To Whom It May Concern : I am writing to share a terribly egregious situation created by the holder of my home mortgage, Colorado Housing and Finance Authority ( CHFA ), and their servicer XXXX e. I am also writing to request your assistance in this matter as multiple attempts to contact CHFA/XXXX to resolve the dispute have proven futile. Due to CHFA/XXXX 's neglect, I was unknowingly exposed to a huge potential liability and I am now being penalized for CHFA/XXXX 's failure to properly service my home mortgage. CHFA/XXXX has levied a {$1600.00} unauthorized penalty against my escrow account which more than doubles my escrow payment and increases my monthly mortgage payment over 20 %. I closed on my home on XX/XX/XXXX. I utilized an independent mortgage lender/originator, XXXX, to obtain a CHFA Home Loan, and I obtained an initial Property/Hazard policy through a XXXX XXXX agent in XXXX, CO. Upon closing I learned that XXXX XXXX would not be able to continue my Property/Hazard coverage due to some ' fire line inspection issues ( it is a mountain home ). I immediately obtained a new policy via XXXX XXXX brokerage, under an insurance company named XXXX with no lapse in coverage. I paid approximately 70 % of the annual premium with the understanding that the servicer would be billed for the remainder to be paid from escrow. I took steps to notify the mortgage originator, XXXX, and provided a copy of the policy ( see attached 1 / XX/XX/XXXX email and policy ). Around this same time I was notified my mortgage would be transferred or acquired by CHFA and serviced by XXXX. I was assured all account information, including insurance policy, would be forwarded to the new loan holder and servicer. Approximately 12 months later, XX/XX/XXXX, I was contacted by CHFA/XXXX stating my XXXX Property/Hazard Policy had been cancelled. I explained that a new policy had been obtained back in XX/XX/XXXX, with no lapse in coverage, and information was provided prior to CHFAs acquisition of the loan. I subsequently provided a copy of the XXXX policy ( see attached XX/XX/XXXX email ). Later in XX/XX/XXXX I received another notice from CHFA/XXXX stating again that my Property/Hazard Policy had been cancelled and that I was required to maintain coverage, and either to provide proof of insurance or obtain insurance. I contacted CHFA/XXXX again who then notified me that the XXXX Policy had also been cancelled, and that CHFA/XXXX now had no record of coverage after XX/XX/XXXX. CHFA/XXXX did not provide any reason as to why the XXXX policy was cancelled, and could not verify payment for the coverage as they had no record of the XXXX policy. After several attempts to contact XXXX XXXX brokerage and XXXX myself, I was unable to determine why the policy was cancelled. As quickly as possible, I obtained a new home owners policy, again through XXXX, but this time I utilized an agency in XXXX, CO accustomed to insuring mountain homes and dealing with ' fire line ' issues. The policy and premium information were provided to CHFA/XXXX who made payment in full on XX/XX/XXXX in the amount of {$1000.00}. This is my current Property/Hazard policy in full effect, so once again I believed the matter had been resolved. In late XX/XX/XXXX I received yet another correspondence from CHFA/XXXX again stating I needed to provide proof of insurance. I contacted CHFA/XXXX and spoke, at length, with their representative XXXX on XX/XX/XXXX. I explained all the events which had occurred over the past year and confirmed I have complete Hazard/Property coverage in effect through XXXX. I advised her that I was not made aware of any lapse in coverage and that CHFA/XXXX had in fact failed to adequately service the loan from its inception failing to obtain policy coverage information and make payments on the new XXXX policy for 12 month s. At the conclusion of the conversation I was assured by CHFA/XXXX representative XXXX, that I would only be billed for the lapse in coverage from the date I was notified ( XX/XX/XXXX) until the date the new XXXX XXXX policy went into effect, XX/XX/XXXX. XXXX gave me an estimated charge of approximately {$160.00}. You can imagine my shock when I received the attached notice that CHFA/XXXX had actually assessed a charge of {$1600.00} against my escrow account on XX/XX/XXXX, under the guise of " forced place " insurance, intended to cover a prior period in time ( please see attached CHFA notices XX/XX/XXXX &XX/XX/XXXX ). I have spoken with CHFA/XXXX on multiple occasions since that unauthorized penalty was assessed, even contacting senior servicers in CHFA ' s XXXX Office, all to no avail. CHFA/XXXX has charged a so called " premium '' for a backdated policy by an insurance company who had never before inspected or insured the property. CHFA/XXXX 's attached escrow transaction claims an effective date of XX/XX/XXXX, but the policy states the coverage is for the period of XX/XX/XXXX to XX/XX/XXXX ( again a past period ). The expeditious nature with which the backdated policy was obtained and cost of coverage imply a pre-existing relationship with their provider, possibly indicative of kickback and/or commission on the so called " policy '' purchase. Per Colorado Revised Statutes definition, insurance is a service which transfers risk from one party to another and insurance can not be provided when there is no risk being transferred. In this case no risk or uncertainty exists, because all events are known and in the past. Further Colorado Revised Statutes provide no insurer is capable of assuming the insured 's risk when there is no risk to be assumed. CHFA and their servicer XXXX are therefore attempting to assess an unauthorized and unsupported penalty claiming to obtain an insurance policy to cover a past period in time. This practice is also prohibited under Dodd-Frank. I agree through the execution of my loan documents that CHFA may obtain insurance on my behalf in security of the asset, if l refuse to maintain hazard/property insurance. However, in this case I never refused or failed to obtain coverage. Had CHFA/XXXX adequately serviced the loan from their initial acquisition, no lapse would have occurred. CHFA/XXXX has assessed an unauthorized penalty on my escrow account, rather than doing their job and properly servicing the loan as follows : 1. They failed to obtain and maintain accurate Property/Hazard Policy information upon acquisition/transfer of the loan. 2. They failed to ensure payment and continuing coverage under the XXXX Property/Hazard Policy. 3. They failed to notify me timely of any lapse in coverage and any potential liability. In failing their due diligence and responsibility as mortgage holder and servicer from the beginning, CHFA/XXXX has exposed me to substantial risk and have charged my escrow for a supposed policy which does not meet the Colorado Revised Statutes for insurance, potentially defrauding my escrow account under the guise of a " forced place " premium. I am insisting per the loan agreements, Colorado Revised Statutes and Dodd-Frank Federal Regulation : 1. The reversal of the {$1600.00} unauthorized penalty levied against my escrow account 2. A new escrow analysis ( post reversal ) I would like to conclude by stating that I am a relatively new resident to the state, who fell in love with Colorado, deciding to make it my home. However, I am seriously beginning to question that decision given how this state sponsored agency conducts business, attempting to take advantage of new home owners. I would greatly appreciate any assistance you or your agency may provide in resolving this matter.

Due to unforeseen and unavoidable circumstances we had to file bankruptcy, chapter XXXX, in XX/XX/2018. At the time of filing we had received notification prior of our mortgage lenders intent to foreclose on our mortgage. Our bankruptcy attorney advised that we needed to complete a loss mitigation package with our mortgage lender to modify the loan so that we could get back to an on time and current payment structure. We submitted the package by fax on XX/XX/XXXX. Follow up was made in XX/XX/2018 with our mortgage lender to get an updated status on the process and we were informed that they did not have the required documents and asked that we resubmit the package and supporting documents and needed to start making paymentd. Documents were emailed again in XX/XX/2018 and auto bill pay was set up to initiate the monthly installments. We received another package in XX/XX/2018 with a checklist of documents that were needed in addition to those submitted and updated docs were needing to be resigned and dated. The additional documents were submitted XX/XX/XXXX and XX/XX/XXXX as requested. I received a letter in XX/XX/XXXX stating there would be an appraisal performed and it would be at my cost. Shortly thereafter a letter was received from the attorney working for the mortgage company stating we needed to pay arrears to the filing date or they would request the bankruptcy stay protection would be requested removed with the courts. We received a court document stating the stay removal was honored. I contacted the mortgage lender XX/XX/XXXX and was told I needed to speak with the bankruptcy department but they were gone for the day. I have not received any further documentation from the mortgage lender or their attorney 's office. I reached out to the lender today, XX/XX/XXXX at approximately XXXX, and was told that as of XX/XX/XXXX we still needed to submit the same that was previously submitted on XX/XX/XXXX and XX/XX/XXXX and asked to speak with the foreclosure department. Their representative advised that I could submit an email request to receive an update or I could contact their attorney to get information. I called the attorney and spoke with XXXX who verified the stay removal, I asked for an update on the process and was told there was a sale date of XX/XX/2018. I inquired why I've received no additional documents or court filing papers and was told that they do not have to supply anything more or refile as they initially had done and that it was up to me to find out on my own. I asked about the loss mitigation in process with the lender and he said if the lender has accepted and is willing then it will halt the proceedings. XXXX asked that I forward the documents emailed to the law firm which I emailed immediately. I called the loss mitigation department again and spoke with XXXX and asked if she could recertify what I was told earlier and what the attorney stated. She again verified documents needed as of XX/XX/XXXX, I told her that I did submit the aforementioned documents on XX/XX/XXXX and XX/XX/XXXX. She review further notes and said that she now sees that and it was in a " different place '' on their system ; she was able to confirm what was received and that I again needed to submit several pages of the packet with the current date and outline a few other items needed and that she could email the list to me, to which I confirmed my email address. She mentioned that I needed to submit supporting documentation to my claim of hardship when the initial form stated that no support was needed for unemployment, loss of income and medical. She said it stated it is needed. I called back and spoke with XXXX about an hour later as no email was received, she said the notes show the email was sent and attempted to verify with XXXX, who sat next to her. She said it was sent and verified my email address, I confirmed that I still did not have it and asked for it to be resent as I needed the email to respond and include the attorney counsel to show intent and documents sent ; as of the time of this complaint ( XXXX ) it still has not been received. I've had this mortgage with XXXX for nearly XXXX years and up until the time they optioned to use their current servicer ( XXXX in Illinois ) several years ago I had little issue. They were always fast and efficient and helpful, unfortunately I find the servicer to be slow and generally slow in every effort to their benefit. At this time we are in limbo and feel that due notification should have been send, as well as updated intent for the foreclosure with new filing and sale dates.

I got hurt on the job at last employer. I could not do the job any more so I resigned and started going back to school. I tried to get my mortgage company to give me a modification on my loan about XX/XX/XXXX ( for the fourth time, but first time because of new XXXX ). They denied me ( again ), at this time I had a room mate that I knew was not going to last long. I managed to keep the room mate almost a year to pay bills, but in XX/XX/XXXX all that changed and I applied for XXXX which is XXXX XXXX XXXX XXXX XXXX, I know I can not do what I used to do for work, and even have a Workmans Compensation doctors documentation about my list of work restrictions. Up until XX/XX/XXXX I was able to pay all my bills with my XXXX money, My income tax return for the previous year, and my Pell Grant money from my school. XX/XX/XXXXwas the first time I missed a mortgage payment in the 10 years I have lived in my house. I made sure to call the mortgage company and tell them what was going on i was told to pay what I could by their representative, and fill out a loss mitigation packet. About the end of XX/XX/XXXX I sent the mortgage company a XXXX cashiers check, they told me information I was missing from my packet, in a letter and said I needed to send them more money. Mid XX/XX/XXXX. I sent another loss mitigation packet to the mortgage company, because just sending in the missing information again was not enough. I also sent them an XXXX dollar cashiers check about the end of the month. They again said I was missing information, and sent the check back saying they do not take partial payments. I again sent in yet another lossmitigation packet to my mortgage company Colorado Housing and Finance Authority, and tried to resubmitt the same XXXX cashiers check to them. Again they sent me back the check with the same explanation, and told me I was missing information. I was told at the beginning of XX/XX/XXXX my house was being put in foreclosure. XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX in XX/XX/XXXX. I am looking for work, but I have gotten so many rejection letters because the new direction I have to go in order to work I have little real experience in. I am even volunteering at a business in order to get work experience, but they do not have open positions for me to get a pay check at the moment. I Called a number I recieved on a mailer to help with avoiding the foreclosure which is XXXX XXXX XXXX about the beginning of XX/XX/XXXX, I was on the line when they called my mortgage company the first time. I was told if I paid XXXX my mortgage company would put the rest of money I owed on the back of my mortgage. I have done my part but since I sent in my last loss mitigation packet last week about the same time the public trustee in my county said the mortgage company again is saying I am missing information in my packet and their lawyers are only ones who can delay my foreclosure. The lawyers are asking for the sale t proceed this Wednesday. Every time I have sent a loss mitigation packet this year I make sure to send my XXXX documents, and the little bit of documentation I have giving my money I get from My Welfare, which XXXX is a welfare program. I am also actually ahead on my payments for my mortgage as far as the payment amortization packet says. Which says I am where I should be for XX/XX/XXXX. My interest has always been 6.5 %, but since Colorado Minimum wage is higher than many other states renting somewhere else would cost me more than the mortgage payments do and that is for an apartment. I really am upset that my mortgage company has never wanted to help me, nor do they give me a chance to try a modification, or grant me a forbearance. I now have a steady room mate ; he is actually my fiancee, that pays their bills, but do not have enough money to cure the mortgage held by the public trustee, which would stop the foreclosure. Also just a note an example of missing documentation the mortgage company refuses my loss mitigation requests for is, I will send the packet in middle of the month, the mortgage company will say i am missing the bank statement for that same month that was not even published until after they already received the packet.

Please see below a timeline with my issues with Colorado housing ( CHAFA ) XXXX XXXX Filed for a forbearance with mortgage company ( CHAFA ) it was approved XX/XX/XXXX Forbearance ended XX/XX/XXXX & XX/XX/XXXX- I made my regular mortgage payments while I was in the process with XXXX XXXX XXXX doing a refi on our property. End of XX/XX/XXXX my refi was set to close on XX/XX/XXXX. So I did not pay my mortgage for XXXX. The refi didn't end up going through to The refi company wanted copies of XXXX taxes I hadn't even filed yet. XX/XX/XXXX our home went into foreclosure XX/XX/XXXX I filed for modification XX/XX/XXXX sent paperwork to Colorado housing ( CHAFA ) via email Called 5x to follow up on paperwork they said it would take a month to process XX/XX/XXXX - We listed our home for sale with the XXXX XXXX. We were terrified of losing all the equity we had on our home. We didn't want to sell our home XX/XX/XXXX - Our home was under contract XX/XX/XXXX - Our home caught fire, our shop burned to the ground and our home was damaged XX/XX/XXXX - contract on home fell through XX/XX/XXXX - Called they said our house was officially in loan modification. Putting foreclosure on hold, I paid my first payment while in loan modification they said i could do a partial claim. Never received any paperwork I called at least 10x checking on status of loan modification always the run around no paperwork ever mailed out XX/XX/XXXX - Paid mortgage Called and spoke with the manager and said they were still waiting on loan mod XX/XX/XXXX called again following up with mod they had no answers other than it was processing and i was not in active foreclosure but it was on hold. I called every other day asking for a resolution no one would call me back. Still haven't received any paperwork. I asked the mortgage company to call the county and stop the foreclosure they said it was on hold with them. The county still shows its in current foreclosure XX/XX/XXXX -paid the mortgage XX/XX/XXXX - We received a foreclosure notice that our home would be foreclosed on XX/XX/XXXX called 5x this week asking for update XXXX XXXX and XXXX - My husband and I both spoke to 2 different managers XXXX and XXXX. Both had told us similar stories. They aren't sure what is going on that our modification is approved, they aren't sure what is wrong. They aren't sure why we haven't got our modification paperwork. Every Time they escalate to a higher manager and said they will call us back and nothing. We told them we received foreclosure notice from the county, they assured us the foreclosure was on hold. However I emailed the county lady and she told me that it was still in active foreclosure. XX/XX/XXXX retained XXXX law firm XXXX retainer to assist in modification and foreclosure issue XX/XX/XXXX paid regular mortgage payment XX/XX/XXXX chafa report on our credit that our home loan was delinquent 180 days in the month of XXXX, but has reported current the entire time since i started forbearance. XX/XX/XXXX called chafa to have them remove the credit report reporting negatively asked if there was any update on modification they said no XX/XX/XXXX law firm XXXX law firm has called 4x asking to escalate to a manager, no one returns calls ever Its been over 98days since modification and I have had nothing sent to me for modification i have been promised several times that i am approve and its processing then told they aren't sure what's going on Our home is posted on XXXX as a pre foreclosure every real estate agent under the sun has contacted us to sell our home. We are being bullied to sell by home buyers trying to undercut us.

This is XXXX XXXX again. Please see complaint XXXX. I received a call from XXXX XXXX, the specialist who is supposed to be handling my loss mitigation claim, on XX/XX/XXXX. she advised me that I had been approved for forbearance. She also stated there were a couple more documents that she wanted ( even though I had already sent them to her ). I sent those items to her again. On XX/XX/XXXX she emailed me a formal letter discussing my forbearance. On the same day, I emailed her regarding the incorrect information in the letter and requested follow up. Specific issues with the letter : " Lender has made a loan to mortgagor ( s ) that became delinquent under HUD mortgage letter XXXX, dated XX/XX/XXXX. Loan is currently due for XX/XX/XXXX. '' I have paid my mortgage every month until XX/XX/XXXX. I applied for forbearance in XX/XX/XXXX and the specialist who was supposed to me managing my forbearance has bungled the whole thing and has drawn this out in a way that I have been living in a house that is unlivable. I am in the middle of suing the seller of this home and she mismanaged my loss mitigation claim so badly that it is now interfering with my ability to have the issues within the home thoroughly inspected for mitigation. I have very specific court dates that are not flexible. I have sent XXXX all the official court recorded documents with these dates. I have been waiting since XX/XX/XXXX for some sort of help or response. Every month, I have hoped and prayed and waited until the XXXX before paying my mortgage. Finally after receiving word on XX/XX/XXXX I began looking for an apartment complex. on XX/XX/XXXX XXXX XXXX instructed me that I had 30 days to find and sign a lease. On XX/XX/XXXX I looked at an apartment and sent in an application. on XX/XX/XXXX I put down a {$500.00} security deposit to secure the apartment. When I received the formal forbearance agreement letter and noticed that the information was wrong, I emailed her about it same day asking that it be fixed. I called her 3 different times on XX/XX/XXXX and was not able to speak with her specifically. I called XX/XX/XXXX and I was told she would call me back. XXXX XXXX did not call me back. On Tuesday XX/XX/XXXX I called again and while waiting for XXXX XXXX to become available I was disconnected. I did not receive a call back. On Wednesday XX/XX/XXXX I called again and I spoke to a representative who advised that the only person who could fix the letter was XXXX XXXX. The representative that I spoke with tried to get XXXX XXXX to speak with me personally to resolve the issue. XXXX XXXX would not take the call to resolve the issue. I am supposed to move in on XX/XX/XXXX. I will not be able to move into any apartment complex with a letter stating that I have not paid my mortgage since XX/XX/XXXX. I have paid my mortgage up to XXXX when I was told I had been approved for a special forbearance. I need the letter to accurately reflect that. additionally, this document states that I failed to make monthly payments. This is not true. I was sold a house that is not livable, the plumbing is all busted. The heating went out within the first 6 months of living there. There are active water instructions in all of the walls. There is a deed restriction stating no one should use the house for residential purposes and there is mold entirely throughout the home. This document needs to be submitted to court for my case. It is imperative that it reflects accurate information. I also do not want to lose my security deposit or be homeless. Please have this fixed as soon as possible.

There has been multiple amount of issues with XXXX. We have been trying to solve a problem in which they said we were behind on a mortgage payment from 2.5 years ago. After trying to make numerous attempts to get this taken care of and one department the research department XXXX XXXX supervisor had a solution about a year ago or so and XXXX refused to let that go through and we had to start with a whole different department again. This decision was made after there were complaints filed with the XXXX XXXX XXXX against XXXX. This has gotten so bad that my husband and I have chosen to sell our home which was closed on XX/XX/XXXX to continue to avoid the late payments they were giving us and they were never helpful in getting to a solution to the problem they just kept bouncing us around different departments. XXXX should have numerous contacts in my filetrying to get this taken care of. XXXX also charged us a {$900.00} recovery fee at closing which was never disclosed to us after we had filed for bankruptcy in XXXX. The first time I learned about this XXXX was a couple of months before we decided to sell our house. That information was never disclosed to us at the time we file for bankruptcy. They claim that they sent documentation to us I asked for that documentation to be resent when I talk to them two weeks prior to closing and as of today I still have not received that information. No one can verify at XXXX that this was given to us prior to us or at the time we filed for bankruptcy. We still have money in our escrow account that is not being refunded to us even though I was told by supervisor XXXX in the customer service department on XX/XX/XXXX at approximately XXXXXXXX XXXX that the amount of our refund would be {$710.00} and the amount of the refund that was actually mailed to us was {$360.00}. This is exactly the problem that I have had with XXXX all along no one can give me the same answer and it just keeps getting tossed around to different supervisors and different departments with no resolution. As of today we still dont have a complete explanation on the {$900.00} charge which we feel shouldve never been charged to us since we have never been given a full explanation of why or paperwork in regards to that issue ever sent to us. And then the other issue is we are still waiting for the additional {$340.00} to be refunded to us out of our escrow account that is still remaining in our escrow account. It was confirmed to me by both and XXXX on the Customer Service line on XX/XX/XXXX at XXXX XXXX and when she transferred me to the supervisor XXXX that I would be getting a refund of {$710.00}. This is just a few of the problems that we have had with XXXX and Feel they need to be investigated for improper handling or monies. Not to mention theres issues with how taxes were paid out and still dont think that was paid out correctly either. I have asked three different times to have my escrow analysis and a payment summary sent to me and still have not received it 30 days after requesting it. I would be happy to attach any supporting documentation for XXXX should have it all in my file as I have been told by multiple supervisors they have all of my paperwork and all of my phone calls documented that I have documented and have sent into them in people I have tried to work with to solve this issue. If more documentation is needed I would be happy to put that together and email it to where I need to send it to it has already been sent multiple times to XXXX.

This letter is in reference to the issues that I have had working with CHFA. First of all I understand that I was in financial Bankruptcy. When working with my lawyer the intent was for me to be able to keep the house. After filing the bankruptcy I called CHFA and explained to them the situation and that I wanted to keep my house. I was told that all I needed to do was to continue to make my payments every month. I understood that because I made my payments when the bankruptcy was over, I would be in good faith and not in foreclosure for nonpayment. Also because of the bankruptcy CHFA would not send me monthly bills. Moving forward I knew I had to document everything. I created an invoice form that I included with my payment each month. At the time of bankruptcy ( XXXX XXXX ) my monthly payments were roughly {$1400.00}. In XXXX of XXXX CHFA increased my monthly payments to {$1500.00}. Although I received a document from CHFA I did not fully understand the increase and I was not receiving bills. To continue my good faith I upped my payments to {$1500.00}. In XXXX of XXXX I went ahead and upped my payments again to {$1600.00}. This time I did not receive anything from CHFA, I was just trying to continue my good faith. When the bankruptcy was finally settled in XXXX of XXXX I started to call CHFA. After repeated calls to CHFA getting nowhere and becoming extremely frustrated. Finally on XXXX XXXX, XXXX I went to the Colorado CHFA office and demanded to speak to a XXXX. I finally was able to receive a copy of all the transactions and payments to my account since filing the bankruptcy. In reviewing the documents I realized that CHFA had me behind 1 month in payments. From what I can conclude in the transactions in XXXX of XXXX my payment was short {$4.00}. So when I sent in my XXXX of XXXX payment CHFA placed the remainder of the {$1500.00} into a reserve account after applying {$4.00} to the XXXX payment. When I then paid the XXXX of XXXX the payment was applied to XXXX, and CHFA took another {$4.00} from the reserve for XXXX payment. This made my records look like I am a month behind. I also realized that in XXXX of XXXX my payments increased to {$1600.00}. Since I was paying {$1600.00}, CHFA continued to take the difference from the reserve. I contacted CHFA several time between XXXX and XXXX to find out how much was in the reserve account and what I could do to get my account to 100 %. In XXXX I sent in a full payment plus an additional {$350.00} to make everything current. The bankruptcy case is now closed. CHFA will not send me bills. The house is mine in the settlement. CHFA is claiming that they require an letter of affirmation from the judge. I was not able to get that letter. In Colorado the judge will not sign these for mortgages as they are not considered consumer debt. I have contacted CHFA since XXXX. When I receive a call back I am told that they are sending me out invoices and reports. Then nothing comes in the mail. I have tried to refinance the house in order to get some repairs done. CHFA will not respond to assist me. I understand that I am this situation because I filed bankruptcy, but I have paid over {$1500.00}. through the entire process. I am not the average person in the position. CHFA is receiving my money and not talking or working with me.

My home caught on fire in XX/XX/XXXX, I had to be relocated under temporary housing, I had applied for a 6 month forbearance on the home which I received, there were payments that were misapplied on the home to past due payments and not the forbearance, when I tried to point out the fact that I did pay them nothing was done and instead of being able to go into a modification at this point they closed my account in the Loss mitigation department. I then applied for a Modification of the loan at this time there was not a foreclosure date or process started. The loan modification was submitted in XX/XX/XXXX, I emailed all of the documents required to them even though my previous documents were still valid, One of the representative kept insisting that I had to send my divorce documents even though the house was purchased after the divorce, they were asking for bank accounts for my contractor since there was money moving back and forth from the LOSS DRAFT and then they were trying to obtain bank statements from another party that loaned me some money that banked at the same bank as myself, I finally got this resolved and my file was submitted for a loss mitigation review for a modification, after 30 days I contacted the loss mitigation representative and was told there was no answer back and the my file was pending review, I waited a few more weeks and was told the same thing. then two months later I get a notice that a foreclosure sale date was set on the house. I called and complained and told them that under the CFPB guidelines that they could not while in review of a loss mitigation place a foreclosure sale date, so they postponed it I was informed to XX/XX/XXXX, I called them and told them that I needed to find out the status of my review they said there was no response this went on until XX/XX/XXXX when they finally they said I was approved. this was 7 months later, escrow fees and payments were adding up causing more damage. By this time I found out that I could actually reinstate my mortgage so I called to get a reinstatement letter but no one would help me they kept telling me at CHFA that I had to call foreclosure so I would leave them messages and would not get a call back. I spoke to a number of agents in the collections department who refused to have someone internally help me and they just kept passing me to foreclosure who did not respond, Today I actually called the foreclosure attorney at XXXX XXXX and found out that the foreclosure sale date in fact is not for XX/XX/XXXX but XX/XX/XXXX. I have been trying to reinstate my loan for over a month now and can not get anyone to assist me. Today the attorney told me I needed to file an intent to cure with the Public Trustee, this is for a full payoff not a reinstatement. I am not paying the loan in full I just want to bring the payments current. The attorney I spoke with said that she would put the numbers together for the reinstatement but that would take a few days. I am at risk of losing my home because of the mishandling for the loss mitigation review time and because they are refusing to get me a reinstatement quote.

We closed our loan with CHFA ( XXXX ), in XX/XX/2020. We have had the runaround ever since on the escrow refund owed to us of {$3500.00}. I submitted a prior CFPB complaint as to the NUMEROUS conversations during every single month since XXXX. To include XXXX which they failed to mention in their last response. They company claims they have sent several checks but to a XXXX, CO address and we have repeatedly told them that our city is XXXX, Colorado. They know this as we have received our year end tax statement last month mailed to our correct address so why they are supposedly mailing these checks to XXXX, I don't know. We even received a {$54.00} check refund from the second account we had with them. Yet, the larger check has never arrived. After I filed the last complaint, I contacted Colorado Housing and Finance Authority ( CHFA ), who is serviced by XXXX and a Senior Finance Officer there has worked diligently to get our refund to us. She made arrangements with XXXX to have the funds direct deposited in to our bank account, in which they responded to the last CFPB complaint that they did that. That was a blatant lie. I believe they are giving her the runaround also. We have not received our escrow refund. Conversations with XXXX since that time continues to say they again mailed out another check to us. Frustrated, we again wanted to verify the mailing address they are sending it to, and again, they state they mailed it to a XXXX address instead of XXXX. We have continually asked to have the mailing address corrected but they say they can not update it because it is an archived account. Why is an account that has not fully been closed out of all transactions be archived. They still owe us money on that account. The CHFA officer that has worked with me, XXXX, also provided them with our correct address as well as our banking information. Again, we received our year end tax statement at the correct address, but not the money owed to us. Every time I have called, they ALWAYS " transfer '' me to a supervisor whose mailbox is full or I do leave a message and have NEVER been contacted by anyone from XXXX. We are approaching 120 days since our account was paid off and are about to take legal action, contact the State Attorney General, as well as contact the media if we do not have our funds by the 120 day mark. I am a XXXX veteran with XXXX XXXX and the amount of stress and anxiety this has caused me and my family is unreal. There are literally HUNDREDS of complaints here on the CFPB regarding this same exact scenario of people not able to get their money owed to them from XXXX. This is 100 % a legitimate issue that the CFPB needs to look in to because this company is NOT returning money owed to their customers. This is clearly a class action issue. I don't think a simple response from the company on this, then closing the case is sufficient. There is something illegal going on with that company for consumers to not ever be able to get their money back. I HIGHLY encourage others to take their business elsewhere as this has been a complete nightmare.

To whom it may concern : I have lived in the XXXX area my entire XXXX years of life. I bought my home in XXXX after I rented it for XXXX years. I have seen so many good times here, and recently I 've seen a few bad times due to the economy and a short-term job loss. Unfortunately, I may be forced out of my home by my mortgage note holder ... CHFA HAS SET UP A SALE DATE FOR XXXX XXXX, XXXX!!! I am an XXXX. I 've been doing this for XXXX years at least, and I 'm good at what I do. However, I work on commission. Unfortunately, there was very little work due to the slowed economy in late XXXX into most of XXXX. My income suffered, and all of a sudden I found myself behind on my mortgage. I finally was able to switch jobs late in XXXX and now have more than recovered financially. I just need a little assistance in getting this problem solved since XXXX has completely dropped the ball. When I fell behind on my mortgage in XXXX, I contacted CHFA to try and get a loan modification to fix this issue. I asked them to send me an application packet, but it took XXXX or XXXX different requests before XXXX actually was sent!! I then jumped on it and did my part by getting them all the documents they needed to review me for a solution. I was hoping for an answer, but instead I was told they did n't receive it. It took me sending the complete package XXXX different times before XXXX finally acknowledged that they received it, which was just a couple of months ago. They even denied receiving a previous submission I sent by certified mail!! By the time they finally got my application, a sale date had been issued. I thought XXXX would be decent and postpone the sale while they reviewed by application ... but they did n't!! I still have n't heard a word about my application, and the sale of my home is going to proceed -- -- -- -is n't that illegal?? It 's funny how when I fell behind, I could n't keep XXXX off my phone line since all they did was make collection calls to me throughout the day asking me what I was going to do about this. But when I was trying to solve the problem, I could n't even get a single point of contact, just a general phone number to department where everyone I talked to had a different answer than the last person I talked to. Plus, they made it almost impossible to apply for assistance, and now that I finally have, I do n't hear a peep from them? I feel like I 'm being denied access to programs that should be made available to me. I had a legitimate hardship and I 've recovered and want to make good on my mortgage. Is n't that what these programs are designed for? I 'm not asking for a handout or for something I do n't deserve. All I 'm asking for is to be treated fairly and be given an opportunity to solve this issue and move forward. I simply want a review of my mortgage for all available retention options so that I can keep my home. I called CHFA early in XXXX to see what our options were about being able to pay our mortgage due to the economy closing down because of COVID-19. I was told by an agent that there was absolutely no deferment in place are the only thing that we could do was due for the payments for three months or forever long that we needed to was a forbearance. That the payments would just add up but that would we would have a huge balloon payment at that time. Then I was told that at the end of the deferment that was determined that we couldnt make the huge balloon payment of {$7400.00} ( Which worries me because if I dont have {$2400.00} to pay my mortgage why in gods name would they think I would have {$7400.00} 3months from now? ) And then and only then we would talk to a loss mitigator and we would see and the agent stressed the word see and I wasnt confident when the agent said that. That maybe we could put the payment at the end of our loan or we could possibly modify the loan but she wouldnt go into any detail at all about what that meant. The way that the agent talked I could tell that Chfa Has zero interest in helping their customers. I am completely out of a job now. And I am worried that I could possibly default and lose my house. The agent said that Chfa would start the deferment but it would be put on hold until we were mailed the paperwork and we had a chance to look it over and sign it and then mail it back and then the deferment would start two days later I received an email letting me know that the deferment had already started and that they were mailing us our paperwork. I have more than 1 time tried to get a modification of my mortgage with my servicing company CHFA. in XX/XX/XXXX my house caught fire. it did major damage. I fell behind on my payments, I called for a modification. Sent in the documents and it took 6 months for them to review ( I have emails ), I finally got a forbearance of 6 months in which they were to then modify my loan, they did not because I reinstated instead. In XX/XX/XXXX I started to fall behind again due to reduction of income. I tried to modify again and again this took 6 months for them to review, again. I filed a complaint with the CFBP and CHFA stated they were within time line ( I have emails to prove they were not and when they received the last documents ). by the time they provided the Modification in XX/XX/XXXX, I was going to take the modification, but then I found out that I was getting a settlement for a lawsuit I had and decided to reinstate the loan, this was reinstated in full on XX/XX/XXXX. I have been struggling due to the LOSS draft on the file, CHFA actually does not communicate with their other internal departments and so they sent a property preservation company to my house who in returned caused damage and stole items off my property. I signed a waiver after a small settlement for this claim only. They have since entered my house 2 other times still causing damage to the house, this time they are refusing to cover the stolen items and damage. I also called the police who in fact verified that CHFA had this company enter my home ( I have emails that state the house is not vacant, I have verbally told them this on the phone as well and the calls are recorded. I recently have had to file BK because of this. I have attempted to try again for a modification and found out today they denied me for these reasons : 1 ) NOT HAVING SUFFICIENT RESOURCES TO REINSTATE THE MORTGAGE, 2 ) HAVING HAD A MODIFICATION AND A BROKEN PROMIS PLAN, 3 ) BEING MORE THAN 12 MONTHS DELIQUENT. These are not valid denial reasons. I work for a loan servicing company. I work with FHA I know that they did not send the file to FHA because I called them today. The broken promise plan is because I REINSTED THE LOAN, I have the receipt to prove this. I believe CHFA only wants to take my home and nothing else. I am almost done with the remodeling of the home. I have had to extend my own personal money to pay for these repairs because the insurance company refused. CHFA 's reasons to deny my modification are unwarranted. I want to see what they sent to FHA to review, because I do know that my loan qualifies for the a Flex MOD. the prior modification they speak of do not qualify as I reinstated my loan a year ago.

My loan is with Colorado Housing and Financial Authority. I was approved for a loan modification XX/XX/XXXX and although I had late payment my loan was brought current XX/XX/XXXX. I made my XX/XX/XXXX on time. I filed Chapter XXXX bankruptcy XX/XX/XXXX and although it is my understanding my attorney did not file a reaffirmation, the modification was completed after the discharge of the bankruptcy. I have continued to make payment on my XXXX mortgage, however, despite repeated attempts to get an accounting of my payments I am told due to my bankruptcy they can not send any documentation. I received a Notice of Breach on XX/XX/XXXX even though the post mark was 10 days later. I paid the amount of the breach before the deadline and also made my XX/XX/XXXX payment before the delinquent date, as well as applying " unapplied balance to my escrow account. My escrow account : I changed my homeowner 's insurance XX/XX/XXXX to save approximately {$700.00} per year. I requested my insurance agent send the invoice to CHAFA to pay. CHAFA paid ( overpaid ) the old insurance company for which it took me almost 7 weeks to locate ( I had been with them since I purchased my home in XXXX. I advised CHAFA of the change and was told I would be responsible to pay the new insurer ( Farmer 's ) and have to obtain a refund from the old insurance company. I received a notice from XXXX which was not the agreed upon cost of the policy and XXXX adjusted my account and I paid the premium to XXXX. In the meantime, CHAFA paid XXXX, again, for the inflated premium and NOT the correct amount. CHAFA refused to provide me any documentation as to the status of my loan and today I received a letter that they are continuing with acceleration and foreclosure despite my loan is current, as is my XXXX loan. The letter dated XX/XX/XXXX ( the day I made my XX/XX/XXXX payment ) is postmarked XX/XX/XXXX which is the usual mailing delay with any communication I receive. When contacting CHAFA I am transferred all around from customer service, to collections, to the bankruptcy department and all say the other is responsible for lifting the block for online access or correspondence. In fact, when I call and am given instructions regarding payment, when I actually call back to complete the directions ... they have changed ... In fact, my payment amount has increased 4 times in the past 4 months and I have yet to receive any documentation explaining WHY ... WHEN ... HOW LONG?? So I am making payments NOT the {$1700.00} in the loan modification from XX/XX/XXXX BUT {$2000.00}??!!

We paid our mortgage loan off with Colorado Housing and Finance Authority ( XXXX ) in XXXX of XXXX. XXXX is serviced by XXXX XXXX XXXX. I initially opened this mortgage loan in XXXX. We were informed that the remaining amount of {$3500.00} in our escrow account would be refunded to us immediately. The Escrow refund check was supposedly sent out on XX/XX/XXXX. We were told that we had to wait 30 days to request a stop payment on that check in order for a new one to be reissued. On XX/XX/XXXX, we contacted XXXX to have the stop payment put on the check and request a new check issued as they stated they would do after the 30 days. Then we were informed that the check could not be reissued for ANOTHER 30 days, bringing us to XX/XX/XXXX. We called on XX/XX/XXXX to again request the reissuing of the escrow refund check. They said they will submit a request to have the check reissued. Called on XX/XX/XXXX to verify that check had been reissued and the representative said it had not been issued out yet. On XX/XX/XXXX, I again called and could not get an answer from anyone on the status of the check. Over these NUMEROUS phone calls between XXXX and I, I have also requested to speak to a Supervisor in which I was always transferred to a voicemail. I have NEVER received a return call from anyone at XXXX. There is also a consistent issue of a rep putting me on hold to look in to things, only to transfer me to another rep to start the whole thing over again because they simply did not want to deal with the problem. Furthermore, my wife, who is authorized to speak on my behalf has always been able to discuss the account. The account is now archived, even though our escrow has yet to be refunded to us, and suddenly she can no longer speak to anyone about the account. I am unsure how businesses can close and archive an account when there is a refund still owed to the customer. We have got the complete runaround for more than 3 months now on our escrow refund check and nobody at XXXX/XXXX has taken the effort to actually send us a refund check or actually address the issues by getting to the bottom of what is actually going on. This is the absolute worst experience I have EVER had with a mortgage company. Refinancing with another company, for half the interest rate and excellent customer service, was the best thing we ever did. After reading numerous other complaints about the same exact issues, I would suggest that the appropriate agency needs to investigate how this companies manages money and their accounts.

On XX/XX/2020, I submitted our mortgage payment on XXXX ( Colorado Housing Finance Authority/ XXXXI or XXXX the payment processor 's website. I was assured we would not be considered 30 days late as long as we submitted it by XX/XX/XXXX, and that the payment was received and applied on XX/XX/2020. In the following 5 days I called CHFA/XXXX to see why the money had not left our acct, and was told it was not a problem, it sometimes took up to 10 days to process, but not to worry, the payment was counted from the date of submission. Finally on XX/XX/XXXX, I got a notification from credit Karma that my score had dropped almost 90 pts. Upon checking I found out that CHFA/ XXXX had reported a thirty day late payment days earlier. When I called and asked them why they had done that and not told me, they said it was done because they could not get a response to get the money from our bank. When we proved we had the money, upon checking through their customer service I was asked what the routing and acct number was. The agent said their web services had given one incorrect routing number. Upon checking with XXXX XXXX, they told us it was never presented for payment, and they had not received any call to find out how to resolve or receive the payment from them. We were told at various times over the next 5 months by CHFA XXXX customer service agents that this late payment should be considered a Bank / mortgage, clerical error, and should be removed from the credit bureaus. We submitted our proof of payments to them, the receipts of payment and application of payment, and made up the payment immediately as well as the next payment due in XXXX. But though we followed all their complaint and removal procedures, they refused to remove the 30 day late, and insisted on doing this when they have no proof that we commited any error and we in turn have proof of the payments all being on time in our mortgage statement and correspondence from them, including statements saying they had received and applied the payment successfully. They are feeling thousands of dollars over the course if the mortgage by trapping us in their high interest mortgage and keeping us from refinancing. We have found out other clients of theirs have also been denied credit when they discovered the same type of 30 day late payment processing errors on their credit reports. They are not following the FCRA reporting law.

I have a FHA loan through CHFA and because of Covid we went into forbearance for 6 months and then we were told we could file for a loan modification loan and through out this process we spoke to so many representatives that provided false information that prolonged the process for a loan modification and then were given a contact person XXXX XXXX XXXX who told me that I did not fill have to fill out the application because I already had an HFA loan and that he would submit the information for my loan modification and this was a lie, instead he submitted for a partial claim that increase our mortgage payment. I contacted him and told him this was not what I wanted so then he sent me the loan modification application packet and I filled it out and submitted it to the Loss Mitigation office and XXXX XXXX sent me an email confirming all was good and that he would be submitting it on XX/XX/2021 and we should have had the loan modification on XX/XX/2021, however when I contacted this office they told me that he had just sent the documents on XX/XX/2021 and as of today XX/XX/2021 we told that Mr. XXXX sent or received it on XX/XX/2021 so this will prolong it for another month we CAN NOT hold on any longer. This person is well aware that we need this taken care of ASAP and he has done everything in his power to delay the process. We are surviving on only my income that does not cover our mortgage and he still refuses to complete my loan modification and he will not return my calls or emails. He has delayed us for 6 months and we have called and asked over and over again to speak to his superior and no one will call us. We having been asking for a loan modification a 1 complete year and have not heard from on supervisor. I have sent complaints through their website and still no one will contact us. I have filed complaints over and over with CHFA and no one will return my call, their representatives continue to transfer me and hang up on me because I ask to speak with a supervisor or manager. Hello, I bought a house in XX/XX/XXXX and borrowed {$390000.00} from Colorado Housing and Finance Authority with the first time Colorado program. I had been making payments on time until I was offered the COVID relief program in XXXX XXXX. I was able to miss 5 payments and was told that those monies would be placed on the back end of the loan. I began making payments in XX/XX/XXXX and have been making them since. I am now in the process of refinancing my loan with a new lender, in order to lower my payment, and remove the PMI from the loan. I received the payoff statement from CHFA two weeks ago, however, and the Total Amount to Pay Loan in Full is over {$420000.00} -- {$28000.00} more than what I originally borrowed. I believe I know what is happening, the computer is ticking every day since the day I missed a payment for COVID relief, but no one has told the computer to stop ticking once I started making payments again last fall. The computer thinks I haven't made a payment since XXXX or XXXX of XXXX and my payoff statement reflects that, despite the fact I did make payments. I have spoken to multiple agents at the lender in all the departments, so far I think I've spoken to 30 representatives between Customer Service, Payoffs, Collections, and Loan Mitigation, and many of them supervisors. So far only two customer service agents have been able to understand my dilemma, none of the supervisors are willing to help beyond transferring me back and forth to Loss Mitigation from Customer Service where I have to start over from scratch.My feeling is either a ) no one has the time or inclination to help or, b ) no one has the skills to help. They are almost all very nice people but what would take me a few hours to do when I worked at a mortgage company, they are going on over two weeks. The folks at Loss Mitigation say I owe them {$12000.00} as of XX/XX/XXXX, which sounds like the amount of payments I missed for the five months in XXXX. To me at this point, they are hoping I go away-desperate to get the new loan so they can not have to bother with the math. I desperately want to pay these folks what I owe them, mostly so I can get back to work, but I don't want to spend my child 's college fund on their mistake.

My loan was sold to CHFA, and they stopped paying my hazard insurance from escrow, I got my own policy and sent them the declaration page following the directions on the website - 4 times! I finally got someone to listen to me and was told I should apply for a loan modification, I can't afford the XXXX XXXX monthly escrow increase for the lender placed insurance plus the policy I'm carrying on my own, but no one cares to look into it for me. I filled out the loss mitigation application, and after a month of no response I sent an email to them, I finally received an apology and a list of paperwork I needed to submit, most of it I had already submitted. finally after another month of sending paperwork over and over, I received a notice that my loss mitigation application had been accepted, along with a certified letter stating my loan was in default, That's when I found out my XXXX XXXX had dropped XXXX points, and I started receiving daily collection calls.. after more than a month I received notice that I was given a forbearance, and had seven days left before my payments were to resume. I have 2 credit cards that have reduced my credit limit to my current balance, which increased my debt to credit ratio reducing my credit score even more. I still cant afford the payments, but I was going to pay everything but the increase in the escrow, turns out they wont take a partial payment, so it appears I have to continue defaulting on my loan. I can't refinance because they destroyed my credit, ( it's called dual tracking, which is illegal ), also according to the forbearance letter - I need to make arrangements to pay back my forbearance, so I'm in worse trouble than before. I'm XXXX, and I care for my XXXX XXXX were both on fixed incomes and have only lived in this house for 2 years, and my mortgage has already gone up more than the two of us can afford. I'm hoping to find an attorney to protect my interests, I've used my mortgage money from the last couple months to buy a new heater for the home. so my heating bills don't eat me alive this winter. All I need is to get my mortgage back down the point I can afford to pay it, and CHFA just keeps ignoring me.

I entered into Forbearance program with CHFA for three months ( XXXX, XXXX and XXXX ) last year and after three months, I started my payment on XX/XX/XXXX and CHFA entered into my account on XX/XX/XXXX my first payment after Forbearance, CHFA send me document to be notary from my Bank for my Forbearance to reinstate my account in which I sent all the document to them and called them for confirmation that they received the document, I still have my duplicates. I noticed CHFA was holding on to my payment for months and when I called them that my payments are not applied to my account, they told me until the program is over which force my account to one year of the program. I only run the program for three months last year but they applied all payment from last year XXXX in this year XX/XX/XXXX only applied three payments last year. Now CHFA reported to credit bureau that I own them 5 months mortgage payment in amount of {$14000.00} ( that's XXXX per month ), which according to their system all payments from XX/XX/XXXX to XX/XX/XXXX applied to Forbearance my account indicating that I still own Mortgage for 5 months. They charge my account with {$310.00} late payment which stop any lender to refinance with because debt and also late payment. I called them 2-3 times every month since XXXX till today and all that they ( XXXX XXXX XXXX XXXX told me is their supervisor or underwriter have to address my case. I have spoke to a lot of staff or Rep. ( XXXX, XXXX, XXXX etc ) on the phone and what they told me is their supervisor will call me or fix it. I always received calls from this number XXXX collecting debt every other days and multiple threaten letters to send my house to foreclosure, when I called them am told they will it in 2-5 weeks. Am told one staff called XXXX is responsibly or handle my account but she stop working on it since last two months XXXX without any reason and I believe because they notices am doing refinance with XXXX XXXX XXXX, knowing that I can't refinance if am still under Forbearance, Late payment on my account and also send to Debt collections.

My second mortgage account ( a downpayment assistanceloan ) was incorrectly reported in forbearance as of XX/XX/XXXX. I have never requested a forbearancenor would I ever need one on this account as it is a no-interest, no monthly payments due, and does not need to be paid until a refinance, sale, payoff, or XXXX. This was discoveredby another bank during a prospectiverefinance at the end of XX/XX/XXXX. I have requested this be corrected multiple times over the past month ( or more ) via phone of the bank 's ( XXXX Mortgage ) customer service line but have yet to be successful. I've also been reassured multiple times by customer service agents that this was under investigation ( which would take up to 20 business days, initiated on XX/XX/XXXX ) and, as of XX/XX/XXXX, that investigation was completed. The representative I spoke to on XX/XX/XXXX, told me that it was only investigated for XXXX and not all of the credit bureaus, even though I requested, multiple times, it to be investigated and corrected for all bureaus. The representative that I spoke to on XX/XX/XXXX, said that there would need to be anotherinvestigation with another 20 business day lead time. I also attempted to get a letter from the bank stating this account was never in forbearance and that it was in good standing so that the bank I was attempting to refinance with could continue the refinance while the credit report was updated. This letter was requested on XX/XX/XXXX. I received the letter on XX/XX/XXXX, but it was incredibly vague and was full of grammar/spelling errors. The substance of the letter is as follows : " We can confirm that for you loan ending in XXXX there was in forbearance on that account. That account is currently considered current and in good standing. '' This was not able to be accepted by the refinancing bank. Upon contacting the bank 's customer service I was then told that I would need to wait until the completion of the investigation mentioned above ( expected XX/XX/XXXX ) before they could issue a letter stating that the account was never in forbearance.

The abbreviati on Chfa is referencing Colorado Housing and Finance Authority. I originally called CHFA o n the XXXX of XXXX to try for th e 4th time to get loan modified. This time was first time I was ever delinquent on the loan though as in making a payment on certain date. In my payment schedule I am ahead of where I should be until XXXX of XXXX . My complaints against Chfa a re : 1. Chfa has violated the requirements for a Single Point Of Contact in Section 38-38103.1 2. Chfa has only notified me they received my loss mitigation packets once ; when they said I was missing papers, after their phone call I did provide the missing pages for the first packet and sent them via email that same day. I sent the second packet ; with up dated information on XXXX XXXX , because I received a phone call from Chfa on XXXX XXXX , telling me if I want to keep my house I had to do this again. 3. Chfa h ave never given me any type of decision on the packets I have sent in ; not even the first packet I sent in which was on XXXX XXXX , in two emails, or even after I sent the missing papers they claimed. 4. When I initially called Chfa on XXXX XXXX the representative told me to pay what I could as soon as I could. I sent XXXX cashiers checks, XXXX on XXXX XXXX for {$700.00} and XXXX on XXXX XXXX for {$800.00} and they returned the second check stating that I had not sent them the mitigation packet, with an entirely new set of documents so they would be proceeding with foreclosure. *Previous to this year I have tried to modify my mortgage at least 3 times since XXXX . Chfa 's representitives have stated that my loan is unconventional, I could apply for a modification but they did not have to allow it. On my loan paperwork, it states my loan is a Conventional Loan, and insured by XXXX XXXX .

I discovered that Colorado Housing Finance Authority ( CHFA ) sent out a check for {$310.00} in XXXX of XXXX. I never received a check, and discovered that it was sent out in XXXX of XXXX. I contacted CHFA and the rep said that they would research it and if it wasn't cashed would issue another check. The representative said that it would take between 1-2 weeks. After the 2 weeks past, and I did not hear anything else I called back in on XX/XX/XXXX. The representative said that they couldn't find the request but would resubmit it with 1-2 weeks again being said it would be done. After 2 weeks I called again. The representative said that they would send an email to their cashiering department and they would give me a status. In the beginning of XXXX I received an email from CHFA saying that the request for the check was submitted on XX/XX/XXXX with an estimated receipt of 30-60 days, which would of been XX/XX/XXXX. After the 60 days I called back and was told by various representatives and supervisors that it would be 30-60 days, 30-90 days, and my options are to wait the 30-60 days or start the process all over. Finally a supervisor said that she would get it it and I should receive it by XX/XX/XXXX and would receive an email with a tracking number as it was being sent by 2 day XXXX. XX/XX/XXXX passed and again nothing so I called back and was talked to a supervisor who said she was going to talk to them and I should have an answer by the end of the day. On XX/XX/XXXX, I contacted them again since there still wasn't any answer and was again told various other dates for when it will be sent out or would have someone contact me, which has only happened once back in XXXX. On XX/XX/2023 I informed CHFA that I had made multiple calls and left a message with XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CO XXXX with no responses and no returned calls. On XX/XX/2023 ( XXXX ) I contacted the loss mitigation department in an effort to get an updated mortgage statement, which was necessary for my application for mortgage assistance. On XX/XX/2023 I was notified that they ( CHFA ) was unable to give me any information on my account or answer any questions I was informed that my lawyer would need to contact their lawyer for any and everything I may need. I asked why and I was told that they were unable to tell me anything I repeatedly informed them that I did not have a lawyer nor had I ever had a lawyer. She looked into my account further and then repeated that something I or my husband had done caused the note on my account that they were unable to give me any information pertaining to my account including my most recent and/or updated mortgage statement. A check for XXXX and XXXX Mortgage payments was sent from XXXX to Colorado Housing and Financing XXXX in plenty of time to be credited to my account and to avoid any late fees, I have verified that it was sent, to and tried to contact XXXX to tell them it was paid, person who finally answered the phone explained the benefits of automatic withdrawal so my payments won't be late anymore, after trying again to explain that it was paid already and that taking the money from my account is not going to solve my problem I got frustrated and hung up. I need to start charging XXXX for my time trying to straighten out their constant issues with my mortgage and treating me without any kind of respect, all the fees you have charged me should really be refunded to my account as I still say that nothing that has gone on with my mortgage as been my fault, going back as far as XXXX forgetting to pay my insurance from my escrow and then charging me for a foreclosure for over 2 years while you tried to say it was my fault, and your other illegal activites, including double accounting, and your constant lies- which I have in writing since I usually cant talk to anyone about my issues maybe you could assign a person to my account, who's willing to answer their phone, and would be aware of what has gone on with my account, and would talk to me when I have issues, and I could work with them to avoid pulling my hair out every month. A mortgage loan is not supposed to be this difficult.

My home was damaged by water in XX/XX/XXXX, mitigation services were completed, as was the repair work. I was issued a final insurance check inXX/XX/XXXX, which had to be sent into CHFA. I called CHFA to confirm all of the steps that needed to be taken and I sent in the check. They then called to tell me the check is being sent back because the proper documentation was not provided ( which was never discussed in the phone call ). I returned their call to confirm, twice, which documents they needed. I supplied them with the documentation that was requested. I then called to confirm, again, that they had received the documents and that everything was set in order for them to release the money. I was assured that they had received everything they needed and that they would issue me two separate checks, one for the mitigation company and one for me. They then sent me a partial check ( XX/XX/XXXX ), one third of the insurance check to be exact. When I called to inquire about it, they told me not all of the proper documentation and been received and that they will only pay out in increments and not issue the full amount. On top of more documentation, they also are now requesting an inspection that the work has been completed, which was never once discussed when we communicated about the issuance of the check previously. My home has also been refinanced with a different company, and CHFA is holding money from me for a home that they don't even own anymore.

XXXX hit XX/XX/XXXX, I applied for forbearance on my mortgage and it got approved for a year. I became unemployed due to the pandemic. A year went by and I applied for an extension of 3 months which was approved. After my first extension, XXXX, the lender lost communication with me, didnt tell me that I have to fill out another loss mitigation packet to receive additional time. Im still unemployed at this time with no hope in sight for income. Finally get another job XX/XX/XXXX and making regular payments again XXXX XXXX XXXX. Come XXXX I was informed that my mortgage had been transferred to the foreclosure department of XXXX. I had found out also by calling in to make a monthly payment too, its not like XXXX had reached out to inform me of all this. I asked how come and they said that the deferred payments of the forebearance agreements werent paid on time. I said that if your communication was better between us this wouldnt have happened because I didnt know the arrangement was to pay in full the deferred payments and by the way the property is for sale and set to close XX/XX/XXXX. A foreclosure attorney was hired by XXXX XX/XX/XXXX and now is showing on my credit report as foreclosured upon even though, I paid off all loans and attorney fees. I DONT feel as if I deserve the derogatory remark on my credit report simply because I lost my job and livelihood from the Covid pandemic and did everything I could to get my life back to normal

I have had a first and second mortgage with Colorado Housing and Finance ( " CHAFA '' ) XX/XX/XXXX. In XX/XX/XXXX I filed a Chapter XXXX bankruptcy. My mortgage was not discharged and subsequently the delinquency was included in a promissory note in XX/XX/XXXX. I have made ALL my payments for my 1st and 2nd mortgages. However, CHAFA has not provided a 1098 for my first mortgage for XXXX, nor do they provide a monthly statement of my first mortgage, nor to they report my payment history to the credit bureau of my first and second, despite in XXXX my 2nd was being reported, not the first and now neither is reporting. Clearly, my pay history with my mortgage would raise my credit score significantly for a refinance and despite maintaining a XXXX credit score I am unable to get a more favorable rate. CHAFA has gone back and forth as far as allowing me online access. I called on XX/XX/XXXX and left a message with the legal department. No response. I called customer service today and was advised they are unable to provide me online access and can only mail the requested documents ( despite the 1098 was due XX/XX/XXXX and the monthly statements have not been provided at ALL ) thus I am unable to complete my taxes and it puts a further delay my ability to refinance.. In fact, last year when I attempted to refi my home CHAFA refused any cooperation with me or the mortgage associate I was working with.

Colorado Housing and Finance is withdrawing money from my escrow account based on false claims of my lack of insurance. It began on XX/XX/XXXX, when I received a notice by mail that hazard insurance was purchased for {$2200.00} on my behalf due to a lapse in coverage. I immediately remedied the issue by purchasing a new policy and submitting those documents directly to XXXX on XX/XX/XXXX. They, in turn, claimed that they had no evidence of my insurance coverage from XX/XX/XXXX, when I purchased my home, through XX/XX/XXXX when the policy ended. So I then submitted that to them as well. I was assured by phone that they received the documents and were in fact viewing them, and that I should expect a new escrow analysis to include refund for any unused hazard insurance. However this never occurred, and I have been playing tag with XXXX ever since XX/XX/XXXX. Now it appears that they are very angry with me for filing a formal complaint with you. I can tell because on the same date they responded to this initial complaint, they sent me a letter on XX/XX/XXXX demanding proof of insurance or they will immediately purchase hazard insurance and charge me for it. I am attaching this latest communication from XXXX, as well as proof of coverage here in hopes of clearing this up once and for all.

On XX/XX/XXXX, I received a notice stating that my escrow account was charged {$2200.00} for hazard insurance. I did not authorize this and was unaware of any lapse in my homeowners insurance. I immediately phoned both my mortgage company, and then my insurance company to reinstate my insurance coverage. I was assured that I would be reimbursed any funds outside of the lapse from XX/XX/XXXX through XX/XX/XXXX. Since then, I have been back-and-forth through a secure messaging portal, email, usps and phone countless times resubmitting all proof of insurance. My mortgage company is simply exhausting me to no end, and taking no action. I finally received word on XX/XX/XXXX, that they have reimbursed the full amount to my escrow account on XX/XX/XXXX. However I see no evidence of this in my recent activity. Their recent escrow assessment has not reduced my mortgage payments. You see, this force placed insurance has caused a deficit in my escrow account. This has caused my mortgage to be increased by {$250.00} since XX/XX/XXXX to cover the deficit. So essentially, I am paying for this high cost hazard insurance twice. When in fact I have my own insurance which I purchased on XX/XX/XXXX as I originally stated. Please help me resolve this matter. Bait & Switch. XX/XX/2019 due to the onset of the pandemic. I received mailing from XXXX For hardship due to covid-19. An option was to refinance through XXXX or another bank. I chose XXXX since. I'm already a customer. For two years I asked for a manager or supervisorexplain the terms. To help me get refinancing. I was told to keep paying my mortgage payments. XX/XX/2020 Colorado housing and finance ( servicer ) failed to pay hazard insurance which is in my contract. Escrow was set up and had funds for renewal but they repeatedly sent me threatening letters claiming I had to personally pay. I had insurance company fax XXXX XX/XX/2020 to number chfa provided. XX/XX/XXXX I submitted on loansolutioncenter website a request for assistance, and called chfa and they confirmed that it was to be paid. XX/XX/2020 chfa bought lender insurance 3x the price and nother coverage for my family. Communication received was utter nonsense and blaming me or anyone but themselves. They violated several RESPA and TILA statues. Still have no resolution and they have not returned my escrow and have not followed my closing agreement and continue to deny responsibility. According to RESPA and TILA they are to be fined and compensation is due. I can prove letter sent as resolution was filled with false information and their timeliness is beyond legal limit. Please help. I saved all documents. I was also charged 2 late fees, during the period of forbearance coverage time. No updated information on any websites or emails.

I was late for my mortgage in XX/XX/XXXX, which I paid in XX/XX/XXXX. I reach out to CHFA and got a forbearance approved in XXXX, for XXXX, and XXXX of XXXX and XX/XX/XXXX. During this time my loan was still reporting late to the credit bureau, I started paying on my loan after the forbearance ended, I was also offered a partial claim back in XXXX of XXXX which took 3 months to be approved, this was then approve in XX/XX/XXXX and never got paid out until XXXX of XXXX, I was told to keep paying until it was paid out I have been paying on time since the forbearance, and was on time ever since, however as you can see in the attachment I have been reported late ever since the forbearance. I kindly ask that they remove the late payment report since XXXX XXXX to XX/XX/XXXX. Likewise, XXXX and XXXX of XXXX were also a forbearance period which I was also reported late for, please remove those as well. I am current on my mortgage and have only been late twice due to losing my job during XXXX. The Mortgage company made a note on my credit report that the late was due to natural disaster but refuse to remove the late reports. Thank you

On XX/XX/XXXX I received notice that my loss mitigation application had been received and found complete. On XX/XX/XXXX I received notice that my application was forwarded to a specialist on XX/XX/XXXX and to please allow 30 days for XXXX to process my application. Meanwhile XXXX continued to pursue foreclosure against me, and has rescheduled it 3 times now, current sale date is XX/XX/XXXX. On XX/XX/XXXX I Sent a RESPA notice of error and request for information, certified mail, to the proper address asking for the status of my Loss Mitigation Application since I have not received any results of the loss mitigation application I had submitted and that had been accepted as complete. On XX/XX/XXXX I received a notice from XXXX that they are " reviewing my account and will make every effort to respond to my inquiry as promptly as possible, and will certainly do so within the time limit required by law. XX/XX/XXXX Still waiting for a reply, I could cure this foreclosure through XXXX, but since I have a pending loss mitigation application they can not process my application.

I went into forbearance back in XX/XX/XXXX and it ended in XX/XX/XXXX and was advised to make some kind of payment while I was In the process of modification of my mortgage, but if I couldn't not worry about it. Signed the paperwork for the modification in XXXX of XXXX, sent it in and was waiting on notification of the approval. Called XXXX in XXXX of XXXX for an update on if the modification was approved and was told it was still being processed that I would receive notification in the mail shortly. Called again over the next several weeks and months all the way thru XXXX. Finally got the notification of approval at the end of XXXX. By this time the mortgage was now behind for 4 months and they were demanding payment. I've tried several times to explain to chfa what was going on and most of the time they either don't answer the phone or dont call back when I leave a call back number. When I am able to get someone on the phone it is as if I am XXXX and don't know what I am talking about and that I should have been making payments regardless if I had an approval or not.

Because of Covid 19 natural disaster, I had to go into a forbearance agreement with Colorado Housing Financial Authority ( CHFA ) in XX/XX/XXXX until XX/XX/XXXX. During this time, I talked to representatives several times about my mortgage and the forbearance agreement, and in those conversations, I brought up the fact that CHFA had reported to all 3 credit bureaus that my account was late XXXX, XXXX and XXXX in XXXX. The representative would say that they had noted this in my account and they would look into it. I have continued to look at my credit reports and the XXXX, XXXX and XXXX months continue to show as late payments. I started making monthly mortgage payments beginning XX/XX/XXXX and also signed a modification agreement with CHFA in XX/XX/XXXX. The XXXX, XXXX and XXXX in XXXX continue to show as late payments. Under the CARES Act, there should be no negative impact to a borrowers credit score for payments missed during an approved forbearance period. This has affected my credit scores.

Colorado Housing and Finance Authority ( CHFA ) is not allowing us to make a payment directly to our escrow account. They demand a payment of my mortgage payment before I can pay online. They said they would take a check, or payment online. I ended up making the payment on the phone, they did waive the fee after complaining. I was not provided a receipt and only a confirmation number. I asked for an email receipt in which they refused and said its not in their policy. I am requesting an investigation into this companies ' practices for billing and management of my escrow account. This company also refused to let me manager my taxes and insurance. They refuse to remove my escrow. CHFA is not in the fair practice of business in my opinion they lack credibility and seem to be all about profit not the consumer. If you look at their reviews online this story matches others complaints too. They have a XXXX start on XXXX XXXX XXXX on XXXX and are one of the worst companies I have gone with.

My assistance application with Loss Mitigation with XXXX was completed on XX/XX/2023. I was first told by Loss Mit that the process would take 30 days for an answer, then that changed to 45 days, then 45 business days but until now NOTHING. I have called every week since I submitted the application to get status and keep being told it's still " in review ''. Some agents have stated that the application was incomplete as of XX/XX/2023 while others stated that those agents were wrong and were not sure where they got that information. It's a never ending story with this servicing company! I don't understand why it's been this difficult to get information on an application that should have already been fully processed. Then I'm told that the underwriter or " specialist '' hasn't reviewed the application to make a decision. I have done everything in my power, my due diligence, to try to get this resolved but this company has failed and continues to FAIL.

I have recently talked with a mortgage XXXX and he advised me that in XXXX we should have been informed about relief due to XXXX. I informed him we have had a hard time catching up and that we were never given assistance or offered a XXXX forbearance and due to no assistance we have been in financial distress ever since. As of XXXX of 2020, the Colorado Housing Finance Authority is no longer offering refinancing, no FHA streamline financing or otherwise. Beause they do not offer refinancing, they are no longer willing to allow subordination on second liens they hold. Their downpayment assistance programs give borrowers the option of taking a grant or taking a silent second lien when receiving the downpayment funds. If you take the silent second option, they refuse to subordinate if you attempt to refinance the first mortgage, demanding payoff. However, when they were offering refinance options, they had no issues refinancing. This has left many stuck in higher rate mortgages when they could easily refinance now to take advantage of lower rates. Their pushback is that these terms are in the Note, but there is not additional paperwork that says that they only subordinate if they hold the first lien.

My house burned down, I 'm trying to get it rebuilt. I have submitted all the documents that CHFA requested and was told that it would be XXXX5 days for it to go through review. It has now been 1 month and they still have n't gotten through review. They are holding my insurance money which they said was required because they have a vested interest in my property and wanted to be sure my house was rebuilt in a timely manner. I have a contractor and everything set for the rebuild and the only thing holding it up is CHFA. So the timely manner in which they speak must apply to everyone but them. My contractor is waiting for his downpayment so he can begin the work. My question is, why does CHFA not have a time limit in which they are given to process such claims? I am a law abiding, tax paying citizen and think I deserve better from my government, whose salary I pay.

My wife and I have a loan CHFA in XXXX XXXXs. We recently sold our house and are having trouble getting Loan Payoff information sent from CHFA to our title company to close on our house. The first time i requested this information was XXXX-XXXX-18 and was told the information would be sent to the title company within 4 hours. It was not received within that time. I have called them every business day since to get an update on the status of our request and we get the same answer that it is " pending ''. My second mortgage for my Colorado Housing and Finance Authority ( CHFA ) loan shows up in forbearance. My first mortgage has never been in forbearance. The second mortgage does not take payments unless I sell the property or refinance. I have tried to contact Colorado Housing and Finance Authority ( CHFA ) and they can not tell me what is wrong. Ive notified CHFA several times that until we are two income household again mortgage will be one month behind. However they call and attempt to collect every day causing me distress and harassing me early in the morning during my work hours and now late at night. They paid another persons homeowners insurance with my escrow before mine was even due. We sent them the paper work and then they paid ours late. We have contacted them twice to have the money put back in the account. They told us that it would take up to 5 business days to research this and they have not contacted us back about it. We again tried to call them about it today and the refused to talk to us about it. I have always paid my account on time every month thru the website that the company provided and i always received notice that they received the payment. However, one month they notified me 30 days later that they never received the payment. I received a two party check with my name and Colorado Housing and Finance Authority after a hail claim. I signed the check and mailed to CHFA per their request. They are stating I as the homeowner can not perform any necessary repairs myself. I have a licensed roofer doing the roof, to be completed by XX/XX/XXXX and they have not seen a dime from CHFA. I was behind on my home mortgage, so to keep the house from being foreclosed on and stop the late payments I did a modification of my loan. By doing this i was assured that the late pays would stop.
