COMPLAIN OF VETERAN HOMEOWNER, XXXX XXXX XXXX SUBMITTED : submitted XX/XX/XXXX. It concerns Re-financing for my Home at XXXX XXXX XXXX, XXXX, TX XXXX. Phone : XXXX XXXX XXXX XXXX Email : XXXX or XXXX FACTS : On XX/XX/XXXX I closed on purchase of my above referenced home. Financing was done through : XXXX, Customer Service Dept. XXXX XXXX XXXX XXXX XXXX XXXX XXXX. # XXXX, XXXX, TX XXXX. My loan was soon sold to : XXXX XXXX XXXX XXXX XXXX. Their Customer Service Dept. can be reached at XXXX, XXXX XXXX XXXX, XXXX, NJ XXXX. I paid on time all my obligations under this loan until XX/XX/XXXX. In early XXXX I started getting a lot of Offers to Re-finance because of something called : XXXX XXXX ( See attached example of letter from XXXX XXXX. ) I started working with XXXX XXXX to refinance my home VA Mortgage Loan and I had submitted most of the requirement paperwork but we got hung up because they insisted upon a signature by my wife ( we have been estranged since XXXX since when she has been living with another man. ) Another Company, Newday Financial, whose Account Manager, XXXX XXXX XXXX, ( phone XXXX ) and I went through a several month process of doing my application ( see documents attached ) until Mr. XXXX too had problems getting the required signature by my wife on my home even though she had filed a statement which I sent to Mr. XXXX at Newday explaining that she had no interest in my home. I got to the point where Mr. XXXX ( sample of letter communication attached ) informed me that we could not close and he would dismiss the application I was making if my ex-wife, or wife, did not sign before a notary. Mr. XXXX was constantly contradicting himself and the promises he made so I called him on these and on Wednesday, XX/XX/XXXX, he got mad, and hung up on me explaining that he was going to close my application. Some time before XX/XX/XXXX, I had received another Offer to Re-finance from XXXX XXXX ( see attachment, the notes on it were made by me as I tried to record what happened ) and by Saturday, XX/XX/XXXX, I had emailed all the documents required by XXXX XXXX, and Ms. XXXX had indicated that the loan would go through, but I have not heard back from XXXX XXXX, the Account Manager for XXXX XXXX with whom I was working on this Application for Refinancing. In trying to make sure everything I did was on the up and up, I sent her a copy of the XXXX XXXX XXXX XXXX XXXX cite where I had made my payments regularly since XX/XX/XXXX. But I had gotten this by going back to that website to make the XXXX payment on time when I noticed the Paid In Full statement written across the cite. I had been told by Mr. XXXX not to make the XXXX payment and so I did not, but since he had gotten mad and hung up on me telling me he was going to close my Application, and we had not closed : and he had told me that without closing he would close my application, I had gotten worried about it and on about XX/XX/XXXX or XXXX, I went on line intending to pay the monthly payment but I saw a Notice PAID IN FULL on my loan payment site. ( Copy attached. ) I have left several written inquiries about what happened to XXXX XXXX XXXX XXXX XXXX but I never heard back from them. However, on todays date ( XX/XX/XXXX ) I again tried to find out from them and, although I forget how, they communicated to me that I should call XXXX ( XXXX ) XXXX. I did and got a hold of someone who eventually got me to Customer Service who got me to the Refinancing Department on the XXXX XXXX phone line. I spoke with someone from each of these departments for some five to ten minutes or more trying to explain what I knew about what had happened but both he and she that I spoke with got mad at me and sent me back to Customer Service who, after I tried for some time to explain to her also got mad and hung up on me. In the course of talking on the phone with Customer Service, I mentioned Newday and she immediately complained, why are you calling us to talk about our Competition and this was shortly before she hung up on me. I could not explain to any of these persons what happened because I do not know what happened. I am therefore filing this because these People scare me because they are worse than lawyers about getting paid and I do not know if even if I could get them to read this they would understand what happened. They need to be at least confronted by someone with some clout. Mr. XXXX had set a series, more than four, deadlines which came and went and he was fighting with me about having to set up yet one more when I complained because he contradicted himself constantly and kept going back on his explanations and promises. I, later, when I spoke with XXXX XXXX, noted the huge difference in the explanations she made of behalf of XXXX XXXX. Mr. XXXX kept talking about deadlines and such as the need for my wife to sign but he was clearly trying to coordinate too many things to keep them straight and this led to my complaint about his contradictions which led to him hanging up and telling me that he was going to close the file. Today, XX/XX/XXXX, I called and tried by various ways to communicate with XXXX XXXX XXXX XXXX XXXX, who finally contacted me ( I forget how ) and told me to call XXXX ( XXXX ) XXXX. I did and spoke first with a Receptionist for XXXX XXXX who said somewhere along the way of the perhaps one to two hour conversations or waiting on the line that they had my loan but could not tell me anything else. I insisted and I eventually was on the phone with Customer Service, whom could not understand what I was talking about and thus sent me to the Refinancing Department whom I spoke with someone there until he got exasperated and told me he could not understand what happened and so he abruptly told me he was sending me back to Customer Service. I was trying to explain to the lady from Customer Service that I did not know what had happened but I started, once again, to explain the facts I have set forth above. In the course of doing so, I mentioned Newday and the lady from Customer Service I was talking with got mad and said something to the effect of : Why do you call us to talk about a Competitor and shortly after that hung up on me. I did not know what else to do so I tried to contact the Texas Department of Savings And Mortgage Lending but they told me I must go to your ( Federal ) site and thus I ended up here. Please help as I know that sooner or later I must pay the mortgage. There is just no way the Banks are going to make and have to pay for a mistake like this. However ; I do not know what XXXX XXXX did to get my loan and as I told them, I am sure they did not pay my mortgage off for altruistic reasons. But still, there are terms involving interest rates which are going down incredibly and also closing and other costs which need to be negotiated. I have negotiated absolutely nothing with XXXX XXXX and, I can tell from my efforts to work with them that they will be like those which I thought were already Antiquated Bill Collectors of the old days who are likely to do anything to collect their fees but who are convinced that if a Consumer makes a mistake, the laws of this nation are there only to protect the Banks make money at the Consumers expense. I was asked by someone at XXXX XXXX if I wanted to make a payment of {$1500.00} and when I must have sounded shocked because I was shocked because that is the amount which they were working to reduce, supposedly! ( Statement attached. ) I can sit here and wait but I know that they, none of this, will just go away even though there was never a closing on any agreement to refinance and the new monthly payment with XXXX XXXX was already about a XXXX dollars less than the monthly payment I would make with Newday and the rates have again gone down. I can not fight these People and they have already made it obvious that they will just not even consider being reasonable at this point where they think they know what happened but do not want to have to explain it to a Consumer like me who they mostly make money from because of what we do not know and so it is for all these reasons that I will be most grateful for anything that you can do that might help me at least understand what happened. I therefore need your help and hereby request it.

XX/XX/XXXX, Applied for a Cash-Out Refinance with New Day to lower our mortgage rate, eliminate all revolving credit accounts and obtaining additional cash that would aid us during the Covid 19 crisis. Submitted all requested documentation within days of request. XX/XX/XXXX, Estimated closing date was XX/XX/XXXX. XX/XX/XXXX, Completed VA home appraisal. XX/XX/XXXX, received our rate lock. XX/XX/XXXX, approaching closing date, we requested clarification on the actual closing date. No response over the next 5 business days. XX/XX/XXXX, XXXX ( existing mortgage lender ) sent email, offering to place a hold on monthly payments for next 3 months, without impact to credit report, late fees or other negative actions. XX/XX/XXXX, No detailed ramifications of the impact the Forbearance agreement would have on our existing refinancing action. XX/XX/XXXX, Concerned that we had waited to make the XXXX payment due to the impending closing of our refinance loan, and didn't want to have the loan shown as " Late '' we accepted the XXXX offer to move the payment due date out to the end of XXXX.. XX/XX/XXXX, still no response from New Day, we escalated our concerns to Loan Officer 's supervisor, that we have not been able to reach anyone regarding our closing or other urgent issues regarding the economic developments we were experiencing. XX/XX/XXXX, received call from Loan officer approximately 2 hours after our escalation call. We explained the urgency of wanting to use the delay with XXXX and would that action interrupt our refinance. He then explained that by accepting the offer, we may have jeopardized the closing of the loan. He would get back to us. XX/XX/XXXX, We received another request from New Day for our IRS transcripts for tax years XXXX & XXXX. We were informed it could take a few days to obtain. However, we were able to go online at the IRS and get the transcripts within an hour of the request. XX/XX/XXXX, we logged onto our loan information on the New Day site and it reflected a closing date of XXXX XXXX We had yet to confirm the status of our loan and then received additional request from New Day for our XXXX XXXX earnings ( previously noted as unnecessary ). XX/XX/XXXX, we were informed that the XXXX agreement was an issue. But, if we were to make the XXXX mortgage payment, we may receive a waiver for having entered into the agreement unknowingly. XX/XX/XXXX, made the XXXX payment to XXXX. XX/XX/XXXX, we had not received anything further from New Day. XX/XX/XXXX, our request was still under review. XX/XX/XXXX, informed that the request was denied and the refinance loan was now dead. XX/XX/XXXX, contacted New Day supervisor for clarification. Supervisor had many facts about our situation incorrect and non-reflective of our actual circumstances. We updated and defended our position and the supervisor took it forward for another review. XX/XX/XXXX, notified by New Day that they would not reverse their decision. XX/XX/XXXX, contacted VA Loan Origination department and they notified us that the Forbearance Agreement should have no bearing on our Refinance. New Day disagreed. ****We were within days of closing this loan, where at that time, no other issues with our funding had been identified by New Day. We " assumed '' that this approval was forthcoming. The decision to reject our loan application not only resulted in placing us in a negative credit reporting condition, it also locked us out of finding any other lender willing to make the loan. Since, our credit report has reflected a sequence of lower scores, which we'll now have to work hard to repair. We are now " stuck '' with the black mark this agreement has created and unable to proceed with any other loan options as a result. It will take a couple of months to correct this ill-informed decision, even though we never signed anything with XXXX, or made any other " official '' agreement. We acted in good faith with New Day. We could have gone to other lenders, but selected New Day because we felt that as a US XXXX Veteran, we would receive " FAIR '' treatment. I am infuriated that a lender, lauding their respect for all Veterans and their willingness to provide " special consideration '' to us Veterans, would have taken such an underhanded approach.

We have a perfect mortgage-payment history, going back to the spring of XXXX , credit scores in about the XXXX to XXXX range, a fully discharged Ch apter XXXX bankruptcy, and NO DEBT, beyond the mortgage, except fo r one secured Visa card t hat I got last year to re-establish credit so that our overall score would be higher when we applied for this refinance. It has a low balance. NewDay USA has gone well beyond what is required in documentation for a VA refinance. Even though the credit report tells the story, it wanted 36 months of mortgage statements or canceled checks to prove that the mortgage was paid on time. It demanded bankruptcy paperwork well before the discharge, which was signed by the judge! It wanted the plan 's payment history and numerous other documents. Just before closing, it denied the refinance, saying that there was a break in payments to the U.S. Trustee. I was very transparent on this, explaining that because of XXXX discrimination, retaliation, hostile work environment, harassment, and being forced to work outside my medical restrictions at my federal government employment, I was forced on leave without pay to tend to the numerous medical issues that my employer had caused AND exacerbated. We continued to pay the mortgage on time, and once my XXXX retirement was approved from the U.S. Office of Personnel Management, we set up a modified-payment plan, which we completed EARLY! We received our discharge in XXXX XXXX . NewDay is CLEARLY overreaching when it reaches over a federa l BK judge in XXXX , MD and makes up its own rules so that we are denied the proverbial, " fresh start '' that the statute provides when the payment plan is complete and the judge signs off on it and issues the discharge. We spent more than a month giving them every single piece of paper that they requested. They wanted to know what happened that got us into bankruptcy. That seems like a reaching question. We had a problem, and we solved the problem by paying what the judge ordered. We need to look at the facts, not satisfy the curiosity of someone, who is just nosy and finds the challenges and unfortunate experiences of others to be entertaining or laughable. This is a TERRIBLE way to treat a XXXX Veteran & his young family! Where is the deference and financial freedom they market about? This is also likely to be retaliation for not taking the higher rate and cash out of the house. They do n't like it ( seemed surprised ) if you are n't going to take cash out. The quote wa s 5.25 for the note with cash out -- 4.25 without. They make a killing off that one percent! We had an active VA appraisal good through XXXX XXXX XXXX , and NewDay would not credit back us the {$480.00} we paid XXXX XXXX to buy that service. They advertise that the {$500.00} appraisal fee is paid by the company. So, why not credit it back to the borrower, if they already have it? But, they are n't reasonable people, and they do n't make reasonable decisions. I delivered many pages of documents the very next day -- in person. Then, the " account XXXX xecutive '' is told that they ca n't be hand-delivered, they have to be delivered with a tracking mechanism. Well, if you have the documents in hand, why the need for proof of how they got there? I had indeed read about the {>= $1 ,000,000} fine they paid to the CFPB not too long ago. That had to do with inappropriate behavior in advertising, so I thought I 'd give them a chance. If you, the co-borrower, or both are XXXX and are applying for the purchase or refinance using XXXX -retirement income, have a Chapter XXXX bankruptcy ( even fully paid and discharged ) and are not taking cash out of your equity in the house for purchase or refinance, then I suggest you avoid using NewDay to meet your financial goals. This company will drive you a bsolutely nuts with its repetitive, relentless, and sometimes needless documentation requests.

Dear CFPB, Please find my complaint against New Day USA, which is a TRADE name registered on XX/XX/XXXX by New Day Financial LLC, a Delaware Corporation located at XXXX XXXX XXXX XXXX DE New Day USA falsely poses as a " mortgage lender '' while NewDay USA does not have a Corporate Registration in Maryland ; or in Delaware or in MI where they offered adjustable rate loans. NewDay USA TRADEMARK was created by NewDay Financial LLC to avoid criminal penalties for predatory and deceptive lending practices ; mortgage fraud, kickbacks, identity theft, harassment and money laundering. In Michigan NewDay USA is listed as " assumed business name '' for NewDay Financial LLC while NewDay USA has no separate registration to conduct lending business in Michigan. During last week I was literally bombarded by refinancing offers from New Day USA impersonating as a " VA approved Lender '' and picture of Rare Admiral XXXX who purportedly personally signed these letters ( with his printed in blue ink signature ). Which is already a deception. The letter has a very attractive offer to get a huge cashout - {$54000.00} for my $ XXXX loan, significantly reduce my principal monthly payments, put thousands in the bank for my family and future, with minimal documents. In reality, Admiral XXXX operates the same mortgage fraud for a large investment bank who pays kickback to smaller predatory lenders to push borrowers in defaults. In XXXX Big Banks advertised adjustable rate loans with huge cash outs in the same manner. When borrowers were lured in such loans and were not able to repay it, Banks blamed borrowers for " buying too much house '' and " use house as ATM ''. This is exactly that Admiral XXXX does - sells veterans too much house, under adjustable rate ; and urge to use their homes as ATM with a guaranteed default. New Day USA do not disclose that this is an adjustable rate refinancing. It stated in a very hard to read font on the back of the letter, almost impossible to read, that " your total finance charges over the life of the loan may be higher '' - in other words, change unexpectably. According to Admiral XXXX, my " prescreened offer is based on information in your credit report '' I never gave Adm. XXXX any permission to pull my credit report ; and even myself I can not get information for my credit report without verifying my identity and my SSN. Adm. XXXX failed to disclose the source of my information. I assume he stole my identity using kickbacks to major credit agencies. Worth to mention, New Day USA is swamped with regulatory complaints for fraud and deceptive business practices. In XXXX New Day USA was kicked out from New York lending market for cheating on exams. In XXXX CFPB filed a consent order to cease deceptive business practices and kickbacks, resulted in {$2.00} million penalties in XXXX XXXX XXXX issued a warning to New Day USA to stop deceiving veterans with predatory loans. But mortgage fraud and money laundering mill by Big Banks who use companies like New Day USA to issue bogus derivatives and credit default swaps is so lucrative and attractive that even Admirals join the force. I respectfully demand investigation against New Day USA fraudulent and deceptive business practices ; revoke their license and permission to issue ANY loans to Veterans ; ban them from Michigan ; order to compensate veterans for harassment and deceptive practices and disclose where New Day USA got my personal information and provide me a copy of their valid corporate registration to legitimately conduct lending business in Michigan and in Maryland where New Day USA is purportedly located.

XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, NC XXXX XXXX New Day USA Address : XXXX XXXX XXXX XXXX, Georgia XXXX To Whom It May Concern, I have repeatedly asked this company to perform an escrow analysis on my mortgage account as I am grossly being over charged on escrow. This is the 5th written attempt along with numerous phone calls. They have ignored all. This led me to begin my personal analysis of my account leading me to find that this company has fraudulently kept funds from my escrow account with that amount not showing anywhere in my account. I contacted the XXXX XXXX, North Carolina Tax office to inquire about the property taxes on XXXX XXXX XXXX XXXX, XXXX XXXX, NC XXXX. They looked at their records and only showed one payment for taxes and it was not from New Day, but another Mortgage lender that I have a mortgage with paid the amount in full. I am showing no credit nor history for the monies New Day withheld in my escrow in that amount at the writing of this letter. The tax amount that was withheld {$1600.00}. I have also provided this company with a new hazard insurance policy that has lowered the overall price of the insurance and increased the amount the dwelling is insured for well over their required amount for hazard insurance. They have done nothing to adjust my escrow payment. I also paid to the escrow {$900.00} for this insurance to help cover the some of the annual cost. They have done nothing to adjust the payment on their end causing me to way over pay based on their analysis. I also provided their company with an elevation certificate showing that the dwelling is not in a flood zone and that their company fraudulently required me to obtain flood insurance when not necessary. Costing me thousands of dollars and continued to harass me through letters stating that I did have enough coverage when no coverage was needed. New Day also listed me as 30 days past due on my mortgage for the month of XXXX. The letter that the mortgage payment had been increased was received on the XXXX of XXXX at my mailing address. I was XXXX and had recently returned from being XXXX XXXX service with the XXXX XXXX in support of a certain operation that had occurred. I did not receive the document until XXXX XX/XX/2021. I had paid their company the mortgage payment of {$1000.00} as it has been that payment for quite some time. New Day received those monies on XXXX XX/XX/2021. I called trying to pay the amount that they had increased the mortgage too and was unable to execute at that time since their company was transitioning to another mortgage servicing company and they could not see my account. Again, I had just returned from a XXXX and having to deal with this fiasco. I was not able to get the account up to date until XXXX XX/XX/2021. Numerous phone calls were made during this time requesting another escrow analysis. Nothing was done. As of the date of this letter I am mailing a copy of this to my attorney, I will also be filing complaints with my state regulatory agency and veterans organizations as well. To include the SCRA. I am emailed a copy of this letter to their company, and SCRA along with various other agencies along with supporting documentation of my attempts to correct these issues. This company has misappropriated funds from my account. I have that documentation as well and will provide all to a secure site as it has my personal information. XXXX XXXX XXXX

In the beginning of XX/XX/XXXX I conducted a online search of refi-mortgages. I was contacted by XXXX XXXX from New Day USA. He convinced me he could do everything I had in mind to include lowering my interest rate to 3.75 % and supply cash out to reduce make home improvements and reduce credit card debt. Because it was a VA loan, I could get 100 %, ( per their television commercial ), of the appraised value. After submitting all required paperwork and having the home appraised, I was told everything was fine. I was contacted later and told that because I, (? ), had not locked in the rate, the rate was now 4.25 %, ( my present rate ). I was furious to say the least. They told me I had to send them a email requesting I lock in the rate. I was NEVER told that. I thought about for a few days and sent the requested email. After that ALL communication ceased. This company pulled my credit af least 2x lowering my score. I left numerous messages with XXXX that were NEVER returned despite his claim he attempted to call me. ( I have my phone records ). I called numerous listed numbers for his company and they ALL led to HIS voicemail. I finally reached a customer service representative who could not help me because all I had was a loan application number, NOT a loan number. Finally, TODAY, I reach him. He claimed had tried to reach me several times. My phone records will support just the opposite. He also had my spouses number AND our email addresses. Now he claims the terms of the loan have changed yet again. His claim was that I told him my house was worth $ XXXX. I said no such thing. What he neglects to mention was that he was aware of the appraisal amount, ( $ XXXX ), which was submitted to him PRIOR to offering the final terms of the loan. It HAD to be to set the terms of the loan. Even after he had the appraisal, he stated there was no problem. Now today, he tells me they can only do 90 % of the home value. Do they even watch their own television. commercials? They clearly state 100 % of your homes value. THEN, while going through the mail today, I get a letter from XXXX XXXX insurance changing the mortgage company from my present company to New Day. HOW? I never signed any closing documents, never agreed to any terms or received any funds. I contacted XXXX XXXX, ( through XXXX, my primary insurer ), and they were shocked. XXXX XXXX has now placed a note in their system to contact EVERY customer prior to switching any insurance coverage to New Day USA. There is now a story on XXXX XXXX, ( XXXX ), that the Feds have placed several companies on a watch list for " churning out '' VA loans. One of those companies is, you guessed it : New Day USA. The retired XXXX XXXX XXXX who poses as a spokesman for this company should be embarrassed, ashamed AND held responsible for false advertising practices. This company has clearly broken Truth In Lending laws as well as false advertising. The Veterans Administration needs to take punitive action against this company. The Department of the XXXX needs to conduct a investigation in the conduct and behavior of one of it's senior retired officers who does his best to intice veterans to do business with a company whose practices are currently being scrutinized by the Federal Government.

In order to take advantage of the lower rates, I decided to refinance my current mortgage. NewDay USA had been advertising refi 's for veterans with no income verification, no appraisal and no out-of-pocket cost. This sounded attractive so I began the process on XX/XX/XXXX. The actual application date is XX/XX/XXXX. My house is currently valued at @ {$180000.00} with an existing mortgage balance of {$75000.00}. My credit score was XXXX and my wife 's @ XXXX so no problem there. During the application process I was told that with an equity position of 40 % loan-to-value no appraisal would be required, however, later in the process I was advised that an appraiser would becoming to do an appraisal. Also, as documents were requested to support the application I was very timely in providing the documents. later in the process on more than one occasion i was asked to provide documents that had earlier been provided. This happened more than once. Finally, during the week of XXXX I was told that we would be able to close the loan on XX/XX/XXXX. Because of a death in my wife 's family I asked that wee delay closing until XX/XX/XXXX. Closing was set for XX/XX/XXXX at XXXX XXXX. Earlier in the process I was asked to provide the name and contact information of a closing attorney. This information was promptly provided. On the morning of XX/XX/XXXX I went by my attorney 's office to validate closing time. They had received no information relative to the closing. When I returned home I called NewDay and was told that closing would not happen that day. I was again asked to provide information I had submitted earlier in the process. Somewhat irritated I did this. During the week of XXXX I received electronic disclosures to be signed before closing. These were signed and promptly returned. Then the week of XXXX, I received more electronic disclosures with no instructions. I finally contacted the processor and was told why new documents came. These were signed and returned and a promise that closing could occur soon. Finally was told that a closing notary would come to my house on XX/XX/XXXX, and documents were signed. As of today, payoff to the first mortgagor is still pending. If payoff does not occur before XX/XX/XXXX the mortgage will be late and late charge due. Not only do I not want to pay a late charge but I have never had a late payment in my life. ( Now XXXX years old ). So what is my complaint? First of all, a refinance with less than 50 % LTV should not take 3 months. A borrower should not have to continually provide documents a second time that have already been provided and I am not real happy with the potential impact to my credit history because of the delay in paying off the first mortgage,.

This is my complaint which i have also filed with the XXXX, MD Office. I have also sent a copy of the below complaint to my Congressman. They are not helping Vets they are lying to them saying you do not qualify for a 3.5 percent loan for cash out. When every other home loan company rates are 3.5 with cash out. I 'm writing this in hopes of warning fellow veterans to look into alternative Mortgage Institutions other than NewDay USA mortgage loans. After submitting required loan documents, I was pleased with the progress of the loan process until I received a copy of the Loan Estimate. NewDay USA gave me an interest rate of 4.2 and 4.7 when the prevailing VA interest rate was at the 3.50 percent. After receiving this information, I contacted XXXX other reputable loan companies and also filed for a VA mortgage loan. Shortly after I received both Loan Estimates, they were surprisingly lower at 3.50 ... Same credit, same loan amount, same loan duration. I was also told that the reason my rate was at the 4.7 was that i had take the XXXX percent financing, however when she looked at my loan she discovered that i was not taking XXXX but XXXX percent. So, she quickly change to another topic. I called my loan representative back from NewDay USA and asked why was my loan interest rate so high. The rep stated that the VA rates we carry are at the 4.5 level and if I wanted a lower rate, I would have to take loan without the cash out option. When pressed on the various details of their loan estimate, my rep became evasive. My loan was cancelled. Now i 'm currently in the process with a new company to obtain a VA Loan with the cash out option. The Loan Estimate i received with this company is at the prevailing VA rate of 3.50 %. My Fellow Veterans - NewDay USA seemingly pride themselves of having Integrity and promotes giving back to service members and veterans. However, please be careful and shop before trusting any company, especially NewDay USA. Please review your " LOAN ESTIMATE '' very carefully before signing closing documents. If your rate is substantially higher then the prevailing VA rate, " Do n't Sign '' those documents. The President, CEO, COO, and Board of Advisors should be ashamed of themselves for misleading VETERAN. Veterans expect more from a company that represents themselves as being the brightest military minds of our generation. Members who know the needs of veterans but instead of helping veterans they take advantage of them by charging outrageous rates for VA Home Loans even when the prevailing VA interest rates are lower. I believe this matter needs to have a congressional leader involved.

In the early part of XX/XX/2021, I sought to refinance my VA loan to take advantage of the equity in my home. Due to hearing ads on the radio, seeing them on television and the internet, and because of the constant barrage of mailings I receive at home, I decided to give NewDay USA the opportunity. I filled out the form online, and was contacted by an XXXX XXXX to begin the process. For nearly a month, I ensured all of the documentation I needed was obtained, the termite inspection was completed, and everything else required of me was done to satisfy the needs of the lender in order to move forward with the refinance. I was contacted by XXXX within the first week of XX/XX/2021 to ask about a loan modification that I recently made to my current mortgage. I explained to him that because of the COVID pandemic, and the uncertainty that so many of us felt, I took advantage of a forbearance program offered to me by my current lender, XXXX XXXX. I detailed how the uncertainty of sustained employment and being able to meet my financial obligations led me to participate in the program, and due to the legal Avenue available to me, I was granted two three-month reprieves in making my mortgage payment. At the end of that six month period, I was to participate in a trial loan modification ( which lasted three months XXXX, and at the end, resume a new mortgage with a modified payment. I met all of the requirements and was NOT delinquent in my mortgage payments, as the COVID relief legislation mandated/authorized, and my credit score was not adversely affected. However, because of this participation in the loan forbearance and the loan modification, I was denied credit, despite the countless assurances from XXXX that things were going smoothly and that closing would happen sometime in the middle or near the end of XX/XX/2021. Fast forward to today, XXXX XX/XX/2021, when I received in the mail a letter from NewDay Financial with the heading Notice of Action Taken and Statement of Reason ( s ), Statement of Credit Denial, Termination or Change stating that I was denied credit because of one checked box : Delinquent past or present obligations with others. This denial reason is a fabricated and blatant XXXX as I met all of the legal requirements authorized for me to use and WAS NOT delinquent in my mortgage or any other debtor/creditor through out the COVID pandemic. I find this type of lying, deceit, and downright dishonesty despicable, and NewDay should be held accountable for their false and fictitious XXXXXXXX

Denial of mortgage Re-Fi opportunity due to false information. Deceptive information and claims regarding denial. Loan officer ( XXXX ) stated loan denied based on derogatory information reported from XXXX XXXX on or about the XX/XX/2021 which is protected by the Cares Act. Loan with XXXX XXXX was amended to reflect a new maturity date. Loan was never delinquent or pass due at anytime. Spoke to XXXX XXXX to ensure that it was not reporting negative on my wife and I credit report. I also pulled our credit reports to verify. XXXX stated he called to advise, never happened. Stated denial letter was mailed around that time, never received. We then sent emails for clarification regarding the specifics of the denial that was never answered on or about the XX/XX/2021. Left several messages to return calls to no avail. Spoke to XXXX, stated would look into the matter and return call, never did. Spoke to XXXX on or about the XX/XX/2021, stated would have XXXX manager call me back. Again no call. Received denial letter dated XX/XX/2021 with bogus information on the reason for denial. Was not the supposed originally dated denial letter. Pulled credit reports to reflect the correct information. Never received originally dated denial letter. Need answers to why I could not speak to the department that provided the erroneous information, why I was not contacted regarding denial until the day before settlement ( XX/XX/2021 ), why veterans are treated by this organization with this level of deception, why I continue to receive solicitations from this company even after denial, why are they allowed to send incorrect credit reported information, why I received a denial letter dated the XX/XX/2021 when I requested the original letter sent via email, what corrective measures they have in place to correct this disservice to veterans, what are they going to do as an organization supposedly supporting veterans to correct this wrong, why have, after requesting the direct mailing address for the Board of Directors not provided? Request made via website. What are they going to do to provide re-fi services to my family and I. On or about the XX/XX/2021, I contact the XXXX who as of XX/XX/21 have not yet received a response back from them. Did receive a call from XXXX who stated was XXXX manager, he could only apologize for no one getting back to us. All other concerns still remain. The company in questions is New Day Financial Services.

I applied for a VA Interest Rate Reduction Refinance Program mortgage loan through NEW DAY Financial LLC Prior to closing the loan. I asked my loan officer about a two-tier Va Loan due to reasons that I had just found out about. The loan officer did not respond in a timely manner and I needed to talk to someone that had knowledge of this process. I went to another company and they explained everything to me and got me Preapproved for my move to Florida, I closed XXXX XXXX, XXXX with New Day Financial. For MY XXXX Loan and Later found out from my XXXX XXXX XXXX that I had signed a Occupancy Statement with New Day Financial stating that I will Occupy the property as my principal residence within 60 Days as of the date of closing in compliance with the terms of the Deed of Trust Mortgage/ Security Instrument relating to the subject Property, and I would continue to occupy the property as my principal residence for at least one year after the date of occupancy. Unless Lend otherwise agrees in writing or extenuating circumstances exist which are beyond my control. I have been the owner and primary residence since XXXX XXXX, XXXX, I called my loan officer at New Day Financial and explained to him that for medical reasons I needed to move to a warmer climate and I had found a home in Florida in which I can spend my winter months and I needed a release of occupancy from New Day Financial, because under the VA two-tier the home in Florida would become my principle residence and my home here would become a second home. The loan officer told me that do not or never have issued a letter of XXXX XXXX and they would not do it. Under VA XXXX rules the VA explained me that I had met my Occupancy Requirement under VA XXXX and Regulations and so I was now confused. If they never do a XXXX XXXX. How can they have me sign a XXXX XXXX that says otherwise. I do not have any Prepayment Penalties, so If I wanted to sell the home and pay off the Mortgage it was ok. It Just do not add up. the XXXX XXXX does not understand what they are talking about. The new Loan Company that is Funding my House is asking for The Occupancy Release and I am totally confused. I have a preapproval Letter from my New Mortgage Company, I found a nice home had my inspection, and XXXX, flew to Florida, rented a Car. Thursday - XX/XX/XXXX -- In response to a direct mail invitation, I contacted XXXX XXXX XXXX about the possibility of securing a loan. I voluntarily gave the Account Executive background information that would have been needed to apply for the loan. At the end of the conversation, I implicitly told the Account Executive that I did not want to proceed any further than the phone conversation at that point. Before advancing any further, I wanted to talk to my husband. That evening I discovered that a credit inquiry was made on our credit reports. This was done even though I specifically requested no further action. In addition, one of their statements on another website : " New Day is required to reach out to the spouse, as well, in order to confirm their intent to be part of the application. '' At no time did they reach out to my husband, yet they did pull his credit report. I immediately contacted the Account Executive and he said I had given them approval to pull a credit report. I firmly told him that my request to hold everything until further notice at the end of our conversation was proof that he should not have proceeded any further with our application process. He also wrote back a sarcastic email ( almost bullying ) that : " Hopefully you will be able to address your current $ xx, xxx of credit card debt on your own and avoid another short sale situation. '' This was unnecessary harassment. My application was withdrawn and his manager called me. Friday - XX/XX/XXXX -- I told the same thing to his manager that the process should not have proceeded to a credit report. He insisted that I gave my permission to do so. He also told me that the hard credit inquiry was no big deal, unless we were going for an auto loan. I immediately told him that was exactly what we were planning to do on the following Sunday, which is why I specifically told them to HOLD the application. After a brief conversation, he said I would be contacted by a Compliance Officer. I am still waiting for that to happen. Saturday - XX/XX/XXXX -- Sent a Certified Letter to New Day asking them to withdraw the credit inquiries. I feel the company should be marked as one that is dangerous to deal with since their Account Executive wrote an email that was high pressure and belittling. In addition, the manager I spoke with tried to trivialize the fact that a hard inquiry was made.

A man from New Day Financial named XXXX XXXX called me directly in XXXX. He told me that they have a program for XXXX veterans. He told me they have 2.25 % interest rates on VA loans and they can get me that rate on my loan. I asked what it would cost me and he said it would n't cost me anything at all. I had been in my house for 21 years paying my mortgage and I thought I was almost done paying my mortgage. He did n't tell me anything about refinancing my loan, he just told me my interest rate would lower. I would n't have wanted to refinance because I did n't want to have to pay for another 30 years since I thought I was almost done paying my mortgage. If he had told me it was a refinance, I would not have wanted it. I trusted him because he told me that he stands for veterans and is there to help veterans. He sent me papers to sign and told me I had to sign them very quickly because the interest rate could change any minute. He sent a notary to my house with yellow highlights where I had to sign. The notary told me that he was in a hurry so he rushed me to sign then took the papers with him. He was only at my house for XXXX or 15 minutes and told me he would notarize my and my wife 's signatures later. Then he told me I would get the documents back later. I got a stack of documents but they did n't have my signatures. After that I had to pay New Day a higher mortgage payment for 12 months. XXXX XXXX told me that 's how New Day keeps helping veterans by taking payments for 12 months on the loans they make. I made the payments to New Day but I still did n't know I had refinanced. After 12 months they turned my loan over to another servicer XXXX. Now I 've learned that New Day was refinancing my loan, and refinanced it twice in XXXX and XXXX without explaining to me what was happening. Now my loan balance is much higher than I thought it was and higher than I thought it should be, and now my mortgage goes all the way until XXXX even though I 've been paying for 25 years. I feel like XXXX XXXX and New Day misled me and got me into a situation that I did n't want. He told me it would n't cost me anything, but it has cost me a lot. And my interest rate is 4 %, not 2.25 % like XXXX XXXX said. I have tried contacting XXXX XXXX since XXXX but I have never been able to talk to him again.

We initially began the process of obtaining a refinance for our home around XX/XX/XXXX with XXXX XXXX XXXX loan company for Veterans. After being approved we decided that instead of refinancing we were going to purchase another home. This process began on or around XX/XX/XXXX. We found our new home, put in a bid, which was accepted, and subsequently put our home up for sale in XXXX XXXX. Each day our loan officer ( XXXX XXXX ) contacted us ( on his recorded line ) while we were working, for data and information, which was given with no issues. When they ( Underwriters ) found out that we own a business our personal information was no longer sufficient and they began requesting tax returns for the last two years ( XXXX & XXXX ), and W2s for XXXX. This information was requested s to see if our business had taken a loss even though our W2s showed an increase in our salary. They then indicated they could not accept the W2s for XXXX stating that as business owners we could have forged our W2s and therefore requested our XXXX tax returns and profit loss statements on XXXX XXXX. We informed them that our taxes are not due until XXXX XXXX as we legally file for an extension every year which is on record, and would not be able to provide them. All W2s for XXXX were submitted to the IRS and we asked them to request the info needed from the IRS as verification. They indicated they don't due this and for that reason they will not service our loan. We began this process in XX/XX/XXXX and on XXXX XXXX, 12 days before our closing we were notified that they would not service our loan. Throughout this process we were continually told that there were no issues, while our loan officer went back and forth several times a day asking for more documents, info, credit ... etc. They cost us to lose our initial interest rate of 3.875 % because they did not lock in our rate. The rates are rising everyday and we now are subject to higher rates. At this time we are scrambling to find a new mortgage company to service our loan while having to be out of our home on XX/XX/XXXX. We will also be contacting a lawyer to look into this matter. Totally Unprofessional and Unethical. Not a good representation of how Veterans are handled.

I got mad and and told her I HAD NOT GIVEN HER PERMISSION TO DO SO and explained the damage that it could do to my already shaky credit. she said that because it was so close to the report that XXXX XXXX pulled, that it would do no harm. My home mortgage is serviced by NewDay USA ( XXXX XXXX XXXX XXXX, Georgia XXXX : XXXX ). In early XX/XX/XXXX I received a letter from NewDay ( dated XX/XX/XXXX ) informing me that my escrow account had an overage and that I would be receiving a check for the excess amount shortly. As of XXXX XXXX, XXXX I have yet to see the funds for this disbursement despite many calls over several weeks to NewDay ( at least eight calls ). Every single action NewDay takes requires several days of processing with little to no follow up. My request to speak with a manager was met with the submission of a ticket which took several days to process and the manager I spoke with insisted that she was unable to speak with the department which issued the refund checks ( she said she could submit a request which would take several days to check on the status ). The manager even told me that me that once the check was mailed " it is out of our hands and there is nothing we can do. '' She had no response when I asked if the same standard applied to my mortgage payment which I've remitted on time over the course of the loan. Doesn't XXXX have a legal responsibility to return my escrow excess to me? When I asked if it was possible to transfer the money electronically ( using the same account I send them my monthly mortgage payment ) another representative told me that they could submit a request which would take a week to process. Other issues I've had with their customer service include the phone picking up but hearing nothing but children playing in the background ( I could hear the kids playing and calling each other by name ), phone picking up then getting nothing but static and random people talking, and calls being dropped. Overall NewDay Financial has had the worst customer service of any financial institution I've ever dealt with. The way they've handled the disbursement of my escrow payment strikes me as a company that is cutting corners wherever possible and may not even have the money to disburse in the first place ( that's why I'm getting such a run around ). They are either incredibly dysfunctional or plain dishonest.

In XX/XX/XXXX my wife and I applied for a refinance mortgage with New Day Financial. The application was conducted over the phone, and I did not disclose any demographic information. The agent told me that my application was denied because I had one 30 day late payment on our current mortgage within the previous 12 months, and my credit score was not high enough. He told us that if we can keep our payments current for the next twelve months and re-apply in XX/XX/XXXX, we could qualify for a refinance. Fast- forward 12 months to XX/XX/XXXX. My credit score improved and all my payments were kept current. Based upon the information I was told, I had confidence that I met the qualifications to refinance with New Day. I called New Day to re-apply for a refinance. This time we revealed that we were XXXX in the demographic disclosure part of the interview. We were told that my wife still did not improve enough to qualify, but my credit met the qualifications. However, before we could proceed further with refinancing with just me, the agent told us that he " was being called into a meeting '' and he had to call me back later or the next day to follow up. The next day I received a call from the agent informing that my application was denied due to a previous delinquency ( 120 days ) on the same mortgage that occurred four years ago. The agent told me that New Day will not approve applicants who had were delinquent on their mortgage within 5 years. I explained to the agent that this was not what I was told when I applied a year ago, and had I known I would not have wasted time applying now. The agent suggested that the previous agent was not fully informed on the requirements and apologized on his behalf. I suspect foul play based on ( 1 ) how I was rushed off the phone before I was made an offer, and being disqualified for a different reason that was not claimed the first time I applied for a refinance ; and ( 2 ) since I revealed my race on the second application and withheld it on the first application, my creditworthiness was further scrutinized.

On XX/XX/XXXX, I submitted a request to XXXX XXXX to refinance my current mortgage, and combine it with my 2nd mortgage. On XX/XX/XXXX, I received an email from XXXX XXXX containing a list of documents required. On XX/XX/XXXX, I sent all the documents he asked for via email. I had already received a XXXX package at my home address. It contained documents my husband and I needed to sign and send back. So, on XX/XX/XXXX, I talked to XXXX XXXX and he told me which documents needed to be signed. On XX/XX/XXXX, I scanned and emailed all the documents he asked me to sign and send. He confirmed receipt of these documents in a phone call and told me an appraiser would be calling. On XX/XX/XXXX, I emailed XXXX XXXX asking about the appraiser since I had yet to receive a phone call. In that email I mentioned I was getting repeated XXXX area code phone calls, but they never left a message. I asked if he thought that was them. He emailed back stating that number was him and could I please call him. I immediately called him ( same day ) and he informed me that he had made a mistake. He had thought I lived in XXXX County, but he now is noting it XXXX County. He asked me to verify this, which I did. He then said he was very sorry, but XXXX XXXX does not have an office in XXXX County, only XXXX County, so XXXX XXXX could not do business in XXXX Co., thus could not service my loan. I am extremely suspicious of this response and can find no evidence on their website or anywhere else to verify this. Please provide assistance with this matter so I am able to understand why I had to go through all the work I did, wait well over a week to know this information. He called repeatedly using that XXXX area code, but never left a message, even a quick " call me back ''. It was outrageous. Thank you for your attention to this matter.

On the XXXX of XX/XX/2021, I applied to NewDay USA to refinance my home and take advantage of the equity I have available to me. However, I found out today, XXXX XX/XX/2021, that the underwriters were not willing to approve my loan application. Im currently using XXXX XXXX as my mortgage lender, and have been perfectly happy, but after seeing ads for NewDay online and in mailings, I decided to pursue things with them. I gave XXXX XXXX XXXX my account executive ) all of the information to proceed - paystubs, W2s, VA eligibility documentation - the whole kit and kaboodle. The plan was to refinance for 30 years, and pay off a significant amount of credit card debt. But because I took advantage of COVID relief programs legally available to me, and subsequently doing a loan modification, NewDay declined to have me as a customer. What is morally and utterly reprehensible is that someone who ( along with millions of others ) didnt know what COVID was going to do for their livelihoods and careers/jobs, partook in the generosity of their lender to take part in a forbearance option. I was in forbearance for 6 months, and at the end, took part in a trial modification for three months, which led to my current loan. But because NewDay didnt like the fact I did all of those things - all of which any smart person would do in times of uncertainty - they opted not to continue with the processing of the loan. NewDay and its underwriters need to change their practices to not look negatively at someone making the right decision for them when it comes to their home. Ive never missed a payment, and have always treated XXXX XXXX XXXX XXXX XXXX right, but NewDay didnt view it that way.

As a XXXX veteran, I applied for a mortgage loan through NewDayUSA for a property my wife and I have been renting for 5 years. From the very start, I was suspicious, because he asked me my race. When he ran my credit, he said it was n't sufficient after giving me my scores, which were XXXX , XXXX , and XXXX . I know this to be inaccurate, which I expressed to him. So, from there the harassment began ... I was constantly faxing the same documents over and over again to him. During the process, I had to prove my wife pays XXXX of our XXXX car notes. I provided proof she does, and had been for XXXX , not to mention XXXX consecutive months of payments. All the payments were current!! ... with none being late 30 days or more. Truthfully, she would split some of the payments up, but it would all be in the same month. In addition, we had to submit her bank statements, showing the money was coming out her account. They also wanted us to contact the lender, and get a transaction history to sent to them. Please keep in mind, when they ran my credit, it shows the loan to be current, because my name is on the car loan. The purchase price of the home loan is {$60000.00} and my monthly income is {$3800.00}, so I was just FLOORED when he called me on X/XX/2017 and said ... '' we 're unable to move forward with the loan ''. After meeting ALL the requirements, this is a slap in the face. I say this, because the underwriter 's reason for the loan disapproval was, my wife might stop paying the car note for some reason. THIS IS LUDICROUS!!!

NewDay USA Issues timeline : 1. Promised to close in about 2 weeks XXXX XXXXBasic numerals to close provided. 2. Up to XX/XX/XXXX many attempts to contact email, voicemails etc ( little response ) 3. Around XX/XX/XXXX after numerous attempts to make contact the Assistant Vice President Loan Origination tells me that the previous employee was fired. 4. Now requests to unfreeze my credit so he can pull a 2nd credit report? 5. Said he was going to handle the issue personally, about a week or two later then requested again my credit be unfrozen ( 3rd time ). 6. At this point I also requested my loan numbers as I had little faith in what was going on and they were going to buy done points ( etc ) I just just wanted the current/simple numbers as my trust in them was going down with every interaction. 7. No response for over a week and on XXXX almost 2 moths later the numbers were approximately 10/12k higher than first quoted. 8. On XXXX ( Friday ) left a message that I should be his first call on Monday to explain the delta between the two quotes. Assistant Vice President Loan Origination 9. OnXX/XX/XXXX he finally got back with me well over a work week. ( Insanely ) I explained to him that I no longer needed his services and already started a new loan with another company. This company was .25 % lower rate and 10k more cost effective ( basically what I was promised ) by them at the beginning. I already have a closing date and completed my appraisal and everything else ( in a week Ill add ).

I have paid my home mortgage in full, I received a letter saying that it is paid in full, on XX/XX/2021. Later in the month I received a phone call stating I still owed {$150.00}, because I had to stop payment on a check. I asked if the {$150.00} would take care of everything. I was told it would be a XXXX XXXX. Next I received a Partial Claim Agreement to be notarized and returned to New Day, for a Hardship Loan. I called the number XXXX, someone stated I owed {$30.00} fee. I questioned that because I was told, the {$150.00} was all that was outstanding. I asked to speak to a supervisor, but was not allowed to speak to anyone. I called back later in the afternoon, spoke to XXXX XXXX. She said she considered the loan paid off, I had a letter stating that and to disregard the Partial Claim Agreement. After that a XXXX XXXX called about the Partial Claim Agreement, about mistakes that may have been in the agreement, something to do with VA loans. I did not understand what he was talking about or why I received the Partial Claim Agreement, since I considered my loan to be paid in full. I called New Day to follow up with someone, I talked to XXXX XXXX XXXX, she again stated there was a {$30.00} outstanding fee. I would pay the fee if that was the only thing owed. She put me with XXXX XXXX XXXX to pay the {$30.00} fee. I was not able to pay the fee. XXXX XXXX XXXX, New Day, I. XXXX XXXX XXXX, phone number XXXX. He confirmed that I tried to pay the fee of {$30.00}, but was not allowed too.

On XX/XX/XXXX, I contacted NewDay USA to ask questions about a mortgage refinance. While discussing with the representative XXXX XXXX, he asked if he had permission to run my credit. I told him no, that at this point I was not ready to go forward with the application. We continued the conversation briefly and then the call was terminated. After roughly one minute of the call ending, I received notification from XXXX that a hard inquiry had been done by the mortgage broker for NewDay USA. I called back and spoke to XXXX again and he said that he did run my credit without permission and I would need to dispute it, or asked if I would like to hear the rates I qualified for. After speaking with XXXX, I asked for a supervisor at which point I was forwarded to XXXX XXXX. XXXX agreed that what was done was a clear and direct violation of the Fair Credit Reporting Act yet had no remedy for the impact on my credit. XXXX also explained that since people do not usually say no to having their credit ran, a lot of times the representatives just click yes and proceed ahead with the application prior to having the approval. These are serious implications if a lender that has designated themselves to be a trusted lender for veterans is actually violating the FCRA consistently. Both XXXX and XXXX tried to inform me of the rates I had qualified for with the illegal credit check instead of offering solutions to the inquiry that XXXX had done without authorization.

I was thinking of refinancing my VA mortgage. I called a few brokers and they quoted over the phone and via email some rates. I decided to call XXXX XXXX, I have seen many of their TV ads. I talked to a XXXX XXXX XXXX XXXX over the phone and asked him to quote his rates for a 30 yr fixed. He informed me that he " did not have the rates '' but if he asked me a few questions that he could give me those rates. I informed him of my approximate credit score and told him that all I want is the rates. I told him I did not wany him to run my credit, He told me that if my credit score was as high as I said that running a credit check would not change them. I gave him the info he needed and after he gave me the rate I told him that I was not interested as the rate was 1 point higher than some of the rates I was quoted. Under no circumstances was I interested. 3 days later I received an loan application all filled out with a loan number, as if I was applying for the loan. They did not even have the courtesy to mask my and my wife 's SSN, I then received a phone call from them asking why I withdrew my application! They have sold my info to other companies because I am getting a phone call from other companies almost daily.I was never told nor did I give them permission to fill out an application, I am sure this effects my credit score and history, they had no right to do this, I feel they are taken advantage of veterans.

Hello, XXXX : New Day XXXX is scamming folks into using their services ( at a minimum ) I am a proud XXXX XXXX military member. As such I was recently deceived by a letter from a XXXX XXXX XXXX XXXX XXXX. The return address and much of the company marketing upon opening of the letter very clearly identifies myself as a veteran and authorizes a large sum of money with a mock check totaling up to {$60000.00}, signed by XXXX XXXX XXXX XXXX ... a civilian who's military background has absolutely zero to do with a mortgage company. This extremely unscrupulous and deceptive leverage of his former pay grade is a disservice to veterans ( fact ) and the legacy our warriors throughout the history of this great Nation have fought to preserve ( my opinion. ) Unsurprisingly the phone number within the document did not reach this XXXX yr old XXXX and the return address is not his residence. The same address is clearly marked by a XXXX XXXX XXXX headquarters on the business ' website. I may not be a XXXX XXXX but I know right from wrong and this is obviously wrong. Tighten up " XXXX. '' Honestly, forgo your own legacy XXXX XXXX and XXXX XXXX. Tell your lies to your own family and loved ones, don't send this garbage in the mail to mine. Take your hat off of the hook you put it on because it isn't worth a XXXX. Another red flag is activation codes on everything that can be used as a complaint vector.

NewDay XXXX Financial was working on a refinance of my mortgage. At the time I was no longer employed due to a XXXX Related & VA Established XXXX and Workers Industrial Insurance " Work-Related '' Injury that required XXXX surgery. My workers compensation biweekly payment ranged around {$2100.00} ( or as an annual income {$54000.00} ). This compensation would have continued until XXXX of XXXX venues occurred either I recovered from the surgery and went back to work or the surgery failed I was placed on XXXX a little higher then this compensation. Instead I was told that, while they would accept an individual receiving social security XXXX and VA XXXX they would not accept workers compensation payments, even if over {$50000.00} as an annual income. They stated that there was no guarantee that this funding would continue. Now I have a problem here as there is no guarantee on any of the funding I draw ; XXXX retirement can be discontinued by the federal government at any time ; VA XXXX could be cancelled at any time ; and my possible employment in the construction field could start and stop within a month if the client cancelled the project. There are no guarantees on anything but industrial insurance has a better control then all then others. There are specific conditions that have to be met to stop payment. So why was over XXXX of my total annual income essentially tossed out ...

I would like to bring to your attention the unethical Veteran 's Administration ( VA ) mortgage loan procedures of NEWDAYUSA mortgage company. I have had VA mortgages in the past and I am looking to refinance my current mortgage which has {$57000.00} remaining principal at a rate of 3.75 %. I answered a mailing from NewDayUSA which said NO appraisal was needed. One of the first things the agent said was " There will be a {$500.00} to {$600.00} appraisal fee, but we will pay it and add it to the closing costs. '' I was offered a 30 year {$150000.00} loan at 3.5 % to pay off the current 15 year mortgage, and {$15000.00} in other debt ; plus cash for remodeling. The agent than listed the fees and closing costs : a {$7700.00} fee that the VA supposedly charges! ; {$4000.00} escrow ; {$2900.00} title and other closing costs ; {$2100.00} fee that NEWDAYUSA charges ; {$4300.00} fee that was not explained. Total {$21000.00} in closing costs. NewDayUSA 's offer was a 30 year loan with a principal balance of only {$20000.00} more than my original mortgage principal which is a 15 year loan ( {$150000.00} vs {$130000.00} ; and payments would be {$40.00} more than my current monthly payment ). NEWDAYUSA is scamming veterans and needs to be investigated. I am aware that mortgage companys add costs to the loan balance but these fees are totally unreasonable. Something needs to be done.

At the end of XX/XX/2020 our mortgage with New Day USA XXXX XXXXXXXX XXXX ) was transferred/sold to XXXXXXXX XXXX but on XX/XX/XXXX both companies withdrew my monthly payment of {$1800.00}. I believe the error was on New Day USA 's end because they had told me that the payment withdrawals would stop at the end of XXXX. Despite repeated calls to them I have not been able to get the money back. I am a Veteran and could not afford to have two mortgage payments come out of my account so it overdrafted onto my credit card. I will now have to pay interest on the credit card for that amount. At the very least I need the money to be credited back to me as well as a penalty payment to cover the interest on my credit card and the time lost due to multiple calls to both companies and my bank to try to get the money back. I have attached copies of the monthly statements from both XXXX XXXX and New Day USA as well as the transactions from my bank account that show the payments coming out of my account on XX/XX/XXXX and XX/XX/XXXX. I would also just like to say that I have spoken with New Day USA XXXX XXXX XXXX XXXX multiple times in an effort to resolve this and they have been very unhelpful to the point of being rude. This kind of treatment of anyone let alone veterans is a disgrace.

Starting with phone conversation the representative was n't truthful. I was told payment could be Scheduled on line free of charge. This is not true they charge you for paying on line. I thought I was doing business with New Day Financial as I was told. Then a few weeks after closing I received a check for $ 1500.00+ & change from my home owners insurance company I called them to ask why they informed me insurance had been paid two times. I called mortgage company they said they did n't know anything about it. I put check in bank & saved it in a couple of months I got statement from a loan servicing company That New Day turned me over to but say still is New Day. They informed me I owed {$1700.00} or payment would go from {$800.00} to {$960.00} per month. I asked when I only got {$1500.00} check why did I now owe {$1700.00} they said that 's way they operate. Now my payment went from {$800.00} to {$820.00} per month! In my opnion I 'm being taken advantage of. My loan is VA & I 'm in my XXXX do n't have lot of money to fight these people with so I 'm hoping since it is a VA loan I can get government help. NewDay USA rep erroneously stated that I do not have an existing credit file because he is a rude rep in my opinion and doesn't appear to have any integrity. This company continued to pursue me for loan even after there false statement concerning my credit report. The statement is extremely inaccurate. I explained to the rep Mr. XXXX XXXX on numerous occasions that I am currently in a loan and have had a credit report for almost 40 years and that I am in a VA loan currently yet he insisted that I am a " XXXX XXXX '' on all credit reporting agencies sites. This statement is false as I have just closed a personal loan and I am in the process of refinancing my VA loan. I told Mr. XXXX on XXXX that I am refinancing my loan through my current loan provider and yesterday, and today I got a denial letter stating I don't have a credit file. I think he and ND felt rejected and this denial letter was their way of retaliating. They ( NewDay ) were even XXXX enough to write down what I know to be false. My fiance and I currently own a home together, we have for the past 3 years. Our names are held jointly on both mortgage loan and title. Not being legally married was not an issue with my current lender. We are in the process to refinance with a VA backed loan. We applied jointly for the VA loan, and were denied on XXXX XXXX, XXXX since we are not legally married. So, we went ahead with the loan application with only my fiance 's name on the mortgage. I was told that since both of our names are already on the title of the house that that wouldn't change ... my name would still be on the title of the home, but not the refinance loan. I was ok with that. But I get news yesterday ( XXXX XXXX, XXXX ) that in order to close on the loan, the VA wants to take my name off the title and list only my fiance 's. We already own this home jointly. I feel that I am the victim of discrimination based on marital status. I have done some initial research, and everything I have found so far says that it is illegal to discriminate based on marital status. The ECOA, FHA, and FCRA all state that this type if discrimination is illegal. Can you help me in any way to find out what I can do about this?

To whom may concern I refinanced my house with new day USA XXXX XXXX XXXX. I set up auto pay in XXXX around XXXX my first payment was due XX/XX/XXXX so on XX/XX/XXXX I noticed nothing came out of my account so I called. XXXX claimed my autopay would not take affect until XXXX so I said go ahead and pay it then two days later they charged me XXXX a second time. Which left me in financial difficulty for two weeks. Then I called to have the second payment refunded XXXX said they would send me a check so after week or two my account was electronically credited XXXX by then my XX/XX/XXXX payment was coming so I called again on XX/XX/XXXX because autopay did not take payment again they said I was in default so I checked the Mail there was a check for XXXX in mail from XXXX so they refunded both payments when they were suppose to keep one since then I have payed both payments my credit score has dropped 77 points while Im in middle of credit card refinance which was denied due to this all I received was Im sorry no I think not that is not enough for their incopetance

I Applied with New Day USA home loan after they have been soliciting me for over a year with invites to apply for a VA Home Loan through their company. After Speaking with the representative of New Day USA home loans, I was told that the company have all types of programs that help XXXX veterans like myself get into a home any way that they can. As we were going through the questioning process, He asked about my spouse Social Security number and He assumed it was female. When I corrected him that my spouse was indeed a XXXX he let out a Loud Laugh while on the phone with me. He did not apologize and proceeded to ask me questions about my race, ethnicity and religion. After the questions he hung up and called me less than five minutes later Denying my application without an explanation. I conta cted New Day USA for a mortgage refinance on my current mortgaged property. I was then called 1 m inute later by a sales representative named XXXX XXXX who asked me questions to apply for a mortgage loan with them. First, he says " thank you for your service ''. I hate that. After enough questions he asked to do a credit check and asked me for m y SSN. Unfortunately, I gave him my SSN. XXXX said m y credit score w as XXXX . After asking that only then did he ask about my employment situation and since I have n't worked for an employer in 5 months, he could n't qualify me for the loan. I told him I have investment income ( stocks ) from dividends and I have a job starting on XXXX XXXX . But that was not enough. So, I asked him why could n't he have asked that question prior to running a credit repo rt with my SSN? He said " that is not how it works ''. Well, that should n't be how it works and now my credit is negatively affected and have not been approved for a loan. They hurt veterans, not help them.

Am trying to get a home mortgage. Through XXXX XXXX XXXX. I started around the first Of XXXX. They had XXXX XXXX do Appraiser on my house. On XXXX/XXXX/XXXX. We initiated a refinance on a VA mortgage loan in XXXX of 2020. We were told it would take about three weeks.We provided documentation and signed disclosures on XX/XX/XXXX. The first round of documents requested from us were all provided within 24 hours. Any other request of us has been provided within the same ( 24 hours or less ) time frame. It has been over 2 months now since we started the process. The individual who we are working with does not return emails or phone calls. I have called in to the company to complain for the 2nd time, and they are not providing a complaint system to me that is followed up. I would have expected a compliance department to contact me. When I called the general customer service number last week, I was told that our loan was approved, so I am just waiting for closing. I am afraid that this is all a scam at this point, and they have tons of our personal information.

I applied to New Day USA to refinance my VA mortgage. It seemed all was going well until I received a call from Mr. XXXX XXXX XXXX saying he had to cancel our loan application because he had found out it was a manufactured home. I told him OK but every time I see XXXX XXXX advertising what they do for veterans I get mad again. My home tax value is XXXX and my loan balance as of XX/XX/2020 was {$96000.00}. I was not requesting any cash, only trying to reduce my monthly payment. My credit score as of today at XXXX is XXXX vs the US average of XXXX for my age group. I charge NewDay USA with discrimination because of the type home I choose to live in. I have never missed a mortgage in my XXXX years on this earth and I dont like being told I am not as good as other XXXX XXXX veterans and am not entitled to the same benefits. I refinanced with New Day Financial ( XXXX XXXX XXXX ) He promised me No Payment in XXXX or XXXX, Well my Bank by Mistake made XXXX payment and cancelled it. Well in DEFIANCE New Day Financial Decided to keep my INSURANCE ESCROW CHECK AS PUNISHMENT FOR THIS ACTION. Even though the Full amount of 2022 insurance was added to the refinance paperwork. Many calls lead me in circles, then I get E-Mails from New Day Financial saying they can't reach me??? Their XXXX SURE COULD. AND MY CELL PHONE KEEPS TRACK OF MISSED CALLS AS WELL AS MY HOUSE PHONE. In early XXXX, I received an advertisement from NEW Day USA to lower my mortgage payments by refinancing my existing VA loan. By XXXX XXXX, I had submitted all of my personal information, ( W2 's, Mortgage statement, social security numbers, etc.. ) to NEW DAY representative XXXX XXXX XXXX For the next 10 days I heard nothing from NEW DAY or XXXX. I called him several times, left VM 's and e-mailed him at least 7 times. No response. Then on XXXX XXXX, I received a letter from NEW Day stating my application was incomplete and I needed to submit W2 's, Mortgage Statements, social security numbers, etc ) I have since spoken to several people from NEW Day and have requested all of my personal information back from them. New Day USA is conducting a plethora of television ads. According to the ads, the spokesperson claims to be a retired Admiral who is now " chairman '' of New Day USA. The ads also say that the company is an LLC. I understand that the highest title in an LLC is " managing partner. " I believe that New Day USA is trying to convey that they are something more than what they are while taking advantage of veterans like me. Below, I am required to state to which part of the mortgage process is the complaint related. I am not applying for a mortgage loan. I notice the incongruity while I see the ads, and I think it 's wrong to appear as a non-profit ( chairman ) when they are only in business for profit. Given the amount of advertising they are doing, they have to be making a ton of money. That admiral ( if he really is an admiral ) should be in jail.

For the past 5 years or MORE, I have gone to this company 's website MULTIPLE TIMES, to be removed from their mailing list. I've gone to all 3 credit Bureaus and made sure that I don't receive unsolicited mail based on my credit. I'm on the National Do not Contact lists. I complained to the XXXX MULTIPLE times. I sent this company a CERTIFIED Cease and Desist letter to STOP contacting me two or three years ago. And I'm STILL receiving unsolicited mail. I want this to STOP. After a few months of receiving nothing from this company ( YAY! ), they're back at it again. Received three mailings in the past two weeks. In addition, the way the letters are designed is borderline predatory to XXXX and XXXX. Stamping things like " Final Notice '' and " Response Needed/Required '', in addition to using a " Rear Admiral '' to gain trust.

I contact this company NewDayUSA to help with a veterans refi-cash-out mortgage application. I was ask to lift the freezes off of mine and my husbands credit files. This company did not inform me that they were going to ask another company to pull our reports. But they did, XXXX XXXX is who they used on XXXX the XXXX and XX/XX/2021. This action cased damage to my credit score, it went down by 18, making me below average for any type of credit loan. I was waiting for this company to do an appraisal on my home before further process of the loan application. I decided not to continue to wait any longer and withdrew from the process. Then going to another veterans lender found out about my credit score dropping by 18, now it is XXXX, below average.

New Day USA, XXXX XXXX XXXX XXXX, XXXX, MD XXXX, Telephone : ( XXXX ) XXXX sends me a piece of mail marketing almost every other day. I have NEVER contacted them. That company is known for predatory lending - they convince veterans and other elderly that a loan will help them and convince them to finance their mortgage. The person then ends with much more debt than what they had before. I do not mind receiving an occasional offer from legitimate companies but this company is simply too much. I shred and throw away all their letters, I never respond, you would think they would have taken the hint by now. Please help consumer by giving us a place where we can report these annoying and damaging to the consumer, companies.

On XX/XX/2019 I viewed the website for New Day Mortgage XXXX XXXX XXXX and in big, bold letters it states " Your VA Home Loan Benefit is worth more at NEW DAY '' XXXX XXXX answered the phone and I asked him how it was worth more at New Day and he replied that " New Day will refinance to 100 % LTV while other lenders only go to 85 %. '' I replied that he was lying, that every lender will go to 100 % LTV, in fact more, because the funding fee is added. I told him I was sick of deceptive advertising and I was going to report the company. He called me back and tried to convince me her was right about the LTV. He also said they would refinance to 100 % with a XXXX credit score and no one else would do that.

I would like to know how New Day Financial ( NewDay USA LLC ) obtained my address and my information. I have registered with the Do Not Mail list, the DMA choice, The Idaho Attorney General, and I have contacted the NewDay USA LLC to stop. I continue to get letters from this organization. I do not want their services, and I would like this to end. NewDay USA LLC will not disclose how they obtained my address, or even how they know I have a mortgage backed by a VA guarantee. I am tired of my private information being sold and bought without my consent. This needs to stop. Next I will be writing a letter to the Senate Banking Chairman Idaho Senator XXXX XXXX. I pay my Mortgage by direct debit monthly. My last payment came out on XXXX XX/XX/2018. I Refinanced with new day usa this year. In XXXX i was removed fron new day to a company named XXXX XXXX i called new day on XX/XX/XXXX to find out where my XX/XX/XXXX payment and was told i was no longer with new day usa. they gave me a number to call for XXXX XXXX. I called the numberi was given XXXX and was told i would have to wait 30-60 DAYS AND HUNG UP.i HAVE MISSED MY XX/XX/XXXX PAYMENT. I have heard nothing from this new company. Since last year, VA XXXX XXXX have been sending letters to my home, addressing them to my husband, a war XXXX vet. The problem is that he died 5 years ago. We, my son and I, have been contacting these companies. They do not indicate company names in their correspondence, so we have had to call and email them requesting cease and desist, because he ( we provide name ) is deceased. If we talk to them they agree to do so, but then, their letters keep coming. I am not sure if they are accessing my husband 's information. If they were looking at county information, my name would be there, as a vet and home owner and I have received no correspondence from them.

We refinanced our mortgage with new day financial in the fall of XXXX. During the loan process we established that our escrow and are taxes would be prepaid so they could pay for our taxes. This is been going on since XXXX of XXXX I call them several times, every few weeks and get transferred to the escalations team. I saw a commercial on XXXX XXXX for a VA Home Loan. The commercial was very compelling. They explained that if I was a Veteran and had an XXXX they would help me use my VA entitlement for a mortgage. I get on the phone and go through a lengthy process of applying for the loan and was denied. Even though I have served honorably, have a VA entitlement, and a good income they still turned me away. My closing date was XX/XX/24. The Attorney arrived at my home with only one set of closing documents. I asked her about the copy for my records? She stated she only had one copy. I advised her I will follow up with the lender. I then emailed my loan officer who advised me he will send a signed copy once the loan package was received in his office. The rescission period ended on XX/XX/2021 and I have yet to receive a set of documents. I never had the opportunity to review the package during the rescission period. To date I have no idea where to send my payments or anything else for that matter.

XXXX web site posts your XXXX score as one value but provides a different, lower value to lenders. Their explanation is that the posted value is a CONSUMER score, not a XXXX, however their website specifically says XXXX score. So, believing I had a qualified score, I applied for a VA refi with XXXX, only to be told my " XXXX '' score provided by XXXX was almost 50 points lower but offered a refi at a rate higher than for which I believe I would have qualified. This smells of a bait and switch scam between XXXX and the lending industry.
