According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' XXXX XXXX is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' XXXX XXXX the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX XXXX Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

On XX/XX/2023 XXXX XXXX made an attempt to make an unauthorized charge from my XXXX XXXX account by trying to charge my now discontinued debit card ending in XXXX {$350.00} for a payment for my car loan. This is a card I used XXXXne time on XX/XX/2023 to make a payment also in the amount of XXXX. The card is not even saved on my XXXX XXXX account because I rarely use it. Unless it's an emergency. On XX/XX/2023 around XXXX I made a call to XXXX to inquire why they had tried to charge me with out my permission and if I was set up on reoccurring bill pay. I was in fact not set up for reoccurring payments or scheduled payments at anytime. The gentleman on the phone couldn't answer why they would attempt to charge me with out my permission and told me a supervisor would be calling me back. On XX/XX/XXXX I sent an email to XXXX XXXX customer service asking again for answers. I only recieved the generic response of " The email below has been added to the requested account and the account representative has been notified ''. On XX/XX/XXXX I sent another email requesting all communication be in writing. On XX/XX/2023, XX/XX/XXXX and XX/XX/2023 I had not received any reply or answers except for the same generic email as before and emails with the following quoted text from A XXXXXXXX XXXX representative. " Based on your silence and neglect, I am reviewing this account for additional action. Your attention and cooperation are needed immediately. Please be aware that your account is delinquent and is being reported to the credit bureau as such ''. I have not been silent or neglected. I have reached out. I have been ignored and neglected. I want to know why they tried to make an unauthorized charge to my debit card.

Payment was 4 days past due with XXXX XXXX, I was called numerous times daily, while at work. My references were called numerous times daily. I received a voicemail threatening repossession after only 4 days past due. I have paid a year on car, with no late payments. When I returned call to Creditor, I spoke with my Credit Manager. He was rude and Irate. I asked for copy of contract to be mailed to me. He wanted to speak about the payment that i made online earlier. Offered him a reference #. He yelled and screamed at me that if i made my payments on time then he wouldn't have to harass me. Asked him to stop calling my references, especially my elderly mother. He yelled no way, he will call all refs until i pay on time. Again asked him to stop calling my references. He refused. They will not work with you when needed and speak with you like you are stupid and worthless. I regret ever purchasing a vehicle through them. The car is always tore up, the warranty was worthless. I tried to explain that is is hard to pay for repairs and the car at the same time. I was told to either pay on due date or the car will be repossessed. Let him know that I would be reporting his actions to the CFPB and his response was a loud laughter with the reply " Have fun with that ''. Their phone calls are recorded. The company that I am having problems with is XXXX XXXX. Address XXXX XXXX XXXX XXXX TN XXXX. Phone number is XXXX Since I am out of work because of the Coronavirus I havent been able to make the payments. My Payments are due every two weeks and and I was told two weeks ago by a manager named Ms XXXX that if I made the current payment they would be able to help me with the payments going forward because of the virus. My mother made a payment for me. I had two miss calls from XXXX XXXX yesterday and every time I called back the phone would hang up. I called back today and talk to a representative that had to call me back and told me that her Manager told her that I would need to make another payment and they could extend the payments for 30 Days. That not what I was told, and Im not working because of the virus. Im not sure who else they are doing this too, but its not our fault that we are out of work. I have filed for unemployment and I havent received anything yet as I told the first manager. This is something that is happening world wide, they shouldnt be able to handle Business like this.

On XX/XX/2019 at XXXX, I received a phone call from a representative at XXXX XXXX XXXX to a late car payment that was due XX/XX/XXXX. I assured the representative that I would make the payment. At XXXX on XX/XX/XXXX, I receive a phone call from the same representative. I asked her not call my phone and that I would pay when I have the time since I was at a meeting at my daughter 's school. She called back from an unknown number at XXXX, which I answered and hung up after hearing the representative 's voice. I have missed calls afterwards from a private number at XXXX. Three calls from XXXX at XXXX. Three more private calls at XXXX. There were also calls made to my fiancee 's phone while he's at work. After the parent meeting, I called back to speak to a supervisor. Their major concern was the late payment of {$100.00} out of {$160.00}. The measures taken is not necessary and is ever necessary. This is not the first issue.

I paid off the car XX/XX/XXXX. I was told XX/XX/XXXX that they would send the title. I confirmed it's fully paid off. I got home from a trip the XXXX, not there. I called, they said it was sent. I got home from a music festival the XXXX, not there. I was told go to the clerks office and get a duplicate title. I go the XXXX to the clerks office, it's still showing the lien. I move on the XXXX. I called to get an email with the VIN. The person who can do that is out until Monday and nobody will send the email. They won't give me a copy in person. Its my car. I own it. This is a class C misdemeanor apparently in Tennessee. I have to have it the XXXX and they've been nothing but rude. I've had to take work off to do this.

Ever since I have gotten the loan if I go one or more than 5 days past due they come at me with threats of taking my car .I have texts showing them just recently trying to take payment out multiple times in a 24 hr period off my debit card and also my wife 's debit card and I have voice mails of them threatening of repossession every time. I have kept in contact with them the best way I can and have done. In conversations with them I have told them situations of any late payment and they have lead me to think that they understand and that they will work with me and never do. The reviews I have read on the XXXX XXXX XXXX there are so many complaints on this company with the same thing that happened to others.

I have tried contacting XXXX XXXX due to inaccuracies on my credit report. I disputed the account on XX/XX/XXXX and did not receive a response back by XX/XX/XXXX. I waited an additional month and sent a letter off on XX/XX/XXXX. It is now XX/XX/XXXX and I still havent heard anything back from XXXX XXXX regarding the dispute letter that was sent to them on XX/XX/XXXX. XXXX XXXX has been in direct violation with the FCRA for over 4 months now. This is unacceptable, as a consumer I deserve to know what is going on with my credit report and at least a response back from the company to let me know what is going on.

This vehicle was voluntary surrendered XXXX or XXXXXXXX XXXX XXXX in the height of Covid 19. The vehicle was sent to a repair shop of the XXXX XXXX XXXX XXXX. XXXX XXXX XXXX XXXX XXXX. Pace Financial was aware of this. The truck was a death trap, shouldve never been sold to a consumer, previously wrecked vehicle. The truck was sold at an auction and since has been charged off! However I never received any info regarding the remaining amount and pace is reporting a different amount to the credit bureaus every month. The amount and information on my credit report is inaccurate.

Pace Financial in XXXX, TN is horrible & when your unable to make your scheduled monthly payment they call & say if you do n't pay by the end of the month your vehicle will be repossessed because we have to have it in here by the end of the month or it goes to managers review. They keep you on the phone when they call for XXXX or more mins lecturing you & repeatedly tell your hurting yourself & your car will be repossessed if you do n't listen to us!!! They have no compassion to your situation or circumstances!!! Def stay clear of this company!!!

City Leasing continues to call every day harassing me for payment. They have also contacted my friends and family with the attempted to embarrass me. They have come to my physical address making threats, embarrassing me and harassing me. The manager XXXX was very rude and disrespectful and threat to destroy my home if I didn't make payment.They call every day to speak to me accept Saturday and Sundays.
