This complaint is against CBM Collections ' collection claim, on behalf of XXXX XXXX XXXX in XXXX, as it appears in my credit report. XXXX collection claim is not valid, since it is demanding payment of monies I never committed myself to pay them. I was billed for almost double the amount I was quoted for a XXXX procedure. In 2014 I paid to XXXX XXXX XXXX slightly over {$300.00} for a XXXX. This amount of slightly over {$300.00} was what I was quoted for a XXXX procedure. I never contracted any responsibility to pay any extra amount XXXX may wish to receive. I did not receive any additional service to justify the difference between the amount I was billed for and the amount I was quoted. Therefore, I can not accept nor submit to such claim. XXXX XXXX XXXX excuses the discrepancy between the amount quoted and the amount billed, because they alerted the amount quoted had to be prepaid. According to them, that meant the amount quoted was only an initial payment, but the final amount due would be anything over the amount quoted. XXXX explains their quote does not provide any insight of what would be the final amount due. Instead, I have pointed out that what XXXX calls 'prepayment ' is actually generally referred as 'down payment '. It only takes to look up a dictionary to understand a 'prepayment ' is a payment that needs to be completed before services are rendered. If XXXX quote is only a statement of an initial, partial payment, but does not provide any insight of what will be the final amount due, then they need to say so. They need to clarify the quote is only a down payment, but the final amount due is undetermined. XXXX has a very obscure and deceiving way of conducting business : they quote a very low amount to get the client 's business, but then they bill you for a much higher amount. If the client does not submit, they ruin your credit rating. The mismatch between the terms 'prepayment ' and 'down payment ', is not accidental, but absolutely intentional. XXXX continues its practice of referring what is actually a 'down payment ' as a 'prepayment. When XXXX submits its collection claim in my credit report is making a statement I am not financially responsible and do not meet my financial commitments and responsibilities. They are alerting lenders and creditors, there is a risk I may not return the money I borrow or may not pay as promised. That statement is false. XXXX claim is false. Plain and simple : I never agreed to pay the amount XXXX claims I owe them. The truth is XXXX is actually trying to rip me off and is hurting my credit as a way to coerce me. Please, find attached my letter of grievance to XXXX.

On XX/XX/XXXX I was served paperwork saying I was being sued by CBB Collections over a repossession I had with XXXX XXXX XXXX I called them multiple times and attempted to make payment arrangements that were reasonable for my budget to avoid being garnished. They refused to work with any amount I told them I could afford and told me I had to pay at least {$400.00} or so to avoid them sending in for a judgement. I filed my taxes and told them okay I would be able to just pay them once it came in. They told me I would have until the agreed upon date of XX/XX/XXXX to pay the full amount of XXXX that I owed to avoid the judgement. The week of I called them and informed them my return was being delayed and requested them to just hold off until the money came in. They refused and told me all I had was until that deadline. I called them back on XX/XX/XXXX when my refund got to my account and asked if they had sent in for the judgement and they said they never did and that I still had the option to pay. I paid the {$5400.00} on XX/XX/XXXX. In XXXX XXXX XXXX ( this year ) I sent an letter to XXXX XXXX XXXX requesting they delete my tradeline since I paid them in full the year before through CBB Collections. The lady informed me they never received payment from CBB and told me I still owed them the balance. She told me the balance owed was {$4900.00} not the {$5400.00} that CBB told me I owed them. The lady at auto credit financial told me CBB told her the debt wasnt paid. I told her no this is wrong because I paid them one year prior. She emailed me back and told me she called CBB and that CBB told her that I paid the balance in XXXXXXXX XXXX XXXXXXXX and they would send her payment as soon as they could. I told her this was incorrect because I paid them XXXXXXXX XXXX XXXXXXXX and I provided her with my bank statement showing the transaction of {$5400.00}. She said she would have to contact them and find out why she did not receive the payment the year I actually paid. I have not heard back from her since. Right after speaking with her I called CBB and left a message and never received a call back. I then emailed them and never received an email back. CBB Collections not only lied to me and took an extra {$490.00} on top of the actual balance owed, but they also held onto that payment for a full year and lied to auto credit financial and told them I never paid them in XXXX and paid them in XXXX. CBB reported to my credit report that they received payment XX/XX/XXXX. Because of this auto credit financial has been reporting this open bad account as being unpaid for a full year and it has been damaging my credit.

I opened account in XX/XX/XXXX with XXXX XXXX XXXX for a used SUV. On XX/XX/XXXX I moved across the state and ended up defaulting on the loan as a result of an incident involving XXXX XXXX from an ex boyfriend. Sometime near the middle of XX/XX/XXXX, a guy showed up at my residence and hooked up his vehicle to my SUV associated with the account from XXXX XXXX XXXX, said he works with XXXX XXXX XXXX and took off with my SUV. I never received any communication from XXXX XXXX XXXX as to the repossession of the vehicle. Nothing. Then I notice sometime later on my XXXX credit report the account with XXXX had been reported on as current ; paid or paying as agreed and listed under " satisfactory. '' The account was never reported as " repossessed. '' But I noticed a second account from XXXX XXXX XXXX was opened in the middle of XX/XX/XXXX, after I had moved across the state and there being no communication whatsoever with XXXX. It stated the " last payment made '' was in XX/XX/XXXX. I knew absolutely nothing about this account let alone having made ona single payment on this account! I noticed this second account was stemming from the initial account I opened with XXXX. XXXX XXXX XXXX took the vehicle..had the vehicle in their possession yet fraudulently opened a second account in my name and expected payment on a vehicle they repossessed! After several years, the initial account was closed then XXXX sold the fraudulent account to a debt collection agency, CBB Collections, as seen on my XXXX credit report. In true fashion, as with XXXX, I never received any form of communication whatsoever from CBB Collections as to the account they acquired from XXXX XXXX XXXX. Then on my credit report, it shows the total owed to these two companies is more than {$12000.00}! To me trying to comprehend what the heck is going on, it appears I now owe more than {$12000.00} to two different places for a vehicle that XXXX took back possession of. I refuse to take responsibility for these 2 accounts because first and foremost, I do not have the vehicle anymore, essentially it was involuntarily given it back. And second, I didn't open a second account with XXXX XXXX XXXX to sell to a debt buyer. As far as XXXX goes, I can't seem to get anymore to update my correct information including my current name.

This account with CBB Collections is an account that was " assigned '' to them in XX/XX/XXXX by XXXX XXXX XXXX. XXXX XXXX XXXX fraudulently opened an account in my name in the middle of XX/XX/XXXX after I had moved across the state XX/XX/XXXX because of XXXX XXXX XXXX XXXX XXXX. I did have an initial loan with XXXX XXXX XXXX for a used SUV but I unintentionally defaulted on that loan after I moved. XXXX XXXX XXXX had repossessed the SUV in the middle of XX/XX/XXXX but spent the next 4 1/2 years adversely and fraudulently reporting to the credit bureaus not only on the account attached to the repossessed SUV but also on the second account they opened in XX/XX/XXXX AS WELL AS " assigning '' the fraudulent second account to CBB Collections who then began reporting negatively and continue to do so to the credit bureaus. After I discovered all of this on my credit reports, I tried multiple times to dispute with the credit bureaus only to have the results stay the same and on my reports. I finally filed complaints regarding XXXX XXXX XXXX as well as XXXX and CBB Collections with your company. The second, fraudulent account with XXXX XXXX XXXX ended up getting deleted from my credit report with XXXX but the account from CBB Collections stayed as they " verified '' the account for CFPB and the initial account with XXXX XXXX XXXX was corrected and now states " Paid '' with a " Balance {$0.00} '' as well as " exceptional payment history. '' Now I'm having the same exact issues with CBB Collections and XXXX. The account with CBB Collections should be null and void and they should not still be reporting a balance of {$5800.00} owing as well as continuing to report on the account each month because the account that was assigned to them has been proven to be a fraud! They no basis on which to attempt to collect any amount of money on an account that technically did not exist! I want this removed from my report before I have to retain a lawyer and sue each and every company involved for preventing me from being able to secure credit and further build my credit worthiness on my good name.

He mistakenly gave out my personal information to this collection company without my permission. Once my information was given out, the collection company proceeded to call, until they reached me through my workplace. I advised them to stop calling me at work. They did not validate any information over the phone as Section 809 of the Fair Debt Collection Practices Act, subsection A states. In XX/XX/XXXX, I gave XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX in XXXX XXXX. There were some issues surrounding XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I believe that this issue was due to provider neglect. Further, none of the providers had followed up with me to check on my well being or explain why the traumatic experience had happen. After I was recovered from the XXXX I began receiving medical bills. I was in communication with the clinic on negotiating a payment, as my deliver seemed to not be properly billed to insurance. Additionally, I have communicating to the clinic about how I shouldn't be responsible to pay for a delivery that resulted in a very negative experience. Not shortly after the delivery, my medical bills were sent to collections. Within the short period of time that they were in collections at CBB, inc XXXX XXXX XXXX, I was in communication with the debt collector. I had notified them the issues surrounding insurance and that fact that I was working with insurance and the clinic to resolve my debt issues. On XX/XX/XXXX, I received a notice that legal action is being taken against me. I do not believe that CBB Collections has sufficiently put forth an effort in contacting me before taking legal action. Additionally, I had been the one to make the initial phone call to arrange a payment plan in XXXX of XXXX, which I had done. When I spoke with the debt collector on XX/XX/XXXX, he had mentioned that the payment plan wasn't complete and I had failed to sign a contract implementing the payment plan.

CB1, Inc. out of XXXX MT, failed to notify me of debt within 5 days as required. When I requested validation of my debt in the form of a letter, sent certified for proof, under the Fair Debt Collections Practices Act, they failed to provide the following : Verification that there is a valid basis for claiming I am required to pay the current amount owed. Notation whether this debt is within the statute of limitations and how that was determined. Proof that I agreed to pay this debt in the form of a document with my physical signature on it, stating that I agreed to pay this debt. HIPPA release form stating they have permission to access all of this aforementioned health data. Details about their authority to collect this debt : whether they are licensed in Montana, and if so, to provide the date on the license, name on the license, as well as the license number, and the name, address, and telephone number of the state agency issuing the license. Not only did they fail to provide their authority to collect debt within the state of Montana, the inability to provide a HIPPA release from authorizing them to have permission to access all of my private health data is a gross violation of my rights under HIPPA. I followed this with a letter of dismissal, as they have no legal right to harass me into paying any debt they can't prove that I owe, or that they have the authority to collect. I promised them the next action taken by me would be a complaint to the Federal Trade Commission if they refused, so here we are.

Received letter on XX/XX/23 and the letter is dated XX/XX/23 stating notice of legal action. I called the collection agency ( XXXX collections ) on XXXX XXXXXX/XX/23 and spoke to XXXX at ext. XXXX asking to make a payment arrangement of {$250.00} and he advised he can't set up an arrangement because its past the date and will move forward with legal. I advised him that the letter states I can set up reoccurring payments but yet he is telling me I can't. He then asked of my husband 's place of work and I advised him absolutely not. asked him about the legal part of the letter and he said he can't discuss anything he can only take a payment. All he was saying is " hmm hmm '' and : ok : and was being very vague. I asked to speak to someone higher up than him which was XXXX XXXX which she was unavailable and I left a message. I told XXXX he cant not harrass us at our plaace of work so I will not be giving him the location. I also told him this is the first letter I received so I was I supposed to take care of this sooner if I have not received a letter, but he said they have sent several letters and left voicemails on my husband phone which he has not received. I am asking the appropriate questions and they arent giving me any information other than I need to pay immediately and if I dont then the legal action will just move forward

In XX/XX/2019, I received a phone call from CB1 Inc., in the conversation they stated that they possessed a debt of mine but have discussed the matter with my ex and she agreed to a payment plan with my ex. I stated that if anything changed to notify me but that my ex had the mail forwarded to her new address. They stated that they would mail everything to my current address even though the mail was being re-directed. I didn't hear anything ever again from CB1. CB1 maintained contact with my ex ( not the account holder ). They never contacted me ( the account holder ) again even after my ex defaulted on her payment arrangement with CB1. I found out what was going on by reviewing my credit report. Once I knew what was going on, I sent a debt validation letter and requested for all derogatory marks on my credit report be removed until this could be properly validated and handled. CB1 refused to take appropriate action and to follow the required instructions per the FDCPA. The attorney for CB1 has lied on multiple occasions and has attempted to XXXX me into doing what CB1 wants without CB1 taking appropriate action. I have filed a letter disputing the debt but have not received a response.

I was struggling to communicate with the collector previously as I was working to find a payment plan that would work to pay off the XXXX $ medical bills that I accrued from routine care at the XXXX. SEE ATTACHED. Petitioner incurred roughly {$220.00} in services at the XXXX XXXX XXXX XXXX XXXX. Petitioner paid {$25.00} on-site as a deductible and the XXXX XXXX XXXX XXXX XXXX said they would bill his insurance. For whatever reason, they then began billing him for {$190.00}. Petitioner attempted, unsuccessfully, to have them charge his insurance company and ultimately paid the {$190.00} debt out of his own pocket. Now, four years later, Petitioner has learned that the XXXX XXXX XXXX XXXX XXXX never accurately reconciled the debt as being paid and, to make matters worse, sent the debt to XXXX XXXX XXXX, a debt collections agency in XXXX XXXX, MT which has been falsely reporting the debt as being unpaid and in " Collections '' to credit bureaus. Worse, they have been levying " fees '' and " interest '' on a debt which had been paid off years earlier. Both Defendant 's have been notified of their errors and have refused to correct their actions.

I received a letter from a debt collection company dated XXXX XXXX, XXXX ( attached ) stating I owed their client {$160.00} before penalties. When I added the alleged amounts up, it only came to {$81.00} and I disputed everything in a letter dated XXXX XXXX, XXXX ( attached ) and requested information to prove the alleged debt. I received a response back from the debt collector dated XXXX XXXX, XXXX ( attached ) showing even more alleged debts and adding up to the original {$160.00}. They stated they would get me the information I requested. Yesterday ( XXXX/XXXX/XXXX ) I received a phone call from the debt collector. They stated, " If I want the detailed information, I would have to contact the original creditor myself. '' In other words, the debt collector does not have the detailed information and can not provide it to me. They 're only going on the word of the original creditor the alleged debt is owed.

CBB a debt collection company has reported to all three credit reporting agencies that I owe and amount on a medical bill. The amount reported is wrong. The payments being reported is wrong. I sent CBB a letter on XXXX XXXX by certified mail asking about the mis-reported balance and that i had made that payment and paid that account off. I heard nothing back from this letter. I pulled my credit reports from all three credit reporting agencies and noticed that they did not mark in the comments that this account is being disputed as required by law. I sent a good will letter to them by certified mail asking that this misreported, inaccurate report be removed by them from all three credit reporting agencies or I was going to take further actions. CBB still has not responded to any of my inquires or letters to date.

I am XXXX. Faxed letters dated XX/XX/XXXX, XXXX, and XX/XX/XXXX informing CB1 Collections to cease and desist all contact and that I would only work with the creditor. I have received repeated phone calls have been made to me on XXXX, XX/XX/XXXX, XXXX, and again today on XX/XX/XXXX. The individual who called me today said his name but I had to ask him who he worked for. After he told me CB1 Collections, I hung up. I attempted to fax CB1 Collections another letter after they called me this a.m. However, I received an unsuccessful fax transmission notice ... CB1 Collections should be fined for violating the FCRA and noticed to stop calling/contacting me, period ... I have made repeated attempts to contact the creditor via fax, email, and mail without any response from them regarding settling the debt too ...

On XX/XX/22 I sent CBM collections a letter requesting a validation of an alleged debt they placed on my credit report. On XX/XX/22 They sent back a ledger that was made from their office. Also my understanding debt collectors are required to identify themselves when they attempt to collect a debt as well as note that any information you give them will be used in an attempt to collect the debt, which it is NOT marked anywhere on their " ledger '' they sent me. On XX/XX/22 I sent them a cease and desist and failure to validate the debt and requested they remove the account immediately considering they have violated more than one FCRA and FDCPA laws. They have not responded since, not have they removed this account from my report. I have included all correspondence as well as my credit report.

A collection agency reporting on my credit report CBB Collections is reporting two accounts. I have no knowledge of these accounts, they have not contacted me, by phone, mail or any other means. I called them to find out why it was there and what exactly it was approximately 30 days ago. This company was unable to verify my information fully, also was unclear what this was it took them sometime to figure it out. I attempted to resolve the accounts while on the phone call and because they could not verify some basic information I could not see spending almost {$2000.00} on something that could possibly not be mine. I requested the information they had and still havent received anything from them, I also have disputed this information and it still remains on my credit report.

This company is attempting to collect a medical debt from a hospital. I was covered by my insurance at the time, and they continue to tell me that I owe money. Furthermore, they make harassing statements to me once a month, with things like this : " If someone owed you money and you sent them a bill, do you think you would deserve a reply? What is it going to take to get you to pay your obligations? '' The most recent correspondence was dated XX/XX/2018 - but I have been receiving messages like this for the past year, if not two. Also, the amount of the dispute is incorrect. They are adding interest and fees that are not something I am going to pay.

My husband had a XXXX bill that he never received a bill for ( and assumed insurance had paid for so was not aware that it existed ) and the debt was accrued before he married me. However the collection company ( CBB Collections of Billings ) served him with papers to try to collect the debt. He went in to the collector company made a payment and made payment arrangements. However a week and a half layer the sent me papers as well. I 'm not sure if my complaint is light and perhaps they have every right to do this. But it is extremely frustrating when your an honest person and no one cares when u try to make it right.

I have a debt with CB1 Collections Agency. I called and spoke with a representative on XX/XX/XXXX at XXXX XXXX trying to resolve the issue and pay the debt in full. She said she was unable to work with me and that she could not accept payment as they already filed in court. And that I would be served. They would like me to pay the fees for filing in court for a process server although I have never been served. This has now extended for two months and negatively affected my credit.

I have a verbal agreement with the manager of the company in front of his lawyer of XXXX a pay period, I tried to make the payment for this pay period on their website as I have done since XX/XX/2019 after the agreement and it won't let me make the payment, the website says the XXXX is less than the agreed upon amount, I have received no notification from them that I can no longer only pay XXXX a paycheck. I feel this is an unfair practice to make me miss a payment so they can sue me. I have tried several times to make the payment and it won't go through.

They can not validate this alleged debt and it needs to be removed from my credit report.

XXXX sent me several letters on my account stating that it is closed because of money that I owed them. I contacted them and requested to dispute the transactions, but they were unable to assist me further and proceeded to mail me more letters. I mailed a letter back stating that I will not pay them what I owe because I did not authorize it and they sent more letters to me, this time to my different address. This is leading to harassment because I asked them nicely to stop the first few times
