XXXX refinanced XXXX trust through XXXX loans ( fixed rate Balloon ) - went to XXXX XXXX XXXX XXXX modified to 4 %, 30 year term, XXXX XXXX XXXX wroteoff/charge off over the years transferred to many debt collectors Capstone Funding Group XXXX XXXX XXXX XXXX XXXX is suing in court Foreclosure on the second, the home is under water to a XXXX paid on time Nationstar XXXX
Capstone is suing on the original note from XXXX a 6.75 interest rate loan Spoke with XXXX XXXX and asked her to provide to me proof that they have the XXXX modification & what int. rate are they using? She said she has to ask manager to get into the vault for the paperwork. I told her I am concerned about Fraud.
XXXX XXXX never cld back, I called her and she said she does n't have the paperwork.
XXXX XXXX then filed the final loss mit. to court saying she did not do a mitigation, but because I did not give her the XXXX modified loan agreement. I have emailed this to XXXX XXXX XXXX XXXX XXXX, XXXX XXXX said she can talk to me about a modification, she would call me back - never did XXXX called cell # of XXXX XXXX - she told me she no longer works for Capstone, she will try to get ahold of XXXX XXXX, the foreclosure is on hold, they got the XXXX docs that I sent XXXX/XXXX/XXXX XXXX XXXX of XXXX. XXXX XXXX XXXX. ( XXXX ) called after 3 times got ahold of a XXXX, she took his info she stated she needed to contact XXXX XXXX who is working on our file ( KB told me the day before she was no longer working for capstone ) The phone num capstone provided on their contact sheet is temporarily disconnected since XXXX, the other number goes to a recording, you can not talk to anyone, the voice mail says ca n't accept messages, this has been happening for the last two weeks - we have a mediation date on XXXX/XXXX/XXXX Please help I do n't believe they own this loan, the XXXX MERS assignment shows XXXX XXXX as working for XXXX XXXX, as a VP, but when you XXXX her she is an assistant at XXXX XXXX XXXX in XXXX, that is who the recording was requested by.

Capstone has refinance my present mortgage with XXXX, I have several complaints with your office regarding XXXX. XXXX was the Servicers XXXX ( see attached complaint number ) So I ask Capstone to change Servicers and Capstone denied my request., sencodly Capstone payoff XXXX XXXX complaints will be file today ) but the lien is still showing owed with the XXXX XXXX ''. I believe was planned. So Capstone or XXXX because they refuse to XXXX in making XXXX correct issue with money owe to borrower ( myself ) late fee that never happening and now loads lien to still existing with XXXX COUNTY '' Capstone or XXXX do n't care to assist in any thing the XXXX does. XXXX Capstone still has n't given borrower the signed close documents for this loan for XXXX and XXXX was payoff to XXXX

RE : case # XXXX They have not responded to CFPB as of XX/XX/2017 The last I spoke the XXXX XXXX, he told me he could not help me or look at a modification unless, I gave him 3rd party consent to speak with our first mortgage company, I asked him why and he did not give an answer. XXXX is with Capstone funding group trying to foreclose on the 2nd mortgage. There is no legal fact that he needs to have authorization to speak with my first mortgage which is not foreclosing and is not represented by them.
