I am a victim of identity- theft, I am writing to request that you block all accounts disputed as fraudulent on my credit reports with XXXX XXXX XXXX XXXX and XXXX. This information does not relate to any transactions I have made. I did not give anyone authorization or consent to use my personal information. I hereby exercise my legal rights enacted by Congress and The Federal Trade Commission, which explicitly states when a victim of identity-theft dispute a fraudulent account on his/her credit report it shall be honored by all credit bureaus and all fraudulent information should be blocked within 4 days and proper notification shall be given to all data furnishers pursuant to section 605b of The Federal Fair Credit Reporting Act. Failure to comply shall lead to complaints being filed with XXXX XXXX XXXX XXXX, Consumer Financial Protection Bureau, and Attorney General stating your companys unlawful collection practices, misrepresentation of creditworthiness, defamation of character, and noncompliance to abide by laws enacted by Congress to protect victims of identity-theft who's credit been impacted by acts of fraud. Because I know my rights under THE FAIR CREDIT REPORTING ACT, CONSUMER CREDIT PROTECTION ACT ( CCPA ), and FAIR and ACCURATE CREDIT TRANSACTION ACT of 2003 ( FACTA ). I will be taking action. I also know my rights under this paragraph of Section 312 of the FACTA LAW : SEC.312. Procedures to enhance the accuracy and integrity of information furnished to consumer reporting agencies. ( b ) duty of furnishers to provide accurate information. -- Section 623 ( a ) ( XXXX ) of THE FAIR CREDIT REPORTING ACT ( 15 U.S.C . 1681s-2 ( a ) ( XXXX ) is amended ( XXXX ) in subparagraph ( A ), by striking " knows or consciously avoids knowing the information is inaccurate '' and inserting " knows or has reasonable cause to believe that the information is inaccurate '', and ( XXXX ) by adding at the end of the following : ( D ) DEFINITION -- For purposes of subparagraph ( A ), the term 'reasonable cause to believe that the information is inaccurate ' means having specific knowledge, other than solely allegations by the consumer, that would cause a reasonable person to have substantial doubts about the accuracy of information. Policy states. According to the Fair Credit Reporting Act FCRA 611 ( 15 U.S.C 1681 ), Procedure In Case of Disputed Accuracy. ( a ) Reinvestigation ( XXXX ) Reinvestigation ( a ) In general. Subject to Subsection ( f ), if the completeness or accuracy of any item of information contained in a consumers file at a consumer agency is disputed by the consumer and the consumer notifies the agency directly, or indirectly through a reseller, of such dispute, free of charge, conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate and record the current status of the disputed information, or delete the item from the file in accordance with paragraph ( XXXX ), before the end of the XXXX-day period beginning on the date on which the agency receives the notice of the dispute from the consumer or reseller. Therefore, my position is being clearly stated, these accounts do not belong to me, meaning that you are reporting inaccurate account information within my credit file. The fact that these are inaccurate account information means that you, this credit-reporting agency, are reporting incorrect accounts. XXXX. CAROLINA FINANCE & {$7800.00} I am well aware of my rights as a consumer. The Fair Credit Reporting Act requires that you, the credit-reporting agency report accurate and/or correct account information within my credit file. I was provided a pay off amount on XXXX from XXXX XXXX by email. I made the payments and monitored the account via credit reporting because after this I was told The information could not be provided by email. It's always a hassle with this office. Based on information provided by XXXX credit reporting, I had balance of XXXX. I paid this amount off in 2 payments. I received a notice on my door stating I owed. I on XX/XX/XXXX. I emailed the office. On XX/XX/XXXX, that Monday, I received an email saying my account was not paid off. I spoke with XXXX XXXX on XXXX XXXX, who told me by account was not paid off. He then told me I owed another 1500+ plus dollars. I then asked for the payment history. He put me on hold and did not return to the phone. I called back and was put on hold again when I asked to speak with him. He never returned to the phone. I then asked for the payment history to be sent again. After not receiving, on XXXX I requested it again or to send me my titled. It was finally mailed out and it is now showing I owe XXXX not 1500.00+. I then informed them this could not be so and they had even reported to the credit bureaus I owed nothing and to send me my title because I did not owe anything else or it would have been included in the balance. This company also in XX/XX/XXXX repossessed my car with only one payment outstanding saying it was because I did not call the office and I had to have a cell phone number to keep in contact. At this time they told me that they had to put a tracker on the car and I had to pay for it as well or I would not get my car back. I complied n order not to be responsible for more storage. I needed the car and could not afford this absorbency.

On XX/XX/2018 my car was repossessed due to non payment. I was notified of a returned payment the day before ( XX/XX/2018 ) and was told on XX/XX/2018 I had until XXXX XXXX to make the payment in full or they were going to repossess my car. I made the payment in full over the weekend and the payment posted on the following Monday XX/XX/2018.They told me they had to install a tracking device on the car, because they had to repo the car. I feel that's extreme and unfair, I never hid the car for them to feel the need to install a GPS tracking device on the car. The finance company did not release my car until Monday XX/XX/2018, meanwhile marking the car as a repossession on my credit. When I asked about removing the repossession off my credit because the car is currently in my possession XXXX XXXX at my finance company told me, " no we're not removing it off, it is what it is, we had to pick the car up so it's a repo, deal with it ''. I don't want to have a repo on my credit if the car was released to me and in my possession. I received correspondence post dated on XX/XX/2018 on yesterday XX/XX/2018, informing me that my car was going to be put up for sale, meanwhile I already have it back and this letter came out after the payment had been paid, while having to wait 4 extra days to receive my car back. I missed 3 days of scheduled work due to not having my vehicle, especially after I corrected the missed payments.

This account has reappeared on my personal credit report and is reporting as late from XX/XX/XXXX to XX/XX/XXXX. This information is currently incorrect. This account for Carolina Finance was part of a Bankruptcy in XXXX, in which the Bankruptcy terms were agreed. Also, the Creditor, Carolina Finance took possession of the vehicle, before being included in the Bankruptcy and the vehicle was sold at auction resulting in full payment of the loan balance. I received a Deficiency Letter from Carolina Finance in XXXX stating the sell of the vehicle. This was all added in the bankruptcy. According to the FDCPA, Carolina Finance is in violation of the law, by reporting fraudulent and inaccurate information to the Bureaus. In XX/XX/XXXX, I contacted Carolina Finance at XXXX and spoke with XXXX, who advised me there is nothing they could do and I would have to contact the Bureau reporting the information. I asked if he could mail me out a copy of the original loan and the bankruptcy notice and he stated he is not the one to do so. On XX/XX/XXXX, I contacted Carolina Finance once again and asked how could we resolve this issue. I spoke with a XXXX or XXXX who would not give last name and he told me to fight with the Bureau. This account begins reporting as late in XX/XX/XXXX. I did not have possession of this vehicle or owed any amounts as of that day.

The company has garnished my wages multiple times over the years they have collected over {$8000.00} and the balance has not moved. I have attempted to work with the company regarding my balance and they refuse to give me any information regarding how they came to my balance or why the money that is being garnished from my check is not impacting the balance at all. I am unable to verify the debt as the company refuses to give me any information and I was not made aware I owed the debt from the original creditor. If the original creditor had informed me that this debt was owed i would have made arrangements. I believe that the original finance company finances cars in hopes that people can not repay and they can collect in excess of the value of the car. I believe this because the original creditor refused to let me get current. I lost my job and fell behind on the car. When I called and tried to get current the original finance company told me my only option was repossession. I worked with them to pick the car up and I never heard from them again. The next thing I know I am being sued by XXXX XXXX on behalf of their client, XXXX XXXX ( the original creditor ).

I bought a car in XX/XX/XXXX, it was financed through Carolina Finance in XXXX. In XX/XX/XXXX, we has a 2 day lapse of insurance, once I provided the insurance information to Carolina Finance, they still added insurance to my car totaling over {$2000.00}. After a debate, they reduced it down to half. That amount was paid off last year. There has been some embezzlement issues and some people were fired. I got a call last month from them stating that I was still responsible for the insurance. My car was double insured the whole year of XXXX because I had insurance and they charged me for insurance. My insurance broker Mr. XXXX XXXX @ XXXX XXXX here in XXXX NC told me that what they were doing was illegal and told me what I should do. So I am contacting you for help in this matter. I have the paperwork that they sent to me when I was finished with the payments, which tells me that I do not owe them anything. Since I told them that I had paperwork proving that they were wrong they told me last week that they were looking into the matter but have not come u with conclusion to this matter.

There is a recovery place that has called me multiple times in a different state in which I do not reside that I was visiting over the holiday weekend. He contacted me on Saturday XX/XX/XXXX. Spoke with him gave him what my address was and told him that I did not reside in the state that he was contacting me from. Gave him what my address was. Was supposed to call him back but I did not. His name is XXXX XXXX he told me he was a recovery agent. The phone number he has been contacting me from is XXXX. He left me a voicemail that he will put an alert out for my car where i Can be pulled over on the highway and have it towed in. He said he was an investigator with the state. I have not since spoken with him since the XXXX but this voicemail came through on XX/XX/2018. For him to even say he can do this is a violation. He can not put an alert out on my vehicle and I dont know what kind of scare tactics he is trying to do but this is not fair treatment. Please advise. Thank you.

I purchased a vehicle from Carolina Finance in XXXX. Voluntarily surrender the Vehicle XXXX due to financial difficulties. My rep was XXXX. He agreed that I voluntarily surrender the vehicle which I did. I paid off my loan, per my contract and I 'm being told I still have a balance of {$2800.00}. No 'knowledgeable ' explanation has been given and the company has not provided a statement to indicate what these additional charges are for. I 'm unable to obtain the title to the vehicle since they 're stating the balance is not paid in full. The loan was satisfied in XXXX 2016. Since then, the company has decided to give me a new account number with this new balance, which they are unjustifiably claiming. For starters, the APR this company has charged is ludicrous. However I did agree to those terms on the contract. These additional fee 's they 're claiming, I DID NOT agree too. If this company is claiming I did agree, I need documentation to support that claim and validate these additional fees.

In the latter part of 2017, I discovered I had a small balance left on an old auto loan I had with a company called Carolina Finance. I contacted them, and worked out a settlement arrangement to resolve the remaining balance. The settlement arrangement we agreed upon was paid on XX/XX/XXXX. XXXX months have now passed, and Carolina Finance has yet to properly update my account on my credit report. I have contested the account three times with XXXX, XXXX, and XXXX XXXX ; and Carolina Finance keeps telling the credit bureaus I have an outstanding balance owed. Please see attached copies of the - CAROLINA FINANCE , LLC XXXX XXXX XXXX XXXX XXXX XXXX , NC- XXXX prior to the deletion that occurred in XX/XX/XXXX per law. The original date of the first delinquency was XX/XX/XXXX which has now been reentered illegally reflecting a date of 1 XX/XX/XXXX . Also, my credit score has taken a major hit as the account is reported as the first major delinquency as XX/XX/XXXX which was previously listed as XX/XX/XXXX . Carolina Finance has been reporting the incorrect balance since XX/XX/2016. They reported the car was sold at a auction and the new balance is half of what they are reporting. I contacted the office to make them aware and requested a printout in which I received. I also contacted the credit bureaus in which no update was ever made to the account and provided them with the paperwork. This is causing harm when I apply for loans because its showing I owe more than what is owed. I just want the issue resolved. Carolina finance has charged this account off.

I reached out to this company and credit bureaus to inform them all that this account was open fraudulently. I sent them certified letters on XX/XX/2018, XX/XX/2018, 2018, and XX/XX/2018. It is now XX/XX/2018. I sent the CAROLINA FINANCE LLC and the CREDIT BUREAUS a copy of my police report, ID, and my social security card. The companies has not responded to any of my letter directly, which is a direct violation of the fair credit reporting act.

In XX/XX/2018 I settled this debt with the company 's attorney XXXX XXXX XXXX ( after I had to file a CFPB complaint against them ). Recently a lender pulled my credit and this account is still showing that I owe money. They are also reporting every month as if I have missed a payment for over 2 years. I lost my job during Covid which I had for 24 years. I have been very open about this. I finally landed a Full Time job after working for a temporary agency for a year and half. The amounts are still fraudulent with no explanation? There is no explanation for fraudulent charges. I have video of day car was repossessed and charges and payments are fraudulent in account as well including last payment. Account was still charging fraudulent charges.
