XXXX XXXX reported me fraudulently to the credit bureaus in XX/XX/XXXX for an amount of {$450.00} that I never owed. I have emailed to the company the cancellation and no further charges to my debit card that was sent to me as confirmation on XX/XX/XXXX. Below is a copy and pasted email of the original confirmation of no further charges that was forwarded to XXXX XXXX management to resolve this matter. In XX/XX/XXXX, I received a CPAP machine for XXXX XXXX from XXXX XXXX XXXX XXXX in XXXX XXXX. I was XXXX. They told me my insurance would pay for the machine for a year and then I would own it. They did not tell me they don't take XXXX. They knew I was going to XXXX XXXX for several months for ecclesiastical classes.They knew my XXXX birthday was in two months. After my XXXX birthday in XXXX, and knowing I was then in XXXX XXXX, XXXX XXXX informed me that they don't take XXXX. They demanded the machine back or payment in full. I said I would return it when I returned to my home in XXXX but was required by my church to stay in XXXX XXXX until my classes were done. XXXX XXXX is a life threatening condition so I could not return the machine without being able to replace it ( and finding an XXXX and then replacing it temporarily in XXXX XXXX would have been very difficult and would have taken me away from my classes. ) When I returned to XXXX, I attempted to return the machine to XXXX XXXX but they had already sold the debt to Capital Credit in XXXX Oregon. I received no letters from Capital Credit. In early XXXX, a Capital Credit representative called me. I explained the situation. She said she would note this for my file and would contact XXXX XXXX. I told her I still had the machine, it was in good condition and I could return it. ( I had obtained a new XXXX machine from a supplier In XXXX that does take XXXX. ) After this phone call, I received nothing from Capital Credit ; no letters or phone calls. In late XXXX, I found a collection report from Capital Credit at XXXX and XXXX. I disputed it.. In XX/XX/XXXX, Capital Credit sent me a letter saying they were enclosing the documentation I had requested and the amount had increased by {$790.00} to {$2000.00}. I had not requested documentation, I had disputed the debt. I called Capital Credit several times and left messages but no one ever called me back. And they sent no further collection letters or calls since that one in XXXX and it is now XX/XX/XXXX. I still have the machine. It is in good condition and could be returned to XXXX XXXX. I am a minister in my church and I have no other credit collection reports at the credit agencies.

This was a debt that I did not owe that was incurred by my ex-wife six years ago. Although I was not obligated to pay the debt by the terms of the separation agreement, and did not agree to incurring the services and the cost thereof as the separation agreement required me to pay for healthcare premiums and XXXX XXXX to simply absorb any copays, I paid this amount so as to facilitate my children 's well-being and conclude a divorce. I paid this {$60.00} charge in XXXX XXXX even though it is an account that belongs to XXXX XXXX and even though she sent the bills to me months after they were due -- thereby causing them to be late through her negligence. Nonetheless, I paid them, successfully contested the negative marks on my credit reports, and believe the matter concluded. I heard nothing more about it, and it did not appear on my credit report, until six years later, in late XXXX XXXX, out of the blue. It is paid and closed and was only late for 30 days because XXXX XXXX did not inform me of a co-pay that was due. I spoke to XXXX at the collection company, Capital Credit and Collection, today, and advised her of the above facts. She indicated that Capital Credit and Collection had not taken any actions that should have resulted in reporting this paid and closed account as a negative account on my XXXX credit report. XXXX at Capital Credit and Collection advised me to dispute the account to XXXX and to the CFPB and that when XXXX and the CFPB contacted Capital Credit and Collection XXXX or XXXX of her colleagues would instruct XXXX and CFPB to remove the negative account from my credit report. I hope that indeed Capital Credit and Collection does as promised and removes this negative account from my XXXX report as well as the other XXXX XXXX and XXXX reports if it shows up there. If not, I will be obligated to commence litigation against Capital Credit and Collection. In other words, Capital Credit and Collection does not want this item on my credit report and did not report it to XXXX, and yet it is on my XXXX Credit report. It needs to be removed immediately as it is interfering with my credit score and my ability to purchase a house for my family, including foster children.

Hello, I called on XX/XX/2019 to resolve a debt & find a solution, the call ended at XXXX XXXX. I tried to explain I wanted to pay them back. XXXX, the supposed " supervisor '' kept lecturing me that I made an agreement & that I let this happen. Advised me they couldn't do anything unless I paid a lump sum of the loan, that then she could offer a discount. That's not so much my problem, but I continued to tell her that " where would I even find that money '', she responded that she didn't know me that it clearly wasn't her problem, how this was the only way to get a discount. At that point, I became frustrated because she continued to belittle me & it felt as she was laughing at the situation. I let her know she was coming off rude and that it was very unprofessional, counterproductive too. That I wanted to find a solution and that this conversation had turned into a lecture of thing I already know. I already know it was my responsibility to adhere to the bank agreement. I would have preferred to find some sort of payment plan, which I asked her if I made payments and then got my balance down if I could eventually find some sort of discount for the debt I have. She ignored that questions. Then argued with me about her being rude and unprofessional. Continuously interrupting me to the point I felt very disrespected. When I requested to speak to the manager, she said there was no one else and that I could talk to the owner. But, refused to transfer me & also refused to give me anything other than her first name. Told me she was the one in charged & then hung up on me. Following that I attempted to recall & another employee again told me they heard her talking to me and said that she didn't do or act rude to me. He also laughed, then transferred me to the supposed owners voicemail saying he wouldn't be in until the afternoon. The voicemail had no features of identification, so I'm still not sure if they even did that. Hands down the most rude and violated feeling.

They attempted to charge {$17.00} interest on the debt ... which is illegal, according to Oregon State, as well as Federal law. According to Federal Law : https : //www.ftc.gov/system/files/documents/plain-language/fair-debt-collection-practices-act.pdf 15 USC 1692f 808. Unfair practices A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limit- ing the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obli- gation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. According to Oregon State Law : XXXX XXXX XXXX : A debt collector engages in an unlawful collection practice if the debt collector, while collecting or attempting to collect a debt, does any of the following : ... ( n ) Collects or attempts to collect interest or other charges or fees that exceed the actual debt unless the agreement, contract or instrument that creates the debt expressly authorizes, or a law expressly allows, the interest or other charges or fees. I spoke with the company, who was easily willing to drop the interest, but insisted that it was legal for them to do. I paid the {$60.00}, but they should not be lying to people, telling them that they can legally apply interest charges on a debt, when they clearly can not. At the very least, this company should be reprimanded for these unjust and deceptive practices.

My health plan apparently made an error in how much the pharmacy received for a filled prescription. XX/XX/2022 - I called again to ask more information. I asked for their CA debt collector license number, and then they immediately put me on hold indefinitely. They then simply would not answer any call from my caller ID. Relevant facts : - There was never any debt contract or instrument signed. As such, no interest or fees have been expressly defined. The addition of interest by the company violates both the FDCPA and the CA XXXX FDCPA. - From my understanding, laws and regulations require health plans to retrieve any overpayments directly from providers, not from a consumer who never received any cash payment. Therefore, this debt is invalid. - This agency does not have an active debt collector license in either Oregon ( their home state ) or California ( my residence state in which they are attempting to collect ). Further, the agency also added interest to an alleged debt without any written contract, and therefore adding interest is in violation of the FDCPA. The company in question is XXXX XXXX of XXXX, OR. They hired Capital Credit & Collection of XXXX XXXX XXXX XXXX XXXX, XXXX, OR XXXX with a phone number of ( XXXX ) XXXX as collector on my account. This company ( XXXX XXXX ) purported to provide XXXX page 1 ranking for my company, XXXX XXXX XXXX XXXX XXXX XXXX XXXX. I contracted to pay them $ XXXX/month for this service. I never received any ranking results nor communication from them after I started paying them. After approximately 9 months of them taking out $ XXXX/month I asked them to stop all charges ( by telephone ). They said I was under a contractual obligation to continue. I told them I was getting no results and was very unhappy with the service. They refused to stop charging me or cancel my subscription. I continued to pay until my card expired, at which point they could no longer charge me. They said I still owed them. I argued they provided no tangible results nor proof they were doing anything for me. The final amount owed was {$75.00}. I ended up just paying the {$75.00} in XXXX of 2017 to close the account. However, my personal credit was negatively affected as a result of the collection effort they took upon me. It should never have attached to me personally as an individual as this was a company account. I believe they are continuing this practice with other unsuspecting people/companies. I also believe they do nothing to help increase ones ranking on XXXX as no reports were ever provided. This kind of practice needs to be stopped. On XX/XX/18 2 payments of {$25.00} and {$50.00} were taken out of my bank account from capital. I cancelled those payments KNOWING i would NOT have funds available at that time. I scheduled a payment for XX/XX/18 KNOWING funds that day would be available. Capital has made me overdraft in my checking account not once but twice since 2 payments were to be taken out. Once those payments were cancelled I assumed that they were cancelled and set up for the correct date to be taken out. So, I look at my statement for capital and they are charging me for the return of the {$25.00} and the {$50.00} then also a late fee of {$25.00} Which they did reverse that. But because my payments were returned of {$75.00} combined. That their is nothing they can do. Because they were returned payment. So the payments that were returned I got hit with them. I spoke to a man name XXXX ( XXXX employee number ) and he kept speaking over me numerous of times. He stated those payments were returned your bank set us a memo stating funds were not available as of XX/XX/18 and for me to call my bank. Which I proceeded to contact my bank and stated to them what was said from Capital. And when I spoke with my bank she stated funds were available as of XX/XX/18. And will give me print out with day and time my funds were available. So today XX/XX/18 I contact XXXX and he again proceeded to talk over me. And explained that I want to speak to his boss and he stated NO that the boss is administrative and he speaks on their behalf.

A collection agency sent a bill to my house, but the bill had the wrong name ( Not mine ) for something I never purchased. I call the company and told them they had the wrong name. Sort of similar, but not really, to my name. They said they would just change the false name to my name, and I should pay! I have not done business with the company and owe nothing. I sent this info to you by letter, perhaps about 2 months ago.I received a letter from you with a case number. The letter was no help. I called your phone number, and got someone who said I did not have my e-mail or phone number on my letter, so nothing would be done. I don't remember seeing where those two were asked for. Anyway, the person I was talking with said to send that information back to you folks, which I did with my case number. Then I got a letter from you which looked as it was telling me how to file a complaint which I already have done. I am having an ongoing issue with a collection agency attempting to collect on a debt which has been disputed to no end by myself and which they have refused to investigate as outlined by the FCRA and with specificity to the Fair Debt Collection Practices Act. The company of which I speak is : Capital Credit & Collection. On numerous occasions I have disputed with them and requested documentation in hard copy, I have requested information that does not consist of them sending me a bill. They refuse to provide anything other than their bills and their letters threatening and seeking to force payment. I am asking this agency 's assistance in this matter. The matter needs to be investigated in a timely fashion as I have asked them numerous times, and if it can not be verified, which I believe they can not do since they have always avoided to assist me, then I ask it be removed from XXXX, XXXX and XXXX and anywhere else it is being illegally reported.

I had student tuition fees that had been unpaid and I got taken to court for them on XX/XX/XXXX, by XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX. We negotiated the amount down to {$1400.00} being owed by me and that I would pay {$150.00} on the XX/XX/XXXX of each month for 12 months to XXXX. I called the office and set up automatic payments, Ive paid two payments of XXXX so far. I received a letter on XX/XX/XXXX from XXXX saying I was being contacted for debt collection for {$3900.00} being owed to XXXX XXXX XXXX ( the original debt amount before negotiated and settled in court ) and to call XXXX at XXXX. I do not understand why I am being contacted for a debt that has already been settled in court and Ive also made payments toward. I have the case number and documentation stating these things.

I was applying for a mortgage on my home and the lender told me there was a collection on my credit from Capital Credit and Collectionis Services. I had no idea and had never been contacted by them.regarding the alleged debt. They had filed a lawsuit without notifying me and I happened to find it because of my lender pulling my credit report. I was unable to get that loan. I answered their lawsuit complaint and I countersued them in federal court, they have not responed to my answer at all. The fact that they violated FDCPA. Forged my Signature on the paperwork they claim I signed and never contacted me regarding the debt is enough but they also reported it to all three credit bureaus and I would like it removed. I have tried reporting it with the 3 burueus but they have not removed them.

I have a debt in collections with Capital Credit. The original debt was filed under the XXXX XXXX XXXX. It is for an unpaid fulfillment of a prescription, which was ordered after my insurance plan expired. The original debt is for {$5300.00} ; but Capital Credit is trying to charge me {$6100.00}. I assume the difference in price is because of interest/fees, but as I understand it, the creditor has no right to charge me interest or fees unless there was a contract with the original business to which I owe the debt, which permits the charging of interest or fees. In this case, there wasn't. The prescription was ordered after my insurance policy had lapsed, and therefore if there were any language in the policy that permitted the accrual of interest or fees, it does not apply.

The auto loan was charged off in XX/XX/XXXX. They then sold the debt to a collection company and that company is still reporting the balance as a 30 day term account instead of a collection account. Due to them reporting the account that way the account will never be removed from credit report. I disputed and got no where. I then contacted the company directly and was told if I settled the debt with them that they would remove from my credit report. This will have been reported on my credit report for 7 years since last activity on XX/XX/XXXX which, if I am not mistaken, means it should be removed under the FCRA. I find this very disturbing and unsettling. The name of the company is XXXX XXXX XXXX XXXX. The original debt was to XXXX XXXX XXXX XXXX.

My wife went to the same XXXX that I was using and had XXXX XXXX XXXX. They never fit right and XXXX XXXX nurse and my wife had words and could not resolve this issue. My wife refused to pay and they just reported it to credit bureaus. It was on her credit report and she disputed it and it was removed. It was then put on my report as collections {$3400.00}. My XXXX work was always paid by me or insurance. XXXX XXXX office was Sold to XXXX XXXX who refused to correct the issue afterwards.. the debt was transferred to my Account under my SS #. Filed a fraud report to police and after investigation they said it is a civil matter between us. XXXX XXXX has passed away and they still refuse to help. They said there done it was turned into collection!

This collection companies is violating the FCRA mandates Inaccurate Information-Errors include incorrect activity dates, account status, ammount owed, past due amount, date of last activity, etc Incomplete Information-Fields are left blank Unverifiable information-There is no contract with these people. Credit card customer service representative erroneously made an error about letting me know as to soft- pull instead of a hard-pull. The latter immediately cancelled my credit card and advised me not to worry because they will notify the reporting agencies their mistake. I called several occasions and notified the latter so far nothing has changed on my credit reports. They then tell me now, I have to call the credit bureau myself directly and whoever gave me false information.

I got an alert in 2017 that there was a collections on my credit report. Ive disputed this several times and have requested debt validation and all that they send me is an invoice from XXXX for {$96.00} with my name but an address which is incorrect. This isnt mine and the collection agency has failed to demonstrate that this specific debt belongs to me to collect on that debt.
