XXXX XX/XX/XXXX we signed up for XXXX in our home for services. After about a year of having the service we requested to end the services with XXXX. We were informed by XXXX that according to their contract if we ended services early we would still be required to pay for the entire contract even if we no longer used the products. They also informed us that we were outside of ability to cancel the contract which was 30 days after signing the contract. That didnt allow us to We informed them that we would not pay for the entire service if were not using it. They reached back out to us and stated that we could pay a lower rate for services but would need to sign a new contract for 2 years. We informed them that we wanted out of their contract however they refused to let us out. Now we are in XXXX and received a letter from XXXX XXXX XXXX dated XX/XX/XXXX requested a payment for debt and a phone call from XXXX XXXX from CLM ( Capital Link Management ) stating that I owed debt to them. He reported following on the voicemail on XX/XX/XXXX at XXXX XXXX : " Hi this message is intended for XXXX XXXX, my name is XXXX XXXX and I'm with the legal division here at CLM and I'm just trying to get a legal notice out to you XXXX and its going to be in regards to a petition of civil judgement as well as garnishment these issues are both currently pending issue at the moment. So its imperative that you seek either yourself or a legal representative attorney on your behalf so that I can help you avoid the claims from being filed. I just need a return phone call from you immediately its a time sensitive matter.. the recorded action could be taken immediately. If you do wish to resolve this on your own terms. With all this being said the number in whcih you can reach me at is going to be area code XXXX thank you ''. I called back the agency following the voicemail and requested that they cease all phone calls to myself and my family. They are to immediately only send me items in writing to my home and the address that they have on file. On XX/XX/XXXX at XXXX XXXX. He called back again and left a voicemail stating the following : " XXXX XXXX its XXXX XXXX with the legal division here at CLM you have had..you have had notices sent out to your home address over the last couple of years since the charge off date, umm theyve all went unreplied to and unnoticed so I do need a callback from you to discuss this matter over the telephone umm my number to give me a call back is XXXX. '' I called back to XXXX XXXX and informed him of the FDCPA laws and the request that no phone calls be made to me. He stated that he needed to verify who I was before he could put in the request. He also stated that his company was a mediator for the law office of XXXX XXXX Solutions. When questioning him if he was an attorney he refused to answer. I then asked him if he was stating that XXXX XXXX XXXX was a law firm in which he stated yes and that garnishement would follow. He then reports that there were many individuals who were seeking help from them and if I didnt want to work with them they would send it back to their law office and sue me and begin the process for garnishement. I informed him to send it back to them. Following this phone call I called XXXX to ask about these practices. XXXX informed me that they sold the debt to XXXX XXXX XXXX and that they were unable to speak about the issues. There are now two debt collections calling me and my family in reference to XXXX and their illegal contract practices. The letter from XXXX XXXX XXXX also does not list that I can get a verificaion of debt or any other dispute regarding the debt.

NOTE : On the next page, I will supply the last 4 digits of my husband 's social security number because the debt is his, NOT mine. They are calling & texting the WRONG PERSON! This is my husband 's debt, that he took on independent from me, without my knowledge or consent. I responded to their text messages informing them that they were contacting the wrong person at the wrong number. I gave them his phone number, & yet they continue to harass me. I have been receiving repeated phone calls & text messages from Capital Link Management or Capital Management. I did not answer the calls because I did not have any business with the company & didn't recognize the name. Then the text messages started on XX/XX/2023. I don't even know how they obtained my cellphone #, because it's independent from my husband 's. Text Messages : XX/XX/XXXX- they offered a settlement through text message and asked him to reach out to XXXX XXXX. XX/XX/XXXX- another text message stating that XXXX XXXX needed a statement on my husband 's behalf. I responded that they had the wrong number & supplied his phone #. XX/XX/XXXX- another text message stating that XXXX XXXX needed a statement. I again responded telling them they had the wrong person & number & supplied the correct number. I also told them that I wasn't on any account associated with his debt & was not responsible for it. I asked them to please confirm receipt of my text message & received no response. I stated that if they were capable of sending text messages, they were most certainly capable of reading them. XX/XX/XXXX - yet another debt collection text message. XX/XX/XXXX- another debt collection text message. I replied in anger, telling them that they were harassing me & I was going to report them. Calls : XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ( twice ), XX/XX/XXXX, XX/XX/XXXX. There may be other calls & text messages that I overlooked, as around the same time I was receiving calls without caller ID. This is a violation of FDCPA ( b ) Communication with third parties Except as provided in section 1692b of this title, without the prior consent of the consumer given directly to the debt collector, or the express permission of a court of competent jurisdiction, or as reasonably necessary to effectuate a postjudgment judicial remedy, a debt collector may not communicate, in connection with the collection of any debt, with any person other than the consumer, his attorney, a consumer reporting agency if otherwise permitted by law, the creditor, the attorney of the creditor, or the attorney of the debt collector.

A company called " Capital Link Management '' began texting me on XX/XX/XXXX from the number ( XXXX ) XXXX. The message reads : " [ NICKNAME & MAIDEN NAME ] your account has recently been sent to collections. Due to Covid-19, we understand that this is a difficult time and we are here to help. We have new options and programs to assist you in resolving this matter. Please call to take advantage of this offer XXXX. '' This sounded like scam. Since they were using a nickname and my maiden name that I do not use when doing any business and knowing that I always pay my bills on time, I thought nothing of it. I then received a similar text on XX/XX/XXXX. It read " [ NICKNAME & MAIDEN NAME ] This is a message in regards to a settlement offer on your account. We have some Options to help during these tough times. Please call us at XXXX. '' I then started received more texts referencing offers to settle debts with " XXXX XXXX XXXX XXXX. '' Sometimes two copies of the same message were sent on the same day. Since I hadn't done business with this company, I still ignored the messages as they seemed like a phishing scam. On XX/XX/XXXX I responded " Please stop texting me. STOP '' and then received an automatic reply from Capital Link Management that I had opted out of their texting service and will no longer receive messages. This was the first time their company name was mentioned. I started receiving daily calls from Capital Link Management at the beginning of XXXX from XXXX. They would leave messages saying various things like " We are trying to find the location of [ NICKNAME MAIDEN NAME ]. '' and " We are debt collector trying to collect a debt from you. '' I also received a strange voicemail from Capital Link Management saying my bank rejected a payment that I had scheduled with them ... which of course, I never did as I have been ignoring the calls. They also referenced the " XXXX XXXX XXXX XXXX '' company was negatively reporting on my credit report, which isn't true either. I blocked the number and are still receiving daily voicemails from this company. So in additional to harassment, I am being called about a debt that I do not owe.

I received a call with Voice mail from XXXX on XX/XX/2020 saying that the compay had a petition of wage garnishment/judgement with my name and social attached to it. So i return the call and explained the debt had been paid. And asked for reference of the company name and if they were the creditor. He informed me they were CLM, capital link management and were a mediation company and not the debt collector. The debt collector was actually XXXX XXXX. The representative stated he didnt have that in his system and i could email bank debit details via email to show my repayemts. I did decline as im not at all comfortable sending that type of personal information via email. I asked to be sent documentation via mail and they refused saying they could only send an email. He then put his supervisor on the phone and again i asked for documentation and he repeated the same that they could only send email and why hadn't i previously responded. He also stated that 95 % of the time there are no errors and its not normal that the debt would be paid and they not have that info. I told him i just received the call and that when it referred to garnishments i contacted them back immediately. I have no issues dealing with debt or owed funds but for them to mention garnishments and or judgements without any prior notification of court and or subpoena is ludicrous. And they are not the creditor to threaten such action but only a mediation company at that to make that threat is simply outrageous. I shouldnt be threatened of garnishments to scare me as a consumer to payment. The supervisor said they dont do regular paper mail because of turn around time and proceeded to send me a letter of discussion of agreements in which our conversation we agreed to no such payment. I only requested documents proving and or outlining the debt. The email was a letter stating i agreed to pay when i did not. What profesional company that is debt collection and or mediation does not send official mail?

This phone number has been repeatedly calling me and my family. On XX/XX/ a vague voicemail, only identifying a XXXX as caller was left for me using my maiden name ( which has been changed for years ). A search of the phone number revealed potential scam- similar reports of a XXXX using a maiden name in regards to an incorrect debt. Today, XXXX, I answered. XXXX was argumentative and aggressive. I repeatedly voiced wanting to know who he was collecting for- to verify if it was a scam or not. XXXX became upset at my indication of a scam and continued to argue, wanting me to verify my identity. He continued to say that if I searched his number, the company he was calling for- Capital Link would be listed. When the XXXX number is searched, it does not show publicly as affiliated with Capital Link. At one point, in a threatening tone, XXXX argued that he had my full social and DOB. During the entire confrontation, he adamantly refused to identify who the debt was from. I have never received in writing an indication of a medical debt, nor has this XXXX from Capital Link ever informed me of the information I have right to- the identity of the original debt. I have no collection reports on any of my credit reports, and am currently up to date with nothing owed to any known medical bills. XXXX continued to argue, remain vague, and then disconnected my call when I requested to speak to a XXXX as his attitude was completely inappropriate. I have told him to stop contacting me and my associates as it is harassing at this point.

My daughter contacted me saying that a debt collector contacted her and my ex-wife, after they have never tried to reach out to me. The collection agent gave them detailed information about my debt and full story behind it, as well as names of parties involved, amounts owed as well as dates and other details. I contacted the company XXXX Capital Link Management LLC ) and spoke to an agent who was very unprofessional right from the start making threats of arrest and lawsuits. I recorded the conversation where he also threatened me saying he has access to my social media and will reach out to family and friends. I kept asking if it was legal for him to give out my information and details of my debt to a third party and he insisted that it is legal to do whatever it takes for them to collect. A second agent also said that my daughter claimed she was my employee and it was legal for them to give out the detailed information of my debt. My debt involved a check that was given to me by a client for services provided. I cashed the check at a check cashing business and that check later came back as insufficient funds. They are unable to collect from the issuer so they are coming after me. Capital Link Management llc is acting like they are attorneys and police making threats and acting unprofessional. They have terrible reviews on XXXX and will do anything to collect even if it involves breaking the law and regulations

On XX/XX/2022 at XXXX ( PST ) Capital Link Management employee XXXX XXXX executed improper conduct by contacting my wife, a person who has XXXX debt belonging to this company, using work related tools/software/program to locate, use, and share her non-publicly listed phone number for personal reasons. XXXX XXXX also shared her unlisted phone number with a relative. XXXX XXXX contacted her via his work phone ( XXXX ) twice and via cell phone. My wife was contacted not only by XXXX XXXX but also the man he extended her unlisted phone number to on the same day. This practice is improper use of a debt collector 's software and hardware to locate a person who is not affiliated with or have a debt related to Capital Link. This is a gross and extreme invasion of privacy that caused unnecessary emotional distress from happening to my wife ( and possibly others ) again. I have contacted the compliance office at Capital Management and was told that this was not a legal or policy violation. I have attached email chain between myself and XXXX XXXX. I disagree with this assessment and believe they are trying to deny this issue was a legal/policy/regulator violation. I contacted CFPB and confirmed this is a violation which should be submitted. I am not asking for action or compensation other than the acknowledgment that this is not an acceptable or legal use of company assets and that it will not happen again.

i received a call for my husband company states capital link management. said that I have a past due amount which was not covered by my deductible for my husband in 2017 and it hit collection in XXXX of XXXX they wanted XXXX said that in 30 days it will hit my credit report. i said i have never received an invoice, she said we sent it to you. i said well please send me a statement. they said they would email it to me. they emailed it said nothing more than original creditor which i do not know, reference number and creditor acct number. i called and said i needed a statement of what the payment was for ie who was it from and what was the date of service. they said we sent it to you. I said this is from 2017 i hope you understand that I am not going to pay it without researching. they said we are a collection agency and we don't have that information you can pay now or it will go onto your credit and you will owe XXXX. I said, maam i will pay it, I just want to research it. do i call you back, she said i was rude and if i didn't pay now, they would just send it to be on our credit report. How am i supposed to know if this is real or not? when i called the company, they just said hello... i said who is this and she said capital management... she knew my social number, address my husbands social... email was " XXXX XXXX '' XXXX of who sent my statement to me.

I received multiple texts messages from different numbers starting with XXXX and each of them stated the following : Hello this is our ( first, second, final, etc ) attempt to locate XXXX XXXX XXXX If we do not hear from you or your legal represenative before the end of business, this will be marked as a direct refusal. Please call XXXX, at XXXX XXXX XXXX XXXX using file number XXXX, Thank you. I responded to each text asking who the company was and what it was in reference to but there was never a response given. I called the number and was hung up on before even given the opportunity to give any information. I simply stated that I kept receiving text messages telling me to call the number but I wanted to know what it was in reference to. They did not ask my phone number, name, or any information. They said- we have your number and we will delete it and then after a minute or so they hung up. I could hear talking in the background but nothing else. If a company is going to text these types of messages out, they should be required to respond the same, especially if they are demanding a response. No identifying information was ever given and no one ever stated they were a debt collector. When I looked the number up listed in the body of the text and it seems to be linked to Capital Link Management- which is a debt collector.

I was contacted at XXXX to theXX/XX/2020, I did not answer because I get a lot of spam calls, in the voicemail a Mr. XXXX XXXX from Capital Link Management company, a third party debt collector. First off I feel that the information he included in the voicemail was inappropriate, my first and last name, city , county, state, full birth date, and last 4 of my ssn. My first point is until today they didn't have confirmation that the phone number they called me on was mine or that I was the only one with access to it, secondly if I had changed my number than another individual would have enough information to steal my identity. when I called him back he informed me that I was being sued by their client XXXX XXXX XXXX and that a judgement in mediation had already been made on my case. I owed {$410.00} but could settle today for {$280.00}. He was supposed to email me for an electronic signature, which I have yet to receive, also the agreed amount of {$280.00} could only be paid in full, there wasn't any mention of a service fee on the payment, which came out to {$14.00}. The account number for this is XXXX and the confirmation number for the settlement is XXXX. In the end I feel that they have abused both my personal information and proper tactics on debt collection practices. Thank you XXXX XXXX

On XX/XX/2020 I was contacted by courier trying deliver a legal notice. They would not give me any information but stated I had to be home to accept notice of a debt that was not mine. They said if I wasn't it would be counted against me. They would not give me any information other than the debt was for my brother-in-law who my family is estranged from for over 7 years. I asked how they got my info any they would not tell me anything other than they had my info and would continue to contact me. They also had part of my social security number, which I believe was searched unethically as I am not a client of theirs and do not have any debt with them. She gave me the information of the agency employing her- Capital Link Management LLC. When I called the number to inquire as to why I was being involved they said that my brother-in-law owed a debt and that if I want to stop being contacted about the matter that I should tell him to handle the debt. They said they have been sent me many notices bother written and over the phone ( I have not had any contact with them until today. ) They said they would not stop contacting me and would be sending more notices and calling. After speaking with my mother and father in-law they are contacting them and using the same harassment techniques.

Capital Link Management has been contacting my daughter and husband on their cell phones, one of which is a employer-provided mobile phone. They leave multiple voicemails stating they are collecting a debt for " my first and last name '' with a threatening tone, but probably being careful with the words they use. They have sent my daughter texts. When she replies " STOP '' to " opt-out '', seconds later she'll receive another text from a different number. It is always a male that leaves voice messages and one actually spoke with my husband. One of the voicemails states his name is XXXX. I DO NOT owe any past due debt. My credit is excellent ( score averages around 800 ) and any lines of credit I have are in excellent standing. My personal credentials have been in various breaches over the years, including XXXX, XXXX, etc. As a result, I have been a victim of identity theft. " Someone '' submitted a XXXX tax return with my SSN and personal data. Thankfully the IRS have security protocols in place. Unfortunately, I can never file my federal tax returns with my SSN. I must use a TAX ID with PIN. I would like Capital Link Management to cease all communication with my family members, as I do NOT owe or have any past due debts.

On XX/XX/2022 the debt collector - Capital Link Management on behalf of XXXX XXXX XXXX XXXX XXXX XXXX XXXX contacted both my parents ( XXXX & XXXX ) and XXXX of my siblings also - via text message disclosing a debt that I had that had been referred to collections. In the text- they disclosed the amount of the debt {$680.00} an offer for settlement of the debt {$230.00}. In addition- they disclosed that if the debt was not settled it would be be transferred to the Pre Legal Collections Team. The included the number XXXX. I also received the same text message and did subsequently settle with the debt collector. It is my understanding that it is illegal for the debt collector to contact my family and disclose the amount of the debt and the information that they did disclose to them. I have the text messages that were sent and can provide if requested. I would like this company fined and whatever restitution that I am owed be paid to me. This was something that should have never been disclosed to my parents and or siblings. I am XXXX y/o and not a minor. If you need the phone numbers that these texts were received- please let me know and I will provide to you.

XX/XX/2021 Dear Sir or Madam : On Monday, XX/XX/XXXX, I received a letter from XXXX XXXX XXXX XXXX a collection company - ( attached ) concerning a debt that I supposedly owe to XXXX Bank. There is a secondary collection company named Capital Link Management who is also named as a debt collector. Both of these collection companies have received numerous complaints against them for various violations of the Fair Debt Collections Practices Act. I have tried calling the number on the letter to find out what this is about but no one picked up the phone. I was only able to leave a message. However, today is Friday, XX/XX/XXXX, and I still have not received a phone call back. This concerns me because I have never heard of any of these companies before. Not XXXX Bank nor Capital Link Management noXXXX XXXX XXXX XXXX XXXX And as such, I have never had any dealings with them let alone owe them the money they claim I owe them I am contacting you to let you know that all of these companies are obviously conducting fraudulent actions against me and I ask that you take a hand in the matter. Today, XX/XX/2020 - XXXX XXXX from Capital Link Management, on behalf of XXXX XXXX, called my step-mother and my mother first before calling me and threatened me. I'm a realtor. My phone number is everywhere. There's no reason whatsoever that she called my family in the first place. But the to add salt to the wound, she told them that there is a Civil Suit, that XXXX is threatening to file to petition for a lien against me. I have no problem talking to someone about paying my debt, but that's a personal matter that I would rather not have anyone else know about. This caused so much grief and strain. Also, I've received zero correspondence about the matter. Nothing written or otherwise. XXXX asked for my email to email me, but I haven't received anything there either. I pulled my credit report and there is no evidence that XXXX has my debt to begin with. How do I know this isn't a scam? I asked XXXX what it is that XXXX wants and she said they'd be willing to drop 80 % of the debt. When I asked her for a dollar amount, she told me they'd settle for {$6700.00} of the {$8400.00}. She had it screwed up.

Someone called me from a company called " Capital Link '' stating that they were attempting to collect a debt from a PayDay Loan ( that is from over 10 years ago ) and that I already paid off. The person on the phone stated that they had my social security number. She then asked if I could elaborate more to which I responded I don't need to elaborate anything with you. I have full access to my credit reports from all 3 bureaus. I have nothing in collections and excellent credit scores. The fact that they called to " collect '' a debt which I'm either way past the statue of limitations on here in CA or I have already paid sounds extremely fraudulent and misleading. They also sent me unauthorized text messages from the same company of which I never opted in to receive texts from as well as contacted my mother 's home line and spoke to her in a threatening manner.

I first received a call from another number associated with " capital link management '' on XX/XX/2021 it was XXXX XXXX XXXX. No message was left and i only found out who it supposedly belonged to via an intensive internet search. A compliant was filed with the XXXX regarding this and this company agreed to only contact me via mail as i requested on XX/XX/2021. However, this same company called at XXXX using a different number XXXX XXXX XXXX. This time an actual message was left with no identifying information as to who they were nor that they were collecting a debt. However, they did give an ultimatum that if i didnt call back by close of business that day, i would be marked as non compliant. Not only was this second call a direct violation of the agreement with the XXXX. The tactic is in direct violation of many fdcpa laws.

Verified phone number on website. They have also been calling me and leaving voicemails stating This message is in regards to a legally required notice we need to speak with you immediately to confirm location information please press one to speak with a representative. They are asking for my location and this concerns me. I have attached a photo of the text message which doesnt state they are a debt collector and the voicemail they continuously leave me when they call.

This company identifies as XXXX. They send me text msgs and calls every day asking me to call a XXXX XXXX or XXXX XXXX back at XXXX. They get me on the phone and start aggressively trying to make me share my information. Very aggressive and subjective language. Very harsh and insulting and sarcastic verbiage. I told them that my legal representation would be in contact and the response was, " Oh, sounds like you're really smart. How do you have a lawyer when you couldn't pay your bill? '' They also threatened to call my family members about a debt, which from my understanding is against the law. They mentioned my family members by name and said they would reach out to them. Also, tried to get me to confirm my employment, saying that they would be calling them upon getting off the phone with me.

Capital Link Management is not only sending unauthorized wrong-party phone and text debt collection messages to my personal cell phone, but they have revealed, in detail, the debt of a party completely unrelated to me in violation of the FDCPA. That detail includes, without verification of my identity or cell phone authorization, the wrong-party name of the debtor a detailed amount owed. Their ( now redacted ) unlawful message reads " Hello, XXXX XXXX, our office Capital Link Management, has been granted the ability to provide an equitable settlement or payment plan on Balance Credit, account. XXXX $ XXXX,. Option 1. pay one time $ XXXX, or $ XXXX, over a year period. Please Call XXXX at XXXX. Thank you. If you wish to no longer receive text messages, please reply STOP. ''

I recently had the opportunity to pay off old debt from over 5 years ago ( they were not one of the creditors ) and then I was told that they called me to set up a payment plan but I don't remember doing that yet they keep trying to run the payment through. I'm not sure how they got my debit card number unless they got it from the original creditor. I tried to reason with them but the only response I got was that if I didn't set up a payment plan, they were going to sue me and I should expect a service processor soon. No one gets a heads up of being served. I'm from a family of attorneys. I know how these things work. I have tried to reason with these people but there is no reasoning. They are dangerously close to getting sued for harassment. It needs to stop. Thank you

Called from XXXX company called Capital Link Management in NY. Called my business line and left a very threatening message that they needed to talk to my attorney today, blah, blah. Very rude tone of voice and trying to " strong arm '' someone. I called back and it was for a debt for a person not at this number. Then they thought they were cute and started asking if I knew this person, etc. I don't want them calling my number again. This is a business and I don't have time to waste talking to bottom feeder bill collectors. These people have been calling and texting for over a year. Early morning mostly. Every single day.
