Our original mortgage was set up with XXXX XXXX XXXX in XXXX of XXXX. At the time of closing our escrow account was over inflated by a few thousand. I questioned this at closing as our house payment was approximately {$400.00} more than originally stated. At signing we told them the figures were inflated by {$400.00} per month. We were told that this was normal as a law had passed for title companies that if the taxes or insurance were under quoted they would be responsible for the shortage and fines so it was normal for them to inflate them and once the mortgage was set up with the company that buys the loan we were responsible for requesting an escrow analysis and the company that bought the loan would adjust to the correct amounts. XXXX, XXXX CMC Funding Specialized Loan Servicing bought our mortgage. On XX/XX/XXXX I called and spoke with XXXX. He stated the escrow per month was {$630.00} and that once the loan was what they called " boarded '' meaning it is on their system I could put in the request and CMC would contact XXXX County Assesors office and get the correct information along with my insurance company. During XXXX and XXXX I spoke with someone weekly checking to see if the loan was boarded. It did not get boarded until XX/XX/XXXX according to a call I had with XXXX at CMC Funding. I explained my situation and they stated no worries she would put in an escrow analysis request and to follow up in 10 days. XX/XX/XXXX I spoke with XXXX and he stated there were no notes and laughed when I stated my case. He refused to transfer me to a supervisor stating he would put in a request for analysis and a supervisor call back which I would receive in 24 to 36 hours. I never received a call. I called back in on XX/XX/XXXX and spoke with XXXX who stated she is a manager. At this point my home owners insurance and taxes had not been paid yet. I explained this to XXXX along with the needed escrow analysis. She transferred me to XXXX in the Tax Department and he said he would put in a request for analysis and a research request as to why the taxes had not been paid. I was then transferred to XXXX who I explained my situation to and she stated that she could see the request XXXX put in and the tax review should be done by XX/XX/XXXX. XXXX stated that she would put the request in for the insurance review to see why it had not been paid. XXXX requested that I fax my tax bill and insurance bill in which I did immediately with my loan number and contact information. My taxes were due XX/XX/XXXX with a note from the county stating that mortgage companies often take until XX/XX/XXXX to pay. I had contacted my insurance company as they were stating I was going to be cancelled due to non payment. They agreed to put a 30 day hold on the policy and it would be cancelled by XX/XX/XXXX. XX/XX/XXXX I called back into CMC and spoke with XXXX in insurance. She stated they still had not paid the insurance and she didnt know why but that she would put in a ticket for investigation. XXXX transferred me to XXXX in taxes and she stated that the review wouldnt be complete until XX/XX/XXXX for payment of taxes. I explained how all these tickets had been opened to review my escrow and investigation of my insurance and taxes not being paid. I explained my house payment being {$400.00} higher per month and that there was {$6100.00} sitting in my escrow account. XXXX stated she would put in a hardship ticket and that should rush everything. XX/XX/XXXX I received a call back from XXXX stating she was from the escalated department and that she doesnt know why I would be told for the last two months that they would do an escrow analysis and why the title company would tell me that when I signed because they dont do those until a year has passed. I explained again that taxed and insurance had not been paid. She stated she could see tickets in and just wait. I called my insurance company on XX/XX/XXXX and paid the homeowners insurance which was a total of {$610.00} as they confirmed that they had not received payment and yes cancellation was set for XX/XX/XXXX. XX/XX/XXXX I spoke with a manager by the name of XXXX. I explained all of the above. She stated that a check had been sent for insurance on XX/XX/XXXX. I stated that was strange as my escrow account had not decreased. XXXX stated that she would send an email to the management of the escrow department explaining the escrow issue and that she would be in contact within 24 to 36 hours. I spoke with my insurance company today and they have not received payment from CMC. XXXX which is today, I called again as I had not heard back from CMC Funding. I spoke with XXXX and she stated she didnt know who XXXX was and she had no way to transfer me but she did see a note that XXXX would call when she received an answer on the escrow account and that she had notated there was a shortage. I explained there is not a shortage but an overage of a few thousand. She said there was nothing she could do for me. I had her transfer me to the Tax department. I spoke with XXXX. He stated the taxes had not been paid according to his records and the XXXX County tax site. He stated he would open a ticket for investigation and I should check back in 10 days. My escrow account at this time has a balance of {$6100.00}. If an analysis is not done until XXXX of XXXX which is what CMC Funding is stating the balance of my escrow account will be over {$12000.00}. When I spoke with XXXX from the escalation department and she stated they do not do reviews until the next year she said that they wouldnt change anything anyway as the taxes will be going up next year. When I called to CMC Funding today and tried to get a manager and couldnt my goal was to discuss RESPA section 10 as they are out of guidelines holding way more than 1/12 in escrow and way more than 1/6th for a cushion. They also are not following the restrictions on pre accrual as according to XXXX they are within guidelines storing thousands in escrow in case the taxes go up next year. After over two months of speaking to several individuals I can not get results. The additional {$400.00} per month on the house payment is placing us in a hardship situation. When our tax bill from the county went out for the bill due XX/XX/XXXX, the homestead exemption was removed in error. This caused our tax bill to be {$2800.00} for the year, split into two payments of {$1400.00} each. Upon receipt of the tax bill, I immediately contacted the county to have the bill corrected. However, this was not done in time to prevent the payment from the mortgage company. On XX/XX/XXXX the mortgage company distributed {$1400.00} to the county for the tax bill. When the homestead exemption was applied, the corrected total property tax for the year was {$1400.00}, payable in two installments of {$720.00}. The county sent a revised bill showing this, and also showing a credit of {$710.00} from the bill due XX/XX/XXXX applied toward the fall bill due XX/XX/XXXX. The bill clearly shows a tax balance of {$9.00} due on XX/XX/XXXX. It also clearly shows a note on the taxpayers summary that the homestead deduction was not applied in error to explain the corrected bill. I submitted this documentation to the mortgagee and they performed an escrow analysis on XX/XX/XXXX. However, the escrow analysis erroneously concluded that the bill due XX/XX/XXXX is the full {$720.00}, although the bill clearly shows a tax balance of {$9.00} due on that date. This caused our escrow payments to increase from {$230.00} to {$280.00} in error, as the original escrow payment is sufficient to cover PMI, the tax balance, and hazard insurance when paid through XX/XX/XXXX. I have attempted to resolve this issue numerous times and have been told different things by different people. It is XX/XX/XXXX, and my first phone call to the mortgagee was on XX/XX/XXXX. After the initial escrow analysis came back incorrectly and I saw the payments went up, I spoke with one representative on XX/XX/XXXX who advised me that I should contact the county and have the overpayment from the XX/XX/XXXX bill refunded to the mortgagee so it could be deposited into my escrow account and balance it out. I called the XXXX County Tax Auditor XXXX XXXX ( XXXX ) and explained to her that the mortgage company was requesting the {$710.00} overpayment be returned to the mortgagee. XXXX XXXX advised that this is not a standard request from a mortgage company, because there is no overpayment because there is still a balance of {$9.00} on the account. The taxes are annual taxes and they allow residents to pay twice a year. She advised that the bill that she sent me, and that I sent on to the mortgagee, is a certified tax bill. She could not understand how a mortgage company would not accept a certified tax bill. After speaking with XXXX XXXX, I again called the mortgagee on XX/XX/XXXX. This time, I was advised that what I had sent in was a Taxpayers Summary and not a bill, and therefore could not be accepted by the tax department. I explained to the representative that this is a certified bill for both spring and fall that also includes Copy C which is the taxpayers summary. She continued to advise me that it would not be accepted. I asked her what this meant. She advised me that I would be required to make the overpayments into escrow in the amount of {$280.00}. Then, the mortgagee would request a copy of the tax bill from the county in the fall. When they receive the bill and pay it, then I can request another escrow analysis. At that time, my overpayment will be returned to me in the form of a refund. I advised her that telling me to knowingly overpay for five months when I have sent in a certified tax bill is an unacceptable resolution, and I requested to speak with a supervisor. XXXX XXXX, the supervisor, advised me that the documentation that I sent in would be acceptable to have the escrow payment corrected, she would forward it on to the tax department, and it would be resolved in 35 business days. I never heard back. I called back and spoke with another representative who escalated me to a supervisor named XXXX, agent ID XXXX. He advised that he would seek resolution as well and that he would put an extension on my XX/XX/XXXX payment so as to allow for sufficient time to resolve this issue. He advised I would have until XX/XX/XXXX to pay my bill without any penalties, late fees, or being considered late. On XX/XX/XXXX, I called again and spoke with another representative who advised me that despite the conversation with XXXX several days before, the bill had not been postponed as advised. She said that she would do that. I again explained my concern to her. This time, I was advised to send in proof that I qualify for the homestead exemption in the first place, because they wont accept the tax bill without that. I inquired about why Ive been calling since XX/XX/XXXX and no one has advised me of this requirement, and she did not know. This problem has dragged out since XX/XX/XXXX and has still not been resolved. Listed below are some of the dates and call durations that I found in the call log from my cell phone provider : XX/XX/XXXX 20 min XX/XX/XXXX 24 min XX/XX/XXXX 26 min XX/XX/XXXX 24 min XX/XX/XXXX 15 min XX/XX/XXXX 6 min XX/XX/XXXX 18 min XX/XX/XXXX 7 min XX/XX/XXXX 8 min XX/XX/XXXX 17 min XX/XX/XXXX 8 min In addition to the above calls, I have spoken with 3 supervisors : XXXX XXXX, XXXX XXXX, and XXXX XXXX. Two of these supervisor calls were incoming, and I dont have a record of the number that they called from and thus those two calls are not included in the above call log. This brings the number of phone conversations I have had regarding this issue to a minimum of 13 calls. This issue has still not been resolved. Enclosed you will find more than sufficient proof to resolve my complaint. I have included the XX/XX/XXXX tax bill that shows the tax bill amount for the year and the document showing that we received the homestead exemption. Then, you will find the XX/XX/XXXX tax bill that went out for the wrong amount, and the document that shows that the homestead exemption was removed. Finally, you will find the revised, corrected tax bill that is a certified copy from XXXX County that explains in Copy C Taxpayers Summary -- that the Homestead deduction was removed in error.

Account went into default 9 months after loan was made due to Homeowner ( a Retired XXXX XXXX ) had a XXXX XXXX in XXXX. Homeowner could not return home and the home was put on market for sale. In XX/XX/XXXX, the property was put in Family Trust naming the Homeowners " Power of Attorney '' and the Heir to the homeowners Will a co-Beneficiary of the Trust and the Loan Care Servicer '' was notified. The Family Trust was created to cover the financial responsibility of maintaining the home, utilities, and as necessary assist Homeowner with financial responsibility to put loan back in right standing should Homeowner be able to return home. Attempting to sale the home was difficult. The area comparable sales were lower than the balance owed and short sale offers were denied by XXXX XXXX XXXX. Meanwhile, the borrower had another XXXX and required XXXX XXXX XXXX XXXX. The homeowners monthly living expenses were greater in the out of XXXX XXXX than it would be to return the homeowner to her home and arrange in XXXX XXXX. Homeowner could not afford to pay home mortgage and XXXX XXXX XXXX at same time. The loan was sold and a New Servicer XXXX XXXX XXXX ( XXXX ) took over the loan. We contacted XXXX to apply for mortgage assistance with Home Retention Options. A loan mod app was submitted. XXXX approved the loan mod and first payment was scheduled for XX/XX/XXXX. The Homeowner Passed away XX/XX/XXXX PRIOR to the first trial mod payment date. In XX/XX/XXXX. We contacted XXXX and we were VERBALLY ( XXXX XXXX ) instructed to send in payment if we wanted to keep the trial mod terms. Also send along with payment documents related to Homeowner passing death certificate, etc. The death certif took 30 days+. We sent the verbally requested docs and made a electronic payment on XX/XX/XXXX before the trial mod would be cancelled as instructed. However, XXXX MISINFORMED US AND THE LOAN MOD WAS CANCELLED ONCE XXXX LEGAL DEPT REVIEWED FILE ABOUT 30 DAYS LATER. XXXX DID NOT SEND A LETTER TO NOTIFY US OF A CHANGE IN STATUS OF LOAN NOR DID THEY ALERT US OF IMMEDIATE DANGER OF FORECLOSURE. SLS DID NOT NOTIFY US OF WHAT STEPS TO TAKE TO KEEP THE HOME IN FAMILY. XXXX verbally advised me ( I randomly called in ) that we should reapply. After several calls, we were advised to reapply naming occupant/family as Non Borrower. NO WRITTEN NOTIFICATION OF WHAT TO DO Family was grieving during this period .... I called in approx XX/XX/XXXX and spoke to XXXX XXXX XXXX who was kind and she tried to figure how to include the direct heirs and clearly list them on Mortgage application. We resubmitted docs and waited for response, got one call to ask about the Trust, and then no more contact. After several weeks, I randomly called in to check the status of the review. I and was told the file was closed and could foreclose anytime. After several calls, getting no where with a clear understanding of what exactly XXXX wanted Us to do. No understanding as to WHY the first submission for Loan Mod was not processed??? ( NO DENIAL LETTER NO WRITTEN INFO TO SAY WHAT WRONG ) I called XX/XX/XXXX and spoke to XXXX XXXX and I asked for a supervisor and got XXXX XXXX Supervisor, Loss Mit. My concern was that a foreclosure date could be scheduled anytime and we still had no Understanding of how to proceed toward Home Retention/Foreclosure Prevention Options. XXXX advised me to resubmit using both surviving Beneficiaries naming them as Borrower & Co-Borrower on RMA NOT Non Borrower. XXXX said he would put in a request to generate a letter to Us saying in WRITING as to what was necessary to submit for loan mod and advise how much time to get all back in for a review. XXXX stated he would call me back about letter and general follow up. XXXX did not call me back nor did we receive anything in mail to say what to resubmit. However, I resubmitted on XX/XX/XXXX. By then the property was scheduled for XX/XX/XXXX Foreclosure Sale. XXXX says FHA Loan and NOT ENOUGH Time to process request ( 37 days required by FHA ) FRUSTRATING!!! I have since been calling SLS to ASK FOR HELP to no true avail until I contacted FHA on XX/XX/XXXX and obtained a FHA Ticket # XXXX HUD Specialist XXXX XXXX is now assigned. After getting very Little communication from SLS and in general SLS had closed the file would not transfer me to Loss Mitigation when I called in and was simply waiting for XX/XX/XXXX. After FHA ticket generated XXXX finally began to reach out me and allow me to speak to Loss Mit. XXXX Rep, XXXX, called me twice on XX/XX/XXXX late in the evening asking for Drivers License copies of Heirs??? I asked if the foreclosure would be postponed now to process our request? Call dropped. I got no return call from SLS. I called back in to get a supervisor to explain WHY SLS was calling and what did this mean? XXXX who could not explain to me WHY they wanted drivers license but told me f/c sale was still scheduled but send in the drivers license. But now XX/XX/XXXX, I just spoke to XXXX XXXX supervisor at XXXX XXXX XXXX to advise him the drivers licenses/ID is emailed in. XXXX says the Problem is NOT 37 days but whether the internal XXXX processing and underwriting team can secure the note not knowing who is direct heir??? or whether an assumption must be done as opposed to a loan mod??? I asked him to please postpone the sale and lets All figure this Out. IN the face of Homeowner death not 6 months ago. We JUST did not need the pressure of a foreclosure sale even though we were doing our best to COMPLY to XXXX requests. We offering to make you whole and take Full responsibility of the debt by Loan Mod. XXXX says he will call me back by end of day tomorrow. NO APOLOGIES FROM XXXX XXXX has no sense of obligation to assume responsibility for erroneous instructions and waste of time in process.

This has been a series of nightmares one after another. Sadly, this was my first home purchase and it hasnt been a good experience. My previous mortgage company, XXXX XXXX ( XXXX ), sold my mortgage one month after I closed on my condo inXX/XX/XXXX The night before closing I was told by XXXX I had a sellers credit and I could bring less to the table. Which as a new person to buying a home sounded great. However, I was never told there was a caveat with that. I learned about that caveat inXX/XX/XXXX. In XX/XX/XXXX I received a tax bill from XXXX County ( XXXX, IL ) explaining I was late on my XX/XX/XXXX tax bill ( installment 2 -- the previous owners tax bill ). This prompted me to call my new mortgage company XXXX XXXX who is serviced by XXXX XXXX XXXX. When I called them, which bear in mind was my first time ever calling them, they were unable to find my property PIN, so therefore was unable to answer my tax questions. Basically they had the wrong one on file. I reached out to XXXX and they called CMC and resolved it. Both my most recent tax tax installment and the previous owners taxes ( installment 2 were paid -- but paid late. Which means I included this in my taxes for XX/XX/XXXX. Then I received a bill from XXXX in the first week of XX/XX/XXXX explaining that my escrow was negative and I owed {$4100.00} by XX/XX/XXXX ( when my mortgage was due ). The letter went on to say if I failed to pay the {$4100.00} the mortgage would go up to $ XXXX/mo from {$1200.00} until the {$4100.00} was paid off. I was in obvious shock. I reached out to both the closing attorney and title company, they said that XXXX messed up, and didn't take enough money from me at the closing. So when they sent money over to CMC it wasnt enough, so when they paid the taxes it put me in the negative. This was the caveat mentioned above, no one explained to me that I was liable for the taxes from the previous owner.This was the sellers credit basically. This brings me to my complaint against CMC/XXXX XXXX XXXX. Since receiving the letter requesting {$4100.00} I have also received another letter telling me that I owe {$3700.00}. When I called CMC to understand if it was {$4100.00} or {$3700.00}, they said {$3700.00}. I mentioned that I didnt feel secure with their accounting and it appears that one of the escrow payments from XXXX went to principle instead of escrow while at CMC. They said they would look into it, I have called several times without being given a satisfying answer. I understand that XXXX messed up, that makes sense to me. However, I have been waiting close to two weeks for CMC to tell me what is truly owed. CMC ended up opening a work item about 10 days ago, that work item was for their escrow team to research what was truely owed.The work item was due to be completed yesterday. On XX/XX/XXXX I called CMC and the representative told me the work item had been completed, then I mentioned to him that nothing had changed. I asked him to explain to me what logic they had come up with. Like I said, If i owe the money I owe it, but based off receiving two conflicting amounts, messing up my property PIN, and paying my taxes late, I was not feeling like just taking their word for it. He couldn't give me an answer so I asked for a manager. XXXX the manager ( phone code XXXX ) explained that my payment was reversed months again and that {$3700.00} was the correct amount. I said well send me a letter to show me this and I will pay it. He then said once you do that your mortgage will go back to {$1400.00}. I explained that my mortgage was {$1200.00}. He said well your taxes must of gone up. I said not by that much ( my taxes are approx. $ 3700.yr, so that would be quite the jump ), He put me on hold, and then said he was going to reach out to the escrow team, and get back with me with hopefully good news tomorrow. He confirmed my number and said he would give me a call around XXXX on the XXXX. He didnt. I apologize for the long story but I just wanted you to understand how we got here. My mortgage is dueXX/XX/XXXXand I feel like this is just being hung over my head. The bottom line is I'm going to have to pay them or it goes on my credit. Which isnt right for them to have that sort of power. I have read nightmare reviews online of people having the same issue with them and then being 1 year in and still not having the money returned to them. I sadly dont have a lot of money where I can just pay them {$3700.00} AND have them jack up my mortgage by {$120.00} with no true logical answer. No one wants to help me there and if I cant get a manager to help me who will help me? I cant stress enough that I'm not trying to get out of paying what is owed, but I just want to make sure its the right amount. Plus it seems unlikely that my mortgage should be anything other {$1200.00} after paying them {$3700.00}. Please help! Thank you in advance!

Our loan was bought officially in XX/XX/XXXX from another lender. We had {$4100.00} in our Escrow per Closing Disclosure. When this lender took over the loan our escrow balance was only at {$720.00}. This is because previous lender sent 2 wires of money to this lender from our escrow to cover our estimated XXXX taxes which was {$3800.00}. So our initial Escrow of {$4100.00} + {$390.00} ( XXXX Escrow payment ) - {$37.00} ( Mortgage Insurance ) - {$3800.00} ( amount this lender received in wire transfers ) equals the {$720.00} Escrow Amount per the " Initial Escrow Amount Disclosure Statement '' that this lender has on file. The problem is that this lender never credited that {$3800.00} that they received in money wires from old lender from our Escrow account to cover estimated XXXX taxes. This resulted in old lendre paying XXXX taxes ( {$3700.00} was actual amount paid ) which put our Escrow account in the negative. This lender claimed to have " borrowed '' us money to cover XXXX taxes. Then it was not until XX/XX/XXXX that they increased our Mortgage Payments to {$1700.00} to make up for Escrow Payments. We called this lender regarding the missing money. We were told a note would be made along with a ticket being created and a Supervisor call back. None of the above was ever done. When we went to pay our XX/XX/XXXX Mortgage Payment we paid our normal {$1500.00} ( Technically paid {$1600.00} even ) it was considered an additional principal payment due to not covering the new {$1700.00} due balance. When I called regarding the missing payment I was informed of what happened by a teller. He was helpful in reversing the payment so it would be put towards the monthly mortgage and I had to pay to additional {$170.00} over the phone. I had explained we had a ticket in regarding the missing escrow. He said he could not change anything, only could write a note in our file. We now have a late mortgage payment in our history. From XX/XX/XXXX through now we have been paying the additional amount of money to cover Escrow. It has caused financial and emotional stress on my entire family. And since XX/XX/XXXX we have been calling this lender to try and get the issued resolved. We have never received a call back from a Supervisor. We have to re-explain the entire situation to every Teller that takes our call. Multiple tickets have been opened and supposedly resolved. Now this lender has paid our XXXX taxes and again put our Escrow in the negative because they refuse to acknowledge or credit our Escrow account the {$3800.00} that old lender wired them back in XXXX and XX/XX/XXXX. We contacted our old lender who provided us with all the proof of wires they sent to this lender from our escrow to cover our XXXX taxes. On XX/XX/XXXX this lender requested a total of {$13000.00} from old lender for 4 different loans to go towards escrow. Loan # 1 ( {$1400.00} ), Loan # 2 ( {$6700.00} ), Loan # 3 ( {$2000.00} ) and our loan ( XXXX ). On XX/XX/XXXX old lender wired that amount. On XX/XX/XXXX this lender requested a total of {$870.00} from old lender for XXXX different loans to go towards escrow. Loan # 1 ( {$190.00} ), Loan # 2 ( {$280.00} XXXX and our loan XXXX {$390.00} ). On XX/XX/XXXX old lender wired that amount. We want our money back, our mortgage payments readjusted to previous amount and for the late payment to be removed so it doesn't effect our credit or ability to remove PMI.

I requested a packet for a partial mortgage release from CMC XXXX I received the packet and submitted all required documents at one time on XXXX XXXX. The packet stated review would take XXXX business days. I called the company XX/XX/XXXX and they advised they had received all required documents and were reviewing them and that it was taking them a little longer than usual because the buyer lives in another state. I then tried to call again at the request of our title company, each time I call it starts out with the same thing..I do n't see where you have submitted a request I give them my information to the customer service rep again and they are able to locate where I submitted the packet. It has been over the 90 days and I ask is there anyway to get an update for the title company. The first XXXX calls they told me a supervisor would call me in XXXX hours. I never received a call or email. The next time they told me someone would contact me via phone on XXXX XXXX, I sat by the phone all day no call. Then I was assured I would receive a detmination on XXXX XXXX. When I called back they advised that I would hear something on XXXX XXXX, this was after she showed no record of me submitted records back in XXXX XXXX. She told me to try email for faster service. I told her I emailed in XXXX XXXX and it is XXXX and I have not gotten a response. She told me to send a letter, I have attempted that twice. I asked her if it usually takes XXXX months for them to respond to email requests and she stated yes. I said it is normal for a review to take XXXX of a year to complete and the consumer not hear anything or receive any updates. She stated Yes. I have attempted written letters, emails, phones calls, I feel like they are just giving me the run around. My contract with the buyer expires Monday XXXX XXXX, they want an update before we can extend it. I have tried since XXXX to get an update but can not get in touch with anyone thru calls, mail, or email. I do n't know what to do. The only option I seem to have is refinance with a different lender. This company bought my loan from a local bank and I have never had such horrible customer service. They are always late on my taxes and insurance. the insurance company calls me constantly telling me the mortgage company will not release funds from escrow, they lost my first payment that our local bank send them. It took them XXXX months to " find '' it. The had credited it under the wrong account due to a typing error on their end. Even though I sent my cancelled check, and the local bank send their check information CMC/XXXX could not find my payment. Once they did find it and they had it the entire time there was no apology, no call to tell me they updated my account, nothing. I always pay weeks before my payment is due, never been late, never had a late fee. I am a good customer I expect good customer service. I have saved all of my emails, the title company as confirmation of sending our packet and it being accepted. The title company was on the phone/conference call to customer service. Upon the recommendations of both my realtor and my mortgage broker, I submitted a request for the removal of my Mortgage Insurance ( PMI ) approximately 6 months following the closing date on my home. I verified the required LTV ratio ( XXXX % or less ) for removal of PMI via my online account with the mortgage company ( " if you have good payment history [ true ], you may request cancellation of your PMI on or after the date the principal balance of your loan reaches 80 % of the original value of the property '' ). When I requested, in writing, the removal of the mortgage insurance ( prior to the appraisal ), the letter I received from the lender specifically stated " For loans originated less than five years ago [ true ], but open for at least two years [ false ], the LTV must be at or below XXXX %. If your loan was originated less than two years ago [ true ], generally it wo n't be eligible for PMI termination unless you are the original borrower on the mortgage [ true ] and significant improvements have been made to the property resulting in an increase in property value [ true - approx {$35000.00} invested in improvements, primarily in a new kitchen ]. '' I found this unclear and bit contradictory - did I need XXXX % LTV or XXXX % LTV? So I called and spoke with a representative from the mortgage company who confirmed for me that the loan-to-mortgage ratio needed to be at or below XXXX percent, following an appraisal of my home, in order for the mortgage insurance to be removed. Based on this information, I submitted a payment of {$390.00} for the bank to send an appraiser of their own ; they would not allow me to hire an independent appraiser ( I specifically asked due to the obvious bias a bank-hired appraiser was likely to have ). The appraiser spent less than 5 minutes on my property, and her appraisal ( {$250000.00} = {$22000.00} more than the selling price ) did not seem to reflect the combination of increasing property values in the XXXX and specifically XXXX XXXX areas, along with the significant investments we had made in improving the home. Regardless, this new appraisal brought me to an LTV of about XXXX %, which based on the information I had, I understood would remove the monthly PMI payment I 'm required to make. Only at this point did I learn that, according to the bank, I needed to meet an LTV of 75 %. Thus, I paid {$390.00} for an appraisal based on false information, and achieved no results or savings from it, and according to the bank I am still required to pay a monthly PMI of between $ XXXX-XXXX. I think it 's important to note that I have a perfect payment history. I pushed back and the bank did not agree with me regarding the removal of the PMI. Then, today I received a refund check based on XXXX and XXXX XXXX fraudulently advertising savings available via a fee-for-service payment program that I joined to reduce my total interest payments over the long-term. This immediately reminded me of the questionable practices surrounding my PMI and appraisal, and I feel I need to now report what is likely another area in which XXXX/CMC Funding is defrauding its customers.

We are due a pro-rated refund on Mortgage Insurance that is no longer needed on our current mortgage. The mortgage company only has to ask for this refund from XXXX and it will be given to us. The amount owed is {$9400.00}, per XXXX at XXXX per email from XXXX on XXXX/XXXX/19. On XXXX XXXX, 2019, we took out a mortgage with XXXX XXXX XXXX company that required Mortgage Insurance. XXXX XXXX XXXX sold the loan to XXXX XXXX on XXXX/XXXX/19, who then sold the loan to CMC Funding and XXXX XXXX XXXX XXXX ( XXXX ) on XXXX/XXXX/19. On XX/XX/XXXX, we ( XXXX XXXX XXXX XXXX ) re-cast the loan putting a substantial amount of money down on the mortgage, therefore under the Homeowner 's Protection Act, we are no longer required to have Mortgage insurance. On XX/XX/XXXX we overnight mailed CMC the recast docs, along with the requested refund of the pro-rated mortgage insurance. On XXXX/XXXX/19, XXXX XXXX called CMC Funding to inquire about the status of the refund. She was told there was no record of any refund due her, but to call the Servicing company, XXXX, and see if they could help her. XXXX also did not have any record of any refund due. XXXX then called XXXX XXXX company, and they confirmed that she does have mortgage insurance, and, yes, was now due a refund if her loan had been re-cast, but that XXXX would have to request it, not the XXXX. The certificate of the policy with XXXX is # XXXX. XXXX and XXXX XXXX have since been on the phone almost daily or in email correspondance since XXXX/XXXX/19 with various supervisors at XXXX XXXX XXXX XXXX and all they get are the runaround, " It's being reviewed ... .No answers yet ... '' We have provided them with proof of our mortgage insurance policy. We have provided them with the name and email address of " XXXX at XXXX, '' who will confirm that they have a check ready to mail to end this situation. This is a cut and dry situation. The money the XXXX ' are owed is money they brought to their original closing date on XXXX/XXXX/19 to satisfy a requirement that is no longer needed. It is NOTmoney that belongs to CMC or XXXX. XXXX XXXX from the XXXX ' initial mortgage company ( XXXX XXXX ) has also been trying diligently to get CMC and XXXX to request the refund from XXXX XXXX, but she, too, has been getting the run around. This is causing financial hardship for the XXXX, and there seems to be no sign of a resolution. The various supervisors at XXXX that are not giving us answers are : XXXX XXXX, XXXX XXXX and XXXX. We have also spoken through the course of this ordeal with customer service reps : XXXX, XXXX, XXXX, and XXXX. Everytime we call the customer service number, we have to start over again with a new person. It's exasperating and exhausting. My wife and I have our mortgage with CMC funding ( XXXX ) after we refinanced over the summer. Our first payment was due in XXXX After we made the payment, I called the company in late XXXX to set up biweekly payments to be made. The representative I spoke with set up up for the incorrect amount which I realized when I received a paper copy about 8 days later. Start date was supposed to be on XX/XX/XXXX. I called again and set up the biweekly payments again with a new representative with the start date of XX/XX/XXXX. He told me that we would no longer have to make the monthly payments. I began receiving calls from the number listed above this past week but no voicemail was left. I finally searched the number after 2 calls in the same day ( XX/XX/XXXX ) and realized it was our lender. I called them back and the representative informed me that we had not made our XXXX payment yet. I informed him of our biweekly payment that we set up in early XXXX. He stated that the previous 2 representatives did not set that up correctly and would need to be cancelled. He then said if I would want to set up the biweekly payments I would need to prepay my mortgage 45 days out which would mean paying both of the XXXX and XXXX payments now ( which neither representative previous informed me of ). I asked him XXXX on a recorded line ) that there was supposed to be a debit on XX/XX/XXXX and he assured me it would not occur ( on my call today on XX/XX/XXXX the representative informed me that it needs to be done 3 days previous to the draft which the representative on XX/XX/XXXX did not state ). I checked my banking account this morning and it did occur. I just called them today and asked for a refund of my money and the representative said it would take up to 3 weeks for the check although they had debited my account previous to XXXX on XX/XX/XXXX. He stated I could use that payment as a credit to my account for the XXXX payment. I am unsure if they will actually do this or not though and will probably have to call again. I also asked to speak with a manager while we were on the phone and he would not do this and stated that one will " call me back. '' Todays representative also said I could pay my XXXX payment now over the phone ( but did not state that there is a {$12.00} fee associated with this that a previous representative informed me of ). When I spoke with a representative on XX/XX/XXXX I asked why they do not leave a voicemail and was informed that " anyone can listen to those so they do not want private information being intercepted. '' I do not have their number in my phone so I comes up as a unknown number. Personally I feel this is a predatory practice as the consumer does not know their mortgage company is attempting to contact them. With all my encounters with this company I have noticed several " predatory '' like practices that they are. In XXXX XXXX, my wife and I bought a house - the mortgage was set up with XXXX. Shortly after closing, Access National sold the mortgage to CMC Funding ( " CMC '' ), a wholly-owned subsidiary of Capital Markets Cooperative, LLC. We were directed to send the monthly loan payments to XXXX. We have had problems with XXXX servicing our mortgage. Specifically, we had XXXX problems when we attempted to make additional payments to reduce the remaining principal on the loan. On XXXX XXXX, XXXX I sent XXXX checks totaling {$40000.00} to pay down the principal. On XXXX XXXX, I noticed ( on the XXXX web site ) that checks had not been applied to our account nor had the checks cleared our bank accounts. I called XXXX 's customer support to inquire and was told I had sent the checks to the wrong address - even though it was the address listed on their web site and the same address that I had previously sent checks. Over the past week ( XXXX XXXX thru XXXX XXXX ), I have worked with XXXX to resolve the issue. XXXX 's president, XXXX XXXX was very responsive and I have no complaint regarding XXXX. I also attempted to contact CMC because to my understanding, my legal is agreement is with CMC, not XXXX. They were completely unresponsive. Their web site directed me to call a phone number for a person that covered the Midwest. I left a message on XXXX XXXX requesting a call back - no call back - and called again on XXXX XXXX - no answer. I attempted to contact CMC via an electronic form on their web site - the form does not work. I contacted their XXXX, XXXX XXXX, via LinkedIn and received no response. I called a phone number on their web site - not only was there no answer, there was no voicemail. I talked with my contact at XXXX and apparently they were unable to get a response from CMC. While CMC 's internet presence is what I would expect for a mortgage company, their lack of response makes me question whether they are a legitimate company. How can a company be in the mortgage business and yet be unreachable by phone or electronically? I have a lot of questions for CMC - first of all, why was my loan assigned to a loan servicing company in XX/XX/XXXX known to have terrible customer service under their previous leadership - and later found to be guilty of fraudulent business practices? I want to know what is going on with the " wrong address '' problem. Did CMC intentionally make it difficult for customers to pay down the principal with additional payments? I also want to know if CMC was involved in the Equity Accelerator scheme. Last, I want CMC to hear firsthand from me regarding the impact of these problems - the trouble that it has caused me. My legal agreement is with CMC and I hold them accountable for all of these problems and consequences.

I asked what the phone number was I could call XXXX back at to check on the status of my escrow. He would not provide a number. I asked to have XXXX XXXX call me back. He said she would call me back XXXX / XXXX / XXXX . XXXX / XXXX / XXXX No return phone call from XXXX XXXX . I called customer service and spoke to XXXX ID # XXXX . I asked for status on my ticket number. After being on a lengthy hold he returned saying he would expedite my claim to the tax department. I told him that I was informed that was done on XXXX / XXXX / XXXX but clearly it had not. After another lengthy hold XXXX advised that they would need to " analyze the escrow ''. He said this analysis would be done by XXXX XXXX and advised that I call back on XXXX XXXX . This is where I ended my efforts and am filing this complaint. I have no confidence in the return of my escrow money and am unable to pay other bills because they have held onto it for 5 months. CMC Funding and XXXX XXXX should be SHUT DOWN.

This is a follow-up to a complaint previously filed by me on XXXX XXXX , 2017 . As background, I had not received a paper statement of my monthly bill and I was getting worried that they would send it too late for me to make the XXXX XXXX payment on time. I did n't want to incur a late charge. I contacted customer service of XXXX XXXX because that was one of the logos printed on a prior mortgage bill ) and XXXX told me that CMC Funding was servicing my loan and XXXX could not help me. I called CMC Funding and they pointed me to their website ( I never received a welcome package or information of what the website for online payments was ). But then I could n't seem to login. Finally, after working with the customer service person for an hour, I was able to access my online account and I paid my mortgage for XXXX 2017 . Today I wanted to go online and check my escrow balance so I went to the CMC website. I clicked the top login button on the webpage and I was routed to a login page where I entered my information. But the webpage said that it did not recognize my account information so I called customer service back to report the online issue. When I spoke with the customer service representative, I was told to go back to the CMC website and click the login function on the BOTTOM of the webpage, as the login function on the TOP of the webpage routes to XXXX due to a website error. Both XXXX and CMC are subsidiaries of XXXX but they service different loans for the company. I find it concerning that CMC knows that there is a website functionality error on their website that is routing customers to the wrong loan servicing company and their current solution is to wait until customers call and direct them to use the bottom login. Before I 'd been told this information, I kept going to the top login function to try to access my account and on multiple occasions entered my social security number and other identifying information. It 's disconcerting to me that my information might have been sent to a loan servicing company that is n't associated with my mortgage on multiple occasions due to their website functionality problems. Moreover, CMC still has not addressed why I am no longer receiving paper statements. I ask that CFPB investigate XXXX and CMC to determine whether these companies are appropriately servicing loans and whether their negligence results in higher levels of loan defaults and late fees.

I have attempted to contact my servicing company 3 times with respect to a canceled auto debit that caused me to need to pay a {$10.00} fee to avoid a late charge. I suspect CMC Funding ( XXXX, XXXX ) has done this to many others as well. Below is the text of the message I have sent them without response. In addition to the problem described below, they collect escrow to pay property tax and insurance. I am now 6 months into them servicing my loan and my county ( XXXX, OH ) still has the old servicer as the tax mailing address. This means that my tax bill never get to this servicer and I will need to come out of pocket to pay property tax and the servicer will just continue to accrue my escrow payments. I informed CMC funding that the tax mailing address was still wrong several months ago and no correction has been made. Interestingly, they have a " consumer advocate '' whose website is not functional ( when clicking on links I get an Error XXXX ). Please intervene to correct the issues described. I would like the {$10.00} late fee applied to my principal balance, my entire escrow balance applied to my principal, canceling of further escrow payments without penalty ( I will manage my own property tax and insurance payments since this servicer is incapable of doing so ), and the extra payment I made in XX/XX/XXXX should also be wholly applied to principal as well. Thank you. Begin message sent to CMC 3 times to date : My autodraft originally scheduled for XXXX XXXX was canceled without my consent after I modified the autodraft to add some additional principal. The confirmation said this would take effect XXXX XXXX but gave no indication that the XXXX draft would be canceled. I had call with your customer service that confirmed no late fees would be assessed. I did n't realize the autodraft did n't post until XX/XX/XXXX at which time I scheduled a one time payment with a {$10.00} fee for the XXXX. During the process I inadvertently scheduled XXXX payments. Provided that the XX/XX/XXXX autodraft will draw as scheduled ( please DO NOT cancel this ), please re-cast the payment that posted XXXX XXXX to reflect the payment due XXXX XXXX ( as posted ) and credit the additional {$2600.00} paid on XXXX XXXX to principal instead of towards an early XX/XX/XXXX payment. Therefore my XXXX XXXX autodraft will make the XXXX XXXX payment. Please also refund the {$10.00} online payment fee and credit that towards my principal as well. Thank you.

On XX/XX/XXXX I closed on my house using XXXX XXXX as my mortgage company. I was told my first payment with them would be XX/XX/XXXX. When I had not heard from XXXX at the end of XXXX, I contacted agent ant XXXX and after a few days she emailed me that my loan had been sold to XXXX XXXX XXXX XXXX on XX/XX/XXXX. I tried to get in contact with the company but I did not have a loan # to access when I got in touch with them since I had never received anything in the mail. I followed up by accessing my account on line which also said payment due date was XX/XX/2018 but had no amount. On both XX/XX/XXXX and XXXX I accessed my account online where it still said amount due XX/XX/2018 but had an amount of {$0.00}. I made my payment of {$1500.00} on XX/XX/XXXX even though it said I did not owe anything. Today I received a collection call from XXXX XXXX XXXX saying that I was behind on my mortgage and that I had not paid XXXX mortgage payment. I told the rep that I had been in contact with their company and was told that I did not have a XXXX payment and I confirmed on the web site that the first payment was due XXXX XXXX but no amount was due so I paid what was on my closing papers. The rep advised me that I was suppose to make a payment but their company had misapplied the exact same amount {$1500.00} on XX/XX/XXXX so it showed that I had made a payment but it was actually someone else 's payment. I told the rep that on my first call, I was told my first payment was to be XX/XX/2018 and not that my next payment was on XX/XX/2018. As of today, I went back to my online account and it now says next payment due XX/XX/2018 amount {$1500.00}. I also shows a payment made of {$1500.00} on XX/XX/2018. I believe that I have made the payments that I was suppose to have made but now I am being asked to make another payment today XX/XX/18 and another one on XX/XX/18 totaling {$3000.00} which I don't have. I will have my regularly schedule payment reedy for XX/XX/18 but not the extra {$1500.00}. By this time, I will be outside the 60 days of protection from them reporting me to the credit bureau as well as accruing interest and late payment fees.

At this point, I have filed a claim with my Owner 's Title Insurance Police at XXXX XXXX, I have paid for a reinstatement quote to the servicer XXXX and I have complained to XXXX 's department of errors and omissions, as well as filing a complaint with the NC Commissioner of Banks about the original documents from this loan. The bottom line of this is : The Deed of Trust is not valid. It's missing dates, seals and signatures and the attorney for the trustee has filed several notices after the fact indicating they are registering a Corrective Notary Affidavit, and an additional satisfaction of the loan. However, they keep sending the home loan, not registered with XXXX, through the courts for foreclosure proceedings non-judicially. I can not refinance the home, sell the home or otherwise do anything with the title trail they have made. They ( the trustee ) are insistent they are correct that they have the right to sell the home and that all of the banks and lawyers and insurance folks are incorrect that my deed of trust is invalid. Aside from just paying a retainer to a lawyer, how do I find out who is correct that the deed of trust is valid according to XXXX XXXX 's loan requirements and state and federal law or not? On the last page, my signature is not present. The notary also forgot to date the acknowledgement or verification. My signature is undated and unsealed elsewhere in the document but not on the same page as the notary among other errors. What government agency can look at this and tell me what to do other than what I have done above to clear this up because the expense of getting a lawyer involved is something I am willing to do but I just reinstated this loan that had a balance of XXXX with a payment of XXXX. I still owe XXXX on the loan according to paperwork that could be correct. It's been lingering in foreclosure for years because of paperwork errors but I would like to know who can assist me with determining if there was a problem. Thanks in advance. I have been working with XXXX XXXX XXXX ( XXXX ) and XXXX to resolve an escrow amount that was not properly applied to my account. My loan servicing changed in XX/XX/2018. At that time, my previous provider ( XXXX ) had sent a payment to XXXX County for my property taxes in the amount of {$3100.00}. The amount was returned to XXXX from the county as no payment was due. When XXXX received the check, they forwarded the payment to XXXX but XXXX never applied the credit to my escrow account. I received a notice from XXXX that my escrow account was negative and that I owed more money in XXXX. I then called to inquire about where the {$3100.00} was and why it hadnt been applied to my account. I spoke with 2 different agents on separate occasions and neither followed up on the payment. On XX/XX/2018, I finally forced a conference call between the 2 companies. At that time, both companies agreed that the funds were never transferred from XXXX to XXXX and that XXXX would need to reimburse me for the escrow shortage. I then began to work with different agents from XXXX to try to get resolution and payment. I spoke with the company on XX/XX/XXXX and XX/XX/XXXX to try to get the payment refunded to me and neither time did the customer service representative follow through. In XXXX I called a third time and reached XXXX XXXX with XXXX. After 3 days of calling the company, XXXX informed me that XXXX did in fact receive payment and negotiated the check ( XXXX ) for {$84000.00} on XX/XX/XXXX. This check was sent to XXXX and the funds were for multiple clients accounts. She would not provide me with a copy of the cleared check as it contained other customer information. I then called XXXX to track down the item and spoke with XXXX, ( agent XXXX ) who told me that she would need to research the item and that the process could take until XXXX to refund the money. I feel as though these companies are not following through and taking care of their clients when they owe them thousands of dollars. I closed on my new property in XXXX of XXXX. Since that time, my loan has been transferred to a new servicer twice already. In a letter dated XXXX/XXXX/XXXX from XXXX, I was advised that my new servicer would be XXXX XXXX XXXX, effective XXXX/XXXX/XXXX. By the time I received this letter, I had already mailed my XXXX payment to XXXX. When it was time to mail my XXXX payment, I mailed it to the address that XXXX had provided me for XXXX XXXX Servicing since I still had not received any communication from this new servicer. My first communication from XXXX XXXX, c/o XXXX Loan Servicing was a mortgage statement dated XXXX/XXXX/XXXX, which also included a Notice of Servicing Transfer letter. This statement showed a total amount due of {$930.00} with a payment due date of XXXX/XXXX/XXXX. Two things : 1 ) My monthly mortgage payment is supposed to be {$460.00} and 2 ) I have not missed any payments, have not sent in less than owed, nor have I been even a day late. I asked them to explain why my statement showed a past due amount of {$470.00}, what the additional {$18.00} charge ( {$470.00} - {$460.00} ) was for, and also requested an itemized statement with the correct outstanding principal, escrow balance, et cetera. To this date, I have not received a written acknowledgement of my inquiry. I have, of course, received a statement for my XXXX payment. The payment is now the correct amount, but my escrow balance is wrong. In addition, I am concerned that they tried to charge me some late fee in the middle of a transfer of service.

As of my XX/XX/XXXX statement, I am under 80 % loan to value. I submitted a request via their online messaging system for PMI to be canceled, as there was nothing on their website anywhere explaining how to cancel PMI. Their online system requires a secure login and account to be set up, so it verifies my identity. However, they wouldn't do anything based on this request. Instead, the response told me that a request had to be submitted in writing via mail or fax. There was no form or template provided -- just that I had to include the account number. My partner and I wrote the request using the CFPB website information and an online template, and we never heard back. I sent another email message a couple of weeks ago via their electronic system and was told they would reply in writing. No information was provided. Another week has gone by without anything being received, and I just called in. They're now saying that I have to give them permission to do a BPO and pay {$140.00} to {$170.00} fee for them to do it. My loan ( and appraisal ) is less than two years old. When we bought the house, it also apprised for more than what we paid. This information could have been provided when I first asked about canceling PMI, and it wasn't. Even after verifying my identity twice, they also wouldn't let me authorize the BPO. They also claim they are allowed to require me to use their vendor and pay their fee as part of the cancelation process, but I didn't see anything like that on the CFPB website. I also asked if they would credit back the additional PMI payments being made from their failure to properly inform me of their process, and I was told they wouldn't. To me, this just feels like the mortgage company doesn't actually want to cancel the PMI and is dragging out the process. I would appreciate assistance from the CFPB with getting my mortgage company to actually cancel my PMI.

I closed my loan with XXXX XXXX and prior to my first payment, it was sold to XXXX XXXX XXXX XXXX to service the loan. I received notice from XXXX that my loan was being sold to XXXX XXXX who would maintain the servicing of the loan. I did n't receive the welcome package from XXXX XXXX until a few days before my due date. I then went to their website to try and register so that I could pay my mortgage on XXXX/XXXX/XXXX. The website kept saying they could not find my mortgage loan so I could not register and make a payment. I called the number listed on their website multiple times on XXXX/XXXX/XXXX - XXXX/XXXX/XXXX with no luck in getting in touch with someone at the Company. On XXXX/XXXX/XXXX, I sent a email to someone listed as a region manager who then reached out to help. He stated that my loan number was listed wrong on the paperwork ( they left off the first 3 digits on the letter ) and gave me the correct loan number. I was then able to register and make my payment but at a charge of approx. {$8.00} given it was a " expedited '' payment due to it being late. RESPA protects me from late charges and reporting me being late on a payment given my loan was sold prior to the first payment. I told the Company that I had no other choice but to make the payment online with them and the site gives me no other option to pay so I was forced to pay the " expedite '' charge. I ask them to refund that charge given it was not ethical to charge me to make my first payment with you and not provide other options at this time. The company stated they would try but that they normally do n't refund this because it was my fault I was late ( which is not true ). I work in the mortgage industry and with the largest mortgage servicers and this is the worst practice of mortgage servicing that I have ever seen. Please respond immediately with corrective action.

The mortgage service company has been doing my annual escrow analysis incorrectly for the past two years ( XX/XX/XXXX and XX/XX/XXXX ). They do the analysis in XX/XX/XXXX, a month before my county and city taxes are posted on my county 's website. As a result, their numbers ( and dates ) are incorrect, leading to incorrect shortages, which translate to higher monthly payments. XX/XX/XXXX, it took several months to resolve this. It is now happening again XX/XX/XXXX. I received my escrow analysis dated XX/XX/XXXX and have been trying to resolve for over two months now, and it is still not correct. I have provided copies of both my county and city taxes with correct amounts and due dates, and I have still not received a printed revised escrow analysis to prove that they have made the changes and correctly recomputed my escrow payments. As a result, the incorrect monthly amount was due XX/XX/XXXX ( today is XX/XX/XXXX ), and I was forced to make a payment to avoid late charges although the issue has not been resolved. For the past month, I have been working exclusively with XXXX XXXX, a customer service rep, who is trying to help resolve this. He informed me ( for the first time ), that I could also request that the shortage be spread over 24 months instead of 12, so I submitted a request to have that done as part of the escrow re-analysis. I am still waiting for both of these changes to be incorporated into a revised escrow analysis, in writing, that proves they are using the correct tax amounts and the correct due dates. This is the most challenging mortgage servicing company I have ever dealt with ( I have owned XXXX properties serviced by multiple companies in the past 20 years ), and I do n't have time to go through this every year as I have for these past two years. Mortgage Co. XXXX XXXX XXXX c/o XXXX Loan # XXXX on XX/XX/XXXX XXXX XXXX bought our loan from XXXX XXXX XXXX XXXX XXXX when they did the transfer they dropped one of the 3 borrowers names from the loan, they also changed the property address to our mailing address when the property address is completely different. We provided the note and deed of trust showing all three of our names on the loan as well as the correct property address and up until XX/XX/XXXX XXXX XXXX.had the right property address on the mortgage statement and then all the sudden on the XXXX statement CMC changed the property address to our mailing address which then caused them to say we are not insured when in fact we supplied the insurance binders for the property address in XX/XX/XXXX as well as XX/XX/XXXX but because internally they changed the property address to our mailing address they say we are not insured and now are charging us for their internal insurance binder at the cost of {$2200.00}. I have literally spoken to every supervisor int he insurance dept as well as the loan dept, I have conference calls as well throughout the 8 mos of dealing with this and everyone is gon na fix it but 8 mos later I am sitting on hold listening to them tell me they are gon na fix it .... We are at our wits end and do not have any other recourse but to diligently call them without fail every month trying to make them see that they did this mess not us ... we only get a run a round as we are now going on 8 mos of pure XXXX. I called CMC Funding XX/XX/2019 to get a payoff amount on my mortgage, first payment due XX/XX/2019 but sold my former home so I wanted to pay in full. Sent a certified check for the full amount on XX/XX/2019 knowing there would still be interest owed. Called XX/XX/2019 to find status since I received a letter saying I now owed two months of mortgage payment. Was told if a check for the shortfall was not received by XX/XX/2019 my original check would be returned. Immediately the doorbell rang, there was UPS with my original check, on the XXXX! I called CMC, spoke with XXXX who gave me an additional amount to pay. Left for the credit union right away, wire transferred the original amount of {$320000.00} plus an additional {$1900.00} in interest. On XX/XX/19 received notice of foreclosure. Called immediately, spoke with several people who claimed a shortfall letter had been sent ( I never received anything ) interest was still being charged, yes they had my wire transfer but it had not been applied since it was not the full amount. I asked how I was supposed to know this and they said a letter had been sent. We went around and around until finally I was given an additional amount to wire transfer to stop the money bleeding. A claim was supposed to be initiated, I did receive a check for {$160.00} for escrow (? ) but no additional explanation. I don't feel I should owe any interst after XX/XX/19. Customer service did nothing but give me the runaround, made it difficult to payoff the mortgage and I still don't think they have been accountable.

I applied for an equity credit line only to be declined because unbeknowns to me the mortgage company had placed a lien equal to 150 % of the loan on the property. I 've contacted the company, CMC Funding ( they use XXXX to service their loans ) regarding releasing the additional 50 %. After several emails and XXXX phone calls assuring me that they would be quickly getting back with me I have heard nothing from them. My request was pretty simple but they seem content ignoring me. If by chance I did sign something in the closing documents that allowed then to increase the lien on the proerty to 150 % of the loan value it was done in a very deceptive manner. None of the previous loans that I have had ever had anything like this and if something this restrictive was added to the loan documents it at a minimum should have to be made crystal clear to the applicant as part of the truth in lending. It appears to me that if I took action using the Kentucky Revised Status that they could consider me in default of the loan, which seems absurd but even my personal bank did n't understand the process and that is why I 've tried to deal with CMC/XXXX regarding this issue in a civil manner but apparently they do n't operate under the concept of real customer care. If I had known I would have either negociated it out of the terms of the loan or found a different mortgage company.

To Whom It May Concern ; XXXX was my previous loan service company. Today, I am being serviced by XXXX XXXX XXXX XXXX XXXX. The issue begins when XXXX sells mortgage to new company, XXXX XXXX. At the time ( XXXX,2017 ), I had made my regular monthly payments in addition to one large principal payment of {$78000.00}. The issue is that the new company, XXXX XXXX, never received these payments and all of the funds that were paid are currently " lost. '' I have been trying to resolve this issue with both companies for over 2 months and have not been able to get this fixed. I ask that you please review my case and help me with my problem. In addition, since the funding of accounts were not properly transferred, all recent payments that have been made have charged a higher interest and I would like for a new amortization schedule to be applied from a " true '' cost of funds. In other words, older loan ( XXXX ) was suppose to transfer funds into the new loan ( XXXX XXXX ), therefore my outstanding principal should have been established at {$310000.00} and not at the amount of {$390000.00} ... there is currently a discrepancy of {$81000.00} + additional interest charges that my account is being charged since the loan started at the higher amount {$390000.00} and I have already made a couple of payments to this amount. XXXX XXXX acquired my VA home loan from XXXX sometime in 2017. Due to their flawed business practices and poor accounting, they failed to reconcile my home insurance information and proper property address from XXXX. Consequently, they took out an unauthorized and unnecessary insurance policy on my home which already had insurance through XXXX. XXXX sent the insurance policy by fax numerous times, their automated fax system failed to reconcile my insurance policy as well. I eventually provided the insurance policy from XXXX through an online portal on the XXXX XXXX website, but they already had the policy open for at least a month, resulting in at charge to my account of over {$170.00}. XXXX XXXX and their collection company XXXX ( XXXX XXXX XXXX ) have been harassing me by phone and mail to pay this additional amount and I refuse, because the policy was unnecessary and I never authorized it. It's their policy, and they should pay for it. I shouldn't be punished because they have flawed business practices and poor account management. I never authorized them to purchase my loan from XXXX and I wish they never had as it's an incompetent company. Please step in and protect me as XXXX XXXX has been unwilling to pay for the mistakes they made and I shouldn't have to pay my hard earned money to a crooked company.

I refinanced my home in XXXX with XXXX XXXX. In a letter dated XX/XX/2019 I was notified that my loan servicing will be transferred to XXXX XXXX, XXXX. The paperwork was not clear and in reality only the primary mortgage had been sold and XXXX XXXX retained the 2nd mortgage. XXXX XXXX Loan # XXXX to XXXX XXXX , XXXX Loan # XXXX XXXX XXXX Loan # XXXX, in reality stayed with XXXX XXXX. Without this knowledge, I made both payments to CMC/XXXX through my bank bill pay on XX/XX/XXXX. I made 2 separate payments to CMC, but I used the appropriate XXXX XXXX account number on each. I only knew there was a problem when XXXX called to collect on the past due payment. At that time my account had not been " on-boarded '' by CMC so they could not help me. Account was finally set up 2-3 weeks later. After multiple hours of research, CMC posted the erroneous payment of {$1000.00} to additional principle. I applied for a refund and I received a message that the check was sent to my address of record on XX/XX/XXXX but I have not received. Many call attempts but after being on hold, they hang up and state they are in an all employee meeting and disconnect the call on multiple occasions. At least 6 times in last 3 days. Maybe 12 times before that. Can't be in all employee meetings that much.

CMC Loan Servicing gave me loan numbers for two of my mortgages with them when they bought my loans. I then set up automatic payments using those loan numbers. They then switched the loan numbers without giving me any notice of the change. So, my automatic payments were going to the old loan numbers. They then turned around and said I have not paid for two months. I called in and explained what happened. They assured me that they would take care of it, but did not. Then I had my bank call them and showed them proof of payments. They said they would fix it, they did not. Now I just received a Notice to Foreclose on those 2 properties. I called them back. No one returns my calls. This is by far the most horrible company I have ever done business with. My next call is to a lawyer. The one after that to all the regulatory agencies I can find to let them know what they are doing. For XXXX XXXX XXXX. XXXX, MS , the first house, the old loan number is XXXX. The new loan number is XXXX. For XXXX XXXX XXXX XXXX, MS the old loan number is XXXX. The new loan number is XXXX. The payments that according to them I did not pay are for XXXX and XXXX, but I did pay them. They have also negatively impacted my credit score because of this.

We purchased a home in XX/XX/2019 and took out a mortgage. On XX/XX/XXXX, we sold our previous home and received payment for it. On XX/XX/XXXX we tried to pay off our mortgage. Our original mortgage was through XXXX XXXX XXXX in XXXX, and they quickly transferred it to CMC Funding. We received a letter dated XX/XX/2019, telling us of the transfer and to send all payments after XX/XX/2019 to CMC Funding. I called CMC Funding on XX/XX/XXXX and each business day since then asking for a payoff so we would quit accruing interest. Im told each day that it hasnt been fully loaded into the system and to call back in a few days. This has been going on for a full three weeks with no satisfaction. I have been told conflicting information and have asked to talk to a supervisor several times. I am told no one is available ( even though they were able to ask their supervisor questions ) and Im told a supervisor will call back within 24 hours and I have never received a call back. One employee told me they had XXXX loans to upload and that they were all supposed to be uploaded by Friday XX/XX/XXXX. I believe they could accommodate this request but dont want to do it yet because they earn interest every day until it is paid off.

My loan has been sold about 4 times since I first opened it in XX/XX/XXXX. The current company, XXXX XXXX, has claimed I have no hazard insurance, and they threatened to make me pay for additional insurance. This information was transferred when the loan was sold. I also had my insurance company fax the information. Today, XX/XX/XXXX, I got a letter, dated XX/XX/XXXX, that this was my second and final notice regarding hazard insurance. They again said I do not have any. I called and ask why they were sending this. They said they never got any information from the insurance company. I then said the information was faxed. They then said they did get information, but it wasn't sufficient. The obviously lied initially and are now claiming there is not enough information. They told me to send the information again. I told them I would, but asked how I would know it was sufficient this time. They said they wouldn't. I would have to call or ultimately pay the additional fee. They are making it impossible and seems like a scam, to say the least. I don't know what to do. I plan to get a lawyer involved, as this seems highly illegal. Also note : in my 2 months with this company, this is not my first issue.

XXXX XXXX 2015 : received XXXX letters from CMC ( conveniently backdated XX/XX/XXXX and XX/XX/XXXX ), the XXXX bank stating that the XXXX XXXX 2015 payment should be made to CMC. This was my first letter from CMC, received 3 days before the alleged due date. I called CMC, spoke with XXXX, agent number XXXX, who said the issue will have to be sent to a research specialist, expected return call time XXXX XXXX. I was told I could rely on the " grace period '' under RESPA in the meantime, while they determined where the payment should be made. The gentleman I spoke with said he could not give me a payoff amount, said a supervisor would email me an amount within 2 hours. At XXXX PM I hadn't received a email so I called again and again was told they could not give me a payoff amount. I said, you have asked me a lot of personal information ( SS #, loan #, name, address ) and still you can't give me a payoff amount? I asked to speak to a supervisor and was told that none are in the building?? I said there isn't one supervisor available in the entire building available for me to speak to and was told no. I don't understand how this company can do business like this and why I just can not be given my total amount of the mortgage so I can pay it off. This to me says something is wrong and why are they hiding my information from me? My mortgage company, since the time of my closing in XX/XX/XXXX, has been charging me monthly in tax escrow what I should be paying quarterly. I.E. my newest bill shows I owe {$580.00} as part of my MONTHLY payment. My tax payments are actually {$580.00} owed EVERY THREE MONTHS. The condo I bought is in a new development of four units, and the parcel does not officially split into 4 parcels until XX/XX/XXXX. This is why the City tax collector sent us a letter stating what each unit individually owes since we only have one tax ID. I have been in contact with them multiple times since XX/XX/XXXX ( 10 to be exact ), when I first received a letter from my city 's tax assessor. Still nothing has been done to rectify the situation. They did do an escrow analysis after my 9th call and multiple previous requests that allegedly got lost in their system. My payments went up, based on the tax increase ( my city tax payment per the city 's assessor, increased from {$430.00} to {$530.00} ), but they have failed to correct my monthly payments. Currently I am paying {$6400.00} per year when I should only be paying {$2100.00} annually.

Our home insurance company raised our premium because they said we were underinsured. (The notice was lost because our mortgage had been sold 3 times in one year). However, we contacted XXXX XXXX as soon as we received a cancellation notice from our insurance company that our policy was set to cancel for lack of payment to let them know they needed to pay the additional premium. (We called XXXX XXXX in XXXX to let them know the policy would be cancelling in XXXX) There was a three way call between the insurance agent, XXXX XXXX, and my husband to get this issue resolved. Everyone knew what was going on and my husband was assured the premium would be paid. Everyone had each other's direct contact number and said they would contact my husband if there were any problems. It seems that XXXX XXXX did not pay the updated premium, nor did they reach out to the insurance agent or my husband. Now, we have had a lapse in insurance coverage and lost our policy. We had to pay a penalty for the lapse, have increased insurance premiums on a new plan, and have to pay $XXXX for XXXX XXXX's forced hazard insurance also.

Attached is a copy of the payment webpage of my mortgage that is serviced by CMC Funding. The mortgage payment is due on the first of each month and I have a grace period of 16 days to make my payment without incurring any additional charges for making payment anytime during the grace period. The servicer, however, is charging a fee for making payment during the grace period. According to the schedule of fees on the attachment, the servicer charges {$5.00} if payment is made 5-9 days after the due date, {$10.00} if payment is made 10-15 days after the due date, and {$10.00} if payment is made 16 days or more after the due date. These charges starting 5 days after the due date essentially add up to a fee for making payment during the grace period. Is this a legal practice and in compliance with CFPB rules associated with loan servicing? I did not choose this servicer. My loan was sold to CMC Funding. It appears that this practice of charging mortgagors for making payments anytime within the first 16 days would violate the grace period stipulated in the loan documents. Please advise.

I am having difficulty getting CMC Funding to apply my payments properly. I always overpay my monthly bill to reduce the principle faster, and therefore pay less interest over the term of the note. I will attach to the complaint proof of my payments and the monthly statements from CMC Funding. I will also attach a spreadsheet showing each payment and how much should have been applied to principle from each. If you examine the statements from CMC funding you will see that my they put money into something called suspense. And, if they are applying my payment properly, how could my payment due XX/XX/XXXX be negative {$500.00}? I have called them repeatedly about this, and they claim they will correct it. I have asked for, and spoken to, a supervisor at CMC Funding, and was told every time they would correct the error. And then I get the next statement and it is still wrong. I closed on a refinance transaction in XX/XX/XXXX with Guaranteed Rate I paid my first payment to Guaranteed Rate, the institution that originated my loan. Subsequently my loan was sold to CMC Funding The second servicer, CMC Funding, stated they did not receive the payment from the original servicer, Guaranteed Rate. I provide documentation that I paid the payment from my acct. The documentation was provided to the second servicer, CMC Funding on XX/XX/XXXX & XX/XX/XXXX. On XX/XX/XXXX I was told the issue was not resolved by the new servicer and the " ticket '' had been closed. At this time I provided the information again and now they are reporting as 30 days past due for my acct. This month is will be 60 day past due. This is negatively impacting my credit rating and they are not assisting in resolving the issue. I am told by CMC Funding to wait and they will contact me when they resolve the issue. I am not at all confident this issue will be resolved timely given the way the situation has been handled so far.

We refinanced with XXXX XXXX, and our loan was sold off to XXXX XXXX XXXX. Our first few payment were processed normally, but our XXXX payment has been misplaced or some such XXXX. we insisted the payment was made, and finally were told the account number had been changed from the account we were paying to through XXXX XXXX. They said that we were responsible for the payment since they had to history of the payment being received. We provided our bank statement showing the payment had been paid on XX/XX/19, and we provided a proof of payment generated by XXXX XXXX. They are saying it will be applied to XXXX but could take 3 to 4 weeks! My main concern is IF this sorted out, are they going to adjust my interest accordingly, or am I going to end up paying more interest than I should, and are they going to correct the credit reporting to show the payment was made and not missed. The loan officer, XXXX XXXX from XXXX XXXX told us to file the complaint with CFPB to make sure everything gets sorted out properly.

I recently refinanced through XXXX XXXX in XX/XX/XXXX and my first payment is due in XXXX XXXX 2016 according to the note. However i received a letter dated XXXX XXXX 2016 that the loan was sold to CMC funding C/O XXXX XXXX XXXX. XXXX XXXX acquired my loan in XXXX and in XXXX I was notified on XXXX XXXX of a new servicing agent, CMC Funding/XXXX XXXX XXXX. Additional letters from CMS/XXXX showed inaccurate accounting information showing that I owe for XXXX and XX/XX/2019. I called CMC/XXXX on XX/XX/XXXX and informed them that I previously made payment to the previous servicer, XXXX. Since XX/XX/XXXX, I have called every week and mailed on XX/XX/XXXX and XXXX CMC/XXXX a certified letter which they received on XX/XX/XXXX and XX/XX/XXXX. I also emailed them proof of payment from a statement downloaded from my previous servicer, XXXX. I was recently mailed a letter of intent to foreclose and continue getting calls from CMC to collect payment. CMC Funding has not been able to make accurate nor timely personal property taxes, even though there has been adequate funds in my escrow account for this purpose. My taxes are to be paid in XXXX and XXXX. The XXXX payment was in arrears until XXXX of 2015. CMC Funding assured me that this would not occur again, and that they would work with me. I received a delinquent tax notification from my county that the XX/XX/XXXX payment was not made. In XX/XX/XXXX I sought legal counsel. With his help the XX/XX/XXXX issue was resolved. CMC Funding has been in touch with my attorney, letting him know that they were working with me directly regarding the XX/XX/XXXX payment. In fact, I have had no direct contact from CMC Funding, until I notified them on XXXX XXXX 2015 that the tax was in arrears. I went ahead and paid my county taxes with penalty and interest to the amount of {$800.00}.

We received notice that our mortgage servicing company ( CMC Funding / XXXX XXXX XXXX ) would be changing as of XX/XX/XXXX I called on XX/XX/XXXX to set up payments, was told that the loan was in process and we could not set up our account until the XXXX I called again on XX/XX/XXXX, and was told it was still in process. I have had a mortgage on my current house and has always been on automatic draft out of my checking account. My mortgage company paid my county TAX bill late ( -- even after several phone calls to them advising them I was receiving late notices ) -This caused my county ( XXXX ) to put a tax lien on my credit report and now I cant get them to correct it. This has hurt my credit rating and I have dropped from an Excellent rating to a Good rating. I have made many documented phone calls and emails to CMC Funding/XXXX will not do anything to correct the situation. I made my usual payment for my mortgage of {$2300.00} on XX/XX/XXXX to CMC Funding and I was not told that it went to " unapplied funds '' because the escrow amount changed. Since then I have called twice and was reassured that this was resolved and not to worry - that I am to pay the shortage amount of {$96.00} which I did on XX/XX/XXXX and there will be no issues. Today, I get another late notice indicating that the account is overdue. I can't get through their automated phone system because it hangs up on me in the middle of the call and its virtually impossible to contact a live representative. This is beyond frustrating as I don't want my credit to be affected for an error made by the servicer. Their website also is not user friendly and does not send out emails when you make transactions.

I called in and inquired and they said they were behind with mail and processing due to XXXX holiday. On XX/XX/2019 my mortgage was transferred from XXXX XXXX XXXX to CMC Funding. XXXX XXXX XXXX transferred to CMC {$2100.00} Escrow balance. The loan principal balance was {$220000.00}, reduced by the additional principal of {$150.00} and from 2 mortgage payments. However, when I received my statement from CMC Funding the escrow amount was incorrect. The statement showed that my escrow acct is {$1200.00}. XXXX however XXXX XXXX transferred over XXXX. My property tax was lowered by XXXX County due to the camp fire. I have an escrow account with my mortgage company which I did not pick, my loan was sold. I have been contacting CMC Funding since XX/XX/2019. Today is XX/XX/19 and they still can not change or fix my escrow account. XXXX County has sent me XXXX check because the mortgage company continues to over pay and will not change my monthly payment amount. In total frustration on XX/XX/19 I asked them to stop paying my property tax all together. As of XX/XX/19 they still can not do that and every time I ask for a supervisor I am put on hold and then hung up on. I believe that what they are doing is not only bad customer service, but illegal.

Our mortgage servicer, XXXX XXXX XXXX XXXX, reported a delinquent payment to a third party by means of a verification of mortgage. The payment in question falls within a 60-day RESPA period that occurred during a transfer of mortgage loan servicing earlier this year. The mortgage servicer acknowledges this but has declined to modify the verification of mortgage or provide a written explanation to the third party. This appears to be a violation of Reg X, 12 CFR 1024.33 ( c ) ( 1 ). which states that a during the 60-day RESPA period following the transfer of servicing of a mortgage loan, " a payment may not be treated as late for any purpose ''.

I thought I had properly set up my loan on monthly auto draft through the online website. I never received a phone call letting me know that my mortgage payment was late. I happened to check the website on XX/XX/XXXX and noticed that my loan was now over 30 days late. I immediately made the XX/XX/XXXX and XX/XX/XXXX payments. As I was under the assumption that the loan was set up on auto draft. Also, had I been notified before the 30 days was past, I would have made the payment on time. Customer service likes to argue but is not really good at what they are doing. The monthly escrow withheld amount is too high and over {$600.00} higher than it should be. Its cushion is 4 month and it is against the law. Its estimation is based on wrong tax rate assumption. Servicing rights to my mortgage were transferred before my first payment. There was no notice of transfer of servicing rights given to me by the original company ( XXXX XXXX ) or the new company ( CMC Funding Inc ). CMC Funding XXXX # XXXX purchased our mortgage in XXXX of 2016. Since then we have issue after issue with our statements showing the wrong amounts, payments not being debited to our account in a timely manner, warnings that our payment is more than 30 days past due. I closed on a Home Loan in XX/XX/2019 with XXXX XXXX XXXX and setup my auto pay with their loan service Department. I always do auto pay. I had even setup and additional payment of {$1000.00} on top of my monthly payment. However, the bank apparently sold my loan to another service provider.
