RE : Attentively review my formal writ composed declaration of not proven complaint misinformation that is all or in part : deficient of the adequate current status in the fullness of TRUTH, ACCURACY, COMPLETENESS, TIMELINESS, documented OWNERSHIP, certifiable RESPONSIBILITY, or otherwise irrefutable, complaint obligatory, and regulatory requisite reporting thereby mandating your immediate actions to rectify and remedy and any infractions behavior ( s ) by retaining or returning to demonstrate TRUE, CORRECT, COMPLETE, and COMPLAINT METRO 2 data field formatted reporting!!! I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX , XXXX , and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with The XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( 1 ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C. 1681s-2 ( a ) ( 1 ) is amended ( 1 ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( 2 ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( 1 ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( 5 ), before the end of the 30-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. 1. COLUMBUSFIN bal. {$3100.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. My credit issues are very specific, these accounts and/or items do not belong to me. This means that you are reporting incorrect account information within my credit report. It is this in mind that I request that these listed accounts and items be Blocked and Deleted. According to the Fair Credit Reporting Act FCRA, Section 1681c ( 2 ) Block of information resulting from identity theft. 1.Block. Except as otherwise provided in this section, a consumer reporting shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from alleged identity theft, not later than four ( 4 ) business days after the date receipt by such agency of 1. Appropriate proof of identity of the consumer ; 2. A copy of an identity theft report 3. The identification of such information by the consumer ; and 4. A statement by the consumer that the information relating to the transaction by the consumer. I have provided all of the above listed four ( 4 ) items within this package. Therefore, I expect these listed accounts to be deleted and blocked within ( 4 ) business days. This is clearly an identity theft issue. I am also entitled to receive a free copy of my credit report, so I am requesting a free credit report and that all of these accounts, public records items, and inquiries be permanently blocked and deleted. XX/XX/2017 my auto was totaled, made a phone call to the insurance company and the lien holder as well as made a call to the gap company to let them know what was going on so they can get this taken care of. The insurance company XXXX XXXX offered a settlement in the amount of {$6300.00} and the gap company paid the remaining balance of {$1600.00} I recieved an email from my insurance company with a copy of the check that was sent so I called my lien holder to make sure everything was satisfied and taken care of. Employee from Columbus Finance stated that I owed a balance of {$140.00} because there was interested added AFTER a payoff was given to the insurance company. I have never been made aware of this via email, phone or mail that there was an amount due from Columbus Finance they told me that it was n't their responsibility to make me aware of there being a balance owed. ( they then reported this to my credit stating I am 90 days past due ( again never was made aware of this until i called ) insurance company asked for further information the lien holder refused and said it was n't their responsibility for sending any further documentation. This company is a scam when it comes to the payoff of your loan they have several reviews about this same issue. The woman at the lien holders office even admitted that the interest was added after giving a payoff and letter of intent to the insurance and gap company. They do n't even want to listen to this on the phone they laugh at you and just tell you that you owe the debt and that this is an daily interest loan ( again I was never made aware of this or the daily interest amount ). They are just waiting for this to pile up so you owe a bunch of money. This needs to be settled in full. I have contacted the BBB, the OHIO ATTORNEY generals office and now I want this off of my credit report as I am not 90 days past due and I do n't owe this debt.The next step is going to be contacting an attorney to sue the company as well as the two individuals that were on the phone with me XXXX, and XXXX I believe where their names. They said it took 113 days to receive anything from the insurance company and that it needed to be paid in 10 days I have totaled a car before and it takes more than 30 days to get a check for a total loss, this is n't my fault if a payment is n't received as I am not in the office cutting the check or receiving the check. This needs to be disputed with the lien holder, insurance company, and gap company not me as I am not the one that has access to my account and the payoffs or interest on the account the lien holder does. I also financed Gap coverage in my loan so if something happened like this then my loan would be paid in full not be in this mess fighting back and forth with something that is out of my control.

AS OF first Week in XX/XX/XXXX : I 'm seeing XXXX hard inquires on my credit. They are from a car dealer XXXX XXXX XXXX in XXXX Ohio. They asked if I would cosign as backup for a vehicle for my husband. I specifically refused to fill out the application or to sign ANYTHING until they knew if he needed a cosigner or not. They said they would n't run my credit without my signature, I never did sign or fill out this application and they ran my credit twice. Did not bother to call me either to inform me that my credit was ran. I did n't authorize this. I have retrieved the unsigned form one of the banks got for a credit application. Again this is unsigned and, not filled out by me! The bank stated they get them unsigned often. What good is a signature if they run consumers credit without it and especially without consent? XX/XX/XXXX : Update : So I have been fighting this and have called and gotten the run around each place I call. One of the banks however has been very cooperative where as the other has not. The bank that 's been cooperative ( XXXX XXXX XXXX ) emailed the application form that I did not fill out or sign. They are also going to look into mailing me a letter of dissolution which is what XXXX said I needed. Second bank ( Columbus Finance ) unwilling to work with ME when they pulled MY info keeps saying for me to call the dealer so I just called and spoke with XXXX. Recorded the phone conversation. I feel he was eager to get me off the phone, said he would call me back, I asked when. He said to give them 10 days. He denies pulling my credit, then when I tell him I had the form I actually did not fill out and it was unsigned he said I gave him my DL which is his way at trying to justify that for a credit pull. seriously?! You provide a DL to test drive not to pull credit. They know they were in the wrong, stumbling on words to get me off the phone. The Credits pulls are from XX/XX/XXXX and XX/XX/XXXX.

I have a payment that is almost 30 days late. My fault, totally. When attempting to discuss a payment arrangement with Columbus Finance, I was belittled, spoken to rudely, and outright told to " stop talking '' after being asked a question that I assumed he wanted an answer to. I have never been so rudely and disrespectfully treated by any business. Ever. I was told if I did n't call with a payment by Friday XXXX XXXX, my car would be picked up. I was hung up on after this conversation on XXXX XXXX, 2016 and now on XXXX XXXX, no one will answer my calls or return them. I have called XXXX times and left XXXX messages with the person I normally speak with.

This is my second dispute and Looking over my credit report I noticed some accounts that do not belong to me. The accounts need to be deleted from my credit report immediately. This affecting my ability to buy a home. This is an act of fraud and I am a victim of fraud.
