On XX/XX/2021, I first notified CBC Mortgage/Chenoa Fund of difficulties I was experience with a lender that the approved to use their Chenoa Fund XXXX XXXX XXXX mortgage and asked for assistance. The company ignored this email. On XX/XX/2021, I sent a follow up email, advising CBC Mortgage of my situation and of the complaints that had since been filed with the CFPB and AZ Dept of Insurance and Financial Institutions, where the primary lender/loan officer is located. I sent a third request to XXXX Mortgage on XX/XX/2021, with even more information and additional supporting documentation of the serious issue at hand with the original mortgage. I have since then called and spoken with XXXX XXXX, who advised that the company denied my request to have them remain in the subordinate 2nd lien position while I refinance my loan, as suggested by AZ Dept of Insurance and Financial Institutions to rectify the issues surrounding the original mortgage settlement. XXXX has not provided any additional information as to why my request was denied, even though I both called and emailed requesting for a specific reason that my request is not inline with their own policy, as it appears to be the exact situation their policy covers. I believe that I am well within compliance for the policy to receive an exception from CBC Mortgage to have them remain in the subordinate 2nd lien position as I refinance as it has been discovered discovered that the original loan has a loan defect, and according to their own policy, CBC Mortgage would subordinate to this refinance, as a cure to the defects in the original loan. The defects and neglience of the original lender/loan officer has been documented and reviewed by AZ Dept of Insurance and Financial Institutions and the original lender themselves ( XXXX XXXX ), agree that there were defects in the handling of the original mortgage loan and settlement. The original lender, has so far corrected some of the defects, and covered expenses to do so and we are hoping they will continue to do more to correct the remaining issues. CBC Mortgage/Chenoa Fund seems to not hold themselves accountable to their own policies and I am asking another government entity to review and intervene.

On XX/XX/XXXX, I submitted all the required documents to XXXX XXXX XXXX XXXX XXXX. to request a loan modification. I constantly reached out to them on a regular basis to request an update, and was informed each time to contact them about a week later. Finally, during the end of XX/XX/XXXX, I was informed that XXXX XXXX XXXX XXXX XXXX. was not listed in the first position and that my second lender, CBC Motgage was listed as being listed in the first position. According to CBC 's representative, they are listed on the record in the second position. I provided XXXX with a copy of the Certificate of Satisfaction on XX/XX/XXXX and the documentation was sent directly to XXXX XXXX, whom I late learned was a supervisor in the Loan Modification division. After calling to follow-up, I was informed two weeks later that XXXX XXXX has yet to process or upload any documentation and there wasn't anything in the system to reflect that they had received the document. I also followed up on approximately XX/XX/XXXX or XXXX to request an update, and I'm no longer closer to finalizing this process. On XX/XX/XXXX, XXXX XXXX sent an email to XXXX to notify XXXX that they are listed in 2nd position. They also requested documentation verifying this information. I followed up again on the same day, to ensure they received XXXX XXXX email and was told that they needed documentation from CBC. I stated to the representative that I could connect the CBC Mortgage representative and was told to have them reach out to XXXX XXXX, to have them send the documentation. I have checked the XXXX XXXX Deed of Records and am unable to find a document that shows CBC Mortgage in first position. Can you please assist me with resolving this matter? It is hinder me from filing a loan modification under XXXX XXXX XXXX
