In 2019 COLLECTION AT LAW A.P.C. in XXXX XXXX CA sued me on behalf of XXXX XXXXXXXX XXXX XXXX XXXX, now keep in mind, I have never served one single shred of documentation ; not from the bank, not from the lawyer, and later on in the process not even given the employee instructions '' by my employer ( headquartered in another state, MN, 3000 miles away ) within the 10 days from receipt of the order to begin garnishing my paychecks, as the papers instruct the employer to do in BOLD italicized form, as to make sure not to disregard this part of the order, so an employee can take immediate action to defend against the levy. Upon realizing my paychecks were noticeably lower, I reached out to HR asking questions about the newly added garnishment deduction on my paycheck. My employer, ignoring my numerous requests to provide some sort of explanation on what was going on, continuously ignored my pleas, being 3k miles away, I couldnt just walk in and ask ( I work remotely ) so I went to the head of accounting and finally, after more emails asking this person for answers he oddly, provided me with an email with the employer instructions '' NOT even MY instructions ; although by this time wages are already being levied it would have been nice to have had the forms I should have been given by my employer before garnishments began to know what one does in this situation if one were given the paperwork they were to be given and the very least just to know what options I did have and go from there. But without my documents on how to proceed in fighting a lawsuit, you never knew existed because the account/credit card and debt were all due to theft, therefore I understandably had no idea whatsoever about any charges against me until 25 % of my paychecks were being garnished and unlawfully being paid towards a debt I never knew existed nor was told the debt was going to the courts, NOTHING! Regardless with funds already being taken and it now too late to defend my wages, I at least did get the case number from my employer sending me their own instructions to illegally take my money ; so I did research and found that first I should file an exemption which was what I was to do if I had been served by employer properly, so I did, and then the lawyers in the case opposed my exemption saying I was lying in a roundabout way and because my expenses were higher than my income I was certainly not exempt because I must have income from elsewhere that I wasnt filing in my exemption forms. They ( the lawyers ) claimed I must be lying because I have no debt. First of all, I do have debt, I owe family and friends and secondly, my monthly expenses exceed my income because they are taking the income that I would normally use towards my monthly bills. I spend nothing on entertainment etc and to have some law firm who knows absolutely nothing about me make these claims is ridiculous. Not only that to say my monthly expenses exceed my income IS THE DEFINITION OF EXEMPT!!!! Now being that they opposed my exemption claim and lied again under oath, I have to go to the hearing and explain this to a judge. Thats fine but first I want them to prove the debt is mine, where is the contract I am being sued upon? What rights do they have to take action against me? Where are all the documents showing my signature and the proof the debt belongs to me? If I were notified properly at any point in time in the case these are things I would ask because it is my right to ask, and it is also my right, as a victim of identity theft, to ask for the same information as to how, who, where, when, and by whom the credit was issued to and where the debt took place and how it is proven to be mine. I want these things because I was never given any of these documents and I know this is all on account of thievery and fraud. The bank had no right to appeal a credit card to someone under false pretenses and when the thieves ditch out on the debt the bank takes matters into their own and lies to the court and claims they have proven the debt is mine and served me papers etc when nothing of the sort happened! Prove all of this to ME! Not the court, I want the case against me proven to me, the one who is under investigation and charged by default because I knew nothing about any of this! Of course, you win on default because I wasnt served, prove the judgment against me and prove the debt is mine and prove the authority lies with this law firm to sue me and prove I am in breach of contract by showing me the contract not an affidavit by someone 4k miles away claiming he remembered me and the contract! Prove it all or drop the case immediately!

XXXX XXXX, attorney -- Phone number XXXX XXXX XXXX Case # XXXX Limited Homeowners : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX CA XXXX XXXX XXXX, XXXX XXXX XXXX have a judgement against XXXX XXXX from XXXX. We are in the process of doing a short sale. This judgement is a lien on the subject property. Therefore, in order to close the short sale, we need a release that will remove the lien from the property. We sent in a request for a lien release on XXXX to XXXX XXXX, the attorney. We have been trying to get a settlement or a payoff demand from them since then. We have been calling twice a week. We have received nothing. Each time we call we are told a different story, and to call back in XXXX10 days. The attorney, thru his assistants, is at this point claiming to not even have a copy of the judgement, and is saying that XXXX XXXX of XXXX XXXX has not been providing it to him. XXXX XXXX and XXXX XXXX are forcing this property into foreclosure. They have had ample time to respond to the lien release request and we are simply running out of time. The foreclosure date is set for XXXX/XXXX/XXXX. The lender will not give a further extension. Both XXXX XXXX and XXXX XXXX have likely violated both state and federal law, as they are refusing to verify this debt. This is going to cause undue harm to the homeowner and everyone else involved in the sale of the property. Please see call log to the attorney 's office below ... ... XXXX/XXXX/XXXX - Lien Release request was faxed to the attorney 's office per the fax number the assistant gave me over the phone. XXXX/XXXX/XXXX - Gal that answered the phone said she would get the request to the attorney who will forward it to the client for their response. XXXX/XXXX/XXXX - Assistant said the request is with XXXX XXXX XXXX XXXX XXXX and the attorney is waiting for XXXX to respond. XXXX/XXXX/XXXX - assistant said to call back Friday as they are working with their client XXXX XXXX XXXX to gain clarification XXXX/XXXX/XXXX - assistant said the attorney is waiting for XXXX to validate some things on their end. XXXX/XXXX/XXXX - Assistant said the attorney is still waiting for XXXX to validate some things on their end. XXXX/XXXX/XXXX - had to leave a voicemail for the attorney. Assistant said they could not discuss the current notes. XXXX/XXXX/XXXX - Assistant said the judgement had to be ordered and the attorney was working on it now. The attorney expected to have an answer to the release request tomorrow ( XXXX/XXXX/XXXX ). XXXX/XXXX/XXXX - Assistant said the process server claimed the judgement was in todays delivery but it was n't. The assistant said they would have XXXX XXXX email it to them on a rush and they would have it by tomorrow XXXX XXXX/XXXX/XXXX XXXX. XXXX/XXXX/XXXX - 1st phone call I was told to call back in 20 minutes XXXX/XXXX/XXXX - 2nd phone call I was told to call back in 1 hour. XXXX/XXXX/XXXX - Today the attorneys office is claiming that XXXX XXXX never imaged the judgement in, and therefore someone would have to go down to XXXX XXXX and pull a copy of the judgement. I want a payoff demand and a response to the lien release request immediately.

XXXX XXXX is using collection at law inc. A.p.c./ XXXX XXXX XXXX XXXX bar # XXXX ) to sue me and has been non negotiable for the last XXXX years. I have XXXX in debt that I was unable to pay during covid, as I faced over an entire year of pandemic unemployment and for a half a year previously due to work related XXXX XXXX injury, and 2 forced home relocations during pandemic and riots in XXXX XXXX . I attempted to negotiate hundreds of times over these 2 years since account closed, mostly with no answer, or weeks in between answers, answering machines, zero returned calls, constant denied extensions and offers. They offered to settle in 2019 for 12500, or XXXX per month, which I did not have at that time. Hundreds of calls and offers to them later, they then said I could settle for 18k which I was going to pay lump sum after receiving my worker comp settlement, but had to pay doctor, medication, and moving costs to move again unexpectedly during covid and was then again unable to pay that 18k lump sum. They then said my payment plan would be set at XXXX month, with no ability to negotiate anymore, which I just can not afford. I feel like this had been years of abuse and neglect, as I wanted to pay them but in a rational livable way. I asked to settle again for their previous offer of 12500 or XXXX per month and was denied by the bank directly and by the lawyer they use. Now I am served and have to face court in XXXX, for a debt ive been trying to pay, while suffering from this work related XXXX XXXX, having severe XXXX XXXXwice, 2 relocations in XXXX years during pandemic and riots, unemployed for a year, no family support or significant other. I have no money for a lawyer and the stress of this lawsuit along with the fear of poverty and continued strain on my health is extremely damaging. The lack of compassion and neglect during covid that this bank and lawyer have shown is inexcusable and this cas should be thrown out completely.

Hi, I used to have a payment plant that I couldn't continue with that lasted from XXXX for XXXX XXXX monthly payments. I attempted to settle with XXXX XXXX Attorney with no luck. I called XXXX XXXX Attorney 's office on XX/XX/XXXX XXXX XXXX, called back on XX/XX/XXXX, XX/XX/XXXX and there after three other times that I did not write down date or time. My work has now received wage garnishment summons without previously ever properly served or at my place of employment. This summons currently says I owe {$9600.00} plus {$35.00} sheriff 's fee. I am at a lost for words, can't sleep, I am stressing over this matter. This amount seems ridiculous as interests were 24.99 % and no minimum payment was ever going to help pay this credit card debt down. In one of my many phone calls I attempted to settle for different amounts starting @ {$3500.00} going all the way up to {$5500.00} which is more that half of this total amount. Please help. I've been hearing XXXX XXXX is defrauding so may people and just because they have money they continue to do so. i wage garnishment or XXXX knows how much or let alone pay XXXX XXXXXXXX in mostly interests on this fraudulent credit card going back to early XXXX, right before Covid-19. Covid-19 impacted many of our lives and including mine, by not working for the first few weeks of this start. What should I do?

I wanted to open a checking account with XXXX, but it was denied. the XXXX bank gave me a letter stating that i had to contact the Bureaus. that is when i decided to check my credit and it had dropped from being at XXXX XXXX, XXXX XXXX, XXXX XXXX to the XXXX 's I called the Bureaus in regards to my credit report being a Victim of Identiy theft, they requested a Police Report, Which i did fax over. Asking them to fix my credit report and restore my Scores back .. i have not being helped. this issue is keeping me from having a Normal life. I Need Help Please. Thank You ..

The debt collector, XXXX XXXX, repeatedly harrassed my ex wife and contacted her neighbor to find me, unbeknownst to me. They eventually drop served the papers at her house after repeatedly told that I have not lived there for over a year. They said " we know he lives here a, private investigator told us he lives here. '' They sent a summons after I was served to her house after I was served too. The debt is XXXX. I was seved on XX/XX/23 but my ex did not give me the papers until XX/XX/23 and I got my summons on XX/XX/23.
