Be advised that your claim is disputed and validation and proof of claim of the disputed debt is requested in accordance with the Fair Debt Collection Practices Act, 15 USC 1692 and as amended by adding the following new Title 8 USC 802 et seq., and the Fair Credit Billing Act, 15 USC. 1666 et seq. All of which work in conjunction with each other, including the Truth In Lending Act ( TILA ) 15 USC 1601 et seq. It is not now, nor has it ever been, my intention to avoid paying any obligation that is lawfully owed by the Claimant. In order to make arrangements to pay an obligation which may be lawfully owed, please document and verify the debt by complying, in good faith, with this request for validation and return it to me, within thirty ( 30 ) days of receipt of this letter.

This is NOT a request for verification or proof of Claimant mailing address, but a request for VALIDATION and PROOF OF CLAIM made pursuant to the above named Titles and Sections. I respectfully request that your offices provide Claimant with competent evidence as per the attached Declaration and Proof of Claim that I have any legal obligation to pay you the unsubstantiated alleged debt. Furthermore you shall cease all verbal communication. No phone calls to the Claimant.

At this time I will also inform you that if your offices have reported invalidated information to any of the XXXX major Credit Bureaus, such as, XXXX , XXXX and XXXX prior to validation and proof of claim of the disputed debt, this action might constitute fraud under both Federal and State Laws. Due to this fact ; if any negative mark is found on any of Claimant credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you and your client for the following : Violation of the Fair Credit Reporting Act Violation of the Fair Debt Collection Practices Act Defamation of Character Violation of United States Code TITLE 18 PART 1 CHAPTER 63 1341 ( Mail Fraud ) This debt is considered to be invalid until I receive proper validation and your offices provide Claimant with proof of claim of the disputed debt. Your offices have 30 days to produce the required documentation in accordance with FTC guidelines. During this validation period and proof of claim, if any action is taken which could be considered detrimental to any of Claimant credit reports, said action will be considered a dishonor and cause the self-executing contract portion of this notice to be implemented. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated.

If your offices fail to respond to this validation and proof of claim request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from Claimant credit file and a copy of such deletion request shall be sent to Claimant immediately.

Title 8 USC 809. Validation of debts [ 15 USC 1692g ] ( b ) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection ( a ) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Counter Claim with Self-executing Contract If Respondent, such as by commission, omission, and otherwise : ( a ) Fails to provide VALIDATION and PROOF OF CLAIM within thirty ( 30 ) days ; ( b ) Makes a false representation of the character of the herein above-referenced alleged debt ; ( c ) Makes a false representation of the legal status of the herein above-referenced alleged debt ; ( d ) Makes any threat of action that can not legally be taken, in violation of any applicable law, such as, the law codified at the Fair Debt Collection Practices Act, will be construed to be Respondents tacit acceptance of the terms and condition stated herein. Collection XXXX This letter is being sent to you as a follow up on my previous validation request sent to your offices. Please note as well that my prior correspondence was signed for by your offices, so I know that you are in receipt thereof. You have failed to comply with my prior request, and as such are in violation of Title 15 U.S.C. 1692g, which requires you to, '' cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or a copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector. Collection activities and communications that do not otherwise violate this subchapter may continue during the 30-day period referred to in subsection ( a ) of this section unless the consumer has notified the debt collector in writing that the debt, or any portion of the debt, is disputed or that the consumer requests the name and address of the original creditor. '' I am also demanding validation of the following data DATE OPENED XX/XX/2019 this is not the date of the incident. They are in violation of the FCRA, and FDCPA. I have attached the case US VS XXXX, they are violating this specific part of the FCRA, and FDCPA! Amount Owed {$120.00} : This company is a XXXX debt buyer, there is no proof under FDCPA, and FCRA that the amount owed to them is the amount they bought it for! Date of last activity : XX/XX/2019 there has been NO activity on this account to reset the clock, and this information is incorrect. License to collect : this collection XXXX company is not licensed at the time of the opening of the account to collect in the state of FL. They refused to validate the account in violation of FDCPA, and FCRA In light of your failure to provide any response to my prior letter, you should accept this letter as my demand that you provide me with competent evidence that I have any legal obligation to pay you. Additionally, you should also take note that if you have reported inaccurate information to any of the three major credit bureaus ( XXXX, XXXX or XXXX ) such reporting may constitute fraud under both Federal and State Laws. I have gone back and forth with Doctor 's Business Bureau about a {$350.00} collection being reported to credit reporting agencies. This debt is a result of medical services provided to me. I have disputed the debt as I am an insured patient with 100 % XXXX/XXXX coverage provided by my insurance. The facility ( XXXX XXXX XXXX ) was in-network for the annual/XXXX XXXX but out-of-network for the follow-up XXXX resulting from an XXXX detected in the annual XXXX. I was not informed that the second ( required ) follow-up XXXX was an out-of-network service. In addition, I was required to sign the attached Assignment of Benefits in order to receive services during a medically and emotionally trying time. This is my 2nd complaint in regards to this collection. The original complaint : XXXX, concluded that Collection Information Bureau , Inc. will resend account statement of collection. I contacted the company requesting the ORIGINAL invoice document. I was informed that the original amount was {$25.00} plus accumulated interest and the documents had been sent some time between XXXX/XXXX/XXXX to date. I advised that I DID NOT receive any documents until XXXX/XXXX/XXXX as a result of completing a credit check and noticing said account indicated as collections on my credit report with one credit bureau and not the others. The employee arrogantly informed me that notices were sent in the past ; however was unable to provide specific dates of when notices were sent out to me. She arrogantly stated, " We are not going to keep sending letters! '' I asked if the document was sent via certified mail and the employee responded that mail is not sent certified from their company. She also informed me to send a money order to the address listed and then I will receive an invoice receipt. I refuse to send a payment to an organization that has failed to provide the ORIGINAL invoice that is not dated 5 years later or the originating proof of said account, as this is my right as a consumer. I am requesting original documentation from doctor indicating amount, as I have always had health insurance and doctor 's offices do not render services unless co-payment is paid first, as well as proof of date the notice was sent. I also noticed that this collection agency had an incorrect mailing address on the summary of account that was just mailed to me after I submitted the original dispute. I am filing a complaint against this collection agency due to shady and unprofessional collection tactics. I had previously reached out to them because they obtained an old medical bill for services in XX/XX/XXXX and reported it to XXXX. This bill originally belonged to XXXX XXXX XXXX for {$200.00} which does billing for XXXX facilities and not XXXX XXXX as this agency reported. I had made a payment arrangement with XXXX of {$15.00} a month and the rep that I spoke with years ago advised that it would not be sent to collections. At the time that service was rendered at XXXX XXXX XXXX, I was unemployed and had no insurance. Then my account was sent to collections with no notification ; only the negative account on my credit report. Fast forward to XX/XX/XXXX when I discovered this collections account, I spoke to one of their reps, XXXX. I gave her my new address and contact information. She advised, " that if I paid this bill in full, she would definitely remove this account from my credit report. '' I researched this collection agency and they have a multitude of complaints filed against them. They have an F score with the BBB due to deceptive collections tactics which are strictly forbidden by the Fair Debt Practices Collections Act ( FDCPA ). Since I was suspicious of the rep 's offer, I sent her a Pay for Delete Agreement letter and asked for her written confirmation or signature as an assurance that she would fulfill her verbal agreement. Needless to say, she denied my request and therefore I withdrew my offer. This collection agency is renown for lying to consumers just to collect on a debt. I just checked my credit report today and this agency is still reporting this adverse account which is affecting my credit score.

I had an identity theft and provided the police report and id theft package ( we now knew who did this via the FBI contacting me ) via fax last night they claimed they never received it previously. I called to day to verify if XXXX received it, she told me she had, She said she had competed her investigation and had determined I owed the debt and that if I did not pay by credit card right now she would have me arrest and thrown in jail. I told her it was illegal for her to to try to collect a debt a debt I do n't owe and to say she would have me arrest and I demanded she provide me the method and results of her investigation in writing, she refused and finally put the owner of the company on the phone. I am applying for a mortgage and was told that I had a large amount of medial bills on my credit report and they denied me. When I received the credit report from the mortgage company it listed quite a few very small collections and one large one. I have tried multiple times to communicate via phone and in writing with this company. I have shown proof that I do not have a file in their office. I have never been seen by their physician ( s ), hospital, clinic, or other medical treatment facilities. Upon calling their office and providing my full name, dob, and social security number the representative was not able to find a file with my name. I have requested on two separate occasions via the USPS validation of this debt. I included a copy of my US Social Security card showing my full name and social security number. I requested VOD on XXXX XXXX, 2017, and XXXX XXXX, 2017. I provided my full name and mailing address. I have not received VOD. I suspect they are unable to verify a debt that does n't exist in my name. I am respectfully demanding what the law states. They have no provided VOD within 30 days. They do not have evidence of an account in my name. There are no medical records in my name housed by their physician, clinic, or hospital. I am demanding full credit bureau deletion immediately. I would like the account closed or in the least removal of my social security # and/or name from the file. Additionally, removing my mailing address and phone number from the file if it has been added DUE to MY written correspondence.

I received a collection notice from Collection Information Bureau , Inc. from creditor by the name of XXXX XXXX , XXXX. I paid the amount they claimed I owed, exactly {$81.00} because I do not like to be send to the credit bureau, etc. When I called this morning to ask for the explanation of benefits or at least to know which number should I call to obtain the information and why was I charged for that amount ( I have XXXX and also a supplemental XXXX XXXX XXXX XXXX XXXX. ), the man who answered the phone was very nasty and did not want to give me any information. I called CIB credit collections for the doctors business bureau. I got hung up on the first 3 calls by a XXXX XXXX. I finally found a different number online to call. I was told by XXXX there was no supervisor available, then when I called another number I got a supervisor who kept asking if I had the call on speakerphone letting me know that she wanted to not be on speakerphone. I advised her that if she had something to say she could say it no matter what the phone was on. She seemed irritated and did n't like that. She stated they had been mailing requests for payment to an address I have n't had for years. This is on my credit, and I have n't even received proof of debt. I also refused to give my card number over the telephone due to not being sure it 's even a legitimate business. She did n't have anything to verify their legitimacy other than " well we are on your credit report ''. I have had 2 accounts on my credit with Doctor Business Bureau. Called again XX/XX/XXXX to request detailed info, they would not release the info nor send me info in regards to these accounts as they state on their end shows in dispute, would not advise when it was opened. This is a medical bill incurred in XX/XX/XXXX, I made payment arrangements with the service provider in XX/XX/XXXX to pay {$25.00} per month, at which time I started sending payments monthly, and paid as agreed sending more than {$25.00} some months, in XX/XX/XXXX just as I had paid off the debt it was turned over to a collection agency who immediately put it on my credit report. The collection agency must update the information because I got approved financial assistance ( waived fees ) for the services provided. See attached letter from the hospital and letter from collection agency. This companies are never available to pick up the phone and they never sent me a bill before sending me to collection. The hospital is very disorganized with billing and is known that they overcharge patients with medical insurance. There is someone I know that have paid hundreds for a service that she got 2 years ago. Although she has insurance that is accepted by the hospital and for which she pay a high amount for that insurance the hospital has a really poor quality employees in billing department. They seemed to be prejudiced and bigoted and they judge people by race. I was denied a service recently because the billing assistant thought I didnt deserve to receive medical assistance for having an accent. Twice they have asked me to leave a fee in cash for any amount for services.

I received notification from the credit bureau that a collection had been placed on my credit file. A month ago I checked my credit report and on XXXX it was showing that I have a derogatory collection from XXXX for {$96.00} for a medical collection. I have never received a written collection notice or received any phone calls in attempt to collect the debt. Doctors Business Bur/XXXX XXXX XXXX XXXX have posted 13 accounts of {$30.00} each in my credit report dating back to 2014. I have sent pay to delete letters offering to make payment arrangements with the agreement that the account be 'Totally Removed ' from all credit reporting agencies. In other words, I asked that they do not simply show as Paid, but instead completely removed. The company has not responded. A sample of the letter has been attached. I have sent a debt validation notices to the creditor and only receive a verification of the debt instead of a validation of the debt. As per the Fair Debt Collection Practice Act ( FCRA ), a credit is supposed to respond with the original creditors name, address, and account number and not report to the credit bureaus nor attempt to collect until they have responded. However, the creditor did not send the required information and is still reporting to the credit bureaus, which is in violation of the FCRA. I was advised by the Internal Revenue Service that my social security number and other confidential information were compromised. Doctors business bureau have me on collection for an accountunder my son 's name. He son is XXXX and he has been receving medicaid since he was born covering 100 %. I mailed a certified handwritten letter to the Doctors Business Bureau on XX/XX/2019. USPS states that they recieved it XX/XX/2019.
