This company refuses to remove medical debt that IS in litigation, the debt is a result of a motor accident where it was deemed I was not responsible ( hit by a driver who was texting ) The XXXX lady whom I spoke with told me " it is our policy to place a negative remark on credit file until you pay '' I reminded her that they have a lawsuit lien ( which makes sure they are paid first ) she confirmed ALL of my attorneys info, the lawsuit filling number in XXXX XXXX, my correct address, DOB. Despite telling this lady over and over again that it is in litigation and destroying my credit, ( even after the law changed regarding medical bills ) the lady said that it would not come off my credit file until she gets paid, the are not required to follow as they have their own policy. I called the doctors office whom I received treatment from, explained the situation to them and was told again that its their policy to place on credit file until paid, even if there is a lawsuit prohibiting me paying directly they have to get paid before removing. I have spent 5 years rebuilding my credit following a bankruptcy due to identify theft. I can not pay off this debt as it is in litigation, I can not get the debt pulled until it is paid, the XXXX lady is literally quoting practices that do not exist. They also call and hang up after 1 ring ( common creditor practice in this area ) they claim its to make sure the number still works, and so on, however its then used to make you go before a judge saying you wont take their calls. I have directed all communication through my attorney, however this is part of a crash claim that is being settled by XXXX XXXX ( the defendants insurance ) and the collection agent will not honor any request other than my attorney paying them direct. My credit has dropped XXXX points because of this hostage scenario

XXXX XXXX XXXX XXXX of XXXX, Illinois and owned by XXXX XXXX XXXX and XXXX XXXX XXXX, have, since 2015 reported to the credit bureaus an amount owed by me of {$730.00}. This was an incorrect amount as it did not reflect insurance payments received by them. I have contested this amount for these very reasons numerous times since 2015 and it was repeatedly, and incorrectly, reported by XXXX XXXX XXXX XXXX as being the incorrect amount. This was confirmed to me today by their bookeeper, XXXX XXXX. Remarkably, they take no responsibility for this incorrect and damaging information they simply said " Although we reported it incorrectly to the collection company ( Certified Services , Inc of XXXX, Illinois ) we are no longer repsonsible since they reported it on your credit. When I challenged this statement by saying " But you gave them the wrong information '' they acknowledged that but still denied responsibilty saying " Once we report it we're done '' I believe the law requires them to correct negative information they know to be incorrect. I have tried to pay the proper amount since 2015 but have been thwarted ever since. This has been a stain on my credit report and an inaccurate one as well. Consumers are supposed to pay their bills but providers and collection agencies are required to provide factual information and, when a verification request is promulgated they are supposed to research and update the record as required by law. Both XXXX XXXX XXXX XXXX and Certified Service, Inc ignored the law and continued to report incorrect information for 4 years despite numerously repeated efforts by me to get the information corrected so that I could pay it.. Certified Services Inc continue to violate my consumer rights by reporting this alleged debt. Certified Services Inc is a third party to the agreement therefore they hold no rights to enforce the contract. XXXX. TRANSFER OF INSTRUMENT ; RIGHTS ACQUIRED BY TRANSFER. Primary tabs ( a ) An instrument is transferred when it is delivered by a person other than its issuer for the purpose of giving to the person receiving delivery the right to enforce the instrument. ( b ) Transfer of an instrument, whether or not the transfer is a negotiation, vests in the transferee any right of the transferor to enforce the instrument, including any right as a holder in due course, but the transferee can not acquire rights of a holder in due course by a transfer, directly or indirectly, from a holder in due course if the transferee engaged in fraud or illegality affecting the instrument. ( c ) Unless otherwise agreed, if an instrument is transferred for value and the transferee does not become a holder because of lack of indorsement by the transferor, the transferee has a specifically enforceable right to the unqualified indorsement of the transferor, but negotiation of the instrument does not occur until the indorsement is made. ( d ) If a transferor purports to transfer less than the entire instrument, negotiation of the instrument does not occur. The transferee obtains no rights under this XXXX and has only the rights of a partial assignee.

My XXXX year old son visited XXXX in XXXX, IL. At his 10 minute XXXX it was determined that they could not help him and told him to go someplace else. No mention of any charge was made and no co-payment was collected. He left thinking that it was the end of it, but a year and a half later, I received a bill from a collection agency for {$310.00}. During this time I had not received a itemized bill or any communication from them. He has not received an itemized bill or any communication from them. When I called to complain to Certified Services , Inc . I was told that they do n't have to bill you and they can turn you into collection the minute you walk out the door, if they want to. And, they can turn you into collections up to 6 yrs later if they feel like it. I do n't feel that it is good business practice to turn someone into collection, a year and a half later after absolutely no billing or communication whatsoever. I even question whether this is legal.

I had seen a XXXX a while back. After some time I noticed 3 collection accounts on my credit from the one practice. I called them for dates and amounts charged and to see which insurance they had charged as I switched around that time. They would not give any dates, charges specifically, or insurance coverage info. They said to ask the collection agency now. So I contacted agency, and they said to ask the original creditor. I asked again and was told no. I contacted agency again and they said to contact my insurance. After telling them 3 times the insurance agency will clearly not know what dates and charges the XXXX says I owe, I have gotten no information. No reason for 3 accounts or owing close to {$6000.00} to a XXXX even with insurance!??????

Certified Services Inc violated 15 usc 1681a ( 2 ) ( B ) and 15 U.S. Code 1681b ( a ) ( 2 ). Pursuant to 15 usc 1681a ( 2 ) ( B ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device should be excluded from a consumer report. The definition of a credit card under 15 usc 1681is the same as it is under 15 usc 1602 ( l ) which is the term credit card means by any card, plate, coupon book or other credit device existing for the purpose of obtaining, money, property, labor, or services on credit Notice, congress said ANY card. The credit card is my social security card. This is the credit card I used to originate the consumer credit transaction I am complaining about.

Certified Services is causing me injury by falsely reported a debt on my credit report that I do not owe. I never signed an agreement/contract with them or used their services. They are violating my right under the Fair Debt Collection Practices Act by providing misleading information by reporting account on my credit that I did not sign up for with them. They have two accounts on my credit that should be removed. I have tried going through the XXXX, however, they did not respond to the agency, which provides an example of their business practices.

Hello, I had a XXXX appointment at XXXX XXXX 5 years ago which recently went to collections. I specifically did not authorize this XXXX to perform any work which was not covered by insurance, and I did not agree to be charged any finance charges. It was initially a small amount which I attempted to negotiate but it quickly ballooned with finance charges and became unreasonable. I disputed this with XXXX and they denied my dispute. On XX/XX/2021 I reached out to Certified Services Inc and requested they provide documentation that proves I willingly entered into a contract with them and to display the signatures of both parties involved. This company did not do that. Nor did they cease collection activities and reporting as federal states until the requested proof can be provided. This company is harassing me and as mentioned in my first letter, I would seek assistance from CFPB & State Attorney should they continue to do so.
