THIS COMPANY CAN NOT AND HAS NOT produced me my original bill from the original creditor they purchased my debt from and because of that they must to cease all collection efforts and remove this account from my credit report. REMEMBER I AM REQUESTING VALIDATION, NOT VERIFICATION!! This COMPLAINT is being sent to you in response to notices sent to me from your company and more importantly, due to your erroneous reporting to the Credit Bureau { s }, the highly negative impact on my personal credit report. Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 { b } that your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you. Also, during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing any information with a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate, when in fact there is no provided proof that it is accurate. Anyone can open an account under my name for which a bill is produced, but that doesn't mean it was actually me or that the debt is actually mine. I need real evidence. I have been unemployed since graduation other than odd jobs unable to pay my student loans. Finally got a min. wage job in a warehouse less than year ago. Student loan garnishments of 15 % started 8 months ago $ 250- {$290.00} a month.I have paid {$1500.00} so far which I ca n't afford from XXXX saying I owe {$14000.00} for student loan. Now FMS says I owe {$34000.00} & is going to garnish another 15 % of my pay. I called XXXX the school I attended they said I borrowed XXXX in S loans. The total of these two is {$57000.00} which cant be correct. FMS has no record of any of my payments to student loan debt at all. The government website says I owe {$34000.00} with interest & fees but no payments show. I am unable to get answers as to why XXXX is garnishing my pay & where the money is going. I can not afford to be garnished twice to a total of aprox {$600.00} that is almost an enitre 2 week paycheck. I commute 3 hours a day to work spending over {$350.00} a month in gasand my truck is 10 yrs old with lots of miles if it broke down tommorrow I could not pay to fix it.I ca n't save a dime for repairs. I am homeless living in a 25 year old camper for 7 years now in an rv park with my XXXX wife costing me over {$800.00} a month just to park there. I can not survive with these garnishments. I need an income based payment I can afford to pay and still live with money to repair my truck & camper when needed and pay for medical etc. I want to pay my debt even though I was sold a bill of goods that has not gotten me any kind of gainful employment I make only {$12.00} per hr. I believe XXXX is taking money fraudulently and FMS is not willing to assist me in setting up affordable payments or working with me in any way or even explaining why XXXX is garnishing my pay and why no payments show anywhere. I was constantly harrased by phone when I was unemployed by XXXX until I just started hanging up on them or not answering my phone at all. I feel so frustrated and am going in circles trying to get to the bottom of this nightmare. I owe all this money for nothing. XXXX promised to place me in a job when I graduated but they never helped me get a job. They sent me on a few interviews for which I was not qualified. Our government needs to crack down on all these schools that get innocent people in huge debt trying to improve there chances of landing a great job and supporting themselves and their families. They sell propaganda to those who are desperate to move up in the world.This debt has ruined my credit and chances for the future and makes me wonder why I even try to succeed as it seems impossible. The people at FMS are horrible and offer no help or solutions. They will not listen or offer any advice or even give you the facts. I have filled out stacks of paper sent in financial disclosures everything asked of me but yet they do not offer any viable solution. I do not want to quit this job but I will be forced to if the garnishments dont stop and an affordable payment plan isnt put in place. I would be better off doing odd jobs for cash near where I live. We had hoped to get an apartment and live like normal people again. Even though we filled the financial papers we were not even given the deductions that a household of XXXX normaly gets because we are homeless and do n't pay average rent or utilities. We want to live in an apartment like everyone else but ca n't afford it and now with these garnishments we never will. How can they not give us the national standard allowance for housing when working out a 15 % garnishment? Is n't that illegal? It seems to me there is some kind of fraud being committed. I 'm at the end of my rope now there has to be some kind of accountability for this type of loan servicing. People in other countries get more help from our government than us Americans who pay their salaries with our hard earned tax dollars! I am a taxpayer and demand answers and help concerning this matter. I thank you in advance for your help and concern.

End of XXXX 2015, I received late phone call from woman ( XXXX? She no longer works for company ) identifying herself calling from Financial Management Systems ( FMS ) stating I had a debt in their office from XXXX XXXX. Advised I was out of town but would call the company back when I came home. I continued to receive collection calls and never received debt validation. On XXXX, I spoke to XXXX different people regarding my debt, advising that I needed a letter showing the total due. Every person I spoke to was incompetent and rude. FMS failed to provide this letter after their first collection call. In order to cease the numerous collection calls, I set up payment arrangements and made my first payment. Only after I requested debt validation, did I receive a " demand letter '' for the incorrect amount-after I had already made a payment. I continued receiving collection calls from reps, even after I set up payment arrangements, trying to settle my account in a lump sum. XXXX day, I received collection call at my employer, having never given this #. When asked how they got my work #, they advised it came over with my file. I stated I never gave the # out so that was untrue. Then I was advised they were skip tracing my account because they did not have a good number for my account. Advised that they had my cell # & that was good because they call me all the time for collections. On XXXX, I called trying to get better contact information regarding my account as I was intending to pay it off and spoke to XXXX, I was then transferred to manager, XXXX XXXX XXXX. XXXX as my account had a Cease & Desist flag placed on it due to the issues I experienced when I called in & with receiving a collection call at my employer. Call was disconnected. On XXXX, I called spoke to XXXX about payoff procedures. On XXXX, I received a loan from my bank & asked the company to send a XXXX-day payoff via fax so the bank had the correct amount. The only piece of information I had to give to the bank for debt validation was the incorrect demand letter I had to previously request from FMS - it did not reflect XXXX payments I had made on my account. I had asked for the updated amount to be sent to my bank - FMS failed to send anything in writing. When I spoke to XXXX, I requested the correct amount to be sent to my bank again & also requested copies of my receipts for my XXXX payments sent to me. I was told that due to privacy issues, I can not get receipts for my payments, rather I can use my own bank statements. When I called in on XXXX, she advised that there was a note on my account by the manager to immediately fax the correct payoff letter & my receipts to the bank. I called my bank to verify & they still had yet to receive any faxes from FMS. Instead, my bank used my " demand letter '' ( again, previously requested by me, not sent by the FMS per law ) & the XXXX payments I stated I had made in order to send a check for the amount of {$3900.00}. Since there was n't any late fees or interest accruing, I knew this was the balance, although I did not have proof from FMS. After allowing time for the payment to be received, I called back on XXXX and spoke to XXXX, stated check was received/applied on XXXX. When I asked about receipts, he stated he would send me back to XXXX since we had spoken before. She advised that FMS was unable to provide due to privacy & legal issues. I continued checking w/ my bank who never received any information from FMS. I called back on XXXX & XXXX transferred me to XXXX XXXX, who is very rude, interrupts conversation, acts like he is inconvenienced to be on the phone. I asked for a new manager and was xfer to XXXX. Explained situation again, said he would have to speak to XXXX XXXX & call me back in XXXX mins. Received call XXXX hrs later & said he would have to call me back the following day. No return call.

I received a letter from FMS notifying me my account had been given to them for collections. I called them to discuss payment options and came to a compromise agreement. I agreed to pay the compromise amount and was told it would be expedited and take a couple of days to clear with the Department of Education. I informed them I would be mailing the check so it would give enough time for the compromise to clear. Several days later I got a call from FMS asking if I was going to pay the compromise amount. I told them that yes, as we discussed previously, I had already mailed the check. A week and a half later, FMS called again to ask if I intended to pay the compromise amount. I told them that I had sent the check over two weeks ago and that the payment should have been received by then. They needed some time to look into it and said they would call back. Later that day, they called back confirming that the check had been received, there was nothing more I needed to do and that my account would be closing out. A month later, FMS called me requesting I make a payment on my account. I informed them that I had paid a compromise amount and that my account should be closed. The representative confirmed that my account was closed. I then requested documentation of my payment and account closure. I did not receive any documentation or communication from FMS. I was sent a letter from Department of Education four months later informing me that my account was in default and was being referred to the Department of Treasury for offset collections. I then called FMS.The FMS representative I spoke with confirmed I had completed all necessary steps to comply with the compromise agreement and that my account should be closed. She then referred the account to a manager- XXXX XXXX . In my first conversation with XXXX XXXX, he told me the account was not closed out because the payment had posted the day before the compromise agreement was approved by the Department of Education. He informed me he would be submitting to them a recommendation to close my account and that he would call me back with an update within 48 hours. After calling him twice and leaving two messages, XXXX XXXX returned my calls more than 330 hours after our first conversation. In our second conversation, he told me that I was at fault for paying the compromise amount too early. When asked why the approval was not expedited, he claimed I did not notify FMS of my intent to pay until XXXX XXXX ( this is false ). He also claimed the Department of Education was not recognizing the agreement ( false ) and FMS had submitted XXXX recommendations to close my account and were waiting for a response ( no record of these recommendations with Dep of Ed ). I then called the Department of Education and spoke with representative XXXX XXXX. He confirmed the compromise date and that I had paid before the deadline. He stated that Department of Education relies on the collections agency for closeout documentation to initiate the closure of an account. He stated that Department of Education never received this documentation and he does n't understand why FMS would not have sent it. He also stated that he did not see any record from FMS recommending to close my account. He then initiated the closeout process himself and said I should receive documentation in 7-10 days. A conversation with another Dep of Ed represantative stated that paying a day early would not negate the compromise agreement as XXXX XXXX had claimed. I have copies of written communications, call logs, and phone recordings to verify information stated in this letter. I believe FMS at least encountered a clerical error in their system and rather than taking responsibility, lied and blamed me for the account staying open. At most, FMS attempted to defraud me to collect more money from managing my account.

I have been receiving calls from FMS which is part of Ceannate. I can not understand the number being left for me to call them back. I have attempted to call and must leave a message. I asked that a supervisor call me and no one returns the call. The one time I did get through to a supervisor, I told him that I thought the person leaving me a message was rude because she spoke to fast and I did not understand the number she left. her name was XXXX. I also indicated I felt it was rude of them to contact my daughter since they have in the past been able to reach me by mail and email. He apparently passed that along to his compliance department. I got a letter from XXXX XXXX stating that the caller was in compliance since she read everything verbatim. That might be but since I am a hearing impaired individual and have told them this many times, the fact that I did not understand her makes this problematic. I called and left two messages for XXXX XXXX and he has not returned my call. I have received two more messages, this time from a gentlemen who talks way too fast not not clearly enough for me to understand. In the past I have received multiple letters from this company indicating different amounts due on different days. They have also emailed me. But all of of sudden they will only call and leave messages I can not understand. This started when I switched banks. I want to work with these people but they need to either speak clearly or contact me by email. Each time they call I call the only number I have for them and have to leave a message. I am trying to contact them but they are being incredibly difficult by not leaving a message I can understand, a number I can call back or contacting me by email. If they want to dispute my XXXX, I have been XXXX since age XXXX, I am now XXXX. In the past year my hearing has gotten significantly worse and I am unable to afford XXXX. I filled a complaint with the XXXX of Illinois and XXXX XXXX 's response was unacceptable. A major part of my complaint to the XXXX was that I get voicemail messages from these people that I can not understand. They talk way too fast and I can not get the phone number without repeating the message 5 or 6 times. XXXX XXXX 's solution was for me to once again call. I will then have to leave a message, someone will call and race through their speech - which at this point I will stipulate is done verbatim and meets whatever guidelines they claim it meets even though they speak way to fast for me to understand them - and then leave me a phone number to call which I will again not understand. And this accomplishes what? All that happened here is that I switched banks. But as far as I am concerned, Ceannate/FMS has made a mountain out of a mole hill all because they will not accept or address the fact that I can not understand their messages. At this point I will need then to contact me via email. I have attempted to contact them via email twice in the past week with no response. I also left a message again fro XXXX XXXX after their response to my BBB complaint and have not heard from them at all despite XXXX XXXX indicating that they want to work with me. I am not sure that repeatedly leaving messages that I can not understand is in anyway accommodating my XXXX. Clearly they have no interest in helping me, just aggravating an already dismal situation. Their lack of response or willingness to accommodate my hearing issue is making this situation considerably worse for me. They have contacted me via email and regular mail before, I ask that they contact me by email again so this can get resolved. The longer they wait will create a financial mess for me.

I was student at XXXX university since XX/XX/XXXX, and i was A grad XXXX GPA student. In XXXX XXXX, i was getting married, i did n't take any days off during my wedding but i continued my classes and did really good in my class. In XXXX XXXX, I had XXXX and other health condition so i contacted XXXX Vice President XXXX XXXX XXXX and told him about my medical condition and asked for drop my class for 30 Days. After feeling better, I contacted XXXX XXXX XXXX in XXXX XXXX, XXXX in order to Continue my Class. XXXX XXXX XXXX asked me to speak to XXXX XXXX XXXX in order to sign up my class but after i sign up and they told me they are not offering XXXX program. Instead they have now aeronautical XXXX program which is quite different then my XXXX XXXX Program but they will manage some classes for me. After sign up they asked me to make extra XXXX class fees in XXXX in order to continue my class which i did not took during my health condition in XXXX XXXX. They told me that they had to return tuition fees to financial aids. So XXXX XXXX XXXX fail to told me that i had to make payments and also failed to notify me to sending my medical records. I offered them that i can send my XXXX XXXX but they told me that there is no Guarantee that they will take those payments off from my account. They told me i can not continue my class unless i make full payments and i am XXXX and i had part time job which i could n't afford and they jeopardize my Education and career just because i had health condition. They told me i have to make payments or else they will sent to collection agency. I wanted to finish my education and not to have affect on my credit report so i started making payments {$25.00} every month. Last payments they charge me {$50.00} on XXXX/XXXX/XXXX which was double the amount which i did not authorized. I did contacted person in Bursar office XXXX XXXX so she said she will refund {$25.00} next day but she never did. I did called them couple of time to get my refund but i never received my refund. even though i was making payments regularly they been keep calling me from Bursar office person name XXXX XXXX and i was explaining every day to tell her that I 'm same person she been kept calling and i already made payments and she was saying sorry that she called accidentally. even though till now i was making payments for those classes i did not took due to My XXXX Health Condition. They told me that they will not issue any Transcript unless i make full payments which i could not attend due medical condition. Without Notify me They sent to Financial Collection and i received a call today on XXXX/XXXX/XXXX so i had no choice but to set up a payments plan in order to get my Official Transcript. even though i was making payments every months they still sent to collection agency " FMS Investment Corp. ( FMS ). even though i explain to Collection agency they said i have to make payments to them now on, so i set-up payments plan. Surprisingly Everglades still charging me {$25.00} per month as well as this collection agancy also charging me at the same time.

1. This complaint is in response to the false information you submitted to the CFPB on XX/XX/2018. In your response, you stated that you mailed an initial collection notice to me on XX/XX/2018. Apart from your harassing telephone calls, the only letter I received from FMS in XX/XX/2018 was dated XX/XX/2018 which I received on XX/XX/2018. Upon receiving said letter, I immediately responded with my XX/XX/2018 in which I clearly requested debt validation. FMS received my XX/XX/2018 letter on XX/XX/2018 at XXXX am. Despite this, FMS called me several times in violation of the FDCPA. Since my XX/XX/2018 letter requesting full debt validation, FMS did not contact me before XX/XX/2018 when XXXX delivered an envelope containing a SINGLE SHEET OF PAPER ( copy attached ) with my name printed thereon. This meant absolutely nothing to me. Presumably, FMS classified this as debt validation. I would like to make it absolutely clear that I AM STILL AWAITING FULL DEBT VALIDATION from FMS coupled with the legal basis it has to collect a debt from me. 2. FMS clearly has been relentless in its attempt to collect an alleged debt that it not validated, can not validate or is refusing to validate. I do NOT owe any money to FMS whatsoever, nor do I owe any money to the University which FMS is purportedly collecting the debt on behalf. 3. FMS contacted me by telephone and refused to identify themselves but had the audacity to request my personal information. I am a victim of identity theft and my personal information has been compromised as confirmed by the US Office Personnel Management. It amazes me that FMS alleges that it could NOT disclose account information to me, but yet, went ahead and reported a derogatory account on my credit reports without verifying my identity and/or validating the alleged debt. 4. Contrary to paragraph 3 of FMS uploaded XX/XX/2018 letter, I have not received any XX/XX/2018 and/or XX/XX/2018 letters in the mail. 5. Furthermore, the meaningless sheet of paper submitted is NOT DEBT VALIDATION. Attached herewith is a final letter requesting FULL DEBT VALIDATION, but not limited to, before this matter gets litigated. I trust that this issue can be resolved without the need for litigation. 6. You are required to delete this erroneous and invalidated account information from my credit report. I reserve the right to sue for each violation for an amount equal to or up to the statutory cap of {$1000.00} per violation, excluding defamation and damages. 7. I EAGERLY AWAIT DEBT VALIDATING WITHIN THE STIPULATED DEADLINE OF MY XX/XX/2018 LETTER.

Obama 's XXXX student loan forgiveness is a farce! A scam that our Government is not doing anything about. My doctor and I sent in the required documents and applied for the student loan debt forgiveness program for the XXXX. I received a letter of " Approval '' stating that I was approved for the XXXX program and that after a 3 year waiting period the debt would be paid off if I did not hear from them further. After the 3 year waiting period had passed I assumed that the debt was indeed paid, because the letter that I received stated that If during that 3 year waiting period I was disqualified for any reason I would be notified, and that " If I did not hear anything from them at all by the end of that 3 year waiting period, then I would not need to do anything further, the debt would have been paid off '' Now I have found that not only was the student loan not paid off, even though I was approved, but they have conveniently lost all of my paperwork. Wait ... let me rephrase that ... They lost any and all proof that my student loan was paid off, but they DID NOT lose the paper work showing that I still owe the student loan. Again ... how convenient! I have been informed that up until 2013 all of the paperwork was kept by ... NOW GET THIS ... the carrier of the loan. How stupid is our government officials to let the very loan company that we owe the money to, keep the only proof that the loan was paid off?!! again I say " How convenient! '' These are the people running our country? God help us! Giving the loan carrier the task of keeping all of the paperwork proving that the loan was paid off is like giving bank robbers the keys to the safe! I think that the 3 year waiting period was a part of the scam as well! Why? Why would they want us to wait 3 years? I think perhaps that the XXXX dollars allocated by President Obama for the student loan forgiveness program was probably put in a bank to draw interest those 3 years and counting. If this is true, where is the money made in interest? who 's pockets are lined with that money? Even more important, whose pocket is my {$10000.00} in? I was approved for the program, the 3 years waiting period has passed and in fact it has been about 5 years and I am still paying the debt! Somebody pocketed the money that was supposed to pay off my student loan, ... OR it was paid off, but the loan company is double dipping and forcing me to pay it again! This is why I hate ALL POLITICIANS! They are all crooked and dishonest!

1. Throughout the month of XX/XX/XXXX and XX/XX/XXXX, the company called me repeatedly without even identifying themselves. When asked for their identity, they stated that they were unable to provide me with any information because they were unable to confirm my identity and/or verify my account. It is to be noted that owing to their failure to answer my questions as to the authenticity of their multiple calls and/or company, I was apprehensive about sharing my personal information, especially my social security number. 2. On XX/XX/XXXX I received a letter from XXXX XXXX XXXX ( FMS ) dated XX/XX/XXXX alleging that I owed their client {$7800.00}. This was my first official contact with this company as they had refused to talk to me because they could not verify my identity and did not disclose who they were. 3. I responded to their letter dated XX/XX/XXXX by certified mail on XX/XX/XXXX. Therein, I disputed the debt, dismissed it in its entirety and requested verification. You will also notice that I specifically stated that their calls were being construed as harassment. 4. Pursuant to the FDCPA, I sent in a DEBT VALIDATION AND/OR VERIFICATION REQUEST by CERTIFIED MAIL on XX/XX/XXXX which FMS received on XX/XX/XXXX at XXXX XXXX. Despite sending in this request FMS continued to call my phone repeatedly. FMS called me on XX/XX/XXXX at XXXX XXXX and on XX/XX/XXXX8 at XXXX XXXX from telephone number XXXX. The person I spoke with during those unlawful calls stated that her name was XXXX. XXXX demanded that I provided her with my SSN or part thereof and stated blatantly that WE WILL CONTINUE TO CALL YOUR NUMBER 5. FMS, by continuing to harass me by telephone, and by reporting the debt to the XXXX XXXX XXXX after they received my request for debt validation on XX/XX/XXXX at XXXX XXXX, have violated my rights under FDCPA. You will notice that FMS continued collection activities after they received my request for debt validation. They have also listed an unverified debt of {$7800.00} on my credit report. 6. In light of the foregoing, FMS has sent an unverified debt to the credit bureaus in violation of Federal Law. With the help of the Consumer Financial Protection Bureau, I hereby request that FMS be investigated for their practices and all damaging information be deleted from my credit report.

My name is XXXX XXXX , I have had my federal tax return intercepted along with my wages currently being garnished {$120.00} every two weeks. I have asked them repeatedly to assist me in at least releasing my garnishment and their response has been unhelpful. They need me to get evicted from my residence prior to qualifying me for a release of garnishment. I am a single mother of XXXX with no assistance from anyone. I had a XXXX over the last 3 years and during that time was unable to remember many events and situations. At the time I did not have medical insurance and was left with significant medical bills of which some went in to collections, lawsuits and judgments. I will be paying on these for some time. This was all explained to the DOE prior to them saying they would send me a " Hardship Form ''. There apparently was a loan I signed for account # XXXX serviced by XXXX XXXX from The Department of Education. After I called the Department of Education on this loan and was told it went into default. I spoke to them about bringing it out of default and said they would send me a Hardship Form. As it turns out it was a deferment form so I called again and they said to just send what I could. Within a few days the Department od Education apparently placed this account into collections with a company called FMS. This company called me 5 times over the next five days and I told them not to call me anymore. I requested they only contact me in writing after checking their records of consumer complaints. Now the original amount of the loan was {$41000.00} interest due on this Parent Plus loan to date is {$4500.00}. FMS added {$11000.00} to the amount owed to DOE! How is that even possible, I almost had a XXXX when I got this letter. How is this possible that within one week I could go from owing {$45000.00} to {$57000.00}? Please help me straighten this out as this company is not going to treat me in a fair manner, at least that is my first impression. I would be happy to supply you a copy of their letter. I was going to send a certified letter to dispute the {$57000.00}, please advise. thank you, XXXX XXXX XXXX. These fees can not possibly be legal and the cavalier manner in which the DOE just forwarded this account to a collection company is not right. I have formal payment plans with the Internal Revenue Service and the State of NJ for back taxes while I was in the hospital and recovering. On XXXX XXXX, XXXX, I received a letter notifying me that a debt was placed with their office. This letter was dated XXXX XXXX, XXXX. Today, XXXX XXXX, XXXX, I receive a second letter from this company stating that they have made several attempts to contact me and that I have failed to respond. In this letter, dated XXXX XXXX, XXXX, it states that any accounts that remains unpaid for 60 days after they are placed with their office are subject to garnishment or litigation. It states in the second letter that the account was placed in their office on XXXX/XXXX/XXXX. By the time I even received their first letter, I was already past their claimed 60-day window for legal action. I was waiting for a few more pieces of mail ( unrelated to this matter ) in order to talk to my bankruptcy attorney when I received these two letters literally a week apart from one another. The first letter does not state when the account was placed or a time window for action on their part. I have not received one phone call from this company and I 'm more than confident that the original creditor has my current cell phone number as I have discussed this debt with them before it went to collections and updated all of my demographic information. At the rate in which their adding interest and fees, I 'd never be able to pay them off. Per their letter, with a XXXX % wage garnishment, almost half of the garnishment payment would go to the fees and interest they added to the account in just the two weeks prior to that payment. This makes it impossible to even work out any sort of payment arrangements with them as my wife 's wages are currently being garnished at XXXX %, and add to that my son needing constant medical attention, I feel with their unjustifiably late letter and now the imminent threat of legal action against me, my family 's financial stability is in question and it could possibly put my son at risk due to not being able to provide for him the medical care he needs. In one week 's time, this company has placed an undue stress upon my family with their questionable contact tactics.

I was contacted by FMS, Investment Corporation via mail. I responded in XX/XX/XXXX and FMS never got back to me. My letter discussed a payment arrangement suitable to my income which decreased more than XXXX ( I lost my job ). I received a letter from the Department of Treasury in XX/XX/XXXX indicating that my XXXX XXXX payments from XXXX will be offset in XXXX because I did not contact the creditor ( Department of Education ). My letter to FMS ( 3rd party collection agency ) predated correspondence from the Department of Treasury. Two payments in excess of {$1300.00} were sent via bank checks to XXXX XXXX XXXX and FMS between XX/XX/XXXX and XX/XX/XXXX. However, the current balance is only about {$300.00} of the original debt. I spoke with " XXXX XXXX '' on XX/XX/XXXX and XX/XX/XXXX for a combined total of 95 minutes. During these calls, " XXXX XXXX '' reported that my household debt was more than enough to pay over {$55.00} per month towards my debt. In addition, she was sending me documents via email. I asked if I opened the email, would it verify what was written in the documents? " XXXX XXXX '' indicated that it would even if I did not agree. Therefore, I did not open the email, as her payment could be more than I could consistently pay. " XXXX XXXX '' also wanted me to provide her with my debit card in order to make a payment over the phone. When asked if my debit card would be charged in the future, she said, " yes. '' Therefore, I did not give her my personal information. Instead, I sent a certified bank check. I admit to the debt. I do not accept how I am being forced into making payments that I may not be able to afford. I am still trying to get on my feet after losing my job. On XXXX XXXX, XXXX, the XXXX XXXX XXXX Ohio Bankruptcy Court discharged my debts in a Chapter XXXX case ( # XXXX ) by the Honorable XXXX XXXX XXXX, U.S. Bankruptcy Judge. XXXX of the discharged debts included a student loan with the U.S. Department of Education in the amount of {$3100.00}. Since then, I have been subjected to ongoing harassment and illegal tactics by several collection agencies -- all of which I 've had to dispute sooner or later. The latest agency, FMS Investment Corporation. FMS has unlawfully threatened wage-garnishment unless I pay in FULL - which includes provision of personal information to their agency ( employer, wages, bank accounts, revolving credit, disposable wages and tax return info ). I sent the XXXX Bankruptcy discharge documentation requested by FMS in my " objection '' to the wage garnishment and " request for hearing '' within the deadline period. The documents were sent to FMS certified mail ; signature required/return receipt via USPS on XXXX/XXXX/XXXX. On XXXX/XXXX/XXXX I received another correspondence in ( form ) letter from FMS. This letter states : " you have provided no evidence or application to support the objections or claim for discharge relief that you raised in your request for hearing. '' That statement is 100 % false, as I consulted my XXXX Bankruptcy attorney to request the exact documents being requested by FMS to settle this once again. In addition, my Federal Income Tax Return has been seized many times over the last 16 years. I have n't seen a tax return refund for many years. InXX/XX/XXXX, I entered into a payment agreement with FMS to get my defaulted school loans in good standing so that I could return to school. After I made 6 payments, I was offered a financial aid package from XXXX XXXX University, and started at the end of XX/XX/XXXX. Mysteriously, the payments that I set up with FMS stopped, at which point I was told my account was being sent back to the Department of Education. After I started classes, by XX/XX/XXXX I received an email from the schools financial aid office that they had received notification that I was in default, so I needed to fill out an in-school deferment form, which I did and sent in to the department of education. I heard nothing after that, but applied for financial aid for the school year XX/XX/XXXX. I was notified by email from the school that I was in default, and therefore not eligible for financial aid. Furthermore, they have notified me that they have not received the money from the DOE because I am in default. This means that i have been attending school without any secured funding. Additionally, I finally made contact with someone from the Department of Education at the end of XXXX, and she said I was eligible for a loan rehabilitation, but I needed to fill out an Income and Expense worksheet, so I did and sent in. I have made the small payment required since then, but have heard nothing, and we are at the end of XXXX. So, I need to know : Why am I still in default, if FMS was accepting my payments for 6 months? Why was I offered a financial aid package from XXXX XXXX in the fall of XXXX? My student loans were in default status due to intermittent unemployment and persistent underemployment. Therefore, I entered into the Loan Rehabilitation Program with XXXX XXXX XXXX on XX/XX/XXXX. FMS ( XXXX, NC ) appears to be trying to pull a bait and switch scam regarding rehabilitation of my student loans. In XXXX 2016, I called FMS to negotiate a repayment/rehabilitaiton plan. After several hours on the phone, including a transfer to a supervisor, I was given a monthly payment amount I felt I could afford and agreed to direct debit from my checking account. I was told I would be receiving forms I would need to fill out and return and was given a list of other documents I needed to submit. Although I made several phone calls and left several voicemails to follow up, I never received the forms to complete. I nonetheless submitted the documents as requested. The monthly payments have continued to be debited from my checking account ; however, in the last week, I have begun receiving letters informing me that documents -- including the forms I never received -- are missing and that the rehabilitation agreement will be cancelled. This is clearly a bait and switch tactic, in which FMS lured me into an agreement, took money from me for several months and now is trying to cancel the deal and/or change the terms. I am appalled that a government agency like the Department of Education would do business with such shady debt collectors, and I am beginning to feel hopeless that I will ever be able to resolve my student loan default. If this approach is considered acceptable by reputable government agencies, then I might as well plan on staying in default until I die.

1. FMS is reporting an unvalidated debt to the Credit Reporting Agencies ( CRAs ). 2. Upon receiving written notification of the alleged debt, I immediately responded in writing within the statutory time-frame of 30 days and requested that FMS furnished me with " Validation '' of the debt. 3. The request in paragraph 2 has NOT been forthcoming. Instead, FMS decided to continue with Collection activities and has updated my credit report as recent as XX/XX/2018. 4. Pursuant to FDCRA, all collection activities ought to be stopped during the window where debt validation is pending. FMS has NOT yet validated this debt and as such it should NOT be reporting on my credit report. 5. In light of the foregoing, FMS is in violation of FDCPA, and notwithstanding prior violations previously submitted. Consequently, this complaint serves to engage the services of FTC and/or CFPB to ensure that my consumer rights are protected and are not infringed upon by FMS. Additionally, it is hereby requested that CFPB administratively order FMS to remove all negative information from my credit report and cease all collection attempts until they provide me with Full Validation of the alleged debt. 6. I have been trying in earnest for over a year to set up a repayment plan I can afford for my student loan. I was finally put in touch with FMS to set up what they call a loan rehab agreement. FMS requires extensive documentation to make these arrangements ; I understand this need, and I do not have a problem with that requirement. However, I have now supplied every document they have asked for four times over a two month period. I have supplied the correct documents with the correct data ; they have acknowledged that I am eligible for the program ; I have begin making payments to them over two months ago, but they continue to contact me requesting the same documents over and over. And although I have been and continue to make payments to them, they continue to call and email me asking for the same documentation and telling me I am still not " officially '' rehabbing my loan even thought they are collecting payments every month. Today I sent them yet again every document they have asked for. I wonder if they are losing my documentation which contains highly sensitive personal information, and I wonder if they just continue to stretch this out to increase their fees. Why would the Federal Government enlist such an incompetent or unscrupulous company to act on their behalf?

I contacted the Department of Education in an effort to verify that the information being reported on my credit report was accurate back in XX/XX/XXXX. I have sent several letters asking for proof ( with my signature ) that the amounts they are requesting be verified. They have sent letters back and included an e signature on a promissory note. They garnished my income tax last year and this year. This years garnishment was done in XX/XX/XXXX which totaled {$6900.00} I just pulled my credit reports onXX/XX/XXXX and they are still showing that the balance that I owe DOES NOT reflect that anything was paid towards the balance. In other words prior to XX/XX/XXXX my balance that they said I owed them was {$12000.00} and upon pulling my credit report on XX/XX/XXXX the balance still shows that I owe them {$12000.00} which is incorrect. As of today XX/XX/XXXX I logged into my debt summary for the Department of Education and it shows that I only have a total of {$6200.00} in student loan debt. This inaccuracy on my credit report is causing a drastic problem with my scores and I need them to report accurately and remove this debt totally from my report!

I have a debt with XXXX XXXX XXXX XXXXXXXX. The company handling the debt is FMS XXXX. I am trying to establish written dialog with the company but they have refused to communicate via mail. I asked via mail, early XXXX, to send information on a loan rehabilitation program. I sent two more in XXXX. Every time I sent certified mail. The third time I expressly wrote on the document to communicate via mail. In all responses, I only received a typed notice with .... " If FMS has a phone number on file, we will attempt to contact you .... '' Is this something I can rebut and expect them to contact me via paper mail? It feels exploitative and hostile. Am I wrong? I have been working long term with single parenthood, homelessness, psychological repair, and other, I feel, unfair challenges. FMS seems to have only found me because I tried to work out a plan through an attorney and then contacted me after I couldn't afford the attorney anymore. At approximately XXXX on XXXX XXXX, 2016, an agent of FMS called me ( http : //www.fmsdc.com/ ). They said I was listed as a reference for a family member and needed my family member 's contact information. They said my family member gave them my contact information ( misrepresentation # 1 ). I asked if they were a collection agency and they refuse to confirm nor deny ( misrepresentation # 2 ). I asked to speak to a manager and I was told the manager 's name was XXXX XXXX. They gave me their mailing address which was different from their website address. According to the Fair Debt Collection Practices Act, FMS clearly had the intention to misrepresent to me they were an agency hiring my family member. When asked point blank if they were a collection agency they would not affirm. Their website is clearly a debt collection agency. This is not the first time the agency has called me requesting information. I have been trying to get FMS to work with me to help me repay a loan which I believed was still with my original lender, XXXX XXXX, on deferment but to no avail. Finally, the head of the call center, XXXX XXXX, agreed to set me up on a payment plan of {$5.00} per month if I would send a signed letter to them confirming I have XXXX people living in my household. I let him know I would not be filing taxes for the fourth person as a dependent, but he assured me my signed letter would be enough, and I would have no further issues with a payment plan. I cant even attend school to better my life because of the student loans being in default. I have tried to work this matter out with the Dept of education, i have sent in all the documents they asked me to. the denied me, saying i am respsonible to pay the money back. I submitted a complaint against FMS Investment Corporation last year because while attempting to arrange reasonable payment arrangements, they submitted a Federal offset to the IRS. I recently noticed that they responded to that complaint, but their letter was sent to the incorrect address. Since then I have consolidated my student loans, all student loan servicers were notified ; however, FMS Investment Corporation is still showing as a collection agency and they still have not removed the XXXX offset. By comparison, a different student loan collection agency immediately removed the XXXX offset when they were notified that the student loans were being consolidated. The student loan servicing agency who hired FMS Investment Corporation for collection is no longer servicing my student loan and the offset should immediately be removed. I believe the school I was attending at the time was University XXXX ; however, I immediately enrolled in XXXX School so it could be also be XXXX University.

Currently having my wages garnished without due process. Collection agency, FMS did not send any notices prior to sending my employer the " Wage garnishment order ''. When calling FMS to verify, they told me the notices were sent to an address I lived at ten years ago! The company requested information ( which I faxed, with proof ) t o verify my demographic info : Lease, driver 's license, proof of mail, bill statements, etc. Only for them to say, " they did not get the fax '', a month later. Entered into a rehabilitation loan repayment program about 11 months ago and was told that First, the interest would be at XXXX balance owed when completing the program. I have looked into the law regarding what governs this under 34 CFR 662.405 section 4, Vi, Paragraph B, of which it clearly states that they can not charge more than 16 % total collection costs to be added to the unpaid principal of the loan when the loan is sold to an eligible lender or assigned to the Secretary, which may not exceed 16 % of the unpaid principal and accrued interest on the loan at the time of the sale or assignment. The amounts shown would indicate that this would be more than 16 % and I was not notified within the 45 days of this assignment that it also clearly states in the CFR. I had brought this to the attention of the interest charges were way to much and I am asking that they recast the discrepancy that I had originally requested before transfer to a servicer.

I was contacted by XXXX XXXX XXXX XXXX XXXX, NC XXXX about a defaulted student loan. I was well aware of the loan status. I had a Garnishment Hearing Decision on XXXX XXXX, 2015, from the Department of Education, for my Student Loan Debt..They decided that I owed {$24000.00} for the outstanding principal and {$13000.00} in accrued interest. While the person 's voice did not seem threatening, when I called to offer a payment agreement the person on the other end said he could not accept the {$50.00} per month I offered because there were government regulations. He did of course mention I could be subject to wage garnishment or a lawsuit. He said he could not work with me filling out a form. During a time of financial hardship I fell behind and was unable to make student loan payments. I have been assigned to the loan servicer called FMS. I was never informed that a loan went into default as I have been using XXXX for another school loan and believed it was my only XXXX. Recently received an order from my employer 's Human Resource Department that my wages were going to be garnished due a student loan. Now, I was aware of the actual student loan, but the garnishment of not only my wages, my taxes where also seized. Thus, I called the collection agency to verify and they HAD THE WRONG ADDRESS!! The I3Group is a harassing company and apparently they dont have information that they are claiming to have about my student loan. My loan is not in default but they insist that it is. I make my payments and when I look at my federal loan account online statements when they called they said that the information is not correct.
