This is a continuance of my previous complaint # XXXX against Car FInance Capital and XXXX XXXX XXXX who has failed to answer specific questions that I have been asking since XX/XX/XXXX . It is because of their refusal to disprove my allegations that I made a conscious decision to discontinue payments to them based upon my belief and now proof that both the dealer XXXX XXXX XXXX XXXX . the dealer and CarFinance have committed fraud, conversion of property and Identity theft.

Their response is grossly insufficient and does not answer specific questions. By their own admission they have acknowledged that these same questions have been asked previously and that they have refused to answer them.

In spite of the simplicity to answer my questions the Companies have avoided answering deliberately. I am therefore going to restate my questions and require that the companies answer with specificity providing the statute, code, or public policy in support of their answer.

My questions are as follows : Q : ( 1 ) What statute or law are you relying upon to determine that this transaction is anything other than a " Consumer Credit Transaction ''? Q : ( 2 ) 18 USC section 31 defines the term " Motor Vehicle '' what statute have you relied upon to determine that my " Automobile '' is being used for commercial use or for hire purposes on the highways of the State of North Carolina ''? Q : ( 3 ) 15 USC 1602 ( i ) defines " Consumer Transaction '' as ( i ) The adjective consumer, used with reference to a credit transaction, characterizes the transaction as one in which the party to whom credit is offered or extended is a natural person, and the money, property, or services which are the subject of the transaction are primarily for personal, family, or household purposes. Q : ( 4 ) What statute are you relying upon to have converted this transaction in to a commercial transaction for the purchase of a " Motor Vehicle ''? Q : ( 5 ) The Truth in Lending Act regulates the disclosure of terms regarding all " Consumer Credit Transactions '' including the right of rescission. You have admitted twice previously that you are aware that my automobile was being used for personal, family, and household purposes and not commercial. The Truth in Lending Act Reg. Z Exempts certain transactions. They are as follows : Summary of Coverage Considerations 226.1 & 226.2 Lenders must carefully consider several factors when deciding whether a loan requires Truth in Lending disclosures or is subject to other Regulation Z requirements. The coverage considerations under Regulation Z are addressed in more detail in the commentary to Regulation Z. For example, broad coverage considerations are included under section 226.1 ( c ) of the regulation and relevant definitions appear in section 226.2. Exempt Transactions 226.3 The following transactions are exempt from Regulation Z : Credit extended primarily for a business, commercial, or agricultural purpose ; Credit extended to other than a natural person ( including credit to government agencies or instrumentalities ) ; Credit in excess of {$25.00} thousand not secured by real or personal property used as the principal dwelling of the consumer ; Public utility credit ; Credit extended by a broker-dealer registered with the Securities and Exchange Commission ( SEC ) or the Commodity Futures Trading Commission ( CFTC ), involving securities or commodities accounts ; Home fuel budget plans ; and Certain student loan programs. Footnote 4 : If a credit card is involved, generally exempt credit ( e.g., business or agricultural purpose credit ) is still subject to requirements that govern the issuance of credit cards and liability for their unauthorized use. Credit cards must not be issued on an unsolicited basis and, if a credit card is lost or stolen, the cardholder must not be held liable for more than {$50.00} for the unauthorized use of the card.

When determining whether credit is for consumer purposes, the creditor must evaluate all of the following : Any statement obtained from the consumer describing the purpose of the proceeds. - For example, a statement that the proceeds will be used for a vacation trip would indicate a consumer purpose. - If the loan has a mixed-purpose ( e.g., proceeds will be used to buy a car that will be used for personal and business purposes ), the lender must look to the primary purpose of the loan to decide whether disclosures are necessary. A statement of purpose from the consumer will help the lender make that decision. - A checked box indicating that the loan is for a business purpose, absent any documentation showing the intended use of the proceeds, could be insufficient evidence that the loan did not have a consumer purpose. Q. ( 6 ) Your Contract states on page ( 1 ) near the bottom center of the page in BOLD TYPE " NO COOLING OFF PERIOD '' State law does not provide for a 'cooling off '' or cancellation period for this sale. After you sign this contract, you may only cancel it if the seller agrees or for legal cause. You can not cancel this contract simply because you change your mind.

Q : ( 7 ) What law are you relying upon to supersede the Federal Truth in Lending Act Reg. Z?

15 USC 1692 ( i ) ( 2 ) ( a ) and ( b ) requires you to bring forth a legal action in a Judicial district or similar legal entity in the collection of any consumer credit transaction. ( a ) Venue Any debt collector who brings any legal action on a debt against any consumer shall -- ( 1 ) in the case of an action to enforce an interest in real property securing the consumer 's obligation, bring such action only in a judicial district or similar legal entity in which such real property is located ; or ( 2 ) in the case of an action not described in paragraph ( 1 ), bring such action only in the judicial district or similar legal entity -- ( A ) in which such consumer signed the contract sued upon ; or ( B ) in which such consumer resides at the commencement of the action.

Q : ( 8 ) What legal authority are you relying upon to have repossessed my " Automobile ''?

UCC-9-109 ( 23 ) defines Consumer Goods as goods that are used or bought for use primarily for personal, family or household purposes. Q : ( 9 ) What legal authority are you relying upon to have converted this Consumer Credit Transaction for consumer goods into a Commercial Transaction or " Equipment '' as defined at UCC-9-109-2,.

Q : ( 10 ) Did you at anytime advise me that I was not required to sign a " Motor Vehicle Title Application ''? Q : ( 10 ) What legal authority have you taken my name and applied it to your contract spelled as a mis-nomer utilizing all CAPITAL LETTERS?

Q : ( 11 ) I have rescinded this contract pursuant to the Truth in lending Reg Z 15 USC 1692 ( i ), and provided you with an invoice for the return of all monies expended as the result of this fraudulent contract. When will you be refunding my money? If not what is the legal basis for your refusal to refund?

Q : ( 12 ) Your letter i.e. Notice of your Plan to Sell property dated 6/14/2017 has an account # on it that is not my account number why is this? provide the legal basis as to why there is a different account than my previous account number.

This is another reason why I need a full validation of this debt as requested for the 3rd time below.

This is a dispute of a debt pursuant to 15 U.S.C. 1692 ( g ) I am also requiring again that you provide verification of this alleged loan through audit certification of debt entry in accordance with " G.A.A.P. General Acceptable Accounting Principles '', " Basel 3 Accord '' and " U.N.C.I.T.R.A.L Convention ''.

In your last letter you stated that it is not XXXX XXXX XXXX practice to respond to such correspondence unless new allegations are raised. This is a dispute of a debt and under the FDCPA 15 USC 1692 ( a ), ( c ), ( d ), ( e ), ( f ), ( g ), ( i ) all of which you are violating you are required to respond. Your actions are also a violation of my civil rights under 42 USC section 1983 and various fraud statutes.

If you are operating within the framework of the law it should be pretty simple to respond by pointing me to the laws upon which you are operating. A lack of response as previously stated will be deemed an admission of the facts by CarFinance and XXXX XXXX XXXX as I have stated them.

First I would like to lay the foundation for the basis of my complaint. There is a distinct legal difference between an Automobile and a Motor vehicle. The latter motor vehicle is specific to commercial transportation and/or for hire activity, in other words profiting in business using the streets and highways within the state. The automobile on the other hand is a consumer good purchased for personal, family and household use. ( see legal definition '' 18 USC 31 ( 6 ) MOTOR VEHICLE. The term motor vehicle means every description of carriage or other contrivance propelled or drawn by mechanical power and used for commercial purposes on the highways in the transportation of passengers, passengers and property, or property or cargo. If you will notice the term automobile is excluded from this definition. If you will also note in the North Carolina General Statutes 20-4.01 ( 23 ) you will note that the term automobile is also excluded from their definition of motor vehicle. ( 23 ) Motor Vehicle. - Every vehicle which is self-propelled and every vehicle designed to run upon the highways which is pulled by a self-propelled vehicle. Except as specifically provided otherwise, this term shall not include mopeds or electric assisted bicycles. Within the Uniform Commercial Code which is within the jurisdiction of the states to regulate because it is in commerce UCC-9-109 ( 23 ) defines Consumer Goods as goods that are used or bought for use primarily for personal, family or household purposes. It does not say with the exception of automobiles. UCC-9-109 ( 1 ) further clarifies that the motor vehicle and not a private automobile can be regulated by the state. Under UCC 9-109 there is a real distinction between goods purchased for personal use and those purchased for business use. The two are mutually exclusive and the principal use to which the property is put should be considered as determinative. XXXX XXXX XXXX v XXXX 5 UCC Rep Serv 1028 ; 266 Cal.App.2d 384, 72 Cal.Rptr. 168 ( 1968 ). Automobile purchased for the purpose of transporting buyer to and from his place of employment was " consumer goods '' as defined in UCC 9-109. XXXX v XXXX XXXX XXXX XXXX XXXX., 3 UCC Rep Serv 1035 ; 415 S.W.2d 347 ( Tenn. App., 1966 ). A vehicle not used for commercial activity is a consumer goods,... it is NOT a type of vehicle required to be registered and use tax paid of which the tab is evidence of receipt of the taxXXXX XXXX XXXX XXXX v. XXXX, XXXX XXXX XXXX XXXX. XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX. Thus self-driven vehicles are classified according to the use to which they are put rather than according to the means by which they are propelled. Ex XXXX XXXX 148 NW 20. The Supreme Court, in XXXX v. XXXX, XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX L.Ed. 825, held that carriages were properly classified as household effects, and we see no reason that automobiles should not be similarly disposed of. XXXX v United States, 152 F. 163, 164 ( 2nd Cir. 1907 ). There are countless court cases and including SCOTUS rulings that clarifies the fact that an automobile is private consumer goods, and the right to travel is a right not a privilege to be regulated by the states. When I realized the fraud that had been perpetrated on me, I posed questions to the finance company and dealer XXXX XXXX XXXX XXXX, Car Finance or its loan servicing company XXXX XXXX XXXX. Neither company responded to specific questions I asked them. The questions are as follows : ( 1 ) Under what legal authority did your client make the determination to require me to sign an instrument known as a Motor Vehicle Title? ( 2 ) Under what legal authority did your client make the determination that the purchase of my automobile was a commercial transaction and subject to registration with the North Carolina Division of Motor Vehicles? ( 3 ) Under what legal authority did your client make the determination that my automobile a consumer good, purchased for household, personal and family use is real property and taxable by the state of North Carolina. ( 4 ) Under what legal authority did your client make the determination that a Motor Vehicle Title was the instrument for securing his interest for the loan instead of the UCC-1 Financing statement? ( 5 ) Under what legal authority did your client make the determination that my automobile a consumer good, purchased for household, family and personal use is being used for hire and/or a motor vehicle being used for commercial purposes? ( 6 ) Under what legal authority did your client make the determination that he could use my personal identifiable information on an instrument of commerce i.e. Motor Vehicle Title without my informed consent? ( 7 ) Under what legal authority did your client make the determination that my automobile is equipment as indicated on the North Carolina Motor Vehicle Registration. Additionally my letters were a dispute of the debt and i requested that they validate the loan in accordance with ( XXXX ) XXXX XXXX XXXX XXXX ), XXXX and XXXX XXXX. They failed to do so. Neither company has answered anyone of these questions. I have given them at least 3 opportunities to do so. Instead they unlawfully repossessed my automobile on X/XX/2017. Up until the time that I discovered their fraud my car note was current and I refused to continue paying these crooks especially when they ignored my concerns. Additionally I was never given the proper notices of rescission which are required under the Truth In Lending Act. The actions of these companies are nothing less than fraud, identity theft, conversion of property and theft of property. All of my written request for answers have been ignored. What should have been done is a UCC-1 Financing Statement should have been filed with the Secretary of States office to secure their interest not a Motor Vehicle Title. By filing a motor vehicle title application they have caused the classification of my automobile as a motor vehicle. This subjects me to property taxes and regulation of the Motor Vehicle Statutes by having the state license plates on my automobile. After bring this to their attention rather than try to rectify the my concerns they chose to repossess my automobile. This is a very serious matter for me. The fact that once I made them aware that I am aware they have shown no compunction to do the right thing whatsoever. I will retain legal counsel to bring forth and avail myself of any and all legal remedies if I do not get a satisfactory resolution from these people within the next 10 business days.

In XXXX I switched finance companies from Car Finance Capital to XXXX XXXX XXXX XXXX because I had purchased another vehicle ( XXXX, traded in XXXX ) and financed with XXXX so I got a cheaper interest rate so I switched XXXX. I had XXXX cars at this time through them, a XXXX ( traded in for XXXX ) and a XXXX. I told Car finance I was switching and they said that everything would be taken care of when my bank contacts them. Well when i purchased my XXXX I had traded in a XXXX that I had financed with Car finance, the company had sent over a check but dduring the week that the check was being sent, car finance called me over XXXX times a day. I had no control over the check as that was between the credit union and car finance. I am XXXX XXXX military and car finance called my Chain of command harrassing me asking me where the money is. You could tell they Got it because the calls suddenly stopped. After refinancing my other vehicle ( XXXX ) with XXXX I received XXXX calls a day asking for the money, my bank stated they had sent a check to car finance. Car finance told me that they had it under control and would contact the new lean holder but I would still get calls and tell them yes the check was sent I just talked to someone at car financ and they said it was taken care of. So every other convo was different. Eventually it was n't handled so I went and Got a check myself and over nighted it. The check was dated for XXXX when the bank and car finance had spoken and Got each other 's information and pay off information and everything so they had been speaking. I had already started paying on this car again at XXXX XXXX ( mind you in 3 yrs that I had car finance I never missed a payment ). I talked to a manager who told, me that now because Car finance refuses to admit they recieved a check ( which the XXXX I sent them is dated from their original convo ) they also said I need to pay interest.. Now I am already paying else where and car finance told me they had everything under control XXXX XXXX, a manager with the company told me the bill was 37 days past due, I over nighted the second check that day but now my credit score just went down XXXX points because car finance reported my deliquent 60 days. I am not deliquent, I am paying my bills but what car finance told me was that they were supposed to talk to my bank and when they didnt they faulted me for it. Now I owe interest in it, I sent many emails stating I need a bill stating my remaining balance and it has been 3 weeks and I have yet to receive it or an email back from the manager ( i sent XXXX emails ). The company has not sent my title to my bank either. I believe that this company is a predatory lender and I have reported them to my Chain of command because I feel they were quick to go to my Chain of command when I am not at fault. The harrassment and emotional stress I have recieved from this company is way too much .. And now my credit is ruined for something that is not my fault. They have the check that states the original date, they can see it was n't me missing a payment. This needs to be fixed now!!!! My payment rate is 99.99 % on my credit report, I pay my bills!!!

The last 4 years I have tried and tried. Letters to XXXX, calls, copies front and back, nothing works. The bank tried to help and saw these incorrect items on my 3 credit reports. They advised me what to do. After the year of back and forth letters, calls and getting no where with XXXX and then the loan companies. 2 car loans and 1 home loan in California. I am in Oregon. Name is incorrect on report as well. I hired XXXX XXXX XX/XX/XXXX XXXX XXXX XXXX. They got some taken off and {$1600.00} later. Its back on my reports. Effecting my insurance, and as you know everything with credit. I started the process in XX/XX/XXXX when I first pulled a credit report, advised by my financial advisor. XXXX XXXXautomated system, the caller must answer security questions to speak with representatives, XX/XX/XXXX what credit card did you have? I was XXXX years old. NONE. Incorrect answer the phone hangs up. I ca n't get anywhere with the phone numbers listed. I try online and what to do. Send a letter. Wait 6 months nothing do it again, with all required copies, forms, letter, proof of person. Nothing. I try to call again. Nothing, After a year of this I try to get credit help. I visit and go to meetings with counselors that advise me what to do. Nothing still. Now Two years of dealing with it. Monthly for 2 years, I have a file with proof. I paid a company, attorneys to help. And now its back on AGAIN!!!! I 'm a single mom, XXXX kids and own a XXXX. I do n't have time for this, I do n't steal credit, And it should n't be this easy. Really a number is a persons life now days. CREDIT, Loans, Emergency, homes, insurance, I can go on. And when someone uses what you work hard to maintain and take care of, its beyond XXXX or criminal. Explain this to my son who is XXXX went to state golf and needed a car, his broke down. I drive all paid off cars, and could n't even get him a cheap {$3000.00} car. REALLY thats embarrassing. XXXX credit score to XXXX now!!!!!! My name is XXXX XXXX of OREGON. I have filed reports on www.alertsftc.gov/XXXX, freecredit reports agency, XXXX Sent letters. I am at a loss. Only to say obviously it pays to be a criminal in this country. PROOF is right here. The other cars loans, phones, and Mortgages information I have. In a file at the accountant. I can get those if this goes anywhere, if needed, at this time its just the same rant and go no where letter. I HAVE A LOAN WITH CARFINANCE.COM ( LOAN # XXXX ) AND I HAVE RECEVED NUMEROUS CALLS EVENTOUGH I HAVE TOLD THEM A DATE I WOULD PAY. I AM CURRENTLY A MONTH BEHIND BECAUSE OF FINANCIAL CIRCUMSTANCE, BUT I HAVE ALWAYS MADE MY PAYMENTS WHEN I SAY I WILL VIA XXXX. THEY SAY THATS NOT A SECURED ARRANGEMENT BUT THAT THEY WOULD NOTATE IT IN THE SYAYTEM ON WHEN I CAN PAY. WELL, I HAVE TOLD THEM SNCE XXXX XXXX WHEN I MADE MY LAST PAYMENT THAT I WOULD NOT BE ABLE TO PAY UNTIL XXXX XXXX MY NEXT AVAIL PAYDAY TO MAKE THE NEXT PMT. THIS IS A VIOLATION OF Fair Debt Collection Practices Act ( FDCPA ), The Act prohibits certain types of " abusive and deceptive '' conduct when attempting to collect debts, including the following : 1 ) Communicating with consumer after request for validation has been made : communicating with the consumer or the pursuing collection efforts by the debt collector after receipt of a consumer 's written request for verification of a debt made within the 30 day validation period ( or for the name and address of the original creditor on a debt ) and before the debt collector mails the consumer the requested verification or original creditor 's name and address. 2 ) Causing a telephone to ring or engaging any person in telephone conversation repeatedly or continuously : with intent to abuse or harass any person at the called number. NUMEROUS TIMES HAVE A PAID WHEN I SAY I AM GOING TO PAY. YES, I AM CURRENTLY BEHIND A MONTH ON THE PAYMENT BUT I HAVE GIVEN VERIFIABLE ARRANGEMENTS ON WHEN I WILL PAY. In or around XXXX XXXX I was laid off and soon thereafter began having financial hardship. I explained this situation to Car Finance ( the agency collecting the auto loan ) of such hardship. Towards the end of XXXX XXXX my income was drastically decreased but I kept my best to make payments and ask that they stop calling my cell phone so often as I was well aware of the times my payments were late but I was still making them. In XXXX XXXX they kept calling on a regular basis even though I explained I was trying to borrow funds and would make sure my payments were n't more than 30 days past due. My requests continued to fall on deaf ears and the calls had gotten to the point I begged to stop and borrowed money from my roommate on credit to pay my bill, because they would n't let me off the phone. I have spoken to people in the legal field because of the harassment and I was advised once I asked them to stop calling my cell phone they would be in violation of the Telephone Collection Practices Act and considering they had called at times prior to XXXX and after XXXX PST they were violating Federal Collection Practices Act. I called them and told them about these violations and I NEEDED them to stop ; i was told ( no less than two separate occasions ) they could n't until my bill was up to date. -- I have made several complaints to them, I 'll need to get their call logs because their number changes and I only have two or three numbers they used to call me on my cell phone call logs. I understand that an attorney may assist in getting direct funds for each violation. My goal is not to have an attorney take a lot of money and I still owe them. My goal is to have them work with me, remove all of the fees ( which is the majority of the amount owed ) and a decent payment plan only on the remaining principal amount. That seems fair, I do n't want a long drawn out legal issue and them to threaten to repossess my vehicle while ruining my credit report. My credit report should n't have any delinquencies regarding this debt because I have made sure payments were not over thirty days.

During deployment turning in my SCRA documents was misleading and stressful.I did n't get info to do so until I was XXXX and away from home. I 've tried contacting the company to make payments.Back in XXXX I even had a customer service agent take XXXX payments without permission resulting in bounced checks and over drafts with my bank. I have to get a new bank account because of this so I could pay bills. I was told my account is under audit and I could n't getme account info or make accept payments at the time. I had the we can take payments / we will differ a paymen to help you catch up a few time while deployed. Then I 'm in Texas going through my XXXX when I finally get help from someone. At that time I 'm told I 'm XXXX payments behind! I 'm told they can differ a payment and help me get caught up. Before that could happen though they would have to take a payment to keep me out of repo and call me back about the deferment. i was never called back again except for another payment. To where at the beginning of XXXX I made a payment around the XXXX and setup XXXX for the XXXX. This was going to get the current for the month of XXXX. Meaning I still owed a payment for the XXXX XXXX payment date. I tell the customer service agent that as of XXXX XXXX XX/XX/2015 I 'm off active orders and told him I would try making both payments XXXX XXXX. He assured that will get on track. XXXX XXXX I get XXXX letters XXXX stating my intrest rate changed and a bill dated XXXX/XXXX/XX/XX/2015 that I now owe XXXX by XXXX/XXXXXX/XX/2015 and my payment is in collection. I called and was told a manager would look at my account and call me back XXXX XXXX of XXXX. XXXX XXXX I 've had to call them. Collections tells me I owe XXXX and they transfer me finance. I 'm told my account has never been audited and my payment is n't XXXX ( results of a " descrepancy from a retina audit '' letter sent XXXX ) it 's not XXXX per the bill sent XXXX. The Collector at XXXX XXXX XXXX disclosed how far past due our account was, disclosed it was out for Repo and she was actively looking for it to reposess it because " that's what I do now Repo Only ''. She discussed a private conversation my husband had with a Supervisor at XXXX when he called to make a compalint aboutbthe matter that occured on XX/XX/XXXX. This Collector was bosting as if she was proud. As if tbis was " normal repo practice for Collectors at XXXX ". She asked where I worked, if my Car was parked outside ( referring to.my place of employment ), she asked what my husband and I drive. We immediately advised XXXX of this as soon as it occurred on XX/XX/XXXX. They have not offered anything to help us with the humiliation, pain and suffering this has caused our entire family. Instead we were told by there legal.counsel that our account WILL go back on the dialer as of XX/XX/XXXX. This is unfair and against our rights as consumers.

I have a loan with Carfinancial Capital since XX/XX/XXXX. the due date was requested to change on XX/XX/XXXX after I get my new job outside the USA from XXXX to the XXXX of each month, the change was requested in order to avoid late fees. I financed a vehicle with Car finance which was taken over by XXXX XXXX which they repossessed in XX/XX/2017. On XX/XX/2018 I went and checked my credit scores using XXXX. There was a auto loan refinance prequalification page to see what better rates I could get. I filled mostly the information about the vehicle and continued. I was not able to get any estimates on the vehicle as they were having technical difficulties. After closing out of the website I noticed a hard pull alert on my credit profile from " CarFinance ''. I never applied for any of the companies they recommended which is why I'm sending this complaint. I did not give this company my full social security number, Written or Electronic authorization to pull my credit report, nor was I aware of a hard pull during the process. This was only to be a pre qualification which is suppose to be a soft pull at best. I've gone through other credit reporting prequalifications before and I've never had a hard pull initiated.

I have a loan with Carfinance.com. Since the first payment XXXX I have paid an extra XXXX every month to go to Principle. Then in XXXX I started paying an extra XXXX to principle. Car finance will no longer send me a statement because I am paid too far ahead, I want a monthly statement so that I can track how they are applying the funds.
