this immediately removed from the XXXX report.

I requested my free annual credit report from CIC - Contemporary Information Corporation. I received 2 postage due envelopes from this company. 1 ) Why should I be paying for my free report via postage due when they make money off harvesting and selling my data? They should apply proper postage and not use these stall techniques to discourage consumers. 2 ) one envelope contained my report. The second envelope that was addressed to me at my home address contained the reports of another individual who I do not know and lives in another state.And they wanted me to pay postage on his information too? Their quality control and protection of his and my private information was not secure. I called the company to tell them of this problem. They didnt say much. I had to run the phone call. They didnt seem to care or have any interest in the situation of sharing someone else 's information with me or my complaint that they sent postage due. I offered them the report number of the unknown person and my report number. CIC told me to send the report back to them. 3 ) Why would I need to pay to send it back to protect this man 's private data. I have the recording of the call into them to prove they offered no solutions other than me paying to send it back. This is totally unacceptable. I am going to attach the 2 envelopes sent to me, postage due and the 2 cover sheets of the reports. I refuse to upload the other consumers private data beyond the front page for his identification, follow up as wel as verifiable proof of this horrific error that occured.

This situation Is causing me much pain and suffering. I have been trying to apply for new apartments for my family to live in and the information you have posted on my personal consumer report is causing me to be denied roof over my children head. This is my third attempt to have your company make this right. I have had no choice but to file a cfpb complaint to settle the matter appropriately. I received you're correspondence regarding my request for validation of this alleged eviction that you " verified. Since XX/XX/XXXX ; I've called and emailed Contemporary Information Corp. ( CIC ) in efforts of removing ( 2 ) erroneously reported evictions ( without success ) to XXXX from leasing company XXXX XXXX XXXX XXXX dated XX/XX/XXXX and XX/XX/XXXX. Both dates in question were judgments in which I paid my rent late ; however, supported by documentation to include : a letter dated XXXX XXXX, XXXX from the XXXX leasing manager of the apartment community where I was a current resident in good standing and further stating that I'd never been evicted with an attached general ledger from initial date of occupancy, XX/XX/XXXX through move out date of XX/XX/XXXX, address of my apartment rental, and proof of payment of both reported dates. Thus, further proving that I remained a resident well beyond the erroneously reported dates. Moreover, a judgment in Maryland with an accepted/cleared payment after a court filing w/out the landlord requesting the court issue a " warrant of restitution '' is not considered an eviction yet CIC refuses to accept my documentation and remove the false reports of eviction. As a result of their erroneous reporting ; I am suffering tremendously and have been denied multiple rental properties and am currently living in a hotel.

Payment was lost by the previous property management company before they switched over. The new company filed an eviction. Payment was reimbursed and reissued.
My submission to CIC : 1. Proof of payment OVER judgment amount.
2. I still live here, so I wasn't evicted nor was a writ of possession issued.
3. Notice of NonSuit. How can BOTH the LANDLORD and JUDGE sign off on a court document, and it STILL not suffice for CIC?
The actual sealing/dismissal of records per the court can take months. That is why the COURT advised me to submit this paperwork to the screening agency.

a faulty background check company, Contemporary Information CorpXXXX improperly shared information about me from the public domain with a property management company without my permission. When this information was shared it was inaccurately interpreted thereby causing me to be denied the opportunity to rent a house of my choosing. Also, the same background check company reportedly gathered credit score information on me but neglected to pull a full report from XXXX as well, therefore only sharing a partial report on my credit scores from a new scoring company named XXXX. XXXX 's primary usage of XXXX scores is only half the reporting. XXXX scores are widely known to present lower credit scores for consumers thereby diminishing credit worthiness to a potential lender or management company. XXXX somehow misinterpreted a traffic citation for a criminal record and passed this faulty information on to the property management company without contacting the California local court who reported the citation in 2017 to verify that their interpretation was accurate.

I applied for a home to rent, on XX/XX/XXXX, and the realtor agency made a " hard '' inquiry instead of a " soft '' inquiry. I was never evicted, the case was dismissed but on-site continues to report it as if i was evicted. XXXX is reporting an eviction that the courts DID NOT report to them to report. This is Defamation! Yes it is public information BUT they did not get my CONSENT to Publicly share my information or report it. This is ruining my reputation and I am liable to SUE for damages, they have violated the FDCPA and that makes them liable under 15 USC 1692k Civil liability.
