XXXX XXXX XXXX XXXXCherry Creek Mortgage offered a very low cash out refinance rate with low costs. I did have to pay the appraisal out of pocket which was different than other loans. We first spoke to the company on XX/XX/XXXX and completed the application and disclosure paperwork on XX/XX/XXXX. Our interest rate of 2.75 % was locked on XX/XX/XXXX. Over the next week they asked for information and I provided it all within days of being asked for it. The only piece missing initially was a requested letter about my wife 's employment status. We put in for it but her employer is based on the east coast and we did not have the letter right away. About 8 days passed before the next communication with the loan company requesting some additional information which I provided. I got an email on XX/XX/XXXX stating that they were able to submit the loan based on only my income which negated the need for the requested letter about my wife 's employment. Great I thought. Cross that off the list. Then on XX/XX/XXXX I got a loan cancellation form saying that " borrower withdrew '' the loan application. I sent a flurry of emails asking what was going on? I did not withdraw anything, in fact I just received an email stating my file was submitted to underwriting the day before? I got a very nasty reply from the loan officer XXXX XXXX stating I was not trying to move my file forward and look at this list of things I did not do. I was baffled and put off by the email as I had done all requested and I had correspondence from the company the day before stating they were moving along. He told me my rate lock was expired and I would need to pay additional fee 's. We had a phone conversation that afternoon on XX/XX/XXXX where he stated he was sorry for the email he sent and that XXXX XXXXCherry Creek XXXX XXXX the extension fee 's and lets just " get this loan done ''. I was happy with the resolution so we moved on. We scheduled the appraisal and submitted a few more documents requested for our home owners insurance on XX/XX/XXXX and XXXX. All is well again right? Projected close date of XX/XX/XXXX which was the projected close date all along. Then I get an email from XXXX on XX/XX/XXXX stating " your loan will not fund for at least XXXX more weeks and XXXX XXXX XXXX XXXX cant and wont absorb the cost on these lock extension fees. They will have to be absorbed into the loan. The cost is going to be {$1100.00} ''. I was blindsided by this since we had just spoken the week prior and he informed me all was well and they would pay the extension fee 's. I informed them I would not be paying any additional fee 's nor would I sign any new disclosure paperwork. Either they needed to make good on the original offer or I would walk. I also told them I would be filing complaints since I felt this was a bait and switch type situation. They were the lowest offering available at the time and I now feel this was falsely advertised. They lure customers in with a low rate and when they are unable to deliver they needed me to pay more fee 's in order to deliver the loan rate they promised initially. I also felt they tried to cancel the loan and submit paperwork showing we requested cancellation which was false as we never did. The communication was poor and the processors seem to not communicate with the loan officers and I feel at best we were mistreated with poor customer service and at worst they are engaged in deceptive loan practices and should be looked in to.

On XX/XX/XXXX, I recently got out of the military with nowhere to turn, no home, no job, nothing. My wife and I went to search for a home for our family and decided to go with XXXX XXXX in XXXX as we used them for our first house in XXXX. First, they messed up our contract and had to redo it because they designed two homes the same, then they lied about our permits being pulled and blamed it on the district of XXXX. I went to XXXX and they had our permits ready to be picked up and paid for. Even after I went to the main office and gave them a piece of my mind, they kept coming up with excuses. They even had houses that weren't even prepped, up and ready before ours was even a thought. To add to that, their preferred lender Pentrust, and their employee XXXX XXXX lied and fabricated our loan application stating that as an XXXX XXXX XXXX with XXXX dependants, I was making {$90000.00} when I was nowhere near that amount in my previous position and title. I just recently got a position, however, as a XXXX XXXXXXXX, and my yearly calculated salary is XXXX. When I got out of the XXXX, my wife reached out the XXXX and tried to explain to him that I am no longer on XXXX XXXX and he never returned any of her calls, and when asked about it he denied it. When I confronted them on their lies, he kept telling me that I didn't qualify for the loan because of the VA regulation and that I was not making enough, when I in fact, called and spoke to the underwriter, and the Loan Processor at the VA and all parties said that it is not true what XXXX was saying. They even went on to say that they never laid eyes on our contract, and no appraisal was ever attempted. As a veteran of 15 years of service, XXXX deployments, with XXXX issues, bXXXX XXXX, XXXXXXXX XXXX, XXXX, and everything else under the sun, my family and I should never be treated like this. No veteran who paid their dues should ever get this mistreatment and they need to pay for their lies. We are living in a rental with the lease ending on the XXXX of XXXX and we have no home to go to because of them. We were truly depending on the completion of this house and now we have nothing. My XXXX has a birthday on the XXXX of XXXX and we have to hustle to find a house so she can spend her birthday. They need to feel what we are going through and they need to pay for their messup.

The amounts listed as payoff for my HELOC and my first mortgage in my loan do not match the actual payoff amounts recorded with my former lender ( payments were made and processed ). The new lender listed payoff amounts ( incorporated into my loan ) that were higher than the actual. HELOC payoff listed in closing doc = {$84000.00}, but actual payoff made was only {$84000.00} 1st Mortgage payoff in closing doc = {$250000.00}, but actual payoff made was only {$250000.00} Discrepancy is {$430.00}. The new loan was closed on XX/XX/21 and payoffs were made on XX/XX/21. There is no record of the additional money being sent to my previous mortgage company in error ( They are showing payment for the actual amounts listed above and no more. ) I contacted the mortgage broker, XXXX XXXX, of XXXX XXXX XXXX XXXX, on XX/XX/21 and supplied him with the docs from my refinance to show the larger payoff numbers listed and the statements from my former mortgage company showing the payments made. He directed me to my former lender, but my former lender only received the actual payoff amount, no extra. I also called the mortgage company that closed my new loan ( Cherry Creek Mortgage Company ), on XX/XX/21 and left a message about the situation. They have not returned my call and my loan has already been sold to XXXX XXXX

I have have been trying to remove my PMI for months now and my mortgage company is dragging it's feet as I continue to pay ~ {$90.00} every month. XX/XX/XXXX : First contact my mortgage servicer about removing PMI. I followed up several times via email and phone before finally getting an answer. XX/XX/XXXX : Paid for and ordered XXXX to remove PMI and was told it would be completed in 20 days. No one ever contacted me. XX/XX/XXXX : No one called about XXXX so I called back. Said they'd look into and call me back. No one ever contacted me. XXXX : Called them again and they said the payment was rejected even though it was supposed to just go on my mortgage. No one ever reached out to tell me that is was rejected or why it was rejected. I paid AGAIN via debit card this time. XXXX : Called again because no one had contacted me. They told me 5-7 days someone would contact me. XX/XX/XXXX : 7 days from last call and no one had contacted. They told me to keep waiting.

I am/was in the process of looking for a manufactured home and was working with a realtor. He recommended XXXX XXXX with Cherry Creek Mortgage. I had filled out the paperwork and submitted on XX/XX/2022 at XXXX, after filling out the paperwork I realized I was not prepared and needed to work on my debt to income ratio. I notified Cherry CreekXXXX XXXXXXXX on the morning of XX/XX/2022 at XXXX I emailed XXXX at her direct email and asked her not to submit my application that I was withdrawing it until further notice. I received an email from XXXX on XX/XX/2022 at XXXX stating she had sent the application to two lenders and it was declined. I am now getting notices of adverse credit decisions even though I asked her not to do it. Because of this, I am now getting all these offers to pay down debt with various debt resolution companies. This is not right. I kept all the emails in the event additional information is needed.

I did a refinance on my home through XXXX mortgage which is cherry creek mortgage, all went went I made my first payment to them and immediately after that they sold my mortgage to XXXX bank, it has been over 70 days since payment was made and cherry creek will not transfer payment to new servicer, I have called about 5 times and sent several emails and in every attempt the answer was we are sending payment today and never did, I am reaching out to solve this issue
