See XXXX XXXX Response At Bottom XX/XX/XXXX Dispute Concerning XXXX XXXX XXXX & Blackwell Recovery Reporting On My Credit Report There was a hostile management take-over at XXXX XXXX XXXX timeshare location in XXXX, TN. a couple of years ago. The new management company advised me and my family that the prior management company was not licensed to manage timeshare projects in the state of Tennessee. The new management company gave us the option to withdraw or opt out of our timeshare interval. We exercised our option and opted out. The prior management company later regained control of XXXX XXXX XXXX XXXX and a class action suit was filed. We joined the class action lawsuit. A negative report was placed on my husbands credit report, which was later removed when we advised the reporting agency about the circumstances and the class action lawsuit. Now, several years later, a negative report has been placed on my credit report. We have paid in full for each timeshare interval we used at XXXX XXXX XXXX. We do not owe any additional money. XXXX XXXX XXXX has continued to charge our closed account for each interval since we opted out of the timeshare. This negative report needs to be removed from my credit report. I have filed a complaint through XXXX. Blackwell Recovery falsely indicates the report is accurate and refuses to remove the incorrect information from my credit report. Company 's Response XX/XX/XXXX Good afternoon : Thank you for bringing this matter to our attention. Please know that Blackwell Recovery is a completely independent, third-party collection agency providing services for XXXX XXXX XXXX. Blackwell Recovery provides these services to its clients within the guidelines of all state and federal laws and regulations. On receipt of XXXX XXXX complaint Blackwell requested verification from XXXX XXXX XXXX that the records in our system are factually correct based on the circumstances included in XXXX XXXX complaint. As part of the validation of the debt, XXXX XXXX XXXX provided Blackwell a copy of the warranty deed signed by XXXX and XXXX XXXX on XX/XX/XXXX. As part of their investigation, XXXX searched the XXXX county records in Tennessee and indicated the deed is still in the XXXX name. This verification is being provided to XXXX XXXX. The information Blackwell Recovery provided to the credit reporting agencies is based on the information in our system. This information has been validated by XXXX XXXX. While our agreements with the credit reporting agencies preclude us from removing factually correct information, we will notify the bureaus in our next file transmission that the information is disputed by XXXX XXXX. XXXX XXXX XXXX has no record of any opt out options offered by the Management company. Finally, Should the XXXX have documentation to the contrary, we respectfully request they forward this information to our attention and we will reopen our investigation. Blackwell Recovery Compliance Manager XXXX XXXX XXXX has completely avoided responding to the issues of my complaint. The only information XXXX XXXX has provided is the assertion that the deed to the timeshare interval previously owned by my husband and myself has not been transferred back to XXXX XXXX XXXX. XXXX XXXX information only confirms the allegations made during the XX/XX/XXXX to XX/XX/XXXX multitude of e-mails between the first management company and the second management company that was sent to timeshare interval owners, asserting that there was negligence, mishandling of information, fraud and improper licensing of the first management company. Now, 3 to 4 years later, XXXX XXXX asks for documentation of these events. Does XXXX XXXX keep e-mails for 3 to 4 years after an issue is assumed to be resolved? I think not. XXXX removed the negative report from my husbands credit report on XX/XX/XXXX. This is clear evidence that the issue occurred and was resolved. You can not remove negative information from my husbands credit file and then report the same negative information on my credit file years later. XXXX XXXX advises that XXXX XXXX XXXX is currently managed by XXXX XXXX XXXX. Apparently the management has changed for at least a third time since our experience. Obviously the first or second management companies did not complete our Opt Out request and XXXX XXXX has no information about an issue back from XX/XX/XXXX/XX/XX/XXXX. Please be advised that I will not be held XXXX between multiple hostile management companies and the negative information on my credit report is unacceptable. In addition to filing an additional complaint with the Consumer Protection Agency, I am contacting the Attornies General of South Carolina my home state, Tennessee the state XXXX XXXX XXXX is located and Arizona the state Blackwell Recovery is located. I am also filing a complaint with the Tennessee Real Estate Commission, asking them for a full investigation into this matter and the proper licensing allegations that were reported during XX/XX/XXXX/XX/XX/XXXX. Company responded on XX/XX/XXXX Company 's Response As part of our renewed investigation, XXXX XXXX provided some additional details about XXXX XXXX concerns regarding the property management company responsible for her timeshare : XXXX XXXX, XXXX has been the Management Company for this owners timeshare property, hired by their Home Owners Association since XX/XX/XXXX. XXXX XXXX XXXX, XXXX is still the Management company for this owners timeshare property. XXXX XXXX is a DBA used by XXXX XXXX XXXX, XXXX. In XX/XX/XXXX, another Management Company, XXXX, illegally took over managing this owners timeshare property. There was a lawsuit by XXXX XXXX XXXX, XXXX to fight this issue. XXXX XXXX XXXX, XXXX won the lawsuit in XX/XX/XXXX and XXXX was forced to vacate. Any promises made by that Company were not valid. XXXX XXXX points out the many years that have transpired. We would like to agree that it has been several years and during that time, XXXX XXXX has diligently sent annual Statements, Reminders and made attempts to contact the XXXX regarding this debt. During that time, XXXX XXXX has no record of the XXXX contacting them to let XXXX XXXX know that they believed that they were no longer owners and provide any correspondence they may have had to substantiate that claim. The possible credit reporting removal in the past by XXXX regarding this debt is not an indication of the validity of the dispute but could easily have occurred because the dispute was not responded to in a timely manner by the data provider and it was automatically removed by XXXX. XXXX XXXX does not reflect that they received a credit reporting dispute from the 3rd Party Default Recovery Company hired at that time. In regards to XXXX XXXX complaint about the Blackwell Recovery tradeline appearing on her credit report, we believe that the information is correct and should remain unchanged. The debt was validated by XXXX XXXX and remains active in our system. XXXX XXXX has updated the settlement parameters regarding the XXXX account to include an option to release them from ownership. This option would release the XXXX from their past obligations owed and any future maintenance obligations for the property. We encourage the XXXX to contact us to review the parameters of the offer. XXXX XXXX XXXX XX/XX/XXXX The XX/XX/XXXX response from Blackwell Recovery is complete hogwash. Blackwell admits there was an illegal management company takeover which I have correctly maintained all along. Blackwell Recovery needs to review the legal aspects of a contract both verbal and written are enforceable by law. We had an agreement with the second management company this does not go away just because XXXX XXXX XXXX and Blackwell does not want to admit they are wrong or the second management company was forced out. As far as XXXX removing the negative information from my husbands credit report in XX/XX/XXXX, there was several communications and the negative information was removed because it was incorrect not because there was no response. Blackwells assertion that there was no response from XXXX is completely false. I have received no letters or communication from XXXX XXXX the assertion that annual billings were sent to me is completely false. I have lived at the same address for 28 years, and my address has not changed. If I had received communication from XXXX XXXX, I certainly would have contacted them immediately. I challenge Blackwell Recovery and XXXX XXXX to provide proof of any communications mailed to me. As far as receiving a settlement agreement from XXXX, that is also completely false. I have received no communication from XXXX XXXX XXXX. I challenge XXXX to prove any communications with me.

I and my husband are XXXX XXXX timeshare owners in XXXX since XXXX. Since the start of our timeshare ownership, we have been paying our maintenance dues on a quarterly basis thru XXXX 's automatic payment plan. Until this day, we have not missed a single payment nor ever late. The 1st quarter payment for XXXX was collected on XX/XX/XXXX. After over a month, on XX/XX/XXXX, I called XXXX XXXX services and had a female agent walk me through in switching the credit card on file for our maintenance dues payment. On XX/XX/XXXX, I was shocked to receive a collection letter from Blackwell Recovery dba Concord Servicing in Arizona. I immediately called XXXX XXXX XXXX to find out what was going on with our account. I was told the payment plan got cancelled in the system on XX/XX/XXXX and as a consequence, our account is thereby considered 80+ days past due with the full remaining balance of {$1900.00} for XXXX Maintenance Dues now due for payment. I shared with the agent that there could have been a system glitch on XX/XX/XXXX because what I did on that day was to switch the credit card on file and it should have not cancelled the payment plan. I also argued that we are technically paid for the 1st quarter which covers XX/XX/XXXX to XX/XX/XXXX so how can XXXX flag our account as past due and impose an interest fee of {$18.00} and miscellaneous fee of {$35.00}? Where did these fees come from? The agent told me it was stipulated in the payment plan agreement. I reviewed the literature on the payment plan agreement and there is nothing in it that would prove we are in violation. There was no reason for us to inform XXXX of anything concerning the payment plan because it was not the intention to cancel the payment plan nor were we aware of an existing issue. XXXX did not practice due diligence to reach out to inform or make us aware of it. Most businesses will make a call, send a notice letter or email about an issue but we didnt receive any of these from XXXX XXXX. Its obvious that XXXX does not review owners accounts to check of anything out of the ordinary before imposing fines or penalties. I asked the agent a few times if we could be extended a one-time courtesy because it was all a mistake and that we've been owners for 16 years with excellent payment history. The agent kept instructing me to deal with Blackwell Recovery directly so I decided to ask for a supervisor hoping to get someone who can exercise better discretion and with a higher level of authority. I had to repeat the circumstances again to XXXX XXXX XXXX of XXXX XXXX XXXX so she emailed me a form to fill out and send back to her immediately in order to reinstate our payment plan. When I asked XXXX XXXX on how the fees can be reversed, she had to transfer my call to Blackwell Recovery because Blackwell is the one to deal with that. I had to go through the same hoops with Blackwell Recovery until I had to ask for a supervisor again. XXXX XXXX XXXX handled my call but unfortunately, I heard the same script from him. He reiterated that we violated the payment plan agreement and that the remaining balance of {$1900.00} is due. XXXX XXXX also said that XXXX XXXX XXXX should have not sent me the form because we can not be put back in a payment plan for XXXX. I reasoned with XXXX XXXX in all possible ways. I mentioned that our excellent payment history for 16 years should at least mean something about our credit worthiness and that our situation is just an isolated case. I also mentioned how the full payment will be a financial burden to us considering the global economic crisis we are in not to mention how illogical it would be to put whatever reserved funds we have into something we can't even use or enjoy during the pandemic. I pleaded to have the fees reversed since these are not even legitimate charges and for our payment plan to be reinstated but to no avail. I decided to pay {$640.00} for the second quarter which is usually collected on XX/XX/XXXX. I wanted to show XXXX XXXX that we are not running away from our financial responsibilities. The next day, XX/XX/XXXX, I called XXXX XXXX XXXX of XXXX again but only to hear from her that she made a mistake in sending me that form. Her excuse was that she just joined the company and didnt know well. I then told her how unfortunate of me to always end up with someone who causes me problems instead of getting help. Knowing now that she is not credible enough to handle the situation, I asked for a supervisor. She said she sent an email to XXXX, a supervisor, to give me a call but I have not received a call until this date. To impart better understanding of my complaint I have attached files to show that our account is in suspended mode ( Exhibit A ). It is flagged not authorized to make payments on the top left. Below the My Account Summary in green background, it also shows that our account is 85 days past due. When you click on Set up a payment plan, the page will then change to show Exhibit B which is the Payment Plan Agreement. There is nothing stipulated in this Agreement that would tell we violated the XXXX. There is nothing mentioned in the agreement that cancelling the payment plan will revert the account to Annual which would then require immediate payment of the remaining maintenance dues otherwise fees will be imposed. On the contrary, it actually allows termination or cancellation of the Card Authorization for electronic debits as long as another payment method, acceptable to XXXX, is used for the Periodic Payments. The {$35.00} fee is actually imposed only when a payment is denied at the time of charge and yet XXXX charged us this {$35.00} fee ( Exhibit C ) when payment for the 2nd quarter is not even due until XX/XX/XXXX. We dont have a loan or owe anything in default to be assessed {$18.00} in interest ( Exhibit C ). Also on Exhibit C, Blackwell Recovery entered my 2nd quarter payment of {$640.00} and also showed it waived the {$7.00} as late fee when this {$7.00} is actually the processing fee collected every Periodic Payment mentioned in the payment plan agreement. I dont want to think that XXXX XXXX of Blackwell Recovery did this to make it look like he extended me a favor because I know these tactics. XXXX did not even exert any effort to resolve this with us first. XXXX took the easy and most convenient route for them to get what they want with utmost disregard of their owners welfare and consumer rights. Our concern is far from complicated but XXXX turned it into a nightmare which brought us immense stress and inconveniences. We dont deserve to be treated this way! XXXX and Blackwell Recovery opted to be cold-hearted and greedy rather than be fair, compassionate and considerate. These two companies ' business ethics and practices must be scrutinized and penalized because they take advantage, deceive and violate consumer rights. The issue here is far more than the {$53.00} fees but this is a matter of respect, fairness and justice. We fervently hope for your intervention and to act as our advocate. We appreciate your assistance and will look forward to your reply.

The information contained in this letter was sent to Concord AND XXXX back in XXXX. As of XX/XX/XXXX, none of the information contained in this letter has been investigated as requested in the first letter sent to Concord and XXXX XXXX years ago. In the first request we asked that your company supply all the information below within 30 days so that we would be fully informed of the late payments XXXX claims we have missed and/or they have not credited to our account properly. We have not received anything from Concord or XXXX regarding this request in two years. This is the second time we have asked for this information and we need to hear from you to make an informed decision about the collection claim of past due payments. This is the second time we are requesting that all question be answered in this audit complaint and that all communication be done in writing within the proper amount of time. It has been two years your collection company should have completed this request within 30 days and that is not the case. Your collection company has far exceeded the 30-day requirement by the Fair Credit Bureau. Please answer the following questions and forward the completed documentation and results to the name and address above as soon as possible. 1. Why you think WE owe the debt and to whom WE owe it, including : The name and address of the creditor to whom the debt is currently owed, the account number used by that creditor, and the amount owed. The only information XXXX XXXX has provided is the assertion that the deed to the timeshare interval previously owned by my husband and myself has not been transferred back to XXXX XXXX XXXX. XXXX XXXX information only confirms the allegations made during the XXXX to XXXX multitude of e-mails between the first management company and the second management company that was sent to timeshare interval owners, asserting that there was negligence, mishandling of information, fraud and improper licensing of the first management company. Now, 3 to 4 years later, XXXX XXXX asks for documentation of these events. Does XXXX XXXX keep e-mails for 3 to 4 years after an issue is assumed to be resolved? I think not. XXXX removed the negative report from my husbands credit report on XX/XX/XXXX. This is clear evidence that the issue occurred and was resolved. You can not remove negative information from my husbands credit file and then report the same negative information on my credit file years later. XXXX XXXX advises that XXXX XXXX XXXX is currently managed by XXXX XXXX HOA. Apparently the management has changed for at least a third time since our experience. Obviously the first or second management companies did not complete our Opt Out request and XXXX XXXX has no information about an issue back from XXXX. Please be advised that I will not be held hostage between multiple hostile management companies and the negative information on my credit report is unacceptable. In addition to filing an additional complaint with the Consumer Protection Agency, I am contacting the Attornies General of South Carolina my home state, Tennessee the state XXXX XXXX XXXX is located and Arizona the state XXXX XXXX is located. I am also filing a complaint with the Tennessee Real Estate Commission, asking them for a full investigation into this matter and the proper licensing allegations that were reported during XX/XX/XXXX. I am also pursuing legal advice from my attorney, to discover all avenues of relief available to me in this matter.

On XX/XX/XXXX, I purchased a time share contract from XXXX XXXX XXXX in XXXX XXXX XXXX, XXXX. The contract was handled by Concord Servicing Corporation, XXXX XXXX XXXX XXXX, XXXX, AZ XXXX. The contract provided two options for payment. Option A : Cash Purchase allowed me to make a single {$44000.00} payment to pay the contract in full if paid prior to XX/XX/XXXX. Option B : Financed Option required payment of {$49000.00} plus fees in twelve monthly payments of {$4000.00} beginning on XX/XX/XXXX for a total cost of {$49000.00} ( an increase of {$4800.00} ). I received a notification dated XX/XX/XXXX notifying me that a loan serviced by Concord was set up and I would receive a statement prior to my XX/XX/XXXX payment due date, indicating that Concord was proceeding with Option B prior to the XX/XX/XXXX option date. On XX/XX/XXXX, I phoned Concord at the XXXX ( XXXX ) XXXX number and provided my bank routing number and checking account number and authorized Concord, in a recorded message, to withdraw {$44000.00} from my account. The representative gave me a transaction number indicating the transaction was complete. I received a letter dated XX/XX/XXXX, congratulating me on payment of my contract stating " Your loan is now paid in full as of XX/XX/XXXX. '' I later received a Reminder Notice dated XX/XX/XXXX, stating " This communication is from a debt collector '' indicating that a payment of {$4000.00} was due as of XX/XX/XXXX. The letter indicated that unless the amount was paid a negative credit report could result. On XX/XX/XXXX, I phoned Concord at the XXXX ( XXXX ) XXXX number and received confirmation that my contract had been paid and that a correction would be issued. Later I received a Loan Statement indicating that a payment of {$8100.00} was due on XX/XX/XXXX. The statement indicated that it was printed on XX/XX/XXXX and it showed the Last Payment Amount of {$44000.00} was received on XX/XX/XXXX. On XX/XX/XXXX, I sent a letter to Concord explaining what had occurred regarding my payment. Having received no response, I called Concord on XX/XX/XXXX and inquired whether corrections were made to my account. When I told the representative that my contract had been paid he said that the funds had not been received. He then told me that the funds were still in my account. I asked why the transaction was not completed. He said that my credit union had denied the transaction on XX/XX/XXXX. I asked why I was not informed. He said I was called but no message was left. I went to my credit union and the account manager indicated that there was no evidence of an attempt by Concord or any other entity to withdraw funds from my account. The funds remained in my account. Later on XX/XX/XXXX, I called Concord and provided the same routing and account numbers and authorized withdrawal of {$8300.00} to make loan payments due for XX/XX/XXXXand XX/XX/XXXX including a {$200.00} late fee. This transaction was completed without incident on XX/XX/XXXX. This action was necessary to prevent Concord from declaring this unauthorized loan to be in default. It is my contention that Concord made no attempt to obtain the funds from my account since the loan had already been put in place. At a minimum, if there had been an attempt that was denied, Concord failed to notify me as would normally be the case for a denial of a transaction. Since I have received no information regarding the status of my original authorization for the withdrawal of {$44000.00} from my checking account, I placed a stop payment for any ACH transfer in that amount at a cost of {$15.00}.

On XX/XX/XXXX I called Concord and I spoke with XXXX who took a payment because I was trying to access the website from XXXX to make payment and the page to make a payment would not load. He told me he was aware of that the website was having issues and he took the payment and waived the late fee. I asked him if this payment would cause a 30 day delinquency and he said it would NOT, and not to worry because they only report 60 day and higher delinquencies. On XX/XX/XXXX I called and spoke with XXXX and XXXX after seeing that I did indeed get a 30 day credit marker. He told me he would speak with his supervisor and have the call reviewed to confirm if XXXX DID indeed tell me that I would NOT get the marker and that someone would call me back, to date I have not gotten a call back or a reply to 2 email communications that I am attaching and the credit marker has not been removed. I have since gotten another marker and they told me on at least 2 phone calls that they only report 60 day and higher delinquencies I have all communications documented. On XX/XX/XXXX I spoke a young lady who told me a XXXX XXXX would review the calls and get back with me, which has never happened. This matter has affected my credit score and I missed a home purchase offer because of this. This has been mentally and emotionally draining. I have requesting a copy of all communications I have had with this company since XX/XX/XXXX. I have asked them for an address or contact person to have the call recording subpoenaed. The reporting on my credit report is not complete. The time share loan was opened in XXXX of XXXX but Concord did not start reporting payments until XXXX of XXXX when I went past due, due to me being set up on auto pay and my bank went through a merger and our debit card number changed and I didn't remember to update the card which was indeed my fault but as I explained to them I was paying every month on time and then they only start reporting me once I was behind, I do not believe that that is right. They are not giving me credit for my on time payments prior to the delinquency. I am desperately in need of help because I am not able to purchase a home because of this. I have 9 other open lines with no delinquencies. I again got another marker in XXXX because I called on the XXXX which is the payment due day and they said because it was 31 days past due. I didn't understand that if my payments are due on the XXXX of each month. Because I had been told anything under 60 days is not reported I thought I was ok. No, another 30 days delinquency. I need these calls reviewed because if I was given correct information these credit markers would never have happened. I feel I am being taken advantage of and being that they have not responded to my emails or returned my phone calls they are very much aware they are wrong. They are currently only showing me with 7 payments made when 17 payments have been made which is causing my payment percentage on this loan to be 70 % due to the delinquencies which is damaging my score tremendously. We attended a timeshare presentation with XXXX. We were picked up from our hotel, driven to XXXX, and in the midst of everything, we were being promised vouchers for food, massages, etc. This was all to entice us. They forced us to stay at the presentation due to them providing us our ride back to our hotel. We were given mimosas before and during the breakfast, margaritas during the presentation and viewing the property, and then more alcohol while the salesperson was discussing the timeshare. It seems to us that they were doing so on purpose to make a sale. Our sales representative told us that he even had purchased a timeshare. He used stories of how him and his family would fly all over the world for very minimal costs, if any. He said that he was able to reserve at anytime, anywhere and it would be available. He even went as far as saying that he could keep in touch with us and assist us in any way possible. This was his tactic to get us to feel comfortable with him, because he never once contacted us nor could we ever reach him. He truly made us feel as though this was an investment for our families, however, its been far from that. Ultimately, he continued pushing us to purchase. We felt as though we would not be able to leave without signing. They continued bringing us cocktails, feeding us promises, and made us restless until the breaking point of signing just so we could leave. After signing, we have found out that we are not able to rent it or sell it, especially not for profit as he told us. They never told us what the interest rate was, even after the multiple times of me asking. The maintenance fees have since gone up and continue to do so each year. Again, something not explained to us. There are so many more fees that are involved with this that was never expressed. For months now we have been reaching out to XXXX regarding our complaints, our concerns, our hardships that we have endured since purchasing this. They have blatantly ignored our correspondences and our communications, solely contacting us for payment. Unfortunately, as expressed, the only solution there is at this point is complete cancellation of this account in its entirety. We look forward to hearing back from XXXX with an amicable resolution of We have explained our situation directly to the resort and instead of assisting us they have decided to use Concord to berate us. It is ruining our credit at a time we can not afford for that to occur. We never agreed to work with Concord and demand they return any debt to the resort so we can finally resolve this matter with XXXX directly. We have sent cease and desist letters to Concord as well and they have blatantly ignored our requests to return the debt to XXXX and to stop contacting us, which is a violation of our rights. Our family went on a one week vacation to an XXXX XXXX at the end of XX/XX/2018. We were offered a presentation to join the XXXX XXXX and given a list of many benefits and ultimately joined the membership on XX/XX/2018, paying a deposit of {$2700.00} with expected monthly payments of about {$200.00} for 24 months. Upon our return home we reviewed the documents regarding the membership and realized the language in the contract was vague and not consistent with the information provided to us during the presentation nor with the initial documents we reviewed. I also attempted to log into their website and was unable to. In the process I discovered a consumer website with disgruntled customers stating the benefits of the club are a scam. I reviewed the XXXX and realized their rating is an XXXX I immediately contacted the XXXX XXXX XXXX XXXX on XXXX XXXX and requested cancellation. I was told the benefits were accurate but the contract merely doesn't read that way and to rest assured it was a good program. I insisted to cancel and was asked to write an official request and email it to their member services department. I did this on XX/XX/XXXX. I also contacted my bank on XX/XX/XXXX and filed a claim. In the interim I was contacted by a person from the XXXX, XXXX XXXX, and he continued to ask me to remain a member, stated I was unable to cancel past five days of signing the contract, and no new contract was offered. I continued to express my concerns though several emails and he continued to state I was unable to cancel. My bank has now informed me that my claim is valid and my deposit monies were returned to my credit card. I emailed XXXX XXXX again and again requested cancellation based on my banks determination of my claim and no use of services. He has not responded but I am now getting letters from XXXX, a debt collector. I attempted to call XXXX on XX/XX/XXXX but they stated they needed to verify multiple pieces of personal information before they could discuss the issue at any level. I was not comfortable disclosing the information requested as I don't know this company and I have not dealt with debt collectors before. I gave them my name, address and account number listed on their letter to me and they said they still could not use that information to verify me. The call was ended as they insisted on getting additional information prior to discussing the matter. The letter from XXXX states non-payment may result in garnishment of social security, veterans pay, wages/salary, and credit bureau reporting as they are a collections company. I made a payment of XXXX for my XXXX XXXX bill, I purchased a XXXX XXXX money order on XX/XX/XXXX and mailed it off that same day and in XXXX of XXXX I received a statement that my payment was never received, they never once called me but the statement says I now owe for 2 months, I called them, they were rude I tried to talk calm and reasonably with them but they always talked over me, I heard that postal services are behind and its my fault I could not find my money order stub with the number on it, so I called them again on XX/XX/XXXX about that payment with was still showing never received, I spoke to a representative named XXXX, I ask if they could let me talk to a supervisor and he says that they are going to tell me the same thing he told me and that was that I still owe the XXXX payment and I insisted that I speak to a supervisor because I said they have more authority than you to help me, he placed me on hold for over 5 minutes and came back and said they are all in meetings, I asked for the supervisor name and I get the run around, he says they will have someone to call me, they are always verifying your number and email, but they never call me or reach out to me by email, I was given an email address for them if I have a complaint, I did email and still no response. I called back on XX/XX/XXXX to talk to them, I again spoke to a representative and says that I have called several time to get someone to help me and to talk to a supervisor because all I wanted to know is if they can take that XXXX payment and put it at the end of my loan and I continue to make my original payments of {$120.00}, and I let them know that I was not happy about when you make a payment they are charging extra {$5.00} to do it over the phone with them or when you make it online and that was never told to me nor did I receive a letter from them that my loan was sold to them from XXXX XXXX, and Concord Services never provided me with there loan number and that my old loan number was still attached from XXXX. XXXX the supervisor I spoke to about putting that XXXX payment at the send says it should be no problem but he would have to send it to his Account specialist for a payment deferral request and it may take up to 3-4 business days for a response and he verified my phone number and email, I let everyone that I spoke to that I was very unhappy with the service that I have been receiving from Concord and this was on XX/XX/XXXX and here it is XXXX XXXX and no one has attempted to reach out to me about anything.

Concord Servicing is the BIGGEST, RIPOFF Company that EVER EXISTS!!! I wish there was a MINUS RATING that I could give them they REALLY DO DESERVE IT!!! DO NOT EVER DO BUSINESS WITH THEM IF YOU HAVE A CHOICE!!!! I had an account through XXXX XXXX and and never missed a payment or never late on a payment. After a few months XXXX transferred my account along with thousands of others to CONCORD SERVICING. WHY my account got transferred is a mystery to me. My payment was due on XX/XX/2020. I called Concord to make the payment and was told that they could not take my payment ( so they REFUSED my payment ), I was told to call back on XXXX XXXX, I called them then and was told the same thing that they could not take my payment and to call back the next day. I called again on XXXX XXXX and was again told they same thing that they could not take my payment and to call back the next day. So I called again on XX/XX/XXXX and was finally told that they had my account transferred over in their system and that because of the delay and the fact that it was their fault they were waiving my XXXX payment and that my next payment would be due on XX/XX/XXXX. I logged onto the website today ( XXXX XXXX ) to make my payment and it shows that I am 30 days behind in payments and there is 2 months payment due. My XXXX payment was NOT WAIVED as promised. I called in to complain about it and was told that yes they did make a mistake in their computers and that the people I spoke with in XXXX LIED to me ( and MANY others ) and gave me incorrect information and that XXXX payment is still due along with XXXX ... I am XXXX and live on a tight budget so with that and all of this XXXX issues it really helped to not have to make a payment for XXXX. BUT now I find out that XXXX is screwing me over and messing up my credit rating and causing MAJOR problems and inconveniences this month. WHAT A HAPPY HOLIDAYS this is going to be!!! XXXX I was notified creditor-Concord Servicing report 30 day late in XX/XX/XXXX to credit bureaus. I contacted Concord to get this resolved for several days from XXXXtoday XX/XX/XXXX and submitted a dispute to XXXX on XXXX and to XXXX on XX/XX/XXXX. It is very difficult to speak with someone at Concord on the mgmt team, resolutions team and the US corporate office. I have only spoken with customer service located in XXXX. I have sent several emails to resolutions team however there is no ph # to speak with a human. My acct was paid several months ahead periodically, the account has never been late. I received an email from resolutions on XX/XX/XXXX indicating the correction would be submitted to the bureaus XXXX. XXXX I emailed Concord Resolutions Dept to get a status on the correction. I then contacted XXXX and was advised a Concord Representative, XXXX, verified the accuracy of the late pmt on the account on XXXX. I completed a conference call with XXXX XXXX XXXX XXXX and Concord Customer Service XXXX XXXX XXXX indicated that he would contact a supv and get back with me. XXXX has indicated that the creditor has the ability to update the account electronically and update on their end same day. XXXX never showed the Concord account as reporting, however I rec 'd notification on XX/XX/XXXX the acct reported late in XXXX. XXXX has not received any correction request from Concord XXXX Concord Resolutions Dept responded back indicating that the correction was submitted on XXXX. I responded back indicating the conversation that I had yesterday with XXXX and Concord Customer Service Rep and that I need to speak with a supervisor. I called Concord and there is no other ph # than the one that transfers you to a Customer Service Rep in XXXX who can not assist with this matter. This is not acceptable to have a US based company however can only speak with CSR in XXXX and unable to speak with anyone with authority to resolve the issue. Concord Servicing Corp, XXXX XXXX XXXX, XXXX, AZ XXXX, services accounts on behalf of XXXX by XXXX XXXX. Our vacation ownership interval contract requires a Refurbishing Fee, due every five years. Our contract was signed XX/XX/XXXX. We do not dispute we owe the fee of {$7100.00} for a full five years. We do dispute that Concord/XXXX XXXX is billing us for the fee 4.5 months in advance of the 5 year anniversary date of our contract, which is XX/XX/XXXX. The contract specifically states ( SIXTH recital, item 2.1 ) that the Refurbishing Fee " ... shall be paid 1 ( once ) every 5 ( five ) years during the term of this Agreement. '' The contract does not specify the Refurbishing Fee is collected on XX/XX/XXXX at the beginning of the fifth year, regardless of the date the contract is signed. If we pay the full amount on XX/XX/XXXX for this first " partial '' five year cycle, we are overpaying by ~ {$530.00}. ( For consumers with a contract date later in XXXX, the amount would be significantly more. ) However, if the amount is properly pro-rated on XX/XX/XXXX for this first five year cycle, we agree in the future we would owe the full amount every five years on XX/XX/XXXX, as it would cover a full 5 years of ownership. We contacted Concord directly, who referred us to their customer, XXXX XXXX regarding any billing errors. We were told by XXXX XXXX that " all Refurbishing Fees are due at the beginning of the calendar year '' and that they would not pro-rate the fee for the partial year. When I pointed out that the contract did not allow them to bill early, we were told that was the way all contracts were managed and if we failed to pay the amount in full as billed, our contract would be placed in default. At no time was anyone impolite ; they were simply firm with their position, would not debate it, and were clear about the consequences. This left us with little option than to file this complaint. To keep our contract in good standing, we are going to pay the fee as billed. However we are also filing this complaint with the CFPB for unethical and inaccurate billing practices.

I was on a vacation in XXXX on XX/XX/2018. When i checked in to the hotel they offered me free upgrade if i attend a Timeshare presentation for 90minutes. I attended the presentation and they were selling vacation packages. From the different packages i chose the cheapest one that best fits my budget. the packages was about {$6000.00} i was told to make monthly payments of {$160.00} for 36 months. I get 2 weeks free Presidential Suite every year for the next 25years at a resort of my choice anywhere around the world they gave me a booklet and a website where i can choose the hotels from. In addition i will get {$3000.00} virtual credit that i can use for massages and free breakfast at hotels that i stay at plus 20 % or more discounts on other days througout the year if i choose to travel. I asked them whats the catch? They said none. By signing up for Timeshare you get all this. I asked when can i cancel? They said within 90days before the contract takes affect. With a {$760.00} penalty which is their application fee. Paid upfront upon sign up. I went ahead and signed up. Provided my SS # address etc. i come back home to the united States and read online about XXXX XXXX XXXX XXXX XXXX. And many people said its a fraud or scam. Some said its true and it works if you travel more frequently. So 2 weeks later i called them to cancel it in XX/XX/2018. becacuse i am from a poor class family and i dont make that much money to travel every year. After numerous emails and phone calls they finally cancelled it. However now i keep getting phone calls to pay the monthly payment of {$160.00}. I keep telling them i cancelled it. I even have emails from the manager of the Timeshare. And yet they are saying the account will stay actice. And if i dont make monthly payments my loan will default and will be reported on my credit as Deliquent payments. I have proof of cancellation and over 50 emails i Exchanged about the cancellation. My HVAC loan was transferred to Concord Servicing Corporation. I paid off the loan with XXXX electronic bank transfer checks on the same day with the same account # 's and same address. I was only credited with the first check. Subsequently, I started receiving calls and bills demanding immediate payment ( I never received any statements because they had an incorrect address listed ). I told them over and over again that this debt had been paid off. They demanded proof. I sent them my credit card statements. They said that was not sufficient ; they demanded a cancelled check which there wasn't one since it was an electronic check. The original checks were sent in XXXX and cashed XX/XX/XXXX. My credit score dropped XXXX points. They refused to talk to my bank XXXX XXXX XXXXXXXX XXXX XXXX so I finally got a copy of the cancelled electronic transfer check which I sent to them. Still they did not clear my account nor did they contact the credit bureaus to clear off my record. My business was denied a credit card because of this ; it has been an embarrassment to me because I pay my bills early and this has damaged my reputation. I contacted the XXXX XXXX XXXX and filed a complaint with them ; the company replied saying they finally " found '' my payment, were re-amortizing my loan and would take off any late payment fees. They would then figure out what the accrued interest that I still owed was and then send me a letter stating what that was. All I got was 2 more letters demanding payment. No apology has been offered. They also said they will notify the credit bureau the next time they run their files which won't be until XX/XX/XXXX but they certainly were quick to notify the credit bureaus that I was " seriously delinquent '' back in XXXX. I demand that this be fixed immediately, that I get an apology and that they close my account. No further payment will be forthcoming from me. They need to be fined for gross negligence.

In XXXX I obtained a loan for energy improvements to my home, through the XXXX XXXX XXXX XXXX XXXX ( XXXX XXXX XXXX ). I have been making payments on that loan until, unbeknownst to me, the company that services that loan XXXX XXXX XXXX stopped payment through the automatic payment method that I had set up with them. When I was able to access their website with new credentials, my loan was no longer linked to my account. I still have no access to any information about my loan, since this was all done via the web account ( paperless ). I also have not received any emails from XXXX XXXX about the account. Around XX/XX/XXXX I received a call from a bill collector notifying me that they were collecting the debt on the account. I told them that I would not pay the debt until I was able to establish contact with the lender. Since this time I have been attempting to contact XXXX XXXX. The phone number at the XXXX XXXX office apparently doesn't pertain to loans outside of California or Florida. When I call this number I am internally forwarded to a third party bill collector, Concord. I have also attempted to contact XXXX XXXX via email and through the form on the XXXX XXXX website but have not received a reply. I am unable to contact the lender to confirm or understand the reason that my loan payment stopped or why this was referred to a bill collector. As I have no information from a trusted source regarding this loan, I am contacting CFPB to understand the legitimacy of the claim against me.

On Wednesday XX/XX/2023, I called Concord and asked for payoff information and where to wire funds. I received an email with instructions on how to wire the payoff on the same day. at XXXX. On XXXX XXXX the amount of XXXX was wired to Concord. On XX/XX/2023 XXXX was wired to Concord to complete the payoff of my loan. The wired funds have been confirmed that Concord has received these funds. I called every day thereafter the see if they have received funds. They kept telling me they have not received funds. I called one time and ask could i talk to someone about wire transfer. I was told that department does not have a phone and the only way i could communicate was with an email. I started the proceedings to file chapter XXXX on XX/XX/XXXX and was discharged in XX/XX/XXXX at which time I did not reaffirm the XXXX XXXX XXXX Timeshare which would have discharged me from all obligations to the XXXX XXXX XXXX XXXXXXXX XXXX, XXXX. I obtained the phone number and tried contacting XXXX XXXX again, and left messages and no one has called or contacted me. I contacted XXXX and XXXX to report this and filled a dispute against this creditor on XX/XX/XXXX. Previously I owed XXXX timeshares with my ex-husband. Both are paid except the annual maintenance fees. In the divorce decree, I was awarded XXXX and my ex-husband the other. My ex-husband has not paid the fees on his timeshare and now the company calls me and says I am legal responsible for the past due fees because they ca n't contact him. When I told them I was no longer responsible and it was spelled out in the divorce decree, the company apologized and asked me to send a copy of the decree. I sent it and provided the husband 's phone number. A few days past and the company called again stating they could not contact my husband so I am still liable because the divorce decree does not supersede their contact. I again advised I am not legally responsible and they should call my ex-husband. I have asked them repeatedly not to call me and they continue to do so on my home and cell phone. I believe they have also reported this debt on my credit report ( I am obtaining a copy to verify ). My credit score has dropped and all my bills are paid on time. I am feel harassed since they continue to call and are not honoring the divorce decree which is a legal document. I have paid all fees associated with the timeshare I was awarded. I want this company to stop harassing me, remove this debt from my report and contact my ex-husband to obtain payment. I believe the tactics of this company are horrible. In XX/XX/XXXX we consented to the XXXX XXXX XXXX XXXX XXXX Direct Install program. A letter was finally emailed to us on XX/XX/XXXX notifying us that the first payment was due back on XX/XX/XXXX and to a company by the name of Concord Servicing Corporation. The letter did not have our correct mailing address. We mailed the XXXX letter with corrections and included a check for {$1100.00} ( six months of payment ) to Concord Servicing Corporation. We received a letter from Concord Servicing Corporation in XX/XX/XXXX for a second loan ( Smart Start Program ). We called the company and asked them what is the status of the first loan ( Direct Install ). Come to find out, XXXX still had not updated their records to the correct mailing address. To date, we called them several times, emailed them, and sent them a certified return letter. They have credited us back {$35.00} in late fees ; however, we found out today that when the first check was received, they applied the payment towards the late fee leaving a balance of {$170.00} ( {$20.00} in late fees ) They should had back dated the credit for the late fees ( {$35.00} ). To this date, Concord Servicing Corporation has never applied the {$170.00} and the Customer Service Representative does not know what happen to the {$170.00} and the company continues to charge us a late fee every month. We have made every monthly payment due by the required due date.

In XX/XX/XXXX, I hired an HVAC company called XXXX XXXX to replace our AC/furnace. They offered financing through a company called XXXX XXXX XXXX ( XXXX XXXX, IA ). The interest rate I agreed to and that is clearly indicated in the handwritten proposal/contract I signed on XX/XX/XXXX was 9.9 % fixed after 12 months with no interest. On XX/XX/XXXX I received notice that XXXX XXXX had sold/transferred the servicing of my account to Concord. In XXXX of this year I finally went online to check the account and saw that Concord has been charging me 11.95 % interest. I emailed to request a correction and was sent a typed contract ( a " Copy of Original '' ) that I had never seen before and did not sign, although there is a XXXX XXXX XXXX Facts '' / '' Disclosures '' page with my signature on it. ( This page includes my name printed by some other than me. ) Key to the issue is that this contract indicates 11.95 % interest rate on the terms page ; however, the original handwritten contract is included as the last page, and it clearly shows the 9.9 % rate. Again, I did not sign an agreement for anything but 9.9 % interest. This company is engaged in fraudulent activity, specifically apparently electronically forging my signature after creating a sham contract that does not reflect the handwritten agreement I signed with the XXXX XXXX sales agent present in my house.

Dispute Concerning XXXX XXXX XXXX XXXX Blackwell Recovery Reporting On My Credit Report There was a hostile management take-over at XXXX XXXX XXXX XXXX location in XXXX, TN. a couple of years ago. The new management company advised me and my family that the prior management company was not licensed to manage timeshare projects in the state of Tennessee. The new management company gave us the option to withdraw or opt out of our timeshare interval. We exercised our option and opted out. The prior management company later regained control of XXXX XXXX XXXX management and a class action suit was filed. We joined the class action lawsuit. A negative report was placed on my husbands credit report, which was later removed when we advised the reporting agency about the circumstances and the class action lawsuit. Now, several years later, a negative report has been placed on my credit report. We have paid in full for each timeshare interval we used at XXXX XXXX XXXX. We do not owe any additional money. XXXX XXXX XXXX has continued to charge our closed account for each interval since we opted out of the timeshare. This negative report needs to be removed from my credit report. I was notified in XX/XX/XXXX via phone by Blackwell that I was in collections with XXXX for my quarterly dues, which in fact I was and did not dispute, due to incorrect ownership information. They had my ex husband 's contact information, and I am the owner by court order of the XXXX XXXX. I traveled to XXXX XXXX XXXX and was persuaded into attending a timeshare presentation for XXXX XXXX. Unfortunately, I made the mistake of signing up for the membership. After a day or 2 I realized the company was scamming tourists out of their money and not providing the type of service advertised during the presentation. We have bought a timeshare with XXXX since 2019 and it has not benefited us. Instead, we have been throwing our money to the wind. The sales representatives did not go into further detail and were manipulative. They made it seem as if this was a great deal and available only for that day to get me to feel like I had to sign right then and there. They had me feel as though I could not walk away, no matter how many times I said no to this contract. I was misled and pressured into signing this contract. The increasing fees for this membership have placed a strain on our finances. This has become an extremely stressful situation for our family and continues to be a burden in our lives. We have made countless requests to be released and the only solution is for XXXX to move forward with the cancellation of this account entirely. We do not want to be partnered with a company that has such disregard for its owners and is purposefully manipulative. First I DID NOT RECEIVE A WELCOMING LETTER FROM CONCORD! Inform delivery shows that the Concord letter was on Saturday, XX/XX/XXXX, was NEVER DELIVERED TO ME!! I barely receive mail through the USPS ; my neighborhood DOES NOT HAVE a regular postal person so I signed up for USPS INFORMED DELIVERY so I could see when any mail was coming. This is why I pay EVERYTHING ONLINE, because I do not get my mail timely. Mailing my payments could get lost, misplaced be considered late and ruin my credit which is excellent. I haven't mail a letter in almost a year and a 1/2 ; because of the poor service from USPS. I was late paying my timeshare maintenance fees, for the XXXX of 2015, and it was sent to collection in XXXX 2015. I paid the collection agency in full, and verified with them that I was paid in full, however they failed to return my account to the original creditor, and instead kept my account open so that the original creditor never knew to bill me for the XXXX of 2015. So neither the original creditor nor the collection agency have sent me anything in writing notifying me of the debt, but instead have made phone calls harassing my elderly parents on their home phone number thrice in the past week. Once by automated robot system, and twice by a live representative from the collection agency sharing my personal information on their answering machine. I tried to work this out with XXXX XXXX XXXX XXXX and they are unwilling to even respond. I am the victim of identity theft. Per the FCRA they are required to validate the debt they have said I owed and have not done so. I disputed through the credit bureaus already and they credit bureaus have come back saying XXXX has verified the debt. Verified and validate are two different things. Verify could mean they answered the correspondence the bureaus sent them and said the debt belongs to XXXX XXXX. Validate means to bring facts to the table XXXX my signature on a contract thats actually my signature would suffice ). XXXX then sold my debt to Blackwell recovery and after telling XXXX they are chasing a fraudulent debt they have decided to take their name off of it which was a smart move. Ive notified Concord several times ( see attached letters and timestamped emails ) that I was disputing the debt, and those notices have been disregarded. Concord continues to send me bills. They charge {$5.00} for payments over the phone or on-line, but not on the much more manual method of sending in a paper check. Then they categorize that charge as 'Late Fees '. The payments made over the phone or on-line post in XXXX hours. For my Timeshare bill, the company does not send me a statement. I can not send my payment to the physical timeshare place ( in PA ) because they will not accept the payment. They use a service called Concord. Concord does NOT send me a statement for the amount but then sends me a collection notice and charges me an extra {$35.00} to take my payment. I signed up for a time share and I had been unable to use it every time that i went to use it due to blackout dates that weren't in the contract. I was still honoring the contract in good faith. The loan, after several years of servicing, was sold to Concord Servicing. A single payment was paid late, generating a late fee. The subsequent monthly payments were paid on time as usual, via online banking bill pay service. Concord continued to charge late fees upon late fees ( pyramiding ). I had a Home Improvement loan with Concord and a balance of {$16000.00} which I paid off on XX/XX/XXXX and they wont update the credit report with a XXXX balance so my rating is going down because it looks like I have XXXX more debt then I should have total. They have refused to do this and claim my rights to do this don't exist. I need them reprimanded for their business practices and the debt associated with my name returned to the original creditor.
