DATE : XXXX COMPLAINT ( S ) : 1- Dramatic increase in monthly mortgage payment due to accounting error at Churchill Mortgage Corporation 2- Threatened with negative impact to credit report if we didn't pay either the difference or the new increased monthly payment amount to correct their error. 3- Owners wish to be responsible to pay the real estate taxes and property insurance and terminate escrow account to prevent any further issues, was denied by the mortgage company because of their self-created deficit to our escrow account. 4- Threatened with late fees and collections if we do not pay to correct their error. 5- We were given 2 ANNUAL Escrow Analysis within 7 months, to adjust for an error that was caused by the accounting department of Churchill Mortgage Corporation . DESIRED RESOLUTION : 1 - For Churchill Mortgage 's accounting department to correct their accounting error, retroactively, which will erase any negative balance and not have a negative impact to our credit, as well will not increase our monthly payment because the change in insurance and taxes doesn't meet the criteria to increase the monthly payment, and we shouldn't be responsible to fix their error. 2- Owners to assume paying real estate taxes and home owner 's insurance premiums on home and not have an escrow account through a mortgage company. EXPLANATION : Good afternoon, we refinanced our home last year through Churchill Mortgage Corporation, because they were recommended by XXXX XXXX. After all required paperwork documents and payments were agreed upon and completed, our first payment of {$1100.00} started XXXX. We then received an Annual Escrow Analysis report dated XXXX, stating there was an escrow surplus of {$1900.00}, which they sent a check to us for. After verifying this twice, being told it was indeed an overage, and that that was how much our previous mortgage company had overcharged us, and it was okay to cash the check. So, we used the money to do some upgrades on our home. And with that same escrow analysis adjusted our mortgage payment from {$1100.00} down to {$1000.00} effective as of XXXX. Because we had already signed up for autopay, there was nothing we needed to do ; they did all the adjustments on their side. We received no other communication. We then received a notice of Servicing Transfer from Present Servicer of Churchill Mortgage Corporation to a New Servicer of XXXXXXXX XXXX XXXX, dated XXXX. As well as we received another Annual Escrow Account Disclosure dated XXXX, stating a change in monthly payment from {$1000.00} to {$1400.00}, effective XXXX. I contacted Churchill Mortgage Corporation, XXXX, and after several attempts, was finally able to speak with XXXX, Corporate Office Liaison for Churchill Mortgage Corporation, XXXX, on XXXX, who didn't have any information on our loan, so I submitted all the documentation requested, which is included in the attachments below, as well as the conversation text. She stated the increase may be due to taxes or insurance being adjusted, which I submitted documentation for both taxes and insurance for both XXXX and XXXX supporting this was not the case. Then, she stated it looked like we possibly were sent a refund in error but would have to have it researched and would follow up with me once she received an update. I explained that we verified it twice, and that we were told it was indeed an overage, and that that was how much our previous mortgage company had overcharged us, and it was okay to cash the check. Again, we only received notice of overpayment of XXXX, as well as a notice of monthly payment adjustment effective XXXX, no other communication was sent to us from Churchill until the change of servicer notice dated XXXX and the second " Annual '' Escrow anaylsis dated XXXX. They increased our monthly payment to correct their mistake, and we refuse, as their accounting department created this error, and we shouldn't be held liable for their mistake. Again, we got verification twice, and it also states on the Annual Escrow Account disclosure statement dated XXXX, that this is a surplus. After waiting several days for an update, XXXX referred us to talk with XXXX. We were not told that our loan was sold to XXXX. We were told the new servicer would be XXXX XXXX XXXXXXXX Talking with a Supervisor, " XXXX XXXX ( female ), at XXXX XXXX she also confirmed that there was an error in processing, which was supposed to have been corrected but sent a refund in error, because a wrong amount was entered for the taxes in the escrow account. We were told we needed to pay them {$1000.00} or the new monthly payment of {$1400.00} to correct their error. We were also told that we would not be able to pay the taxes and insurance ourselves because there is a negative balance. But, this negative balance is due to their accounting error. We then received another Annual Escrow statement dated XXXX, adjusting the payment down to {$1200.00}, with no explanation of how they came to this amount, instead of adjusting this back to the {$1000.00}, because the difference in taxes and insurance doesn't warrant an adjustment. We were told that nothing else can be done on their side about the negative balance created by Churchill Mortgage 's accounting department, and that we need to correct the deficit, and it needs resolved in 15 days to keep from having late fees applied and ultimately needs resolved by XXXX to keep from having our credit negatively impacted. We have requested the autopay be stopped until this is resolved. We are very meticulous with our finances and have done everything to do what is right and pay our debt down to build our credit score up to excellent status. We take responsibility for our mistakes, Churchill needs to take responsibility for theirs. We have included several documents supporting this claim, but if you need anything further please let us know. Thank you for taking time to read this and any help you can provide us is greatly appreciated. This has been very stressful for us, on top of XXXX, now to have to deal with this. I am not able to get back the sleep I have loss due to the stress and worry this has caused, but looking forward to having this taken care of with a positive resolution. I purchased a new home in XX/XX/2021. My mortgage was to be serviced by Churchill Mortgage Servicing Company. They had told me via mail that I would be able to create an online login to see everything related to my loan, make payments, etc. My first mortgage payment was due on XX/XX/XXXX. I called in XXXX when I noticed that their system was not allowing me to create a login. I called and they helped me through this problem. I also asked at this time about how I can apply for a semi-monthly payment. She instructed that I could do this through their online portal. On the call, I asked her where I could find that link to apply. She walked me through and then explained that they must have taken the option off the website and it can only be done via fax/email/mail. She sent me the forms to fill out and instructed me to submit them after I make my first mortgage payment in order for them to process. She said it does take some time to process, but it should be in play for my XXXX payment. I made my first mortgage payment on XX/XX/XXXX and I sent in the paperwork for semi-monthly payment plan to be processed on XX/XX/XXXX. I never heard back from them, so I called to make sure they had what they needed in XXXX to process the request. The representative told me that they received it, but that they needed a " wet '' signature - not a digital signature - for the paperwork to be processed and that they mailed me the forms to sign/send back in. Why they could not email me back to let me know this, I have no idea. I then waited for their letter to come and as soon as I received the letter in XXXX, I filled it out and sent it back. They did not process this " wet '' signature until XX/XX/XXXX and never contacted me to tell me it was received, being processed, or that it would take another 45 days for semi-monthly payments to occur. On XX/XX/XXXX, I called again to ask if they received my paperwork and to ensure that starting on XX/XX/XXXX, my mortgage will be paid semi-monthly as I requested. The representative said that it was processed and that I should see it on my account online within XXXX hours - that I was " good to go '' for semi-monthly payments to start in XXXX. I waited to check my account again until today. It was still not showing on my account. I called Churchill Mortgage again and this time the representative told me that the paperwork was not on my account. After some debating and my explanation of what was going on, she looked into it further and said they received the paperwork but that the semi-monthly payments will not go into effect until XXXX. She also said that to have this processed, I needed to be ahead in my mortgage by 1 month and essentially needed to pre-pay to have this fully processed. I looked back at the form I filled out and it specifically states there are 2 options for 2 monthly payments. 1 ) Bi-monthly payments that includes pre-paying a month in advance and 2 ) semi-monthly drafted payments where no pre-payment was needed. I told her that I chose option 2 that did not need a pre-payment. She needed to " look into things further '' and later came back saying that I was correct and that nothing could be done for my request to start in XXXX, that it would not start until XXXX. She also told me that it will take them another month for my bank account to be set up for drafting. I told her that my account was already set up for automatic drafting, as that is how I paid the last two mortgage payments, and it shouldn't be an issue. She then " looked into that further '' and said that I was right. I let her know that I have worked with other mortgage servicing companies on this very request and it took less than 1 month for the entire process to be submitted and completed. I let her know that I started this process with Churchill Mortgage on XX/XX/XXXX and that it was unacceptable to take this long. The fact that they continuously over the last 2 months tell me that everything is in order for the next month, and then when the month arrives, say there is an issue and it won't start for another month is telling me that either they don't have a set process internally for servicing or that they are deliberately delaying the process to avoid being paid semi-monthly for mortgages. I was furloughed last year due to the COVID pandemic and we are still reeling financially to recover. Because of that, budgeting and cash flow are of the utmost importance to us and the fact that Churchill Mortgage is not willing to work with us within a reasonable amount of time, not willing to be transparent, or even properly alert us to their ambiguous processes is unacceptable. They should not be allowed to service mortgages if they do not have the ability to properly manage their internal processes or alert their customers to any changes.

My issue is regarding my mortgage company ( Churchill Mortgage ) not paying the correct property taxes and the inability to get them to respond. XX/XX/XXXX I checked my property tax account to ensure they paid my property taxes correctly. They did not. I immediately emailed them and called them to have this corrected and I sent them the correct amounts to be paid that I downloaded from my county tax department. Since then, I have sent numerous emails without any answers. They will only say the research department is working on it. They then said to call if I need immediate assistance. I did that and was told that XX/XX/XXXX and escrow analysis would be done. When I check my account, everything remains the same ( payment amount, escrow amount ) and when I check the county records, it still has not been paid. I then told them that I want to cancel using escrow with them and make my payments in the future so I can make sure it is done correctly. Subsequently, they cancel my escrow, but they still keep my escrow funds and do not pay the taxes that are due. They do not respond to my request to give me my escrow funds back so that I can make the tax payment ( which is due in 2 weeks ). Essentially, they are keeping my escrow money, not paying the taxes due, not responding to emails, giving mis-information on phone calls. Nothing is being done and if I don't pay my taxes by the XXXX I will incur a substantial penalty. Please Help!!! Below is the initial letter sent to them. I then show their response 3 days later. That is the last time I have heard from them and as you can see, we are going on one month. On XX/XX/XXXX, we disbursed a payment of {$45.00} to the XXXX XXXX XXXX. Our next scheduled disbursements will be in XX/XX/XXXX in the anticipated amounts of {$2400.00} and XXXX. XX/XX/XXXX or XX/XX/2016 we contacted Churchill Mortgage ( recommended by XXXX XXXX ) and asked about a refi of our house while rates were down. We explained upfront that we had a prior Ch. XXXX Bankruptcy that was over 2 years discharged and included a property that was surrendered and foreclosed. They said that was not an issue and that they could handle the loan. We proceeded to spend 2.5 months trying to get a rate lock and confirmation from them ; I have attached SOME of the very many, many emails. First they tried to force us to sign an application ( filled out by them ) that had incorrect information including my incorrect name, job, loans- I refused to sign a false document even though they pressed me to and said it did n't matter. Finally they agreed to let me fix the errors. Then they repeatedly asked for documents which we sent multiple times via multiple avenues ( email ; fax ) ; they kept losing them, kept requesting them ; finally they said they could get them in-house ; then they said they could not. We were told so many times that they had everything only to come back needing some document we had already sent. They dragged this on for so long that rates have gone up and now they simply wo n't communicate with us at all. We want a refund of the approximately XXXX $ they charged us for a credit check and they should, in our opinion, pay us some kind of damages for leading us down a path when we now can not get the 3.65 % ( approx ) rate that they said we would get when this started! What kind of damages is that if they wo n't close the loan at the original rate told to us?? Furthermore, they do n't even know the XXXX loan laws! They have known for months that the ( old ) property at issue was part of a BK surrender/foreclosure- but they ca n't seem to read BK documents, Orders, discharges, and deeds to see what happened and are NOW, 2.5 months LATER telling us it appears we have to wait 7 years post foreclosure? No, that is not the law! These people are incredibly disorganized, poor communicators, if not outright fraudsters. We have lost months of finding a lower rate loan due to their continued promises that all was well. Now they have simply shut down communicating. We want this closed at the original rate told! XXXX XXXX Churchill mortgage XXXX XXXX XXXX XXXX XXXX XXXX I as a single mother with steady income, steady household income have been denied due to not having credit scores over XXXX. For FHA loans on all government websites it clearly states these loans are specifically designed to help people like me with less than average credit scores or marks on their credit. These loans are being used for people who have higher credit and are being told all credit marks on their reports must be remedied prior to loan acceptance. If I had a perfect credit score or credit profile I would not be looking to obtain a government backed loan. No banks are offering the XXXX credit limit as disclosed as a requirement for the FHA loan, rather asking for XXXX or above. I have attempted through multiple lenders and now my family is at risk for homelessness due to the loan system. I have the ability to pay, I am currently paying and have the ability to pay all future payments. I am being told with a monthly household income of over XXXX after taxes my household does not make enough money. I feel I have been discriminated on as when working with XXXXXXXX XXXX my lender contacted my real estate agent and notified him I was unable to obtain any loan and would not be capable of obtaining any loan. This has greatly affected my ability find and secure housing for my family. If government backed loans are specifically made for lower income, lower standard individuals like myself ( single mother households ) why these loans not being provided to individuals such as myself to remedy homelessness or the chance of. Where go? Who do we turn to? Do we just accept homelessness? There has to be someone who lends based on government standards set in place rather than making their own standards and denials based on poor credit scores when clearly the minimum score has been set at XXXX. This company pulled a hard inquiry on my XXXX, XXXX and XXXX consumer report without my permissible purpose. According to the FCRA 15 USC 1681b - Permissible purposes of consumer reports ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 1 ) In response to the order of a court having jurisdiction to issue such an order, a subpoena issued in connection with proceedings before a Federal grand jury, or a subpoena issued in accordance with section 5318 of title 31 or section 3486 of title 18. ( 2 ) In accordance with the written instructions of the consumer to whom it relates. This company has none of these documents or written instructions from me authorizing them to pull my report. I did not authorize this inquiry. In both XX/XX/XXXX and XX/XX/XXXX, XXXX Mortgage company pulled my credit to try to obtain a loan approval without my authorization. After contacting the local agent who fraudulently pulled my credit twice, I then spoke with her XXXX. He refused to remove the hard inquiries from my credit and offered me a credit only if I chose to utilize their service for a refinance. I made several attempts to try to resolve the issue, via email correspondences and telephone, but felt as though I was getting the run around. Had XXXX never pulled my credit, while I was in the middle of a family crisis, I would not have considered the refinance at either time. I simple asked for information based on a spam email which I received from the local agent XXXX and she took it upon herself to run my information which they had on file from a home purchase I made through them in XX/XX/XXXX. My credit was not where I would have wanted it to be for a refinance and even though it was approved, I would have rather wait on a better credit score to lower my interest rate. However, this option was taken away from me. I had to consider going with their company within the 90 day period, as to not further damage my credit or have another company pull it a XXXX time at a later date. This is not fair to me as a consumer and I believe it caused me to delay a refinance even further than anticipated. It certainly has cost me more in the long run.

XXXX XXXX at Churchill Mortgage understood that I have a XXXX. My husband XXXX and I were told that we qualified for a FHA loan, and that we could indeed move from XXXX to a cooler climate in XXXX hoping to benefit my health. XXXX told us to find a longer term hotel, so we paid {$1400.00} for one month at the XXXX XXXX XXXX, while XXXX told us to use a realtor by the name of XXXX XXXX at XXXX XXXX. Once we were up here, XXXX told us that we had to rent out our paid for condo and show him the year lease, otherwise we would not qualify. We hired XXXX XXXX, and they rented out our home. We had an inspection on the home, it was loaded with live cockroaches, and XXXX insisted I get the house and live there with the cockroaches while an extermination company would use chemicals to kill the bugs. With my XXXX, this would only worsen my symptoms. After this, XXXX told us that since we were not happy with his mortgage company, that " although we qualify for the loan, we need to go elsewhere for the mortgage. '' We can not go back to our home for a year, we can not get a loan, we have contacted about XXXX mortgage companies, and no one will help us. My house is paid for, I am XXXX and now where do I live? My credit is XXXX, my husband is a veteran of 21 1/2 years in the XXXX, and we have been working all of our lives. We are literally homeless, and a victim of XXXX XXXX from Churchill Mortage.

XXXX we submitted a loan application- they messed up on the application. we re submitted another application, after waiting 3 weeks we were notified they lost our application. we refiled another application another 40 days we have now been notified they are not putting the loan through. the advised us not to pay things have have finacially put us in a bind.This was through XXXX XXXX at Churchill mortgage in XXXX michiga

Churchill mortgage pushed me conventional loan, I was wanting VA or FHA. I was told I couldn't get a gov backed loan _ Within 15 days I was sold XXXX. XXXX XXXX, then XXXX XXXX. What do u know. This was a scam to get {$30000.00} cash out of me. This is an obvious move of ihands to take the Cash from me.
