I have become recently involved with a buy here pay here situation where a local dealership hires a finance company by the name of CarFinancial services, a quick contract is drawn up and I purchased a vehicle with financing. I had originally set up auto pay but they couldnt seem to get that right so issues with them have stated from day one. On the day that I looked at my vehicle ( XXXX XXXX XXXX ) it was located at XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, NY XXXX, I am a huge fan of this particular make and model especially since XXXX no longer manufactures this vehicle. I had to have it! This was on a Saturday, nobody was at the dealership but there was a note to callthis number if immediate service is needed. So my boyfriend called the number and spoke with a XXXX who seemed to be the owner. We told him we are very interested and wanted to put down a deposit right away to secure the purchase. XXXX came immediately to the dealership took our {$1500.00} cash scribbled out a hand written receipt and told us to come back on Monday. So we didfilled out some paperwork provided my dmv info then he tells us he will call us when everything is ready to pick up the vehicle. This took 3 days which I thought was extensive but I was just happy to finally be able to pick the vehicle up. On the day we picked up the vehicle, on or around XXXX XXXX, my boyfriend XXXX, had also paid for my first months payment for XXXX so leaving there I was comfortable in thinking I didnt have a payment until XXXX, XXXX. In the meantime another person by the name of XXXX, who was explained to me is the manager of Car Financial Services spoke to me confirming my information and set up auto pay to come right out of my checking account.and I had specifically told him during that conversation the my first payment for XXXX was already made in cash to XXXX at XXXX XXXX XXXX so he confirmed to me at that time no payment will be drafted from my account until XXXX. Well I kept getting bills and reminders delivered to my email address about an upcoming payment that will be drafted from my account in XXXX. So naturally I called several times and even sent emails and text messages reminding them of the payment we made in cash that was to be applied as XXXX payment. Nobody returned my calls or messages so Of course this was never done so my account was unexpectedly drafted for a payment anyways. Now as most people these days I live paycheck to paycheck so this naturally overwhelmed me and my account became overdrawn resulting in several fees. I finally spoke to a customer service rep at Car Financial directly who was very apologetic and explained to me that if I ever make a cash payment in person again to call the 800 number at least 48 hours prior to the draft date so they can stop it. So this being my first major issue I became very skeptical and questioned the reputation of this whole buy here pay here arrangement. Since this issue was eventually resolved, I decided to give them the benefit of the doubt and thought maybe this was a one time fluke so left my auto pay in effect. A couple of months later I had been laid off from my job so I sent an email explaining my hardship and asked if I could skip a payment I believe was in XXXX, again my message was ignored so a couple of my payments ended up being returned from my bank as there were insufficient funds. ( See copies of messages sent via email ) Again more fees added to my account only this time I am unemployed and really struggling. My frustration level was increasing by the day. Since this happened car financial ended up locking me out of my online account. So whenever I did want to make a payment in attempts to catch up I couldnt do it electronically. I felt extremely nervous about having to pay at the dealership as XXXX from XXXX XXXX auto made me extremely uncomfortable. Since I had no choice I sent my boyfriend a couple of times to pay cash. I wouldnt get receipts until days later. One time the payment that he tried to put through was more than my normal {$300.00} payment so this XXXX had repeatedly tried taking out additional payments in all different amounts which confirmed my doubts about their reputation so I ended up stoped the auto pay altogether. I cant tell you how many times their transactions resulted in overdraft fees. To this day my account remains locked out, its almost as if they purposely force my account into default each month so that they can harass me and threaten me. Ive even tried setting up auto pay again all so I didnt have to deal with them but they wont let me nor will they allow me to make electronic payments anymore. I fell behind again.I was eventually caught up on my payments this past XXXX but they sent the repo guy out anyways as XXXX from Car Financial refused to apply my payment after asking him several times. See conversations via text message. Luckily I had my receipts so the repo guy eventually backed off. Im trying once again to make a payment, not due until the XXXX but cant make it because Im now locked out of my online account AGAIN which shouldnt be since I am caught up. Ive spoken to both dealership XXXX and manager of Car financial services XXXX SEVERAL times ..they continued to be rude, condescending and extremely unprofessional. I dont want to have to talk with them ever again. They have to this date caused me much XXXX to the point that Ive gone into full blown XXXX XXXX. I dont have the best credit so cant find any other company for refinancing. Im at my wits end with these people and they repeatedly treat me awfully. I feel like returning this vehicle but Ive already made almost 12 months worth of payments plus {$1500.00} down ( which they have not applied to the balance of my loan ). At one point I had made two payment but they never applied them using the excuse that my account was suspended and I had to make another double payment which according to my records was not the case. Both XXXX continue to threaten me and Im afraid they will send the repo guy out again. I forgot to mention earlier that this repo guy threatened me with a taser gun the first time he was here because I wouldnt get out of his way of taking my vehicle.. Of course after he spoke with someone over the phone he had learned that my payment were in fact up to date. We ended up sending him in with XXXX 's payment just in case and now they are saying I am due for XXXX 's payment when I paid the repo guy for XXXX 's payment?????!!!!!! I shouldnt have to go through all of this chaos in order to finance my vehicle. This posse of auto salesman, finance manager, and repo guy terrify the XXXX out of me and they're obviously all in cahoots. My XXXX is out of control at this point. I have been working extremely hard to re-establish my credit but with their repeated reports to credit bureaus saying Im late is having a negative impact keeping my score low so I cant refinance with another company. This whole experience is nothing short of a never ending nightmare and I dont know what elses to do so I am filing this complaint in the hopes that something can be done to reprimand this organization from mistreating myself or anyone else for that matter. I cant imagine that I am the only one to complain about this scam of a dealership and finance company. I believe these XXXX XXXX are somehow in cahoots with each other and continue to scam other customers along with myself. For what? I don't know I hope that you all are able to investigate them and find out for sure and put a stop to their harassing ways. I made a ACH Payment of {$300.00} on XX/XX/XXXX for my car payment that was due the previous month. I didnt see it pop up on it in the recent payments so I made another one of {$290.00} on the XXXX and XXXX XXXX Those did show up on my account. So I called Car financial services to cancel the first {$300.00} payment and they refused to. I explain to them that I accidentally made another payment of {$300.00} because I did not see the first payment of {$300.00} on the account. I told them that I only had the {$330.00} in my account so that payment should go through. And the last one of XXXX will not go through. The person I talk to said this was fine and that the last payment would just be returned after the other one was processed. I was told this on XX/XX/2022. I called again, yesterday XX/XX/XXXX, because I noticed that the money has not been taken out of my account yet and it has been seven days since I scheduled the ACH payment. When I called they told me that all my payments were returned and that none of them went through. This was impossible because the money was still sitting in my account. I did have the money in my account for the XXXX but I told them that I did not have the money for the XXXX payment that I accidentally scheduled. I explained this to them and they claimed that all three payments were returned even though the payments were made through two different bank accounts. I dont know how its possible for all the payments to be returned especially the ones that I told him I had the money for. So I called on the XXXX and that is when my new car payment is due. So I spoke to somebody I dont remember her name, and she handled the situation horribly. She told me that since it is the XXXX that I would owe the past due balance plus the nonsufficient funds fee plus the new payment. This would mean that I would owe almost {$700.00}. I told her that I would like to just pay the past due amount of {$340.00}, because that was due. She refused the payment and said no that I would have to pay the {$700.00} and that she would not except anything less than that. I told her that this was not fair and that this was not true that my payment was absolutely due today because I am normally given a 10 day grace period on my car bill when it is due on the XXXX meaning when my bill is due on the XXXX they usually give me up to 10 days to pay it so I do not understand to why I owe the money today and why I had to pay it today on top of the past due balance. I did not refuse to pay the past due balance I just explain to her that the new balance for XX/XX/XXXX I did not have but I did have the money for the past due balance. She refused the payment again she said I was rude and said she doesnt want to talk to me or deal with me anymore. She said and I quote I do not want to talk to you anymore or deal with you anymore Im going to sell your car back to the dealership. She hung up on me when she said this. I called the dealership shortly after and they were confused what was going on and didnt have any information at the time. I called the car financial services again and they said she did in fact sell my car back to the dealership. So I called the dealership and XXXX the sales agent, said she spoke to XXXX in a text message I think. And the agent that was handling my case and that said she would sell my car back to the dealership, told the dealership that I refuse the payment, said I wasnt going to pay my car off anymore, and said that I wasnt going to pay the nonsufficient funds. This is absolutely not true. I did not refuse payment I just told her that I did not have {$700.00} To pay the new balance. I told her, ( The sales agent ), that I would pay the {$340.00} which was the past due balance. I did not refuse to pay my car and I did not say I would forfeit my car back to the dealership because I did not want to pay this. I just explain to her that I did not have the XXXX that was due on XX/XX/XXXX. I told her I had the past due balance but she refused it. So the sales agent that I spoke to lied and got my car sold back to the dealership like she claims she would. She was upset with me so she sold my car back to the dealership and lied. This is completely unacceptable and not fair to me. I did not know it was possible that just because a car company agent got upset that they were allowed to do whatever they wanted and lie about it. The phone calls are recorded so I implore that someone please listen to the phone calls and go back and see that I did not say I wasnt going to pay I was trying to make a payment and she refused to take it. I am very upset by this and Im so frustrated that just because she wanted to lie and she was mad at me she was able to sell my car back to the dealership and put me in repossession. Im hoping somebody can resolve this issue this is absolutely not OK. This is not the first time I had an issue with Car financial For every time I call them and theres always a problem with their agents being rude or not trying to work with me when it comes to my car payment. I explain to them that I was going through a financial hardship due to Covid and then I was doing everything I could to make a payment. They also refuse to accept any partial payments for me. And on my pay schedule I get paid weekly. Meaning it is hard for me to make a full payment in one lump sum so I asked them could I do weekly. They refuse every time. When I try to make a partial payment they lock my account and therefore I am no longer to make any payments at all. Even when I called them they tell me they will not take a partial payment I have even have had someone hang up on me because I told them I dont understand why you guys can not take a partial payment just until I get the rest of the money next week. This makes it extremely difficult because it allows them to go longer without a payment at all so they can claim that Im not trying to pay my car payment and this is happened before. Also different rules apply when talking to different agents. But when I called them yesterday an agent told me that my balance was XXXX then I spoke to somebody else and they said my balance was {$700.00}. Im not understanding why certain agents are allowed to make claims and its held is true.

I purchased a vehicle from XXXX XXXX, in XXXX, Arizona, XX/XX/XXXX. I was only contracted with XXXX XXXX, per contract. Car Financial Services is committing Identity Theft, pursuant to XXXX XXXX XXXX ( q ) ( XXXX ) by continuously fraudulently reporting to XXXX, XXXX and XXXX, regarding my contract agreement with XXXX XXXX. I have requested, on several occasions, that Car Financial Services provide the documentation that authorizes ANY use of my credit profile. I spoke with XXXX XXXX and XXXX XXXX, via phone, at the XXXX XXXX for Car Financial Services, on XX/XX/XXXX, regarding the unlawful reporting by Car Financial Services. I informed both employees that not only was Car Financial Services unlawfully reporting on my credit profile, but reporting TWICE for the same car loan. XXXX and XXXX cited, what they believed would be on the contract, as the foundation for the continued Identity Theft, stating that the clause in the box at the top of the contract allowed XXXX XXXX to transfer the contract to an " Assignee. '' I informed both, XXXX and XXXX, that the contract proves that XXXX XXXX is also the " Assignee '' on the contract, not just the seller. XXXX and XXXX cited the fact that the file had been returned to XXXX XXXX due to alleged incomplete payments being made for the vehicle, and XXXX XXXX allegedly paying off the vehicle on my behalf. I informed XXXX and XXXX that this information was, again, incorrect, as was the payment history being reported to the three major credit reporting agencies ; as all three agencies show different information and none which is correct. XXXX and XXXX informed me they had no further records to provide, and refused to provide any information regarding how to speak to Car Financial Services Legal Department. I was able to find the contact information for Car Financial Services. I was contacted by someone purported to be XXXX XXXX XXXX, a legal representative for Car Financial Services. XXXX informed me of the same information as the previous Car Financial Services representatives : that the contract with XXXX XXXX authorized the credit reporting by Car Financial Services and, the contract and payment history are the only available information the company currently has, after returning the file to XXXX XXXX. I, again, informed the Car Financial Services rep that in accordance with 15 USC 1681 the company only had 3o days to prove authorization existed. Car Financial Services still has not and can not produce the demanded documentation, and has refused to act lawfully by ceasing to report the unverifiable derogatory information attached to my current credit profile. As of this writing, Car Financial Services has unlawfully reported a total of 46 months to XXXX, between the two times the company appears for the same car loan. As of this writing, Car Financial Services has unlawfully reported more than 40 times, prior to having one of the duplicate loan entries removed XXXX, XXXX ; but still continues to negatively report on the other, as of this complaint. XXXX removed both Car Financial Services entries after a dispute challenging the XXXX XXXX Compliance of the records presented for reporting the alleged account. Both accounts appeared on the XXXX credit profiled for more than two years. XXXX, XXXX, and XXXX all improperly used my consumer report by securitizing consumer data, yet refusing to provide a copy of my CONSUMER FILE NOT MY CONSUMER REPORT. All three bureaus and Car Financial Services are liable under their SEC agreements to follow certain rules concerning consumers. I will be filing 211 Treasury OMB Forms to audit consumer accounts. The above-mentioned companies are obligated by the FCRA to report accurate accounting. I have advised all listed parties that ALL delinquent reporting for this account is fraudulent, per law. I am, again, demanding the appropriate documentation, signed application with a wet ink signature. I am not asking for an XXXX report. If the said companies do not have the appropriate documentation to show these were in fact authorized reportings it must be removed immediately. I have attached a copy of the contract, which shows no sign of Car Financial Services, and assigns the contract as a " Buy-Here, Pay-Here '' transaction to XXXX XXXX. Paragraph 11 of the contract states : " This contract, together with any other written agreements contemporaneously executed by you and us, constitutes the ENTIRE agreement between you and us and may not be altered or amended unless made in writing and duly executed by you and us. ''

XXXX of XXXX, I bought a XXXX XXXX XXXX from a dealership here in XXXX XXXX, NV. They got me finance through Car Financial Services here in XXXX XXXX, NV. In XXXX of XXXX, a gentleman decided that he wanted to broad side my new truck. My insurance company paid it off in a matter of days. After that I purchased a XXXX XXXX XXXX from the same dealership, but at a different location. I was financed through the same lending company, Car Financial Services. I miss understood that there was no grace period on the payments. I missed the payment date and was considered delinquent and was referred back to the dealership. I promptly made the payment to the dealership and was pick up again by Car Financial Services. I made XXXX 's payment on time. At that point, I had my payment date to match my VA compensation payment date. In XXXX of XXXX, I made my payment over the telephone. At that time, I asked the customer representative why i was being reported to the credit bureaus. He informed that they report it ever month, and condescendingly said that i must use XXXX XXXX. He made it sound like was I ignorant and did not know what I was talking about. I had the same conversation several times throughout the past year. I informed most of the customer representative I talked to that my first loan was there and closed, but the second was not there. I was always informed that it is automatically reported. In XXXX of this year, I wanted to try to get my truck refinanced to lower my interest rate. Finally someone agreed with me and saw that it was not being report and told me what to do. I preceded to get a hold of the credit dispute team for Car Financial Services. I then got a letter in the mail from them stating that I was right it is no where to be fold on any of the credit bureaus. I requested that that it be posted and i was informed that the account ; as far as, the credit bureaus is concerned my account was closed and could not be reported. Why can they report one account a decide not to report the other. I asked why it was closed and not being reported, i was informed that it was done last XXXX. Also, Car Financial Services didn't would not to post it. You see I wanted to accomplish 3 things. One. of my goal was to get a bad XXXX new truck that was done. the second goal was to try to improve my credit rating and get refinanced. Hoping that would improve my score enough to use my VA loan to buy my Mother 's property for her as a present. this was the third and finally thing. Now knowing that I can't accomplish any of things, I am some what XXXX. I don't remember being told that the account was never going to be reported. I then was informed by the credit reporting team that they didn't have to tell me and it was their choice to report it or not. Which i found out to be true, I can't get my truck refinance and i will have to find another way to improve my score. The other option is to go ahead and file bankruptcy and start all over!

i have tried many times to correct this account, Car Financial Services ( # XXXX ) on my consumer report most recently XX/XX/XXXX i contacted the consumer reporting agency about said violations according to FCRA 15 U.S. Code 1681b - Permissible purposes of consumer reports ( a ) In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 1 ) In response to the order of a court having jurisdiction to issue such an order, a subpoena issued in connection with proceedings before a Federal grand jury, or a subpoena issued in accordance with section 5318 of title 31 or section 3486 of title 18. I bought a XXXX from XXXX XXXX of XXXX. I soon learned it was a lemon.I 'm aware of Georgia 's lemon laws, but I can not and will not sit back and let both XXXX and Car Financial Services rob me and countless others. If you take a look on XXXX XXXX page, you will see numerous complaints about the vehicles they sale and the owners criminal history of robbing and lying to customers. Because of the constant repairs, I was unable to keep up with car payments to Car Financial Services and very high and required full coverage insurance. A lot of times I had to choose between car payment, insurance payments or mechanical fees, when car payments were chose, the vehicle sat inoperable. Out if the almost 2 years of financing the vehicle I drove it maybe 18months. During XXXX the car was running, no where near at its best ( no heat, no AC, overheating, front end axle rattling, water pump going out ) but it got me back and forth to work and it started without a problem. I knew the car was in danger of being repossessed and honestly I was over it, I wanted them to come get it, in which they did on XXXX. I just was recently notified of a payment for {$140.00} that posted to my account with Car Financial Services. After speaking to them I learned the car sold for {$600.00}, well below the fair market value of {$2900.00}, which makes this resale commercially unreasonable. I was also informed of mechanical fees that were charged to me totaling {$230.00}, because the car would not start. The car started up without any issues while still in my possession. It had numerous other issues, but it did start. Therefore I should not have been charge a mechanical fee. They are so corrupt I would not be surprised if they " said '' it didnt start to collect more money from me. I honestly hope the new buyer is aware of all the issues this vehicles has. I was told by XXXX at Car Financial Services that the car was running fine until XXXX. More than a month since the car was no longer in my possession. I also had well over {$1000.00} worth of personal property inside of the vehicle that I have no idea where it 's located. From my understanding, I also should have been informed of the auction site, date and time, in which I was not. To me, these are grounds for me to contest a deficiency judgment. I would rather not get lawyers involved but I will. I was cheated with this vehicle. I put over {$4000.00}, not including repairs and to only have {$140.00} applied to a vehicle that they believe was only worth {$600.00} is an insult. I would like this account with them to be removed from my credit, or I will indeed sue for the remaining balance they say I owe on a {$600.00} vehicle.

I purchased a car from XXXX XXXX located in XXXX XXXX XX/XX/2019. I was initially told via XXXX what information to bring and how much down. I brought all required information. My payments are due bi weekly based off my pay date. After getting to the dealership I was asked to pay {$500.00} more down. I was told I can pay it within 10 days. On XX/XX/2019 I made a payment of {$300.00} directly to XXXX XXXX office. That left a balance of {$200.00}. My regular payment of {$210.00} wouldnt be due until XX/XX/2019 and I have a 10 day grace period. On XX/XX/XXXX I received a letter from car financial services saying I owed {$1000.00} by XX/XX/2019. It said I have a past due of {$500.00} and my payment was {$500.00}. I called and said explained my contract says I pay $ XXXX monthly. {$210.00} starting XX/XX/2019 then my next payment of {$210.00} two weeks later. So the person I spoke will pulled my contract and still acted like her contract said something different so I told her I would seek legal assistance so then car financial services said they would t contact me about any payments and send my account back to XXXX XXXX. Since I was having so many mechanical issues with the car and to the point its inoperable at times I requested the remaining {$200.00} be split Into 2 Payments this was agreed upon by XXXX XXXX prior to any communication with Car Financial Services. After speaking with Car Financial Services they still reported false information to my credit report saying my monthly payments are {$1000.00}. My monthly payments are {$420.00} total. Its not even my original due date and Im receiving notices saying Im past due on XX/XX/XXXX. I only owed {$200.00} more on the down payment after already paying {$2800.00}. Also the amount owed on my credit doesnt reflect the {$300.00} I already paid and for some reason my blance is still incorrect.

Im a couple mth behind due to XXXX laid off and me being XXXX I got the boot first because I made less hours already plus I was getting surgery done so they thought it was best. Shortly after surgery my roof at the star club apartments collapse on me and my wife send me into a deeper recovery. In XX/XX/XXXX I was forced into a payment arrangement with no other options based off the branch my title is located. I was given the amount of {$470.00} but the last payment change in XXXX the week I was supposed to make a payment TO {$500.00} I was told it was a additional late fee added but the late fees are {$32.00} which is not adding up. I spoke with someone who stated to tell her which bill and she will decide if I can make the payment. I received a call Monday and inform the company I could make the payment of the {$500.00} on Thursday XX/XX/XXXX was told no and the collector hung the phone. I called back informed the next collector of what happen and to process the payment on my account for Thursday XX/XX/XXXX and received a confirmation number. The collector who processed the payment took the funds out of my account on Monday XX/XX/XXXX. I called to address the situation and spoke with the same collector, she stated I gave her permission which I told her there is a recording of the entire conversation. She then started to yell and hung up the phone. I called back and I ask to speak with a manager and collector told me he is busy. I also asked where was the office located to speak with a manager and the response was where your title is ( Title for the car ). Being this payment was processed without my permission on a day I did not authorize, I now have bank fees and my account is over drawn.

I financed a XXXX XXXX XXXX from a buy here pay here dealership called XXXX XXXX in XXXX, FL on XX/XX/2019 for {$4900.00}. Since buying the car I have had nothing but trouble from it. The driver side seat belt didn't work, it needed a tune up, there was a scrubbing noise coming from the undercarriage. I took the car to Georgia and it broke down on me several times including the tires blowing out on me twice. I have had to make disputes twice already against car financial services for incorrect reports they have made to transunion.
