I was referred to him. In mid XX/XX/2016, we meet with him to see whether or he could help us. He proceeded to inform us that he could help but will be tricky due to the gifting in the contract and that a lot of realitor 's could not help us. I have never bought a house so I assumed that he was being honest. From word of mouth, including gifting in a house loan is extremely difficult. So we decided to go this way and started the paperwork. We got all of the paperwork together that he asked for.. Pay stubs, checking account info, Taxes and a Power of Attorney from the Bank. So papers were drawn up. We go and sign roughly 2 weeks later. Then he proceeds to tell me that he missed some stuff and that we need to come back to sign more papers. So we do this 2 / 3 times. So I need to leave work a little early to do this. I explained to him that this is costing a lot of money in gas and that I have to keep leaving work early due to traffic. After the third time of going down to sign papers, I told him my son was leaving and we needed to ensure that we have all the paperwork in line. He stated we did. Then came again for the fourth time and stated that we needed more info and still needed to sign more papers. Then he had stated to us that he had lost the papers due to carrying then in a backpack from changing offices again for the second / third time. So I took a couple days off work and we drove to we drove to California. We got the papers signed. Drove back. Got in touch with him and dropped off the papers. After doing all that and meeting with him on countless times. After 3 weeks goes by, he stated that due to the time frame on the loan, it took to long. And that we needed all new info again. I reminded him on how that I asked him to ensure that we had everything together the first time and he said we did. He apologize and stated how he not organized due to moving offices and losing papers.I explained and expressed very hard, telling him I 'm gon na have one shot at this due to different reasons. I explained the reason to him as well. So I got what he asked for and got the papers signed that he wanted signed. Got them all back to him. After 2 or 3 weeks goes by. He proceeds to tell me that he needed more info and that we may need this years taxes as well. I asked why on the taxes. Again because of the time frame. So after 3 months of losing papers. acciddently shredding papers or needed to resign the same thing and being extremely lost and frustrated. Of being told the process took to long while waiting on him.Towards the end of XX/XX/XXXX was the last time I spoke with him and told him that I 'm not using him. I did not realize that it took 3 months of paper work and still not done according to him. Then in XX/XX/XXXX, he CHARGED A XXXX Cost to my credit card for a home appraisal. We only got a text stating the amount of XXXX is what the home is worth. We never got our appraisal.

We are officially filing a complaint against XXXX XXXX of Citywide Home Loans in XXXX, Colorado. XXXX XXXX My husband and I, both XXXX at the time, moved to Colorado and purchased our first home. Being first time home buyers we were not aware that we had options regarding our mortgage broker. Our realtor basically told us, this is who you have to use, submit your information to XXXX XXXX for pre-approval so I can show you houses. When our offer was accepted on our new home, we told the mortgage broker that we were interested in a physician home loan. We actually brought this up on 3 different occasions with him, once by phone between him and I, once with my realtor, and once with my father who we were possibly going to use as a co-signer. XXXX said on all 3 occasions that XXXX were not available in the state of Colorado, as they were illegal in some way under Colorado rules. He stated this so confidently that we took his word for it as we did not feel we would know this states market better than he did and went forward with the loan he did have to offer us. We have since learned that physician loans were offered by at least XXXX companies at that time. So as soon as we realized this, we re-contacted XXXX to discuss and see if he could assist us in getting into the XXXX as we originally requested. He again argued that they were not available to us at that time. We asked that he simply pay the PMI that we had lost over the past 6 months and/or closing costs to get us into the right loan. He refused any sort of compromise or discussion. I reached out to his supervisor who directed me to corporate. We had a discussion with corporate after 2 weeks of " investigation '' with XXXX XXXX. The lawyers first comment to me was, " I understand you are upset because you were n't offered some sort of physician discount. '' Nope, no discount, just wanted a physician loan. Just frustrating that after 2 weeks of investigation, this is all XXXX had expressed to her ; basically, it felt as if they really did no true investigation of the details and matters pertaining to our situation. I feel as a mortgage broker he had a fiduciary duty to provide us with the best loan in our economic interest. In our case, this would have been the physician loan. We have also been advised that we also qualified for FHA loans which also were not offered to us and could have been another more beneficial option for us. Now, either he was uneducated on what is available in the market for physicians ( if so, he had a duty to tell us he was unaware of such a loan and we could have done research on our own, rather than stating they are " illegal '' or not available in our state ) ; OR he was aware of these loans but could n't write for it himself and thus make a commission/income placing his own economic interest ahead of ours.

On a purchase contract with an offer date of XXXX/XXXX/16 when deciding between multiple offers XXXX XXXX, with Citywide Home Loans, represented to me as the listing agent that the buyer was pre-qualified and infact had been ready to close on a previous property that the seller backed out of. So he had already been all the way through underwriting, and that she would be able to close quickly. Upon that representation, her client 's offer was accepted. Two weeks later when the home inspection had not even been ordered I was asked for an extension on the inspections deadline and it came with finance and settlement extensions also. I was also informed by the Realtor ( XXXX XXXX from XXXX ) that the Loan Officer was handling the inspection in addition to the appraisal on the property and that she went out of town and that 's why the inspection had n't been ordered yet. The inspection was finally done on XXXX XXXX ( 3 weeks after going under contract ). Then a week later there was a request to extend the finance and appraisal deadline again, which was not accepted. I kept following up to request when the appraisal was complete, and was told that it had been done, that it was fine, but subject to a reinspection after the roof had been re-shingled. I let XXXX know when the roof was scheduled to be re-shingled and that she could order the " re-inspect '' after that. Yesterday, XXXX/XXXX/16, I called XXXX to ask if she already had the Final Closing Disclosure out to the buyer etc. and she told me that she was on her way to a funeral and would call me and give me the update afterward but YES, the re-inspect had already been ordered. She never did call me back yesterday. However, I did get a phone call several hours later from an appraiser who was NOT doing a re-inspect but infact setting up an appointment to do the actual appraisal for the first time. 6 weeks after going under contract. Today, after the agent reaching out to suggest we needed an extension, I let her know we would do an extension for a different loan officer, but not for the current loan officer who had lied about the loan process and status for 6 weeks. Not too long after I received a call from XXXX to inform me that there were some issues with the borrowers Chapter XXXX that would not be able to be overcome. It is my contention that XXXX XXXX : 1. Intentionally issued a false pre-approval. 2. lied about the qualified nature of the buyer on the phone prior to going under contract. 3. Failed to respect contract deadlines to protect the buyer 's earnest money. 4. Falsely stated that the appraisal had already been done on multiple occasions. 5. Incurred expenses to the buyer for inspections, lost earnest money, and potentially the cost of an appraisal for a house he was never qualified for.

My girl friend and I met with our Lender from City Wide Home Loans on XX/XX/XXXX at XXXX XXXX to discuss in more detail about our recent Pre-Qualification for a home loan that was done on XX/XX/XXXX at XXXX PST. While we were there discussing financing options the lender suggested that we qualified for a Nevada home loan assistance grant called " Home is possible ''. We were told this grant would help with our down payment and closing costs and that in 6 months to a year we would be able to refinance in to a potential lower APR rate and hopefully lower our monthly mortgage. While the lender was going in to detail about the grant he suggested that the Nevada Housing Division was changing their laws surrounding the grant and beginning XX/XX/XXXX the grant would become a " second loan '' instead of a grant and certain stipulations would apply where we would not be able to refinance for 3 years unless we paid back the remainder of the assistance we received. He told us that as long as we had an offer in on a house prior to this date the purchase agreement would lock in the deal and we would be " grandfathered '' in to the grant instead of the new " second loan '' and would still be eligible to refinance in 6-12 months. After we were told this we made a point to begin searching for a home as soon as possible. We came up very lucky and put an offer in on a home on on XX/XX/XXXX and the offer was accepted on XX/XX/XXXX. We were under the impression that because the purchase acceptance date was on XX/XX/XXXX, before the new law went in to effect on XX/XX/XXXX, that we would have the offer that was suggested to us. Now, 4 days before closing on XX/XX/XXXX, the lender told us that they submitted the reservation for the grant via email to the Nevada Housing Division on XX/XX/XXXX, but the Nevada Housing Division did not approve the grant until XX/XX/XXXX and since it was after XX/XX/XXXX we would only be eligible to receive the new loan and not the grant. After this, i was frustrated, so i called Nevada Housing Division to discuss my concerns further because the lender suggested that it was not their fault. Nevada Housing Division then told me that the reservations are not sent via email, as the lender suggested, and that the grant is reserved via their website directly from the lender and approved at that same time. We are moving forward with purchasing the home because we have fallen in love, but the misleading and lies from the lender were very discouraging. I feel this is a UDAAP violation due to the unfair and deceptive actions taken by the lender.

I talked to Citywide Home Loans for a new home financing. I knew my credit scores and asked him to provide me a verbal quote on how much rate ranges are. He said he can only provide me a rate after running my credit application. I asked him again - considering prime credit scores how much the rates would be. The competitors are providing 4.125-4.375 % for 30 years fixed with 20 % down and XXXX points. He said to me that their rates are competitive with others and they would be able to provide me similar rates. Then he ran my credit - and my wife 's credit and came back and said that their rates are at 4.75 %. Again, mine is prime credit with 20 % down so the credit check changed nothing at all. It was inexcusable for the lender to not have given this quote earlier. The only reason I was going with this lender is that the builder recommended using him and said they would provide {$2500.00} towards the closing costs if I used this lender. His rates were so bad that an outside lender would be cheaper to me by {$5000.00} even after excluding this builder credit. This was unprofessional behavior on part of the lender - he lied to me about what the rates would before running my credit check. My wife and I got dinged on our credit report unnecessarily.

On XX/XX/XXXX I filed a complaint against and individual who has been trying to sway me to use his lender/mortgage company to close on a house. I refused to use his service because this individual is acting as the construction company owner for the home and as a mortgage lender as well. He has been pressuring me to close on a home today XX/XX/XXXX. I was ready to close on my behalf but he stalled documents and is refusing to take ownership on the delay of the closing date. He was not ready to close today XX/XX/XXXX. He keeps harassing me to use his mortgage company that do not want to use for personal preference. It is my right. I am well within my rights to use a lender of my choice. He has a conflict of interest in this matter and I have documents supporting everything. I just want to close on my home the way the deal went. He does not want to help with any problems along the road such as property value adjustment, Rate lock charge I have acquired because of this delay and he says he will not help me unless I use his preferred lender. When I contacted the broker, I was told loans could process in as little as 8 days. When I asked if they could insure 21 days I was told absolutely yes. I am now being told 30 days at the best. Initially, XXXX % down was agreed upon. After committing to use their program, I was informed that XXXX % would need to be placed down. EVERY SINGLE PROMISED DATE HAS NOT BEEN MET. There has been delay after delay, all blamed upon other entities but, it seems to me there has been little or no sense of urgency to resolve until I get a hold of them at the end of the day and then it is too late for that day. I constantly receive promises that are not kept. The loan processor does n't work every day so there are days where no updates are forthcoming. In summary, I feel I was led into a loan and once I was vested in it there has been lack of communication and no sense of urgency to fulfill their promises. I advise anyone working with this office to be cautious about what they are promised.

We were told in XXXX that we had been qualified thru USDA to purchase a home for {$160000.00}. We purchased a new build home and uprooted our whole lives to move to XXXX, NV and watch our new home being built. On XXXX XXXX we were finally doing our final walk-thru and would be in before XXXX. During that walk thru our lender called the sales agent ( not our agent ), to tell her we did not qualify because we are on income leveling. This means that when social security kicks in, ( in 2 years ), my retirement benefits come down by exactly what my SS amount will be ( {$XXXX} ). They told me that one underwriter had been fired and the new underwriter had dis-qualified me on that fact.
