Im writing this letter because of the harmful business practices I have experienced recently with XXXX XXXX in XXXX, California, and Collection Consultants located in XXXX, CA. Now I am not writing this letter because I want to sound victimized but I am writing to make sure they are held accountable for taking advantage of myself and others. XXXX XXXX is a large organization, seeing many different patients who I believe may all be victims of these egregious practices. They also serve a large number of elderly patients in the XXXX, XXXX XXXX XXXX region, who may be even worse victims of fraudulent medical practices. To begin my story, I had visited the ER room at XXXX on XX/XX/XXXX in order to get care for my stomach. I had gone river rafting that day and could not bear the XXXX I was experiencing afterward. I checked in from my recollection just after 11 at night, where I was sharing I could not drink water very well and was getting dehydrated. They sat me down and IVd me with some water or a saline solution. Then they gave me a few minor stomach meds to calm my stomach down and I was sent home around XXXX. Now for this small visit I did receive a bill a few weeks later for a {$820.00} with my {$280.00} copay. I did pay this and finish it out. My XXXX XXXX insurance with my family put it towards my deductible. Now I thought I was done with these bills at this point for what seemed like a moderately severe stomach issue that was short lived. I moved on from that, moved out of my location XXXX of XXXX, and my friends moved out of that house where the Hospital had my mail address XXXX of XXXX. I was regularly checking mail there and had changed my address since then multiple times. That property was also made vacant by the campus who owned it. Now flash forward to XXXX of XXXX, when I was applying for a new credit card and got denied. XXXX alerted to me I had a collection against me from an unknown source. I had no idea where this was from so I ran a credit report from XXXX, which told me the collection was from a company called Collection Consultants and the original creditor was XXXX XXXX XXXX. Now I tried calling the collection agency first and they shared with me I had accrued interest on this bill. I was surprised because I had never received a bill. I did not even know what day the bill was for. They told me this bill had fallen into their hands by XXXX of XXXX and notices were mailed out but I told them I had never received the bill. Their records they shared, told me the bill had been sent out 4 times to the old address but I shared I had never received it. I also had no proof or evidence the XXXX XXXX had sent a bill to me either ( they never stated clearly ). They also had my correct phone number at the Collections group but they wrote on file it was disconnected they told me. I checked back at my voicemails which I had dating back to XXXX and I only found collections calls from people with completely different business names! I had not even received a call from XXXX XXXX. Now XXXX told me later on the phone they had my old number on file, so it did not make sense that this Collection group did not have my correct address when they had my updated phone number, and were able to pull my information. Now the first major problem I saw here was that my visit was in XXXX, and the Hospital staff told me the bill was not mailed out to me personally until XX/XX/XXXX, during the start of the pandemic. This was a very negligent way to bill someone for a previous visit, and to send out bills to an old address. They only gave me from XX/XX/XXXX until XXXX before they let it fall into collections as well. Now when I spoke to the collection agency they were coercive in regards to my debt and interest. They told me that the original bill was over {$4200.00} but in a way that made it sound like I was originally due for that full amount. Then they told me they could only remove the collection off my credit if I agreed to have them cut my interest in half, and if I asked for all my interest removed I would not be able to have it taken off my credit. This was emotionally intense and fuming to receive interest and be bartered with for interest and collections removal when I had never received the original bill from the Hospital directly in the first place! I later made smaller offers, and even emailed that I would like a written offer of the lowest settlement they could make. I finally got them to email me an itemized statement. My parents also had to request of XXXX XXXX XXXX for this bill, because they never received it or any updates from XXXX XXXX that my supposed deductible and copay totaled at over {$1900.00}. My parents already were paying {$1900.00} a month in premiums, our family deductibles were up to {$3700.00} and the maximum co-pay we would be responsible for was {$7000.00} individual and {$14000.00} as a family! This is unbelievable when other people in this country receive free healthcare right? Now after looking at both statements I found majority of these hospital expenses to be near extortion for patients. They were charging us {$1700.00} for just the bag for the IV and over {$500.00} for putting the IV in my arm from what I could tell on the bill. They also charged an additional {$510.00} for the solution in the bag of water and some saline! How can a water solution be {$510.00}!? Now this bill had been sent out to XXXX XXXX by XX/XX/XXXX and a portion was paid by them however the Hospital had not even issued the bill to me. Even though our insurance paid some of it I was never sent a bill by the hospital, however they randomly decided to dig up this bill in XXXX of XXXX, at the start of the pandemic and during one of the worst economic crises we have ever seen! Now I am sure I am not the only one who was attacked by the hospital with a 2 year bill during the worst economic crisis of our most recent time. I had only {$1200.00} to my name plus {$3300.00} in credit card debt to begin with, and was out of work as a substitute teacher. That is extremely bad timing to be pulling bills out for people unless you were trying to take advantage of people! I also had not been in a good place financially at one point with my business and still am climbing out. In addition, I had a deductible and more copays with my insurance and I can only imagine what some people could be going through if they had pulled out multiple medical bills on them during the pandemic! This is a negligent billing practice by far, and shows they were looking to take advantage of people. I also shared with collections I had lost {$35000.00} potentially in revenue with my business but they were barely willing to offer better settlement options or reinstate my debt with the Hospital and remove it from my credit record. We had spoken with a supervisor in billing from XXXX XXXX, however she was not willing to bring anything on the bill to a settlement, nor to verify that the expenses on the bill were legitimate pricing. She was not willing to provide any explanation for us to make sure the billing was done correctly. She did not provide us the level of room or any information on what was the legitimate cost. It also was inconsistent to find out the ER Hospital bill was greater in total than 5x the ER Doctors Bill! I was not provided any reasoning behind certain laboratory tests, such as a lipase test measuring a certain level of enzymes costing an additional {$200.00} along with other metabolic tests. We had those conversations during XXXX of XXXX, and have not received anything in mail as of XX/XX/XXXX. She also claimed that the account was moved over to collections but she was not specific on who actually owned the debt. I had spoken to other XXXX XXXX staff on the issue of who owned this bill but they also said it was owned by collections. When I asked Collections who owned the bill they stated that XXXX owned it. This sounds like someone is giving out fraudulent information and it is absolutely wasting our time. The supervisor at XXXX was not open to even getting my bill removed from collections and brought back into normal standing when they had claimed it was sent out 4 times to the wrong address 2 years after the fact. They did not even provide documentation proving the bill was sent out, nor were they willing to even mail a statement at first. We had asked a few representatives after the supervisor to send us this information and they could only do it by mail, which extends the process even longer. They could have had my parents address from their blue shield account as well even on the billing when XXXX XXXX paid. They did not request XXXX XXXX to notify us of the bill however, and my parents had never received anything nor does XXXX XXXX attest to have sent out a bill. As of right now I have not received any mail from the hospital or but I have from the collection agency with proof of communication and the billing statement directly from the hospital. I am assuming they have it on its way, but I can not know right now if they are going to keep extending this process and wasting my time. The bill I was sent by email though has a starting date of XX/XX/XXXX however, not XXXX like XXXX shared over the phone, and only gave me 30 days for a pay period. The only official record I have is that the bill was issued XX/XX/XXXX ( not XX/XX/XXXX ) and the pay period had ended XX/XX/XXXX and the collection began XX/XX/XXXX. There is no record provided at this moment the bill was sent out or that there was enough time for the bill to be paid or policies on that bill timeline. They did not share that I would have had x amount of time and why from the issuance of that bill, which produced continuing interest as well. I was never provided any payment plan options, never given information backing what the costs were, and the hospital bill was 5x higher than the doctors bill! The Collection agency said they would provide financial aid documents to be sent out to me so I am doing that. I even emailed them to work with one of their settlement offers just so I could have it in writing to be taken off my credit but I received no response. I hope I am the only one experiencing this issue but unfortunately I know that isnt true. I know that there are people who went in for things more serious than a river virus, and most likely had 10s of thousands of dollars of bills pulled out of the woodworks for them, unpaid for by insurance. I can not imagine how large these hospital bills would have been created if I had anything worse happen. XXXX XXXX is guilty I believe of negligent billing practices, potentially fraud, and extortion of patient services to myself and potentially many other people during one of our nations most frightening economic times. I hope you will consider disputing this practice and protecting the livelihoods of many more families affected by this organization.

To make this very clear : Neither Collection Consultant nor XXXX Hospital have attempted to clear the record. I have provided them both with my original insurance provider, XXXX. Collection Consultant is a debt collector and although I provided them with my original health provider, their claim is that it is not in their policy to contact the original insurance provider. In fact, they claim that I, the patient, have to deal with the original occupant of my bill, XXXX Hospital. Fact : I made the call to XXXX Hospital, ( after receiving a notice from Collection Consultant, from an old address, that I owed XXXX - the original bill was only XXXX dollars. This process is very slow and can take up to a month or longer to process. ( This takes time, and sometimes, causes the patient to forget to keep an eye for an upcoming letter or bill on the mail. During all this time, I am still an employee for the county of XXXX XXXX with full insurance. ) A few months later, after viewing a mark in my credit burial I contacted XXXX Hospital. I told them that I was contacted by collectors and there was a bill. They mentioned that due to the fact that it was passed onto a collector, XXXX Hospital was no longer in charge or responsible with that billing. Again, I have to contact Collection Consultant. Again, I mention to them ( Collection Consultants ) that I already have insurance. Again, they state that it is not in their policy to deal with my original medical insurance group, and so, I must deal with the original billing group - XXXX Hospital. After another two bills from Collection Consultants, I again contact XXXX Hospital with that information ( letters from Collection Consultants and my original insurance provider ) and XXXX Hospital asks me to wait for a reply after their research. Again, more waiting. So, when I contact them, XXXX Hospital claims that this issue must be dealt with by the collector - the case was transferred to a Collection Consultant. As a consumer, with actual full insurance by the county of XXXX XXXX, it is absurd that neither one wants to take responsibility. And of course, the bill with interest remains in my credit report. In the few bill collection letters I received from Collection Consultants, I responded to them - mentioning to them that I had insurance - original insurance provider XXXX. They claim to be collectors. Any changes to that fact, must be altered by the original billing group - XXXX Hospital : because XXXX Hospital updated its computer system, it takes longer to find billing history files - explained by XXXX Hospital. Of course, although they mention that it is not up to them to contact the original insurance provider, they do have a right to increase the bill cost on file, from the original cost of XXXX, to XXXX according to Collection Consultants. Now, the visit to the ER was a basic yes or no possible cold. That has turned into a 5 year voidance policy by both groups and so far, neither one bothered to contact the original insurance provider. They both still make the claim that it is not their need to contact my original insurance provider. I actually forwarded, with pictures, by original insurance providers to both. Collection Consultants refuses to even consider that fact. And XXXX Hospital says that the case was transferred and there 's nothing they can do about it. All that remains is a bill, originally XXXX dollars from a one hour wait visit to the ER into a XXXX dollars 5 year struggle with collectors. As things stand, neither group, either Collection Consultants nor XXXX Hospital are willing to consider the fact that I had, and still do, have insurance. How many billing letters did I receive from Collection Consultants over a period of 5 years, not many. And how many did I contact them? probably more. And another policy that I was informed about - upon my calls to Collection Consultants, not every call I made was being recorded. Nor notes I requested to be added to my file with them was being followed through. And upon requests to be transferred to supervisors or managers, was ignored or told that it was not possible. Similarly, XXXX Hospital has a similar policy. That once the case is transferred to collection, it is no longer their need to deal with the case. The policy continued for years. As a onetime patient, it is so absurd that I provided my original insurance provider and neither group bothered to contact them. Their only policy is to collect debt, even if it means avoiding the fact that there is an original medical insurance group for which could have been contacted for the bill. Similarly, yes, over the past few years, I did receive a few billing payment request from Collection Consultants. That is a fact. And yes, I did contact them. And of course, their claim is that, a few number of collection billing letters is sufficient to explain why my bill has been in their files for near to 5 years and how many times they attempted to contact me - with a collection request. Also to make a point - I have moved 6 times in rental properties in that period of time., as a College grad. I already provided my original medical provider. To both, XXXX Hospital and to Collection Consultant. I mailed it, as an attachment on my previous request.

Today I had a family member call Collection Consultants regarding some collections that were on my credit report. I was on the line and my family member informed them that I was on the line but they never actually asked to talk to me so I just listened in. The call was because back on XX/XX/XXXX I also had a family member call and try and pay the accounts for me since I am scared to speak to a collector. I knew I may have owed a XXXX bill or two so I decided to simply pay them and be done with it. The amount on my credit report was {$800.00} for 3 accounts. When we called on XX/XX/XXXX, the collector was actually very nice. They said if I paid them what I owed them they would actually remove the accounts from the credit report. I thought it was a sweet deal. And since I was going to pay them anyways, I decided to go for it. When I tried to pay them however, they told me they had over 20 accounts on the credit report and I owed {$2500.00}. That was definitely not what I was expecting to hear. They also told me that the three accounts that were on the credit report had different balances as well. They said the account which showed {$280.00} was actually now {$430.00}. The account for {$200.00} was actually {$310.00} and the account for {$310.00} was now {$490.00}. We were concerned as to why the credit report was only showing 3 accounts for only {$800.00} dollars yet they were attempting to collect {$2500.00}. After their explanations which didn't make much sense to me I really began to feel like I was being swindled so my family member asked for all the paperwork they had on these accounts. We wanted to make sure these were actually my accounts and not someone else named XXXX XXXX. The representative who I spoke with said she would order them and send them by mail. Today, 1 month and 12 days later, I have not received anything so we call again. We spoke to a man named XXXX and asked why no documentation had been received. XXXX said there were no notes of any kind that anyone had ever spoken with his company asking for documentation. When we heard that we were shocked. We definitely called on the XXXX and spoke with someone. We didn't just make up numbers for accounts and balances out of nowhere. XXXX responded to that saying he was looking up a master account and not any individual accounts. We responded back by saying here are the three accounts we originally called on so you can check those and see if there are any notes. XXXX still said he didn't see anything. This just made my day worse. XXXX said he would request those documents for me now but I was no longer interested in waiting who knows how much longer for this paperwork. It is my understanding that collectors can't collect anything they can't prove. It is also my understanding that collectors only had 30 days to provide validation of debt or else its not valid. Because I requested the notices on XX/XX/XXXX, and because now on XX/XX/XXXX not only have I not received the notices but the collector hasn't even requested them, they can not collect on this debt anymore. I'm not going to give them more time to do something they were supposed to do already. Also, how can I trust they will actually do it this time if they didn't do it the first time I asked? XXXX was told the same thing today and he just responded with the same I'll request it today speech. To summarize what this complaint is about I will state this from my point of view. Collection consultants is only reporting 3 accounts on the credit report for {$800.00} Collection consultants is attempting to collect on 25 accounts. Collection consultants is attempting to collect over {$2500.00} Collection consultants is telling me to delete these 3 accounts from my credit report for {$800.00}, I have to pay 25 totalling over {$2500.00}. Collection consultants isn't even reporting a proper balance on the three accounts which are on the credit report. That is a violation of the FCRA for not reporting accurately. Collection consultants has been asked to provide proof of the 25 accounts. Collection consultants has failed to provide proof of ANY accounts after 42 days even though they are only allowed 30 by the FDCPA. Collection consultants by their own admission haven't even requested proof of debt after all this time. Collection consultants can't even keep their records straight by noting conversations which took place. How can I trust they are legitimate?

Collection Consultants of California has willfully and blatantly violated the Health Insurance Portability and Accountability Act ( HIPAA ), the Fair Debt Collection Practices Act ( FDCPA ), and the California State Debt Statute of Limitations laws with regards to an alleged debt they claim I owe them {$1500.00} for medical services related to account number XXXX XXXX.

I previously requested validation ( not verification ) of this alleged debt pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 ( b ). Their response dated XX/XX/XXXX violated the Health Insurance Portability and Accountability Act ( HIPAA ) by listing Personal Health Information ( PHI ) without obtaining a medical release form with my signature authorizing the release of such records. Again, the medical services listed on the correspondence were never rendered to me and are being reported incorrectly.

Please be advised that under Federal Statutes, The Fair Credit Reporting Act, ( 15 U.S.C. 1681 et seq ) and Californias Consumer Credit Statutes, and subtitle D of the AAR, SEC. 13401. APPLICATIONS OF SECURITY PROVISIONS AND PENALTIES TO BUSINESS ASSOCIATES OF COVERED ENTITIES ; and SEC. 13407 ( 1 ) BREACH OF SECURITY.

The term breach of security means, with respect to unsecured PHR identifiable health information of an individual personal health record, acquisition of such information without the authorization of the individual.

Please note that these liabilities are under the penalty rules of the Omnibus Final Rule effective XX/XX/XXXX interpreting and implementing various provisions of the Health Information Technology for Economic and Clinical Health Act of XXXX ( HITECH Act ) as issued XX/XX/XXXX ( a ) Duty of furnishers of information to provide accurate information. ( 1 ) Prohibition. ( A ) Reporting information with actual knowledge of errors.

HIPAA and Californias Medical Privacy Statutes and the penalty provisions of the ARRA section D, privacy provisions, the penalty rules of the HITECH Act as issued XX/XX/XXXX and the Omnibus Final Rule effectiveXX/XX/XXXX and the FACT Act final rules effective XX/XX/XXXX are in effect in this situation.

The Privacy Rules prohibits a covered entity from using or disclosing an individuals protected health information ( PHI ) unless specifically authorized by the individual or otherwise allowed under the Privacy Rules.

In general, PHI encompasses substantially all individually identifiable health information that is transmitted or maintained in any medium. Individually identifiable health information includes health information that is created or received by a health care provider, health plan, employer, or health care clearinghouse, and that relates to an individuals physical or mental health or condition, including information related to an individuals care or the PAYMENT for such care.

Consequently, Collection Consultants of California have continued to violate the FDCPA law by not conducting a proper re-investigation of this alleged debt. My correspondence datedXX/XX/XXXX and XX/XX/XXXX, not only requested validation but that their office provide competent evidence bearing my signature showing that I have a contractual obligation to pay this alleged debt. They were also instructed to provide me with a full description regarding the steps taken to rightfully validate this alleged debt to ascertain its being reported accurately by their office. Unfortunately, the computer-generated itemization report provided does not validate this alleged debt but does confirm their violations of both the FDCPA and HIPAA laws.

Additionally, they you should be aware that the statute of limitations on all debts in the state of California is 4 years, except those made orally. The Statute of Limitations has long expired on this alleged debt. If it indeed exists, its considered uncollectible. In the legal parlances of the state of California Attorney Generals office, this is a zombie debt, and their firm could face severe consequences for pursuing this alleged debt any further. Please note that in XXXX XXXX, Plaintiff, vs. XXXX XXXX, No. XXXX XXXX United States Court for the District of Arizona, XXXX, the courts ruled that reporting a collection account on a credit report is considered collection activity.

XXXX XXXX XXXX XXXX XXXX XXXX XXXX # XXXX XXXX, Ca XXXX Collection Consultants of CA Address : City/ State/ Zip : Date : XX/XX/XXXX XXXX : Acct # XXXX To Whom It May Concern : I have previously sent you a request to validate my debt under the Fair Debt Collection Practices Act and all I received was an itemized list of the alleged charges you claim I owe you. This does not meet the Federal Trade Commissions guidelines of what constitutes proper debt validation In addition, in the case of XXXX Vs. XXXX ( IN THE COURT OF APPEALS OF INDIANA, No. XXXX ), the court ruled that : XXXX XXXX. XXXX ( b ) ( emphasis added ). On XX/XX/XXXX, nineteen days after the date of XXXX debt collection letter, XXXX counsel XXXX sent XXXX a letter declaring that XXXX disputes your debt collection-related allegations, denies the same, and demands strict proof and verification thereof. Record at 21. As such, XXXX should have ceased his debt collection efforts immediately upon receiving that letter. Instead, XXXX proceeded to obtain a default judgment against XXXX on the debt collection claim before he had mailed XXXX the necessary verification and, thus, violated 15 U.S.C. 1692g ( b ). XXXX maintains, however, that there was no violation of the FDCPA because he sent adequate verification of the debt [ to XXXX ] in the XX/XX/XXXX notice of claim. Brief of XXXX at 13. Specifically, XXXX claims that a copy of the consumer credit contract between XXXX and XXXX XXXX attached to the notice of claim provided sufficient verification of the debt within the meaning of 15 U.S.C. 1692g ( b ). We can not agree. The contract in no way provides sufficient verification of the debt. A review of the document reveals that it identifies only the terms of XXXX loan, including a 17.99 % annual interest rate and the original loan amount of {$2500.00}. The loan agreement contains no accounting of any payments made by XXXX, the dates on which those payments were made, the interest which had accrued, or any late fees which had been assessed once XXXX stopped making the required payments. Indeed, the existing unpaid contract balance at the time XXXX sent the debt collection notice was at least {$350.00} more than the original loan amount. Therefore, XXXX violated 15 U.S.C. 1692g ( b ) when he failed to cease collection of the debt by obtaining a default judgment against XXXX after XXXX had notified XXXX in writing that he was disputing the debt but before XXXX had mailed verification of the debt to XXXX. We reverse the trial courts entry of summary judgment in favor of XXXX on this issue. I notice that you are still reporting this collection on my credit report, which is considered to be a collection activity. You are now in violation of the FCPDA, and are now subject to fines of {$1000.00}, plus actual damages and attorneys fees, which I may collect from you by filing a claim in small claims court. These collections on my credit report are causing me severe problems in trying to purchase a home and the damage could lead into the $ XXXX. You should also be aware that reporting such invalidated information to major credit bureaus might constitute defamation of character, as the negative marks on my credit report harm my credit and prevent me from enjoying all the benefits of good credit. In addition, the Fair Credit Reporting Act ( FCRA ) does not allow the inaccurate reporting of information on my credit report and under this act. Therefore, if you do not immediately remove this account from my credit report, you are subject to another {$1000.00} fine, plus punitive damages. I'm sure your legal staff will agree that non-compliance with this request could put your company in serious legal trouble with the FTC and other state or federal agencies. I intend to follow through with the suit if I do not hear back from you within 15 days. I look forward to hearing from you, XXXX XXXX

I have sent numerous disputes, notarized, letters, and police reports to Collection Consultants of California, for request of a certified copy of the original contract with my signature to substantiate their claim against me. I have been a victim of identity theft and many accounts were established without my consent.I am unable to find any documentation of any contractual relationship between the creditor, XXXX XXXX and me. The First letter I sent was on XXXX to validate the debt, Collection Consultants of California replied with a letter on XXXX, " In response to your request for proof of contract, we have verified with our client, XXXX XXXX, that balances are correct and owed. '' This letter did not provide me with the original contract with my signature. The second certified letter I sent was on XXXX to send proof of debt accordance with Debt Collection Practices Act, Section 1695 ( G ), The original application or contract, any and all statements allegedly related to this debt, any and all signed receipts, any and all cancelled checks. Collection Consultants of California replied with a letter on XXXX, In response to your request for proof of contract, we have verified with our client, XXXX XXXX, that balances are correct and owed. '' This letter did not provide me with the original contract with my signature. The third certified affidavit letter of fraud was sent on XXXX to Collection Consultants of California, the affidavit sent was the original with the wet signature and original notary stamp notarized by XXXX XXXX, Public Notary, COMM. # XXXX. I also attached the police report that I have been a victim of identity theft and many accounts were established without my consent. The letter was not for a request for verification or validation. The request was for proof of contract with original signature to substantiate their claim against me. Collection Consultants of California replied with a letter I received in the mail on XXXX, " We understand you may be a victim of identity theft. based on the limited information provides thus far, we are not able to investigate this matter fully. My initial communication to Collection Consultants was XXXX XXXX, XXXX, after having discovered this account on my credit report while in the process of buying a car. Meanwhile I disputed with CRA 's online. After sixteen days with no response, I submitted a CFPB complaint on XXXX XXXX, XXXX. To date, Collection Consultants was unresponsive to this as well, so I disputed with CRA 's again through the CFPB. I sent another letter to Collection Consultants on XXXX XXXX, then again on XXXX XXXX, XXXX, requesting underlying documents from the original creditor, including a chain of title, since I was unable to reconcile this account and amount, and suspect that it is something that was already paid in full by my parents years ago. A response from Collection Consultants was finally received on XXXX XXXX, XXXX, in the form of a printout of the itemized account information. I had requested an original itemized statement from the original creditor to review ; the FTC has stated that a " mere itemization '' is insufficient proof to constitute validation of an alleged debt. Per the limited detail provided by Collection Consultants, in fact, it appears that an unknown " adjustment '' was added to the account balance after payments were made, creating a new " balance ''. As of XXXX, XXXX, Collection Consultants recent collection letter has inexplicably inflated the unsubstantiated debt from {$1700.00} to {$2400.00} or {$2400.00}, depending on which letter you look at. Further, it seems that CC may not be the first debt buyer to be involved with this account, given the reported assignment date of XXXX XXXX. Incidentally, the original date of assignment to collection is most likely much earlier, according to your records, XXXX XXXX was initial delinquency, yet is being inaccurately reported to appear recent. Collection Consultants was requested to document their ownership of the debt, the balance of the debt, the date of the default or last payment, the identity of prior owners of the debt and the name and address of the debtor in the original creditor 's records. In addition, the debt buyer must also have the original contract or a document provided to the debtor while the account was active to show evidence of the debt. Please note that, in over 70 days since my initial letter, Collection Consultants has failed to prove that this debt is mine, that it is accurate ( I 've never had Physical Therapy in my life! ), failed to provide me with an original contract made with the original creditor, and has failed to provide me with proof that Collection Consultant 's has a legal right to collect on this alleged debt, as I requested. Dear Sir/Madame : Approximately 1 year ago, it came to my attention that erroneous information was present on my credit report. I immediately contacted the collection agency regarding this matter via phone and then via written mail. My initial contact with the collection agency was met with hostility ultimately terminating in vile words being exchanged. After researching the matter, I determined that the collection agency was required by federal law to " verify the accuracy '' of the information being reported. Federal law is very clear concerning this matter. In my case, the data being reported is are three delinquent medical bills. Because of the nature of the bills, I requested very specific information regarding the debt that must be maintained and provided upon request. As this date, the information has not been provided nor have the accounts been removed from my credit profile. After further research, I determined that the credit reporting agency is required by federal and state law to " verify '' any disputed debt or remove the delinquent account ( s ) from the consumer 's profile. I immediately contacted XXXX, first via telephone and ultimately through multiple letters sent via certified mail to have the " debt verified '' or removed from my credit profile. Again, during the debt verification process, I have requested very specific information which is required under federal law to be disclosed upon request or have the accounts removed from my credit profile without prejudice. On at least two occasions, XXXX has contacted me via U.S. mail stating that the accounts have been verified but have not provided me with any of the information I have requested. In addition, they have refused to remove the delinquent accounts from my credit profile. As a result, I have taken the liberty of contacting an attorney regarding this matter. On XX/XX/XXXX I was taken to the XXXX XXXX room. We were told it was a county hospital and where I should go for financial reason since I was UNEMPLOYED with NO MEDICAL INSURANCE and I was on pandemic unemployment. There is also yet another, 3rd bill coming to me from XXXX XXXX XXXX group for this same visit. Thousands of dollars I have been charged just to go to the emergency room to make sure I did not have COVID. All I needed was to have XXXX ruled out, simple. I was there not even an hour. I called and called their billing department, never getting an answer for MONTHS, I left voice mail messages begging them to call me about these bills. I finally had one person call me and instruct me to send all my financials and income tax returns for the year prior, XXXX which was when I had a job. So they based the hardship assistance I was pleading with them to give me for these bills on a year of income that was long GONE and not the year of XXXX I was currently in and unemployed in for most of the year. I even went online a couple of months ago and paid a {$20.00} payment to the XXXX XXXX payment portal just to show I was trying to come up with something until they could grant me hardship assistance. Now they have turned me over to a collection agency, with out any notice of my status of hardship assistance determination. I have this showing up on my credit bureaus which is crippling to me as I start to try to rebuild my life after a year of very little employment. I can not rent an apartment or get a car loan with this collection on my bureaus, and it is NOT ethical that they have placed this account for collections anyway after I have been trying to reach them AND made a payment to them in the midst of this until we figured out what to do with financial aid and hardship determination based on REAL numbers and income, not my XXXX year of income before the PANDEMIC. I am, and always was, more than willing to make payments to this hospital if they would call me back and please speak with me to set up a payment plan and in the meantime, take this account out of collection.

This company Collection Consultants of California has been harassing us over a year by phone calls saying we owe a hospital bill that we know anything about. They keep calling and adding interest on to the bill. We beg them to please sent us an itemized statement of what this is. We never received a bill. Under the laws of the Fair Debt Collection Practices Act ( FDCPA ), I have requested for Collection Consultants to validate the alleged debts being reported on my credit report with XXXX, and XXXX I sent them a written request dated XXXX XXXX, 2016 via certified mail, which the online return receipt shows it was received and signed for on XXXX XXXX, 2016. Collection Consultants has not only failed to reply to my request for validation within 30 days of them receiving this request, but have violated federal law and failed to provide me with a copy of any viable evidence, bearing my signature, showing the accounts are being reported accurately. I made a second written request dated XXXX XXXX, 2016 via certified mail, which both online and hard copy return receipts show Collection Consultants received my letter on XXXX XXXX, 2016. I reminded them that their failure to reply to my original request for validation of the alleged debts being reported, nor providing viable evidence, is a clear violation of the FDCPA. As such, I requested for them to validate the alleged debts by providing viable evidence or have the alleged derogatory accounts deleted from my credit reports immediately. As of XXXX XXXX, 2016, Collection Consultants has failed to reply for my request for validation of the alleged debts they are reporting but also not provided any viable evidence to support their claim. Please note that Collection Consultants was originally reporting to the credit bureaus the following accounts as being derogatory prior to my request for validation.Since then, Collection Consultants has continually disregarded federal law but has taken the initiative to report XXXX more derogatory accounts to the credit bureaus without advising me in writing as law dictates. I am enclosing copies of my written requests, online confirmation return receipts, and credits reports to support my claims.

This is an issue with both XXXX and a collection agency called Collection Consultants of California. I have an open collection item with the collection agency mentioned above, originally assigned XXXX. To date, I have not received any notification of this collection account. I last went through the process of pulling my credit reports from the 3 credit bureaus in late XXXX XXXX, which is where I first learned of the collection ( it appeared on all three of my reports ). I submitted disputes to all three credit bureaus disputing the validity of the debt- both XXXX and XXXX removed the collection from my records, while XXXX marked it as valid. At a loss of how to resolve the issue, I sent an email on XXXX/XXXX/XXXX to the only contact email I could find listed for the collection agency ( XXXXXXXXXXXX ' ) proposing to proposing to pay the collection just to get it removed from my credit report. I did not imply ownership. I received no response. In XXXX I again disputed the validity of the debt through XXXX and again had it marked as valid. I am submitting this complaint as I am at a loss as to how to resolve this issue and get this collection removed from my XXXX. Due to swift removal of the collection from my credit report by 2/3 credit reporting bureaus as a result of my initial dispute, the lack of communication about the collection by the collection agency, and the lack of response to my email to the collection agency in which I offered to pay the collection amount in full simply to make it go away, I have serious doubts regarding the legitimacy of the collection agency. I feel stuck in a untenable situation where I can neither pay to resolve the collection nor effectively dispute it. I am also confused as to how XXXX has access to data that shows the collection as valid, while the other two credit agencies determined it was invalid.

Hello, I am emailing in regards to XXXX bills from XXXX XXXX XXXX still showing up on my credit file. I am aware that Collection Consultants in XXXX, California ( XXXX. XXXX XXXX, zip XXXX ) still has me showing bad debt for {$75.00} and for {$10000.00} to XXXX XXXX XXXX XXXX XXXX XXXX Bills ). XXXX XXXX, my insurance plan was never billed for the XX/XX/XXXX {$10000.00} amount and is still awaiting on the bill from XXXX XXXX of XXXX. The {$75.00} debt was sent to collections without me ever have received a bill. How am I supposed to know that the {$75.00} debt to XXXX XXXX of XXXX is mine? No bill was ever received but it was sent to collections without my knowledge. I do know that starting XX/XX/XXXX there have been many changes to all three major reporting agency companies ( XXXX, XXXX and XXXX ). I know that my social, my name, address and either my D.O.B or social should be listed to identify me as the person who the company is trying to collect a debt from. I also know that this past XX/XX/XXXX, all XXXX agencies are to remove all medical debt accounts that were sent without properly billing my or any XXXX persons medical insurance. I demand proof from XXXX XXXX XXXX of XXXX that they have billed XXXX XXXX as I have sent in my bills on my own and they have been awaiting a response from XXXX XXXX XXXX XXXX since the beginning of the year to send in a payment. They requested their TAX ID to make a payment on the XX/XX/XXXX bill for {$10000.00}. I work in the XXXX field and I understand that insurance companies MUST be billed and that it can take from XXXX days to up to a year for payment. Recently while conducting a monitor of my credit report I discovered that COLLECTION CONSULTANTS # XXXX, # XXXX, # XXXX has furnished some items that have unverified information. I believe under the Fair Debt Collections Practices Act, I have the right to request that you allow me to validate the alleged debt. I am aware that there is a debt from COLLECTION CONSULTANTS but I am unaware of the amount due and your bill does not include a breakdown of any fees. Additionally, I am allowed under the HIPAA law [ HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT OF 1996 ], to protect my privacy and medical records from third parties. I do not recall giving permission to XXXX to release my medical information to a third party. This is a response of a previous issue with a medical debt where I can provide the case # XXXX I did file a care concern, obviously when I called the very rude and not understanding representative on the phone. I did not agree with the bill and if the hospital was able to help me I would have gladly paid it, But in my case, when the hospital or XXXX said there was not much that could be done and used wrong supplies on me. I was mistreated and was in the same exact amount of pain when I left. I was not able to sleep all night from the pain and the next day needed to seek further care and treatment since XXXX was not able to help me. I will file a complaint with the physician board, dept of insurance, and any other related dept, that overlooks hospitals if I have to. The XXXX that tried to assist me did not have the proper equipment and if she knew that, then I should have been informed that and would have refused service. Bottom line is that I needed to go out of my way because of the pain and spend more money to ease the pain I was experiencing. I went out and have proof of purchase to a beauty supply store that sells small scissors, the same ones that you would find at a nail salon when cutting your fingernails. I was easily able to cut the finger with the small sharp scissors to the point where it was not bending backwards and causing any pressure anymore. I am submitting the line item from my credit card statement and actual image of the product I purchased the following day. You can also see a comparison of the a similar size pair of scissors vs the ones the hospital should have used in my situation. Would you cut your own fingernails with the same pair of scissors designed to cut construction paper? I included backup photos of the proof after how it looked when i treated myself after.

I have informed XXXX, multiple times, that an item on my credit report from Collection Consultants of CA is fraudulent. The latest report number is XXXX ( Collection Consultants of CA account number XXXX ) and the item in question is for {$340.00}. Both XXXX and XXXXredit Consultants of CA have been notified, in writing, with a letter provided by the Federal Trade Commission ( XXXX ) that the {$340.00} account is a result of Collection Consultants of CA fraudulently obtaining my personal information. XXXX claims to " verify '' the debt, but all they do is ask somebody else if the information is correct and the other person says, " Yep, it's correct '' and then they close the dispute. We've already established that somebody else has my personal information. Yes, Collection Consultants of CA have my personal information. Repeatedly asking them if they have my personal information isn't verifying anything other than they have my personal information. I have requested, in writing numerous times, that XXXX and Collection Consultants of CA provide actual proof in the form of a signed and dated contract for the {$340.00}. They have yet to provide this evidence. They have specifically been requested to send me copies of " Signatures on application and accounts '' through the official letter provided through the Federal Trade Commission. They have yet to do so. Also, XXXX keeps requesting that I call them even though I have told them, numerous times, that I do not speak on the phone and that I'm available through text, email, or US mail. They have now blocked my access to information with a statement that I must call them. When I questioned this the hospital sent the bill to Collection Consultants even though I was paying them. They just stopped sending bills then Collection Consultants sent me a letter demanding the payment in full. I called. I told them I was investigating the charges and that I needed them to send me a copy of their HIPPA compliant agreement with the hospital, a copy of their assignment, and an itemization of the bill including anything that I authorized. They never provided this information. They never validated the debt in accordance with the Fair Debt Collection Practices Act. I did pay them only because I did NOT want it to go on my credit and I was assured it would be removed. The representative said at the end of my XXXX payment plan it would be removed from my credit. This did not happen. They deceived me and did not validate it. The item in question was a medical debt that was processed by the debt collection company 's client. Insurance for this medical claim was covered via XXXX and is being corrected by the hospital, but Collection Consultants is refusing to follow California law which states as follows : Welfare and Institution Code, Section 14019.4 ( e ) If a patient provides proof of XXXX eligibility to a debt collector, and the debt collector fails to notify the provider of this proof, the provider shall not be responsible for ensuring that collection efforts against the patient cease pursuant to subdivision ( d ) until either the patient or the debt collector provides the provider with proof of the patient 's XXXX eligibility. I have a mutual child not by marriage and by the Court of California he needs to pay child support and also all medical costs for our mutual child. His child that is not mine injured our mutual child the police were involved but I did not press charges, and because of the result of the injury our mutual child needed to visit the ER and after she got out of the ER her father said that he was going to pay for the medical bill. Which he did not pay. By court judgement he needs to pay for all of her medical. Collection Consultants of California has unlawfully placed collections under my credit reports for debts that were paid to XXXX though a lawsuit and the court of law. I do not owe nor am I responsible for any debts placed against me as the court of law is handling an accident case which resulted in me being compensated for injuries and and physical damages and all medical expenses were included in the suit and I am not responsible for them. This company has used harassing and aggressive tactics to contact me at nights using robotic machines and leaving voicemails and threats of lawsuits on my cellular phone and on the phones of my family members and I have had to change my cellular number. Please investigate their unlawful collection practices and their unlawful placing of debts on individuals accounts without proper verification or providing any paper work of debts owed. XXXX XXXX is in possession of all legal forms and case numbers filed by my attorney which places this debt in the hands limousine company that caused my injuries. They are insured and have covered the costs with XXXX through a lawsuit judgment. I will challenge and respond until they remove the illegal debts from my name. This is regarding previous complaint number # XXXX. Collection Consultants of California offered a pay for delete to resolve medical collections as a remedy for disputed collections. I believed this issue was resolved, but there are still 2 collections from Collection Consultants of California that remain on my credit report. One account is being listed on XXXX, and the other is being listed with XXXX. I contacted Collection Consultants of California and spoke to XXXX. She advised me that there was an error made, and that the amount of {$1300.00} was additional and should have been included in the previous complaint. I expressed to her that I thought this was totally unfair and that I thought the previous complaint resolved any open collections. She apologized and stated she could make an additional offer to delete. I did not want to comply because I felt that I was being mistreated. I recently contacted Collection Consultants of California again to speak to XXXX, on XX/XX/XXXX and XX/XX/XXXX and was told she was not available. Both times I was advised that a message would be taken and given to her. I still have not received a return call from her. These medical accounts have affected me negatively for a really long time and I don't feel I deserve this, especially since I did have insurance at the time of the billing. I have repeatedly tried contacting and disputing XXXX collection which were placed against me which are not valid. Items # XXXX and # XXXX need to be deleted from my credit reports. On XXXX/XXXX/15 I sent a complaint and a dispute to Collection Consultants of California regarding XXXX previously invalid collections placed against me. They continued to leave machine recorded messages and text messages on my cellular phone regarding this debt that i supposedly owe them and I have had enough of their unlawful tactics. I have not even received the required partial response within 15 days after my initial CFPB complaint adjacent them. These items, which I have disputed since XX/XX/XXXX with them and the bureaus are still reporting on my credit files and that is not legal. They are ignoring my disputes and have not sent or validated the debts nor have they responded to my requests to stop communicating with me. I have waited for any verifications through the credit reporting bureaus and have received nothing. I have been speaking with representatives over a course of a couple of years. Most recently, I decided to call and speak with someone about getting these accounts taken care of. There was a delay because there was some accounts that they had that needed to be retracted/deleted by the original creditor. I ended up speaking with someone that gave me a total of a certain dollar amount over {$700.00} to pay in order to settle the account for deletion. She gave me this option with either removing all interest or giving me a 25 % discount, which equated to almost the same total. She said this would both resolve the account and result in deletion from my credit report. Between that conversation and the one that I had today, I called and attempted to settle for less ( understanding there might not be a deletion ) and was told they could n't accept only that. So I told them I would continue to get the rest of the total that was originally requested from me because I wanted the deletion. I finally got all of the money together and called back only to be told by someone else that paying this amount would not result in deletion, only showing account as paid. This does not make sense to me that a company is able to be so disorganized, that different reps are able to give different rules. Now I am being told that there 's no way to get rid of all interest or there can be no deletion.

I had XXXX bills from XXXX that i did n't know about at {$100.00} a bill ; XXXX of those bills belonged to my ex girlfriend ... i contacted collection consultants to resolve the issue and they told me that i could n't resolve XXXX of the bills because there was a third party involved so i told them that if it 's on my credit report then i should be able to handle it otherwise they need to remove it from my credit report. I have continually asked the bureaus to remove two accounts from this collection agency that harasses myself and my family. They create fake accounts without validation and proper handling of disputes and they are all over the internet scamming people. I have disputed this account many many times and sent over my medical information with no response except more calls and voicemails. I was unexpectedly hospitalized in XXXX of 2015. While I work and have medical insurance, I have a XXXX child with limited income. I submitted a financial assistance packet for review to the medical billing office of XXXX XXXX XXXX XXXX for the hospitalization bill. It was reviewed, accepted and the account was closed and settled in full. During the process XXXX XXXX XXXX XXXX had sent the bill to Collection Consultants of California, and retracted it the same day. I have called Collection Consultants of California and notified them that the account was settled in full. I have also provided CCC with proof of this via fax ( with confirmation ) of my notice of account settlement letter from XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX has called them twice on my behalf in an order to close out the account. Collection Consultants of California has continued to harass me regarding the debt, they have not properly closed the account although it was settled in full. They have now sent the debt to my credit report to negativity affect my credit. They are unlawfully harassing me, and will not remove the account from their files although it was paid in full. Keep receiving calls from collection company about a medical bill I have no Idea off what its for never received a bill from the medical facility or an explanation of benefits from my insurance. I have asked over 10 times to please send me a bill and itemized statement of what this is for. They keep calling and telling me the balance owed is more every time they call and they I will continue to be charged interest. I tell them I do not know of this bill and to please send me an itemized statement and invoice. Collection Consultants is reporting a medical bill on my credit. I discovered it when I applied for a mortgage. I have never been contacted by Collection Consultants. They have NEVER made any attempt to validate this debt. They are not allowed to report on the bureaus until they have validated the debt per Fair Debt Collection Practices Act ( federal and state ). I have had a medical expense from an emergency in XXXX. We had negotiated with the insurance ( XXXX ) at the time and had assume the matter was settled. I was surprised to receive a letter n XX/XX/XXXX that the insurance refused to pay certain amount and the hospital is now looking to recover that cost. I no longer have XXXX and is very hard to coordinate on why the insurance declined to pay as i had already met the deductible for that year. Eventually this debt resulted in the hospital transferring to a debt collection agency who was making repeated phone calls. They had also increased the debt amount tacking on additional interest. Last XX/XX/XXXX, I sent this company a copy of my FTC ID THEFT REPORT, a copy of my dispute letter requesting them to remove erroneous accounts due to fraudulent account opened on my credit report. On the letter I sent to this company, I quoted the stipulations of FCRA 605B which state that " a reported fraudulent accounts, with proper required documentation, MUST be removed within 4 business days upon receipt ''. A collection agency has attempted to seek payment under a medical billing without proving they have a right to collect the debt. Collection consultants is reporting 3 medical collection accounts on my credit report. I contacted them because they have NEVER contacted me. I asked for evidence that the debt was mine. They refused to give it to me and insisted that I give them my social security number, where I work etc. I finally got out of them that these accounts are very old but they would not tell me how old. I believe that they are over 7 years old and should not even be on my credit per FCRA. I am 100 % positive that they are over the statute of limitations ( CA Civil Code 337 ) yet they threatened to sue me when I would not give them my work info. They are also re-aging the account. They show that the last activity on the account is older than the opening date of the account. Lastly they made absolutely no effort to validate the debt and still won't give me the information necessary to even determine if these are or ever were valid which is a violation of FDCPA.

I initially called the company Collection Consultants of California to dispute the accuracy of a single derogatory remark on my credit report. After I disputed this information, the company then listed XXXX other separate remarks for various amounts on my report. I called to try to pay the amounts that are listed on my report and they said that it would n't matter because I have many amounts that are due to this company. Not only are some of them over XXXX years old, I 've contacted the originator of the claims. If these are all debts from XXXX creditor being sent to XXXX collection agency, they should only be listed on my report once, not four times. I have 5 debits listed that continue to change listing dates. There is an account listed on my XXXX report from Collection Consultants. My main issue with this collection agency is that they keep changing the date of delinquency to fit within the 7 years so that this account can keep reporting. I sent certified mail requesting that my account show proof that my medical insurance was billed by XXXX hospital for my visit on XX/XX/2015. Collection Consultants of California. I asked them to remove the old medical debt on my record because it violated HIPPA and it was beyond the statute of limitations to collect. They still tried to collect on it. I told them they could no longer do that and asked them to remove the debt. They refused. They, in turn, have updated my credit report stating the debt is only a month old, when the credit report shows they opened the account back in 2013. They have also stated they could not get a hold of me, when they wrote to me with my new address. I have all documentation. It is illegal what they are doing.
