On XXXX XXXX, 2015, I moved out of my apartment at XXXX XXXX XXXX at XXXX XXXX XXXX XXXX in XXXX, CA. Upon notifying the Assistant Manager, XXXX XXXX, that I would be departing ( over 30 days in advance ), I scheduled a pre-move-out inspection, citing my desire to spend as much time as necessary cleaning the apartment before handing over the keys so as to receive as much of my security deposit as possible. XXXX conducted this inspection herself. She noted that there would be some basic touch-up painting needed but that so long as the carpets were shampooed and everything was cleaned and dusted, I had no reason to expect any surprises. I was assured that I could expect the bulk of my {$500.00} security deposit returned and that I would receive a copy of the notes, but the notes were never provided. I moved all my belongings out and then spent two days cleaning, dusting, shampooing the carpets, etc. for an apartment that I was only in for seven months and that was originally leased to me with junk in the cabinets, food stuck to the floor and dust everywhere in sight. I even paid a professional cleaning service {$100.00} to assist me with cleaning before handing over the keys ( I still have the receipt ). Once everything was moved out and cleaned, I went to the front office for a final move-out inspection. This time, no permanent staff members were available. The woman that did the inspection told me she worked for the parent company, XXXX XXXX, and she stated that it was one of the cleanest apartments she 's ever seen during a move-out inspection and that I should have no problem getting my security deposit back. I reviewed her notes and I agreed with everything she wrote. I asked for a copy of this and I was told I would receive one in the mail soon. I never did, but two to three weeks later I was notified by XXXX XXXX that I would not be receiving any of my security deposit back and that I owed them {$97.00} on top of it. The notes included a map of XXXX stains on the carpet that were entirely inaccessible to my emotional support animal because my large sectional couch and my queen-sized bed completely covered the majority of the areas listed and she was crate trained. The documentation provided the notes of the employee that performed the final move-out inspection, but something was added that was not there before, and it was in completely different handwriting. It stated, " STRONG XXXX SMELL. '' There was never any mention of XXXX during either of the inspections. Additionally, XXXX XXXX, also from the parent company, admitted in writing that a mistake was made calculating the painting fees and thus reduced the amount owed by {$50.00} from {$97.00} to {$47.00}. XXXX XXXX XXXX also charged a {$40.00} deposit for a gate opener ( clicker ) for the entrance and refused to return that to me, stating that they had no record of my deposit and determined that the only explanation for this was that they must have given it to me without charging me and that without a receipt, they would not return that deposit either. They informed me of this after I already returned the clicker, so I essentially paid for it and and they got to keep it. I stated that this type of management was unacceptable and that I would be taking them to small claims court over the security deposits. After some time passed, I determined it was not worth the time and stress to pursue it. Several months later, I noticed there was a derogatory mark over a collection on my credit report. The amount totaled over {$100.00}, which was higher than even the original amount owed ( {$97.00} ) and much higher than the " adjusted '' amount, provided by XXXX XXXX ( {$47.00} ). I was never notified that this would be submitted to collections and end up on my credit report nor was I notified when it was submitted to collections and it appeared on my credit report. It was not even listed at the correct amount. I later needed help my girlfriend get an apartment and was informed by her complex that I would not be able to sign a lease until I could provide them proof that I paid Collectibles Management Resources in full. Upset, I went to Collectibles Management Resources, who charged even more than {$120.00}. I paid in cash and received a receipt to send to my girlfriend 's soon-to-be property managers. Nearly a year later, this still shows as open on my credit report.

COLLMGMTRESO ( Original Creditor : XXXX XXXX ) contacted me attempting to collecting on a debt that I have never contracted or agreed to pay them. The rep said I owed them the debt even though I had not contracted to pay them because they purchased the debt from another company. I told the rep I would not be paying on a debt that doesn't belong to me and I think he/she may be calling the wrong person. I also told that rep I would be sending in a debt validation letter to validate this debt. The rep continued to call me everyday for the next couple weeks, leaving me threats on my voicemail. They also began to contact me by mail shortly after the first call I had with that rep. After them harassing me for this debt they started to report negative and defaming information on my consumers report about this account. Upon checking this account I noticed COLLMGMTRESO ( Original Creditor : AMERICAN AMBULANCE ) reported multiple inaccuracies on this account to only one main credit reporting agencies which is XXXX. Additionally, I am allowed under the HIPAA law ( Health Insurance Portability and Accountability Act of 1996 ) to protect my privacy and medical records from third parties I don not recall giving permission for COLLMGMTRESO ( Original Creditor : AMERICAN AMBULANCE ) to release my medical information to a third party. I immediately thought to myself this account was not handled with accuracy or integrity due to the number of inaccuracies within this account. When I noticed the account on my consumers report I sent COLLMGMTRESO ( Original Creditor : XXXX XXXX ) a debt validation letter which I have attached to this complaint. COLLMGMTRESO ( Original Creditor : XXXX XXXX ) never responded to the letter. Since they have never responded to the letter or supplied me with sufficient information in order to validate this debt, I know the debt is a mistake and not mines. I don't not feel like my account was handled with accuracy and/or integrity. Therefore, with respect, I am challenging the accuracy and integrity of this information. 12 CFR 1022.41states ( a ) Accuracy means that information that a furnisher provides to a consumer reporting agency about an account or other relationship with the consumer correctly : 1 ) Reflects the terms of and liability for the account or other relationship ; ( 2 ) Reflects the consumer 's performance and other conduct with respect to the account or other relationship ; and ( 3 ) Identifies the appropriate consumer. 12 CFR 1022.41 ( d ) also states Integrity means that information that a furnisher provides to a consumer reporting agency about an account or other relationship with the consumer : ( 1 ) Is substantiated by the furnisher 's records at the time it is furnished ; ( 2 ) Is furnished in a form and manner that is designed to minimize the likelihood that the information may be incorrectly reflected in a consumer report ; and ( 3 ) Includes the information in the furnisher 's possession about the account or other relationship that the Bureau has : ( i ) Determined that the absence of which would likely be materially misleading in evaluating a consumer 's creditworthiness, credit standing, credit capacity, character, general reputation, personal characteristics, or mode of living. Due to the number of inaccuracies within this account which I have highlighted in the image below in the attachment section I know this debt is a mistake and shows this account was not handled with accuracy or integrity. As you can see For account XXXX there is inaccurate account numbers, date opened, balance, high credit, last reported, and date last active reporting to the one credit reporting agencies. Please remove this account from my consumers report. Due to the inaccuracies of this account only reporting to one credit agency, and not to all three credit reporting agencies. The information upon this account have gotten me denied loans that I would have been approved for had this account have been handled with accuracy and integrity. In XXXX of XXXX, I received a letter for collecting debt from Collectibles Management Resources. On XX/XX/XXXX at XXXX a.m. I called the agent named XXXX XXXX. I asked him what this debt was about and he told me the creditor was XXXX XXXX XXXX and the amount due was {$1.00}, XXXX. I told him I was unaware of the debt and had no idea I owed this company. He said he would send me the invoice from the vendor and he did so, the invoice included date of service and individual being tested for a XXXX XXXX screen. The services provided were for XXXXXXXX XXXX screen collections only. I explained to him that I needed more detail from the individuals being tested, I needed authorization of service, customer service was provided for as well as what type of test. I tried to call the clinic themselves to obtain this information myself and they refuse to do so since the account was in collections. The phone call that I made to the clinic was on XX/XX/XXXX at XXXXXXXX XXXX and spoke with a XXXX in accounts receivable. She told me she will send information to the collection agency that I am requesting that she had no way of obtaining the information because everything has been archived. I also asked XXXX to make some corrections to some errors on some invoices at that time as well she said I needed to explain everything to the collection agency for correction. I did eventually there sometime after receive copies of the authorizations and testing types along with the company. Unfortunately I did not have any of this information in my database for accounting nor my drug testing software. Majority of these tests were conducted in XXXX, XXXX and XXXX. At this point I could no longer Bill my client for these services since they were so far dated. In conclusion after going over the invoices I found several errors as well as inconsistencies that needed to be corrected. However shortly thereafter visiting this claim of debt due to the covid-19 pandemic are facility shut down. Therefore I have not heard from this collection agency until recently regarding this claim. The reason for my complaint is that the individual XXXX XXXX has over stepped his boundaries as a collection agency he has made numerous phone calls to people affiliated with me asking for me. This debt is a business debt and should be only addressed to myself or my business. He has called on XX/XX/XXXX my daughter who lives in XXXX California as well as on XX/XX/XXXX he has called my ex-husband of XXXX years past. As well as on XX/XX/XXXX he is called my current husband 's sister to whom we do not speak, and left her a message stating who he is and what agency he's from with a phone number. He is also called my husband 's place of employment as well as his cell phone which has nothing to do with my current company. He is abusing his power of having knowledge of affiliates with my name and harassing me by letting other people know that there is a pending debt in a collection agency from my company, this is in violation of my rights and I believe this individual needs to be reprimanded. This company 's consistent violations of my consumer rights under the Fair Debt Collection Practices Act have caused significant financial and emotional distress They continue to report an erroneous and unverifiable account on my credit report, despite my repeated requests for proof of claim as required by the FDCPA My efforts to rectify this situation have fallen on deaf ears. I was recently denied an auto loan due to a debt collection from Collectibles Management Resources appearing on my credit bureaus. Apparently the debt was placed on my credit bureaus in XXXX and I never received any written correspondence. The collection company violated the FDCPA by not providing a validation notice, not providing me an explanation of the debt, and not allowing me to dispute the debt. I requested information, and Collectibles Management Resources sent the attached letter dated XX/XX/XXXX that does not follow FDCPA guidelines.

This creditor is trying to collect for a account from the year 1995 and is still trying to resue me and has stated that they have proper response to serving me the acct info and that isn't true because I have never received any paperwork on this acct.
