Hello, I am making a complaint against Clear path lending, in part on the sudden denial of my pending mortgage refinance. I contacted Clear path lending in the end of XX/XX/2020 to begin the process of refinancing my house in Virginia. Mr. XXXX XXXX was put in charge of my file. From the first phone call he had a very cordial attitude and was more than helpful to explain the process. I filled out and signed the various documents that were provided, including the " Wet '' signs that had to be signed and then scanned in. I had various questions but I did not have to pay anything upfront, and all I had to do was provide various documents. This went on in a weekly process in the first weeks of XX/XX/2020, they would send a form and I would either electronically sign it or acknowledge the from and send it back. When it got further into the process, I was asked for " insurance '' information. I had to wait a few days to get the information from my mortgage carrier. I provided clear path with the information when I received it. Mr. XXXX made a single comment about my " lender '' placed insurance, and I told him that I don't have the money to " replace '' my roof, which is not bad but it is a odd rule in Virginia that " all roofs on all houses must be replaced every 20 years ''. I told him that I don't have {$4500.00} to put a roof on my house but it doesn't leak and is in usable condition. He said nothing about cancelling or stopping the process. He and I continued forward on the process. After I sent the last paperwork in, I was told that the loan would " Fund '' in the end of XXXX and that was " good to go ''. The week of the XXXX of XX/XX/2020, I received a phone-call from a woman in clear path lending that informed me that the process was stopped and that the entire process is being cancelled because of my having lender insurance, I informed her that i had worked this out with XXXX ; he told me it was not going to be a problem and that i have nothing to worry about and that the process will move forward. I repeated that to her and she said that there is nothing she can do, that until i replace my roof and get private insurance that the process is cancelled. I pleaded with her to find a way around the issue, and i stated that if this is such an issue then why did it take this long to determine that clear path can not refinance my house. She stated that she did not know the answer. After this phone call, to add insult to injury-i received a " loyalty package '' in the mailbox, of which i take great offensive to because of how i was treated in the final days of trying to refinance. I was marginallized, the failure of the process was made to be my fault and no one would lift a finger to find out why, after a month of positive progress, the process suddenly stopped. As a final insult, i recently received a borrowers determination letter in the mail. In the letter it states the " Borrower, withdrew application ''. That is a lie and blatenly false. I DID NOT WITHDRAW ANYTHING, I WAS CANCELLED AGAINST MY KNOWLEDGE AND THEN TOLD AFTER THE FACT!!!!!!!!!!!!!!!!!! As a side note to this entire process i now have a " Hard '' inquiry on my Credit report and i now have a " withdraw statement '' in my credit history. Clearpath lending is predatory, and does not tell people the entire story, before beginning a loan processing application, and then cancels with no warning. I was lied to, and manipulated with Blatent false advertising and even more false promises by XXXX XXXX and XXXX XXXX. I need attention brought to light on deception and bad buisness practices and outright lies and manipulations of a potential customer, and along with this process i spent {$11.00} to send a form " faxed '' to XXXX XXXX, of which i asked about being reinbursed for my {$11.00} i had to spend to fax a signature. I was ignored-So not only do i have the issues described, i am also out {$11.00}.

I currently have a VA mortgage loan with XXXX XXXX. In early XXXX, 2019, I contacted Clearpath Lending about refinancing my loan. I began working with Mr. XXXX XXXX, a branch manager at Clearpath. I was offered the rate of 4.125 % to refinance. In mid-XXXX, an employee of XXXX XXXX, contacted me to notify me about the VA streamline refinance. He informed me that XXXX XXXX could offer me a rate of 3.875 %. I decided to take this offer. On XX/XX/XXXX, I emailed Mr. XXXX to inform him that XXXX XXXX had made me a better offer, and I was going to accept it. Mr. XXXX emailed response seemed to indicate frustration, as he urged me to do more research on XXXX XXXX, and chided me for falling for this bait and switch. He stated that he would cancel the loan, and his manager XXXX would get in touch with me, as Mr. XXXX was currently on vacation out of town. I replied that I had done my research, and when I analyzed the numbers, it was clear that XXXX. XXXX offer was the better one, but, if Clearpath would be willing to beat XXXX. XXXX offer, I would be willing to listen. Mr. XXXX next emailed response was Thanks buddy what an XXXX XXXX guy FYI. I emailed back Are you referring to me? to which Mr. XXXX replied Sorry wrong person Im on vacation at a beach and then No apologies going back and forth with both work and personal emails on my phone I just replied to your email. In the next email, Mr. XXXX continues to discuss the possibility of a loan with Clearpath, emphasizing the risks taken by Clearpath in offering me an extended lock for 60 days, and their commitment and loyalty to their customers. The last email I received from Mr. XXXX was a profuse apology, in which he attempted to assure me that his XXXX XXXX guy comment wasnt about race, but instead, The email was meant for my manager and we always email a description of the borrower Male, Female, XXXX XXXX XXXX speaking old or young so management can get a better idea of who they are speaking with. Mr. XXXX also stated that his manager, XXXX, would call me the next day in regards to what we can do to make this right. Mr. XXXX also stated that he had been suspended, and the president of the company had gotten word about this situation. The next day, I received a call from Mr. XXXX XXXX. Mr. XXXX identified himself as Mr. XXXX manager, and basically reiterated Mr. XXXX emailed apology, and stated that the president of Clearpath authorized him to extend to me an offer of 3.25 %, to make this right. I told Mr. XXXX that I would consider this offer, and call him back later. When I called him back, I reached his voice mail, and his recorded voice mail greeting stated that, in case of urgent matters, call his manager, XXXX XXXX. Needless to say, this entire situation has left me shocked and appalled. Until the time that I mentioned to Mr. XXXX that I had shopped around and found a better offer, I felt that we shared a good rapport. What other provocation, if not racism, would cause Mr. XXXX to so quickly resort to name-calling, referring to me as an XXXX in the email that was intended for his coworker? Is it possible that Clearpath has an internal policy of identifying their clients using ethnic, gender, and age-based descriptions? Was the president of Clearpath really notified, and Mr. XXXX suspended? Or did Mr. XXXX and Mr. XXXX devise this plan to mitigate any damages caused by his egregious, inappropriate comments? In referring to me as an XXXX XXXX guy, Mr. XXXX clearly exhibits his disrespect for, and willingness to insult his XXXX-XXXX clients when things dont go his way. It also appears that Mr. XXXX was involved in this deceptive situation, which indicates a culture of dishonesty at Clearpath. For this reason, I am filing this complaint of misconduct against Clearpath Lending.

I have been receiving numerous direct-mail advertisements ( letters ) from ClearPath Lending , XXXX involving refinancing of my mortgage at 1.75 % .On XX/XX/2021, I responded to the letter by calling the listed number on the letter. I spoke to a mortgage representative ( XXXX XXXX ). He requested a copy of my current mortgage statement, home insurance, XXXX, and photo ID. I gave him over the phone my address, current amount owed on my home, SSN, and date of birth. On the back of this mailer is listed the qualifying criteria for eligibility to get this 1.75 % interest rate for VA applicants. It simply listed that you needed to have a FICO score of # 800 or better. Days later when I spoke to Mr. XXXX, about where I was in the refinancing process, he informed me that after checking the three ( 3 ) credit bureaus, I failed to qualify for the 1.75 % lowered interest rate because two ( 2 ) of the credit bureaus listed my FICO score in the upper 700 '' s. Only my XXXX had my score in the 800 's. I informed Mr. XXXX that I found this to be incredulous. I informed him that I would check my FICO scores personally. I then checked my scores with all three ( 3 ) credit bureaus and found that all my FICO scores were in the 800 '' s with all three credit bureaus. Thus, based upon the reading on the back of these letters which states, in part, that the interest rate applies to an 800 FICO score ( middle qualifying score ) or higher. My FICO scores were as follows : XXXX : # XXXX ; XXXX # XXXX ; & XXXX # XXXX. So, following Mr. XXXX explanation of what's a qualifying " middle score '', my middle score would be the XXXX FICO score # XXXX, which would qualify me for the lower interest rate. Hours later, I called Mr. XXXX again to inform him that he was in error, and that my FICO scores did meet the screening criteria for obtaining the lower 1.75 % interest rate. Then, Mr. XXXX began to give me this story that ClearPath uses a different formula for calculating a FICO score which makes no sense. If they were going to use their own criteria for determining eligibility then why the need to consult with the three credit bureaus. He stated that they calculate what they call a " mortgage score. '' I stated to him that this is not what is stated on the mailed advertisement that was sent to my home. I further stated that I believe that he and ClearPath is using misleading, and inaccurate statements on the mailer to hoodwink me ( Veteran ) and others into responding to their letters. They now have access to my personal information and they have misrepresented the criteria for qualifying for the refinancing credit terms of 1.75 %. I have requsted to speak with Mr. XXXX 's supervisor. He gave me a Mr. XXXX XXXX whose number is ( XXXX ) XXXX. I have called this individual several times and left messages and he has failed to return any of my phone calls at the time of this writing. Secondly, I requested that I be given disclosures outlining specifically why I was being denied the VA refinanced 1.75 % interest rate. I have yet to receive this information. Your help in this matter will be much appreciated.

ClearPath Lending is sending false and misleading offers to lower my VA mortgage. When I called to be removed from mailing they hung up on me. For example, the offer is to lower my VA Loan rate to 2.25 % Rate, 2.45 % APR for VA loans ; I know this is erroneous information from current VA loan rates. On XX/XX/2020, ClearPath Lending Inc entered into a Consent Order with the Bureau of Consumer Financial Protection. The order settles allegations that the business sent consumers mailers for VA-guaranteed mortgages that contained false, misleading, and inaccurate statements or that lacked required disclosures. The order alleges that the advertisements created the false impression that ClearPath was affiliated with the VA, misleadingly advertised rates or payments as fixed, even though the advertised mortgage was an adjustable-rate mortgage or the payment was not fixed for the indicated duration. ClearPath also allegedly misrepresented the existence, nature, or amount of cash or credit available to the consumer, and the existence or amount of fees or costs to the consumer, in connection with the advertised mortgage. Under terms of the order, the business agrees to pay a civil penalty of {$620000.00}. The order also imposes injunctive relief to prevent future violations, including requiring ClearPath to bolster its compliance functions by designating an advertising compliance official who must review its mortgage advertisements for compliance with mortgage advertising laws prior to their use ; prohibiting misrepresentations similar to those identified by the Bureau ; and requiring ClearPath to comply with certain enhanced disclosure requirements to prevent future misrepresentations. XXXX XXXX was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. Clearly they're not following the injunction. Secondly, I filed an opt out for firm offers of credit and insurance at optoutprescreen offers in XXXX of 2020. The offers of credit have all but stopped except from ClearPath Lending. This company is a menace and should be avoided.

The loan officer XXXX XXXX XXXX @ Clear Path Lending ) did not send a disclosure statement of our loan costs. Several of the documents were different from what we originally signed. Closing costs and fees were higher than what we agreed to. Fees were added to reduce points that I did not agree to nor was made aware of. The Loan Officer ( XXXX XXXX XXXX explains that I was informed of the fee and I signed a disclosure form. I was unaware of any fees associated with buying down points. My credit score is high enough that I do not need to buy down points. I further explained that I would have never agreed to buy points down on a loan because I am very frugal. As a Veteran this is a major issue and seems to be dishonest and unethical. Initially XXXX in XXXX XXXX I asked the loan officer for a break down of all the costs ( I asked for a disclosure statement ) and he explained that a disclosure would be sent at a later date. He also explained that only the final disclosure mattered and all others were just estimates. When XXXX sent the disclosure he had added {$3600.00} so we could buy down our rate to 2.25 %. I did not agree to buy down our rate. I was told that our rate was XXXX based on my and my wife 's credit score. My wife has close to an XXXX score and my score is XXXX or higher. His practices do not seem to be in alignment with what he told me. Lastly, I contacted the Loan Officer and left his supervisor XXXX XXXX a message that there were discrepancies on our documents. The Loan Officer emailed the disclosure documents at XXXX today XXXX. We should have received the documents 3 days ago. The documents according to the date ( on the disclosure ) were ready XX/XX/, yet, we did not receive them. The Attorney was here at our home at XXXX and presented us with documents that we have never seen. This is problematic and unethical.

On XX/XX/17 I emailed XXXX from Clear Path Lending to cancel the refinance. On XX/XX/ I received a call from XXXX XXXX to reconsider. I was emailed a 6-page proposal. I emailed back and canceled. XXXX XXXX called me back to ask me to reconsider and I said that I did not like this refinance because Clear Path Lending has raised my mortgage from {$400000.00} to {$410000.00}. I explained that was too high and asked why I am being charged {$13000.00} for a re-fi and thought that was too much. So, I said cancel. After I said that over the phone, a XXXX XXXX XXXX from Clear Path Lending came on the line to convince me that I would receive around $ 5000/6000 back. When he stated that I decided to go ahead with the re-fi. I called on XX/XX/17 and XXXX answered the phone and I asked when will I receive the $ 5000/6000. I asked to speak to XXXX XXXX. He said that XXXX was no longer working there. I asked about the money I was to receive and he stated to me where do you think that money is coming from. I told him about our conversation on XX/XX/17. He said he would call me back. He didnt call me. I called again today XX/XX/17 and told me he would call me back. He didnt. I never received the {$6000.00}. I would have never gone with this plan. I was tempted by the cash back. Also sent to BBB & FCC.

On Friday, XX/XX/2021 I received a phone call from a home mortgage originator company called ClearPath Lending. His name was XXXX XXXX XXXX, XXXX ID # XXXX. They are the company who did my last refinance on my house. He asked if I'd be interested in doing another refinance into a lower rate. I asked him how much lower would my payment be. He said he didn't have the details in front of him but would go look it up and call me back in a few minutes So, I said OK. A couple minutes after we hung up, I received a series of messages in my email that some company called XXXX XXXX had just made a hard inquiry on my credit report. I had never heard of them and I got scared I had become a victim of identity theft or something, so I was freaking out! A few minutes later Mr . XXXX called me back. I immediately asked him if he had just run my credit. He said yes. I told him he did not ask my permission first and I never wanted my credit run! He apologized and admitted that he did do it without permission and I told him to fix it. He said I'll get in touch with my manager and see about a gift card for you. I yelled at him, telling him I wasn't interested in his gift cards - I wanted the inquiry removed. He has done nothing to fix it yet.

I received a notice in the mail from ClearPath Lending regarding a refinance on my existing VA loan. On XX/XX/2020 I spoke with XXXX XXXX, Senior Loan Officer, NMLS # XXXX. She gave me additional information regarding the refi. She sent me an email which looked very unprofessional and like a phishing email. I replied to this email and XXXX stated the email was blocked. I then called Ms. XXXX via the number provided in the email and left her a voice mail stating that the email had been blocked. I then called the number for ClearPath that I found on the web and the person on the other end would not verify if Ms. XXXX worked for them. In addition, she would not connect me to a supervisor at the company. Ms. XXXX left me a voice mail on XX/XX/XXXX stating that " If I was paying attention to the market, there was an increase in the basis points. '' She stated that I should send over my documents and lock in my interest rate before it increased. She never mentioned the voice mail I left her two days earlier. My concern is that I gave her permission to view both my credit report as well as my spouse 's credit report. There were many red flags in my opinion and I do not want to be a victim of identity theft.

From XX/XX/2020 to XX/XX/2020 I have been receiving solicitation letters from a company called Clearpath. This company targets veterans to take out refinance loans at a lower rate. I contacted the company by phone and email and informed them that I was/am not interested in their product and did no/do not want to do business with them. I called and was told by a person at their call center that my name and information would removed from their database and that my personal information would not be sold or rented to any of their subsidiaries or any private companies or organizations. I made that call after receiving countless solicitation letters and calls from Clearpath prior to XXXX XXXX/2020. On or about the XXXX of XXXX 2020. After I emailed a complaint to Clearpath 's corporate complaint email address I received an response stating that the solicitation letters would stop. Well, I just received two more solicitation letters, one on XX/XX/2020 and one on XXXX/XXXX/2020, and in total from XX/XX/2020 until XX/XX/2020 I have received 11 solicitation letters. I WANT THESE BULLY TACTICS TO STOP!!!!! Can you help me. Thank you XXXX XXXX.

I replied to a piece of mail I received advertising a 2.75 % interest rate for Veterans. I called and initiated a refi ( aroundXX/XX/2020 ). I was told that since my credit score/salary information was high enough that I should remove my spouse from the application to get the lower rate. I received all sorts of documents about the refi that indicated everything was moving along just fine XXXX initial disclosures, estimates, closing disclosures ). Today I received a letter of declination stating that the reason was due to the inability to remove the spouse from the current loan because it is a VA IRRRL. In addition to my credit score taking a hit for the inquiry it has been a huge waste of time. I was told that I wouldn't be making a mortgage payment for XXXX and I agreed to not shop around for better rates. After calling today, I was told that the declination was because the investor is not refinancing VA loans where a co-borrower is being removed until " the covid-19 pandemic blows over '' How can that be a metric for any form of lending? Can you require a co-borrower when the principal borrower meets your lending requirements?

Around XX/XX/2017 I was contacted by Clearpath Lending in an unsolicited mail offer stating that I could use a VA backed refinance to lower my interest rate. They stated that I could use a hybrid loan that started at a 2 % interest rate with deferred payments for two months but that in 3 years the mortgage would convert to a variable rate and would increase by one percent per year to a maximum of 5 percent. They also stated that this would not happen and that I would have nothing to worry about. They tried to sell me that the markets would not be good enough to allow an increase in percentage. They also stated that the VA guaranteed that the loan terms and that the 5 % was a cap that the VA guaranteed. They used their VA loan number to assure me that they were legitimate and that I was getting a good deal. They were very vague with the terms of the loan and would not allow me to see any legal documents detailing the loan agreement before I signed the paperwork. I fear that any other veteran may have fallen for their promises and would be stuck in a predatory lending scheme by clearpath.

I received a flyer to participate in the VA IRRRL program from Clearpath Lending in XXXX of XXXX. I began the process to use the IRRRL program in XXXX of XXXX to decrease our interest rate from 6.7 % to 4.99 %. Because we closed on our current loan in XXXX of XXXX, we were told that we would need to wait until our 7th payment posted on our current mortgage which ocurred in XXXX of XXXX Starting in XXXX, I requested a rate lock multiple times with our lender. I was repeatedly told that upper management was refusing our request. The lender called me today and told me that they had successfully locked our rate at 5.6 %, over a half percent higher than we were initially told. This bait and switch is massively detrimental to my household and our financial plans. The lender has also repeatedly told us that we could skip up to 2 mortgage payments to help us get cash back in our pocket, which is specifically disallowed according to the VA.gov website.

This is a CONTINUATION of complaint # XXXX with XXXX and XXXX XXXX vs Clear Path Lending. As of today, XX/XX/2020, we have CONTINUED TO RECEIVE mailings from Clear Path Lending, despite all the steps that we have taken to have them cease and desist their onslaught of unwanted marketing solicitations!!!!! What can a consumer do??? It's unnerving, really! The waste and unmitigated gall that they have promised in writing to you that they will not contact us and lied and still continue to clutter our lives with unsolicited marketing is a real concern to me as to whether they have any regard for authoritative limits at all. We have said, " Stop '' ; you have told them to stop, but have they? Evidently NOT!!! Are they above the law and conscience? PLEASE, what can we do to STOP these people??? If they are doing this to us, they are doing this to millions of other VA home owners, bless their hearts, and they don't deserve that either. No Veteran does.

I'm not sure if I've arrived at the right location given the narrow scope of the wizard used on this site ; however, I wish to complain about the harassment I'm being subjected to by ClearPath Lending, XXXX XXXX XXXX, XXXX XXXX, XXXX, CA XXXX. I have asked them repeatedly to stop sending me solicitations for refinance of my VA mortgage to no avail. On XX/XX/2021, and on XX/XX/2021, I requested via their web site ( https : //www.clearpathlending.com/contact/ ) they stop sending me correspondence. Today, XX/XX/2021, I received yet another solicitation from them. Their offers mention the U.S. Department of Veterans Affairs and " Veterans Administration '' so I find them to be somewhat misleading as to their possible representation of the federal government. I request your assistance in stopping this harassment.

After purchasing a home with a VA loan my wife and I have received what can only be described as a harassing number of refinance letters from ClearPath Lending. We have never had any business dealing with ClearPath Lending and do not desire to. My wife and I both completed the opt out process at XXXX, as provided by the Fair Credit Reporting Act, on XXXX XX/XX/2021. CleapPath Lending has ignored our opt out and continued sending refinance letters. After giving adequate time for any letters already in the mail to be delivered we directly contacted them on XXXX XX/XX/2021. They agreed to stop sending letters. However my wife and I have continued to receive letters from ClearPath Lending, with the latest received today ( XXXX XX/XX/2021 ).

I am providing a copy of a solicitation letter I received from Clear Path Lending. This letter is VERY misleading and, in my opinion, exhibits an intention to confuse and concern the recipients. This letter implies that a loan has already been made at a previous time and that payments are coming due in the near future. It is very difficult to ascertain that this is a letter soliciting business and not a notice of payment on an existing contract. Is there anything that you can do to control the communication of these companies so that they are required to be transparent in their intentions? I generally just toss these in the trash, but this one was confusing for both me and my husband. I felt this warrants a complaint.

I received a letter in the mail for a 1.75 % VA XXXX loan refinance from ClearPath Lending on XX/XX/2021. I called ClearPath lending the next morning and asked them about qualifying for the letter I received in the mail and they said ... after a lengthy conversation that " that programs quota has been filled up for the month and that I should call them back after XX/XX/XXXX as they only allot 300 of these every month. '' This is a classic bait and switch in which the consumer receives a piece of mail offering a mortgage and terms and then do not make that product available to the consumer.

This is in reference to ClearPath lending XXXX XXXX XXXX XXXX XXXX, XXXX CA XXXX CFL # XXXX, NMLS # XXXX. They are using deceptive and persistent targeting tactics against VA mortgage loan homeowners. They are continuing to target me in a campaign that looks as if I have an expiring mortgage account, using my information and my actual lenders name in the letter. I have contacted them and asked to be removed, but they insisted they needed more personal information.

Clear Path Lending sends 3-4 mailers a week often times camouflaged inside envelopes without displaying their origin. They email, text and call leaving voice mails weekly. I reply to the texts and emails requesting that they stop contacting me. I applied for a conventional mortgage with a different lender last week, XX/XX/XXXX, and the amount of mailings and calls has doubled - offering me a VA mortgage. I desire that they cease all contact with me.

We receive multiple letters per week advising us that we " have yet to take advantage of programs sponsored by the Department of Veterans Affairs ; you are entitled to a payment and rate reduction through VA eligibility lending programs. '' Usually it's a refund of between $ 1,400-2,500. The phone number is usually an ( XXXX ) area code, but the full number typically changes. The most recent one was ( XXXX ) XXXX. There is no listed address.

We closed on our VA loan with Clearpath Lending, XXXX, Calif. on XX/XX/2020. We get daily fliers from them-asking us to refi. Now we are getting daily emails from them. They are annoying and we have called to have them take us off their mailing list, but they just ignore us. Have also emailed them. Not a huge deal, but very annoying. Because of this we would not recommend them to anyone.

I opted out of receiving prescreened offers to refinance my mortgage immediately after I got it in XX/XX/2019. Multiple companies continued to send me their offers, however most stopped after I contacted them directly and told them to stop. Clear Path Lending has continued to send me promotional material, including 2 letters in one day today, despite multiple attempts to make them stop.
