Collection Management Services did not produce an agreement that authorized the company to collect on alleged debt. It is a violation to 15 usc 1692f ( 1 ) and considered unfair practices to claim that a consumer owes a debt without the proof of an authorized agreement. I am challenging XXXX to provide the agreement under penalty of perjury. XXXX sent a verification letter, but failed to state that I had 30 days to dispute the validity of the debt which violates 15 usc 1692g ( a ) ( 3 ). XXXX also said that another company " referred '' the alleged debt. I challenge XXXX to provide proof of this " referral '' under the penalty of perjury. This is referral is also considered false and misleading pursuant to the FDCPA 15 usc 1692e ( 6 ) ( B ). Collection Management Services violated the same section in their response to my last CFPB complaint. Collection Management Services stated that the name of their business as XXXX XXXX Collection Management Services, but that is not the name that the company used in my letter nor is it the name used on my consumer report. This is misleading according to the Act and a violation of the 15 usc 1692e ( 14 ). I would like to bring to XXXX 's attention and for the record. According to 15 usc 1692j ( a ), It is unlawful to design, compile, and furnish any form knowing that such form would be used to create the false belief in a consumer that a person other than the creditor of such consumer is participating in the collection of or in an attempt to collect a debt such consumer allegedly owes such creditor, when in fact such person is not so participating. Because of XXXX 's failure to follow my cease and desist order and their multiple acts against the FDCPA, I will be pursuing remedy for all injuries against me pursuant to 15 usc 1692k. I will sending my invoice along with my Affidavit of Truth to XXXX or XXXX XXXX XXXX or XXXX XXXX XXXX stating all facts which includes each violation and the damages that you have caused me.

To whom it may concern : On XX/XX/2017 I visited XXXX XXXX XXXX in the City of XXXX, CA prior to being a resident here. After being completely forthright about my income status ( 100 % XXXX XXXX XXXX XXXX ) we had a mutual agreement to stretch- out the payments over a reasonable period of time, with wiggle room for fluctuations in my income. At such time we agreed to begin the process of XXXX XXXX XXXX care. I do recall that there were some inconsistencies with should be the first line of attack, and what should be prioritized? After 3-4 visits with the XXXX, the area in which I was being treated became more and more uncomfortable/painful ... .an outcome that I did not expect ( and this was one of several times in my life that I have had minor to major visits to the XXXX 's office. Without becoming verbose, my experience from a communication standpoint, as well as services rendered was far short of stellar. Since there was an outstanding balance after my last visit, I attempted to contact their office, via the telephone, as well as a certified letter in writing, all to no avail. The bottom line : I received ( just suffered from a " XXXX XXXX '' a couple of weeks or so ago ) poor service, and a non-communicative billing staff, who without notice sent my account to : COLLECTION MANAGEMENT SERVICES whose address ( to the best of my ability to determine as they have several listings/derivatives of their corporate name is XXXX XXXX XXXX XXXX XXXX XXXX, TN XXXX Lastly, I have never received a phone call nor any letter ( s ) from this collection agency. I have yet to receive a letter for validation from Collection Management Services. I want to make XXXX aware that a billing statement does not prove that I owe on the alleged debt. I am challenging XXXX to prove that the organization has rendered any services or compensation to which the company may lawfully collect. Where is the agreement to prove this matter? XXXXXXXX XXXX failure to prove this matter is considered false representation under 15 USC 1692e ( 2 ) ( B ) of the FDCPA and subject to fines under 15 USC 1692k. Again, if you all fail to produce an agreement that authorizes you to collect the debt, this considered unfair practices pursuant to 15 USC 1692f ( 1 ) and subject to fines under 15 USC 1692k. XXXX is the name on my consumer report. I want XXXX to be aware of what 15 USC 1692j ( a ) says. I noticed that Collection Management Services of XXXX XXXX, TN had reported negative information on my report without my consent ( violation of 15 USC 1681b ( a ) ( 2 ) and 15 USC 1692j ( A ) ). I began to make payments in order to satisfy the balance and clear my name and credit. My goal is to buy a home ; so it was important that I took care of the matter. I received an letter from them dated XX/XX/2021. The letter was sent for an organization in all caps and not to me the consumer. I seen that it was not my debt and I decided to request validation on XX/XX/2021. They did not give me any proof of agreement or contract that I had with Collection Management Services and they sent another letter requesting payment on XX/XX/2021. Under 15 USC 1692c ( c ) ( 1 ) ( 2 ) ( 3 ), I sent a cease and desist on XX/XX/2021. As of today, Collection Management Services are still reporting to XXXX, XXXX, and XXXX which is a violation to 15 USC 1692j ( A ) and 15 USC 1692c ( c ). Under my rights as the consumer, I demand them to be deleted immediately for they do not have the right, contract, nor agreement to do. The company logo and language on the two letters is a violation of 15 USC 1692b ( 5 ). As the letter continued, they stated it was an attempt to collect which is a violation of 15 USC 1692b ( 2 ) on both letters. As the consumer, I'm seeking remedy under 15 USC 1692k ( a ) ( 1 ) ( 2 ) for each FDCPA violation. As a debt collection agency, Collection Management Services take an oath to abide by the FDCPA.

I consumer XXXX XXXX reviewed a copy of my credit report and understand that Collection Management Services is violating my rights by trying to collect an alleged debt that they are trying to defame my character by placing it on my credit report. You have every right to this alleged debt but I did not give you permission to have my personal information. I will not continue to allow my right as a consumer to be violated. In XXXX of 2017, Collection Management Services reported an alleged debt without verification. The company did not provide any form or agreement that gave the organization a right to collect according to the FDCPA. The company did not disclose that I had a right to dispute the alleged debt nor did they inform me that I had 30 days to do so. I have sent a cease and desist order for all communications. According to the act, communication is the conveying of all information through any medium and my credit reports are mediums of communication. I request that Collection Management Services cease and desist and remove all of my information from their records as well as from all credit reports immediately.

I just looked at my consumer reports and noticed a collection on an account that is not mind. Consumer reporting agencies have assumed a vital role and have a responsibility to report consumer information to the best of their ability with maximum possible accuracy like the Fair Credit Reporting Act clearly says. I have never had this account and did not provide written consent to report the account : COLL MGMT SR : [ XXXX ]. Please investigate and provide proof with statements showing that this collection is mine and proof that I authorized the reporting of this information. If proof can not be provided I demand these collection accounts be removed immediately.

This complaint is regarding account information below that has not been investigated and no information given. Its been over 2 months with no information given to me regarding these accounts. I have no knowledge of these companies and they shouldnt be reporting as I never gave permission for the reporting per Section 1681a -I sent correspondence to the Credit Bureaus regarding this. I was never notified in writing per 15 U.S.C 1692ag prior to accounts being on my credit report, within 5 days. Moreover, these accounts violate debt collections, abusive and unfair practices per section 1692f ( 1 ) adding additional amounts.

When I pulled my consumer report, I seen that Collection Management SE reported numerous items in the total amount of {$15000.00}. As a federally protected consumer, I am aware of the rights that the organization has violated. I have never had a contract agreement with this organization and I challenge Collection Management SE to provide such agreement under penalty of perjury.
