Cascade Capital LLC [ XXXX Old XXXX XXXX ] [ XXXX, CA, Zip XXXX ] [ XXXX ] [ XXXX ] Re : Pre-Arbitration Demand Letter Pursuant to the Fair Debt Collection Practices Act ( FDCPA ) and Unlicensed Debt Collection in the State of Georgia Dear Sir/Madam, I am writing to bring to your attention several serious concerns regarding your debt collection activities as they pertain to me, [ XXXX XXXX XXXX XXXX and to demand immediate resolution of these issues prior to the initiation of arbitration proceedings or federal court proceedings. This company sold my information to a Debt collection company by the name of XXXX XXXX, XXXX XXXX XXXX XXXX XXXX California XXXX. I had no business with Cascade Capital LLC and you have no license to collect debt in the state of Georgia, I have exhibits of you having no license to collect debt furthermore I have written communication that you provided my information to this company, and also recorded phone calls from this company stating that you sold them my information. I also was harassed by the agent when I told him I was at work and continuously to harass me at my place of employment stating that I owe a debt. Furthermore, than decided to send me more information after I stated on my recording that I refuse to pay the debt, and you have the wrong person. You or the company you sold the information to have a license to collect. I have written communication from the company that admit to you selling my information, and recorded phone calls of harassment. You have violated the Fair Debt Collection Practices Act You have violated the Gramm-Leach-Biley Act You have violated the Consumer Financial Protection Act You have violated the Federal trade Commission Act 15 USC 1692c 805. Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt -- ( 1 ) at any unusual time or place or a time or place known or which should be known to be inconvenient to the consumer. In the absence of knowledge of circumstances to the contrary, a debt collector shall assume that the convenient time for communicating with a consumer is after XXXX XXXX XXXX and before XXXX XXXX XXXX, local time at the consumer 's location ; ( 2 ) if the debt collector knows the consumer is represented by an attorney with respect to such debt and has knowledge of, or can readily ascertain, such attorney 's name and address, unless the attorney fails to respond within a reasonable period of time to a communication from the debt collector or unless the attorney consents to direct communication with the consumer; or ( XXXX ) at the consumer 's place of employment if the debt collector knows or has reason to know that the consumer 's employer prohibits the consumer from receiving such communication. Violation of the Fair Debt Collection Practices Act ( FDCPA ) : Under the Fair Debt Collection Practices Act ( FDCPA ), debt collectors are prohibited from engaging in abusive, unfair, and deceptive practices when attempting to collect debts from consumers. I believe Cascade Capital LLC has violated my rights under the FDCPA in the following ways : 15 USC 1692d 806. Harassment or abuse ( 5 ) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the called number. a. Harassment and Abuse : [ Provide specific details of any harassment or abusive conduct you have experienced, such as incessant phone calls, threats, or intimidation tactics used by Cascade Capital LLC. I have exhibits as in emails and recorded calls from an agency that you sold my information to without my consent. I explained that I was at work to the representative, and he kept talking stating that I need to pay a debt after I explained I refused to pay the debt on recording and Im at work and he caused me to get in trouble from continuously to call me. ] b. False or Misleading Representation : [ Specify any false or misleading statements or representations made by Cascade Capital LLC in their debt collection communications. This company has sold my personal information to someone who I have not provided written consent and doesnt have a license to collect debt in the state of Georgia . ] c. Unfair Practices : [ Describe any unfair practices you have encountered, such as misapplication of payments or the imposition of excessive fees. This agency also didnt verify the amount they are telling me to pay that is not my debt. I have been injured by this at work. ] These alleged violations of the FDCPA have caused me significant distress and financial harm, and I insist on prompt resolution in accordance with the law. Unlicensed Debt Collection in the State of Georgia : I have reason to believe that Cascade Capital LLC is conducting debt collection activities in the state of Georgia without the necessary licensing as required by state law. Under Georgia law, debt collectors must be licensed to operate within the state. Please provide evidence that Cascade Capital LLC holds the requisite license to collect debt in the state of Georgia. Failure to do so will constitute a violation of Georgia state law. I demand that Cascade Capital LLC takes immediate steps to rectify these issues by : a. Ceasing all further debt collection activities against me. b. Providing written confirmation that the alleged debt in question has been withdrawn or resolved. c. Providing written confirmation that Cascade Capital LLC is licensed to collect debt in the state of Georgia. d. Acknowledging, in writing, any violations of the FDCPA and a commitment to cease any further prohibited conduct. e. Providing compensation for any damages, including actual damages and legal fees, incurred as a result of the FDCPA violations and unlicensed debt collection. This letter is not an admission of any liability on my part, and I expressly reserve all my rights and remedies under federal and state law. I did a voluntary repossession returning the vehicle financed through XXXX XXXX on or around XX/XX/XXXX. The account was charged off. Then last year in XXXX XXXXI received a notice that Cascade Receivables Management would begin taking legal action against me by filing a suit against me rendering a judgement which would give them legal means to freeze or levy my bank account or accounts. I receive XXXX benefits. At the time I financed a XXXX XXXX XXXX while working at XXXX XXXX to supplement my income. I became unemployed and could no longer afford to pay the monthly payments. I turned over the vehicle and they were franticly telling me as I was walking out the door that they had a form that I needed to sign. I dont know what the form was or what it said as I never signed it. I just got into my friends car and he drove me home. I hadnt received any notices in writing via mail or phone from any collection agencies until XXXX of XXXX when I received in the mail a collection notice stating that if I did not respond or dispute the debt that Cascade Receivables Management would begin taking legal action against me filling a lawsuit and a judgement would be rendered giving them the legal means to levy or freeze my bank account and in addition to that garnish my wages for outstanding debt. I called the collection agency XXXX XXXX aka XXXX had turned over to Cascade Receivables Management. I spoke with a Mr. XXXX and I dont recall if I told him that I received Social Security XXXX. I did tell him that I worked part time at XXXX XXXX XXXX. I wasnt going to respond to the collection notice thinking it wasnt legitimate. I called XXXX and spoke to a female ( I cant recall her name ). I asked her if she could please provide me with the Collection Agency they used as I wanted to confirm that Cascade Receivables Management was a real collection agency. The female did verify that was the collection agency they turned the account over to. At the time in XX/XX/XXXX I had verified that I was XXXX XXXX and was honest with Mr. XXXX. I in good faith and conscience desired to address the debt since I was being threatened with a civil lawsuit and was threatened that once a judgement was made against me that my bank account and other accounts would be frozen or a levy would be enforced preventing me access to my bank account. The bank account I have is with XXXX XXXX XXXX and I have direct deposit of my XXXX benefits to my account. I thought about calling Mr. XXXX back to confirm with him that most of my income is from XXXX. Since I worked part time at XXXX XXXX XXXX I decided to not go to blows with Cascade Receivables Management over the outstanding debt as my conscience bothered me greatly over knowing I had this negative mark in my credit file. I did agree to pay Cascade Receivables Management {$250.00} a month due on the XXXX of every month until the account is paid in full. Mr. XXXX I do recall telling me he would see about helping me something about a reduced amount or something of that nature. I thought okay great I will be helped with getting some kind of credit towards the debt owed. Maybe I didnt understand what he was telling me as I was scared and nervous just even picking up the phone. Honestly I was wanting to do the right thing because I thought it would help my credit score and turns out it has not. I was told by a few friends NOT to respond or agree to pay anything and to ignore the collection letter. I had been a XXXX XXXX for 12 years and I got clean and have been clean for 3 years and before that clean for 4 years but I relapsed. I became homeless and lived on the streets of XXXX XXXX even tried to XXXX XXXX. I got myself clean on my own. I went cold turkey. It was the best decision I ever made. I went to working on my credit about 2years ago. I paid off 4 charged off creditors. Even though I paid in full it really didnt help my credit. It showed paid but still as a collection. Fortunately 2 of the paid collections were deleted from my credit file. I apologized to Mr. XXXX for ignoring the letter but I told him I put aside my fear and that I was working on cleaning up the damage I caused myself. I guess what Im saying is Im no longer homeless and I have food to eat and a place to sleep at night. Im glad to be alive and happy I chose to not overdose or jump off the overpass back in XXXX. Im sorry for telling you all this but I just want you to know Im not complaining about it because what I learned is to let go and let God and to accept things as they are. I didnt fight Mr. XXXX the collector for Cascade Receivables Management as I wanted to be at peace with myself about my debts I created and failed to pay in full those companies I owed. After all if I didnt pay my debts then Im a liar. I agreed to pay those companies I owed and if I didnt make good on those outstanding debts then I would be in fact a liar. I didnt want that on my conscience. I was financially responsible. I now help others and have even help a few pay their debts whenever I had the means to do so. I learned that the 12 steps to sobriety is worth it. Today I love myself and Im proof that it works if you work it and the promises really do come true. I reclaimed my life. And even when my Father passed away XX/XX/XXXX I didnt relapse. I stayed focused on myself even though I wanted to numb the pain over the loss of my Dad. I didnt I got through because of my Higher Power. Please forgive me if I used this filing of a complaint to tell you what happened in my life which effected my choice to pay the debt owed to XXXX. I could have argued the point with Mr. XXXX that they couldnt legally collect this debt since I am receiving XXXX but I didnt. I believe that God knows what I must do and so I listened. On XX/XX/XXXX, my XXXX XXXX XXXX daughter who was experiencing a case of XXXX XXXX XXXX with XXXX XXXX XXXX XXXX was taken to the nearest XXXX. The reason I had taken my daughter to this XXXX XXXX is that only 2 weeks prior she had been diagnosed with XXXX XXXX and was prescribed XXXX XXXX once a day. Her Physician had advised me to monitor her because there was a risk of having an XXXX XXXX to this medication and if that were the case to please take her immediately to the emergency room to have her examined. With that in mind we drove to this location which is only 10 minutes away from our home and which in a prior situation had an excellent experience. When arrived at the location it was XXXXXXXX XXXX it was a very prompt service. When we walked in, we were received by the triage receptionist who was attending a patient and asked us kindly to wait to be attended. We sat down and within a minute we were asked to come in to take vitals from my daughter and asked the reason we were there. After that, they promptly took us to the room where we waited to be attended by the attending physician. While we waited my daughter kept complaining of worsening XXXX, after she had begun to complain the attending physician came in with a smile. He asked my daughter what the reason for our visit was, as my daughter explained how she felt he continuously kept smiling and did little to nothing to help her with the XXXX which had proceed to get worse. He stood in front of her and didnt even care to thoroughly examine her. All he did was peek through her shirt and diagnosed her with XXXX. After he had examined her he prescribed her with XXXX XXXXXXXX XXXX which they did not have even though it was an XXXX. So at XXXXXXXX XXXX. no pharmacy is open at that time, he told us to look for one, mainly because there was none open nearby. We asked if they knew where to find a pharmacy that was open 24 hours but they said no. Not even 5 minutes in the XXXX when we were out the door. When I was there, I expected for my daughter to have a thorough examination or at least a shot to stop the XXXX from continuing. After being released I arrived at my home to see my daughter covered in XXXX in her back, buttocks and legs. I contacted her pediatrician over the phone again and she advised me to give her a double dose of XXXX, she was surprised that the XXXX Dr. had not administered nothing and seeing the pictures of her XXXX The pediatrician advised me to contact the billing department regarding this matter since the services provided was not the proper procedure for the allergic reaction nor the amount being charged. I have attached a picture, so you can see how she was. I was told by her pediatrician that the Physician was not careful enough to examine her correctly this could have been a XXXX reaction. As soon as I received the 1st bill I called the billing department for a detailed view of my statement and to explain the situation, but I was notified that they had established a specific amount when there are no procedures done and that the fact that I didnt received a satisfying service was not enough to help my bill. They told me I had received a discount for uninsured, I appreciated the discount and by no means was this discount enough to cover the service he gave us. What I was asking is for them to reconsider the amount billed that for a service of less than 30 minutes with no help for my suffering daughter I was asked to pay {$880.00} for the hospital visit even though nothing was administered that is not including the {$820.00} for the Physician charges. I understand that each hospital can charge what they desire. I started to call and send letters, after sending a letter on XX/XX/XXXX, and several phone calls regarding the charges the hospital was willing to reduce my bill from {$880.00} to {$140.00}. I did a payment plan for that amount and finished paying it. I spoke with the manager of this free standing XXXX and was told he would try to help me with the {$820.00} Physician charges but after several attempts he said he could not help me. So I started sending letters to the Physician 's billing department and I received no response. Then I started to receive letters from collection agencies regarding this bill and I would always ask to have this debt reviewed to see if the Dr. would lower the fee for his lack of attention. Also I have previously contacted the collection agency asking for verification of debt and they have not responded. After a while the letters ended but they began again with calls that just call and hang up and call again. They also called and no answer. So after a call that disturbed me regarding a collector stating he would sue me I started looking for information. I also learned that they have reported it to a collection agency as of XX/XX/XXXX. So I decided to contact the CFPB for help in disputing this debt. I have learned that this debt is past the statue of limitations. They have been attempting to collect a debt for the past 4 years and I have always responded to their letters but never received a response. Please help with the phone harassments and the continuous charge of {$820.00}.

Starting around the beginning to of XXXX I started getting calls from a couple different companies claiming to be debt collectors on an unpaid medical debt that I owed. In speaking with them they were referencing a medical visit that I legitimately had with the XXXX XXXX XXXX XXXX on XX/XX/XXXX. Their claim was that I owed money to a doctor that provided service during that visit named XXXX XXXX XXXX XXXX XXXX During the phone call they repeatedly made attempts to exacerbate the conversation, in what I can only assume was an attempt to try and prove that I was somehow an unreasonable actor and therefore use that against me. The fact of the matter is that I have repeatedly and consistently asked for the following over and over : ( 1 ) Proof that the debt is legitimate, ( 2 ) Confirmation as to why this debt was not properly submitted to my insurance that has no record of it, ( 3 ) Comment on why it is that the first time I'm hearing about the debt is from a " debt collector. '' During the months of repeated annoyance by these different collectors I've actually called XXXX XXXX XXXX XXXX, who states that not only do they have no records of that physician on my file, but that their records show that I've paid the bills they have on file. In addition, I've now reached out on two separate occasions to XXXX XXXX XXXXXXXX XXXX XXXX and spoken with the Accounting Department. Both times, I've received no confirmation that they either ( 1 ) provided service or ( 2 ) have an outstanding bill with me. In fact, both calls ended with the person I was speaking with saying that they would review my case with their manager and get back to me. To date, they have never gotten back to me claiming that the debt is legitimate. So I'm now finding myself with these agencies continually annoying me, and frankly I don't think I'm asking for anything unreasonable, but given the prevalence of fraud out there, I'm highly suspect that these people are even legitimate actors. I have told them repeatedly, that unless they can legitimately prove that I owe the debt, than I'm not paying them anything. To date, other than phone calls the only form of an invoice they've provided is something produced on their own letterhead, not the doctor 's, and that the doctor has not confirmed is even legitimate. In all cases, when I try and make these reasonable requests they attempt to draw the conversation out and get more and more aggressive with me, in an attempt to get me to be more aggressive. For example, I'll state what I'm looking for to prove that this is legitimate, and they will respond with something along the lines " Sir SIR, calm down, you owe this debt, and you have to pay your bills. '' I've even gotten responses like that after I clearly stated : " I have no problem paying legitimate bills, but you've yet to prove that this is legitimate. '' More questionable items on their part, is a claim to a varying dollar amount that I supposedly owe. I've been told that I owe anywhere from {$150.00} to {$730.00}, to somewhere in between. " Why the inconsistency? '' one may ask, no clear answer. In addition, on the phone they've referenced a date of service on XX/XX/XXXX, which was when I went into the hospital, but on a mailing collection notice they sent me, they claimed a date of service of XX/XX/XXXX. Why the discrepancy, who knows? I don't know what to do at this point as one of these collectors has dinged my credit, a first for me, and they've done so all without anyone being able to prove that this is even a legitimate debt. Their actions and attempts seem like nothing but pure scam, and frankly I would've ignored it as such, until one of them dinged my credit.

I had disputed this debt with XXXX and sent them certified mail that they were not to collect my bills as it was a HIPPA violation. They dismissed the debt, but the company sold my debt to another third party. Again, this violates my HIPPA rights as I never gave XXXX XXXX XXXX Permission or Acute Care Specialists PLLC, XXXX XXXX XXXX XXXX, or Cascade Capital Funding , LLC to sell my debt to a third party. Furthermore. I am allowed under the HIPAA law ( XXXX XXXX Portability and Accountability Act of 1996 ) to protect my privacy and medical records from third parties. I do not recall giving permission to XXXX XXXX XXXX XXXX for them to release my medical information to a third party nor did I give XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX, MN, XXXX Permission to sell my debt to Cascade Capital Funding , LLC XXXXXXXX XXXX XXXXXXXX XXXX, XXXX XXXX XXXX CA XXXX. I understand that the HIPAA does allow for limited information about me but any details may only be revealed with the patient 's authorization, therefore my request is twofold and as follows : I am requesting that the HIPAA covered entity or its business associate provide debt validation for an account in question. Please provide that validation in the form of agreement, and original bill, and a detailed statement of procedures is required, if any. Please provide a breakdown of fees, including any collection costs and medical charges, if any. Please provide a copy of my signature with the provider of service to release my medical information to. Please provide a report of comparative analysis between the dubious signature and the signature recognized by the alleged signer, if any. Cease any credit bureau reporting until the debt has been validated by me. Please provide me with a verited certificate of authority, and proof that your company is licensed to collect debt in my state. The Company in question is Cascade Capital XXXXwho garnished {$180.00} from each of my weekly payroll. They claim until the amount of {$3000.00} is paid for judgement against me in XX/XX/XXXX for a debt bought from Santander for a delinquent auto lien on a repossessed vehicle. The garnishment took place on the payroll of XX/XX/XXXX and XX/XX/XXXX. The problem is this debt was legally settled through another collection agency XXXX XXXX XXXX XXXX on XXXX XX/XX/XXXX. I was contacted on XX/XX/XXXX by my parents that XXXX XXXX XXXX XXXX called in reference the delinquent auto account from XXXX. The reference number is XXXX and account # XXXX. They advised it was a attempt to collect a debt from XXXX and gave me three options to settle. The settlement options I believe were a 12 month payoff of {$5000.00}, a XXXX payoff for 6 months, or to pay off immmediately for {$1000.00}. I agreed to settle for {$1000.00} and under contract they gave me until XX/XX/XXXX to pay it in full. On XX/XX/XXXX I noticed I was garnished for {$180.00} by another agency Cascade Capital XXXXin referecnce the same debt. I was furious and notified XXXX XXXX XXXX XXXX in referecnce the garnish and they stated that XXXX have used another creditor in addition to them. I said that breaches our contracted agreement and asked will this end the garnishment that came after we agreed to settle. I was advised it takes 60 days before it clears through all the credit bureas so I paid {$820.00} which they agreed upon due to the {$180.00} garnishment applied for the same debt. Even after paying I was garnished again on XX/XX/XXXX so I tracked down the contact for Cascade Capital XXXX XXXX XXXX and XXXX. He is claiming the two firms do not know each other and he will not accept the letter of settlement I sent him, because he owns the delinquent account bough from XXXX. XXXX XXXX XXXX claim the same account and instead of garnishment opted for settlement. XXXX is a fraud but both to have claim legal right to the account. I am now being garnished for the settled debt by Cascade Capital. Now XXXX XXXX is rollingback on the settlement and refunding the money but I am still being garnished by Cascade. I am not at fault here I paid the debt under legal terms. Both claim ownership on their own terms, but stated to be lawful. I am caught in between for a debt contracturally settled. XXXX XXXX and Cascade have grievance against XXXX for double selling the debt contract not with me. I did not agree to accept a refund for this legally settled debt, I am no longer liable. I need Cascade to cease garnishment and pursue XXXX or XXXX XXXX for settlement. I am not paying twice for the same account and Cascade now is trying to charge me more than what I had already settled for. I voluntarily returned my XXXX XXXX to XXXX financial around XXXX due to mechanical issues ( paid XXXX in repairs in 2 years ). XXXX XXXX and their attorneys XXXX and XXXX placed a judgment on me on XX/XX/XXXX. This date is clearly past the 5 year statute of limitations in Florida to collect the debt. I called XXXX and XXXX and asked why they did this after the statute of limitations expired. The representative told me I made a single payment 3 years after I returned the car and that payment started the clock over again and they can collect on the debt. I didnt make a payment to them and asked for proof of payment, date of payment and mode of payment. XXXX and XXXX told me they didnt have the info on the payment they said I made, but they would get the info and contact me via phone or email to prove I made a single payment years after I gave the car back. Never received a call or mail proving the payment. I called back asking for the info and the representative said they cant get me proof of the payment they said I made. XXXX and XXXX t placed a garnishment on a chase account ( XX/XX/XXXX ) I shared with my XXXX XXXX XXXX grandfather with I was taking care of him at the end of his life. The judge in XXXX XXXX XXXX Florida reversed the garnishment on a web conference call and returned the money back to my grandfathers account since I made no deposits into the account and his account consisted of Pensions, social security and POW benefits from XXXX. They did however take around {$800.00} from a chase account I opened while taking care of my grandfather in Arizona. . They also violated the fair debt collection act numerous times trying the collect the debt. They called X wife and relatives with strong arm collection tactics saying the Sherriff was coming to my house unless I contacted them or paid the debt. I contacted Cascade via mail and to them to only correspond with me via mail due to their tactics. The calls stopped for a while and started back up. They would call me and do the same tactics. In closing, Cascade Capital and XXXX and XXXX cant prove I made the single payment years after I returned the car and before the 5 year statute of limitations expired. I feel like they made up the payment to extend the judgment. A quick online search shows this is not the first time they have used this tactic to extend the statute of limitations so they can continue to collect after the statute of limitations expired They also recently placed another judgment on me to keep this going to try to collect. Its been a nightmare for sure.

I have previously Filed a complaint against XXXX XXXX XXXX in XXXX with both the CFPB and the XXXX XXXX XXXX CFPB referred the complaint to the regulator and XXXX XXXX XXXX located in XXXX responded to my XXXX complaint. I accused them of committing Fraud and they responded. The debt was a result due " errors '' with a 3rd party contactor who is no longer in business and they no longer had access to phone calls or documentation ( convenient ) they apologized and informed me they were recalling the debt and closing the account. Today, I received a collection letter from Cascade Capital Funding , LLC with two bills that XXXX said resulted out of " error ''. XXXX XXXX XXXX states the original invoice maybe XXXX, but the balance was forwarded to them for collection '' the Letter States the communication is also a validation of debt. First, that's not a validation of debt, if you can't say definitively if the original account had a XXXX balance or not than you are lying about something or holding back crucial information. ( did I mention, I have a letter, that I have included from XXXX stating the debt was a result due to error ). I believe the collection agency attempted to deceive by omitting crucial information in this really bad attempt to confuse me which is in violation of the FDCPA. XXXX XXXX XXXX has also violated the FDCPA by knowingly and continuing to harass me into paying a debt, they themselves have admitted in writing via the Better Business Bureau was a unfortunate mistake ( it was not a mistake, it was fraud ). So as I start writing this complaint, and I realize the information for the Original Creditor on the XXXX is XXXX XXXX XXXX of Florida with XXXX XXXX XXXX XXXX XXXX 's address. So, I start to dig and find out XXXX XXXX XXXX of Florida was sold in XXXX, but the bill states date of service for XX/XX/XXXX. so i received a bill from a company, that stopped existing 3 years prior. But I just communicated with XXXX XXXX XXXX via the XXXX Well, XXXX XXXX XXXX of Florida was subsidiary of XXXX XXXX XXXX in XXXX, which is a subsidiary of XXXX XXXX XXXX in Texas which is the corporate office who sold XXXX XXXX XXXX of Florida after it caught the attention of the powers that be the OIG. Truthfully, I wasnt sure which box to check because this company has stooped to almost every single one of them. 1 ) They have communicated after my asking them to stop via verified letter. 2 ) They have made false statements and misrepresented themselves 3 ) They sent a letter to my parents address thus improperly sharing my information 4 ) They have attempted to collect a debt not owed as I have no record of this bill and they said that they had closed the account due to an inability to verify it I submitted a complaint against XXXX for the same matter earlier this week. While their response was satisfactory, it is clear that it was not true as I continue to be contacted by XXXX Collections for the same alleged debt that XXXX attempted to collect and then subsequently discharged according to their response to CFPB complaint number XXXX. XXXX initially mailed a statement to my parent 's address in XX/XX/XXXX. When asked, the representative at XXXX said that they mailed a letter on the same date as XXXX despite me having no record of a second separate letter. Upon hearing this, I realized that XXXX and XXXX must be part of the same group and that he was talking about the same letter, but your representative assured me that that is not the case and that he has never heard of XXXX. When pressed further, your representative said that the debt no longer belonged to the original medical group he had initially said that it did and that Cascade Capital Funding LLC was the new owner of the debt. On XX/XX/XXXX, I called Cascade myself and asked the representative what their relationship to XXXX and XXXX was. She candidly said " Oh- that's us! We're all the same! '' Knowing this, it is clear that Cascade Capital, XXXX, and XXXX are all engaging in deceitful and fraudulent collections practices. XXXX assured me that the debt had been written off as of XX/XX/XXXX and that they would no longer contact me in large part because they could not produce sufficient proof to verify the debt, but it is clear that XXXXCascade CapitalXXXX have resumed their contact albeit under a different name and that they have escalated to lying about their practices. Should these deceitful tactics continue, I will have no choice but to escalate the issue further.

On XX/XX/2020, I paid an outstanding medical debt from XXXX XXXX XXXX XXXX XXXX to XXXX XXXX XXXX. The amount of the outstanding debt was {$50.00}. I have attached proof of payment from XXXX XXXX XXXX indicating that I have satisfied the debt in full. From the documents that I have attached, you will see that the original collection from XXXX XXXX XXXX was reflected on my XXXX credit report as of XX/XX/2020. Once I satisfied the debt, it was subsequently removed from my credit report, as shown on my credit report pulled on XX/XX/2020. On XXXX XXXX, another collection for the same medical debt from XXXX XXXX XXXX in the amount of {$50.00} was reported to XXXX by XXXX XXXX XXXX. I immediately contacted XXXX XXXX XXXX to inform them that this debt was already satisfied through another collection agency. XXXX asked me to send them proof of payment. XXXX indicated that once proof of payment was received, the debt would be considered satisfied and removed from my credit report. They also informed me that they received this debt in XX/XX/2020 from Cascade Capital Funding. I have attached documentation showing where I faxed proof of payment to XXXX XXXX on XX/XX/2020. Now, XXXX XXXX XXXX is telling me that they can not remove the collection account until Cascade Capital Funding instructs them to do so. I've reached out to Cascade Capital Funding, who told me they have not received anything from XXXX XXXX and that I need to follow back up with XXXX to get this situation resolved. At this point, I am getting no clear answers from either Cascade or XXXX. Every time I call XXXX and ask to speak to a supervisor, I am told that I have to leave a voicemail and that someone will call me back in 24 hours. I've left at least three voicemails and I've never gotten a return phone call. I'm simply trying to have a debt removed that I do not owe. All documentation is attached. Also, I would like to make it clear that I have never received any phone calls, letters or correspondence of any kind from XXXX XXXX XXXX relative to this debt. All of the correspondence that I've previously received was from XXXX XXXX XXXX. In XXXX I was injured while XXXX XXXX. I was treated at a local hospital and released. Due to paperwork problems, the XXXX XXXX XXXX via XXXX did not pay the hospital. The debt was sent to a collection agency. On my own behalf I contacted the VA and obtained assistance in getting the hospital properly paid ( morally, the right thing to do ). Myself and the collection agency in question received a copy of the letter I will be attaching indicating the hospital was paid and further stipulating that the debt was never mine to begin with, and that I can not be held responsible. The letter further directions the collection agency to remove the collection attempt from my credit reports. I had to follow up with XXXX several times to have the collection finally removed. The debt was apparently sold ( invalid as it may be ) to a creditor that contacted me in XXXX attempting to collect on this debt. I sent them a copy of the letter and requested they close this collection attempt. They said they would. I have now been contacted a third time this year. However, I must report that the agency that contacted me did so " on behalf '' of a collections agency in another state, Cascade Receivables Management. The agency that contacted me was XXXX XXXX XXXX XXXX. They refused to identify on the phone as a collection agency, claiming they are a " negotiations firm ''. They continued to refuse to identify unless I identified who I was first, even though they were calling me multiple times. They further refused my verbal request that they send proof of the debt. I then contacted Cascade and requested written proof of this debt. This occurred on XX/XX/XXXX. To date, I have not received anything. This collection/false debt has been following me and causing me untold XXXX and grief, especially whereas my credit is involved. This XXXX XXXX also called my wife, despite having my contact information. They refuse to leave any voice-mails when they call. I do not know how to get relief from this situation. It is my belief that when I send proof that this is an invalid debt, they will simply sell the account and this nightmare will begin all over again and follow me for the rest of my life.

Loan was paid in XXXX XXXX. In XXXX, 4 years after I moved from VA ( moved in XXXX XX/XX/XXXX-6 months after debt paid ), I was suddenly contacted by XXXX XXXX XXXX representative stating my debt was not paid and that I now owe them {$1100.00}. I explained that the debt was paid and due to so many years passing by I had shredded documents that were not required for me to keep since account was paid off. In fact if I did owe the loan XXXX XXXX XXXX had the right to cash the check in their possession, which they did not have because I had received it back when the account was paid. That was something I requested they provide and they were not able to provide anything. Despite my letter to them and the conversation on the phone I was continuously harassed and nothing sent to me. Then in XXXX I was contacted via collection letter by XXXX XXXX XXXX attempting once again to collect on this paid off debt. That now is an additional two years, totaling 6 years after I paid the debt that XXXX XXXX XXXX is attempting to collect on a debt that was paid in full. Now XXXX, I am receiving a letter from Cascade Capital attempting yet another time to collect. It seems the collection agencies have had no problem finding me and back in XXXX XXXX XXXX XXXX contacted me on the phone that was provided with the account, so I do n't understand why so many years have gone by with no contact and suddenly they want to collect on debt that was paid in full. Somehow their records have been a mess or perhaps since it is a cash basis company their representative may have stolen the money. Again, a check is issued with understanding if payment not made on due date the check will be processed, never has been and never will be because I did get it when I paid the account off. Unfortunately, I attempt to destroy records that I do n't find I need to keep. Sadly I should have kept these but did n't, who what have known this would happen to me.

I received multiple calls in one day, and per the caller, I was being sent to a collection from an unknown medical visit, to which I have heard nothing about from 4 years ago. I said the debt is NOT mine and that they were harassing me by calling me multiple times. the man speaking to me threatened me and told me I was wrong. I informed them that I am protected by law for surprise billing and to contact my congressman, the man did not know what a congressman was. I questioned his authority and that he was even a legitimate citizen of this country. he belittled me by saying that President Trump, who passed this law along with my congressman, was not to be called President. I told the man I was not going to argue with him about this and that if he called me anymore and did not let this go, I will file harassment against him. I then got a letter saying it is in collection and this company is Ability recovery services, in XXXX XXXX for {$340.00} I also would like to add that if this was a real bill that belonged to me, why did it take 4 years to be brought to my attention? Also, it says the company claiming I owe them from something 4 years ago, I have never done any business with.Why would I try to work something out with either of these companies when I don't even believe that this is my debt? I have Identity Theft affidavits on file both with my state and through the Federal level. How do I know if someone tried to falsely use my identity. Is this even a legitimate medical bill? Explain to me how Cascade Capital Funding is associated with a medical bill? I have never heard of such a place. I asked Ability Recovery to give me an itemized bill for this claim and they did not provide it to me. Who would pay a bill that sounds like some sort of extortion mafia who can not even prove that a bill belongs to me or what it is for. This reeks of FRAUD!!

I previously filed a notice of direct dispute with several collection agencies ( namely XXXX XXXX doing business as " XXXX '' & " XXXX XXXX '' and Cascade Capital ), under the provisions of FCRA 623 ( a ) ( 8 ) ( D ), of the accuracy of information reported to my credit file in XXXX for entries made to my credit report at XXXX and XXXX for an amount of {$4400.00} with an original creditor of XXXX. Both entries were subsequently deleted as the collection agencies were not able to verify/validate that the debt belonged to me as they found the information to be inaccurate or incomplete, or could not verify the accuracy or completeness of the disputed information. As required under FCRA 623 ( 1 ) ( E ). However, I received an alert from my credit monitoring subscription that a collection account was added to my XXXX credit report on XXXX XXXX, XXXX. This entry is from XXXX XXXX XXXX XXXX XXXX, has an account number of # XXXX, is for the amount of {$4400.00} ( identical to the amount for the previously disputed and deleted accounts ), but lists the original creditor as Cascade Capital. Cascade Capital is XXXX of the collection agencies, as I noted above, with whom I have previously filed a direct dispute for this exact account and for which they are not the original creditor. I have never had an account with Cascade Capital. It is my belief that they are re-reporting this inaccurate account in an attempt to fraudulently collect in violation of FDCPA 15 USC 1692e ( 8 ) by communicating credit information which is known or which should be known to be false, and 15 USC 1692f by using unfair or unconscionable means to collect or attempt to collect any debt -- by re-reporting the account with a different original creditor and placement date to result in a greater negative impact to my credit scores.

This was a debt to XXXX XXXX XXXX XXXX. This was paid on XX/XX/XXXX to XXXX XXXX. XXXX XXXX with XXXX advised they would notify Cascade that this was paid. I was sent receipts and it was removed from my creit report. In XXXX of XXXX I received notice from XXXX XXXX that this was being reported again on my credit report as unpaid. I contacted XXXX XXXX with XXXX and advised her what happened. She advised she would reach out to XXXX and make them aware this was paid once again. I contacted XXXX XXXX and the new debt collection company. The company asked for my receipts and immediately removed the item from my credit reports. Then in XX/XX/XXXX I received notification again from XXXX XXXX that a collections account was added to my credit reports. Once again the collector was XXXX XXXX XXXX XXXX/XXXX. This time with another collection company XXXX XXXX XXXX. I contacted the new company on XX/XX/XXXX and sent them the receipts showing it had been paid. I was advised that the back office needed to handle this. it would take 7 days. On XX/XX/XXXX I had not heard anything and contacted them again. I spoke to XXXX at ext XXXX she asked me to send the receipts again which I did. I waited to see if it would be removed or hear something from them. Nothing. On XX/XX/XXXX I contacted them again and they said it would take XXXX days and that I needed to contact the creditor that they got it from XXXX. I contacted XXXX on XX/XX/XXXX they said contact XXXX. I also sent the receipt to XXXX on XX/XX/XXXX. Because I was tired of getting the run a round I contacted XXXX XXXX with XXXX. She advised that she would contact XXXX once again. I've just learned that XXXX XXXX XXXX has gone around my back yet again to deliver more false info, this time being my address, or XXXX associated with me to XXXX. So far, I have had to go to each bureau and do what this " creditable '' collections company " XXXX '' said they had already done on their " Non-Monitary Releif '' statement from my first complaint # XXXX, and make sure these were deleted. XXXX out of XXXX bureaus had any idea this was even requested on their end, but another was to correct my address. Which address is my question... Chatting via CFPB complaint, they say they had my current address wrong, which I've proven that was a lie, and as far the address they reported behind my back to XXXX who posted it on my credit report that this was somehow my address on the itemized receipt. I've been advised to treat this as identity theft, and make a statement letting it be known, I shouldn't have to keep learning more and more fouls from a larger collection company. They are either desperate, or employ anyone to let this kind of criminal damaging actions take place. These accruing damages that I've endured are more than I can continue to bear. I've spent over {$1000.00} in trying to discover who this bogus info came from and how to get it removed off my credit reports. This dispute is regarding an emergency service bill. Approximately XX/XX/2015 my niece received XXXX XXXX at XXXX XXXX. Different companies tended to her, one of which was XXXX XXXX XXXX. I was only her emergency contact. I never consented verbally, written or otherwise to be the financial guarantor for any XXXX XXXX provided, including XXXX XXXX XXXX. I was not present when those services were rendered. As a side note, I personally got medical treatment from other hospitals because I didn't trust XXXX XXXX 's standard of care. I filed a XXXX complaint ( ID number XXXX ) against XXXX XXXX ( who furnishes information to the other entities including XXXX XXXX XXXX ). They sent me a letter apologizing for their error. They also sent another letter acknowledging I was wrongfully billed, that the records were updated with the correct guarantor information, and assured me none of the accounts had been reported to the creditors. More than likely, XXXX XXXX XXXX used this information to collect the debt from the correct party. None of the other services connected with the emergency room have contacted me after I received these letters from XXXX XXXX. XXXX XXXX XXXX is fraudulently using multiple debt recovery companies to collect monies they know are not owed. Their attempt with XXXX was unsuccessful after I contacted XXXX XXXX ID number XXXX ). XXXX closed the debt account in question and contacted XXXX to have it removed from my credit report. They are now using XXXX XXXX Solutions. Around XX/XX/2019 I received a letter in the mail saying they were a debt collection company. They call themselves Cascade Capital LLC. The letter states that they have purchased the accounts from the Original Creditor. Total of 2 accounts. The letter gives no detail as to the amount I may owe or services that were provided. It only states to call their office at ( XXXX ) XXXX should I have any questions. XX/XX/2019 I called their office. I was a bit concerned because I was in the process of paying of a debt which they were not aware of. It was not discussed. I asked them how much I owed and I told them when I receive a notice from them after the 30 day wait period in compliance with Florida Statute 559.715. I would look it over and send a payment. One account was for {$48.00} and the second account was for {$25.00} They informed me they were not going to send me another notice.? I said then how can I pay you. I recently found that my credit score dropped 125 points on account of an amount of {$670.00} showing as a debt owed to XXXX XXXX XXXX. I contacted XXXX XXXX XXXX by phone and was informed that the amount was incurred by me at the XXXX XXXX in Washington state on XX/XX/XXXX. When I requested the original bill I received an email from XXXX on XX/XX/XXXX, with directions for paying the amount and with an entry showing the amount of {$670.00} owed to Cascade Capital Funding LLC. My address on this document was also recorded incorrectly. I sent XXXX an email on XX/XX/XXXX, requesting for billing details from the hospital for the amount due. I did not receive any response. I, therefore, followed up with a reminder on XX/XX/XXXX, which also did not elicit any response. I called XXXX on XX/XX/XXXX but was informed that they could not send me any further details. I reached out to the XXXX XXXX in XXXX which asked me to fax the details which I did on XX/XX/XXXX. The billing department of the hospital confirmed to me over phone on XX/XX/XXXX, that I had paid all my bills in full for my treatment at the hospital. I was contacted by a company named XXXX XXXX by a man named XXXX XXXX and subsequently by a man named XXXX stating that I owed them {$1400.00} from an emergency room visit that occurred on XXXX/XXXX/2015. I asked them to give me whatever information that they had so that I could verify their information with my records and the hospital, if necessary. They were verbally combative and insulting to me when all I wanted was to be able to verify the details of their claim. Subsequently, I was able to locate the benefits document from my insurance company that shows that I never owed the debt. This was a debt that was purchased from another company which was, presumably, purchased from the hospital where I had the emergency room visit. My insurance benefits document indicates that the charge in question was an 'Ineligible charge ' that the doctor who made was prevented from making through agreement with my insurance company. I am absolutely convinced that this was a cheap tactic by the doctor, the hospital, and every debt collection company that bought the debt to try to get me to pay for something that I was never responsible for paying, and, had I not resisted their strong-arm tactics, I might have agreed that I owed the debt ( which I do not ). I do n't believe that it was necessary for the employees of XXXX XXXX to speak to me in the manner in which they did -- especially since I do not ( nor have I ever ) been responsible for the amount that they say I was.

I started having my wages garnished by a law firm for a 5 year old auto loan. The court order for wage garnishments was obtained by the law firm in a county I have NEVER lived in. Additionally the law firm misrepresented the owner of the debt by saying it was owned by XXXX ... It was not until we called Santander to find out it was sold to Cascade Capital, with whom I have never had any correspondence from or notice that the debt was sold to. I was never served any notice. I was never given a chance to represent myself in court. Now my paycheck is being garnished ... I have Child support to pay out ... Bills to pay ... I 'm just trying to move on from what happened years ago and this company just started stealing my paycheck. I feel like I 'm never going to recover ... I never had a chance to appear in court ... I was blindsided since I was n't served any notice. And I feel like I 'm going to just keep drowning in debt because what happened five years ago continues to ruin my life. Approx 4 months ago, I noticed a ding on my credit score through XXXX. I pulled up an apparent debt of {$670.00}. On my report the original creditor was Indiana XXXX XXXX XXXX XXXX located in a town about 30 miles east of where I live. I knew immediately this was false since I only see doctors at the VA or through XXXX XXXX. Also the only place I have been for emergency care is through XXXX XXXX in my town. Initially, I attempted to dispute the debt through XXXX however, the debt was not removed. I then called the billing office for Indiana XXXX XXXX and they stated they have nothing on file for me even using my old last name and my current. I then called the collection agency who told me the debt was sent back to the main creditor Cascade Capital. I had to google them and the only information I saw on the collection agency based out of California were numerous complaints of Cascade Capital doing to others what they have done to me. The XXXX has over 60 complaints of similar stories also. I could find no phone number for this agency and no website. Eventually, I came across a file ( I will include said file ) stating Cascade Capitol lost their business license as of XX/XX/21. I just want this so called debt removed from my credit report and right now, I have no way of doing so. Not to mention this is a false debt. Cascade Capital Funding , LLC incorrectly reported an account to my credit report. Also, they shared my personal information to third parties without my consent. I recently received a letter from Cascade Receivables Management that I had to pay on a debt. I never received any other letters from them with any notices about any debt and this violates my 30 day right to dispute. They are claiming that I owe money for XXXX XXXX XXXX XXXX and I have never heard of them before or been anywhere like that. This debt is not mine and they must stop and cease all collection activity. I am now asking for validation for this debt you say I owe. I am requesting proof that I am the party responsible for this debt and that there is some contractual obligation that is binding on me to pay this debt. This is not a request for verification or proof of my mailing address but a request for validation! I ask your offices provide me with evidence that I have any legal obligation to pay you. I will also inform you that if you offices have or continue to report invalidated information to any of the three major credit bureaus this action might constitute fraud under both federal and state laws. XXXX is reporting inaccurate and incomplete data on my XXXX and XXXX reports. I disputed with them as part of the XX/XX/XXXX Class Action Lawsuit to get the account deleted. However they never responded to my certified letter that was received by them on XX/XX/XXXX. I also disputed on XX/XX/XXXX via recorded phone call and was told the account was not being serviced by them since XXXX. I asked for the documents regarding a repossession that's showing on the account and was told they were being sent to me. As of today, I have not received anything, nor is the account showing disputed by Consumer yet it shows date last reported on my XXXX credit report as XX/XX/XXXX. XXXX is providing incorrect data on my reports despite several attempts to have it corrected and or deleted. I also disputed with Cascade Capital on XX/XX/XXXX and was received by Cascade on XX/XX/XXXX. No response to date. on XX/XX/XXXX I contacted Cascade via recorded phone call and was told they no longer service the account and was outsourced to XXXX XXXX XXXX, but XXXX XXXX XXXX is the collection agency handling requests. XX/XX/XXXX at approximately XXXX an agent from Cascade Receivables contacted me by telephone, verified my name, told me I owed money to XXXX XXXX for approximately {$300.00} from XXXX. I proceeded to explain to her that I have two insurances and should owe nothing. I informed her that I could provide her with the insurance information and she declined stating the bill was from 4 years ago and they would not rebill. I also advised her that another debt collection agency contacted me about the same debt and I dont understand how two collection agencies can bill for the same thing. The agent then proceeds to tell me because thats the way things work and that it can bounce around. She also then states that the debt is only X amount and she has seen bills way higher and I need to just pay my debt. I told her I didnt care how much it was that I am not paying something I do not owe. The agent then tells me, I can tell you dont care because you dont pay your bills. Your son was in the hospital and you owe the bill. The call was then disconnected. I called back to their office to complain and the agent that answered this time, after letting him know that I planned on filing a complaint, said, good and hung up. I called back to their office again and advised this agent to mark my account as a do not call or I will file legal suit.

I strongly believe that the companies associated with this account have committed a major crime and should be rep-remanded for it and I am not happy about it. I only became aware of a debt that was placed on my credit file because of a security clearance for my job. I contacted phone number XXXX, which was shown to be the number for the collection agency, not sure of the name, as the credit report shows cascade receivables management, but when I contacted this number the recording states, office of XXXX or XXXX. I spoke with a rep. by the name of XXXX who informed me that this debt was from the creditor XXXX from 2009. I explained to the rep. I have no idea what this debt is and why it 's on my report and why I am just hearing about from 2009. I informed XXXX I am disputing this debt, please refer it back to the original creditor! He stated the debt will stay on my report until it is paid and it 's on my credit report because it has n't been paid. Cascade Capital evidently owns many Credit Collections Agencies. First contact was from XXXX XXXX XXXX XXXX XXXX , PA , who failed to contact me in any way before filing their claim against me with XXXX . They never responded to my letters of XX/XX/XXXX and XX/XX/XXXX . I had a motorcycle accident in XXXX and was treated in a hospital that was within my insurer 's network, but the ER doctor was not. Six months later, I received a bill for approximately {$9000.00}. I worked with the company ( XXXX XXXX ) to resolve the bill in late XXXX. In XXXX of XXXX, I was contacted by a collections agency ( XXXX XXXX XXXX ) claiming that the bill was in collections. This was posted to my credit report at the time, preventing me from engaging in my plan of buying a house. I worked with XXXX XXXX again to obtain proof that the debt was resolved. The collections agency was pleased with this proof and broke off contact. In XX/XX/XXXX, I was again contacted by another collections agency ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX ) attempting to collect the debt. I again provided them proof of the debt having been resolved and they disengaged. Earlier this week, I was once again contacted by a collections agency ( Cascade Receivables ) seeking to collect on this debt. It appears that, whenever I prove that I resolved my debt, the collections agency sells the debt to someone else. On XXXX I filed two complaints against CASCADE CAPITAL , LLC. Complaints XXXX, and XXXX. Complaint XXXX was closed as a duplicate. Complaint XXXX was resolved with the attached response. The response details information and timelines on the debt that I will neither confirm nor deny at this time. However, more importantly, in this response, CASCADE CAPITAL , LLC states that " due to the repeated complaints filed by the consumer CASCADE CAPITAL , LLC is opting to close both accounts out as a refusal to pay. I had a payment arrangement in XXXX for a medical debt with XXXX XXXX XXXX in XXXX, TX. All payments were made as agreed. About a year ago I received an alert about a delinquent account on my credit report. The account is owned by Cascade Receivables ; the hospital is now conveniently out of business. I called the agency, XXXX XXXX in XXXX, Texas, made clear the debt had been paid, and demanded validation of the debt, including all invoices. They never replied. A few months later I got a call from a DIFFERENT collection agency about the same debt ; one conversation with them and they got the message. Now, this morning, I get a text message from a THIRD COLLECTION AGENCY ABOUT THE SAME ALLEGED DEBT. I was contacted by XXXX XXXX XXXX over the last three months and they have already listed a " Collection '' with my credit agencies hurting my credit score. I have-on every occasion- asked them to provide me proof that this debt is mine... they refuse to do it. The company began harassing me and even reported the debt and it was on my credit report. The medical institution is Code 3 ER which closed during the pandemic. I have filed multiple complaints with the XXXX ( if you look at the XXXX website for this organization you will see multiple complaints just like mine ) and other organizations, like the local state departments where it was located in XXXX, because there was no phone number, email, social media account, or way to contact the company about anything and I was on a payment plan which I have proof of but there was no way to get an updated statement. This is a record of my transactions with Cascade receivables managment LLC. In XXXX of XXXX I received a letter from Cascade claiming I owed a debt to them for a medical procedure I had back in XXXX. I contacted them by phone and spoke with them. I explained that I was sure I had paid the balance down to nothing. I then looked through old receipts until I found a screen shot that showed the account no in question had been paid in full. The screen shot is from almost a year after I had the medical service which corresponds to the fact that I had been making payments on that account until I had paid it off. I recieved a notice in the mail that Cascade Capital LLC. has sold an account that is in my name, to XXXX XXXX XXXX. Cascade Capital has repeatedly attempted to collect medical debts that do not belong to me through various collection agencies, the current one being XXXX XXXX. I have requested debt validation through the collection agencies and have only received one page -- a printout from a computer ledger that does not fulfill the validation requirements. Based on the information provided by a collection agency, I have determined that the accounts in question were opened in my name as a result of identity theft. My identity was stolen in numerous breaches of the credit reporting agencies as well as XXXX. I notified Cascade Capital of this information via certified mail, return receipt requested. They received the notice but have failed to act. Their agent, XXXX XXXX, continues to report inaccurate information to all three credit reporting agencies. I reported this organization in a previous notice to you earlier this year, as a sub-collector on another bill. This one in particular is the same type of situation, in that I never received an original bill, nor any follow-up past due notices, around the time of service. Evidently, the organization ( XXXX XXXX XXXX ) sold accounts to Cascade Financial who is attempting to collect through XXXX XXXX. As in the other cases, I do not believe I should be responsible for this charge, due to what I've already said and the fact that it's been almost three years now. Another point is that they're using my street address when I actually have a PO Box that is my official address. I sent in a dispute letter/debt validation letter to Cascade Capital Funding , LLC to validate this debt. I asked for documents/contracts bearing my signature, and dates of services. In correspondence, they corresponded with a letter including my medical records, directly violating HIPPA. After the complaint was submitted, the Company, Cascade Capital Funding LLC corresponded by pointing fingers at who released my medical records to them, a third party. When, in this same case, the same letter, from Cascade Capital Funding, had my medical records inside. The letter sent to me did not have documents bearing my signature that I gave the authorization to release my medical records to third-party contractors. This is the first, failure to validate, and it is a direct violation of HIPPA. In conclusion, this HAS to come off of my medical records, immediately. On XX/XX/XXXX I received a debt collection notice from XXXX XXXX XXXX for {$710.00}. I realized it was an ER visit I had on XX/XX/XXXX due to a workplace accident. An authorization was obtained from my office manager before I even left the office, and they called the ER to let them know I was on the way, and it was to be paid by workers comp. Please reference complaint ID XXXX. It has been closed by the company. Though it did provide additional information it is without resolution so I am trying to get clarification as to my knowledge XXXX has closed and has no direct way to reach them. The last email I was able to receive regarding my bill from XXXX in XX/XX/2019 stated the physician claim was billed incorrectly and was being appealed. Afterwards I only received a facility fee bill and have never received any bills about a physician fee. I received documents yesterday in the mail, after having been contacted by phone earlier in the week by XXXX. I told the callers that I would wait until I saw the physical evidence of the outstanding bills and that I wouldnt be paying them by phone. One reason I said that is because my hospital stay, which these bills are related to, was more than two years ago. I did explain in the phone conversations that I had paid my portion of any and all bills that Id received. I have repeated asked the Debtor to provide proof ( by way of the original bill ) of this debt - both on my own and through your agency. The collection company has put this collection on my credit report without verifying to me that it is a debt.
